Product and Service Council
P
roduct and Service Council (PSC) is an important category of AAOC membership that consists of vendors offering products and services ranging from accounting to painting to windows and screens. AAOC awards an annual PSC member of the year with the 2016 award going to John McCarthy of McCarthy Roofing. PSC prospective members are vetted and all have signed a Code of Ethics stating they shall provide the rental housing industry with the highest standard of integrity, honesty and professionalism. They are a solid resource for your property needs and are listed near the end of every “Apartment News”. Why do I bring this up? PSC membership has really grown this year and there is a positive energy within the group that is infectious. Exciting things are happening on the horizon for AAOC Members. AAOC reformed the Product Service Council Committee when I named Board Member Frankie Alvarez as Chairperson
in the beginning of this year. With seven PSC members and one staff liaison currently at the helm they have been busy planning some fantastic events to blend together all sectors of AAOC Memberships. They kicked off the season with two Networking events at the Fireside Grille-Crown Plaza Hotel in Costa Mesa. This is a great way to interact on a social basis with your fellow PSC members and introduce new people to our amazing organization. Quarterly mixers are being scheduled for 2018 and updated information with time and location can always be found on the website www.aaoc.com. The Committee ended the summer with a bang-up event on the “Wild Goose” Yacht in Newport Beach. Did you check out the recap with pictures of this event in the October issue of “Apartment News”? This was a perfect blend of Property Owners and PSC Members enjoying great food and cocktails while chasing the sunset on

the harbor. For the first time in many years, AAOC held a tailgate party before the September 16 Angel’s game. Buffalo Maintenance and LoCali Property Management sponsored the AAOC tailgate prior to the Angels game...and this tailgate that was put together at the last minute attracted 80 people! December we will be celebrating the holiday season and recapping the year with the AAOC Holiday Cruise and Awards Presentation. R
eaders to this monthly missive know I spend a great deal of time writing about public policy and the impacts it has on private property rights. Not surprising for someone with a political science degree. But so much of the challenge in the housing industry as it relates to someone’s definition of affordability is just that, who gets to define affordability. Advocates on all sides continue to argue and debate income percentages but for me it has always come down to a simple economic equation: willing buyers and willing sellers. Chapman University economist and past president Jim Doti recently penned a piece in the Orange County Business Journal that speaks to this very issue. “For the most part housing analyst understand that higher incomes lead to a higher demand for housing. What they usually miss though is that the relationship is not one to one. A 10% increase in income does not lead to a 10% increase
in the price a family is going to pay for a home. In fact, that family is willing to pay something more, and it all has to do with the income elasticity for housing. …(My) study suggests that the income elasticity of housing is about 1.6. That means a 10% increase in median family income doesn’t just lead to a 10% increase in the family’s willingness to pay for a home. It actually leads to a willingness to pay 16% more. That finding explains a whole lot about the disparity of housing prices. Let’s take OC as an example, the median price of a singlefamily home in the county is $703,000, about 48% more than the median price home in California — $476,000. But that family in OC has a median income of $88,000 versus California’s $74,000. That’s a difference of about 19%. Because of the 1.6 income elasticity for housing, however, an OC family will want to buy a home that’s 30% more expensive rather than just 19% (19% x 1.6 = 30%). If that family with a median income of 88,000
is willing to pay 30% more for a home in OC, that home will go for $619,000, which is 30% more than the California median home price of $476,000. As a family’s income rises, so too does its willingness to devote a larger portion of that income to housing. This suggests that housing is not as unaffordable in OC as it’s cracked up to be.” Doti is a brilliant economist and a friend, and I appreciate his analysis. But like most economic analysis, in the end we are unfortunately left with even more questions than when we started.

Floods

cience fiction writers and others often refer to planet earth as the “rock.” We often marvel at special effects in Hollywood’s entertaining movies depicting fictional explorations of earth’s inner core. But earth’s surface area is mostly water—indeed, 71% according to the USGS, and 96.5% of that is salt water. The life-sustaining properties of the remaining 3+% fresh water available for human existence is well documented. And the epic waterwars between those who have it and those who want it form the plot lines of many old western movies depicting the battles fought for this precious resource. Following 5 years of parching drought in California, we enjoyed some respite in record-setting rainfalls but again learned first-hand the devastating and destructive effect of water unleashed upon the landscape. The national and local media have reported widely on the massive disruption and flooding in and around Houston, New Orleans, large parts of Florida, and most recently, Puerto Rico. Closer to home, we have noted the emergency evacuation of 186,000 people in Butte County and surrounding areas as floodgates and emergency spillways were attempting to corral an abundance of water at the Oroville dam and the Don Pedro reservoir. Meanwhile, the City of San Jose experienced its own flood emergency resulting in the displacement of about 14,000 residents, many other them apartment dwellers. This brings us to new legislation just

recently signed by the Governor. Assembly Bill 646 (Kalra) was introduced by the San Jose representative as a direct response to the reported flooding in his district. The incident was described in some detail in the Assembly Judiciary Committee’s analysis:

In February 2017, several San Jose neighborhoods experienced severe flooding that forced the evacuation of thousands of residents and businesses, and caused significant damage to public and private property throughout the city. According to the author, many of those in his district who lost the most in the flooding were renters who did not consider the need for flood insurance or assumed that they are covered under the property owner’s policy, yet lost all of their possessions, including their vehicles, and now do not have the aid of any insurance that would have helped them to recover from the devastating flood. Accordingly, this bill seeks to require landlords to provide written notice to prospective tenants of the fact, if true, that the rental premises is located in either a special flood hazard area or a dam inundation zone, as determined by the appropriate federal and state authorities. A number of communities and mobile home parks along Coyote Creek were submerged when Anderson Reservoir reached November 2017
its capacity and began spilling into the creek. The worst flooding in the San Jose area in more than a century flooded hundreds of homes and forced the evacuation of more than 14,000 residents. Reported damage to businesses and residents was in the neighborhood of $50 Million. While acknowledging some merit to the humanity underlying the proposal, we and others representing the rental property community were strongly opposed to the detail in the language of the bill as introduced. Consequently, a number amendments were proposed and ultimately adopted as a revised version of the bill was moving toward final enactment. In large part, the amended bill as approved as Chapter 502 of the Statutes of 2017 follows the theme of existing statutory sections regarding notice of known hazards and uses the approach recognized so successfully in the industry’s treatment of accessibility to sex offender information through the Department of Justices’ Megan’s Law data base. In this case, it relates to the on-line availability of special flood plain hazard information through the State’s Office of Emergency Services website. (www. myhazards.caloes.ca.gov.) We will have more to communicate about this bill in our upcoming commentary on other new laws affecting the rental housing industry. Meanwhile, here is the full text of the operative part of this new law that added Government Code Section 8589.45:
8589.45. (a) In every lease or rental agreement for residential property entered into on or after July 1, 2018, the owner or person offering the property for rent shall disclose to a tenant, in no smaller than eight-point type, the following: (1) That the property is located in a special flood hazard area or an area of potential flooding, if the owner has actual knowledge of that fact. For purposes of this section, “actual knowledge” includes the following: (A) The owner has received written notice from any public agency stating that the property is located in a special flood hazard area or an area of potential flooding. (B) The property is located in an area in which the owner’s mortgage holder requires the owner to carry flood insurance. (C) The owner currently carries flood insurance.
(2) That the tenant may obtain information about hazards, including flood hazards, that may affect the property from the Internet Web site of the Office of Emergency Services. The disclosure shall include the Internet Web site address for the MyHazards tool maintained by the office. (3) That the owner’s insurance does not cover the loss of the tenant’s personal possessions and it is recommended that the tenant consider purchasing renter’s insurance and flood insurance to insure his or her possessions from loss due to fire, flood, or other risk of loss. (4) That the owner is not required to provide additional information concerning the flood hazards to the property and that the information provided pursuant to this section is deemed adequate to inform the tenant.

characteristics specified by law. Arbitrary discrimination based on any personal characteristic is also prohibited. Under most state and federal laws, it is unlawful for a landlord, managing agent, real estate broker, or salesperson to discriminate against a person or harass a person because of the person’s race, color, religion, sex (including pregnancy, childbirth or medical condition related to them, as well as gender and perception of gender), sexual orientation, marital status, national origin, ancestry, familial status, source of income, or disability. Many states also prohibit discrimination based on a person’s medical condition or mental or physical disability; or personal characteristics, such as a person’s physical appearance or sexual orientation that are not related to the responsibilities of a tenant; or a perception of a person’s race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability or medical condi-
tion, or a perception that a person is associated with another person who may have any of these characteristics. Housing providers cannot use a financial or income standard for persons who want to live together and combine their incomes that is different from the landlord’s standard for married persons who combine their incomes. In the case of a government rent subsidy, a landlord who is assessing a potential tenant’s eligibility for a rental unit must use a financial or income standard that is based on the portion of rent that the tenant would pay. A landlord cannot apply rules, regulations or policies to unmarried couples who are registered domestic partners that do not apply to married couples. Nor can a landlord inquire as to the immigration status of the tenant or prospective tenant or require that a tenant or prospective tenant make any statement concerning his or her immigration or citizenship status. Housing providers should establish

rental criteria and apply it consistently to all applicants. To find the best and most qualified tenant for your property, certain tenant screening or rental criteria must be established. The successful applicant should: i) have acceptable and verifiable credit history, ii) have acceptable and verifiable tenancy history, iii) have sufficient and verifiable income to meet their present and future financial obligations, and iv) not pose a risk of harm to the rental property or to persons. Acceptable and verifiable credit history means that the applicant has faithfully honored his or her credit responsibilities in the past. By signing and submitting the apartment association application, consent is provided for you to run and receive a copy of the applicant’s credit history from the credit bureaus. Most apartment association can handle this request for you. Credit history is reported based upon a person’s social security or taxpayer

Q&A — continued from 11 identification number. To accurately evaluate a person’s credit history, all successful applicants should have either a social security or tax id number. Lack of a number will not preclude them from applying; however, it is impossible to verify that persons credit experience. As you review the applicant’s credit report, look for collection accounts, late payments, bankruptcies, fraud alerts, and other derogatory information that sheds insight into the applicant’s past practices. Verify that the former addresses listed on the credit report match the ones provided on the application. Note that the credit bureaus have implemented new rules and procedures effective July 1, 2017 which limits the reporting of judgments, foreclosures, liens, and other derogatory items unless specific identifying information, i.e. social security number is included on the court issued document. Since the courts restrict the inclusion of such

information, the result is most judgments, liens and other derogatory information is no longer reported by the credit bureaus. Beware! Acceptable and verifiable tenancy history means that the applicant has been a good tenant in the past. You certainly do not want to rent to the professional dead beat who has been evicted once or several times in the past. Most landlords will automatically disqualify an applicant who has been evicted in the past. Your apartment association can provide an eviction search report that will assist you in determining if your applicant was evicted previously. Be cautious though, as not all evictions appear on the eviction reports. These reports are tools to use, and although they are useful, they certainly are not perfect. In addition to past evictions, you want to see if your prospective applicant has been involved in any other litigation; has he been sued? Or has he sued a former landlord? These records are available, to a

limited extent, through public records searches in each county by accessing your local jurisdiction civil court’s website, or by a third-party provider. Sufficient and verifiable income to meet their present and future financial obligations means that the applicant can afford the rent that you will be charging as well as be able to handle their car payment, child support, credit card bills, student loans and any other obligation they might have. Many landlords will establish a minimum income requirement, i.e. all residents must have a combined gross income of at least three times the rent, however this minimum level may change over time and may not necessarily be static. Consider all legal sources of income. Employment, unemployment, SSI, child support, alimony, and public assistance, are sources of legal income and must be considered. Consider asking to see the original bank statements of the prospect

If he claims to make $4,000 per month, you should see regular monthly deposits of $4,000 per month on the bank statements. The applicant must not pose a risk of harm to the rental property or to persons, means that you certainly do not want to rent to an arsonist, drug dealer, sex offender or anyone who might harm your property, other residents, or might engage in illegal activity on the premises. Consider requesting a criminal background check from your apartment association. Your applications should not ask about ‘arrest’ rather they may inquire about ‘convictions for serious crimes against persons or property.’ Most housing providers, in years past, would decline to rent to persons convicted of a serious crime against persons or property. The law recently changed prohibiting blanket denials
based upon criminal convictions. Rather, housing providers must now identify individuals with criminal convictions and process their application in a special manner. This ‘secondary review’ should consider the “nature, severity, and recency of the criminal conduct.” Every case will now require individual attention and the review will be based upon the individual facts presented. Note that your consideration of past convictions should be limited to serious crimes against persons or property that were committed in the relatively recent past. This area of law is undergoing recent changes, so expect clarification over the next several months. You should consult your attorney for specific guidance in this area. Tenant screening techniques. Require each applicant to submit a credit screening fee upon submission of an application (amount changes annually — check with your local apartment association for the current maximum). Provide a written receipt
for the fee, using the form provided by the apartment association, if required by your state. Although many landlords don’t require the payment, thinking that they might lose an applicant, by requiring the payment, it acts as a prequalifier effectively eliminating the worst of the worst. Verify all the information provided on the prospect’s application. Make a photocopy of the applicant’s government issued picture identification, and maintain all in a safe and secure location. Verify employment by independently securing the contact telephone number from the phone book, or internet. Don’t be surprised if the ‘supervisor’ listed on the application, along with the phone number is simply the applicant’s girlfriend and her cell phone. When contacting previous landlords, expect to get the most helpful information from a ‘previous’ landlord, not necessarily the current one.

Q&A — continued from 14 Run credit and eviction reports on every applicant. Verify the information that appears on each report with that provided on the application. Look for inconsistencies, different addresses, or gaps in employment or residence. Does the applicant have multiple social security numbers? Different names or spelling of names? If the applicant is self-employed, ask for confirmation of a legitimate business. Does he have a website? Business cards? Business license? Ask to see his original bank statements for the past six months to verify that he actually is depositing the amount of money that he claims to be making. Consider informing all the prospective applicants that you have a policy of taking a picture of all successful candidates. This simple policy and practice is extremely effective in weeding out the potential drug dealer, identity thief, and those intending to use the property
for illegal purposes, these folks just don’t want their photo taken, and will quickly withdraw their application. Consider making a surprise visit to the applicant’s current residence. An unannounced visit about dinner time is usually most informative of the applicant’s current living situation. If you see a car parked on the lawn, and the house or apartment in shambles, and a bunch of ne’er do wells hanging out on the porch, picture that activity continuing in your property. If the prospective resident’s current household includes dogs, cats, and distant relatives, they will most likely join your prospect when he moves into your nice, freshly painted, and well-kept apartment! Don’t be shy about the surprise visit, the good prospect might be a bit startled, but will welcome the visit. Walk the applicant out to their car after he drops off the application. The make and model is not as important as the condition and contents of the interior. If you see a filthy beater dripping

Trust your instincts. Use common sense when reviewing the information provided and screening the applicant. Don’t rush! Don’t let the applicant force you to decide until you have completed your screening process. Rent to the best and most qualified applicant, not necessarily the first to apply. Contrary to what the tenants’ rights folks would lead you to believe, you do not have to rent to the first applicant who happens to squeak by, you want the best and most qualified. Sometimes you must accept three or four, or even ten or more applications before you know just who is the best and most qualified. Your own threshold of pain, and business sense, will tell you when enough is enough. Important issues to be aware of. Be careful when answering telephone calls from prospective tenants responding to your listing or advertisement. Do not attempt to pre-screen the applicant over the phone. Provide objective information about the unit, provide your general rental criteria as stated above, and encourage all to visit the property and submit a written application. You never know if the person on the other end of the phone is really a prospect, or rather a fair housing imposter posing as a prospect trying to trick you into a violation

These folks will then telephone the unsuspecting landlord, misrepresent themselves as something they are not, to trick the unsuspecting landlord into saying the ‘wrong’ thing. Gotcha. It’s better to have a vacant unit than to rent to a dead beat that will cause you nothing but headaches until the day he is evicted. The truly bad tenant will continue to haunt you by filing frivolous lawsuits both during and after the Sheriff shows him the door. The damage and destruction that can be levied by the ne’er do well scam artist can be extensive. Proper tenant screening at the beginning will effectively weed out these dead beats who intend on doing you harm. Pre-hung doors come already installed in the doorframe. The components include the door, outside frame and the hinges. Before the advent of “Pre-Hung Doors”, hanging a door required a skilled installer. Now a door can come already in its frame with the hinges in
place. You must start with a rough opening, which means the old doorframe must be removed. The skill required is minimal and you can often do a professional looking job the first time.

I have installed vinyl floor squares a number of times, but I can’t seem to get it square with the walls. It always looks like the floor is slightly cocked to one side. Do you have a procedure on how to start the first tile straight
and end up with a square looking job? Noah

After completing all of your floor prep work; be sure the surface is clean, dry and free from dust and debris. Measure the length and width of the floor; divide each measurement by two and mark the floor at the intersecting lines. Using the measurements, snap a chalk line along the length and width of the floor. This will produce a cross dividing the floor into quadrants. Now check your chalk line for squares-ness, using a carpenter’s square at the intersection of the two lines. Next, dry fit your tile in both directions to determine your run. Keep the following in mind: adjust your chalk reference lines to allow for full tiles at high traffic tile termination points such as dining room to kitchen, hallway to bathroom etc. Ideally, you will want to use no less than one half of a tile at any wall or termination point if possible. Start your first tile at the cross section of the two chalk lines. This will allow you to use two perpendicular straight lines to align your first tile. Follow each chalk line, putting down tile until you have a formed a cross dividing the floor into quadrants. Looking to Ease College Tuition Anxiety?

id you realize that, according to the College Board, more than $240 billion in grants from all sources (federal loans, federal workstudy, and federal tax credits and deductions) was awarded to undergraduate and graduate students in the 2015–2016 academic year? And that those students came from households spanning a wide range of household incomes? During that academic year, the average aid for a full-time college student amounted to $14,460, including $8,390 in grants (that don’t have to be repaid) and $4,720 in federal loans. Once you realize how many resources may be available and begin your research on financial assistance, you could be on your way toward easing some of the anxiety often associated with paying for college.

Start planning during the high school years. Pay particular attention to your child’s junior year of high school and reposition assets or adjust income before it begins. When financial aid officers review a family’s need, they analyze the family’s income in the calendar year beginning in January of the student’s junior year.

Assume you’re eligible for aid… until you’re told you’re not. There are no specific guidelines or rules of thumb that can accurately predict the aid you and your child may be offered. Because each family’s circumstances are different, keep an open mind as you consider financial aid alternatives. A number of factors ‒ such as having several children in school at the same time ‒ may increase your eligibility for assistance. Reassess assets held by your children. Federal guidelines expect children to contribute 20% of certain assets toward their education’s costs, while parents are expected to contribute up to 5.64%. That’s why assets held in custodial accounts (bank accounts, trust funds, brokerage accounts) in your children’s names may reduce the aid for which the family qualifies. But assets held in Coverdell Education Savings Accounts and 529 plans are factored into the parent’s formula, having less effect on the aid for which the family qualifies. Help grandparents’ target their gifts. Grandparents’ hearts often lead them to make gifts directly to grandchildren or to pay their tuition expenses. Even though payments made directly to a college avoid gift taxes, financial aid sources generally count these payments

as an additional resource the family has to pay for college expenses. A better idea for grandparents may be to make a gift to a 529 plan owned by the parent or grandchild. The financial aid treatment of gifts to 529 plans is generally more favorable than for gifts made directly to the grandchild. Plus grandparents using this alternative may also realize estate tax and gift tax benefits. Assess your family’s financial situation to determine what your children will need. Gather records and begin researching available financial aid, grants, loans, and scholarships. Two forms will be key to your aid application process: the Free Application for Federal Student Aid (FAFSA) and the College Scholarship Service Financial Aid Profile (PROFILE). Landlord Rights During a Natural Disaster

n the wake of Hurricane Harvey and Irma, multiple wildfires on the West Coast, tornadoes, and the recent 7.1 earthquake in Mexico, now would be the time to learn about you and your tenant’s rights during a natural disaster. As most parts of the United States are impacted by at least one natural disaster (with some areas hit by several different kinds per year), knowing what to do if a hurricane, earthquake, or tornado affects your property can alleviate some of the stress in the moment.
Contact your Tenants
First and foremost, you should try to get into contact with your tenants and make sure that they’re okay. Depending on if they’re still on the property or not, they might be able to give you some preliminary details about how they weathered the natural disaster, and if the roads are accessible. If there seem to be damages, you won’t be able to professionally repair them (or inspect them yourself) until the roads are clear. Talk to each of your tenants about

what your plan is moving forward. While you can’t make promises about the condition of their property, you can give them information on what you’re doing, and what steps they can do as well. For example, keep them updated on when the property will be inspected, when repairmen will arrive and how long it will take, assure them that you’ve contacted your rental property’s insurance provider and urge them to contact their renter’s insurance provider as well. Quick Tip: Let your tenants know that they can apply for federal disaster assistance. This can help cover costs like accommodation during repairs, disastercaused burial, and cleaning up some items.
Trust your Lease
After a major natural disaster, you should review the terms you have in your lease. This details not only what damages you’re legally responsible for, but what your tenants are responsible for as well. Beyond the lease, you’ll want to look over your state’s property codes. Each state is different and knowing your

tenant’s rights during a natural disaster can help you give advice to grateful tenants who seem lost or confused. Quick Tip: Don’t forget that fair housing rules still apply during a natural disaster!
“What about Rent?”
Regardless of the natural disaster, the tenant is responsible for paying the rent until the lease is officially terminated. That being said, it’s up to you to decide if you want to waive late fees. Make rental payments easier during a natural disaster by moving to an online payment system. Quick Tip: Before a natural disaster, make sure the lease agreement has language that details provisions if the property is partially or completely destroyed during a natural disaster. This includes clarity about rent abatement or lease termination after a disaster. After revising, contact your attorney to ensure your lease is compliant with state law. Passing the Torch, a Phase of Life

AOC recently presented two workshops on Passing the Torch — a family succession workshop. The second “encore presentation” welcomed the overflow of attendees from the first one and brought in additional families interested and intrigued by the topic. I will tell you all about them and what happened, but first I hope this disclosure is proof of how major this subject is to all of us. I helped plan this workshop. I contributed a lot of ideas. And in the end, I realized I need this workshop as much as anyone else. This is life stuff. It is not technical, financial, or legal. Well, only indirectly. It is family stuff; trust, fears, love, hope, and concern. Rich Lombardi moderated the three speakers, each an adult child taking over their parents’ rentals. He fielded questions, in a gentle, fatherly way. You won’t hear his approach from an attorney, estate planner, accountant or manager. Rich is a multi-faceted real estate person. He is a broker, an asset manager, an investor in apartments and other aspects of real estate. He is a born teacher, and also presides over a Toastmasters group. The three speakers spoke from the

heart, honestly and openly, about how they functioned as a family, all involved in the family’s rentals. Rick Roshan shared openly how he and his sister grew up in the business. As tykes, they swam in the pools of the apartment communities, while their mother inspected apartments and worked on the property. Both parents were involved in the apartments, and they spent weekends working there. Rick’s father was a doctor, and yet he saw the value of apartments in addition to a professional career. He planned that his children become functioning adults in the business world. Education was a given, and Rick’s sister became an attorney. Rick handles the family’s apartments with occasional help from his sister. Angie Sparks was selected as the child in her family who would be groomed to take over the rentals. She became an accountant and worked in that field. Now she is a mother of active children, and handles the apartments in tandem with a property management firm. Tim Gorman is the son of Bill Gorman, well known in Orange County for his innovative work and seminars. Tim grew up in the rental and real estate brokerage businesses. He is involved in several other endeavors,

among them being a franchisee of ChronicTacos. He and Rick are members of the AAOC Board of Directors. As Rick spoke I flashed back to our start. When we would bring our little children to a newly acquired apartment property, we would first drive by the nearest McDonald’s to show them how close were the treats and rewards. Not all children love going to apartments, and not all children love hearing about them. My children told me they thought I was born with a telephone in my ear. They hated waiting for me to finish on the phone so they could ask me something. I took them on so many errands when they were little, that they begged to stay home and play with their toys. In retrospect, perhaps we needed to have handled the apartments with a lighter touch, so as not to overwhelm our children. My son absorbed enough from us to appreciate the value of owning apartments, and he purchased his own. My daughter’s contribution was to pick a husband who was very handy and loved repairs and construction. He is my director of repairs, innovative, diligent, and dependable. The Metrics: Uses and Abuses (Part One of a Three-Part Series) from Cash In on the Myths of Real Estate
T
hroughout the writing of my book, Cash In on the Myths of Real Estate, I struggled with where to discuss metrics. I started the book with a first chapter entitled “Bill’s Top Myths.” I place such importance upon quantification that my intention was to include metrics in this section. However my son Tim, who served as not only my inspiration for this book, but also a very important collaborator, argued that this topic was among the most difficult to fully understand and would best be left to the end. Tim believed — and rightly so — that
before embarking upon an in-depth discussion regarding the tools — aka metrics — we first needed to define some of the key principles and practices. Throughout my series of articles for Apartment News Magazine, I’ve covered many of the basics. So, now it is time to focus upon the metrics. Metrics are the working tools that every investor uses to establish in his or her mind the value (or worth) of a property. However — as with any tool — the choice of which to use, along with when and how well the selected tool is applied, results in varying

degrees of accuracy and reliability. There is no one absolute approach to evaluating a potential investment opportunity. Nor is there one specifically right or wrong tool. In this and my next article, I am going to be looking at four of most common metrics used by real estate investors. Then, in the third article of this series, I’m covering the wrap-up to Myth 9-3 which introduces what is, to me, a much better tool to use — IRR or Internal Rate of Return.
9-3 Cash-on-cash, cap rate, gross rent multiplier, and price per door are the best ways to evaluate income properties. Popular Belief: Cash-on-cash, capitalization rate, gross rent multiplier, and price per door are the tried and true metrics that investors should use to evaluate potential income property purchases. Bill’s Truth: These metrics can be useful, but they are not, by themselves, the best way to evaluate income property. In fact, each comes with its own limitations and could lead to false conclusions. The biggest drawback is that all four of these metrics (cash-on-cash, capitalization rate, gross rent multiplier, and price per door) focus upon just one year of operation. 1. C ash-On-Cash is the ratio of annual, before-tax cash flow as compared to the total amount of cash invested. The ratio used is applied as: Cash-On-Cash Return =
Net Operating Income After Debt Service Net Equity (Down Payment)
Cash-on-cash is a good indicator of how your money is performing, but only as a point in time over a oneyear period. This metric can also be skewed by deferred maintenance items and unreported expenses.

When making a purchase decision, as I point out in Myth 9-3, cash-on-cash uses only first year data to project value. Also, the accuracy of the outcome from this tool can easily become skewed. This is particularly true when using cash-on-cash to evaluate a potential purchase of a smaller property, where the owner personally handled the maintenance. All of us tend to discount the cost of our own time and that is particularly true when doing repairs. Deferred maintenance also carries an impact. When making a purchase, most of us obtain at least termite and roof inspections, which offer some degree of insight into potential additional expenses. However, using cashon-cash as your means of evaluating an investment property that you have held for several years is much more problematic. If you are not including reserves for major repairs as a part of your current expenses, you are apt to be facing a very unpleasant surprise in the not-sofar-future. Of equal importance, cash-on-cash ignores the value of money over time. And this brings me to the metric that I will be focusing upon in my next (December, 2017) article — Capitalization Rate. The capitalization rate is an oftenreferenced investment tool, yet this is also perhaps one of the most misunderstood of the quantifying methodologies. Next month I will be focusing my entire article on not just what capitalization rate means, but how this tool is applied and, often, misapplied.
Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester.
