everal month’s ago, a reporter from the Orange County Register called me for insight regarding rental rates in Orange County. Specifically, the reporter wanted to know if I was worried that Orange County’s rents (according to research he had obtained) were only up 3% year-over-year as opposed to places like Los Angeles that were nearing double digits. What’s more, he wanted to know if I was worried that we had dropped several spaces nationally in the “rent growth ratings” he had obtained and that our current growth rate was below last year’s of 5%. My response was simple: Buildings are full and rents are on the rise — it’s a great time to be an apartment owner. Really no science to my quote whatsoever, just happy to be here in 2015 and having emerged from the depths of the early 90’s and most recently 08-10 when this business was not so fun. Past the Sell By Date Fast forward three months and I have now seen this quote broken down, regurgitated and reprinted in no less than 2 blog posts and 3 printed articles by the same reporter. It’s even more amusing to read the manner in which the quote is split up and reused. 4

“Tenants were forced to move as rents increased.” OK, cue that Dunlap guy’s quote. “Families feeling the pinch and barely getting by…” Yeah, it should work there, too. Who knew that in such a genuine, grateful and transparent statement, my words would be used against me? No, I am not so naïve, but it does bring a smile to my face every time I come across the quote in a new article. Sadly, there is so much going on in the world and in the economy today and yet our local media seems bent on creating a “frenzy” or “crisis” out of the rental market rather than cover the real news. There is a key difference between creating a story and covering the news. Real reporters will cover the news and tell a story, not create one. But yes, the reporter’s work does have a special place on my dartboard and beneath my coffee mug. Being the Bad Guy Sure, in the court of public opinion landlords are situated somewhere between the IRS and politicians in terms of society’s least favored people. But the flak that we get for being positive about the operation or outlook of our business is just so ridiculous that it becomes even more nonsensical when applied to other fields. Could you imagine a prizefighter the day of a fight, “well, not much of plan so I’ll just go into the ring and take a beating.” Or what about Arte Moreno, owner of the Los Angeles Angels of Anaheim

speculating on the team’s playoff hopes. Do you think Arte would ever not pick his team to win? Of course not! And yet I am expected to tone down my satisfaction with the current performance of the rental market and the underlying fundamentals of the investment real estate market. That’s right, I should hope my team loses and just be content with that. For those of us who have experienced multiple real estate cycles and focused on multifamily housing, we understand the impact of supply and demand on our industry. While the general public might believe the media, I say don’t buy the hype. Continue to focus on operations, creating and adding value to your properties and your portfolio. Prepare to close 2015 strong and start 2016 even stronger. And next time you’re misquoted or misunderstood, I hope you smile and think of me. F

rom time to time I like to turn the column over to an Orange County elected official to help make the point. This month I offer to you California State Assembly Member Bill Brough. Brough represents the 73rd assembly district covering most of South Orange County and is a former Dana Point City Councilmember. On June 6, 1978, a political earthquake rumbled through California in

the form of Proposition 13 — officially named the “People’s Initiative to Limit Property Taxation” and enshrined in our constitution as — what else? — Article 13A. It came 34 years to the day Allied forces stormed the beaches at Normandy, but for California taxpayers, this was, and remains, their D-Day. Following years of punishing property tax increases that drove thousands from their homes

and threatened many more, the voters rose up. The measure did one thing right away: Set property taxes at 1976 assessed values and limited tax increases to two percent a year as long as the property remained unsold. But it did something even more profound for everyone else in California: Required that all state tax increases be approved by a two-thirds vote of the

legislature and that local tax rates also be approved by a vote of the people. To critics, this is Prop. 13’s original sin: It placed a public vote and a legislative supermajority between the desires of big government and the people’s pocketbook. The special interest spending community has despised it ever since. Like clockwork, liberal commentators, academics and politicians will flatly state that California’s economy and governmental systems never recovered from the passage of Prop. 13. Critics have also compiled an increasingly ludicrous list of troubles attributed to the initiative, making it California’s own Keyser Soze — a mythical malevolent measure that can be blamed for everything and anything. But it’s a lie. And it was always a lie. The state’s budget grew from $55 billion in 1980 to $97 billion in 1992 to $167 billion this year — all record highs. Only in California can this be considered inadequate public revenue. To date, Prop. 13 endures as the state’s most mainstream political belief. Many believe that the initiative’s standing is everlasting. But that’s not true. I’ve come to this conclusion after a recent San Francisco field hearing of the Assembly Revenue and Taxation Committee. I was the only member of the GOP on the panel that day (reports that I was also the only Republican in

all of San Francisco can’t be confirmed). Along with the usual rage against Proposition 13’s ideals, I witnessed an unmistakable organized and strategized plan to overturn it once and for all. First, Democrats have opted to kill the slight fix to Prop. 13 (that they once insisted upon) inspired by tech entrepreneur Michael Dell’s controversial property swap. This matters because rather than pursue a small reform to Prop. 13 that might draw bipartisan support, they will, instead, insist it can’t be fixed and must be completely dumped. Next, Democrats have advanced not one but two special sessions organized around a central question: How much should we raise taxes on hardworking Californians? If Republicans don’t stay united, it will happen for sure. This is not just the latest asymmetrical blaming of Prop. 13. These are the rumblings of an approaching force. As never before, California’s collaborative of special interests and the Democrat Party that exists to serve it, believe now is different. They believe the historically weak Obama economic recovery, combined with high unemployment and low growth for those who need it most, will ironically inspire voters to open the floodgates to new and higher taxes at the state and local levels.

They believe that having mobilized a massive coalition and tens of millions of dollars in 2012 to con enough voters to pass Prop. 30, (the first voterapproved statewide tax increase in a generation), the blueprint to repeal Prop. 13 is obvious. Republicans often say we must ask voters if they agree with the Democrats’ agenda. This is fine, but in times like this, we must do more. We must ask ourselves: Do we have the resolve to save Prop. 13 like the Democrats have to destroy it? If we do, I am convinced we can preserve the spirit of the most important initiative in California history. If we don’t, then a different kind of D-Day will have occurred — with far less honorable results. Thank you Assemblyman Brough. You help make the case for property rights here in Orange County and across the state. The fight goes on.

of perennial concern. The Capitol is replete with the usual gathering of interest groups and parades of public involvement relating to specific proposals. It is the nature of politics that there are differing views on these subjects. Is the glass half full or half empty? That common template was augmented this year by an unusual display of real citizens of diverse backgrounds willing to tell their personal stories of gut-wrenching loss and sacrifice. By the dozens, then hundreds and perhaps even thousands swarmed the Capitol to express their concern over proposed legislation to strengthen the existing mandate for measles vaccination for public school children. Spawned by the Disneyland measles outbreak and its eventual spread to other states and foreign countries, the proposed legislation eliminated the so-called “personal” exemption from mandated measles vaccination for public school children. The media reported widely on the critical events surrounding this change in the “opt out” proposal, which eventually passed the Legislature in a significantly modified form and was approved by Governor Brown. No other proposal of recent memory generated such an outpouring of private citizen involvement with little to weak organization. Its author is facing a possible recall election. Another similar bill of significant public involvement in personal affairs relates to an effort to permit “assisted suicide” or “dying with dignity.” Like the vaccine bill, this measure too evoked

the depths of personal grief and understanding. It also brought real people to the Capitol to relate their intimate stories. That measure could be acted upon this week. These two highlighted bills serve as important reminders that legislative activity at every level…federal, state and local…affect real people. Of course, individual circumstances necessarily vary according to the extent of the particular proposal. With apartment living on the rise in the wake of home ownership decline, it is more significant than ever to be reminded that every landlord-tenant bill presented in the Legislature affects nearly half of California’s population. Whether it’s permissive or mandated action on the part of one or the other of the players in the game, both owners and tenants are affected by the balancing act performed by our legislative representatives. The depth of personal angst in a particular rental situation has been paraded before the Legislature on other occasions and will no doubt arise again upon consideration of future proposals. But the need for balance must always be kept in mind, a difficult task in this contentious environment. Case on point: The mold bill (SB 655) received final Senate approval on a 25–14 vote, with local area Senators Huff, Moorlach, Morrell Nguyen, and Stone voting No. A balanced bill? Not really unless you support the decision of a code enforcement officer’s best guess based upon “I know it when I see it”

standard. An earlier Assembly vote (44–28) found our local area Assemblymembers opposed or not voting: Allen, Brough, Daly, Chang, Harper, Kim, Linder, Mayes, and Wagner. Another timely example: The bed bug bill (AB 551), now pending on the Senate Floor, has much to commend it for some balance; but still would require owners to give a lengthy personal notice by January 1, 2017, to every tenant in California generally describing the noxious bug. have the misfortune of a classic problem tenant. The noise, the parties, and the trash…I don’t know where to begin. She’s on a fixed term lease; she’s bad enough to get under my skin, way under, but probably not bad enough to evict her. She’s paid her rent late for each of the past three months. The lease has a late fee provision, charging an additional $50.00 if the rent is not received by the 5th. She’s been paying

both the rent and the late fee well into the second week of the month. Last month, the first of the month fell on a Saturday. So I served her a 3-Day Notice to Pay Rent or Quit on the 2nd. Was that proper, or should I have waited until after the 5th of the month to serve the Notice?

If rent is due on the first of the month, and the first of the month falls on a weekend or a holiday, the tenant has

until the next business day to pay the rent. The rent is considered late the following day. In your case, since the rent came due on a Saturday, the rent due date would roll to Monday, the 3rd, and the rent would be considered late on Tuesday, the 4th. Q&A — continued from page 10 Regarding your question about whether or not you must wait until after the 5th of the month to serve due to your late charge provision, the answer depends on the specific language used in your rental agreement. If your lease states that “rent is due on the 1st of the month, but will be considered late if not paid by the 5th,” then your lease defines when rent is late, and a notice served prior to the rent becoming late would be premature. Conversely, most leases merely establish time periods before late fees kick in, but do not alter when rent becomes late. For example, if your lease states that “rent is due on the 1st of the month, and if the rent is not paid by the 5th a late fee of 6% will accrue,” then the clause is merely establishing when a late fee accrues, and does not change the rental due date. In this second scenario, you may serve a 3-Day Notice to Pay Rent or Quit on the 2nd of the month (provided the

I’ve been trying to get into one of my units to do some repairs and my tenant is giving me grief. Funny thing, it was my tenant who first complained that the toilet runs constantly, wasting water, yet he’s been stalling and is never available to let me in to make the simple repair. It’s been over a week, and he still won’t let me in, what do I do? What are the general rules regarding my right to enter the unit?

Tenants are required to provide access to the landlord for certain limited purposes, including performing needed repairs, pursuant to California law, and also pursuant to standard lease provisions requiring such access. The landlord must give the tenant reasonable notice of intent to enter the premises, in writing, and enter only during normal business hours. Normal business hours are not codified, but are generally

accepted to be Monday through Friday from 8:00 a.m. to 5:00 p.m. The notice must specify the date, approximate time, and purpose of the entry. No written notice is required when the tenant and the landlord agree orally to an entry for the purpose of making repairs or supplying services that the tenant and the landlord have agreed on, but the oral agreement must specify the date and time of entry, which must occur within one week of the agreement. No notice is required at all if the landlord enters in response to an emergency, if the tenant is present and consents to the landlord’s entry at the time of entry, or after the tenant has abandoned or surrendered the premises. The written notice of entry may be mailed, but the presumption of reasonableness of the notice will not apply unless the notice is mailed at least six days prior to the entry. Alternatively, the written notice may be personally delivered to the tenant or left on, near, or under the usual entry door of the

premises in a manner in which a reasonable person would discover the notice. Special advance notice procedures may be used to facilitate showing the unit to prospective or actual purchasers. In that event, the landlord may give oral notice, in person or by telephone, with at least 24 hours being presumed reasonable, if the landlord or its agent has given the tenant notice in writing that the property is for sale within 120 days before the oral notice. The oral notice must specify the date, approximate time, and purpose of the entry. The landlord may not abuse the right of entry or use it to harass the tenant. If your tenant refuses access after you have served the requisite notice, then you should serve a three day notice to cure breach of covenant or quit. The notice will specify the breach, the failure to provide access, and instruct the tenant to allow access within the three day cure period. If the tenant fails to provide the required access, then you may file an unlawful detainer action to terminate the tenancy and recover possession. Rarely is the filing necessary, as the vast majority of tenants comply.

Several of my older rental agreements provide discounts to my residents of $50.00 if they pay their rent on time. Most state that their rent is $1,200, but if they pay their rent on the first, they can deduct $50.00. My question is, which amount do I put on the three-day notice to pay rent or quit, the $1,200 or the $1,150?

Most courts would require that the three-day notice only demand the $1,150.00. Most courts would consider the additional $50.00 a penalty or a disguised late charge. The courts would reach this conclusion based on the terms of your agreement. If the due date, per the agreement, is the first, then the proper amount to demand is that amount that was required to be paid on the first, specifically the $1,200.00. However, an incentive that encourages

An owner is not generally liable for damage caused to the personal property of a tenant, absent negligence on the part of the owner or his agents. Provided a licensed roofing contractor performed the roof installation, you

maintained the roof adequately, had it inspected on a regular basis, and were not on notice of any prior problems, you should not be responsible for damage to the resident’s personal property. Additionally, the tenant has an obligation to mitigate his damages when faced with a leaking roof. This basically means that if the leak was coming slowly through the roof, and the tenant knew about it, then he should have taken some measures to minimize the damage to his personal property.

he “summer of Trump” has come to a close, so now we will see whether or not “the Donald” can continue his dominance of the GOP presidential field into the fall. He continues to poll well with a commanding lead over everyone else, but there are more debates coming and he has shown some difficulty in responding to questions of policy, especially on foreign affairs issues. Style-over-substance

only carries a candidate so far before he or she must show some ability to tackle the issues. Look what happened to 2012 front-runner Rick Perry when he couldn’t remember the name of one federal agency. I suspect the mortar fire will increase on Mr. Trump during the next debate as the other candidates all recognize they have to bring him down to have any chance of winning. Moreover, too many people think she is untrustworthy. At the same time, Bernie Sanders continues to draw record crowds and poll very strongly with primary voters. The new x-factor is Vice President Joe Biden who is no stranger to Democratic Presidential primaries (1988, 2008), has a strong base of support among Democrats, but does not really seem excited about running. It has been a tough year for the Vice President and his family so one can understand the hurdle he must get over to commit to run. In the House of Representatives the fall months will have more than

the Presidential contest as backdrop. There is also the small matter of the attempt by a group of House Republicans to oust John Boehner (R-Ohio) as Speaker. Discontent with Mr. Boehner among the conservative ranks is not new as evidenced by the 25 House GOP members who voted against his election for Speaker back in January. What is different is taking the aggressive step of actually filing a motion to formally strip him of his rank. While that motion did not require a vote, the consensus is that a vote will take place at some point this fall. That vote will be impacted by what the Speaker does on pending legislative business, including the federal budget, efforts to defund Planned Parenthood and his support for a government shutdown if it comes to that. As many

Washington observers have pointed out, even if someone is elected to replace Boehner, the President will still have the veto pen for another 15 months. What will change in the calculus on these issues? One of the biggest issues in front of Congress is the Iran nuclear agreement negotiated by the President and several other western European countries. Congress argued quite strenuously months ago that they should have a say in whether that agreement goes forward so they passed the Iran Nuclear Agreement Review Act of 2015 by a vote of 98 to 1 in the Senate and 400 to 25 in the House. Under the terms of this agreement, the Congress would be voting on legislation to disapprove the agreement rather than approving it. This process illustrates what some would call a cynical and others would characterize as a pragmatic way to govern. Here is how it works. To pass legislation requires 218 votes in the House and effectively 60 votes in the Senate (see “cloture”). Using a vote to disapprove versus approve the Iran agreement is not relevant in the House where the majority rules but is very relevant in the Senate. That 60-vote threshold lowered the number of votes needed to defeat the disapproval legislation, kill the overall effort in Congress and protect the

Iran deal to 41. Had the vote been to approval the agreement, supporters would have needed 60 votes. And, indeed that is what occurred with a 58 to 42 vote blocking consideration of the agreement and paving the way for its implementation. Even if the 60-vote threshold was met and the bill passed, the President would have vetoed it and the Senate would then have needed 67 votes to override or, put another way, supporters would have needed 34 votes to sustain the President’s veto and allow the agreement to go forward. In short, the process was arguably tilted to defeat efforts to stop the agreement from moving forward. Again, Congress voted almost unanimously on setting up this process. Why? Obviously, no one is on the record stating that the fix was in but, according to Norm Ornstein, a longtime observer and scholar of Congress at the American Enterprise Institute, once the Administration made the deal with the other nations and had the endorsement of the United Nation’s Security Council, opposing it would make Congress and the U.S look bad. More broadly, Ornstein noted, there is a long tradition in both Republican and Democrat Congresses of allowing members to vote no without affecting the ultimate policy outcome. Another example where this is used is with the federal debt ceiling. No one wants the nation to default on its debt so the process is set up to allow members of Congress to voice their opinion, vote against increasing the debt but not damage the country in the process. Dear Margret: The extended drought we are experiencing is tough on everything and sacrifices must be made. However we think a line must be drawn at our trees. The method we recommend to save the trees and still be draught aware is in the use of soaker hoses. The placement of the soaker hose is important. Visualize the shape of a tree with its truck and canopy of branches and leaves. The edge of the canopy is known as the “Drip Line” of the tree. This means that any “rain” or moisture that falls on the tree will be absorbed by the tree’s feeder root system at the drip line. To take advantage of these thirsty roots, place a soaker hose at the drip line or edge of the tree’s canopy. A soaker hose is very water efficient and puts water exactly where you want it. Water the trees at least twice a week and for a couple of hours at a time. The water will soak deep into the soil where it is needed without waste. The trees will be much happier and you will be using and conserving water efficiently. Dear Maintenance Men: I am trying to do my part to conserve water and have found my toilets are the biggest offenders. The toilet constantly fills every five or ten minutes. I have replaced the fill & flapper valves but the problems persist. I’m at my wits end about this! What can I do besides replacing the toilets? Benjamin

Dear Benjamin: Leaks at the Flush Valve are possibly caused by a damaged flush valve seat which may have a hole or the rim is pitted or cracked. The seat is the large drain hole at the bottom of the tank. A temporary repair may be to sand the seat with a steel wool pad or wet/dry sandpaper. This will remove the calcium build-up. If the seat is damaged, replacing the seat will be the next option. “Fluidmaster, Inc” makes a Flusher Fixer Kit that can be cemented directly on top of your old worn flush valve seat. This is a quick fix that may not work on all toilets. If the seat kit does not work, you will need to replace the valve seat. This can be accomplished by removing the tank from the base of the toilet: Turn off the water to the fill valve, disconnect the water line and remove any water from the tank. Unscrew the two or three brass bolts under the tank and carefully lift the tank off. Once the tank is removed, turn it upside down. Remove the rubber “Spud” washer from the tank. Spin the large nut from the threads and then push the valve seat through the tank. Reverse the procedure when installing the new valve seat. The new flush valve will give the rubber flapper a smooth seat for a positive seal. Dear Maintenance Men: I hear people talking about winterizing their buildings. I grew up on the east coast were that meant something! In Southern California, what “Winterizing” could we possibly be doing? Jonathon Dear Jonathon: In California and many western states, “Winterizing” simply means we switch from light shorts and white T-shirt to dark shorts and a long sleeve T-shirt! When it comes to your building, “Winterizing” California style is simple. Start from the top and go down. Inspect your roof; replace any loose BUFFALO.AD.Resized:Layout 1 3/1/12 tiles, shingles etc. Caulk all flashings

around fireplaces, vent pipes, siding to roof transitions and skylights. Remove any junk on the roof, clean your gutters, and secure any loose gutters. Test your gutters with water to make sure they are pitched correctly and check your gutter downspouts; make sure they direct the water away from the building. If you have any floor drains, clean out and snake them. Caulk any wood seams, window trim, stucco cracks, vents and any area that might soak in water during a rainstorm. Check your sprinkler timers and adjust the duration and days watered. Depending on water restrictions in your area; to keep your grass green all winter; fertilize and seed with Rye grass. During windy, rainy weather, trees may touch both the side and roof of your building, trim any branches that may cause damage. Secure any weak or young trees or bushes that may fall in a storm. These simple winterizing steps will help keep you dry and off of the roof during 5:37 PM weather. Page 1 winter

12 Tips: How to Locate Property within California BY ELIZABETH REYNOLDS

W

hen locating a new property, engaging the right property management firm is key!! Here are twelve strategies to locate new properties. 1. Distressed properties. These offer the best opportunities for creating value. Be sure to avoid floor-plan obsolescence and structural problems. Analyze the property as if you were going to live in it. Partner with your property management

firm to get bids on costs for easily solving problems, determining your optimization plan, and offer price for that asset. 2. Vacant properties. Keep an eye out for properties with boarded window or doors, those that are lacking cosmetics, landscape, maintenance, or repos and shells. Determine what would be the highest and best value for that asset.

3. Auction houses. There are numerous auction houses nationwide. Call on auction houses in advance to understand the acquisition process, list price versus sales price, and know how much you are willing to pay for property based upon its true value. 4. Are Applicants Giving You Fraudulent Paystubs? BY BECKY BOWER

owners, students and entrepreneurs (where providing income information for rental and credit applications is very difficult), those outside services are extremely relaxed on their requirements for accuracy. Paystub companies depend on the honesty of the person buying the income document and, while honest applicants do exist, no 3rd party verification is conducted. Protect yourself from the possibility of accepting counterfeit paystubs by cross referencing the information listed on the applicant’s credit report —

reating fraudulent documents has become easier as technology has improved. With just a computer, printer, scanner and Photoshop software, fabricating fake paystubs can be done at home. Even online paystub services like stubsamples.com and speedystub.com generate paystubs based on the information put in by the user for an inexpensive fee. While these services might seem like a good idea to applicants who are independent contractors, business

employment section. Another step is to do an online search of the employer listed on the rental application and call to perform a verbal verification. When asking for proof of income for tenant screening, be aware of how your application process can help undocumented applicants apply. Tell ‘Em What You Can Do BY NANCY FRIEDMAN, THE TELEPHONE DOCTOR

O

ne of the most abrupt and shocking forbidden phrases you can say to a customer is, “We can’t do that.” These words close the door on the customer’s request as quickly as does its close cousin — “That’s our policy.” Everyone has heard the “We can’t” phrase before, and we’ve heard it used in situations in which we could imagine a reasonable alternative. Telling customers “We can’t do that” doesn’t help them. It’s a dead end. Customers are only concerned with

what you can do, not what you can’t do. The solution is to remove the “We can’t” out of your vocabulary when speaking with a customer. Instead, offer suggestions of what you can do for them. We call this a positive alternative. Consider this scenario in which someone calls their local government asking for help with a problem: Eric: “Good afternoon, county assessor’s office. This is Eric.” Customer: “Yes, I need to talk with your appraiser. I just received my new

real estate tax bill and it’s way too high. Now, I work until a quarter to five, but I’m just a few blocks away. Can someone meet with me just after 5 o’clock?” Eric: “Ohhh, we can’t do that.” Here’s a far better way to handle this situation: Eric’s positive alternative: “Well, here’s what we can do. We’re only open until 5, but let me transfer you to Mark Murphy. He’s one of our appraisers. He Tell ‘Em — continued on page 32

If you’re able to hold, I’ll transfer you to Mark.” Here’s another example: A man calls a local retailer and asks if they have a particular sales item in stock. “Yes. We still have three left. We’re open until 5:30 today,” the clerk replies. “Unfortunately, I’m out of town on business today. Is there any way you could hold it for me until tomorrow morning? I’ll be in to get it.” The clerk is aware their policy does not allow sale items to be placed on hold, but instead of saying, “We can’t do that,” the clerk responds with the positive alternative: “If you’ve got a moment, I’ll talk with my supervisor and see if we could take a credit card number from you over the phone. That way we could hold it until you pick it up.”

The important thing to remember is that every time someone repeats, “We can’t do that,” a customer likely is lost. The key is to replace that forbidden phrase with a positive alternative: “Here’s what we can do.” Remember this theme, don’t tell them what you can’t do, tell them what you can do!

El Nino is Coming…Are You Prepared? BY JOHN MCCARTHY, MCCARTHY ROOFING

I

can’t say with 100% certainty we will experience an El Nino this winter. No matter what predictions you may hear. I can say everyone needs to be 100% confident their roof will be ready if it comes. If you aren’t familiar with the term, El Nino, it means more significant rainfall for Southern California due to the prolonged warming in the Pacific Ocean and sea surface temperatures. The likelihood, although speculated, according to the NOAA’s Climate Prediction Center, is that there

is greater than a 90% chance that El Nino will hit this winter and continue into the spring of 2016. How much additional rain can we expect? There is no real way to predict the percent, but if history is any indication, we could experience up to 13.68 inches, which is what we got in February of 1998. Has it been a few years since anyone has looked at your roof? If so, you should have your roof inspected by a licensed roofing contractor. This will give you the knowledge of any needed

repairs and what the cost will be. Or, hopefully, the peace of mind your roof will hold up to no matter what comes this winter. To be prepared in any event, develop a recovery plan and provide emergency roofing contacts to your property managers. If you think you are one of the lucky ones that won’t be affected, and don’t take the above recommendations to heart, you might just hear the following El Nino — continued on page 42

igher apartment rents are being widely reported and this always stirs the pot a bit. The adjacent chart illustrates the recent trends. RealFacts reports that in Orange County in Q2 2015 year over year percentage rent increases were 8.4% for one bedroom, 6.3% for two bed / one bath and 5.9% for two bed / two bath (based on 100 unit + properties). Blending all unit types together (studios to 3 bed), RealFacts shows an overall 6.9% increase year over year on apartment rents in Orange County and a 7.7% upturn nationwide. Some will look at the recent figures and claim that rent increases of this magnitude are excessive in light of an otherwise docile inflation rate of .8% in southern Cal and .1% nationally over that same period. As the question could perhaps be framed, “why should apartment rents increase at a significantly faster clip than CPI?” For perspective, let’s back track seven years to see how rent levels in OC have fared as we’ve emerged from the financial meltdown/recession era of 2007–2008. In Q2 2008, Realfacts shows the average rent on an Orange County 2/2 unit was $1,829/mo. Rents dropped by 7% over the next two years, with Q2 2010 2/2 rents slipping to $1,700/mo, i.e., $129/mo lower that what tenants were paying for the same unit type two years earlier. By Q2 2012, the rental market had improved and landlords were collecting

$1,844 on the same 2/2 unit, or, 1% above the Q2 2008 level. Fast forwarding to the Q2 2015, current rent on a 2/2 unit in OC has climbed to $2,090, which is 14.27% above the $1,829 rent level of 2008. With that metric in mind, let’s circle back to consider whether today’s $2,090/mo 2/2 rent in OC is “excessive”. Over the past seven years OC rents have increased about 2% annually. That is not excessive or overreaching in my book. There’s ebb and flow within markets. Dynamics shift and evolve. We have to permit investors to recoup losses from down years when market forces allow, meaning there will be disproportionately greater returns in some years. That’s a healthy and a necessary phenomenon in a free market economy. Thus, the upward trend in rent levels does not give cause to indict the rental housing industry. Sure, we’re now in a landlord’s market, but tenants clearly had the upper hand from 2008 to 2010. And yes, apartment owners, like all other investors, will seek to maximize returns on their investments. That’s no bulletin. Nor is the fact that tenants and all consumers will always seek to pay as little as possible for the goods and services they purchase. That is the capitalism model. Simply two sides tugging on opposite ends of the rope to gain the greatest possible pricing advantage. Mess with the purity of that basic model by intervening to aid one

side or the other and unintended consequences tend to occur. That said, without question, government plays a vital role in maintaining order and regulating many markets. It’s the when, the how and the degree of such regulation that are our ongoing challenge. Capital and liquidity—both vital to fuel a sound economy—are fickle. They can spook and withdraw if market dysfunctionality or overweight government interference is sensed. In China’s “state capitalism” system (government dictated economic infrastructure blended with private enterprise), recent events have exposed the risks of public sector orchestration of market functions. Specifically the Yuan had become so over-manipulated by Beijing that attempts to re-work it backfired. As of this writing (9-7-15), the financial debacle that ensued had amputated a staggering 38% in value from their stock market from their mid-June high and precipitated significant outflows of capital. Not to say that China and the US rental housing industry are perfectly analogous, but I’ll use the comparison to make this basic point: Let’s trust and defer to market forces to the greatest extent possible before “re-engineering” a marketplace. So please, no panic button pushing needed on apartment rents at this time.

s a property management executive, strategic reference “information” shared by your leasing teams with future residents is an excellent way for them to demonstrate their industry knowledge, professionalism and will significantly increase their leasing performance. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums.
