Staples Opens EBCA 2014 With Case Law Review

Staples heads the litigation group for Archer Norris, and resolves complex disputes and achieves numerous defense verdicts and cost-effective settlements. Bill presented his annual Case Law Review for the January 8, 2014 EBCA luncheon crowd.

The crowd was very welcoming and happy to see Bill Staples for his Annual Case Review Seminar. He said it is always fun for him because it makes him go through the case law and find the more practical cases that apply to the Insurance Industry.

He reviewed about sixteen cases and had a summary of each case in a hand out we all received. One interesting case was: "Brown v. Mid-Century Insurance Co (213) Cal. App. 4th 841. The insureds purchased a homeowner's policy that covered damage caused by a sudden discharge of water but excluded damage caused by a constant, slow or repeating release of water.

A hot water leak developed in a pipe under the insured's house and continued for at least a month. Mold grew on several walls. The court held that the leak was not sudden and there was no coverage. (bottom line is always read your policy).

Bill’s talk drew a large number of Claims professionals and was enjoyed by all.

Jo Ann Dean, past East Bay Claims and CCNC President won the 50/50 raffle drawing. The other 50 % will be donated to charity.

Mr. Carey will address Building Envelope Failures and Deficiencies.

Jay provides consulting services for contractors, developers and building owners with an emphasis on building envelope design, residential sheet metal flashing and waterproofing, foundation construction, plumbing and tile/stone installation. Jay has provided expert deposition, trial and arbitration testimony.

Jay is an approved MCLE instructor and continues to conduct seminars on construction related matters to attorneys, contractors and insurance representatives.

Mr. Carey obtained his California general contractor’s license in 1992. He holds two specialty contractor licenses (C-36 Plumbing and C-54 Ceramic and Mosaic Tile) and is a licensed Nevada general contractor. Mr. Carey is a graduate of the University of California at Davis. Mr. Carey entered the construction consulting arena in 2001. Prior to that, he owned and operated his own construction business working on new residential and light commercial projects.

The Market Conduct Division consists of the field claims bureau and a field rating and underwriting bureau. The bureaus are tasked with performing examinations of insurance company claims, underwriting, rating and marketing practices to ensure they are complying with all applicable law and regulations.

The California Department of Insurance, established in 1868, is the largest consumer protection agency in California, regulating the $123 billion insurance marketplace. In 2012 the California Department of Insurance received more than 160,000 calls from consumers and helped recover over $64 million in claims and premiums.
