Fighting the Good Fight, Especially in Frightening Times
F
or several months we have been alerting AAOC members about the onslaught of attacks on private property rights and have been working tirelessly on all fronts to combat them at the local, state, and federal levels. As an independent owner of income property, I am so thankful to the men and women who had the foresight to establish the Apartment Association of Orange County for the very purpose of protecting and defending our rights as owners and operators of rental housing. For almost 60 years, the AAOC membership has presented a unified front and actively supported, with confidence, our association leadership and staff both in defending against detrimental public policy and in advocating for industry-based solutions to a wide range of issues. AAOC may not be the largest apartment association in California but it has consistently been one of the most effective and influential voices on rentalhousing issues. It has formed and/or been a member of several housing and business coalitions, worked with some of the best and brightest legislative advocates, established and maintained a respected Legislative Committee and local advocacy program, and stood strong in its convictions and fought for what is right. On top of that, AAOC has been fortunate to have had a history of first-class government affairs staff and volunteers who have represented the association and its members well. I would particularly like to thank Director Emeritus Ray Maggi (MPMS, Inc.) for his decades of service on this

front. His contributions to AAOC have been too significant to measure; his expertise and experience too valuable to put a price tag on; and the lasting impact of his mentorship of so many individuals and the depth of his altruism impossible to quantify. Thank you, Ray, for all that you have done to grow, nurture and strengthen AAOC. Of all the threats to our private property rights and our industry, the continuous attempts to gut the protections provided by the Costa-Hawkins Rental Housing Act of 1995 remains our most costly and formidable fight. The General Election is upon us and our industry’s eyes are fixed on Proposition 21, the latest attempt to eliminate Costa-Hawkins. Our industry is fighting hard and working as part of a larger coalition to defeat this ballot measure. We must defeat Proposition 21 and defeat it soundly if we are to give rent control advocates pause before trying another ballot initiative in the future. Here are three of the top reasons why Proposition 21 must be defeated: • Eliminates Costa-Hawkins Protections. Proposition 21 would gut the Costa-Hawkins Rental Housing Act of 1995 and remove most of the protections for rental property owners. Cities or counties could enact vacancy control so an owner cannot raise rents to market rate after a tenant moves out. It would also limit rent increases to 15% of the previous tenant’s rent within the first three years of a new tenancy. Further, it would cap rents

on single-family homes if the owner owns three or more homes, as well as on properties built after 1995 if they are more than 15 years old. This means more properties would fall under local rent control every year. • Allows Regulation of SingleFamily Homes. Proposition 21 would allow local governments to impose rent control on apartments and privately-owned single-family homes without a vote of the people. Unelected bureaucrats could also be empowered to charge homeowners a fee for taking their home off the rental market. • Reduces Housing Supply and Drives Up the Cost of Existing Housing. Proposition 21 would lead to more landlords taking their rental properties off the market and converting them into condos and townhomes, further reducing the rental housing supply and making the housing crisis even worse. Additionally, by creating an inconsistent and unpredictable patchwork of local ordinances, Proposition 21 would prevent critical affordable housing development and drive rents and housing costs up even higher. In closing, 2020 has been a frightful, if not horrible, year and it will hopefully end on a positive note with Proposition 21 being defeated and rent control advocates being sent packing once more. If ever there was a time to fight the good fight, it is now.

What a Difference A Few Hours Makes
I
n “seventy-two little hours,” August 31, 2020 marked the date California’s governor signed into law the most restrictive set of laws on residential rental property owners the state has seen in decades. It was presented to him for signature after the legislature passed AB 3088 — and on the heels of the 2019 passage of AB 1482. Under AB 3088, tenants can largely remain in possession from March 1, 2020 through January 31, 2021, termed the “Covered Period” under the new state law. If that did not get your attention, the new law also allows tenants to personally deliver or mail just twentyfive (25) percent of the rent that was due for the months from September 1, 2020 through January 31, 2021. By now, let’s hope you are generally familiar with the new law. If not, let’s look at some of the most important aspects of the law. There are other laws (including federal and hundreds of local government ordinances and regulations) that change the manner in which we collect rent when it is due, provide notices regarding non-payment of rent, seek to recover unpaid rent and, if necessary, eviction during the COVID-19 pandemic. There is the CARES Act, the CDC Eviction Moratorium, hundreds of local ordinances, and the provisions of AB 3088 to follow. The combination of the new changes in law cannot be ignored or avoided unless the owner/ agent wants to be subject to substantial penalties and attorney fees should violations be determined.

AB 3088 affects the ability of an owner to evict tenants due to non-payment of rent from March 1, 2020 through January 31, 2021 should a tenant state they have experienced a financial hardship that is related to COVID-19. Notices to tenants and declarations by tenants are different due to certain time periods. The first time period to follow is termed the “Protected Time Period” which begins on March 1, 2020 and ends on August 31, 2020. During this time period, tenants cannot be evicted due to non-payment of rent should they receive a specified notice and declaration by September 30, 2020 and submit a completed declaration (which you are to deliver) within 15-days. The next time period, termed the “Transition Time Period,” you are to deliver a separate notice and declaration to a tenant that does not pay all of the rent due to the pandemic. Should the tenant complete the declaration and submit it to you within 15 days, the tenant is largely protected from eviction due to non-payment of rent. Should the tenant fail to complete and deliver the declaration to you, the tenant is for the most part not protected by the new law. There is a provision in AB 3088 that allows an owner/agent to evict “high-income” tenants. The highincome tenant provision in the new law may not be useful in most cases. While the courts are to “re-open” as of October 5, 2020, there are other laws that will not allow you to proceed due to non-payment as well. But on that date

the court is authorized to issue summons and enter default judgements or proceed with cases alleging “just cause” and other non-payment of rent cases. Let’s look at a few more specifics regarding non-payment of rent. During the “Protected Time Period,” the owner/agent is to serve tenants who owe rent a 15-day notice (court days which exclude Saturdays, Sundays and other judicial holidays) unless the service is restricted or prohibited by local ordinance. The notice is to include specific language that the Legislature wanted to have served on the tenant. In addition to the notice, a declaration form is to be served on the tenant. The tenant has 15-days to complete and return the notice to the owner/agent. For those that like small claims court, the bill should be of great assistance. Starting March 1, 2021 if a tenant does not pay their transition time period rent (September 1, 2020 through January 31, 2020) the monetary jurisdiction is lifted until February 1, 2025. Owners can file an unlimited number of small claims actions during this time. Remedies in small claims court have a number of risks. During the “transition time period” (September 1, 2020 through January 21, 2021), the owner must serve a 15-day notice to pay or quit. The notice is to include specific language and declaration form to be completed, signed and delivered to the owner/agent within 15 days. The declaration form states the tenant has experienced a financial
hardship during the pandemic. Also during the transition time period, the tenant is to pay the owner/ agent at least 25% of the rent due by February 1, 2021. If a local ordinance does not permit the tenant to pay even this percentage amount, the tenant can avoid paying the 25% of the rent. If the tenant completes and delivers the declaration to the owner/agent during the transition time period and pays 25% of the rent, the tenant is once again largely protected from eviction due to non-payment of rent. Tenants who have not returned the completed declaration within the 15-day time period can file the declaration with the court once the tenant is served with an unlawful detainer. Should that occur, a court hearing is to be “scheduled” within 10 days prior to the underlying action. A judge is to determine at this hearing if the failure to return the notice was due to “mistake, inadvertence, surprise or neglect.” This gives the court tremendous discretion. As in a tennis game, we would say, “advantage tenant.” In the event that the tenant does not file the completed declaration with the owner/agent and does not appear in court, the owner/agent can proceed with an eviction where rent accrued between September 1, 2020 through January 31, 2021, on and after February 1, 2021. The new law also provides for protections for every financial obligation under a rental agreement. The same statutory language in the 15-day pay or quit notices must be included in cure or quit notices. Owners/agents must serve the notices and declarations for each of the periods (protected AND transition). If the property is subject to the CARES Act there may be as many as eight notices. For cure or quit notices regarding financial obligations, there will be an additional four notices. The impact of local ordinances must not be overlooked. If a local moratorium ordinance was in effect as of August 19, 2020, the terms and requirements remain in full force and effect until and
unless there is a sunset clause that expires before January 31, 2021. Amendments or new ordinances that are adopted on and after August 19, 2020 will not take effect until February 1, 2021. It is important to note that the new state law does not permit a city or county to extend a full repayment requirement beyond March 31, 2022. Not to be forgotten, the federal Centers for Disease Control and Prevention (CDC) stepped into the game by prohibiting evictions through the end of the year. It does, however, allow state and local governments to adopt and enforce laws that are more restrictive than the CDC order that was published in the Federal Register on September 4, 2020. Violations of federal laws may expose owner/agents to significant fines that range from $100,000 to $500,000. There is little question the new state and federal laws are complex. I am scratching my head and asking why didn’t the Newsom administration, state legislature, and federal government provide rental assistance? And you may want to ask yourself, why did a state apartment association support a bill that allows tenants to pay 25% of rent due for five consecutive months and permits tenants to remain in possession for over a year and barely pay rent? Think of this, AB 3088 is a screaming deal for tenants, by allowing tenants to remain in possession, continue to incur interest free rental debt and make it impossible for future rental owners/agents to discover the debt was never paid. Vote “No” on Proposition 21
C
alifornia voters rejected rent control initiative Proposition 10 in 2018 by more than 59 percent. In Orange County, voters rejected the initiative by more than 65 percent. AIDS Healthcare Foundation Director Michael Weinstein, undeterred by the crushing defeat of his ballot measure, committed to spending $30 million this year on Proposition 21, a second attempt to expand local governments’ ability to impose rent control on the same voters who rejected his first attempt just two years ago. Proposition 21 represents a catastrophic threat to the Costa-Hawkins Rental Housing Act of 1995, which has provided protections for California rental-property owners and the greater rental-housing industry for the past quarter-century. Costa-Hawkins restricts the enaction or expansion of local rent control and protects the ability for rental housing providers to reset rents to market rates when rental units become vacant. More

specifically, it prevents cities from applying rent control on apartments built after 1995, or earlier in cities that already had rent control in place. These core protections for rental-housing providers would be eliminated if voters approve Proposition 21 next month. It would also further exacerbate California’s housing crisis as well as the current financial and legal effects being felt by the rental-housing industry due to Assembly Bill 3088, the recently enacted COVID-19 tenant protection law.
So, what if Proposition 21 is approved?
Proposition 21 would dismantle protective state housing policies but gutting the Costa-Hawkins Rental Housing Act of 1995. Cities would be allowed to adopt new restrictions on private property and rental housing. Proposition 21 would allow cities to impose rent control on buildings older than 15 years, meaning that additional rental units would come under rent control each year. Proposition 21 would eliminate the protection against rent control for single-family homes and condominiums. Proposition 21 would eliminate vacancy decontrol for rent-controlled properties, meaning that rental-housing providers could only increase rents by up to 15% during the first three years after a new tenant moves in. Research has shown that even moderate rent stabilization laws destroy neighborhoods and mixed-income communities and discourage new resi-

dential construction. More than a dozen California cities have imposed rent control laws and there is no indication that those jurisdictions with the most extreme policies have seen any positive impact on their communities. In fact, one need only look at Los Angeles as an example of how rent control has negatively impacted neighborhoods and communities. Governor Gavin Newsom signed California’s first rent control law last year, Assembly Bill 1482, and now Proposition 21 seeks to impose even more radical policies that will further erode private property rights in California and destabilize the rentalhousing industry. Questions & Answers Not sure if I can take any more of this. Just when I thought we were through the worst of it, now I hear that Governor Newsom signed AB 3088, the COVID-19 Tenant Relief Act of 2020. Not only that, the CDC has issued an Order. I’ve read several articles about how to comply with this new bill, still very confused. Can you clarify it for me? What does it do?
AB 3088 limits a housing provider’s ability to evict a resident for non-payment of rent or other financial obligations (“COVID-19 Rental Debt”) that came due or will come due between March 1, 2020 and January 31, 2021, the “Covered Time Period.” Although it is intended to protect those residents who have experienced “COVID-19 related financial distress,” there are few if any safeguards that would prevent the abuse of these new protections. The new laws create two time periods within the Covered Time Period, and establish different rules for each: i) March 1, 2020 through August 31, 2020, is the

“Protected Time Period;” and ii) September 1, 2020 through January 31, 2021, is the “Transition Time Period.” Additionally, a “High Income Tenant,” as defined, is subject to certain limitations. What do housing providers need to do now?
On or before September 30, 2020, you must serve a specific form notice, the “Notice to Tenants Who Have Not Paid One Or More Rental Payments That Came Due From March 1, 2020 Through August 31, 2020” to any tenant who has “not paid one or more rental payments that came due during the Protected Time Period” (March 1, 2020 through August 31, 2020). It can be served by regular U.S. Mail or as you would other legal notices. How do I handle rent that came due during the Protected Time Period (March 1, 2020 through August 31, 2020)?

If a resident owes rent that came due during the Protected Time Period, you are required to use a new Fifteen-Day Notice to Pay Rent or Surrender Possession form. This new form replaces the old Three-Day Notice to Pay Rent or Surrender Possession. Note that the fifteen days do not include Saturdays, Sundays, or other judicial holidays. Note that this new form is only to be used for rent that came due during the Protected Time Period. Complete the form carefully, as the information contained is a bit different than the old Three-Day Notices. Each installment of rent that came due must be listed separately, along with the date each installment came due. Note also that the new Fifteen-Day Notice includes a Declaration that the tenant must complete and return if the tenant has experienced “COVID-19 Related Financial Distress.” The resident can return the Declaration to you in many ways. It may be returned to you in person, by mail, or by email if
you provide an email address on the Notice. If the resident returns the Declaration, you will be unable to evict the resident for non-payment. Rather, the COVID-19 Rental Debt can be pursued in small claims court, or the general civil court, after March 1, 2021. Note that the small claims court jurisdictional limit will increase to allow the recovery of COVID-19 Rental Debt. If the resident owes other financial obligations, monetary sums other than base rent, i.e. utility charges, garage rent, late fees, etc., you would proceed as stated above, preparing a separate notice for each Time Period, however you
would use the new Fifteen-Day Notice to Perform Conditions and/or Covenants or Surrender Possession form. Just as you are required to use different forms for each Time Period as described above, there is a different form for each Time Period to demand other financial obligations, one unique form for the Protected Time Period and another for the Transition Time Period. These forms can be served concurrently with the Notice(s) to Pay Rent or Surrender Possession as appropriate. How do I handle a resident who is in breach of the lease or is causing a Nuisance?
Depending on your unique circumstances, you may be able to pursue an eviction based upon the resident’s failure to cure after being served a Three Day Notice to Perform Conditions and/or Covenants or Quit for a material breach of a covenant contained in your lease (other than rent or financial obligations), i.e. sublet without consent, maintaining a pet without consent, etc. If appropriate, once the Three-Day Notice to Perform expires, and the resident has not cured, a ThreeDay Notice to Surrender Possession could then be served to terminate the tenancy. Alternatively, in the event the resident is engaged in illegal conduct, is committing waste or is a Nuisance, you may have grounds for the service of a Three-Day Notice to Surrender Possession based on such conduct.

Can a Housing Provider evict for Just Cause?
Between now and February 1, 2021, all residential properties, with some very limited exceptions, are subject to the Just Cause requirements of AB 1482. That means even single-family residences, which were previously exempt, are now temporarily covered and require Just Cause prior to termination of the tenancy. The new laws still allow a Lessor to withdraw the rental property from the rental market and allow for termination based upon the owner’s intent to move in a qualified family member. Termination because the Lessor desires to substantially remodel or repair the Premises must now relate to maintaining the habitability of the Premises rather than simply performing a renovation. Fixed term lease expiration, notices of non-renewal, and 30- or 60-day notices that previously did not require just cause, are no longer grounds for termination and will not support the filing of a new eviction. A few months ago, you had question about bath fans and removing moisture from the bathroom to avoid mold issues. Our residents never seem to switch on the fan or leave it on long enough for it do its job. What else can I do? Mike
Dear Mike:
We have often commented about wiring the light switch and the fan switch together. However, if the resident turns off the lights as they leave the bathroom, the fan also turns off. Rick, a general contractor who reads our column, sent us what he does in this situation. Read below for his suggestion. We think it is a great idea that will eliminate any moisture issues in a bathroom. “The key is to do one of two things. Either replace the wall switch with a moisture sensitive switch or replace the fan in the ceiling with a humidity-sensing bath fan. Both will work equally well. The fan will turn on-and-off depending
on the humidity in the room, thereby helping to eliminate any mold issues due to excessive moisture. When installing the fan option, make sure to eliminate the switch and wire directly to the fan. Both the switch and the fan can be found at most home improvement centers.”

The stench in the rental unit following a nasty eviction was overwhelming. The tenant smoked heavily and collected all sorts of garbage. The unit was a disaster. We have cleaned the unit, including the carpet and painted the walls. The place still smells bad when we show the unit to a prospective resident. Because of the lingering smell, this unit is un-rentable. What do you suggest? Jessica

Rancid smells, nicotine, animal and organic odors are very hard to remove even after painting the walls and cleaning the carpets. Chances are, if the resi-

dent was a long-time hoarder, carpet replacement will be inevitable. Remove the carpets, pad and tack strips. The tack strips are wood and can absorb and release the smell of smoke, urine etc. Thoroughly clean the floors with soapy water mixed with bleach. After cleaning the floors, it is not a bad idea to paint or use a primer to coat the flooring. One of the best ways to remove the odors from the walls is using old-fashioned elbow grease. Before painting, wash the walls with soapy water using a brush or rag. Adding TSP (a powdered cleaning solution available at most hardware stores) or using a degreasing agent will help in the cleaning. If you have flat ceilings, wash them too. If you have “acoustical” or “pop-corn” type ceiling, that is a problem. By its nature, acoustical ceiling material is difficult to clean. Encapsulating the acoustical ceiling with spray paint may solve the problem. You will need a primer coat and a minimum of two coats of paint. If the smell is still present, give it another coat of paint and let the unit air as much as possible. Don’t forget to wash the windows and window frames as they can retain nicotine odors. Replace any HVAC filters and vacuum dust from furnaces and A/C units.

Determining if a roof actually needs replacement or should be repaired is sometimes more of an art than a science. An old roof, in good condition, that has leaks may be as simple to solve as an inspection of the roof flashing system. The roof flashing is where the roof meets a different material or changes course. For example, roof
flashing is found around the chimney, in valleys, where the roof transitions to vertical a wall or around vent pipes. Any roof transition area is a potential roof leak. Keeping the roof flashings in good order is the first line of defense. However, should your roof be experiencing leaks in several different areas, missing granules (bald spots), and pooling, it might be an indication of a roof past its prime and ready for replacement. In the case of a shingle
roof, the tell-tale signs are more obvious. For example, a shingle roof may exhibit curling edges, loss of granules and material brittleness. This roof may be beyond repair and should be replaced. Tile roofs may present different issues as they may look great on the outside, but have hidden damage under the tiles, such as a rotted felt membrane or disintegrating roofing paper. These are much more difficult to solve and often times the repairs are more expensive than replacement. When requesting a bid from a roofing contractor, always ask for a cost to repair the existing roof and a cost to replace the roof. When seeking multiple bids, always use the same scope of work for each roofer. A deviation in scope will make it harder to determine the correct course of action. We need Maintenance Questions! Nick’s Picks: 2020 Election Edition

orget for a moment the debate over whether the following quote should be attributed to Mark Twain or Benjamin Franklin and instead, reflect on its truth, “the only two certainties in life are death and taxes.” It should come as no surprise that as we approach the 2020 Presidential Election, there are 12 statewide ballot measures in California, many of which will aim to raise taxes, and likely a local tax or bond initiative cropping up on a ballot near you. Since this is primarily a business/real estate publication, we will focus on the issues that will affect us the most. You don’t need me to tell you to vote no, but before I do, let’s take a deeper look at some of the craziness. Proposition 15: Split roll initiative that would repeal Proposition 13 (1978) protections for commercial and industrial properties. This is presented as the “kumbaya” measure that will solve every last one of the State’s problems, including homelessness, schools and

more. Proponents of the initiative claim that Proposition 13 created a property transfer “loophole,” failing to accept that Proposition 13 was passed in 1978 because the State’s tax system was out of control. It is especially misleading as it claims to “exempt small businesses.” This is misleading and not an outright lie because the exemption does not pertain to real property taxes but personal property taxes. Here we are 42 years later and the State’s tax system is still out of control. Nick’s Pick: “No” on Proposition 15 Proposition 19: Allows for the reassessment of a rental home or nonprimary residence when transferred. You have worked hard and amassed a real estate portfolio over the course of your career/life, and now the government wants a bigger bite of the apple. You can expect upward tax assessments on values greater than $1 million and the elimination of the transfer of taxable values of inherited properties unless the properties are the heirs’ principal residence. See comment above regarding our State’s out of control tax system. Nick’s Pick: “No” on Proposition 19 Proposition 21: Repeal of Costa Hawkins and AB 1482 to enact statewide rent control without vacancy decontrol protections. Watching and Tracking as Both an Owner and Investor
A
key takeaway offered in last month’s article on “Ways to Cope with No Clear Direction” (Apartment News, September 2020) was the importance of watching and tracking. Owners, for the most part, tend to know the cash flow generated by their properties. However, just looking at the monthly totals is only part of the picture. What lies behind the totals and how those numbers are trending may be more critical.
A true understanding of what is happening and the ability to make changes that might improve future outcomes requires digging into the details, both in terms of rents collected and expenses. A reduction in cash flow may not just be the result of delinquent rents; it may be a combination of several different factors from both sides of the equation. At the same time, owners also need to put on their investor hats and look at the real estate market. Now the focus is

interesting to note that in just a 30-day window, active listings dropped by 16% from 67 active listings down to 56. That downward movement in inventory was reinforced by a nearly doubling of properties under contract (i.e. from 10 properties back in late-July to 19 properties in late-August). The fact that the number of listings sold in the last 180 days (6 months), remained somewhat steady (47 and 51), indicates that there may be a further tightening in the market ahead. So, what do these numbers really tell us? First, there is no apparent rush to market. In fact, the number of available properties offered for sale has dropped, yet there seems to remain a significant level of demand. It is important to note that prices have dropped, as well. But, again, the decreases have not been by huge percentages. And, as we all know, a lack of competition tends to drive prices back up or, as more likely, de-accelerate any further decreases. So where do you go from here?

September General Membership Meeting Recap
T
his AAOC General Membership Meeting on September 15 was jam-packed with legislative and election information, in addition to an update on AAOC’s efforts to address Orange County’s homelessness crisis. The meeting was broadcast once again via Zoom and began with Executive Director David Cordero presenting the slate of officer and board member candidates for 2021. The proceedings were then opened to allow for nominations from the floor. With no additional nominations being made, Cordero closed nominations and announced that the slate would be deemed duly elected at the next General Membership Meeting on October 20.

Next was Sue Parks, Chief Executive Officer of Orange County United Way, who provided a first anniversary update on the partnership between AAOC and the “United to End Homelessness” initiative and the Welcome Home OC Program. This vital program provides critical, permanent supportive housing and support services to individuals who have been experiencing homelessness. Parks reported that 138 households and 221 individuals have been assisted to date by the Welcome Home OC program, and that 66 AAOC member rental communities have assisted in this effort, with no evictions. Parks pointed out that there are 187 veterans who still need homes along with a number of foster youth. Members who are interested in finding out more about the program can contact Orange County United Way by emailing Kristine Peters at kristinep@unitedwayoc.org. The meeting then segued to “No on Proposition 21” campaign strategist Tony Russo, who provided an update on the campaign and pointed out the diligent efforts being undertaken to defeating this latest rent control initiative. He discussed the series of commercials slated to begin airing in September; the endorsements against Proposition 21 by many newspaper editorial boards; and an intensive statewide mail campaign. Following the Proposition 21 update, AAOC Director Emeriti Nicholas Dunlap and State Senator John Moorlach (R-Costa Mesa) discussed a wide range

of political and public policy issues affecting the state, including the wildfires burning throughout California, unemployment, the Black Lives Matter movement, and various economic short falls that are leading the state and various unions to look for new revenue sources. Moorlach also addressed that severe pension shortfalls that are being felt by the state and the potential impact on taxpayers. He felt that a shared risk plan and higher employee contributions may help, along with fixing a significant problem with state employees accumulating unused vacation and sick pay. AAOC Executive Director David Cordero then concluded the meeting by walking members through the five new operational forms mandated by AB 3088, the COVID-19 Tenant Relief Act of 2020, which are now available for members on the AAOC website. Love Your Tenant

n August 31, 2020, the California Legislature passed, and Governor Newsom immediately signed into law, the COVID-19 Tenant Relief Act (AB 3088). This new law protects residential tenants who are in financial hardship from being evicted until March 1, 2021. AB 3088 states that a tenant who pays a minimum of 25% of their rent from September 1, 2020 until February 1, 2021 will be protected from eviction.

We have always tried to keep tenants happy by being proactive in preventable and other maintenance repair items, however now we are overextending ourselves. We have taken a prudent approach with no rent increases or late fees and offered payment plans. We will not be increasing rents and we will
waive late fee penalties, etc. until after March 1, 2021. Provided that the tenant is paying partial rent, we are replacing carpet and stoves when requested, even when the existing is in reasonable condition, as this lets the tenant know we are all in this together. Tenant — continued from 28 unhappy or having a hardship, they can pay 25% of their rent until January 31, 2021. The landlord, however, must continue to pay all of their own utilities, mortgage, maintenance repair and property tax bills. Many owners who do not have adequate reserves will lose their apartment investments. Luckily, most tenants are honest and will pay the entire rent on time, unlike politicians who are callous and want to buy votes with landlord rents.
What Does AB 3088 Mandate
This law expands upon previous laws and regulations related to COVID19 by only requiring tenants, as of September 1, 2020, to pay a minimum of 25% of their rent if they were adversely affected by COVID-19. 1. Rent Due March 1, 2020 to August 31, 2020 Limits a Landlords ability to evict a tenant for non-payment of rent due from March 1, 2020 to August 31, 2020, if tenant experienced financial hardship related to COVID-19. If tenant has an income under $100k or 130% of median income where apartments are located, the Landlord can require a signed Declaration and additional verification related to COVID-19 hardship. The Landlord cannot start eviction until January 31, 2021.
2. Rent Due from September 1, 2020 to January 31, 2021 Tenants are protected from eviction as long as they return the COVID19 Hardship Declaration stating they were adversely and financially impacted by COVID-19. They also must pay at least 25% of the contracted rent each month and can pay in one lump sum prior to January 31, 2021 to avoid eviction. The remaining 75% of the rent becomes consumer debt and the Landlord must file a Small Claims Court Action after March 1, 2021 and cannot evict even if the judgement is not paid.
Any Pay Rent or Quit Notices cannot include any past due rent for the period of March 1, 2020 through August 31, 2020 or 75% of the monthly rent owed for the period of September 1, 2020 to February 28, 2021.
3. Notices to Tenant Notices will be 15 Day Notices (court days) and will probably have to file several Notices as you may not combine time periods. My advice is to retain an attorney who specializes in Landlord/Tenant Law as there are stiff penalties for the Landlord who does not follow the procedures accurately. 4. Local Ordinances If local ordinances on eviction were in effect prior to August 19, 2020 they will remain in effect. You may

CDC Eviction Moratorium
The Center for Disease Control (CDC) issued a Nationwide eviction moratorium on September 4, 2020, which may or may not apply to California. Violations are $100,000 and up. Tenant must, however, submit a written Declaration of their circumstances to their Landlord under Penalty of Perjury.
Legal Challenges
The Fifth Amendment to the U.S. Constitution prohibits government from taking property for public use without just compensation which is usually interpreted as market value. Restricting and changing existing leases to lower rental amounts present a good case for declaring AB 3088 unconstitutional, however that will take years of litigation.
The Future
David Chiu (D-San Francisco), who sponsored AB 3088, was not happy with the last-minute changes and says he will revisit AB 3088 early next legislative session. The solution is for the State of California to put in place a program like the Federal Section 8 (HUD) that helps low income tenants pay their rent. Our single party (Democrats) in Sacramento have refused to allocate any funds to help tenants and try to put the burden and blame on the landlords. In conclusion, Love Your Tenants and make them happy so they continue to pay full rent for landlords to pay their mortgages, utility bills and maintenance repairs costs, property taxes and stay solvent. Landlords and Their Tenants — Might They Help Lead Us Through The Chaos? BY NICK LIEBERMAN
T
o no one’s particular surprise, apartment sales took a gut punch in the 2nd quarter of this most trying year, as COVID-19 fallout enveloped the marketplace. In Orange County, as the adjacent chart reveals, the number of 5-unit+ multifamily purchases shriveled to just seventeen from April through June. That compares to forty-two sale transactions in each of the 2nd quarters of 2018 and 2019. Moreover, the total dollar volume for those seventeen closed transactions was a mere $74 million — a very far cry from the $491 million and $347 million in apartment sales closed in Q2’s 2018 and 2019, respectively. The dearth of deals was equally evident on a national scale. Q2 nationwide multifamily sales were virtually sliced in half compared with the 2018 and 2019 numbers. Clearly, apartment deal making was on pause during the 2nd quarter with the COVID-19 straight jacket in place. But is a slower transactional marketplace necessarily a major problem for apartment owners? Not really. As Michele Kaufman, MAI Executive Managing Director at commercial property services firm Cushman Wakefield, told me in a Zoom interview on September 15th, the Q2 slowdown in apartment sales is simply due to owners not wanting to put properties on the market at this time. Limited apartment inventory is just another
COVID reverberation being felt through the economy. But in truth, the toll taken by COVID on multifamily investors so far (as of September 17) has seemingly been more in the nature of substantial inconvenience and anxiety rather than financial. True, the average rent in Orange County declined .04% in Q2 2020 compared to Q2 2019 (see chart on opposing page, again), but that’s certainly not a collapse in rents. And yes, occupancy in Orange County apartment units fell to 95.8% in Q2, down from 96.4% in 2019; still, 95.8% occupancy is hardly a disaster; it’s actually a number that many multifamily owners would love to be “stuck” with forever. The most relevant metric for rental housing investors at present might be rent collections as compared to scheduled rents, though such figures are not readily accessible. For what it’s worth, based on feedback received from numerous AAOC apartment owners and property managers with whom I’ve consulted, my sense is that rent collections have been significantly higher than owners were calculating when trying to get their arms and heads around the situation back in March and April as pandemic panic was taking hold of society and the economy. Assuming above expectation rent collections have indeed prevailed on a October 2020
widespread basis, at least through the month of June, perhaps a tip of the cap to the tenant community is in order. They’ve largely paid their rent despite: (1) a huge job loss surge — OC unemployment was at a disturbing 18.1% level at the end of Q2; and (2) government actions that have opened the door to legally withholding rent payments based on COVID impact claims. That said, we’ll hold our applause for now and await 3rd quarter numbers. Among other elements at play, the federal stimulus payments authorized by Congress in the spring, which expired in the summer, may ultimately translate to less rent payments being made in Q3. My personal take, however, is that the vast majority of tenants will honor their rent obligations, even those who face financial challenges. I further believe that for their part, the vast majority of apartment owners will bend over backwards to find ways to keep their tenants in place and make thoughtful concessions for those legitimately financially COVID-harmed residents in order to assist those folks to bridge the gap until public health concerns are lessened and economic stability is restored. And not to get too dramatic here, but may I suggest that the stakeholders in the enormous rental housing sector — apartment owners and apartment dwellers (about 130 million of the latter) — may now have an opportunity to

Fact Sheet Michael Weinstein and his multi-million dollar special interest group are now backing Prop 21 on the November 3, 2020 statewide ballot that will make the housing crisis worse. These are the same special interests who spent more than $25 million on the flawed rental housing measure, Prop 10 in 2018, which voters rejected overwhelmingly with a 59% NO vote. Don’t be misled. Prop 21 is even more flawed than their last measure. It’s bad for homeowners and renters – and will make California’s housing crisis even worse.
Eliminates Costa-Hawkins Protections •
The Costa-Hawkins Rental Housing Act of 1995 prohibits local governments from enacting certain types of restrictions on property owners. Prop 21 removes most of those protections for property owners, meaning a city or county could: o o o
Enact vacancy control so an owner cannot raise rents to market rate after a tenant moves out. The measure would limit rent increases to 15% of the previous tenant’s rent within the first three years of a new tenancy. Cap rents on single-family homes if the owner owns three or more homes. Cap rents on properties built after 1995 if they are more than 15 years old, bringing more properties under local rent control every year.
Allows Regulation of Single-Family Homes • •
Prop 21 allows local governments to impose rent control on apartments and privately-owned single-family homes without a vote of the people. Prop 21 could even lead to unelected bureaucrats charging homeowners a fee for taking their home off the rental market.
Reduces Housing Supply and Drives Up the Cost of Existing Housing • •
Prop 21 will encourage landlords to take rental properties off the market and convert them into condos and townhomes, further reducing the rental housing supply and making the housing crisis even worse. By creating an inconsistent and unpredictable patchwork of local ordinances, Prop 21 will prevent critical affordable housing development and drive rents and housing costs up even higher.
Places Bureaucrats in Charge of Housing with the Power to Add Additional Fees •
Prop 21 will put as many as 539 rental boards in charge of housing, with bureaucrats deciding what people can or cannot do with their properties, and will give the rent boards unlimited power to add fees on housing, which will ultimately be passed on to tenants in the form of higher rents.

If approved by the voters, rental property owners and operators stand to lose not only the existing protections provided to them by the Costa-Hawkins Rental Housing Act but also significant decision-making authority over their investments. The Apartment Association of Orange County (AAOC) is already working to defeat this radical rent control initiative but we need your help. Expand rent control to include buildings that were constructed after 1995 and are more than 15 years old. This means more units would fall under rent control each year.

Empower local governments to impose additional rent control measures on apartments and singlefamily homes without a vote of the people.
•
Prohibit rental property owners from raising rents to market value when tenants move out.
