PRESIDENT’S MESSAGE B y J ohn T omlinson
H
appy New Year, my name is John Tomlinson and I am honored to serve as your President for 2019. I would like to a take a moment to thank Nicholas Dunlap for his tireless efforts and stewardship of the Association over the past several years. It is my goal to carry the torch and further promote all that the AAOC has to offer its members. I would also like to take a moment to recognize two directors who retired in 2018, Jim Loftus and past President Jerry L’Eucyer. Jim and Jerry both served our board with distinction and honor for many years. Their exemplary leadership and good counsel will be missed by our Association and especially myself. I can remember as a young child attending membership meetings with my parents. When I look back, some of my fondest memories are associated with spending time with my parents as they managed our rental properties. After many years of working for my
father’s company, Tomlinson Enterprises, my cousin and I William “Bill” Tomlinson II formed Tomlinson Management in 2001. Providing quality rental housing to our residents is our number one priority and AAOC is an integral partner in our ability to achieve our number one priority. You may not know, but this year happens to be a very special one, in that we are celebrating the 55th Anniversary of the AAOC. We hope that you will join us as we ring in the New Year and celebrate this milestone of 55 years of service and representation of apartment owners in Orange County. This year will also be an important year legislatively, with the likelihood of the increasing double threat of regulation and taxation, especially Split Roll Taxation. The AAOC is extremely fortunate to have a dedicated and experienced group of volunteers spearheading the good fight to preserve our ownership rights. Prior to my involvement on

the Legislative Committee and the Board of Directors, I was unaware of how much the AAOC does to protect apartment owners from overly burdensome and onerous laws and regulations. Now more than ever, we require your continued participation and financial support to fight the new challenges that lie ahead. As with every new year, we encourage you to be aware of both new and past policies and trends that could affect your property and more importantly, your bottom line. The hot topic for 2018 was Proposition 10. With your help, we were instrumental in the overwhelming defeat of this nefarious attack on our ability to the provide what we do best, quality rental housing for our residents. he New Year is here and certainly there is a lot of “new” to talk a out. In a historic election both nationally and at home we saw many changes — both good and bad. Statewide, the good saw the rental housing and real estate industry come together in a concerted effort to soundly defeat Proposition 10 — the repeal of Costa-Hawkins. On the bad side; several of our property rights advocate legislators were defeated in November.

The Democrats made historic gains in the state Legislature. They secured control of three-fourths of the Assembly — a feat that has not been accomplished since 1883. In the Senate, Democrats control 29 seats out of 40, which would be the party’s largest margin since 1962. These margins will give Democrats numbers well beyond the two-thirds threshold needed to approve tax increases or place constitutional amendments on the ballot without Republican votes. It remains unclear whether the Democratic caucus will, as it has in the past, include enough centrists to block liberal proposals opposed by business groups and property rights advocates. Please stay tuned and watch for Red Alerts from AAOC asking for your support in opposing bad policy affecting our industry. Looking ahead in 2019 we start with our January General Membership Meeting on January 15th at the Great Wolf Lodge. Once again this meeting will feature our guest speaker and friend, Steve Duringer. Steve always draws a large audience and brings us up to date regarding the newest legal and legislative issues facing us. The AAOC General Membership Meetings are the single best forum for Independent Rental Owners to learn, share, mingle and connect. We have seven of these and all will be held at the Great Wolf Lodge. tional education and who doesn’t(?), every year is filled with education classes and workshops including Maintenance, Fair Housing as well as the 11 week Housing Providers course. This annual event allows you to see the latest products and services in the apartment industry all under one roof as well as opportunities to win cash and prizes. I mentioned earlier the “super Majority” in both houses of the State Legislature. As I said, this dominance gives the Democrat Party the power to pass taxes, amend political spending laws, move constitutional amendments to the ballot, and so forth without Republican support. Housing is THE top issue in California with the rental market being in the cross-hairs. I expect our full attention will be necessary in protecting our property rights like never before. AAOC Legislative Advocacy continues to be vital in an industry such as ours and we couldn’t do it without your support. Many of you stepped up to help defeat Prop 10 and other bad legislation, but in this environment, we certainly can’t rest on our laurels. Use of Criminal History Records
A
B 53 (Assembly Member JonesSawyer) introduced on the first day of the 2019–2020 session a bill that requires property owners to follow a lengthy, costly, burdensome 5-step tenancy application process in order to fill any vacancy. When a rental unit becomes available, lproperty owners will no longer be able to fill their units and begin collecting rental income immediately. Instead, property owners will now have to go through the following 5 phases: Phase One: During the “initial application assessment phase,” tenants may be screened, but criminal history questions and background checks are off limits. Phase Two: After the initial assessment phase, owners are allowed to ask about criminal history and perform a criminal background check. Phase Three: Owners must then provide a written statement to any

applicant he or she wishes to deny tenancy explaining his or her decision. Phase Four: Owners must then give any applicant who was denied tenancy 14 days to respond with evidence demonstrating the inaccuracy of a criminal record, or evidence of rehabilitation or mitigation. Phase Five: If an owner receives a response from an applicant, the owner must delay making a final decision for a “reasonable period”, and reconsider his her decision in light of the new information. Only after going through these five phases is an owner allowed to deny tenancy based on criminal convictions. AB 53 also creates new protected class by prohibiting landlords from denying tenancy for any of the following reasons: 1) an arrest not resulting in a conviction; 2) participation in, or completion of, a diversion or a deferral of judgment program; 3) a conviction that has been judicially dismissed, expunged, voided, or invalidated; 4) any adjudication from the juvenile justice system; and 5) information pertaining to an offense other than a felony or misdemeanor. Our issues with the bill as introduced include: AB 53 forces landlords to hold units off the market for up to a month. Rental property owners will collectively lose millions of dollars under the provisions of this bill, because they will be

required to keep units vacant for up to month to comply with the bill’s fivephase application process. No longer will landlords be able to assess an applicant’s qualification and rent their units within a few days. The new process requires an initial interview, which can take a few days, then a second interview to determine an applicant criminal history, which can take a few days, then they have to write a denial letter which can take a few days, then they have to wait 14 days for a response, then they have to wait another “reasonable” period of time for reconsideration, which may be 7–10 more days. All together, that’s nearly a month of potential rental income that landlords are denied. The five-phase process is unprecedented and unwarranted. The rental application process is not like the employment application process where applicants are called back for second and third interviews. Prospective tenants typically submit an application, after which a landlord interviews the applicant. Criminal background and credit checks are performed, and an applicant is either offered tenancy or denied. In the residential rental business, time is money. Thus, landlords typically make quick decision to fill vacancies they may have. The five-phase application process is an unprecedented overreach into regulating the tenancy application process that unnecessarily delays filling vacant units, creates administrative burdens, and unreasonably results in income loss.
Barring criminal history inquiries during the “initial phase� also serves to bar questions about employment, rental history, and credit. Questions about employment, rental history and credit are often related to criminal history. For example, an applicant just released from prison after spending the last five years incarcerated, will have no employment, rental, or credit history during that period. Any questions about employment, rental, and credit history, or any background credit checks will either reveal the gap in records or will force the applicant to discuss his or her criminal history. Because such criminal history questions are prohibited during the initial phase, landlords will be forced to wait to the second phase to ask these important tenancy application questions, further delaying their ability to fill their vacancies. The bill creates a several new protected class. First, the bill ultimately serves to protect convicted felons by forcing landlords to hold property off
the market, and requiring written explanations detailing why a convicted felon was denied tenancy. Second, the bill protects anyone who committed a crime as a juvenile regardless of the type of crime. Third, the bill protects anyone who has been arrested, but not convicted, regardless if they are factually guilty of the crime for which they were arrested. Fourth, it protects anyone who has participated in a diversion or deferral program regardless of whether they successfully completed, and regardless of the underlying facts of the case. Fifth, the bill protects anyone who has committed any offense that is not a misdemeanor or felony, including offenses economic offense relating to late payments, bankruptcies, civil liability, and other fines and citations. Landlords are liable and subject to forfeiture and nuisance abatement laws for criminal activity on their property. A landlord can be liable for criminal acts committed by tenants against other tenants. See Yu Fang Tan

v. Arnel Mgmt. Co., 170 Cal. App. 4th 1087, 1095 (2009), citing Ann M. v. Pac. Plaza Shopping Ctr., 6 Cal. 4th 666, 674 (1993) (holding landlords owe a duty to their tenants to take reasonable steps to protect against foreseeable criminal acts of third parties that are likely to occur in the absence of such precautionary measures. A landlord may also be subject to governmental forfeiture laws if their properties are used for illegal purposes. Additionally, landlords can be cited, fined, or otherwise penalized by local drug nuisance abatement statutes. Landlords have a duty to keep their tenants and property safe. Landlords must have the ability to keep their tenants and premises safe from criminal activity. Not only is safety an important legal obligation for which landlords can be sued, it is also a moral and ethical duty. Sacramento — continued from 9 able to keep convicted sex offenders away from the property. Protecting the property and tenants sometimes means denying tenancy to convicted felons who pose significant safety threats. Where young children reside, for example, a landlord needs the ability to check a prospective tenant’s criminal history to determine whether he is a convicted sex offender. There is no justification for requiring landlords to put their tenant’s lives and property in danger. Landlords have a legitimate nondiscriminatory purpose for checking the criminal background of prospective tenants, and denying tenancy when they pose a significant threat. They must be able to protect their tenants and protect their property. Felons who have been convicted of sex offenses, drug sales or manufacturing, property crimes, burglary, arson, robbery, assaults and other violent crimes, pose the greatest danger to the residents and
the property. The United States Department of Housing and Development (HUD) requires landlords to deny tenancy to applicants who have committed certain crimes. The fact that HUD policy requires landlords to deny tenancy to felons not only supports our policy position on the issue, it is strong evidence that…Under HUD policy, landlords are prohibited from admitting an applicant if the applicant, or any member of the applicant’s household “has been evicted from federally assisted housing for drug-related criminal activity.” Criminal history is a fundamentally different character trait than those of current protected classes. Protected classes consist of categories in which people have no choice in participation — race, color, national origin, sex, sexual orientation, persons with disabilities — or groups in which the choice would not be relevant to a landlord, such as religion or families with children. The same cannot be said regarding felons.
No one is born with a felony conviction. A felony conviction results from choices made by that individual. To give felons protected class status protects them from the consequences of their own conduct. No such protection is presently afforded to anyone by the Fair Housing Act. The Assembly Member is committed to the issue and the bill. It now is up to us to show the legal and problematic issues to him and the legislature. What’s New for the Upcoming Year
T
he 2018 elections galvanized the AAOC to be part of the powerful effort to defeat Proposition 10, which would have repealed the Costa Hawkins Act and allowed the expansion of rent control. Because of the engagement of our own members and the support throughout the state, the No on Prop 10 Campaign received 59.43% of the statewide vote. In Orange County over 65% of the voters said no to Prop 10. In an election year when many changes occurred on the state and national levels, the voters of California and Orange County emphatically decided not to change the current rent control laws of our state. But, of course, this does not mean that the issue of rent control will go away. The affordable housing crisis in California will be one of the big

Sacramento political footballs in the upcoming 2019 session of our California State Legislature. Affordable housing is a complex subject and does not lend itself well for solutions by noncomplex politicians. The politicians in Sacramento use the terms “rent control” and “just cause evictions” to show that they are trying to work on the complex affordability problem. We will be carefully monitoring all their efforts. We will have new Orange County elected officials in both the Assembly and Senate who will be joining our delegation in Sacramento. The AAOC will look forward to reaching out to these new members regarding property rights issues. In the upcoming year the AAOC will also be working extensively with our Orange County local elected city officials to make sure they have the

tools and facts needed to protect the multi family housing industry. We want our members to be at the table especially when issues regarding housing affordability or private property rights are discussed on the city level. The 2018 local city elections were very positive for property rights candidates. Over 2/3 of the candidates endorsed by the AAOC were elected to city councils. We will continue to reach out and actively participate with these newly elected officials in the coming year. 2019 will be a year of political changes, but with the heightened engagement level of our informed and active membership ignited by the No On Prop 10 efforts, we will continue to keep AAOC members updated regarding additional ways to stay involved and to continue the fight.

Questions & Answers One of my former tenants took me to small claims court over her security deposit. She claims that I was unreasonable in spending all of it, because she claims she had a cleaning crew come through the place before she moved out. Well I don’t know if she used a cleaning crew or a wrecking crew, because the place was trashed. Anyway, the Judge in the small claims court apparently liked her, and I guess I lost my temper at the hearing. When all the dust settled, the judge ordered me to pay her! Go figure. The little paper says that I have time to appeal this decision if I want to. I basically wanted to know what happens in the event of an appeal, and whether or not I could have a lawyer handle it.
A small claims appeal is a “trial de novo,” that is, the appellate hearing will be a “new trial.” You, as the Defendant, essentially get another chance to prove your case. By and large, the structure of the proceeding is essentially the same. However, on a small claims appeal, as opposed to the initial small claims proceeding, you may have an attorney represent you. In your situation, if you’re afraid that you might lose your temper again, call a lawyer who will talk about the case with you. Of course, there are times when it’s simply more cost effective to “go it alone,” when the amount you’re fighting over is less than the cost of retaining counsel. If this is the case for you, and you really feel that you were not treated fairly in the small claims court, then appeal the decision. Just remember to take a deep breath

out in the hallway. I am a resident manager of a 16-unit complex. I received a telephone call from a person wanting to rent a unit from our small complex. I asked the prospective tenant if she had any children. She got offended and told me, in no uncertain terms, that I could not ask that question. I replied by thanking her for her criticism and hung up the telephone. Is the prospective tenant correct that I cannot ask if she has any children?
Yes. Rather than ask how many children will reside in the unit, a more relevant question would be to ask how many occupants would reside in the unit. Most acts of discrimination in rental housing occur during the resident screening process. For this reason, it is prudent to put your screening procedures in writing and to adhere to them strictly and impartially. All rental units must be available to families with children. Furthermore, rules designed to discourage families from applying to rent may lead to the filing of discrimination complaints. Minimize the prescreening over the telephone; you never know if the caller is truly a prospective applicant or just a tester from Fair Housing hoping that you will say something actionable. ment. The couple came over to the property and like always, I show everyone the very same unit. I really didn’t think these kids would fit in with my more mature residents, so I told them about the big mega apartment complex down the street. I have recently attended a property management training class put on by the local apartment association and I was told that my conduct was discriminatory. I was looking at the interest of the applicant; I truly didn’t think they would enjoy themselves. Was my conduct in violation of the antidiscriminatory laws?
Yes. You cannot ‘steer’ certain prospective residents to another complex that you think they’d like better. Do not attempt to discourage prospective residents by saying, “You wouldn’t like it here — it’s too noisy” or “There are mostly adults living here, so your children wouldn’t have anyone to play with.” Additionally, be truthful about vacancies. Don’t say that there are no units available when, in fact, there are units available. Clearly, this also applies to the sizes and types of units available. Don’t pretend that there are no two-bedroom units available, or no units with other desirable features, if there actually are. Don’t deliberately show certain prospective residents the least desirable vacancies on the property. The key is fairness — it is illegal to show only the units that are dirty, damaged, or otherwise unattractive to certain prospective residents, while showing clean, attractive units to others.
I just sent out my annual rent increases to all of my residents. Because times are tough, I delayed sending them out, and I kept the increases minimal. Well, I just got home, checked my messages, and got an earful from one of my more “vocal” residents. She claims that I was retaliating against her, and that the rent increase notice was not valid. Says that she won’t pay it, and that I violated the law by even giving it to her. Something about her deducting $6.50 from her rent three or four months ago for a leaky faucet. I remember that she shorted the rent, but I didn’t really mind, she took care of the dripping faucet herself. What does this mean, what is “retaliation?” Did I do something illegal by serving my annual rent increase notice?
No. Although there are strong protections in place for certain tenant conduct, your resident is confused. A landlord cannot punish a tenant for exercising a “legal right.” The law offers tenants certain protections from retaliatory evictions and retaliatory acts. California law will infer that a landlord has a retaliatory motive if he seeks to evict the tenant or take other retaliatory action within six months after the tenant has exercised certain protected rights, including using the repair and deduct remedy, complaining about the condition of the unit to a public agency, after giving the landlord notice, or after filing a lawsuit based upon the condition of the unit. The tenant must prove that she exercised one of these rights, in the past six months, and that her rent is current. The landlord may counter the tenant’s claims of retaliatory conduct by establishing that he did not have a retaliatory motive. If the landlord’s actions were based on a valid reason, and not in response to the tenant’s exercise of a protected right, then a court would find that the landlord did not retaliate. If your annual rent increase was consistent with past practices, didn’t solely target this individual tenant, was based upon objective business reasons, and was not meant to “punish” this resident, then your rent increase would

Our rental has a non-standard size sliding glass door that we’d like to replace. We’d like to get a whole new door and track. How easy is that? We have siding on the house. What should we expect in the way of wall damage or ability to get a larger standard door frame into the space? What questions do we need to ask the installer? KWT
Dear KWT:
Replacing a sliding glass door and frame as a DIY job is not for the faint of heart! It is not really that difficult as it is unwieldy and the doors are large and heavy. You state the door is a nonstandard size; this might be a good time to standardize your glass door. Start by removing the door, bottom track and frame. This will expose the rough opening in your door way. Measure the rough opening for a standard sliding door of your choice. It is sometimes easier to enlarge the rough opening to
accommodate the new door. The reason for a larger opening is because you will not need to find or install new outside siding or stucco nor patch the inside drywall. “Rough opening” refers to the dimensions inside the trimmer studs and between the floor and the bottom header. This opening will be slightly larger than the patio doorframe. The extra space allows a little fudge room for squaring the frame with shims. If you decide to have a contractor install the new sliding door, have the installer explain in detail what the job will entail, what the finish will look like and how long the job will take. Make sure they are set up for dust control as a job like this can cause a considerable amount of dust during the construction if the opening is enlarged.

The installation of a dishwasher is not as complicated as it looks. Turn off the electricity leading to the machine. Turn off the water at the main shut-off. If your dishwasher site is not pre-plumbed with a separate water valve, remove the existing hot water angle stop valve under the sink and install a double threaded angle stop/shutoff valve. Use a stainless steel braided flex water line to hook up to the dishwasher. You may need to buy a fitting to screw into your dishwasher to accept the hose. Most new machines don’t come with the fitting, or remove the fitting from the old dishwasher. Next, connect the drain line from the dishwasher pump motor outlet to the garbage disposer inlet. (Don’t forget remove the “knock-out” in the garbage disposal inlet.) Be sure to use an “Air Gap” between the dishwasher and the
garbage disposal. The air gap is installed next the faucet and stops the water from draining back into the dishwasher by siphon action. If you are unable to install a true air gap device, loop your drain line over the dishwasher before hooking up to the garbage disposal. Both methods will prevent debris from sucking back into the machine. Look for a small electrical box under the dishwasher, remove the cover and pull out the wires. Connect your wires or pig tail to the machine (A “Pig Tail” is a wire with a plug on one end and bare wires on the other end). Be sure to hook up the Green ground wire for safety. Carefully push your machine under the counter. Once in place, adjust the legs by turning them in or out to level the machine. There should be two tabs at the front top of the dishwasher, use these to secure the machine to the counter top with screws. Now turn on your water and electricity and test your dishwasher and check for leaks.

I am a new owner of a small apartment building and plan on doing my own maintenance. My first task will be recaulking the bathtubs. Unfortunately every time I caulk, I make a huge mess and there is caulking everywhere. What is the trick to caulking? Tom

Yes, we’ve all struggled with our caulking nightmares. Here is a simple solution; First always remove the old caulk and clean before installing new caulk. 1. Check the size of bead you will need. Smaller is better than larger. 2. Cut the nozzle of your tube to the desired size. It is best to cut the nozzle at a 45-degree angle and again, the smaller the opening (within reason) the easier it will be to apply. 3. (If you are new at this, it is best to use a water-based product. The

Goal-based Insurance Strategies Can Help Strengthen Your Portfolio
S
imilar to your investments, your insurance needs and related strategies change over time. As part of a smart financial strategy, it’s critical to review and adjust coverage at different life stages to make sure that you’re protected. “I refer to insurance as one of the cornerstones of an effective financial strategy,” says Peter Landry, Director of Wells Fargo Advisors Life Insurance. “You can have the best investment strategy, and you can have the best rate on your loans, but nothing is going to carry that forward without the right type of protection in place. Insurance can act as a safety net for any good financial strategy.” Landry outlines four basic life stages that should trigger a reassessment of your insurance strategies.
Life stage: Starting out
When you’re launching a career, your insurance needs to fall primarily into the category of income replacement: ensuring that critical expenses like the mortgage and college tuition are paid if you pass away. During this stage in life, as you’re dealing with multiple expenses and trying to build wealth, it’s important that your insurance strategies are properly aligned with your budget and timeline. “You may want to consider term life insurance — a good, relatively affordable solution that covers you until your peak earning period and your reduction in expenses can come through,” says Landry. “You might use a level premium term policy that’s maybe 20 or 30 years.”
Life stage: Pre-retirement
At around 45 to 60 years old, it may be appropriate to think about leveraging life insurance to help with retirement planning. “Folks in that age range may have maxed out what they can contribute to a 401(k) on an annual basis,” Landry says. “They may not have options from an income perspective to contribute to an IRA either.” Individuals in this situation who have a need for life insurance may want to consider insurance strategies such as an indexed universal life product or a variable universal life product, designed

to accumulate what is called high early cash value. Landry says this approach is not necessarily geared toward funding a particular death benefit, but rather toward accumulating cash inside of the policy. “The life insurance provides for your protection needs, but then the supplemental income and that high early cash value component deliver a lot of value so as you get into retirement, you can seek to maximize things like Social Security and IRA withdrawals — and use that life insurance cash value as a bridge strategy.” Note: Investments in variable universal life are subject to market risk, including loss of principal. “High early cash value” will fluctuate in value based on market performance. Cash value is accessed through policy loans and withdrawals, which reduce death benefit.
Extended care planning
The third life stage involves insurance strategies based around extended care needs, an area where carriers have gotten creative with solutions, says Landry. Options include traditional long-term care, a hybrid policy that combines life insurance and long-term care insurance, and a life insurance product with a long-term care rider. Strategies — continued from 20 are hesitant to use long-term care insurance strategies, if positioned properly they can be an effective estateplanning tool. “The knock on long-term care coverage is, ‘If I never need it then I don’t really get any value from it.’ But in many cases, you can marry it with a life insurance product solution. You have a life insurance product, and if you need long-term care, you can draw upon that policy,” Landry says. “It reduces the face amount of the policy, but you are able to cover your costs related to long-term care services, and if you never need long-term care, well, you have a life insurance policy that you can leverage for your estate planning purposes.”
Legacy planning
The last life stage is legacy planning: using life insurance strategies to create leverage — in a tax-efficient manner — so you can leave a gift to your recipient
of choice, such as a family member or charitable organization. These solutions tend to be individually tailored. “We have insurance specialists who work hand-in-glove with estate planning attorneys to put together life insurance solutions that can help meet legacy planning needs,” Landry says. At every stage, Landry says, he and his team focus not on products, but on solutions and insurance strategies. “It’s not about, ‘You have to get an insurance product,’” Landry says. “It’s, ‘Let’s talk about the insurance that you have. Specialization — When It Really Counts

ver the course of producing this monthly column, my father and I have delved into various aspects of building one’s wealth through real estate and, in particular, through the buying and selling of residential income properties. There are many reasons to sell or exchange. A change in personal or family circumstances may dictate a need for a property that requires less hands-on supervision. Perhaps you are consider-

ing a move and want to purchase an income property in that area. Or, as my father would recommend, you have developed a written real estate plan and, having analyzed and quantified your options, you recognize that now is the time to make that change that will better fulfill your investment and personal goals. Whatever the reason, when the time arrives to take action, most owners call upon the services of a licensed real
estate professional. As covered in my father’s book, Cash In on the Myths of Real Estate, selecting that individual is often more important than perhaps initially recognized. Buying or selling an income property is a much more complex process than the typical residential property. It takes knowledgeable professionals at many different levels to ensure an optimal outcome for all involved. One of the largest real estate com-

Popular Belief: Many real estate agents believe that they are fully qualified to sell any type of residential property. After all, the basic mechanics are pretty much the same. Bill’s Truth: Yes, the forms are readily available to all agents. However, selling residential income property requires a depth of knowledge that extends much further than the rules and regulations covered in real estate licensing classes. Determining the value of an income property requires added expertise and calculations. There are also special tax rules – such as those for a 1031 exchange – that may impact the terms of the sale. On an even more practical level, conducting the appropriate due diligence, communicating with the renters, and resolving potential issues with a lender are just a few of the challenges that residential income property agents face with nearly every transaction. Look for agents who have firsthand experience with the ownership and operation of the type of property that you are selling. They should also have available a trusted group of equally knowledgeable advisors and support services to call upon as needed.

Soft Question Selling
S
ince the inception of business, customer service has fallen into three categories: passive, average and proactive. • Passive and average people wait for things to happen, and, in general, do the bare minimum. • Proactive people make things happen and create positive situations. Proactive people are naturally inquisitive. They use their personality. They are friendly, warm and above average in being helpful and getting the job done. They speed the rapportbuilding process by immediately introducing themselves. This creates a positive and lasting impression. Is it any wonder why customers prefer dealing with proactive people? Proactive people look for opportunities to make it easy for a customer to do business with their organization. This gives them an edge, not just in rapport building, but also in cross-selling. Generically, it’s called cross-selling, upselling or even suggestive selling. Here at Telephone Doctor we call it Soft Question Selling. Remember to see if your caller has any need for other services or products your company offers. Your company is likely in a very competitive environment, and extra business is important, but how do you keep from seeming too pushy? You may worry that the customer is going to resent your attempts to crosssell. I do hear that every once in a while, and certainly none of us wants to offend

the customer. It’s a matter of technique. Your company probably has products and services that your customer needs but doesn’t know about. If you don’t offer or suggest these helpful ideas, you’re actually denying them something they might need. Don’t deny your customer a choice: That’s key in being proactive! But how is it done? By asking Soft Questions like these: • By the way, are you aware of our free overnight shipping policy if we make a mistake on your order? or • Would you be interested in taking advantage of our sale on knit polo shirts? or • Were you aware of our VIP plan? It allows business travelers to upgrade for only $25 per day. Those were Soft Questions, and they are seldom rejected. If the customer needs the services, they will give you a positive response, and if they don’t, they’ll give you a soft turn down to your soft question. Try it. It works. Here’s a brief scenario using the Soft Question Selling. Proactive Agent: Great! I’ll put your paperwork in today’s mail, Mr. Mills. [Soft Question] Oh, by the way, are you aware of our free, online bill paying service? Mr. Mills: No, I’m not.

Proactive Agent: Well, it’s a convenient way to pay your bills without needing to write the checks or needing to mail them. Mr. Mills: Well, that sounds interesting. Sure, tell me more. Remember: Use soft questions to give your customer a choice! And, once again, here’s something to keep in mind that will help you with that all-important cross-selling, upselling and suggestive selling: Soft Questions usually get soft answers. You won’t feel rejected with a soft answer even if you don’t get the added sale. The important thing is that you aren’t denying your caller the choice of having access to a product or service that could benefit them. Statement of Fact: • To achieve a superior level of customer service, we need to exceed our customers’ expectations. That is done by showing an obviously friendly and sincere interest in your customers and doing what’s needed to make every encounter a positive situation. You also can exceed your customers’ expectations with a soft approach to cross selling, up selling and suggestive selling. If you’ll use Telephone Doctor’s Soft Question Selling technique, you’ll get soft answers, whether yes or no. O
nce upon a time, in the land we will call “Working Class America”, gentlemen and ladies worked at their jobs 40-hours a week for 30 years so that they could achieve the epitome of success, the gold watch at retirement. These people went to work dressed professionally, on time, and loyal to their employer. This value system was crucial to an entire generation. Fast forward to 2019, is a gold watch still the perception of success? Most people would say nope, not at all. Our most visible CEO’s wear jeans and hoodies to work and have created work spaces that resemble a living room. There are many contributing factors to why our attitudes and values have changed. For starters, we typically experience a change cycle every twenty-
five years. Each of these cycles bring new technology as well as changes toward authority, balance, loyalty, and entitlement. This is an important aspect of our work environment today because for the first time in American history we have four different generations working together side by side. By 2020 there will be five generations out there. Traditionalists, Baby Boomers, Gen X, Millennials, (and soon Nexter’s) are collaborating, leading, and having conflict with each other at work. Each generation has distinct attitudes, behaviors, expectations, habits, and motivational buttons. Roles today are all over the place and the rules are being rewritten daily. Our challenge is to manage this phenomenon for a

peaceful work environment where everyone can thrive. Research shows that the most dynamic and potentially volatile work relationship is between Baby Boomers and Millennials. According to AARP, 10,000 baby boomers reach retirement age every day (that is not a typo!) and this will continue until 2030. Due to not being financially prepared for retirement, and many supporting adult children, 60% of baby boomers plan to work past the age of 65. This can lead to a resentment and frustration for Millennials that upward advancement is not as readily available. Boomers work efficiently and tend to be workaholics. Millennials are goal oriented, have a “what’s next” mentality, and are accustomed to pushing a button to get what they want. They are starting in the workforce with crippling student loan debt and have an overwhelming desire to get ahead while working with other equally bright and creative people. How do we satisfy both vital populations? The answer is to listen to them both and realize their similarities can form a unique bond. Working Class — continued from 28 need me as much as I need you”; each group appreciating the fact that the others’ challenges and viewpoints are not absolutely wrong and theirs right—they are just different; neither group can have a “my way or the highway” operational mode, everyone needs to be able to make accommodations; if we make improvements, each group takes equal credit, just as each group needs to take equal responsibility if there are errors. Understanding the differences between generations is fundamental in building a successful multigenerational workplace. I also believe that we need to stop labeling the people we work with. I recently attended an HR conference and nearly every topic was about “how to deal with millennials”. I found this rather interesting as I have never heard of anyone addressing “how to deal with boomers”, or “how to deal with Gen X” as a seminar topic. When we put people in boxes, we tend to see only the gen-
eral perceptions of the people in that box, not the unique talents. Let’s not blame the Millennials for everything that is wrong in the workplace and remember the time when we were shiny and new as well. The Boomers have amazing and rich work experiences and should be regarded as the living historians and culture keepers of your company. If good business is based on understanding others, then excellent business would be based on listening to each other and celebrating what each individual brings to the workplace, regardless of their birthdate. The land of “Working Class America” now has a unique opportunity to learn and prosper from each other, carving new roads and examples for those “Nexters”! N
o, the Stones were not singing about the Federal Reserve in their late sixties counter culture classic, but perhaps parallels may be drawn today. The Fed, like the character in the song, is powerful but not fully understood given the complexity of its craft. Historically our nation’s central bank has conducted its business a bit below the radar, leading some to cast a suspicious eye, including our current chief executive, as noted below. This seems rather an unfair characterization. Not that we need to get all dewy eyed about a bunch of bankers, but I would hope that as a society, and as investors specifically, we could acknowledge the relatively thankless job with which this institution has been charged and accord it the respect it is due. Now, understandably, it can be a challenge to muster warm fuzzies for folks that periodically determine that interest rates must rise, which is the mode the Fed has been in since December 2015. During this time its Federal Open Market Committee initiated eight consecutive rate increases — .25% per hike, a total of two percentage points (200 basis points) — the last of which was rolled out in September, with a ninth bump expected at its late December meeting (this article goes to press 12-11-18). Three weeks after its September hike the Fed was lambasted by President

Trump when he declared to reporters, “I think the Fed has gone crazy”. The irony there being that the president had handpicked Jerome Powell to become the new Fed chair in February. In an eight month stretch (after three rate hikes) Mr. Powell and his twelve-member policy setting committee had suddenly lost their wits. As we know, the Fed also lowers interest rates, though public outcry is minimal at such times. The last rate downdraft occurred from December 2006, when subprime loans first began imploding, through December 2008, by which time major financial behemoths had been eviscerated. During this hellish two-year collapse, the Fed implemented ten consecutive rate decreases that kicked interest rates fully to the curb, lopping off five full percentage points from the Fed Funds rate. Those rock bottom rates, ranging from 0% to .25% for institutions that borrowed directly from the Fed, ultimately produced long term lending rates of 3% to 4% for consumers and businesses, and helped the country get back on its feet. Ten years later, the economy remains solid, and as the adjacent chart attests, apartment owners are faring exceedingly well. The Fed doesn’t need pats on the back. But we do need to let the Fed do its job as the independent body it was intended to be, free of undue influences. Created by Congress and signed into law by Woodrow Wilson in 1913, the Federal Reserve has three primary mandates: (1) maximize employment January 2019
(2) stabilize prices and (3) moderate long term interest rates. A throng of the Fed’s 16,000 employees are numbers crunchers that devote their lives to analyzing the financial ins and outs of our immense $20 trillion annual economy. The Fed’s “game” is to figure out how to make America run in as economically efficient manner as possible given the mind numbing number of variables with which it must contend. No doubt the Fed has its pockets of corruption like every other bureaucracy since the dawn of civilization, but to date no one has figured a better method of running a central bank than the one now in place. To his credit, Chairman Powell recently announced a number of initiatives that will significantly increase Fed visibility and the transparency of its policies and its observations of the economy. This “coming out of the shadows” move is aimed at broadening public support following the president’s harsh criticism. Apartment owners and all US investors should realize that an imperfect Federal Reserve is nevertheless a bulwark of the economic infrastructure that has made America a great nation, and capital markets should be encouraged to have confidence that the Fed will always honor its mandate without bowing to anyone’s particular agenda on Wall Street, Main Street or Pennsylvania Avenue. It takes a thick skin and sturdy backbone to adhere to those principles. Sympathy — continued on page 44

andlords are required to adopt reasonable policies in an attempt to prevent identity theft of their prospective, current and past residents. There are rules and laws that have been put in place that must be followed by

community owners and management company employees due to the handling of proprietary personal information obtained from residents. This policy should be included in your company’s P&P manual. Pursuant to the FTC’s Red Flags Rule which implements Section 114 of the Fair and Accurate Credit Transactions Act of 2003, a landlord may be considered a “creditor” based upon the FTC’s current interpretation because it may collect rent delinquencies and it relies on consumer reports that ask for sensitive information including Social Security Numbers and addresses. The Rule’s purpose is to keep sensitive information secure to prevent identity theft. Identity Theft is defined as “fraud committed using the identifying information of another person”. A Red Flag is defined as “a pattern, practice, or specific activity that indicates the possible existence of Identity Theft.” Identifying Information is defined under the Rule as “any name or number that may be used to identify a specific person including name, address, telephone number, social security number, date of birth, government issued driver’s license or ID #, alien registration number, government passport number,

employer or tax ID #, unique electronic ID #, computer IP address, or a routing code.

Require certain identifying information such as name, date of birth, address, driver’s license or other identification; 2. Verify the applicant’s identity (for instance, review a driver’s license or other ID card); 3. Independently contact the applicant to verify all information provided in the application for residency against information disclosed in the consumer report including prior addresses, complete applicant name and identifying numbers. In order to detect any of the Red Flags identified above for a current Resident, it is suggested staff take the following steps: 1. Verify the identification of the Residents if they request information (in person, via telephone, via fax, via email); 2. Verify the validity of request to temporarily or permanently change billing address; 3. Verify changes in banking information given for billing and payment purposes; 4. Obtain reasonable explanation for rent payments coming from third parties. In the event staff detects any identified Red Flags, it is recommended to take one or more of the following steps, depending on the degree of risk posed by the Red Flag:
Prevent and Mitigate: 1. Continue to monitor an account for evidence of Identity Theft; 2. Contact the applicant or Resident

3. Change any passwords or other security devices that permit access to Resident information; 4. Notify the Program Administrator for determination of the appropriate steps to take; 5. Notify law enforcement; or 6. Determine that no response is warranted under the particular circumstances.
Protect Resident Identifying Information
In order to further prevent the likelihood of Identity Theft occurring with respect to residents and applicants, take the following steps with respect to internal operating procedures to protect resident and applicant identifying information: 1. After holding files for the appropriate time, ensure complete and secure destruction of paper documents and computer files containing resident and applicant information; 2. Ensure that office computers are password protected and that computer screens lock after a set period of time; 3. Keep offices clear of papers containing consumer information; 4. Except for applications for residency, do not request social security numbers; 5. Ensure computer virus protection is up to date; 6. Require and keep only the customer information that is necessary for landlord-tenant purposes; 7. Keep all documents containing resident social security numbers, dates of birth, numbers on driver’s licenses and other ID cards, consumer reports, account numbers on resident financial institution accounts in a secure place, limiting access only to individuals with a

business need for access.
Program Administration
The program administrator, a designated staff member or member of upper management, should periodically review and update the company policy to reflect changes in risks to residents and applicants from Identity Theft. In doing so, consider the prevalence of identity theft in the general multifamily community throughout your state, changes in identity theft methods of detection and prevention, and changes in the business arrangements with other entities your company does business with. If warranted, then update the policy. The designated program administrator is responsible for ensuring appropriate training of the office staff on the policy, reviewing any staff reports regarding the detection of Red Flags; implementing the steps for prevention and mitigation of identity theft; determining which steps should be taken in particular circumstances; and considering periodic changes to the policy. Service providers should also perform activity in accordance with reasonable policies and procedures designed to detect, prevent and mitigate the risk of Identity Theft. You may want to consider, by contract, that service providers have such policies and procedures in place and that they review and report any Red Flags to staff. Did you know that the use of asbestos was never banned and can still be present in new construction? Would it surprise you to know that your maintenance person could single handedly cost you tens, maybe hundreds of thousands of dollars by simply cutting some drywall open to make a water leak repair? According to AQMD’s (Air Quality Management District) Rule 1403, you must first test the drywall and joint compound prior to any renovation activity or minor repair if you are having an unlicensed contractor involved. Some property management companies or homeowners may have gone to the expense of sending their maintenance person to asbestos awareness training giving them the false sense of security that this certification is all they need to protect themselves. That couldn’t be farther from the truth! All that awareness course is designed to do is educate the maintenance person to identify risks associated with asbestos and at best stabilize the material so testing can be done.
