Lee and Marty Dito at the April 12, 2017 luncheon meeting.

The duo plan to address insurance fraud and, specifically, the obligations insurance carriers have when fraudulent claims arise.

John P. Lee has been a Detective for four years with the Benicia Regional office of the California Department of Insurance (CDI). John is currently assigned to a multi-discipline group, working Auto, Workers’ Compensation, Healthcare and Property insurance fraud.

Mr. Lee spent two years on the Healthcare task force, investigating fraud committed by healthcare practitioners and providers.

He also worked on the Urban Auto Task Force, investigating auto fraud rings and body shops. Prior to working for CDI, John worked for over 25 years as a Special Agent with the Immigration Service (INS) and for the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) investigating a range of federal crimes.

John began his career as a police officer with the San Francisco Police Department.

Department of Insurance Detective Marty Dito has been with the California Dept. of Insurance for almost two years.

“I investigate mainly auto, workers’ comp and healthcare fraud,” Dito stated.

Prior to the Department of Insurance, Dito was a police officer, with more than 32 years on the force, for the San Francisco Police Department.

“I worked both in uniformed patrol and in fraud investigations,” he explained.

A native San Franciscan, Dito was born, grew up and went to school in San Francisco. He moved to Contra Costa County after getting married.

Ranahan Expresses Value of Effective Mediation at March EBCA

Noted Mediation expert, Michael Ranahan, Esq., with JAMS, was the featured guest Speaker for the March 8, 2017 EBCA Luncheon. Mr. Ranahan effectively utilized his more than twenty years experience as a Mediator to discuss the process, and how to make the most of potential settlements.

“We promote communication among the parties and to facilitate resolutions of the dispute,” he stated. “The Mediation process is to be considered settlement negotiations for the purpose of all state and federal rules protecting disclosures made during such process from later discovery and/or use in evidence.”

The participant's sole purpose in conducting or participating in mediation is to compromise, settle, or resolve their dispute, in whole or in part, he explained.

“I started in the industry 28 years ago as a carpet cleaner,” Allen states.

“After a year of carpet & Allen Brody upholstery cleaning we started to perform water damage mitigation. The next 5 years I spent in content restoration,” he explains.

“The company I worked for obtained a contractors license and we started estimating and performing smaller construction projects until a large historic hotel loss came across my desk. We secured the Million rebuild.

“Over the course of the next 20 years I become a Sr. Project Manager and then the last 4 years as a Director of a National disaster response and recovery company performing cat and large losses within the United States,” he adds.

Brody’s passion for his work is unquestioned. “Life didn't start until restoration came into it,” he states emphatically.

A native Detroit, Michigan, Allen is a veteran - Former US Army.

He is a graduate of The Pontiac Business Institute in Business and Accounting, and holds multiple industry certifications.

“Each project is it's own individual accomplishment. Helping others in a time of need is forefront to being in our industry. Whether it's a homeowner who has never been through the process of an insurance claim or an area wide event affecting a community the sense of restoring calm and exceeding expectations is it's own reward,” he shares.

Mr. Ranahan devoted a bit of time to touch on The California “Lemon Law”, legislation designed to protect consumers against potential new or used vehicles sold or leased in California that come with the manufacturer's warranty.

“If the Manufacturer or Dealer can't repair a serious warranty defect in

your vehicle after a ‘reasonable’ number of repair attempts,” he stated, “the manufacturer must either replace the vehicle, or refund it’s purchase price - whichever you prefer.” Best bet, he suggested, is to “undo” the deal and get down payment back.

The use of Mediation can be a powerful tool, often avoiding the need for litigation, yet typically non-binding - as opposed to “binding arbitration. Mr. Ranahan demonstrated a calm and even demeanor becoming of a good “neutral”.
