S

ometimes, both in business and in life, we spend too much time looking ahead. We disregard the beauty of the moment, the hustle and bustle of the day-to-day world because we are focused on what we hope might be better, brighter or somehow easier times. Over the past two years in my term as President of AAOC, I have often found myself in the unique position of having to reason or explain away our successes. Fielding the barrage of negative press and publicity that is reserved for the housing and financial services industry by the mainstream media and getting to explain how national or even local averages can be inaccurate or exaggerated based on the sample data set utilized for survey purposes is something that has become second nature. Although it’s really just telling the truth, for some, it’s hard to believe.

Looking Back to Show Thanks

I often look back on 2007–2010 when our business was more challenging. For those of us with holdings outside of Southern California and in the Sunbelt or Rustbelt markets where jobs, income and households disappeared, there was a real sense that the market would never come back. For those with holdings only in Orange County, think about it like this: if it’s bad in Orange County, it’s much worse elsewhere in the US. But ever so slowly, the economy has turned around and people are back working, new households are being created, we are again seeing wage growth and with these improving fundamentals has come rent and occupancy growth. Paired with historically low rates, those who were not highly leveraged and were able to hang on are now in a position of comfort. And there’s nothing wrong with that!

Sure, the market is an easy example of timing and projecting or reflecting, but we see this also with the relationships we form within our industry. At last month’s reverse tradeshow, we had a packed house of new vendors and old friends looking not only to support AAOC but also to grow their businesses. Talk about a true win-win! It was so great to spend the afternoon reconnecting with old friends and colleagues who are involved with the same crazy business that we are. I can’t tell you how

overnment advocacy is challenging work. Our team of Jon Smock and Ron Kingston in Sacramento are among the best lobbyists in the business. Smock and Kingston, whose updates appears monthly here in Apartment News Magazine, work all year on advocacy for the Apartment Association of Orange County in our State Capitol. As I have said before, lobbying and government affairs often doesn’t get the proper credit in part due

designed to streamline the permitting process. But other more substantive proposals designed to increase needed housing production failed to pass the Legislature. The overall result is a woeful lack of new housing to meet California’s insatiable demand. Of course, we must not forget legislation directly affecting the apartment community. These pages have reported the early demise of a number of measures affecting rental properties, but now turn to the three most important industry bills that have been approved by the Governor. Alter a long slog through several different iterations covering multiple legislative sessions over a period of many years, water submeters will be required to be installed in multiple unit properties commencing January 2018. Much will be written about in these pages concerning implementation of the many provisions of Senate Bill 7 (enacted as Chapter 623). Suffice here to note that your lobby team was successful in obtaining a number of helpful amendments before its final enactment. Assembly Bill 551 has been appropriately described in these pages as the “bed bug” bill, for it indeed deals with the identification and eradication of these varmints. Scaled down from an earlier version of the bill that would have imposed significant straightjacketed procedures and mandates on landlords, the final version of the bill (approved as Chapter 599) simply requires delivery of informative notices regarding of the evils of this nuisance bug at time of rental and within one year of enact-

ment ultimately delivery of the notices to every tenant in California. The revised proposal also introduces new issues into the mix of problems associated with compliance, including new costs for more frequent PCO involvement. Maximum engagement in this bill has been a high priority for your lobby team and will no doubt occupy future comment in these pages as implementation processes continue, including new and revised forms. The third bill in this trio of measures directly targeting landlords may be the worst of the lot. Assembly Bill 2819 (Chapter 336) will affect directly every landlord seeking to recover possession of rental property through the unlawful detainer process as well as every landlord who uses credit-checking services to qualify a likely applicant for a rental. The bill would modify the “60-day masking rule” dealing with closing public access to court actions involving unlawful detainer (eviction) cases. It switches from the defendant to the plaintiff the burden of prevailing within 60-days of filing a UD action. The measure provides that UD court records remain closed to public access indefinitely thereafter unless the property owner prevails and presents the appropriate paperwork to close the case by judgment or stipulation of all parties. Much more will be forthcoming in these pages regarding the need for litigants to follow through to judgment to clarify availability of court records for accurate credit checking. These pages regularly contain a great

Public media sources also report on new laws and other information helpful to an informed readership. Lest we forget the civics lessons of youth, our own Governor is very much a part of the legislative process. The end of the line. Or, as remarked often by President Harry Truman, the buck stops here. Governor Brown has a full two years left on his term of office. What he has not done in Legislative matters this past year is every bit as important as what he has approved. So, in that light, here is a sampler of random chosen veto messages that resonate the Governor’s oft-stated views of “subsidiarity” and tight-fisted fiscal restraint, as well as demonstrating a good handle on what goes on generally. Here is a veto message about certainty in Assembly Bill 1505: Although the bill extends the criminal statute of limitations for violations of seven Public Contract Code sections, violations of four of those code sections carry no

criminal penalties and are not actual crimes. We should not introduce any uncertainty into the Penal Code. Here is a lengthy one on workers’ compensation awards, Assembly Bill 1643: This bill prohibits apportionment in cases of physical injury based on pregnancy, menopause, osteoporosis, and carpal tunnel syndrome and requires that breast cancer not be less than the comparable impairment rating for prostate cancer. I am vetoing this bill for many of the same reasons that I returned a similar measure, AB 305, last year. This bill is poorly drafted and reflects a seriously flawed understanding of both the workers’ compensation system and the nature of physical disability that may result from a work-related injury. The bill would, among other provisions, mandate that impairment ratings for breast cancer be no less than the ratings for prostate cancer. It would also create broad gender-based exceptions to the core principle of apportionment: that

employers are liable only for the permanent disability directly caused by their employee’s work-related injury. This measure seeks to draw a false comparison between disability ratings resulting from prostate and breast cancers, notwithstanding that these organs neither perform analogous physiological functions nor do their treatments result in similar physical limitations. There is a wide disparity in impairment levels that may result among individual women diagnosed with breast cancer and individual men diagnosed with prostate cancer, and individuals of all genders diagnosed with any form of cancer, depending on the stage at which the cancer was diagnosed, the nature of the treatment, and the degree and process of recovery. The suggestion that these two very different conditions should be rated equivalently in all cases has no basis in medical fact and upends the goals of ensuring consistency, uniformity and objectivity in ratings supported by substantial medical evidence.

On the issue of apportionment, this bill creates broad, gender-based exceptions to the rule that employers are liable only for the percentage of permanent disability directly caused by a workrelated injury. As written, the bill would prohibit apportionment to, and thus require employers to pay for, a permanent disability that actually resulted from pregnancy or menopause, or from osteoporosis or carpal tunnel syndrome where these are preexisting conditions or unrelated to work. As I said last year, there is no place for gender discrimination in the workers’ compensation system. Current law, however, already prohibits apportionment to risk factors, including gender, age, and family history. There is ample opportunity within the workers’ compensation adjudicatory process for workers, their counsel, and others to raise any concerns or allegations of improper and impermissible gender discrimination in the medical evaluation or apportionment process. California’s workers’ compensation system strives to treat all injured workers fairly and to ensure that all workers, regardless of gender, are adequately compensated for any permanent disability directly caused by work-related injuries. Rather than promoting equality, the statutory changes proposed by this measure would create new genderbased classifications and spur additional and costly litigation, undermining the successful reforms enacted in 2012 and the sustainability of the system. And another on workers’ compensation, Assembly Bill 2086: This bill requires the Division of Worker’s Compensation to appoint qualified clinical neuropsychologists as Qualified Medical Examiners (QMEs). I have the same concerns with this bill as with its predecessor, AB 1542, which I vetoed last year. The changes contemplated by this bill relate to legal evaluations, not medical treatment of injured workers as suggested by the declaratory text of the measure. If enacted, the bill would create a unique

lower standard for a select group of providers with a direct financial interest in being appointed as QMEs in California’s workers compensation system. In addition to increasing benefits and stabilizing costs, the 2013 workers’ compensation reforms were intended to return medical treatment decisions to doctors and reduce the excessive litigation relating to medical treatment disputes. Treatment of injuries by neuropsychologists where medically appropriate as determined by injured workers’ physicians will be unchanged by a signature or veto of this measure. However, a signature would be a step backwards in the ongoing efforts to reduce unnecessary costs that do not benefit injured workers. On parental leave, Seante Bill 654: This bill establishes an unpaid, job protected parental leave requirement that applies to businesses with 20 or more employees and allows workers to take up to 6 weeks of parental leave to bond with a new child. It goes without saying that allowing new parents to bond with a child is very important and the state has a number of paid and unpaid benefit programs to provide for that leave. I am concerned, however, about the impact of this leave particularly on small businesses and the potential liability that could result. As I understand, an amendment was offered that would allow an employee and employer to pursue mediation prior to a lawsuit being brought. I believe this is a viable option that should be explored by the author. On community colleges, Assembly Bill 2069: This bill requires each community college district to publicly post the total number of part-time faculty office hours paid divided by the total number of part-time faculty office hours that are taught. The state recognizes the many contributions part-time faculty make in students’ lives. The 2016–17 budget increased payment for part-time faculty office hours by almost $3.7 million, bringing the total state investment to November 2016

$7.2 million. In 2015–16, we created more opportunities for part-time faculty to become full-time faculty by providing $62.3 million for the hiring of new full-time faculty. Although the bill’s language is simple, gathering and reporting this information still has a real cost-about 10 percent of the entire allocation of funding for part-time office hours. We would do better to spend the money on more office hours. Note: These are just a few of many messages. Q&A — continued from 12 identification card issued by a foreign country, and is not valid for identification in the United States. In order to work in the United States legally, one must have a social security or a taxpayer identification number. It is illegal for an employer to hire an individual without a valid social security or a taxpayer identification number. Identity theft is rampant in California, and it is incumbent upon all credit providers, including landlords, to ensure that the person that fills out the credit application truly is who he says he is. Many tenant’s rights advocates, and that is exactly what they are, advocates, advancing the rights of tenants at the expense of landlords, insist that it is discriminatory to require a social security number when evaluating a prospect. You as a housing provider have a legitimate business purpose in determining the credit worthiness of a proposed resident, and not only to predict his ability to timely

meet his rental obligations, but you must determine his ability to continue to meet those in the future. Further, in the event you had to pursue this individual in the future due to a breach of the agreement, you must assess the risk in searching for and locating this individual should you need to collect a past due amount. A consistently enforced policy of requiring a social security or a taxpayer identification number in order to screen your prospective residents does not violate Fair Housing laws and does not constitute illegal discrimination. I am a very conscientious landlord. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. This month I received a letter from one of my tenants telling me that I had no right to enter his apartment to look

around, that he would not let me in. What do I do? Can I force my way in to do the inspection?

Your policy of doing annual inspections is admirable, and is practiced by responsible landlords throughout California. Most tenants welcome a responsible landlord’s actions in ensuring that all is well, and voluntarily cooperate in providing access upon the landlord’s reasonable request. It is clearly in the best interest of all to ensure that any maintenance issues are promptly addressed, and that a spirit of communication and co-operation exists between a landlord and his residents. Trouble is, your resident is right. There is no specific provision in California law requiring a resident to allow the landlord access to merely “inspect” the premises. California law states that a landlord can enter a rental unit only for certain reasons. Those reasons are in Q&A — continued on page 16

Q&A — continued from 14 an emergency, when the tenant has moved out or abandoned the premises, to make necessary or agreed repairs, decorations, alterations, or other improvements, to show the unit to prospective purchasers, tenants, or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a pre move out inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a landlord to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. Is there anything I can do to increase my collection rate after I’ve evicted someone? Seems like after the Sheriff gives them the

boot, these characters just disappear into the wind never to be heard from again. I know you see this all the time, so I thought you might be able to share some thoughts that will help me get my money back from these deadbeats?

Of course. Start thinking collection before you even create the tenancy. It seems counter intuitive, sure, but your tenant screening process lays the groundwork for firms like ours to go after and collect the monies due you after the tenant vacates. A complete and verified application is the best start. Those crazy questions asking for references and emergency contact information is where a good collector will start to find that former tenant. A legible copy of a valid government issued identification is important as well. Make a photocopy of the first rent check you receive from your brand new tenant, then each month compare the bank information to see if it changes. Copy any new check he tenders and put

it in your file. You should ask your tenants for emergency contact information, i.e. cell phone, email, work phone, etc. on a regular basis, at least once every year. Phone numbers, cell and work change throughout the course of the tenancy, the best information is the most current. Generally, tenants fully co-operate at the inception of the tenancy and during the term prior to any dispute. Rarely do tenants refuse to provide such contact information as most recognize that it is needed in the event it’s necessary to contact the tenant during the tenancy in case of emergency. In the event of an eviction, make sure your attorney proceeds to get the money judgment for rent, costs and attorney fees. If the tenant skips, small claims court is generally the place to go to reduce the amount due to a judgment. A judgment, coupled with the information stated above, in the hands of an aggressive collection attorney will dramatically increase the likelihood of securing a full recovery.

Just opened up the mail, and what do you suppose was in it? A notice from my bank informing me that one of my tenant’s rent check was returned unpaid because he placed a stop payment on it. Imagine that, it’s now mid-month, no warning, no phone call, the deadbeat didn’t even have the courtesy of letting me know he was going to stop payment on his check. It kind of makes sense though, he asked a couple of weeks ago if I’d let him out of his lease early, guess his girlfriend has a nicer place and he wanted to move in with her. I called his phone number, got a recording saying that it had been disconnected. His cell phone works, got his voice mail, and left a message. I’m guessing that when I swing by later today, it’ll be empty. What do I do now? I don’t want to make any mistakes; can I just change the locks if he’s out?

You have a couple of issues that you need to resolve, first the issue of return of possession of the premises, and then, of course, getting you paid. If the tenant appears to have vacated when you visit the unit later today, then you must follow certain procedural rules before you simply change the locks. Ideally, you will be able to contact the tenant on his cell or at work. If you make contact, ask that the tenant confirm that he is out by faxing or emailing you written confirmation. If you are able to confirm that he has moved out, you will not have to follow the abandoned real property notice requirements, and will be able to retake possession immediately. If when you visit the unit, and find that it is vacant, and if the rent is due and unpaid for fourteen days, and the tenant has not voluntarily surrendered possession, then you must serve a written notice of Belief of Abandonment of Real Property. The notice can be posted on the premises and mailed by regular mail to the tenant’s last known address, your property. You must wait eighteen days before you retake possession. If the tenant does not reply, in writing, by informing you of his address for service of an unlawful detainer within eighteen days,

A flashlight and clipboard with notepad will be essential. 3. During the inspection take extra care to look for improper drain connections, leaks, possible or future leaks, corrosion, staining

4. Check the garbage disposal unit under the kitchen sink and if you find 1/3rd HP disposal unit, consider replacing it with a half horse motor disposer. The underpowered 1/3rd unit is a large contributor to your kitchen drain line clogs. It is important to also instruct the resident in

the proper use of the garbage disposal unit such as using plenty of water while using the disposer and not stuffing too much scrap food all at once. 5. Take special note of large trees above the route of the main drain line. The roots may be invading the pipe and causing many of the backups you are experiencing. Have the plumber use a camera snake to inspect the pipe. 6. If your property does not have proper mainline drain cleanouts; plan on having them installed. We recommend having the pipes hydro jetted at least once a year to clear grease from the lines.

Three years ago, I had termite repairs done to the back side of my building. Turns out the wood was never painted or protected and now the wood is badly damaged. Would prime and paint have prevented this damage? George

Dear George:

It is unfortunate that your contractor did not complete his job by sealing or painting the new wood. This would have saved you the effort and expense of repairing the wood all over again. We cannot tell you how many buildings we see that had termite or dry rot repairs completed years ago, and they are still not weatherized or painted! It is not the cost of the lumber that is expensive, but the labor that you want to avoid by having to perform the same work twice. When replacing wood at your building you should insure that the proper type of wood is used for an exterior job and that the wood is sealed with primer and paint. To do the job properly, the wood should be primed before it is installed followed by a second prime and paint. proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a pilot light being out. Also, check the oven’s temperature calibration with an oven thermometer. Because of heavier than normal use of the plumbing, it may be a good idea to snake out your main plumbing lines. Also, sending a note to each tenant on the proper use of the garbage disposal will be useful. Note what they should and should not put down the disposal unit. A few items to include on this “Do Not” list are: banana peels, potato skins, coffee grounds and any stringy food. Also make sure they turn on the water before using the disposer and put down small amounts of food at a time. Do not use the disposer as a trash can and then turn it on when full, it will clog. Sprinkler heads sticking up above the grass or landscape near sidewalks. Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter wind or rain. Check your decking for cracks or damage and inspect the exterior stairways for wear and tear. FEDERAL FOCUS — THE NAA CONNECTION

White House Toolkit Points to Local Barriers to Affordability Crisis

L

ast month the Obama Administration weighed in on one of the seminal issues impacting local communities and one with which our industry finds itself struggling again — housing affordability. What might surprise you is that the message from the White House was not directed at property owners. The Housing Development Toolkit (available on the whitehouse.gov website) opens with this: Over the past three decades, local barriers to housing development have intensified...The accumulation of such barriers—including zoning, other land use regulations, and lengthy development approval processes—has reduced the ability of many housing markets to respond to growing demand. The toolkit discusses in specific detail the costs that these barriers impose on local households, the economies and even the environment as well as their role in exacerbating gentrification and income inequality. This is a welcome

message from the Administration. As many of you are experiencing firsthand, the issue of housing affordability increasingly dominates local news and policymaker debates. Beyond the statistics, low- and moderate-income families struggle to find housing that meets their needs at a price they can afford. This is an issue in the usual suspect markets on the coasts, but also in places like Austin, Texas, Nashville, Tenn., and Colorado Springs, Colo. While this current crisis is not breaking news, the scale and scope of the problem seem greater than in previous cycles as does the intensity of the advocacy efforts by tenant-rights’ organizations. Last month a few NAA affiliate offices and events were picketed by protesters and in one case, an Association Executive was personally the target of an advocacy campaign. The White House efforts could not come at a better time. What many advocates seem unwilling to acknowledge is that the seeds for our current crisis were sown long ago

in local land development and use policies. As the Housing Development Toolkit notes, when the recovery from the 2008 recession began, many communities were not positioned to take advantage: In a growing number of metropolitan areas, the returning health of the housing market and vibrant job growth haven’t led to resurgent construction industries and expanding housing options for working families, due to state and local rules inhibiting new housing development that have proliferated in recent decades. There is also of course the added complicating factor of stagnant wages. No- or low-wage growth is hard enough in markets where demand is “normal.” It is downright dangerous in the growing list of markets where exorbitant development costs and red-hot demand accelerate rent increases. Federal Focus — continued from 26 The toolkit goes on to describe a number of excellent policy options available to local governments to streamline the development process and increase apartment housing supply. Nearly all are positioned as incentives to development and even mandatory inclusionary zoning is described in both mandatory and voluntary terms but the toolkit’s recommendation tilts more towards voluntary incentive for IZ like density bonuses or streamlined approval processes. Rent control is not on the list of policy recommendations. While not on the list of policy recommendations, the toolkit does make a case of sorts for source-of-income protection for Section 8 voucher holders, characterizing a property owner’s choice not to participate in the Section

8 program as “discrimination.” We will continue to respectfully disagree with the Administration on this and stand in support of the freedom of a private owner to take on the responsibilities, and burdens, that come with accepting Section 8 vouchers. NAA has been a vocal, aggressive champion of this program for decades, including its voluntary nature. Also missing from the toolkit is a strategy for fighting NIMBYism (Not in My Back Yard) that pervades in so many jurisdictions. Truth-be-told, many of the hurdles put in the place of apartment development were put there by NIMBYists who would sacrifice anything to prevent more supply of apartments. More and more local governments, with help from private sector employers, non-profit organizations and others, are standing up to these forces.

Those efforts must be replicated around the nation if we are ever to make a dent in this affordability challenge. Nothing in the toolkit is earth-shattering, however, the focus and emphasis it places on local governments and their central role in the affordability crisis are extremely important. Our hope is that local governments listen and future Administrations make the same commitment. Make sure to mark your calendars for the 2017 NAA Capitol Conference and Lobby Day on March 7–8. How to Professionally Text Applicants and Tenants

W

hen talking to applicants and tenants online, understanding how to present yourself professionally through text is vital. With no tone inflections, it can be difficult for your tenants and applicants to know if you’re serious or making a joke. To further progress your relationship with your tenants, and lure in new applicants, these tips can help you understand that line between personal and professional within text messages.

Don’t use shortcuts for your text.

Ultimately you want your tenants and applicants to understand what you’re saying—especially if it has to do with rental requirements or the lease. While using acronyms like ‘Thx’ (thanks) or ‘Pls’ (please) is convenient, there’s potential for miscommunication. Use full sentences with proper grammar when texting applicants and tenants alike. If you have a lot to text, then ask them if they’d be available to talk on the phone, where you can fully explain in a few minutes.

Emoticons: good or bad?

Generally, using emoticons (like smiley faces) is frowned upon in the professional world. They’re typically reserved for conversations with someone you’re on closer terms with. That being said, if you and your current tenants have a close relationship, using an emoticon or two for non-official messages wouldn’t be the end of the world. When you’re texting your applicants, whether or not you want a close relationship with your future tenants, it’s better to establish that professional boundary from the get-go.

Be extra polite.

Most people use emoticons to produce a certain type of tone. However, in most messaging situations with your tenants or applicants, it’s better to stay clear from emoticons. To balance out this lack of tone, be sure to be extra polite in all your text messages. Although most tenants won’t take offence when you text them about scheduling maintenance work, using ‘please’ and ‘thank you’ never hurts.

Communicating through text messages is only effective when you respond in a timely manner. Generally you’ll want to respond within that day. As voice-to-text features have increasingly become available for smartphones, be aware that this feature isn’t 100% accurate all the time. If you use voice-totext, make sure you look over your messages before sending. As a general rule, you should review all your messages to ward off autocorrect. When it comes to understanding how professional your text messages should be, it’s up to you to set your boundaries and guidelines. Rent vs. Buy: When is Tool Rental the Right Move?

H

aving the right tool is key to completing a job efficiently, safely, and in a high-quality manner. While purchasing tools represents a significant expense, in many circumstances, renting provides the best value proposition. When evaluating whether buying or renting the right piece of equipment makes the most sense for your business, ask a few key questions:

Perhaps the most significant variable is cost. While the cost of renting equipment varies, the rate typically represents a very small proportion of the equipment’s cost.

Maintenance costs are another consideration that can be overlooked. If staff doesn’t have the time or skills to regularly maintain or repair the equipment, it is wise to outsource. Renting gives access to tools that are professionally and regularly maintained by experts. Maintenance expenses are one of the largest controllable elements in an operating budget. While most of those expenses are related to payroll, tools and equipment required by the maintenance team may also be a line item, depending on your management model.

How often will this tool actually be used?

Is there ample storage space?

How much does the equipment cost?

If the maintenance team will use a tool only a handful of times during a year, it is probably more cost effective to rent than to pay for the product and have to find a place to store it. Keep in mind that more than one tool may be needed on the property at any given time. Consider whether renting additional units of the same tool or

Storage is an important factor to consider when deciding to rent or buy. It isn’t in the best interest of the community to have a rarely used, large-sized piece of equipment taking up space. In this situation, it is best to rent whenever that tool is needed. That said, if the product is small or is frequently used, buying may be the better route.

How difficult is it to transport?

Take into account transportation costs if the piece of equipment needed is particularly large. Remember that the tool will need to make it to different areas of the property, so factor that in. If the tool requires a large truck or special/ oversized trailer, consider renting to make it less of a hassle. Take all of these factors — price, maintenance, storage and transportation — into consideration to determine whether it is more cost effective to buy or rent tools and equipment. With some good decision-making, maintenance costs can be kept at a minimum and the community can free up other parts of it’s operating budget. How Will Your Heirs Manage? from Cash In on the Myths of Real Estate

ou’ve devoted long hours and many a weekend to making repairs and managing your properties. But all of those missed games and midnight calls have paid off. Today you are enjoying a very nice cash flow and sleeping well knowing that your heirs will continue to grow the

equity that you spent so long to build. But is that really the case? In my first Cash In on the Myths of Real Estate article (March, 2016), I addressed the topic of whether or not your heirs really want to inherit your property. All too often, properties are sold-off without any thought as to how the continuation

7-2 My heirs will be able to manage my properties. Popular Belief: Owners think that since they managed their own properties, other family members will be able to do the same. Bill’s Truth: Over the years, property management has become much more challenging. Not everyone can manage their real estate holdings effectively —especially those who are new to the business and have no experience. Times have changed. Fair Housing and an ever-growing list of local ordinances have added to the complexities and risks of owning property. Your heirs may not have the skills or the desire to learn what they need to know. Make sure that you consider provisions for your heirs to hire professional management. However, be aware that hiring a property manager does not relieve your heirs from the responsibilities of ownership. They need to understand the principles of ownership to ensure that whomever they hire is effectively managing their building. Suggest that they take some classes at your local apartment owners association and do some outside reading to obtain the knowledge and training that they will need. Keep track of who is providing what services regarding management and operations. And, make notes as to your own recommendations about what should be done. In fact, if you can, create a relationship with a good property manager. You might ask this individual to conduct an annual review and give you an updated quote regarding management services and fees. Cash In: Recognize that your heirs may need professional assistance and make arrangements to ensure that any transition will be as smooth as possible.

Don’t Blame the Policy or Procedure Manual When Dealing with a Resident

O

ften times, it is easy for a community manager to simple say, “I’m sorry. I’m just following our company policy or the procedure manual.” This may be why you are doing what you are doing (whether it is approving or denying applications, handling evictions or enforcing the community rules and regulations.) However, simply saying that you are doing it because that’s what the policy says isn’t going to help any resident feel good about what’s happening and it often doesn’t create a positive environment within the community.

Address the Facts

Whether you are dealing with conflicts, enforcing the community rules or you are facing application questions, your ultimate goal is to talk about the facts involved in the situation. Why are you making this decision? What facts led up to this decision? By taking these steps, and being clear about your specific needs, it is possible for individuals to better understand why something is

happening and what they can do, if possible, to fix it.

Make the Human Connection

One of the most important steps that a company can take is to form a human connection with the residents within the community. That means being “real.” Instead of sending a note about noise complaints, visit the unit when you know the resident is there. Then, say, “We’ve been getting noise complaints over the last few days. I wanted to check in on you and find out what’s going on. Do you need any help? Is there a concern we can work with you on?” By creating this type of dialogue you don’t just “yell” at them. You talk to them and find out what’s going on so you can address it. Of course, document the conversation and follow up with a letter. It takes a matter of minutes to make these changes to the way you are handling conflicts and resident needs. It’s always a good idea to work directly with people to understand them, not

because you want to base decisions off of relationships, but because you want to develop strong relationships that minimize conflicts in the first place. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible.
