Recertification Completed at March MVCA

Following a delay due to severe weather conditions, the annual DOI Fair Claims Regulations recertification seminar went off without a hitch at the March 17, 2017 MVCA luncheon meeting.

Christine Reed, a partner in the Monterey office of Low Ball and Lynch was the returning presenter for this annual event. Ms. Reed gave an instructive seminar that earned attendees their annual required recertification of the regs.

Prompt attention and response to claims as they arise, and throughout the process, was the primary take-away element to effectively adhering to the mandated California Department of Insurance “Fair Claims Settlement Practices Act” regulations.

Ms Reed advised claims people to be sure to make insureds aware of

the timelines they may expect to be met and maintained. In the event claim processing fails to meet the mandated timeline, it is far better not to try to extend the time. “I’d rather you violate Fair Claims than extend statue of limitations,” which could potentially open greater risk.

Attendees received a very comprehensive thirty-page handout with all the information needed to adhere to the regulations. MidValley Claims Association’s own, Marv Wenograd, was commended for his fine on the fly presentation at the February meeting, when Ms. Reed was stuck in stormy rains, flooded roads, downed trees and accident-related traffic jams in Monterey. She spent two and a half hours just trying to get out of town before conceding she would have to reschedule. As things go, it all MVCA Board Member, Katie Howard, of Wingard Construction worked out nicely.

Material Science & Fire at April 21 MVCA Luncheon

Dr. James Mason, PhD, PE to address MVCA Dr. Mason has a Ph.D. in Solid Mechanics from the California Institute of Technology. Among his credits, he also holds a Master of Science in Materials Science and Engineering and a Bachelor of Science in Mechanical Engineering from UC Berkeley.

Fire cause and origin investigation frequently identify a product failure that initiated the blaze.

However, fire cause and origin investigators are often un-equipped to determine the cause of the product failure and a materials scientist is required to determine the cause of the failure that initiated the fire. Further, fire sprinkler system sometimes fail causing water damage in a manner that requires a materials scientist to determine. This seminar is about the role of the materials scientist in determining the cause of fires related to product failures or fire suppression system failures.

Dr. Mason is a Senior Engineer at ARCCA specializing in mechanical failures.

He performs analyses of failed consumer and industrial products/equipment and machinery design/failure, as well as metallurgical laboratory analyses. He also conducts engineering evaluations and provides analyses and opinions on the fracture and fatigue of metals, plastics and welds. Dr. Mason has experience with medical devices and routinely conducts investigations of failed consumer medical devices, including fracture/fatigue crack analyses of orthopedic implants, plastics, and the complex interaction of materials with the human body.

Dr. Mason is a Licensed Professional Engineer in five states and is an Accident Investigator accredited in Crash Data Retrieval and Commercial Vehicle Event Data Recorders. He performs motor vehicle accident reconstructions and conducts passenger and commercial vehicle inspections, as well as site investigations to gather photographic evidence and document conditions.

Dr. Mason has a Ph.D. in Solid Mechanics from the California Institute of Technology and both a Master of Science in Materials Science and Engineering and a Bachelor of Science in Mechanical Engineering from the University of California, Berkeley. He has also received a Professional Science Master’s Degree in Biology from the Illinois Institute of Technology.

BRODY NAMED NEW WINGARD CONSTRUCTION GM Wingard Construction announces the addition of long time industry pro, Allen Brody, as the firm’s new General Manager.

The next 5 years I spent in content restoration,” he explains.

“The company I worked for obtained a contractors license and we started estimating and performing smaller construction projects until a large historic hotel loss came across my desk. We secured the Million rebuild.
