2018: As Good As it Gets?
2
017 was a very good year for rental property owners. Even with rising rental rates, rental housing remains the more affordable housing option in the marketplace and as a result, apartments continue to be the darling of the commercial real estate investment market. Add in the undersupply of rental housing stock and the very high cost of buying and owning a home and it’s no surprise that you likely experienced a year of high occupancy with increased rental rates, all while watching your property value continue to climb! But not all is well in Mudville. Rising rents have created a real and strong call for rent control by activists who believe that rent control is a “magic pill” solution for the housing crisis. Of course, this problem is decades in the making and it’s not only here in the OC where housing is very expensive. Since 2012, the OC median home price rose 66% while incomes rose just 3%. Nationwide, the increase in home prices was 43% and income growth was at 4%. It doesn’t take an economist to conclude that Orange County isn’t the only area to see big rent increases over that time period. So not only is rent control being promoted both statewide and locally, other issues are continuing to surface on the local front. Along with homelessness, which one city believes rent control might solve, the hot issue is parking. Let’s step back in time when your building was built. Let’s assume

that it’s a 10 unit building with other 10 unit buildings on the street and singlefamily residences in the immediate area. When your 10 units was built, code might have required 13 parking spaces. What would today’s code require? — likely 20+? Moreover, when your building was built there probably weren’t more than 1 or 2 cars per apartment. Now there are likely 3 or 4. So if you have 30 cars at your building and 13 spaces, you’ve got 17 cars being parked on the street. So do your neighbors. As a result, your residents are forced to park streets or block(s) away from their apartment and when homeowners complain, cities have to get involved. One such city is Stanton. Stanton had listened to AAOC legislative advocates about devising a system to relieve parking in these high density areas. The city hired a consultant to analyze the city’s parking situation to arrive at a solution that would comply with an Attorney General opinion obtained by AAOC back in 2016. At this time, the California Attorney General issued the formal opinion that local authorities may not institute preferential parking regulations that discriminate among residents based on the residents’ dwelling type. Stanton’s consultant determined that there was no version of a parking permit program that was consistent with the Attorney General’s opinion and provided permit relief in the impacted areas based on the lack of available parking. Dissolution of the permit parking program was recommended

with the preservation of existing permit parking areas which discriminates against apartments. AAOC continues to advocate for a more equitable parking solution in Stanton — one that doesn’t create hardship for apartment owners and residents. AAOC is also working with Anaheim for an equitable solution where the dialogue from the city appears to be more genuine. We hope to devise a good program with and for Anaheim that would be a model for other cities. AAOC continues to advocate for good policies and legislation as it relates to the rental housing industry. We ask for your continued support this year as it will be another battle and only through your support can we have another good year on the legislative front. Happy 2018! Bill 168, dealing with employment. We start with that correction by adding the following to the bills listed in Part One: AB 168 (Eggman) Prohibition on Seeking Salary Information. Prohibits all employers, including the Legislature, the state, and local governments, from seeking salary history information, including compensation and benefits, about an applicant for employment. The bill also requires an employer to provide the pay scale for a position to an applicant upon reasonable request. Owners are advised to edit their employment applications to exclude questions seeking prior employment salary information.
2018 Proposed Pending Legislation/ Propositions
SB 721 (Hill) Mandatory Inspections of Balconies and Decks. This 2-year bill proposes to require property owners of 3-units or more to hire a qualified inspector every six years to inspect 15% of all exterior wood supported or stabilized walking surfaces above six-feet from the ground, including decks, balconies, porches, stairways, walkways, entry structures, and their supports and railings. Because owners are already subject to rigorous inspection and maintenance standards, additional inspections are redundant and unnecessarily costly. Instead of requiring regular state-mandated inspections, the legislature should focus on strengthening inspections that are already in existence, and amending the building code

to ensure better materials are used. AB 1506 (Bloom) Statewide Rent Control. This 2-year bill will be voted on in 2018. In its current form, it repeals the Costa Hawkins Act. The Act, adopted in 1995, prevents cities and counties from adopting harsh rent control policies, which include: 1) Regulating initial rental rates and rates established after a change in tenancy; 2) Rent controls on housing constructed after 1995; and 3) Rent controls on single-family homes. The Costa Hawkins Act was adopted specifically to curb out-of-control and extreme rent control and vacancy decontrol policies that at the time were popping up all over the state. Repeal of the Act would devastate the rental housing industry, and force owners out of business. 2018 Ballot Initiative—Costa Hawkins Full Repeal: Tenant advocacy groups have filed a proposed ballot initiative to repeal the Costa Hawkins Act and expand rental control laws across the state. To qualify for the November 2018 ballot, the group sponsoring the initiative needs 365,880 valid signatures. Between this initiative and Bloom’s AB 1506, the Costa Hawkins Act is being attacked from all sides. Now is the time more than ever for property owners to get politically active.
Proposed State Regulations
The State’s housing agency, Department of Fair Employment and Housing (DFEH), through its Fair Employment and Housing Council (FEHC) is proposing three sets of new housing discrimination regulations (also referred to herein as “regs”) relating to assistance animals, criminal background checks, and national origin discrimination. As described in more detail below, the new regulations completely overhaul prior law, and impact residential rental property owners in significant ways. FEHC will begin working on another regulation relating to occupancy standards in 2018. Your lobbying team has been involved in DFEH’s regulatory process from the very beginning, attending and participating in all public meetings, and submitting nearly a dozen letters opposing various provisions of the new proposals. While many of our proposed amendments have been taken and written into the new regulations, many have not. The final product is a set of new, extensive, and in many ways burdensome regulations that will undoubtedly impact every residential rental property owner in the state. When the new regulations are set to go into effect, we will provide our members with a comprehensive guide to the new regulations and information about how to comply. Criminal Background Screening: In 2016, the U.S. Department of Housing and Urban Development (HUD) provided new housing guidelines prohibiting various forms of housing discrimination based on a tenant’s criminal history. Specifically, HUD’s new guidelines prohibit rental-housing decisions that have a “discriminatory effect” on protected classes unless there is a “business necessity” for the decision. Discriminatory effect (also called “disparate impact”) is a legal theory of discrimination that is based on whether a business decision disproportionately affects a whole class of people. Under the theory, tenancy decisions based on
criminal history may have a disproportionate effect on minorities because minorities are arrested and convicted at rates disproportionate to their share of the general population. By example, HUD states that exclusions of tenant applicants based on prior arrests alone will likely have a discriminatory effect on minorities and would not meet the business necessity rule because there is no business reason to exclude those with arrest records. Thus, owners may not exclude
tenants based on prior arrests alone. DFEH is finalizing its own set of criminal history discrimination regulations based largely on HUD’s guidelines and the discriminatory effect doctrine. Under the new regulations, use of criminal history information to make tenancy decision must be based on a business necessity, or substantial, legitimate, nondiscriminatory interest, like Smock/Kingston — continued on page 10

Smock/Kingston — continued from 9 safety. Additionally, rental property owners must consider feasible alternatives to excluding tenants with criminal histories. Owners will therefore likely be required to conduct an individualized assessment of all tenant applicants with a criminal history, and consider whether there are feasible alternatives to excluding tenants with criminal pasts. Individualized assessments include considering any mitigating information, any rehabilitation efforts by the applicant, the tenant’s tenancy record, the factual accuracy of the incident, the type of conviction, and how long ago the conviction occurred. Owners will likely also need to adopt application procedures that do not assess criminal history in the first round of interviews. The new regulation is comprehensive and extensive. We will provide our members with a comprehensive overview of the new regulations next year. Reasonable Accommodations/
Assistance Animals — Emotional Support Animals: DFEH has proposed new regulations requiring rental property owners to provide reasonable accommodation to disabled tenants for a host of new reasons, including for “assistance animals” like emotional support animals. Federal HUD guidelines already require owners to make reasonable accommodation for those with disabilities, including for assistance and emotional support animals. California’s version of the regulations expands on the federal guidelines. Under the new regulations, owners will have to make reasonable accommodation under a host of new circumstances. Requirements include, but are not limited to, allowing disabled tenants to pay later than the due date, allowing third-parties to co-sign a disabled tenants lease, and providing disabled tenants more time to move after a successful unlawful detainer. If there are disputes about whether an accommodation is required, owners

and tenants must meet to try to work out their differences. Regarding animals, owners will be required to allow owners to have emotional support animals. These animals are not limited to cats and dogs, and may include any type of animal allowed by ordinance, including insects, mammals, amphibians, and others. There is no limit to the number, type, size, or breed of the animal, as long as a medical professional prescribes the animal. Proof that a disability exists and need for the accommodation is required by the tenant if the disability accommodation need is not apparent. But tenants can provide proof through various means including a “reliable third party,” receipt of disability benefits, a medical professional, health care provider, a non-medical service agency or individual, and even from a peer support group. Owners may follow up with the sources of proof, but may not ask about specific medical information. Additionally, support animal certifica-

tion from an online service that does not include an individualized assessment from a medical professional is presumptively considered not to be information from a reliable third party under section 12178(f). An accommodation may be denied if, among other reasons, the accommodation would constitute a fundamental alternation of the services provided, or would impose an undue financial or administrative burden considering, in part, the finances of the owner, the benefits to the tenants, and the availability of alternative accommodations. An accommodation for an animal can also be denied if the animal would constitute a direct threat to the health and safety of others or would cause substantial property damage. Owners may establish reasonable rules to ensure the animal is under the control of the tenant and is not creating a nuisance for others. Tenants must also pay for damage caused by their animal. However, pet fees and deposits
are not allowed. There is a lot more to the new disability accommodation rules. We will provide our members a more detailed guideline of the rules in 2018 when the new rules are expected to go into effect. National Origin Employment Discrimination: DFEH’s proposed new national origin employment discrimination regulations greatly expand prior California rules on the subject. National origin as a protected class was originally meant only to protect against discrimination based on place of birth. It has evolved, however, to protect much more, including citizenship and immigration status, physical, culture, and linguistic characteristics, association with members of a national origin group including through marriage, membership in an organization, participation in schools, churches, temples, mosques, or other religious institutions, and a person’s name. The new regulations prohibit English-only restrictions, English proficiency tests, and discrimi-

nation against a person’s accent in the employment setting unless a business necessity exists. Other rules bar retaliation and harassment based on national origin. They also bar discovery of a litigant’s immigration status in civil cases. They even bar height and weight discrimination because those characteristics, it is argued, can be associated with a person’s culture and national origin. It should be noted that many of the new regulations are based largely on already existing federal rules promulgated by the Equal Employment Opportunity Commission (EEOC). Although the new regulations do not apply to landlord-tenant law, they likely will soon. For now, rental property owners will have to follow the new rules when they go into effect as they apply in the employment context. Smock/Kingston — continued from 11 tions which will do away with the current unofficial “2 plus 1” standard in favor of one that would be based on square footage and habitable rooms. The “2 plus 1” standard allows owners to limit the maximum number of persons that may reside in a unit to 2 persons per bedroom plus 1 additional person. Under the current standard, therefore, an owner could limit the maximum number of persons living in a 3-bedroom unit to 7 people. The proposed standard, however, would be based on square footage and habitable areas. Habitable spaces would include such areas as the foyer, kitchen nook, dining area, laundry room, living room, etc. Under the proposed standard, an owner of a 3-bedroom unit might have to accommodate up to 15 people! That’s dormitory living. The new standard will impact water and sewer services, create unhealthy, unsafe and unsanitary conditions, become a
nuisance to other neighbors, and possibly lead to damage and deterioration of the property.
New Laws Reminder
The following are laws that were previously signed into law, but did not go into effect until 2018. Bed Bug Disclosures (AB 551, Statutes of 2015) Starting July 1, 2017 rental property owners must provide to all new tenants written notice in 10-point font containing the following information: 1) educational information about bed bugs, 2) the procedure to report suspected infestations to the owner; and 3) a statement that the tenant shall cooperate with the inspection and facilitate the detection and treatment of bed bugs. The written notice must also be provided to existing tenants by January 1, 2018. The educational information must include the following: a) general information about bed bug identification; b) behavior and biology; c) importance of
cooperation for prevention and treatment; d) importance of and for prompt written reporting of suspected infestations to the landlord; and e) procedure to report suspected infestations to the owner. Water Sub Meters: New Construction/ Billing Requirements (SB 7, Statutes of 2016) On January 1, 2018, water submeters are to be installed in new multifamily construction or mixed used commercial properties. In addition, tenants that are to be billed for actual water use through submeters are to receive a specified notice at point of rent concerning the billing and are to receive notice about water usage on each water bill. Questions & Answers I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?
Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may
be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental property or to others. These general rental criteria can and should be applied equally and fairly to all applicants, and in compliance with all fair housing rules. Once applied, the best applicant should be accepted, not necessarily the first to apply. I just put my single-family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two

kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?
The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/ enclosure conform to all state and local codes and ordinances. The gate should be self-latching, and should be checked to ensure that it closes properly. Review your insurance policy with your broker to ensure that your coverage is adequate; consider an umbrella policy as well. Your broker can counsel you on coverage limits; consider $3,000,000 as a minimum. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self-latching gate functions properly. Consider requiring that your tenants procure renters liability insurance as well. These requirements should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving
in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?
No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. This article is presented in a general nature to address typical landlord tenant legal issues. Wood floors take the most abuse of any wood product. The floors need to be protected from scratches, spills, foot traffic and any grit and dirt on the surface. Polyurethane finishes provide a hard, durable finish that wood floors require. Polyurethane is easy to apply, however it is best to use a natural bristle brush rather than a foam pad. The foam pad will leave air bubbles in the
finish. Sand properly to remove any loose finish; this will allow the new finish to adhere properly. When applying the polyurethane finish, allow the first coat to dry overnight, and then sand it lightly with a 220-grit sandpaper. Always apply a second coat and we recommend a third coat to ensure the best protection and look for your wood floors.

rental units painted and the painter typically sprays the walls and ceiling as opposed to rolling on the paint. I’m a bit worried about my smoke and CO Detectors. I’m I being overly cautious? George

Overly cautious? No! We think you are right to worry. The paint and construction dust can contaminate the smoke/ CO detectors and lessen their sensitivity. It is important to either cover the detectors in a protective plastic bag or remove them during the painting and construction work. While you are there, check the batteries and dates of installation. If you remove the detectors during painting, don’t forget to reinstall them before the next resident moves in. Task Force — continued from 22 30% of that $5.2 billion in gas tax revenue to programs having nothing to do with repairing our roads and highways. Some of your road-repair dollars will actually fund job training for felons. Some, park maintenance. And we can’t be surprised if some ends up in the general fund, as happens too often. But…we still need road repairs, so the next victims will be homeowners. The same politicians who passed the gas tax are pushing a Constitutional Amendment (SCA 6) to drop Proposition 13’s two-thirds vote protection for Parcel Taxes and Homeowner Bond Debt to pay for road repair and transportation infrastructure. SCA 6 could cost homeowners another $136 billion in addition to the outrageous gas tax paid by all. And finally, when all the new Parcel Taxes and Homeowner Bonds hit the ballot, politicians write ballot “captions” that deceive Californians into voting yes
without really knowing they’re raising taxes — taxes paid only by homeowners. Got it? So now, please authorize and support the HJTA “Truth in Taxing” Task Force to help us end these rip-offs. Our first priority will be to expose the fraud and misuse of tax dollars, educating voters about the systematic deception, shell games and bait-and-switch tactics currently used to raise taxes. We will fight to block any Constitutional Amendment that would lower the two-thirds vote for homeowner-only taxes of ALL kinds, not just for road repair and transportation. PLUS, we can achieve a “Truth in Taxing” on ballots! The captions on ballot measures usually stress lofty goals — (fix our roads!) minimizing or ignoring that yes votes approve huge tax increases. HJTA has sponsored Assembly Bill 195 (AB 195) to require that all local ballot measures reveal the dollar amount, rate and duration of the new

tax. AB 195 could save homeowners millions of dollars, but sponsoring and passing legislation is complicated and costly. And, as always, our influence depends completely on the backing of BIG NUMBERS of grassroots activists and donation from individuals like you. But, if we can afford it, we have even more ways to protect you like enforcing tax transparency that politicians still ignore, even though it is required by law! Politicians often enact tax hikes too quickly without time for public consideration or complaint, sometimes in the dead of night. That’s why voters passed Prop. 54 last November, requiring that all bills be in pint and available for public view for at least 72 hours before any final vote in the Legislature. Is that too much to ask? Evidently so, since the Assembly has rushed nearly 100 bills through without giving the public this legally required minimal time.

orget about putting up signs or relying on word-of-mouth; social media is the modern way to make hundreds of people aware of, and learn about your products and services. Up to 60% of apartment dwellers report that they found their rental through website listings and social media. Studies indicate the average American logs as much as ten hours of screen time per day with approximately two of those hours spent on social media. Utilizing social media, your outreach possibilities are endless, and with Instagram they are eye-catching too. Using Instagram as a way to reach new residents and impress existing ones is a simple and effective way to bring you social media success. We live in a very social age and Instagram photo posts are one of the best tools for grabbing the most attention. Instagram is an easy-to-use mobile application that lets you capture and edit photos or videos on your computer or smart phone. Instagram was released in October 2010 to fill a niche for onestep uploading applications that would be easy to use and relatively quick to post. Setting up and managing an Instagram account for maximum impact is simple and you can become acquainted with the platform quickly. As with other social media accounts, posting and interacting regularly is the

single best way to manage current audiences. Using hashtags with relevant search terms is great for bringing in prospective residents and a good tool for resident retention too. Instagram allows you to take and prioritize photos, add quick captions, add easy to follow hashtags and share across other platforms at the touch of a button. Instagram is a visual medium so you need to capture images that will catch the eye and use your social media communication to set an engaging and inviting tone. Use high quality photos that feature your best selling points. What makes your community stand out against the competition? Focus on the most unique and exciting features and capture them in photos. When taking photos, remember a few key tips: • Consider the lighting. If taking pictures outdoors, midday light is the best and brightest. Dark photos are not very appealing. • Shoot at a good angle. If taking photos indoors, take pictures from an angle that makes the space look large and open. Experiment with different angles, different eye levels and from different areas. Pick the best for posting.

• Remember it’s okay to edit photos. Do not over use the filters, however you can “tweak” your photos a little to highlight features. Play with the brightness, color and even cropping to make sure that you are presenting the best possible photo. • Loading photos to a listing site too? Remember to load your photos onto a listing site with the full file size. If you post to a listing with a small file size, you will lose the picture quality you worked so hard to obtain. • Be sure the photos contain the name of your community in the file name so that when people search for your community online, your Instagram photos will appear in the search results. • Take a variety of photos. Take photos of apartment interiors, common areas and feature amenities. Since they are digital, take as many photos as you want. Choose the best and delete the rest. Is It Mold or Mildew?
P
roperty owners and management companies know how hard it is to find and keep good tenants. If a tenant complains about suspected mold, it’s important to take it seriously. Having vendors in place, (mold consultants and remediation contractors), allows a property owner or management company to react quickly to a mold complaint. A quick reaction keeps the tenant satisfied and is essential in minimizing risks for potential liability concerns. Owners, property management, and builders are being sued in record numbers over issues of mold. There are many avenues for managing microbial issues on a low-key and cost-effective basis that can provide solutions and reduce the potential for liability. This industry has a lot of hype. What is the right course of action?
What you don’t know can cost you money!
The California Department of Health Services describes mold as “…simple, microscopic organisms found virtually everywhere, indoors and outdoors.” Therefore, there is no such thing as a residence being free of mold spores, as they are found indoors and outdoors. Mold spores can also be found in dairy products, beer, bread yeast and in many medicines, i.e., penicillin. In Southern California, we are used to associating allergies with the spring and fall Santa Ana wind conditions. The winds cause

mold spores from grass, trees, shrubs, etc., to become airborne along with other pollutants such as dust. For individuals who are susceptible to allergies, this is a ripe environment for varying types of reactions. Mold has been around for a very long time; early references can be found in the Bible. Many wonder why mold has become more publicized than ever before. In recent years, testing methods have become more sophisticated, diagnostic capabilities have improved, and the general public has more access to information. Changes in building materials utilized since the 1970’s are more susceptible to mold growth. An example is the former use of lath and plaster walls compared to the current, less expensive use of drywall. Drywall contains a paper backing and lath and plaster does not. Whenever sufficient moisture is present, the paper backing on drywall may promote the growth of mold. Many potential moisture intrusion sources exist in single and multi-family residences such as bathrooms (sinks, tub, shower enclosures, toilets), kitchens (sinks, dishwashers, icemakers), laundry rooms, and various types of plumbing throughout the structure. There are outside sources that can also affect the interior including, sprinklers (over watering), poor drainage, plugged exterior ground drains, and flowerbeds raised above concrete slab. Of course roof leaks can

also impact the structure. Mold cannot grow without a moisture intrusion source (i.e., a water leak) and a porous material, (i.e., drywall, carpeting, wood). Mold will usually be embedded in the affected material and cannot be easily wiped off. To remediate mold, it may be necessary to cut out and conduct remediation activities in the affected area(s). During cold weather, doors and windows tend to be kept closed and a lack of ventilation can become an issue leading to mildew that can often be mistaken for mold. This winter, there has been an increase in tenant complains regarding mold growth in bathrooms, bedrooms, and around windows. The most common complaint is mold growth on bathroom ceilings, walls and grout in the shower. We have all seen how fast a bathroom mirror will fog up from the steam (humidity) of a hot shower. The longer the shower, the more steam (humidity) is produced which will condense on cool surfaces (mirror, ceiling, windows and walls). Without adequate ventilation the humidity will remain on the various surfaces and not adequately dry. This may form a surface fungal growth, which is usually mildew. Mold or Mildew? — continued from 32 been opened. Again, the humidity will condense on cooler surfaces such as the interior of outside walls and windows. This condition is more prevalent in rooms located on the north sides of buildings where direct sunlight does not have an opportunity to warm the interior of an exterior wall or window. A fuzzy type of fungal growth, caused by humidity condensation and lack of ventilation, can also form where there is dust on walls behind dressers, dirt and grime in the corners of windows and window casings. In closets, this fuzzy type of mold may be found on shoes, clothes, etc. Numerous studies have shown the relationship of elevated humidity levels, cool surfaces, and the effects of mildew growth. Is it mold or mildew? Is your tenant’s complaint real or is it a housekeeping issue? Many times after investigating affected areas, we have found some of the following conditions:
• No water leak; • Elevated humidity levels were due to inadequate ventilation in bathrooms; • Limited usage of heating system to reduce humidity and to warm wall surfaces; • Inadequate housekeeping in showers, around windows, etc.; • Dirt & grime on metal window casings and the window track; • Dirt & grime along a wall causing furniture / bedding limited air circulation. An easy way to tell if the microbial growth is on the surface vs. embedded in the substrate is to gently rub the surface with tissue. If the growth is easily wiped off, usually it will be a type of mildew. A general cleaning of all surfaces utilizing wet-wiping with an anti-microbial solution can remove excess dust and residual microbial spores. Once the cleaning has
been completed, it will be necessary to find a solution to the elevated humidity levels to prevent a return of the microbial growth. As an example, humidity levels can be reduced in bathrooms through either opening the window or installing a higher efficiency exhaust fan. For bedrooms, it may be necessary to utilize a portable dehumidifier during the winter months. Through increased housekeeping of walls, windows, closets, furniture, and bathrooms, most microbial growth can be prevented. The key can be as simple as air movement, keeping surfaces clean, and reducing humidity. As mentioned above, mold will usually be embedded in the substrate and will need to be cut out to remove it. Mildew is usually a surface growth and many times can be removed through scrubbing the surface. New Year Delivers Pop in Fannie/Freddie Loan Limits
T
he new year brings substantially more elbow room to finance 1-4 residential properties. This, because Fannie Mae and Freddie Mac have raised their loan limits by a hefty 6.84% over 2017 levels. Below are the old and new limits: Conforming Loan Limits Units

(It should be noted that “High Balance Conforming” loans come with higher interest rates, typically about .25 percentage points above rates for loans within conforming loan limits. High Balance loans are only available in areas deemed “high cost”, which include, not surprisingly, Orange County.) The 6.84% hike is truly newsworthy. There had been NO changes in the fannie/freddie limits from 2006 through 2016, before a modest 1.7% increase took effect in 2017. To clarify, fannie/freddie loan limits (sometimes referred to as “agency” loan

limits) are reassessed annually. The calculation formula for any changes in the limits is linked to the national average of US home prices. The fact that it took eleven years — from 2006 through 2016 — for real estate to regain its pre-recession price levels explains why agency loan limits had been held in check until 2017 when prices were finally retouching 2006 benchmarks. Now that the catch up in home prices is complete, fannie/freddie loan limit annual adjustments should begin to reflect actual year over year US home price gains — this wasn’t the case from 2012 to 2016 when home prices were rising, but the agency loan limits were stuck in neutral due to US home sale prices still mired below their 2006 highwater marks.
The importance of agency loan limits
Fannie Mae and Freddie Mac, which are US government sponsored enterprises, purchase well over 50% of the loans made on 1–4 unit residences in the US. In 2016, the last full year data is available, the agencies funded over a trillion dollars on more than three million 1–4 unit financed transactions. In short, these agencies are a bulwark of the marketplace. They ARE the 600 pound gorilla. Without their presence and the liquidity they bring, markets values as we know them today would not be sustainable. It follows that changes in agency loan January 2018
limits impact market psychology and price structures. The higher the fannie/ freddie loan limits, the more “affordable” real estate becomes at higher price points. As an example, consider an investor shopping for a 4-plex in an Orange County coastal location. She plans to purchase with a 25% down payment given that the agencies impose a 75% loan to value cap on 2-4 unit investment purchases (80% LTV max for owner occupancy). A property surfaces in Newport Beach with a $1,743,000 price tag. Under 2018 high balance loan limits our investor can get a $1,307,000 first trust deed loan — 75% of the purchase price — leaving her with a $436,000 cash down payment, which is 25% of purchase price. In 2017, before the fannie/freddie 6.84% increase, the investor would have been limited to the then $1,223,475 loan limit, necessitating an additional $83,525 out of pocket to close the same $1.743 million transaction (the down payment would jump to $519,525, or 29.8% of purchase price). A year ago, under the 2017 loan limits, a buyer determined to use the full 75% LTV leverage would have been limited to paying no more than $1,631,300 for a 4-plex in order to stay within the then high balance conforming loan limit of $1,223,475 ($1,631,300

Metrics: What’s the Solution? (Part Three of a Three-Part Series) from Cash In on the Myths of Real Estate
W
hen making an investment decision — be it to hold, sell, refinance, buy or exchange — you have to look at the numbers. And one’s choice of quantifying tools — i.e. metrics — is crucial to this process. My last two articles in Apartment
News Magazine introduced how metrics can be both used and abused. Starting with Cash-on-Cash as reviewed in November, the following month I continued my examination with a close-up look at Capitalization Rates. Now I am reviewing two more tools

— Gross Rent Multiplier and Price per Door. Again, although often relied upon by many real estate investors to determine their course of action, these methodologies have some serious flaws. Just like Cash-on-Cash and Capitalization Rates, both of these tools only look at
9-3 Cash-on-cash, cap rate, gross rent multiplier, and price per door are the best ways to evaluate income properties. Continuation of Bill’s Truth: 3. Gross Rent Multiplier (GRM) is another tool that relies upon current numbers to determine value. The GRM is the ratio of the price of a real estate investment to the property’s annual rental income before taxes, insurance, and other expenses. It is derived from easily obtainable market data — i.e. rents. The formula used to calculate the Gross Rent multiplier is: Gross Rent Multiplier = Sales Price/Gross Annual Rent In basic terms, the GRM is an indication of how much people are willing to pay for a stream of income. For the investor, a higher GRM is less attractive than a lower one. Like capitalization rates, gross rent multipliers are grouped together into one GRM that investors use for comparison purposes by property type in a specific area. 4. Price Per Door: This tool is basically derived from price divided by number of units. Best used to compare identical units, price per door only gives an indication of value without particular consideration as to the actual income/ expense numbers or any other variables. All four of these metrics tend to be used as a shortcut means of establishing the price or the value of a property. However, these tools all ignore the big picture, which is how much money are you actually going to make? Internal Rate of Return (IRR) treats your equity dollars as if it were money in the bank and focuses upon the cash down payment, cash generated over multiple years, and net cash proceeds from the sale. Remember, as discussed previously, in calculating the IRR of a property you need to set a future date for the time of sale and make projections about what is going to happen to your stream of income (cash flow) during the ensuing period, and about what will be the sales price. By deciding what you want your return to be, you can actually work backwards and use that IRR to determine what price you should pay for a property today. Cash In: Applying various metrics is useful, but you still have to look to the future. Take the time to calculate your IRR.

one year of operations. That can be very dangerous. The final metric that I am addressing — Internal Rate of Return — offers a much more viable alternative. Some investors believe that IRR is not a reliable tool, because it does require making projections about the future. Yet that is exactly what all of us do when we purchase an income property. I do not know of a single investor who buys today thinking that all of the relevant numbers — rents, expenses, taxes and, especially, interest rates are going to remain stagnant. Some may ignore that change is a basic fact of life, but savvy investors are willing to do their homework and made educated guesses as to what the future will bring. The smartest investors will also take a look at what I call Intrinsic IRR. This is the secret sauce to my success. Next month, I will share with you what Intrinsic IRR means and all of the various ways that this tool can be applied in your own decision-making. About the Author: William R. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. This usually necessitates the apartment owner to go into a non-standard market for a year or more with substantially higher premiums. This is why it is crucial that an inspection is done prior to being quoted by an insurance company. Avoid having a cancelled policy due to the “bugs” being found after the policy is in place. Many times the tenant’s complaints can be easily solved without the need of an outside vendor. However, there will be times when an expert may be needed.
