The East Bay Claims Association is a charitable and educational organization that is dedicated to the betterment of Insurance Claims Professionals, through: continuing education; industry knowledge and contacts; and a strong commitment to integrity and respect in networking. As the season changes, your East Bay Claims Association is gearing up for a strong finish to the year. Beginning with the return of our October 10th guest speaker, attorney Gregg Meath, followed by the popular EBCA Bowling Tournament November 14th, with the holiday luncheon party to cap off the year December 12th, there is much to look forward to. Gregg Meath spoke for us a year ago and brought some invaluable information on social media, and the levels to which it the public information found there may be used in claims investigations. We are looking forward to an update from him, and for anyone who missed him before, make sure you catch him this time! Plans are in place for the 3rd annual EBCA Bowling Tournament. This has become such a valued event for this organization. Everyone seems to love it. This is also our annual food drive for the Contra Costa/Solano Counties Food Bank. California Residents Forced To Evacuate Could Tap Insurance For Cost Reimbursement

Insurance may help evacuated residents even if homes are not damaged

BUTTE/LOS ANGELES/VENTURA, Calif. — Thousands of residents from Butte, Los Angeles, and Ventura counties ordered to evacuate due to wildfires may have homeowner or renter insurance coverage to help with evacuation and relocation costs, even if their homes are not damaged or destroyed, and in many cases no deductible is required. “With sometimes only minutes to evacuate, residents often escape with only the clothes on their backs,” said Insurance Commissioner Dave Jones. “Additional living expense coverage can help ease the financial burden of evacuation and is often the first step in helping residents begin the recovery process. I urge residents to reach out to their insurer and verify their coverage to get the help they need.” Many homeowners are unaware they may have insurance coverage under their homeowner and renter policies to help them with evacuation and recovery expenses under additional living expense coverage, known as ALE. ALE coverage typically includes food and housing costs, furniture rental, relocation and storage, and extra transportation expenses. The department is urging evacuees to contact their insurer to verify their ALE coverage provision, limits and learn about requirements to use the coverage.

It is critical to keep all receipts and document the date, time and names of any insurance company employees you speak to regarding your coverage and details of the conversation. Here are some tips for consumers: Policy provisions, including deductibles, vary by company, residents should check with their insurer or agent as soon as possible to confirm coverage, limits, and any other limitations and documentation requirements. Most renters’ policies also typically include ALE coverage. Consumer should make sure any insurance agent or public adjuster offering their services has a valid license by checking online with the Department of Insurance. Public adjusters cannot solicit business for seven calendar days after the disaster. Don’t forget copies of insurance policies, important papers and a photo or video inventory of your possessions. Keep all receipts accrued during the evacuation. An inventory can be completed quickly and easily on your smart phone and safely stored in the Cloud. more DOI page 8

As she began the start of her two-year term as president of the East Bay Claims Association this past January, Jennifer Pinney appointed, as part of her Board of Directors, EBCA member Eric Gacutan, with Alliance Environmental Group.

Eric tells us one of his favorite activities is bowling, and that he has been bowling since age seven or eight. “I loved going to the Bowling Alley with my parents, Aunts and Uncles and siblings growing up,” he explained. He was in a bowling league in college.

In their free time, Eric says he and Vanessa enjoy Six Flags, going to Festivals and just being with their boys.

Eric says he still loves to bowl, and he clearly does it very well. He said he also likes working out at the gym.

Greg Meath Returns with Latest on Cyber Law at October EBCA By Bryan Harrison

The East Bay Claims Association was pleased to welcome returning guest speaker, Gregg Meath, of the Law offices of Meath & Pereira at the October 10, 2018 luncheon meeting. He brought his in-depth perspective on the latest in Cyber Law to the group. Mr. Meath, who teaches colleges courses on the subject, stated that the industry is moving toward “full October guest speaker, Gregg Meath integration” by insurance company investigators, with regard to utilizing social media as a regular part of investigations. When he spoke for the EBCA last year, he cited statistics on frequency of Facebook Guest speaker, Gregg Meath, with EBCA VP, Amaya Fine posts, Instagram and other social media, illustrating the incredible resource available within public domain for claims investigations. “2.3 billion people have Social Media Accounts,” he stated. Don’t wait until it’s too late to get flood insurance SACRAMENTO, Calif. — Climate scientists warn that rising global temperatures are contributing to severe weather events-fires, hurricanes, droughts, and floods-which are causing or may cause loss of life, injuries, property damage, and economic disruptions. Many residents may not be aware that flood damage is not covered by traditional homeowners’ insurance. Now, more than ever, is the time for consumers to evaluate their risk and consider purchasing flood insurance to protect their assets. “Flood insurance may be all that stands between you and devastating financial losses,” said Commissioner Jones. “As we move into the rainy season, I urge homeowners to review their coverage needs and consider a flood insurance policy. Consumers need to know their risks and prepare before disaster strikes.” Flood insurance is available through the Federal Flood Insurance Program and must be in force for 30 days prior to a flood, so experts are suggesting consumers, including those in low-risk areas consider purchasing coverage well before storms hit. The Department of Insurance encourages consumers to review existing homeowner

coverage to make sure they understand what is and is not covered when rain storms cause damage other than flooding from rising water. The commissioner also advises consumers to prepare for potential disaster by using their smart phone to perform a home inventory to document their belongings and store it in your cloud along with scans of your deed, insurance policy and other important documents for access after a disaster. The department has a number of resources to help consumers with insurance coverage or claim questions. The department’s consumer hotline is available toll-free at 800-927-4357. licensing process. tigations, and how social media posts can sometimes illustrate a very different status of well-being for some claimants. He also pointed out limitations to the use of social media in the claims process. “Lawyers, law firms and investigators may not ‘friend’ or ‘follow’ a represented claimant or plaintiff to obtain otherwise private information,” he said. “If this is done pre-suit by a claims professional or investigator to obtain information, it could be pre-cluded during litigation if improperly obtained.” He strongly advised against that approach. Likewise, impersonating someone, or pretending to be someone other than oneself in the course of an investigation is prohibited by the insurance code, he said. People are apparently getting smarter about their privacy set-

tings, too, he said. He cited a recent case where a judge reprimanded the plaintiff for making her Facebook account “private” during litigation. Defense counsel actually sought sanctions for spoliation of evidence in that instance, albeit unsuccessfully, he added. Mr. Meath also offered-up some tips for properly locating relevant social media-based content. 1) Investigate straight away 2) Preserve available content take screenshots 3) Expand search beyond the claimant - friends, family & interest groups. 4) Don’t engage in deceitful tactics. He also suggested getting claimants to sign a social media release. The talk was very well received.

Bowling Tournament To Include Annual EBCA Food Drive Participants encouraged to bring food items to donate to the Food Bank of Contra Costa & Solano

FOOD BANK OF CONTRA COSTA AND SOLANO Leading the fight to end hunger, in partnership with our community and in service of our neighbors in need.

1 in 8 residents turn to the Food Bank. Food Bank of Contra Costa & Solano distributes food directly to low-income people at community sites and make food available for other nonprofit organizations serving the ill, needy and infants.

20 million pounds of food was distributed last year. More than half of that was fresh fruits and vegetables. The Food Bank has developed programs that provide food to meet the demand as well as support the nutritional needs of the people we serve.

1 in 4 emergency food recipients are children. Programs including Food for Children, Farm 2 Kids, and the School Pantry Program operate throughout the year to help alleviate childhood hunger. EBCA members and guests attending the November 14, 2018 EBCA Bowling Tournament are greatly encouraged to bring some food items (non-perishable preferred) to contribute to the overall EBCA FOOD Drive donation. We hope to have a bin there, or may need volunteers to assist in delivering good to the Food Bank. Let’s all do our part to help!

Here are some facts about the Food Bank of Contra Costa and Solano that we hope you will find useful and share in the community on our behalf.

FOOD BANK FACTS: • Approximately 182,000 people served each month. • 22 million pounds of food distributed; enough for more than 17 million meals. • Nearly 60% of the food distributed is fresh produce. • 96 cents of every dollar donated goes directly to food programs. • 1 in 4 people receiving emergency food are children. • 1 in 3 people served have to choose between paying for food and paying their rent or mortgage. • Every dollar donated provides the equivalent of two healthy meals.
