EBCA Mission Statement:

The East Bay Claims Association is a charitable and educational organization that is dedicated to the betterment of Insurance Claims Professionals, through: continuing education; industry knowledge and contacts; and a strong commitment to integrity and respect in networking. In order to accomplish this mission, the Association provides a forum and network for insurance claims professionals to meet and share information. This forum and fundraising events held by the group also help to connect insurance claims professionals in local communities and expands public awareness of the work performed by insurance claims professionals.

W

hile experience alone doesn’t necessarily make for a good leader, experienced leaders often bring a tried and true perspective that can be a huge operational benefit to an organization. EBCA Board Member, Liza Wisecarver, with Brightleaf Textile Restoration, having joined the board in 2018, not only brings a good level of experience in the claims industry to the board, but demonstrates a level-headed perspective and an openness to working with the team for the benefit of the association and its members. A Bay Area native, Liza was born in Fremont, California, and has remained in the Bay Area still. A mother of four children, ranging in age from 16 to 4 years old, Liza and her husband, Robert, make their home in Antioch. An only child herself, Liza went to Elementary school in Brentwood before attending and graduating from Carondelet High School in Concord. She then went to College at The Fashion Institute of Design and Merchandising, graduating with a degree in Merchandise/Marketing. Her career took her in the direction of healthy living and well-being. Liza went to work in the Fitness industry. Six years ago she entered the Claims Industry, working as a Marketing Representative

initially for FRSTeam, and then with Servpro of Antioch. Liza clearly takes her years of experience as a serious measure of her growth in the industry. “I have had six years to learn and develop my knowledge of this amazing Industry and, since I’ve been with Brightleaf, their business has more than doubled,” Liza said. Liza and Robert’s four children include their 16 year old daughter, sons 12 & 10, and the youngest is their 4 year old daughter. Her favorite pastime is spending time with her family. She and Robert make a practice of taking the family to Lake Tahoe once a month to go skiing, snow boarding and hiking together. Liza also enjoys running and working out. She shared that many times her 16 year old daughter runs with her. The East Bay Claims Association finds its ranks poised for the greatest level of success and growth this organization has experienced in some years due, in part, to the experience and strength of the current board. Liza Wisecarver will no doubt play a significant role in that continued success.

EBCA Holiday Luncheon Celebrates Charitable Beneficiaries By Bryan Harrison

The East Bay Claims Association honored three chosen charitable organizations with donations and recognition at the December 12, 2018 luncheon meeting. Long time friend to the organization, The Bay Area Crisis Nursery, was represented for the first time by Development Director, Catherine Dieterich. She explained that Sister Ann is on Administrative Leave at this time. Ms. Dieterich thanked the EBCA and acknowledged the long-standing relationship with the association. “We generally operate on a shoestring,” she said, in appreciation for the donation. “This year, it’s more like half a shoestring.” Allyson Schloming, Director of Development for Shelter, Inc., was likewise very gracious in her acceptance, explaining that Shelter Inc. works to provide temporary housing for up to six months, with a goal of establishing a permanent housing situation in that time. “We are averaging 3.8 months of temporary housing to meet that goal,” she stated. The third organization represented was Stand! For Families Free of Violence. Their representative thanked the East Bay Claims Association for their generous donation, as well. EBCA donated $1,000 each to these important community organizations. EBCA President, Jennifer Pinney, thanked them all for being there, and for all the difficult work they do. The festive atmosphere of the holiday event ensued, with raffle prizes, and appreciation for member involvement being expressed.

Wednesday, January 9, 2019, as we welcome Ms. Christine Reed, of Low, Ball & Lynch, as our presenter. Christine Balbo Reed joined Low, Ball & Lynch in 2003. She practices in the areas of employment, personal injury, premises liability, construction defect public entity defense and Marijuana Law and Litigation. Ms. Reed specializes in the representation of civil litigation defendants throughout Northern and Central California. She is admitted to practice in the State of California before the 9th Circuit Court of Appeals, and in the Northern, Central, and Eastern Districts of the Federal Courts. She will be presenting the annual California Department of Insurance recertification of the “Fair Claims Settlelment Practices” Act at the January 9th luncheon meeting. Christine handles all aspects of litigation, including arbitration, jury and court trials in state and federal court. Christine is a regular presenter at various claims association organizations, CIWA, PCEA, PARMA, Insurance Professionals of Monterey Bay, and organizes Low, Ball and Lynch’s annual Sacramento Seminar/Webinar conducted for all LBL clients nationwide. Her most recent speaking engagements have focused on Marijuana Law, An Emerging Insurance Risk and California Fair Claims Practices Regulations. She was born in Torrance, California and raised on the Monterey Peninsula. She was admitted to the bar in 1995 after graduating from the University of California, Berkeley in 1991 with a degree in Legal Studies and from Monterey College of Law in 1995, where she earned the David Sabih Scholarship Award. Ms. Reed is a member of the California Bar Association, Nothern California Association of Defense Counsel, Defense Research Institute, Monterey County Bar Association, Monterey County Women Lawyers Association and Insurance Professionals of the Monterey Peninsula. Christine is a fourth generation Monterey Peninsula resident currently living in Carmel with her husband and two children. She enjoys swimming, officiating swim meets for Pacific Swimming, yoga, skiing, hiking, cooking, her dogs and cat and traveling.

Supreme Court denies review of decision upholding Fair Claims Settlement Practices Regulations

LOS ANGELES, CALIF. — After a decade of legal wrangling over the regulations that implemented the Unfair Insurance Practices Act (UIPA), the California Supreme Court let stand the decision of California Court of Appeal, 4th Appellate District, upholding the Insurance Commissioner’s Fair Claims Settlement Practices Regulations, which prescribe how insurance companies must process insurance claims. The regulations are the foundation in determining the number of violations committed when assessing fines against insurers that have committed unfair claims practices. Department of Insurance examinations of PacifiCare’s claims-handling uncovered evidence of numerous unfair claims practices-which included wrongful denials for life-saving treatment for people battling serious illness and claim payment denials for providers and hospitals-all because the insurer was focused on maximizing profits through what it called “efficiencies” after the 2015 botched $9 billion acquisition of PacifiCare by UnitedHealthcare. The Department examinations also uncovered evidence the company was well aware of the egregious issues.

Under the Insurance Code, these unfair acts or practices include misrepresenting what medications or treatments an insurance policy covers, failing to promptly pay claims where liability is reasonably clear, and forcing claimants to file lawsuits to get full payment, and other acts. The Insurance Code allows the commissioner to impose fines of up to $5,000 each time an insurer

punish insurance companies for knowingly harming even one consumer.” Based on departmental examination results and following an administrative hearing that took three years, Insurance Commissioner Dave Jones found PacifiCare committed 908,547 separate violations of the UIPA, and he imposed fines aggregating $173,603,750 in penalties. On behalf of PacifiCare, UnitedHealthcare sued the commissioner, arguing that none of its harmful conduct violated the Insurance Code. PacifiCare argued that insurers are immune from fines for committing these unfair acts, even if the insurer did so intentionally, unless the commissioner is also able to show that the insurer knew it had committed the acts frequently enough to constitute a “general business practice.” The court of appeal rejected the argument, stating: “PacifiCare’s interpretation of section 790.03(h) is not only internally problematic, it stands in contrast to virtually every other

statute the Legislature has enacted in connection with: (1) enforcement of the Insurance Code against insurers generally; (2) enforcement of the UIPA in particular; and (3) the imposition of administrative penalties against insurers in other contexts.” The court also rejected PacifiCare’s argument that the commissioner must prove an insurer had “actual knowledge” of its illegal conduct and held that it was within the commissioner’s authority to hold the insurer responsible if its agents or employees were aware of facts that would cause a reasonable person to know of the violations. The court also found the commissioner’s reasoning was sensible in that restricting the definition of “knowingly” to one particular individual’s actual knowledge would fail to take into account that many people handle a claim, and an unfair practice can be committed by cumulative acts, not simply the intentional act of one person.” Further, the court of appeal also upheld the commissioner’s interpretation that an insurer’s “willful” violation of the act may be established by showing a purpose or willingness to commit the act, and agreed that penalties for willful violations do not need to require a showing that the insurer intended to violate the law or injure someone. The court held, “As the Commissioner points out, he engaged in an extensive, formal rulemaking process in the course of promulgating these regulations. That careful consideration, combined with the Commissioner’s expertise in the area, weighs in favor of according significant deference to the Commissioner’s interpretation of the terms, and we do so.”

Jones releases report on COIN program’s success in California; urges policymakers to reinstate tax credit SACRAMENTO, Calif. – Insurance Commissioner Dave Jones released a report January 3, 2019 detailing the successful progress of the California Organized Investment Network (COIN) during his administration. COIN is a program within the Department of Insurance that sources and structures investments for insurers that are financially sound and yield positive social and/or environmental impact in California. The report shows based on prior data call findings and COIN's tracking of insurers' investments, COIN investments are estimated to reach $29 billion by the end of 2018. These investments support renewable energy projects, affordable housing opportunities, health

ments during 2016 through 2018 underscore the importance of the Community Investment Survey (CIS) Data Call and monitoring insurer reinvestment into California. After the sunset of the CIS Data Call and COIN Community De-

velopment Financial Institutions (CDFI) Tax Credit in 2017 (despite efforts by Commissioner Jones through sponsorship of AB 2728 (Atkins) and AB 778 (Caballero)), information about the amount of capital insurers hold in California community development and green investments is no longer available to the public. "Insurer investments into California's underserved communities and environment remain crucial to the economic development of the State," said Insurance Commissioner Dave Jones. "I encourage policymakers to authorize the Department of Insurance to obtain annual reporting from insurers on their community and green investments in California and to reinstate the COIN CDFI Tax Credit."

Established in 1996, COIN is a collaborative effort between the California Department of Insurance, insurance industry, community affordable housing and economic development organizations, and community advocates to support investments benefitting California's environment and low-to-moderate (LMI) income and rural communities. Over the past 20 years, the COIN CDFI tax credit program provided tax credits to investors and helped CDFIs raise funds for projects creating social and environmental benefits to low-to-moderate income households or areas, as well as rural communities in California.

The East Bay Claims Association Board of Directors voted at their board meeting following the Holiday Luncheon Party December 12 2018 to forego an association golf tournament for 2019. EBCA Treasurer and Golf Tournament Chair, John Ehlert, presented the suggestion in his monthly report to the board, offering up that the idea of skipping the traditional annual tournament might be worth considering at this time. The association financials are in good shape at this time, he explained, and participation was down so much this past year that this looks like a good opportunity to try a year without the tournament.

Mr. Ehlert shared the current financial picture for the organization, which validated his suggestion. With the advent of the Bowling Tournament, Paint Nite, and other ideas, the motion to suspend the golf tournament was carried unanimously. “We strive to provide event sponsorship opportunities to our associate members and vendor partners that serve them as well as their sponsorships serve to sustain this association, and keep our charitable fund-raising efforts thriving,” said EBCA President, Jennifer Pinney. Vendors will be encouraged to continue to participate in all EBCA activities.
