A Stroll Down Memory Lane… Are the Good Days Behind Us?
I
t’s an honor and a privilege to be your new AAOC President. I want to give a big thanks to your Board of Directors for selecting me to serve in such a lofty position! I will be following in the large shoes of Nicholas Dunlap who was an outstanding President and is a leader in our industry. Thanks Nicholas for your service! I’ve had a long history with AAOC dating back to the early 1980’s and have seen our business change in many ways. Hence the subtitle: “Are the good days behind us”? Or are they ahead of us? I remember in the early to mid 80’s when investors we represented purchased a large property in Tustin for the unheard of price of $50,000 per unit. How much are your units worth today? I also remember the “experts” predicting

that upwards of 10,000 new units would have to be built to keep up with the expected population growth. However the population in the OC exploded during that period from approximately 2M people to currently just over 3M people—or 50%! I don’t know how many units were built during that time, but it’s safe to say the number is fewer than 10,000 annually and not enough to keep up with this growth. Rents as we know have also risen dramatically since those early days to the point that the idea of rent control in Orange County gets thrown around by legislators and media alike. Moreover, rent control has been an issue AAOC and others had to strongly oppose and probably will have to fight against in the future. So are the good days behind us or are they indeed

ahead of us? To be continued… 2017 is shaping up to be another exciting year; Steve Duringer will speak to a full house at the January Membership meeting while Rent Control is tentatively scheduled for the February meeting. We will be adding content to the Legacy program to educate and address concerns that second and third generations might have about entering this business. And of course there’s our Trade Show in March. And that only covers the first quarter! Craig has been in the rental housing industry since 1981. He currently lives in San Clemente with his wife and enjoys traveling around the world.

he New Year is upon us and, certainly this year, the operative word is “new.” There are new events and programs for Apartment Association of Orange County members. There is a new President of the United States. There are a plethora of new California laws affecting the way we run our businesses and our industry. There is a new C.E.O. of the National Apartment Association. There is a new President of the Board of Directors of

your Apartment Association of Orange County. There is a new “Super Majority” in the California State Legislature. As my good friend and former Apartment Association President Bill Gorman would say: “there is no good news or bad news, there is only news.” So, let us assess, adapt, modify and more forward into 2017 together. industry partners to renew industry education, business relationship building, and legislative advocacy. Members Sharon Quirk-Silva (AD 65) and Al Muratsuchi (AD 66) who recaptured their respective legislative seats after losing their first re-election effort in 2014. With the organizational process well underway, fitting new and returning legislators into important committee slots, the legislative leadership must now turn attention to perennial issues confronting the constituency: transportation grid-lock, housing shortages, aging water infrastructures, education funding shortfalls, et cetera, et cetera, et cetera. California’s needs seem to grow exponentially year and after year without end. There is no magic solution in sight now, but maybe something new may emerge among these freshly installed Senate and Assembly Members. The following comment pertains to clarification of an item of special interest and a reminder of a plumbing retrofit that needs to be done pursuant to prior legislation if not already accomplished. Bed Bugs. As noted last month, a new law operative on and after July 1, 2017, will require new leases and month-to-month rental agreements to include a specific notice regarding bed bug identification, behavior, and biology. All current tenants must receive the same disclosure notice by January 1, 2018. (Civil Code 1954.603.) The remaining sections in the new law are effective January 1, 2017, including a provision that prohibits an owner from showing, renting or leasing any vacant dwelling unit that the owner knows has
a current bed bug infestation (Civil Code 1954.604), and prohibits owners from retaliating against a tenant for reporting a suspected bed bug infestation. Plumbing Fixtures. On or before January 1, 2017, all noncompliant plumbing fixtures in any single-family residential real property built prior to 1994 must be replaced with waterconserving plumbing fixtures. For multifamily residential real property built prior to 1994, all noncompliant plumbing fixtures must be replaced with water-conserving plumbing fixtures on or before January 1, 2019. Installation may be more difficult than expected. Replacing a faucet may involve replacing water supply lines and angle stops. Replacing a toilet may include replacing flooring because the toilet footprint may not match the old footprint. When purchasing a new faucet, ensure that the faucet matches the cover and openings in the sink. Water Conservation. The State Water Control Board has recently voiced concern over reports from local agencies throughout the state of customers slipping back into old usage patterns. Increased water usage in the face of another drought year suggests the need for tighter control beyond voluntary cutbacks. We could all be in a world of hurt if the trend continues unabated. Look for updates on this issue as at this writing the slushy wet snow continues to fall in the northern Sierra.

fair housing complaints to proceed where actions have a discriminatory result even if there was no intent to discriminate. The better process is to develop a screening process that identifies prospective residents who have been convicted of a serious crime against persons or property. Further, your inquiry should take into consideration factors that demonstrate a risk to resident safety and/or property. The guidelines suggest that a policy that fails to take into account the nature and severity of an individual’s conviction is unlikely to satisfy the new standard. Further, a policy that does not consider the amount of time that has passed since the criminal conduct occurred is unlikely to satisfy the standard.

Beginning July 1, 2017, all prospective tenants must receive certain notifications regarding bed bugs and how to control them. Your apartment association will have revised rental agreements, bed bug addendums and other notification documents revised by the time this article is published and will be available for your use. The booklet is titled “Residential Environmental Hazards: A Guide for Homeowners, Homebuyers, Landlords and Tenants” was created with your tax dollars by the state and provides scary information about radon gas, asbestos, lead based paint, formaldehyde, water and soil contamination. I’ve replaced the smoke detectors in one of my rentals three times in the last year. I know something’s up, what do I do?
It’s more important now than ever before that you establish and follow an operations and maintenance plan when managing and maintaining your rentals. Not only is it just good business sense to maintain your rentals properly, but also the law mandates your prompt response to complaints of serious habitability defects. It is critical to identify tenants who engage in damaging and destructive conduct. Although the code

specifically precludes a tenant from benefiting due to his inflicting damage to the apartment, often it is difficult to prove the tenant caused the habitability defect. A good practice to enact is to create a maintenance log of repairs to each unit. Many owners will require a tenant “sign off ” when the repair is completed, other owners photograph the repaired item upon completion as proof of completion. These practices will support your claim that the “selfdestructing” smoke alarm is being damaged by the tenant. Several pieces of legislation have been enacted to crack down on the small minority of landlords who fail to properly maintain their buildings. Depending upon the severity of the defect, and providing that it is not tenant caused, a landlord may be cited by one of several governing agencies and given a period of time, ten to thirty-five days to make the repairs. If the repair is not completed as required, there are provisions that would allow the governing agency to

make the repair, and add the fees and costs of correction as a lien against the property. Additionally, legislation eliminates the tax benefits to the owner during the period of non-compliance, and in extreme circumstances, precludes an offending owner from demanding or accepting rent. Now more than ever before, it is critical that you document your repairs and identify the residents who are engaged in sabotage or other destructive conduct. Just when I thought I was doing everything right, I think maybe I’m not. Here’s the short version. I’ve had my building on the market for a while, waiting for a buyer. I received an offer and we opened escrow a couple of weeks ago. The buyer is doing his due diligence and is going through the books records and all of that. A couple issues arose. First, the buyer is doing his inspections of the units and we gave all of the residents plenty of notice of when the buyer and his inspection people would visit
each unit. My manager served written notices to all, and provided well over the required twenty-four-hour notice, most got at least three days’ prior notice. Well, Mr. Thinks He Knows It All in one of the apartments just sent me a letter warning me that if anyone enters “his” apartment he will sue everyone. Says he used to go to law school; that he knows his rights, says I can’t go in. Needless to say, this was unexpected. I have the inspectors and appraisers and the buyer scheduled to visit at the same time. The buyer is very hands on, and says he must personally inspect each unit. If he doesn’t let me in, it may jeopardize the sale, what do I do?
Mr. Thinks He Knows It All is mistaken. California law provides that residents must allow access to and entry for appraisers and prospective purchasers, among others, upon service of at least twenty-four hours’ notice. His failure to allow access violates California law and is a breach of your rental agreement. Your resident needs a little “prompting.”
Prepare a Three-Day Notice to Perform Condition or Covenant directing him to comply with California law and the terms of your agreement by allowing access at the already noticed date and time. Additionally, provided his tenancy is a periodic tenancy, and your property is not subject to rent control, a notice of termination of tenancy can be a great motivator. Prepare a Notice of Termination, and instruct your manager to serve it at the same time as the Notice to Perform or Quit. Let the resident know that provided he allows access as scheduled, you will rescind the notice of termination. But if he doesn’t, he should start packing. Given the alternatives, compliance almost always occurs. In the unlikely event he continues in his refusal, you have several options. Typically escrow instructions will preclude your evicting a tenant without the buyer’s consent once escrow is opened, check your escrow instructions to see if this applies. Most buyers would have no problem

and will consent to his removal. The buyer and lender can be appeased by agreeing to a hold back in escrow of sufficient money to effect any needed repairs to the unit, and or to cover eviction costs. Escrow instructions can be amended to allow for reimbursement for repairs, and costs, or a return of the retained money to you. Federal Focus — continued from 14 Opportunity through Modernization Act that eliminated much of the bureaucracy around the inspections process. We were not as successful on the other two issues though our preferred legislation on those topics advanced a great way towards passage. The issues remain critical today so we are reprising our focus on ADA lawsuits and flood insurance at the 2017 Capitol Conference and Lobby Day. The effort on flood insurance has added importance this year as the National Flood Insurance Program (NFIP) will expire in September. Without the NFIP apartment owners and operators would have few, cost-prohibitive options for flood insurance. This program must be extended and improved. Added to the list of issues for the 2017 Capitol Conference is tax reform. Back when we all thought Hilary Clinton would be the next President of the United States, the odds of tax reform actually happening were low. There was simply too wide of a gulf between Secretary Clinton and the GOP. Those odds are now flipped on their head. Reform of the tax code was a hot topic during the campaign and Presidentelect Trump’s team has stated it is a “200-day” priority after the repeal and/ or replacement of the Affordable Care Act. Meanwhile, House Republicans have crafted a proposal they call a “blueprint” for tax reform which suggests some fairly radical changes to the
code, including areas impacting real estate. Their goals are generally the same or similar to those of the Presidentelect but it’s the details that matter. That will be the first level of negotiation. A critical decision the majority powers must make is what kind of bill they want to pass—the preferred Republican package or a negotiated bill that includes Democratic priorities. Recently, the concept of durability has come up a lot in this context. Specifically, according to advisors close the President-elect, Congress should take a bipartisan approach to tax reform (like was done in 1986) so that whatever bill is passed survives beyond the GOP majority. The obvious comparison is to the Affordable Care Act—a bill passed on party lines without a single GOP vote that now is almost certain to be repealed or significantly weakened. The President-elect wants a legacy which demands a bipartisan approach. No matter what route tax reform takes, the apartment industry will have to be involved. Anyone who was in the industry when the Tax Act of 1986 was passed will remember how significant —positive and negative—this legislation was for commercial real estate. This new round of reform is shaping up to be potentially as significant with a lot of specific implications for our industry. Literally everyone who develops, owns or manages apartments or who works for a company that does will be impacted by tax reform. As such, everyone needs to be involved. The table is being set
and it’s up to you if you want to be a guest or a main course. Your lives are very busy and it can be extremely challenging to cram one more task onto an already overflowing list. Slab leaks! They are the bane of my existence! Turns out the problem is the hot water recirculation line. I’m trying to decide if I should fix it again or just abandon the line and remove the circulation pump and be done with it. What harm can it do? Do I really need a hot water return line for my residential units? John
Dear John:
Unfortunately, dealing with slab leaks
is almost a “rite of passage” for property owners or managers. First, let us demystify what a return line really is. Simply, it is a dedicated hot water line which loops from the water heater to the furthest unit, and back to the cold water heater inlet. Its purpose is to maintain hot water at each tap by assistance from the circulation pump. The circulation pump constantly delivers hot water through the return line or loop. A slab leak is a water line break under the concrete floor of a building.

A water pipe under a concrete floor can leak for a long time before it is noticed or it can bubble up through cracks in the concrete depending on soil conditions. The most reported type of slab leak is on the hot water side of the plumbing and along the return line of the recirculating system. Maintenance — continued from 18 corrodes the pipe. We do not recommend canceling the return line and removing the pump. This will cause other unintended consequence such as a slow delivery of hot water to many of the units in the building. The lack of a pump will waste water while the residents wait for hot water to come out of the tap which in turn will make the water heater work harder. Not only will this annoy the
residents, it will cause the water heating bill to go up. As for repair of the return line, there are a number of solutions. If the return line has chronic leaks, it is best to run a new line outside the slab. The old return is canceled at the pump and the furthest plumbing fixture in the building and the new line installed and routed back to the water heater. Another solution after the pipe is repaired is to limit the incoming water pressure with a pressure regulator and
put a timer on the recirculation pump to operate only at peak demand times such as morning and evening. Installing a water softener system will also help keep both the hot water heater and water lines from corroding as quickly.

I am installing safety grab bars in all of my showers & bathtubs and I need some guidance on the installation procedure. What do I need to know to install these bars correctly? David
Dear David:
The use of handrails and safety bars help provide stability and extra support required by the elderly and people with limited mobility. Approved ADA grab bars are available in a wide variety of configurations, colors and finishes. The most common is the stainless steel or chrome finish. The grab-bars must be able to support a dead weight pull of 250 pounds. The preferred method is to bolt directly into the wall studs. This is not always practical, as the stud might not line up where they are needed. Grab-bars can be mounted vertically or at an angle to match wall stud spacing. If finding studs becomes a problem, alternate installation methods are available. If your walls are in good condition, you may use large toggle bolts or if you have access to the backside of the shower or bath walls, insert a backer plate or add a new stud for an anchor point. Safety grab bars can be located at any local hardware store. It is advisable that you check ADA requirements with local, state and federal agencies for regulations governing height, distance & angle of the bars.

common, removing a turkey, roast or other large item from the oven and placing it on the open door. The extra weight is enough to tip the stove forward. The solution is an “anti-tip bracket” installed behind the stove. An anti-tip bracket is “L” shaped and usually installed on the floor and against the wall (towards the back of the stove) for one of the rear legs to slide into. Replacement parts are available at any hardware or home center stores, however, if not installed, there is a good chance, it is still in the plastic bag tied to the back of the stove. Shut off the circuit breaker or gas line feeding the stove, carefully slide the stove away from the wall, ensure a bracket isn’t installed (the last time the stove was slid against the wall it may have simply missed the bracket) and if not installed, search around for the original

You are very lucky it was you and not one of your resident’s children that found out about the dangers of a tipping oven. First let us explain what a tipping oven is: Most stoves with an oven are free standing appliances. The stove is placed in the kitchen, gas or electrical lines are installed and it is ready for use, very simple. The issue arises when a resident is using the stove and they or a child opens the oven door and puts weight on the open door. This causes a cantilever effect which may pitch the whole stove forward causing the stove top pots or pans to fly off the stove and onto the person or child in front of the stove. Best case scenario is this causes a mess in the kitchen and worse case is a resident or child is badly burned or disfigured. It is not uncommon to hear about a small child wanting to see what Mommy is cooking by using the oven door as a stepping stool or even more
plastic bag. Hopefully, the instructions and template is still in the bag. Keep in mind installing an antitipping bracket is both a resident safety issue as well as an owner liability issue. This is a $10.00 part and a ten minute install that will keep both you and your resident out of hot water. Protect Yourself Against Liability Within Your Community

Americans with Disabilities Act both protect residents from discrimination due to a variety of factors. If a resident believes he or she was not treated fairly under one of these two laws, they could hold community management liable for their situation. Getting to know these laws well, and adhering to them exactly, is the best way to avoid liability in this area.
ne of the biggest concerns that many people have before investing in a community or becoming a property manager is liability. What if someone gets hurt or something happens on the property? How will that affect me and the community? Well, there are things that community management teams can do to protect themselves against liability. Liability — continued from 24 for a resident’s negligence, such as in the event of an avoidable accident, an indemnification clause put into the lease is a great way to avoid this type of liability. This clause will state in the signed lease that the community manager is in no way responsible for accidents resulting from the resident’s negligence. • Keep up with maintenance and safety checks — The easiest and most worthwhile way to avoid liability is to simply keep up with the community maintenance. Hazards like broken sidewalks and run down structures are ideal places for accidents to occur, and these can be avoided simply by keeping up with routine maintenance. Staying protected against liability is an important job that should be treated as such by both the community owner and community manager. This type of
protection will ensure that owners and managers will be covered in the event of any type of accident or situation, and that things will be handled fairly should any type of scenario occur. hile finding a suitable resident for your vacancies, you’ve probably come across applicants who are on a visa. Whether it’s a work or student visa, many of these applicants have no financial background in the United States, and this makes performing a credit check impossible. Everyone in the United States (regardless of whether they’re a citizen, a green card holder, or have a visa) is protected under the Fair

Housing Act, which specifically covers “discrimination because of race, color, national origin, religion, sex, disability, and the presence of children.” To avoid a potential discrimination lawsuit, you should prepare your leasing process to include practices that can vet your applicants, equally. might have a social security number, it’s important to note that not everyone does. Regardless, you should always accept SSNs from applicants (as you can run a credit report on a SSN). You will not always be able to run a credit report on a taxpayer identification number (TIN). Contemporary Information Corporation, the screening service provider we use, has the ability to process a credit report without the SSN, which is helpful when screening applicants with visas.

As with any applicant, you’ll need to see that the applicant has a steady source of income. Be aware that there are multiple ways to illegally create fraudulent paystubs online. A letter from their employer can easily be forged. Some ways which visa applicants can prove they’re reliable can be through copies of bank statements, tax returns and student grants.

Another way you can see if the applicant is reliable is to contact their previous landlords. Considering that your time zones might conflict, request the landlord’s email address instead of their phone number. While this should not be your only means of figuring
out whether or not an applicant is reliable, in combination of additional documents, contacting the previous landlord can help secure your final decision. While allowing alternative forms of documentation like passports, tax returns or bank returns when making a rental decision will significantly help applicants on visas, it’s vital that you receive backup documentation on all applicants. Understanding Property Values from Cash In on the Myths of Real Estate
A
ll too often owners gauge the current value of their property based upon the reports that they receive from their local real estate agents. They hear that a fourplex just down the street sold for $895,000 and
immediately assume that since they, too, own a fourplex that that must be the value of their property. In the final chapter of my book, Cash In on the Myths of Real Estate, I tackle one of the most critical compo-

nents of income property investing— establishing the value of a property. The very first myth in this chapter addresses the difference between price and value.
9-1 The market establishes property values. Popular Belief: In a free market economy, the price at which a property is sold establishes the value of that property. Bill’s Truth: The market sets the price, not the value. There are many ways to determine value. What someone pays for a property is not necessarily the best indicator of what that property is actually worth. For an investor, the underlying purpose of purchasing a property is to achieve a target rate of return. So, value needs to be analyzed not as to how the property will perform today, but what the cumulative return will be based upon the future profit to be taken at the time of sale and the income generated up until that point. This is what I define as intrinsic value. Caught up in the immediacy of today, investors often ignore the impact that changes in interest rates, cap rates, and market rents may have upon the value of their property when they are ready to sell. Determining intrinsic value requires an analysis of operating income/ expense projections and a projected sales price. Two key factors—interest rates and cap rates—will impact that future sales price, so consideration needs to be given to what those rates will be at the time of sale.
Be critical of other people’s evaluations. Yours should be better. Other factors that influence the intrinsic value that you set for a property might include owning a nearby property and thus gaining greater operational savings, a need for additional depreciation, or the timing of concluding the upleg of a 1031 exchange. Cash In: Determine the intrinsic value of a property to more accurately add a premium or discount to the listed sales price.
Ask yourself one simple question: Is this property at the price presented going to provide me with the return that I am seeking?

With the recent bump in interest rates, we are starting to see prices slip. For some investors, this might be considered as a window of opportunity, although I would advise caution given where we are in relationship to the current 18-Year Real Estate Cycle. Remember that when you are establishing what price to pay, you need to set a realistic date for selling the property. Almost everyone who knows me has heard me tell the story about putting a dollar in the bank and doubling that investment every day versus every other day. Extending the holding period on a property while waiting for prices to rebound, significantly reduces the return on your investment. So what about selling? If prices have started to drop, is it too late to put your property on the market? In the December 2016 issue of Apartment News Magazine, I talked about the impact that an increase in interest rates will have upon values. We have yet to know how quickly by how much interest rates may or may not rise. What we do know is that, although slightly reduced, there is still a premium to be taken upon selling in Orange County. My advice is to take a very hard look at each and every one of your properties. Run the numbers and determine how well each property is meeting its targeted rate of return. Be honest with yourself about the actual costs of holding onto each property. Do not anticipate that expenses are going to be less or that certain types of repairs/maintenance undertakings can be deferred forever. As I say in my book, every property in your portfolio has a job to do. Make sure that your properties are working for and not against you. About the Author: William R. Checking In BY NATIONAL APARTMENT ASSOCIATION
F
or years, the hotel and apartment management industries have been moving closer together, the line between the two often blurred as residents seek hotel-level customer service and amenities. Waterton recognized the trend—as well as the potential cost and time-savings associated with integration—and formally merged its two platforms in September. Goodbye, Ultima Hospitality and Waterton Associates; hello, Waterton. “In Chicago, we started our hospitality division in 2006 and utilized a similar value-add investment strategy to that of residential,” says David Schwartz, CEO of Waterton. “As we continued building that platform, we recognized that the hotel side had more employees than residential but was doing a lot of the same things-be it HR, construction, accounting or operations.” Once Waterton explored consolidation as a means to greater efficiency, the similarities between hospitality and residential became all the more apparent. So, too, did its buying power and areas of potential growth. “We’ve coined this overlap between residential and hospitality ‘Resitality,’” Schwartz says. “It’s the idea of recreating the comforts of home for our hotel guests, and giving our apartment residents all of the services and amenities they expect when staying at a resort or hotel.” With a $4 billion portfolio of approximately 20,000 apartment units and 13 hotels nationwide, Schwartz says Waterton now has an even clearer

sense of its brand. “Over the years, we realized that whether we were managing an apartment community or a hotel, our goal was the same: To deliver an exceptional level of service to our customers, regardless of whether we counted their stay in nights or years.”
Guest of Honor
With more than 2,000 employees— 500 of whom were on the residential side—Waterton began the integration process by addressing the more obvious components: Merging HR and payroll under one umbrella, and consolidating the construction teams under one leader. From there, other departments followed. Operationally, Waterton began implementing many of the same servicebased SOPs that its hotels follow. “All of our hotels are branded and have franchise agreements,” Schwartz says. “We have the unique perspective of being required to run them under stringent operating procedures. The hospitality industry is very well trained in service culture and we want to bring the best of that to multifamily.” Since the integration, Waterton’s apartment housing employees have made a concerted effort to focus on customer service practices more often seen in hospitality, such as mentioning every resident by name. Schwartz says Waterton is also encouraging its property managers to offer food and beverage options that are extremely common in extendedstay hotels-such as a coffee and snack

station in the lobby, a managers’ wine and cheese club for preferred residents or a smoothie bar for celebrations. Going forward, the company is exploring hiring an employee dedicated solely to food and beverage. “We’re very focused on surprising and delighting our residents with best practices that come straight out of Marriott and Hilton,” Schwartz says. Easier said than done, of course. “The multifamily industry can be very transactional,” says David Scharfenberg, Waterton’s Assistant Vice President of Operations. “We have credit checks, lease agreements, policies and standard operating procedures for every aspect of our business. They are all important, but Resitality challenges our teams to eliminate some of the busy work and do more.” Part of doing more means understanding more. “Hotel operators regularly solicit feedback from their customers and have a much higher customer service response rate,” says Barney Pullam, Vice President, Business Process, for Waterton. “We are looking at how we can further drive our response rates to better understand residents’ overall experience at our apartment communities.” As Waterton evaluates the emotional needs of its customers, it’s discovering the behaviors that are most important to meet those needs. Checking In — continued from 38 broken garbage disposal and also takes the initiative to replace an old faucet once they’re there; or a leasing agent walking a new resident to their destination instead of giving directions-much like hotel staff. “It’s the little extra effort that makes the resident say, ‘Wow, they really care about me,’” Scharfenberg says. “And when things go wrong, our associates have the autonomy and resources needed to correct the situation on the spot.”
Blurred Lines
Tucson, Lexington, Denver or Brooklyn—it really doesn’t matter. When you walk into an Aloft Hotel, you know it. The boutique brand owned by Starwood Hotels is modern, fresh and fun. There’s a unique energy there; a certain vibe. “Every hotel brand has a vibe dictated by its SOP,” Schwartz says. “From lighting levels, to music to scent, it’s basic stuff that hotels do every day.” Although Schwartz says it’s impossible to compare a Waterton apartment community to an Aloft Hotel that has the exact same lobby everywhere in the country, he says all of its high-rise apartment communities should have the same feel when you walk in them; the same with all of its garden-style properties. That means playing the same music in the common areas and using the same air-freshener scent in the lobbies. In other words, “A property manager can’t pick any old Glade stick.” “We want to take subsets of physical types of properties-such as high-rise and garden-style-and create more SOPs for standardization,” Schwartz says. “It allows for more quality control and a stronger, more identifiable brand. It’s very exciting and creating great efficiency. We should have done it a long time ago.” On the amenities side, Schwartz says many of Waterton’s properties are ahead of the game.

“When you look at newly renovated apartments, the rooftops, lobbies and fitness rooms all resemble great hotels—sometimes even nicer,” he says. “So much of the arms race in development is amenities, all of which are now rivaling hospitality.” Conversely, Schwartz says the hotel industry could benefit from many apartment industry interior design trends. Many apartments, for example, are replacing carpeting with hardwoodstyle vinyl tongue-and-groove floors. Some hotels are beginning to follow suit, using throw rugs over hardwood flooring to provide a more homey atmosphere for guests.
Modern Family
From “Step-by-Step” to “The Brady Bunch,” a blended family is not without its growing pains. The same can be said for a blended company. Prior to the integration, everyone working on the hotel side was an Ultima employee. “They had a lot of pride with that name and company, and now they’re Waterton,” Schwartz says. “That’s required a lot of communication. They’re part of a bigger pond, and that’s a good thing. They have more opportunity for growth. But we had to sell that.” Although most job titles have not changed, and some employees’ duties are still strictly hospitality or residential, Schwartz says many are now involved in both aspects of the company. “It’s still early in the process, but our employees want to play in both spaces and fill the holes on each sides,” he says. Of course, not everything lends itself to seamless integration. Schwartz says marketing is approached very differently on the hospitality side, a challenge Waterton is working to reconcile. “Hotels have national accounts with the likes of Coca-Cola, and multifamily is not as good at establishing those partnerships,” he says. “It’s not as straightforward and we’re trying to figure that out.”

Marketing also ties into leasing— a process still unique to rental housing. “A hotel purchase decision is a commitment for one night or a few days,” Scharfenberg says. “This decision is often based on online photos, reviews or word-of-mouth. With rental housing, the online experience and word-ofmouth are only part of the sales process. The majority of renters still want to tour the property before making a commitment. “When a prospect arrives at one of our communities, they start making their decision the moment they pull up to the front door. And when they come inside, it is critical that they are promptly greeted by a professional who welcomes them, listens to their needs and, most importantly, makes that connection—similar to the level of service provided to guests checking into a hotel.” And then there’s the issue of economic incentives under one platform; determining how to engage a resident in the hotel space. If a resident lives at a Waterton community, does that now give them preferred Starwood status? If Waterton were owned by Marriott, could that resident move around to Marriott hotels throughout the country? On the employee side, Waterton is exploring hotel discounts for its apartment community personnel, and if it’s feasible to offer its hotel employees rent concessions. Schwartz says this is new territory, but this is the future. Going forward, Waterton would like to see a STR-like benchmarking system in multifamily. Though not without its challenges, Schwartz says it’s a long time coming. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible.
