McCurley Demystifies Business Loss Claims at February MVCA

Jim Mc Curley, CPA and Stephen Cole, CPA, from the Sacramento office of RGL Forensic Accounts, were the delightful guest Speakers for the Mid Valley Claims Association February Luncheon.

Their presentation on business loss claims was very interesting for the many business owners in attendance as well as the adjusters.

“The definition of Business Income is ‘net income’ (net profit or loss before income taxes) that would have been earned or incurred, and continuing normal operating expenses incurred, including payroll,” McCurley said. “We will pay for the actual loss of business Income you sustain due to the necessary suspension of your operations during the period of restoration.”

The suspension must be caused by direct physical loss of or damage to property at premises which are described in the declarations and for which a Business income Limit of Insurance is shown in the Declarations. continued on page 7

2015 CCNC Planning Under Way - "Hot August Claims!"

In the long-standing tradition of the CCNC, the 22nd annual event will focus on continuing education for P&C Insurance Claims Professionals.

"We are changing things up just a bit," stated 2015 CCNC President, Jack Corry.

"Our theme, 'Hot August Claims!' is a nod to what has become our own Northern California classic. We plan to dazzle a bit, while providing exceptional continuing eduction accredited tracks for Liability/Casualty and Property Claims professionals."

The main two-day event, Tuesday, August 11th and Wednesday, August 12th promises a wide array of activities both familiar and new.

It's never too early to get attendee registration set-up. Attendee Registration is open at this time.

It’s Recertification Time once again!

Please join the MVCA Friday, March 20, 2015, for our annual luncheon seminar with attorney Mark Berry, of the law firm of Mayall Hurley Knutsen Smith & Green, presenting the certification for all claims personnel of the California Department of Insurance “Fair Claims Settlement Practices Act” Regulations.

Mr. Berry has been gracious enough to offer up this presentation annually for the Mid-Valley Claims Association membership for more years now than anyone’s really sure of - at least eight or nine now, conservatively.

Mark E. Berry is a shareholder in the Stockton-based firm of Mayall, Hurley, Knutsen, Smith & Green. Born in Sacramento, California, June 25,1962, Mr. Berry graduated from California State University at Sacramento with his Bachelor of Arts degree in 1985, following graduation from the Northern California Police Academy in 1984.

He earned his Juris Doctorate from McGeorge School of Law, University of the Pacific in 1991, and was admitted to was admitted to the California State Bar that same year.

Mark was employed at the City of Berkeley Police Department from 1984 until 2001. He is a member of the San Joaquin County Bar Association, having served as President in 2001. He is also a current member of The State Bar of California. Mr. Berry has been named a Fellow by the Litigation Counsel of America.

There are Service, retail and manufacturing businesses.

Retail business suffer differently according to the time of the year.

Jim said " The Constant Dilemma is What should I ask for"?

How much info do I need?

How long is the restoration Period? Rule of thumb is if loss is days long, get weeks of data. Loss weeks long you need Months of data, Loss is months you need years of data.

You need to ask for a detailed preloss annual income statement.
