Even as many of us have been super busy helping on claims, much of the world likely stopped and celebrated the holiday season. I do hope you were one of them. I want to thank everyone who came out to our SCA President Steve Moore, PE, CASp December Holiday luncheon meeting. It was great to see a strong turn-out in the midst of the busy holiday season, and the FireHouse Restaurant was a fun change of pace for us all. The Charitable Giving aspect of the SCA is something we can all take great pride in. Efforts are still being pursued by our Giving Committee Chair, Jim McCurley, on the best way to contribute funds to victims of the Butte County Camp Fire. We will keep you posted on that as we go. Final details for the annual SCA Winter Gala event are quickly coming together. The event will be held Saturday, January 26, 2019, back at Studio 817 in Downtown Sacramento. The phenomenal Jason Kettlehut and his Social committee, including Tami Umland, have been working diligently to ensure this will once again be a fantastic event! We are pleased to present longtime SCA Board Member, Jack Corry, with special recognition at this event, and look forward to a nice crowd to help us celebrate our “Wine & Dine” theme. The SCA annual Membership drive is currently in full swing! An aspect of the property restoration process that has grown in recent years includes portable moving/storage containers for contents inventory pack-out. A native of Afghanistan, originally, Eva fled with her family at the age of 4; at the outset of the Russian invasion of her country. “We managed to escape even as there was a fire fight happening on our rooftop,” she said. “We were really lucky.” She was raised in Frankfurt, Germany, where she lived with her parents and three siblings for 25 years. Eva said her family traveled extensively, spending Summers often in nearby Italy. She met her husband, Aaron Kurukhi while attending flight school in Toronto. “It’s a dream of mine to be a pilot,” she shared. Aaron lived in Virginia at the time. At Eva’s mother’s request, he flew to Germany to meet her family, and there asked her parents permission to propose marriage to Eva. “My family all loved him from the start,” she said. The whole family traveled back to Afghanistan for their wedding, along with her sister’s wedding 10 days later. Eva and Aaron were married July 7, 2007. “My sister had originally planned for 7/7/07, but when we decided on that date she moved her’s to 7/17/07. Everyone was able to stay for the ten days and two weddings,” she said. Now, a mother of three young boys of her own, Eva says she plans to one day adopt a young afghani girl to raise in a more western tradition. “Girls are just now starting to be able to do more in my home country,” she said. “But, I would really like to be able to bring a young girl here to know that she can live truly free.” Eva expressed that she still believes in the “American Dream”, and knows that, as an entrepreneur, she can build the life she wants for herself and her family. Just since starting her new business, Eva has already established relationships with some of the most well-established restoration firms in the area.

“Being flexible and responsive, as we are, has already helped us build business,” she said. “We were recently able to deliver a unit in French Camp, near Stockton, when no one else could, which helped our client get the job done promptly,” she stated, by example. Standard coverage is within a 50 mile radius around Sacramento, but Eva said “we will go where we are needed.” New on the scene, Eva is excited and anxious to become more involved with the Sacramento Claims Association, and the industry, generally. Special Lifetime Achievement Presentation for Jack Corry at January 26, 2019 SCA Winter Gala

Jack Corry, now former owner of Water Smoke & Mold Removal in Sacramento, will be recognized by the Sacramento Claims Association Board of Directors with a Lifetime Achievement Award at the annual SCA Winter Gala January 26, 2019. Jack Corry’s achievements in the property claims insurance restoration industry extend back many years. After a successful career in communications and consulting, Jack began his restoration life as a franchise owner before opening his own independent business, Water Smoke & Mold Removal in 2007. Jack founded and built his emergency property damage clean up company through service to the insurance and property management industries. His experience in communications helped him establish a network with claims associations, realty property managers and rental housing associations to build and maintain customer relationships.

As a member of the Sacramento Claims Association, Jack served on the board of directors from 2014-2018. He also represented the SCA on the Claims Conference of Northern California planning committee, where he served as President in 2015. In recognition of a tremendous career in the Claims industry, and as an honored long-time Board Member of the Sacramento Claims Association, and Past President of the Claims Conference of N. California, join the SCA in celebrating a Lifetime Achievement award for Mr. Jack Corry at the 2019 SCA Winter Gala event.

December 13, 2018 SCA Holiday Charitable Giving Luncheon gathering OLD SACRAMENTO, CA — The annual Sacramento Claims Association Charitable Giving Holiday Luncheon, held Thursday, December 13, 2018, was moved downtown to The Firehouse Restaurant in Old Sacramento. Always a special event, this year's celebration took things up a notch. A good sized crowd filled the low-ceiling basement banquet room with ample seating and a festive tone all about. SCA President Steve Moore welcomed everyone and made note the anyone interested in joining the current SCA Board of Directors would be encouraged to inquire with him. He then gave some accolades to Social Committee Chair, Jason Kettlehut, first for his work on the October SCA Top Golf Adventure, and secondly on the upcoming annual Winter Gala January 26, 2019. Jason spoke briefly about the big new year's party, and stated folks should be looking for info on the web site. (2019 SCA Winter Gala).

Long time SCA Treasurer, Jim McCurley, is also now the Charitable Giving Committee Chair. Jim gave good mention and praise for the work of the FireFighters' Burn Institute, to whom the association donated at the annual Golf Tournament this past May. He also mentioned some of the other charitable organizations the SCA has contributed to in recent times. He then put it to the group for input for thoughts, ideas and preferences as to worthy places to contribute. The organization has money to give, and he wanted to be sure the members had a say in the process. Results of that decision will be announced soon. The annual Food Drive generated 281 pounds of food for the Sacramento Food Bank, as well. A delicious lunch was enjoyed by all, with a good amount of time left for visiting, as well as various raffle prizes.

Supreme Court denies review of decision upholding Fair Claims Settlement Practices Regulations LOS ANGELES, CALIF. — After a decade of legal wrangling over the regulations that implemented the Unfair Insurance Practices Act (UIPA), the California Supreme Court let stand the decision of California Court of Appeal, 4th Appellate District, upholding the Insurance Commissioner’s Fair Claims Settlement Practices Regulations, which prescribe how insurance companies must process insurance claims. The regulations are the foundation in determining the number of violations committed when assessing fines against insurers that have committed unfair claims practices. Department of Insurance examina-

tions of PacifiCare’s claims-handling uncovered evidence of numerous unfair claims practices-which included wrongful denials for life-saving treatment for people battling serious illness and claim payment denials for providers and hospitals-all because the insurer was focused on maximizing profits through what it called “efficiencies” after the 2015 botched $9 billion acquisition of PacifiCare by UnitedHealthcare. The Department examinations also uncovered evidence the company was well aware of the egregious issues. Under the Insurance Code, these unfair acts or practices include

PacifiCare argued that insurers are immune from fines for committing these unfair acts, even if the insurer did so intentionally, unless the commissioner is also able to show that the insurer knew it had committed the acts frequently enough to constitute a “general business practice.” The court of appeal rejected the argument, stating: “PacifiCare’s interpretation of section 790.03(h) is not only internally problematic, it stands in contrast to virtually every other statute the Legislature has enacted in connection with: (1) enforcement of the Insurance Code against insurers generally; (2) enforcement of the UIPA in particular; and (3) the imposition of administrative penalties against insurers in other contexts.” The court also rejected PacifiCare’s argument that the commissioner must prove an insurer had “actual knowledge” of its illegal conduct and held that it was within the commismore DOI page 10

sioner’s authority to hold the insurer responsible if its agents or employees were aware of facts that would cause a reasonable person to know of the violations. The court also found the commissioner’s reasoning was sensible in that restricting the definition of “knowingly” to one particular individual’s actual knowledge would fail to take into account that many people handle a claim, and an unfair practice can be committed by cumulative acts, not simply the intentional act of one person.” Further, the court of appeal also upheld the commissioner’s interpretation that an insurer’s “willful” violation of the act may be established by showing a purpose or willingness to commit the act, and agreed that

penalties for willful violations do not need to require a showing that the insurer intended to violate the law or injure someone. The court held, “As the Commissioner points out, he engaged in an extensive, formal rulemaking process in the course of promulgating these regulations. That careful consideration, combined with the Commissioner’s expertise in the area, weighs in favor of according significant deference to the Commissioner’s interpretation of the terms, and we do so.”

Richard Lara pledges to confront climate-fueled wildfires, fight fraud, expand health care as next Insurance Commissioner

Retired U.S. Judge Vaughn Walker, author of marriage equality decision, administers oath to first statewide LGBTQ elected leader SACRAMENTO, Calif. — Ricardo Lara took office as California Insurance Commissioner at a ceremony in Sacramento on Monday, January 7, pledging to help Californians recover from wildfires while defeating the threat of climate change. Commissioner Lara is the eighth Insurance Commissioner of California since voters created the position in 1988. Commissioner Lara is the first openly LGBTQ+ person to be elected to statewide office in California. U.S. Judge Vaughn R. Walker administered the oath of office. Judge Walker wrote the decision in Perry v. Schwarzenegger in 2010, overturning Proposition 8 and allowing marriage equality in California.

“California’s Department of Insurance is the largest state consumer protection agency in America,” said Commissioner Lara. “We are the Department of Fair Deals, the Department of Fresh Starts, the Department of Rebuilding Your Home, the Department of Protecting your Investment, and the Department of the Sun Will Come Out Tomorrow. In short, we are the Department of Hope, and we have never been more important.” He pledged to protect the victims of wildfires and other disasters, defend all Californians from the threat of climate change and insurance scams, and promote innovation and technology.

We need bold action to ensure our communities adapt and are resilient to this new reality,” said Commissioner Lara. “There is no other industry that has the necessary expertise to ensure that California is prepared to mitigate and reduce risk to our communities and environment. Our planet can’t wait. I am ready, and I hope you are too.” Commissioner Lara took the oath of office on a facsimile of Califor-

nia’s first Constitution from 1849 in its original Spanish translation. For California’s first 30 years as a state, all laws were translated into Spanish, starting with the Constitution. As the son of two immigrant parents from Mexico, Commissioner Lara grew up in a bilingual house and has been a champion for multilingual learning. Commissioner Lara was first elected to the California State Legislature in 2010 and represented the 33rd Senate District from 2012 to 2018. As Senator, he won healthcare for more than 250,000 California children and introduced universal healthcare legislation. Commissioner Lara said he would work with the new administration of Governor Gavin Newsom to expand access to health care. “To Governor Newsom - I am excited to be your partner in expanding affordable healthcare for every Californian,” said Commissioner Lara. “There is nothing we cannot achieve with our new common agenda. We stand ready for your California4All vision.”
