Halloween Tricks from Sacramento; Treats from AAOC
A
s of the writing of this article, it seems the State Legislature is handing out Halloween tricks but no treats to our industry. No candy. No rewards. No breaks. Just punishment for those who provide much needed rental housing in their communities. In case I was unclear, I am incensed that our elected officials would treat the largest small business enterprise in the State of California as a petulant child. I say allow the market and consumers’ choices determine the rental rates. Our consumers, both current and future tenants, are perfectly capable of determining what rental unit or home is appropriate for their needs. We are now just a few short days away from AB 1482 becoming law. In the latest update to the bill, the proposed rent cap was decreased from seven percent to five percent, plus CPI. I fear that in future legislative sessions proponents of rent control and rent caps will argue that five percent is too high, and an even lower cap is what
renters in California really need. Equally egregious is that the sunset provision was arbitrarily increased from 3 years to 10 years. I want to thank all AAOC members who have called their elected officials to voice their opposition to this disastrous piece of legislation. I can’t tell you how many times we have visited elected officials, in Sacramento and in their district offices, and they have said “thank you to the members of your association for their calls.” I assure you that your calls and time are a tangible benefit to our cause. On a positive note, I would like to reflect on the abundant opportunities and events that AAOC presented in the month of September. Provider program graduates, and the kickoff of our Welcome Home OC partnership with Orange County United Way. We also held our PSC Roundup, our quarterly Multifamily Mingle networking mixer, and our annual Angels night and tailgate on the final Saturday of the regular season. This month we are hosting two more premiere events, the first being our General Membership meeting on October 15 at the Great Wolf Lodge. AB 1482 Passes State Legislature. Prepare to Do Business Differently
B
y the time this issue of Apartment News hits mailboxes, you will almost certainly be aware that AB 1482 (Chiu) was passed by the California Legislature and sent to Governor Gavin Newsom to officially be signed into law. This means California rental property owners and operators will be required to change how they do business when the law takes effect on January 1, 2020. On September 11, 2019, AB 1482, the statewide rent cap and “just cause” eviction bill passed the State Assembly one day after the State Senate approved the measure. The votes came after Governor Newsom and his staff had finished brokering a deal with legislative leadership and certain stakeholder groups aimed at clearing a path for the bill’s passage. Following the vote in the State Assembly, AB 1482 was sent to the governor’s desk for his signature, but as of the writing of this article on September 13, there has been no indication when he will sign the bill into law. However, I am certain there will be a big signing ceremony and a proverbial victory lap that will be taken by state law makers, tenants’ rights advocates, and others. Who would have thought that less than one year after California voters solidly rejected statewide rent control measure Proposition 10, the state legislature would blatantly disregard the will of the people by passing a bill that effectuates statewide rent control for at least the next 10 years?

So, where does the rental-housing industry go from here and what exactly is the industry looking at in terms of compliance with the new law? There are many questions still to be answered and more of the details regarding how the law will be implemented and enforced should come into focus in the coming weeks and months. AAOC will continue providing updates on the new statewide rent cap and just cause eviction law in Apartment News. Additionally, a comprehensive member briefing is presently being planned for this fall. For now, here are some basic changes that rental property owners and operators can expect when the law takes effect on January 1, 2020: • On a statewide basis, all rent increases occurring after March 15, 2019 will be capped at 5% per year plus the change in cost of living, as measured by the Consumer Price Index (CPI). • “Just Cause” evictions will be implemented for all tenants who have lived in a rental unit for at least 12 months. • Single-family homes are exempt under the law unless they are owned by large corporations, REIs or LLCs with at least one corporate member. • Relocation assistance in the equivalent amount of one month’s rent will be required to be paid to tenants for no-fault evictions within 15 days of notice being served.

Finally, I would like to thank our members, staff and association leadership who actively engaged our state legislative representatives and advocated in opposition to AB 1482. While our efforts did not result in the bill’s defeat, I am proud of how we banded together and fought hard and respectfully over the past seven months. AAOC never waivered in its opposition to AB 1482 and our association leaders and other representatives were equally as strong and consistent in their dealings with state lawmakers and other stakeholder groups. I also want to acknowledge the advocacy efforts of our California Rental Housing Association (CalRHA), which sought to keep the collective interests of California’s multi-family housing industry at the forefront of its discussions and negotiations. And, finally, I want to thank the California Association of Realtors, and particularly the Orange County Association of Realtors and Pacific West Association of Realtors, for standing with our rental property owners, operators, investors, and brokers in the final days of the legislative session and amplifying our shared concerns and reasons for opposing AB 1482. The Future of Housing: Framing the Discussion (Part 1 of a 3-Part Series) With hundreds of cities and counties across America trying to deal with a dearth of housing stock, public officials at all levels are getting involved. Whether these policymakers are in the early stages of debate or actually implementing changes, rental property owners are being painted as the villains. As long as that narrative continues, the one’s with the most to lose will continue to be left on the outside of the discussion; with minimal opportunity for feedback. California Strategic Advisors will be publishing a three-part series that examines the future of housing and provides viable solutions to ensure rental property owners are substantial players in the process. This month, in Part One, we examine the current housing climate.

hile campaigning, Governor Newsom stated he would address the housing shortage in California by committing to the development of 3.5 million new homes by 2025.1 Eight months later and experts have noted that have has been a 16% decrease in housing production compared to last year. Attempts such as withholding funds from local governments that do not approve new housing have been greatly watered down, with many believing the new policy has no enforcement mechanism and is unlikely to yield results. 2 The situation from last year has been exacerbated by increased material costs, new and higher govern1 https://www.latimes.com/opinion/story/201908-02/housing-crisis-permits-california 2 Id.

ment fees, placement of new density requirements, heightened neighborhood resistance, shortage of construction workers, impact of housing in high fire severity and flood zones, and restrictive lender requirements. These are issues that cannot be fixed with the signing of a pen and will likely still be issues next year. The proposed solutions place a greater weight on property owners than developers. This year the Assembly Housing committee estimated that over 200 housing bills were introduced by legislators. Solutions like SB 50 (Weiner), which removes single family zoning in areas within half a mile of a transit stop, seek to create state control over zoning issues, typically left to local governments.3 While the bill died in Senate Appropriations, many legislators have already publicly claimed they will push for it to be passed next year.4 Weiner’s proposed solution would not create immediate relief, but it would be a boon for developers as multifamily units have proven to be a greater windfall than single-family homes. Other state legislators have sought to focus on the current costs of rent. Assemblymember Wicks took a “softer” approach and pushed for a statewide registry on

all rental properties in the state.5 Such an approach delays a solution but equips the Legislature with data to push harder on rental owners. Assemblymember Chiu’s solution is by far the most extreme attack on rental owners; AB 1482 would place a cap on rental increases while allowing local counties to make the cap as low as they believe is reasonable.6 None of these solutions increase housing in the short term, but they do an excellent job of shifting the burden away from those charged with ensuring California takes care of all its citizens. The media has certainly contributed to the fearmongering of housing but to suggest it is all fake news would be a gross overstatement. homeless. The reason this has become a rental owner’s problem is likely due to many claiming they became homeless due to the high rise of rent and evictions. As Forbes.com recently noted, the media is playing “fast and loose with eviction data,” the Forbes story is correct that the eviction data is being misused to paint a picture of rental owners as the problem.9 Unfortunately, just because the media is confusing correlation with causation does not mean that housing issues are completely fabricated. Forbes suggests combatting this exaggerated narrative with more facts and data, but in politics a good story sells far better than empirics. When thousands of people are rallying across the state it at least forces the hand of Legislators to do something. The biggest problem for rental property owners is their image. Stale Legislature; even though we know that terminology is fraught with its own negative connotations. This characterization has allowed housing advocates to suppress your voice and in turn remove you from the policymaking process. Lobbyists can articulate your points, but when the general perception is that you are the villain it is increasingly difficult to offer substantive solutions and be taken credibly. To adjust the rental owners’ image will not require millions in funding and a brand-new PR campaign. Instead, it requires being seen as one of the groups willing to engage and fight for a solution. Moving away from a perception of being reactive to one willing to ask the hard questions and make the tough choices. Some of these choices could feel like cutting your nose off to spite your face, but as the next edition of this series will argue, sometimes we must sacrifice in the short term to gain meaningful change in the long term. Statewide Rent Caps are Bad, But Things Could Be Much Worse
Y
ou should be glad if you don’t own rent-controlled multi-family units in the city of Santa Monica. Our neighbor to the north has had a rental housing crisis for 40 years that is much worse than the rest of California. Santa Monica is a beautiful seaside town founded 145 years ago. Movies and TV shows have profiled the rich and famous who grace its sun-drenched streets. But lurking behind this glamorous façade are some of the most severe rent control laws in the country. The proponents of rent control have said they want to keep neighborhoods stable and affordable throughout the city, but it is a 40-year-old pipe dream. According to HUD affordability standards, only a household with an income above $100,000 could afford a onebedroom or larger unit at the 2018 Santa Monica median rent. Rent control is strangling this popular city. Since 1980, only about 8,600
total new housing units have been produced and despite the lack of housing construction, Santa Monica has not become any less of a desirable place to live. Rent control laws have not increased housing affordability. There were almost 39,000 rent-controlled apartment units available when the Santa Monica rent control law took effect in 1979. Now, after 40 years of rent control, there are only 27,445 rentcontrolled units left in a city with a population of almost 90,000 people. Since 1979, there has been an elected Santa Monica Rent Control Board with five members who meet monthly at City Hall to decide the fate of multifamily rent-controlled housing owners. The major duties of the Santa Monica Rent Control Board are: • To control the amount that may continue to be charged for a rental unit and provide remedies for the collection of excess rent. able rent increase of 2% for eligible units, with a maximum $44 increase for rents of $2,175 and above. The Board and its city staff are funded by the rentcontrolled multi-family housing owners. Each rent-controlled property owner has to pay a Rent Control Registration Fee of $198 per unit, per year, and owners are restricted to charging only one-half of the Rent Control Registration fee as a pass-through to the tenants. Even worse, if the rent-controlled property value was reassessed on or after March 1, 2018 due to a sale or voluntary improvements, the owner may not pass through property-tax-related surcharges to any tenant. Lori Browns was a candidate for the Rent Control Board during the 2018 election. In her Santa Monica Mirror candidate questionnaire, Browns admitted, “We don’t have a handle on rent control as it is, and it hasn’t helped us address the housing crisis that has come to Santa Monica and elsewhere in California.” Brown lost the election. The prospect of statewide rent caps is bad, but it would be much worse if you owned rent-controlled apartments in Santa Monica.

Questions & Answers Most of my residents pay on time and their checks are honored by their banks. Lately, it seems that I’ve been getting many checks from small banks, even some internet banks with no real offices, many I’ve never even heard of. I recently had one returned insufficient funds over three weeks after the check was deposited! Do I have to accept these types of checks? Should I require that all my tenants pay by cash or cashier’s check? What about direct deposit?
You can control the method of payment and the types of payment instruments that you will accept. If your tenancies are month-to-month, you may change the terms of the tenancy agreement to establish different payment methods or to require payment by certified funds. Service of a thirty-day notice of change of terms will suffice. It is generally not a good business practice to accept cash as payment for rent, due to the increased risk of robbery, theft or other criminal conduct. Many owners allow residents to make direct deposits or transfers to the owner’s bank account. There are many benefits to this arrangement, but many drawbacks as well. If you do allow the resident to make direct deposits, then establish an account separate from your personal general account, and establish clear guidelines instructing the resident when and how to make deposits. Suggested guidelines would state that you will not accept a partial payment without prior consent; that the resident is not authorized to make a direct
deposit after service of a three day notice to pay rent or quit or a notice of breach of a covenant of the lease, or for any period of time after expiration of a notice of termination of tenancy. Once your payment terms are established, stick to them and require the residents do the same. It’s always something with one particular tenant of mine. When he first moved in three months ago, he deducted one hundred ten dollars from the rent because he said he had to fix a few things in the unit. I didn’t say anything at the time, I needed the unit rented, and I didn’t want to upset my new tenant. Since then, he has been able to find something wrong each and every month, deducting a little bit each month. I told him I didn’t think that was right, but he did it again this month. He says he is entitled to, that California law says he can “repair and deduct” for anything wrong in his apartment. Is this true?

California law, specifically California Civil Code Section 1941.2, provides that a residential tenant may make repairs and deduct the cost from the rent only under certain circumstances. These limited circumstances require the tenant to give the landlord notice of the dilapidation before using the repair and deduct remedy. After giving notice, the landlord has a “reasonable time” to make the repairs, before undertaking to repair and deduct. Thirty days is considered reasonable. A shorter time frame would apply to plumbing leakage, water penetration, or defects that place the resident’s safety in jeopardy. Only defects that render the premises uninhabitable will qualify for this remedy. Tenants may only invoke this remedy twice in any twelve-month period, and each time the remedy is utilized, the cost of repair cannot exceed one month’s rent. In your situation, it appears that the tenant is abusing a privilege only available to tenants with serious dilapidations in their apartments. Without providing
notice to you of the defect, and an opportunity for you to correct any serious defect, the tenant is not entitled to deduct anything from his rent. Provided you haven’t condoned his conduct, or waived your rights to accept the full amount of rent, you may demand that the tenant pay all amounts previously deducted, and become current. I recently bought a building in a pretty rough neighborhood. Seems like a day doesn’t go by without some sort of violent crime nearby. Just the other night, there was a shooting just down the street. I buy paint by the truckload to cover all of the graffiti and tagging on the building. I have a couple of vacancies now, and I don’t know if I have to tell them about all the stuff going on. If I did no one would rent, what do I do?
Crime, unfortunately, is a fact of life in many communities throughout Southern California. When asked by the prospective resident about crime in the area,
refer them to the local police department for statistics. Be careful not to portray your building as a “security” building or advertise it in any way that may create a false sense of security or safety. If your property provides an increased risk of harm, or has had a recent rash of criminal conduct, you may have a duty to disclose this fact to the prospective resident, even if not asked. Street parking spaces are few and far between near my building. My apartment complex has just enough parking spaces for my residents to each have one space. If a resident has more than one car, they must try to park it on the street. It has been working out fine for years but now I have this one tenant who refuses to follow the rules. He is constantly parking his second car in someone else’s assigned spot. I’ve told him several times but he just ignores me. What do I do? Legal Q&A — continued on page 14

Ensure that you have the proper signage at the entrances to the parking area. Most cities require the sign to contain certain restrictive parking language, plus the local police department telephone number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for their specific requirements, as they vary from city to city. Next if you know the offender, then provide a written warning of the violation. Attempt to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield of his car. If practical, take and save a photograph of the warning on the vehicle windshield, because the offender will always claim
that you did not give prior notice before towing. If he fails to remove the offending vehicle, the car may be towed.

Dear Frank:
Let us try to break down the most common of caulk types and when and where to use them. 1. Acrylic Latex caulk (painter’s caulk): Inexpensive, easy to use, water cleanup. Not for use in damp locations such as bathroom or kitchen or outdoors. Designed to be painted over. 2. Vinyl Latex caulk: Easy to use, water cleanup and can be used outside. Not very flexible; use in expansion joints is not recommended.
3. Acrylic Tile Sealant: Easy to use, water cleanup. The sealant is perfect for bathroom and kitchens and other wet locations. It is mold and mildew resistant. Paintable. 4. Siliconized Acrylic Sealant: Easy to use, soap and water or solvent cleanup. Perfect for porcelain tile, metal and glass. Similar to Acrylic Tile Sealant, but tougher and longer lasting. 5. Pure Silicon: Best for non-porous surfaces. Long lasting, indoor/ outdoor caulk. Super flexible and strong. Harder to use than any of the above caulks. Solvent cleanup. Mold and mildew resistant. Could smell until cured. 6. Butyl Rubber: Best use is outdoors. Messy to use. Perfect for sealing roofs, valleys, gutters, flashing and foundations. Moisture and movement tolerant. Sticks to anything. Cleanup with solvents.
7. Elastomeric Latex Caulk: Water cleanup. Longest lasting caulk. Great adhesion to almost all surfaces and can stretch close to 200%. Elastomeric caulk is very tolerant to wide temperature and weather extremes. It is most often used outdoors. This caulk can bridge gaps up to 2 inches wide and deep. The caulk dries very quickly; tool the caulk immediately after application.

I want to create a seating and relaxing area in the middle of my building’s courtyard. My thoughts are to use decomposed granite and eliminate the current grass area. How do I go about installing the surface without making a mess or a future headache for myself? Bryan
Dear Bryan:
Decomposed granite or DG for short is a great way to add a durable, natural and water wise surface. A few things you need to know before you get started. The key word in DG is “Decomposed”. In other words, this granite is decomposing. There are three options: raw DG for flower beds, stabilized DG for walkways and resin-coated DG for driveways. For your purpose you need to use a stabilized DG for walkways. It has a binder mixed into the DG. Maintenance Men — continued from 16 install DG, dig down three inches overall and use a wood, rock or brick border to keep the edges of the DG from crumbling. As an option, lay down a weed barrier cloth under the DG. Apply DG in one and a half inch layers, water down (don’t flood) and tamp or use a heavy roller to compress the DG. Wait eight hours between layers to let the DG settle. Repeat the above for each subsequent layer. When installed properly, the DG
surface will be rock hard, stable, dust free and will allow water to drain.
Dear Apartment Owners and Managers:
We are getting close to the holidays, which means more people at your apartment buildings. Chances are, some of those residents will be inviting guests for dinner over the coming holidays. For some of these residents, this will be the first time this year they will turn on the oven! What are the
odds you are just starting your own dinner or you are sitting down with your own guests when an emergency call comes to you on Thanksgiving Day from one of your residents? That call might be about a clogged sink or non-working oven with an apartment full of guests waiting for dinner. This scenario can ruin both you and your residents’ holiday. The answer is: Preventive Maintenance. Remember, the holiday season starts with Halloween and the demand on your properties only gets worse from there. Check each stove and oven for proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a pilot light being out. Also, check the oven’s temperature calibration with an oven thermometer. This time of year sees a higher than normal use of the plumbing, it may be a good idea to snake out or hydro jet your main plumbing lines. Also, sending a note to each tenant on the proper use of the garbage disposal will be useful. Note what they should and should not put down the disposal unit. A few items to include on this “No No” list are: banana peels, potato skins, coffee grounds and any stringy food. Also make sure they turn on the water before using the disposer and put down small amounts of food at a time. Instruct your residents to not use the disposer as a trash can and then turn it on when full. It will clog. Christmas and other holidays also mean more people than usual walking on your property. Is your property safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Craig’s Corner — continued from 20 (at the worst point since the 1940’s) continue to be near the worst in the nation. In Los Angeles and Orange Counties, the 46.5% homeownership (vs. 64.1% - US) rate is second worst in the nation, and California distinguishes itself by holding four-of-the-five worst ownership levels in the nation. Even with historically low mortgage rates today, first-time affordability in the second quarter sat at 42% in Orange County and 45% in Los Angeles County. To compound these dismal homeownership statistics, millennial homeownership nationwide is a full eight percentage points lower than that of their predecessors — Gen X and Baby Boomers — which translates into many more renters than those prior generations. On the supply side of the equation, many contend California has underbuilt by more than 100,000 housing units per year, for decades. Moreover, my Building Industry Association (BIA)
source in San Diego states that from 1988 to 2010 — about 14,000 total housing units were built annually in San Diego County and similarly Orange County, but from 2011 to the present, only about half of that was built. So, it seems like the supply and prices of housing is likely to get worse before it gets better. Presently the median selling price of a home here was $735,000. The demand for Orange County housing will continue to grow, though maybe at a slower pace. In 2018, the state population grew by 187,000, with the growth rate of .47% being the lowest in recorded history. Who knows if this is an aberration or if this will continue to trend, but with nearly 40 million people living in California the need for housing will continue to be a big issue up and down the state. And when the cost to build new apartments is what it is — in excess of $600,000 per door — one would think that rents for existing stock would continue climbing at an unencumbered rate.

But, with statewide rent control on the horizon, the rules of owning and managing our apartment investments are changing. As providers of affordable housing, more than ever, we need to stand together as an industry. At a minimum, we need to preserve the proposed rent increase of CPI + 7% (as of this writing), we must fight to maintain vacancy decontrol, thwart the rising trend of jury trial evictions, and defend the assault against Proposition 13. We can still successfully buy, sell, operate and manage our investments but our business models will have to change. More on this in a future column.

Dear AAOC Members, Our effort to defeat AB-1482 ended today as the State Assembly voted to pass legislation that would effectuate statewide rent control. We fought hard and truly gave it our all. While we are disappointed with the outcome (an understatement), I am grateful to be surrounded by such passionate and thoughtful people who took time away from their day jobs, families and other interests to call, write and share with Legislators the negative consequences that this bill will have on our business and our industry. Through numerous red alert emails, magazine articles and social media updates, we endeavored to advocate for and inform our AAOC members of the challenges faced and win the fight to protect property rights that we have on so many occasions. This time, our efforts came up short. The anatomy of our efforts consisted of thousands of hours of staff and volunteer time, counseling legislators, their staff, legislative advocates and more on the issues we face. There were hundreds of calls, meetings, emails and strategy sessions with property rights advocates across the State. And at a time when we know that only one thing can help solve the problem (building more housing), the legislature chose to do the one thing that has historically been proven to limit new supply: enacting rent control. In spite of our recent defeat of Prop 10, the legislature has voted against the will of the people. But it was not just the legislature, we also fought other real estate groups and associations who sought to cut deals as opposed to fight bad legislation. We worked diligently to modify the bill, but our requests for help and for leadership were ultimately overlooked. Our hope for 9th inning heroics were ultimately undercut by a backroom deal between the Governor and a competing association. I am grateful for the courage and support of all the legislators who opposed the bill and I am even more grateful for your efforts, making calls and sending emails. We exist and thrive not just to serve you, but because of you. Once the Governor signs this bill into law, there will be new policy framework to follow and there will likely be overreach from cities and municipalities across the State. We are gearing up to fight Prop 10, Version 2.0 on next year’s ballot and that will take aim at removing vacancy decontrol. With rent control in place, the stakes are even higher. Please stay tuned for additional information and as always, do not hesitate to reach out to the Apartment Association of Orange County with questions or concerns. AB 1482 (Chiu) Tenant Protection Act of 2019: Rent Caps—Quick Facts

A
s you know, Governor Newsom called for statewide rent control in his State of the State Address in January. Throughout the year, CalRHA has engaged in ongoing negotiations with the Governor and Legislature on this issue. Ultimately, the Governor pushed a deal through the Legislature via AB 1482, which will cap annual rent increases in California at 5% plus CPI and require landlords to have “just cause”
in order to evict tenants. The bill passed out of the Senate on September 10th on a 25/10 vote, then passed out of the Assembly on 48/26 vote. The Governor will sign the bill soon, but no later than October 13th (the bill signing deadline). Below is an analysis of the new law:
Key Provisions • Caps annual rent increases at 5% plus the change in cost of living, as
measured by the Consumer Price Index (CPI), for all rent increases occurring on or after March 15, 2019 • If a landlord increases rent by more than this cap between March 15, 2019 and January 1, 2020, the rent on January 1, 2020 must be what the rent was on March 15, 2019, plus 5% plus CPI Quick Facts — continued on page 28

For tenancies existing before July 1, 2020, this notice may be provided in the rental agreement, but written notice must be provided by August 1, 2020, or as an addendum to the lease or rental agreement. For tenancies starting or renewed on or after July 1, 2020, this notice must be provided as an addendum to the lease or rental agreement, or as a written notice signed by the tenant, with a copy provided to the tenant. Negative Interest Rates…Huh?
I
t’s a concept that’s difficult to wrap your head around. “Counterintuitive” to traditional money and investment thinking. Nevertheless, negative interest rates have become an economic reality in many countries, particularly in Europe and also in Japan. In August, Deutsche Bank reported that about $15 trillion in government bonds worldwide carry negative returns. That represents roughly 25% of all global sovereign debt and that percentage could grow. The term, negative interest rate, refers to a scenario in which cash deposits incur a charge for storage at a bank or other institution, rather than receiving interest income. In short, you pay the bank to hold your money, rather than the bank paying you interest. Your excused if feeling somewhat perplexed. Negative interest rates are a creation of modern banking strategies, initially emerging from a Scandanavian central bank beaker a decade ago. As reported by Neve Gotshalk of Moneywise, it first happened in Sweden in 2009 when the nation’s central bank lowered the rate on some commercial bank overnight deposits to –0.25%, with Denmark’s central bank then rolling out its own negative interest rates in 2012; the European Central Bank followed suit in 2014 and Japan joined the rates under zero fraternity in 2016. So yes, negative interest rates are a thing at this point and can’t be dismissed as a freak phenomenon from some third world economy. To clarify, this is not to say that all interest rates are negative in nations
where negative interest rates exist. Traditional positive interest rates exist for things like car loans, credit cards and home mortgages (though, for the first time ever, a negative interest rate mortgage is about to debut in Denmark through Jysek Bank. It will reportedly offer ten-year mortgage loans at a rate of minus .50% — you borrow 100,000 Krone to buy a house and pay back a total of 99,500 over the ten-year term.) The general effect of negative interest rates and the strategy behind them is to incentivize investment. Access to interest free or almost interest fee loans, aka “cheap money,” will activate risk takers/capitalists and that leads to invention, innovation, investment, employment and overall greater prosperity. At least that’s the theory. While borrowers are the beneficiaries of negative interest rates, obviously, savers suffer. What depositor would move funds into a below zero % interest account? Investopedia lists examples of depositors accepting negative interest rates as pension funds, investment firms and other corporate clients. Negative interest rates may be thought of as a tool, among other tools, used by central banks to assist the needs of their nations’ economies from time to time. The concern is that these needs may grow and the use of negative interest rates becomes more routine over time. Ultimately, negative interest rates are a symptom of and reaction to a flagging economy. Central banks jimmying the system, in an effort to spark confidence and investment. October 2019

In free market economies, ideally all moving parts should flow organically, driven as purely as is practical by market forces. Intervention by central banks is a non-organic artificial overlay on markets, a distortion of sorts that risks upsetting capital flows and potentially creates a perception of national financial weakness, an iffy signal to be sending out to investors. Our own central bank, the Federal Reserve, should adhere strictly to its dual policy objectives for the country: 1) maintain price stability and 2) maximize employment. The Fed’s in business to do those two things, not to support stock prices or to make sure borrowers get the lowest possible interest rates. The latter may be happy byproducts of policy, but not ends unto themselves. Thus far, there are no known instances of negative interest rates in the U.S. and present circumstances do not suggest the need. In fact, Americans seem downright pleased with current interest rate levels. With 30-year home loan rates at about 3.375% as of this writing (9-8-19) — down from 4.125% when the year began — homeowners are storming the refinance window; apartment rates have also declined sharply. Trimmed interest rates buttress real estate values, as they lower property carrying costs. The U.S. economy remains the most stable in a world where softening and even contracting economies (e.g. Germany) are on the rise. Healthy economies needn’t indulge in negative interest rates, a financial construct not wished for in these parts.

Why Do Buildings Fail in an Earthquake?

here’s a saying in our industry, that earthquakes don’t kill people. Buildings do. Yes, it is over-simplified, but the fact remains that earthquake threats to public safety are fundamentally linked to structural stability. People get injured in earthquakes because a building facade, wall, parapet, ceiling or other part of the structure collapsed when it is was stressed to the breaking point by the violent ground movement caused

by the quake. Whether it’s the compression of the earth from P waves, the undulation of S waves, or fast-moving surface waves (the most destructive type) — buildings must be able to absorb and distribute the energy transmitted by these waves, or they break, usually in their weakest spot.
Why Does This Matter?
It matters because never before have we understood so much about the
structural vulnerabilities of our buildings, and how to fix them. Nationwide, and especially here on the West Coast, there is a push to prepare our communities and make them safer against disaster. Many cities have adopted or are considering ordinances requiring retrofits of buildings proven to be vulnerable in a major quake. The White House, in its National Security Strategy, listed the promotion of American resilience against natural

disaster as one of the country’s primary security issues for 2018. Here in California, there are five basic building types that have been proven to be vulnerable to failure or collapse in an earthquake: 1) soft-story; 2) tilt-up; 3) non-ductile concrete; 4) steel moment frame; and 5) unreinforced masonry. Listed below is a quick description of each building type and the general structural engineering approaches to make them safer. Soft-story Buildings: Extremely popular as a means of conserving space, these structures with open ground floors used for parking have been proven to be vulnerable because they lack the support to withstand lateral forces that push the building from side to side. The swaying can cause the first floor to collapse, and the upper floors to pancake on top of it. Retrofit construction for soft-story buildings usually entails the installation of a steel moment frame or frames, a sturdy foundation and drag lines to absorb seismic ground motion and prevent swaying. Tilt-up Buildings: Tilt-up construction began in the early 1900’s, but didn’t really catch on until the post-World War II construction boom. The walls of a concrete tilt-up building can weigh between 100,000 and 300,000 pounds. Many tilt-up structures built prior to the late 1970s were built with limited or weak connections that have been proven to fail in an earthquake, causing severe damage and/or collapse. These building defects can be easily corrected with seismic retrofitting. Non-Ductile Concrete Buildings: Nonductile concrete buildings prior to 1978 are characterized as having concrete floors and/or roofs supported by concrete walls, columns and/or frames. These buildings make up the majority of earthquake losses around the world because they typically attract large numbers of people: thereby enhancing the potential for death and injury. Retrofit construction of these buildings usually entails the use of shear walls
and column fortification to provide a stronger framework to prevent a collapse of the heavy floors above. Steel Moment Frame Buildings: Steel moment frame construction dates back to the 1880s with the very first skyscraper, the Home Insurance Building in Chicago, but this building technique was most commonly used in the 1960s to 1990s. These structures, when built before the 1994 Northridge earthquake, can sustain brittle fracturing of the steel
frames at the welded joints between the beams and the columns. There are several retrofit approaches to consider in these instances, depending on the building. Some approaches include boosted beam-column connections and chevron bracing throughout or at various points in the structure. The Mind of a Rental Fraudster
T
he last two-and-a-half years has spurred a massive increase in rental fraud in the multifamily industry. In fact, CheckpointID, the leading fraud prevention service for apartments reports that nearly 3% of the hundreds of thousands of IDs they scan for properties are fake. So, what is causing the spike?

of the criminals that are doing it. If someone was going to rob a house on a given street and 3 houses have gates and 3 do not, guess where they would go? To the houses with no gates. It is not because they think the haul of stolen goods will be sweeter, rather they know it will be easier to get away with the crime. Rental fraud is similar. We know this because the statistics now prove it. CheckpointID’s data across 434 sampled properties shows a decrease in “failed

IDs” as a percentage based on the length of time these customers use its service and deterrent signage. Data sample across these 434 properties from mid-July 2018 to mid-July 2019 shows a decrease in fail 1D from 3.16% to 1.27% in just one year. In the first three months when these properties began implementing the software, the average percentage of failed ID was 3.01%. In the last three months, this percentage has dropped to 1.38%. The statistic above shows that window signs that say “We Verify IDs” deters potential fraudsters and tells them to move to the next property. In our example, this is the house with no gate. It’s critical to prevent potential fraud early — before a tour even starts. Some fraud is caught at the final screening process, but certainly not all. Fraudsters can manipulate pay stubs and even buy fake Social Security numbers. Leasing agents are now playing detective to try and stop this, rather than simply focusing on leasing an apartment. “Prior to CheckpointID, there was no gatekeeper. Prospects present their IDs and leasing agents put them in a drawer, and off they go. The fraudsters are masters of befriending the staff and lowering their guard,” said Terry Slattery, CEO of CheckpointID.
Online Fraud
The other huge issue is online fraud. With online leasing, people sign a lease before anyone ever sees them. Hiding behind a computer emboldens fraud-
sters as even if caught, they simply move on. It is crucial then to verify the id entity of online applicants. Online ID verification software, like CheckpointID, uses facial recognition technology to match applicants’ faces against their IDs. To do this, the software asks the applicants to scan their IDs and submit face photos. Often, fraudsters are very reluctant to submit an actual photo of themselves, even if it matches the fake ID as they do not want to be on record for committing a crime. This deterrent will be critical in the fight to prevent fraud!
