I

n baseball, it’s the bottom of the 9th inning. In boxing, it’s the (championship) 11th and 12th rounds. In politics, it’s the month of November and we are heading into what is easily the most important political contest in decades. Property rights, property values, equity and cashflow are all at stake on November 6th as voters choose to decide whether or not to repeal a once relatively unknown and now well recognized California Act known as Costa Hawkins through Proposition 10.

Battered and Bruised

This has been a grueling fight. One that is weighed by emotion on the “Yes” side: The rent is too damn high! And one supported by fact: a repeal of Costa Hawkins would result in decreased construction of new housing units needed to support our current and growing population. While the sentiment is not lost in today’s world of an improving economy and rising rents,

the so-called Affordable Housing Act will not make rents more affordable and will not create more affordable housing. It is just another selfish ploy by Michael Weinstein of the AIDS Healthcare Foundation to curtail economic growth and development.

Socially and Economically Just

We have presented facts and data, and also helped to share stories as to how a repeal of Costa Hawkins would be so devastating for both sides (owners and renters). Renters would be doomed for years to come by a dearth of new and needed rental units and homeowners would see values decline as the result of an expanded rent control regime in California. So it’s no surprise that our industry has come together with hundreds of other important stakeholders from the social justice, business and real estate spectrum to oppose this truly flawed initiative.

aving lived and breathed Proposition 10 for the past six months, it has become very clear to me that, whatever the outcome, AAOC’s local advocacy will be much more important going forward than it has been in the past. AAOC’s past local efforts have been significant and essential in thwarting stupid policy and maintaining property rights for rental housing providers for decades. However going forward we will be fighting issues

as consequential as rent control and Prop 13 attacks. I predict we will be dealing with these critical issues and more as property rights opponents get more creative and organized. For sake of perspective, I attended the NAA convention in June and was able to interact with a number of Association Executives across the country. The issues they deal with in their respective locales are tame compared with what we’re up against. Interestingly many of the issues they deal with are issues we dealt with a number of years ago. Only a couple of associations (Seattle and Chicago) are dealing with rent control, but other than the rest of the country are fighting battles that were fought here years ago. This is further evidence that many trends, both good and bad, emanate in California. I think we’ll be forever fighting to thwart the extreme overreach by government and special interest groups. After all, Proposition 10, largely spon-

sored by one man/organization, has overturned an entire industry, galvanizing it while challenging the whole idea of individual private property rights. Many of our future battles will be contested locally with the goal being to preserve our property rights and keep the rental housing business vibrant and healthy while providing the best quality we can. This year a record number eleven rent control efforts were initiated in cities across California from San Diego to Santa Ana and Santa Rosa. The San Diego County city of National City was the sole Southern California jurisdiction to hold a vote this fall. Be sure that advocates of rent control will persist while becoming more emboldened and organized. All this is why AAOC has gotten even stronger and more organized interacting with many of the cities in the county. Bill Christiansen has become essential to this effort and has a lot of assistance from staff as well as the Legislative Committee and Nicholas Dunlap. Our ongoing message will be that tighter, more rigid rent control laws will serve to have a contagion effect on new development that would virtually halt new apartment growth and hurt California’s overall economy. Instead the solution is to start building more affordable housing to address the needs of all Californians seeking better quality of life and safe modern housing for their families.

California’s New Prop. 65 Hazardous Chemical Warnings Updated Q&A

S

tarting August 30, 2018, businesses, including rental property owners and managers in California with more than 10 employees will be required to replace their existing Prop. 65 hazardous chemical warning signs with new signs that are more specific about the hazardous chemical that may be present in specific areas. Specifically, the new regulations require new signs in enclosed parking facilities and designated smoking areas. This Q&A provides an overview of Proposition 65 and explains how rental property owners can comply with the new regulations.

What is Proposition 65?

Amid rising concerns about exposure to toxic chemicals, California voters in 1986 approved Proposition 65 (“Prop. 65”), which requires California to publish a list of known chemicals that cause cancer or reproductive problems, and for businesses to provide a “clear and reasonable” warning before exposing individuals in the state to any chemical listed by the state as toxic. There are currently 850 chemicals on California’s list. The Office of Environmental Health Hazard Assessment (OEHHA) administers the program. See the list at the Environmental Health Hazard Assessment (OEHHA) website, oehha.ca.gov. After Prop. 65 went into effect, business owners with 10 or more employees, including rental property owners and managers, were required to post warning signs in and around their properties

warning the public of possible exposure to harmful chemicals. The signs typically warn the public that they may be exposed to chemicals known to cause cancer or reproductive toxicity. Failure to comply with Prop. 65 regulations exposes businesses (including property owners and managers) to potential liability, including penalties of up to $2500 per day per violation. In addition, business owners may be subject to injunctive relief and attorney fees.

What’s changing with the Prop. 65 law?

New California regulations, adopted in 2016, and which go into effect on August 20, 2018, require businesses to replace their old signs with new signs that provide the public with more information. A typical old sign read: “WARNING: This Facility Contains Chemicals Known to The State OF California To Cause Cancer And Birth Defects Or Other Reproductive Harm”. The new signs, however, significantly revise the required warning content and specify separate “safe harbor” warnings (described below) based on the type of business and/or product, the chemicals at issue, and the method of transmission. The new signs must contain the following: • A statement that the area or facility “can expose you to” a particular chemical (this is a significant departure from current regulations); • The name of at least one listed chemical, like carbon monoxide,

that prompted the warning; • Specify whether that chemical is known to cause birth defects or reproductive harm, cancer or both. • If the warning for one chemical (such as lead) is both a carcinogen and a reproductive toxicant, the warning is to specify that chemical; • The internet address for OEHHA’s new Proposition 65 warning website; • A triangular yellow warning symbol , with the word “WARNING” in all caps. The purpose of the change, in the words of Governor Jerry Brown, is to provide “more useful information to the public on what they are being exposed to and how they can protect themselves.”

What do rental property owners need to know about the new Prop. 65 regulations?

The new regulations directly impact rental property owners and managers in California who have 10 or more employees. Such owners must replace their old warnings signs with new ones in two different areas of their buildings: 1) enclosed parking facilities, and 2) designated smoking areas. Owners and managers can design their own warning signs as long as they comply with the new standards. Owners and managers whose signs do not comply perfectly with the new regulations, however, are subject to liability for non-compliance.


Alternatively, an owner and manager can use “safe harbor” signs, which contain the precise language expected by the state, and which if used, ensures that the owner and manager cannot be sued for noncompliance. The term “safe harbor” is merely a term of art that refers to a provision of a regulation or statute that if complied with properly, ensures protections against liability. It is important to note that all signs must be “clearly visible under all lighting conditions normally encountered during business hours and under such conditions as to make it likely to be seen, read, and understood by an ordinary person.” Title 27 California Code of Regulations Article 6 Clear and Reasonable Warnings § 25600.1. Definition of “Sign.”

What signs are needed for enclosed parking facilities?

The term “enclosed parking facilities” simply means parking lots that are covered by ceilings and walls, like underground parking lots, above ground covered parking lots, garages and carports. These “enclosed parking facilities” must have warning signs because they can contain harmful doses of carbon monoxide from the exhaust of motor vehicles. Warning sign verbiage: the following is the safe harbor language that if used protects against liability: (See 27 CCR Section 25607.21)

Warning: Breathing the air in this parking garage can expose you to chemicals including carbon monoxide and gasoline or diesel engine exhaust, which are known to the State of California to cause cancer and birth defects or other reproductive harm. Entrances include those accessible by vehicle and pedestrian (including alleyways and sidewalks). • Signs must be displayed so that they are readable and conspicuous to the public before they enter. • Signs must be 20 x 20 inch sign with at least 72-point type and be enclosed in a box. The outside dimension of the sign may be larger however, if the outside dimension is larger the Prop 65 warning still must be 20 x 20 inches with at least 72-point type and enclosed (emphasis added) in a box. ( See 27 CCR Section 25607.20). • The sign must be in English and any other languages that are used on signage at the entrance.

What sign is needed for designated smoking areas?

A designated smoking area is an area on the property specifically reserved for smoking. Any areas designated as a smoking area requires a Prop. 65 warning. Therefore, if smoking is generally allowed anywhere on the property, then the entire property is considered a designated smoking area, and warnings signs will be required to be posted all over the property. It is highly recommended that property owners and managers who do allow smoking on the property designate a specific area or areas for smoking. Reducing the number of areas that people can smoke will limit the number of warning signs required. Nonsmoking tenants will also appreciate it. If smoking is prohibited anywhere on the property, then no warnings signs are required. Warning sign verbiage: the following is the safe harbor language that if used protects against liability:

Are there more Prop. 65 regulations coming? Yes. Although not yet finalized, OEHHA is expected to adopt a regulation that allows rental property owners and managers to provide Prop. 65 warnings, other than those for enclosed parking facilities and designated smoking areas, in their rental contracts. Thus, owners and managers who store or use certain cleaning or pesticide products, that contain Prop. 65 chemicals, on their property will not have to post warning signs for exposure to those chemicals. Instead, owners will be able to simply add a lease provision into their rental contracts warning of the presence and exposure to those chemicals. Any warning provided within a lease contract will have to abide by OEHHA’s rules and regulations. This new regulation is not expected to be effective until sometime in 2019.

What should owners and managers do with the warning signs that are currently posted?

For all Prop. 65 warning signs related to enclosed parking facilities and designated smoking areas, you must take those down and replace them with new “safe harbor” signs or warning signs that are consistent with the new regulation. All other Prop. 65 signs, like those warning about pesticides or cleaning chemicals, must remain up until next year when the new regulations allowing for lease contract warnings go into effect. I

am a very conscientious landlord. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. This month I received a letter from one of my tenants telling me that I had no right to enter his apartment to look around, that he would not let me in. What do I do? Can I force my way in to do the

inspection?

Your policy of doing annual inspections is admirable, and is practiced by responsible landlords throughout California. Most tenants welcome a responsible landlord’s actions in ensuring that all is well, and voluntarily cooperate in providing access upon the landlord’s reasonable request. It is clearly in the best interest of all to ensure that any maintenance issues are promptly

addressed, and that a spirit of communication and co-operation exists between a landlord and his residents. Trouble is, your resident is right. There is no specific provision in California law requiring a resident to allow the landlord access to merely “inspect” the premises. California law states that a landlord can enter a rental unit only for certain reasons. Those reasons are in an emergency, when the tenant has moved out or abandoned the premises,

to make necessary or agreed repairs, decorations, alterations, or other improvements, to show the unit to prospective purchasers, tenants, or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a pre move out inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a landlord to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. My tenants and I seem to be able to work out our differences quite easily, but there are times when we disagree as to just who is responsible for making certain repairs to the apartment. Can you give me some guidelines that will help me decide if the repairs are my responsibility or the responsibility of the tenant?

Residential rental units must be “habitable.” In legal terms, “habitable” means the rental unit is fit for persons to live in and that it substantially complies with state and local building and health codes that materially affect a tenant’s health and safety. The law makes both

landlords and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental agreement can determine who takes care of the minor repairs. California law lists several items that are required to maintain a habitable unit, these are effective water proofing and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facilities, heating, and electrical in good working order; clean and sanitary buildings and grounds; adequate trash receptacles; floors, stairways and railings in good repair. Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, and smoke detectors. A landlord is also responsible for the installation and maintenance of the inside wiring for one telephone jack. Tenants must take reasonable care of the rental unit and the common areas. Tenants are responsible for repair of all damage resulting from their neglect, abuse, or acts by

their family, guests or pets. Tenants must do all of the following: keep the premises “clean and sanitary,” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly, not destroy, damage or deface the property, not remove any part of the structure, dwelling, facilities or equipment, must use the premises as a place to live, and use the rooms for their intended purpose, and notify the landlord when dead bolts and window locks don’t operate properly. Most of my rental properties are residential multi family, but I have one small retail strip center in Los Angeles that I own as well. I’ve never had a problem with my commercial tenants, but I have one who hasn’t paid rent this month. Can I use the same three-day notice to pay rent or quit that I use for my residential properties?

Commercial and residential landlord tenant laws differ in many ways. One major difference between the two is the ability to accept partial rent payments after service of a notice to pay rent or quit for a commercial property, and not for a residential property. Legal Q&A — continued from 13 partial payment without waiving your notice, and may proceed with an unlawful detainer action without having to re-serve a new notice. For that reason, all commercial notices to pay rent or quit should contain language stating that in the event a partial payment is made, it will not act as a waiver of your right to commence an unlawful detainer action. If you have served a notice that does not contain the proper language, and your tenant tenders a partial payment, you may immediately provide the tenant with a letter acknowledging the partial payment, but also stating that the partial payment will not act as a waiver of your right to proceed with an unlawful detainer action. Other than that, review the cure periods stated in the default portion of your lease. Typically, the cure period for nonpayment of rent or other monetary sums due is three days. Failure to pro-

vide proof of insurance is typically three days as well. Most commercial leases will allow ten or thirty days to cure a non-monetary breach. Ensure that the forms that you intend to use are consistent with the terms you have negotiated in your lease agreement, as the terms of your lease will control. I have a tenant who just skipped out last weekend. He’s been behind in his rent, but I was working with him and he was catching up. Got an email this morning from him, confirmed that he was out, said he left the keys in the unit. Guess I’m kind of glad he’s gone, won’t have to go through the eviction process, but now what? He’s only six months into a one year lease, and I don’t have any prospects. What is my next step?

First thing is to confirm he’s out, pick up the keys and change the locks. Document the condition the unit was left in, by taking several pictures of the

premises. If there is damage, take detailed pictures of the damage. You will need to provide an accounting of his security deposit within twenty one days if the property is residential, thirty days if it is commercial. Now that you have possession of the premises, you have an obligation to mitigate your damages, that is, to attempt to relet to minimize the loss that you are sure to incur. Ensure that you maintain a log and document your actions in attempting to relet the premises. If you retain the services of a broker, ensure that he or she does the same. Your former tenant is responsible for the remaining term of the lease as well as any costs that you will incur in re-letting the unit. These additional costs might include advertising fees, signage, broker’s commissions, tenant improvements for the replacement tenant, and the difference in rent for the remainder of the term in the Legal Q&A — continued on page 18

We have a Formica style kitchen counter top in a vacant unit which has knife cut damage from a previous resident. The damage is localized and the rest of the counter top is in great shape. I really don’t want to replace the top for such a small area of damage. Do you have any suggestions on repairs? Frank

Dear Frank:

Depending on the location of the countertop damage, use a wood, tempered glass or nylon cutting board of slightly larger size than the damaged area. Draw a template on the countertop using the cutting board as a guide. Carefully cut the damage area out. Use a very fine saw to make the opening, this will keep the edges clean. The hole should not be more than one-eighth inch larger than the cutting board. This will leave a hole in your countertop the

size of the cutting board. The hole may need to be reinforced and spacers added to make up for the thickness of the new board. The cutting board should either be flush to the existing surface or no more than one-eighth inch above the surface. Use good quality adhesive silicone caulk to install and seal the cutting board to the countertop. If you don’t feel confident in your cutting skills, there is an alternative. The tempered glass cutting board is

If the board is clear, you may want to paint the underside to help hide the countertop damage. Clean any grease or wax from the damaged area of the countertop and apply water proof construction glue and press the glass cutting board into place. After the glue has cured, use a good quality silicone caulk to seal and dress the edges.

Most bathroom sinks have an overflow hole near the top edge of the sink. This hole serves two purposes; 1: Acts as a safety drain to keep the sink from overflowing should the water rise above a certain level in the sink. 2: The over-

flow hole also serves as an air vent for the sink when the water levels are above the pop-up plug. The overflow hole allows air to escape through the drain and the water to evacuate more efficiently. A great way to update older and modern units is to upgrade the cabinet knobs, interior door knobs and hinges. Typically apartment or builder grade knobs and hinges are rather utilitarian in nature. They get the job done and that is about it, nothing fancy. That missing certain “je ne sais quoi” in a remodeled unit can be found in the choice of knobs and hinges you install. A wise choice is a lever style knob for interior doors. They come in many different finishes and colors and they not only look attractive and modern, they are user friendly for any disabled or older residents. The use of solid brass knobs adds a bit of weight to a door making it appear rich and sophisticated. Stainless steel knobs, pulls and hinges can make any cabinet look more modern and rich. Check at your local home improvement center for ideas along with these brand names to look for: Westlock, Hamilton Sinkler, Schlage, Baldwin, Kwikset.

Maintenance — continued from 17 plug. Most snakes are too big to go through the overflow drain. Alternatively, a speedometer cable will work great or even a long zip tie will work. Push the cable or zip tie down through the overflow hole at the top of the sink and push any gunk out into the drain. Use water to help push the debris out the overflow drain, a funnel works great to direct a good flow of water. If you can-

not access the overflow to drain, you will need to disassemble the main drain assembly to gain access to the overflow drain exit. Once the overflow drain has good airflow, the sink should drain a bit faster. If this does not solve the problem completely, look at restricting the water flow coming out of the faucet. Lifetime Achievement Award Winner — Ray Maggi

N

o single individual has impacted the apartment industry in Orange County quite like Ray Maggi. A vocal and passionate advocate, Maggi has war stories that date back to a time where there were no blogs, email addresses or social media outlets and in order to stop a potential rent control ordinance from being enacted in one city, he was forced to publish the home telephone numbers of the mayor and councilmembers. Needless to say, Maggi and the Apartment Association won that

fight. But there is much more to Ray than his sharp wit and affinity for legislative affairs. His kindness and generosity to those fortunate to call him a friend or colleague are perhaps the greatest successes of his nearly 45-year history of involvement with AAOC. Without question, Ray’s story is a classic. With a young family and his own home, he began to study real estate investment. Quickly, he discovered that if he sold his home and utilized the proceeds along with savings, he could

acquire a 40-unit apartment community in Cypress and leave his career in the aerospace industry. He acquired the apartment house and soon converted two, two-bedroom units into one and moved in shortly thereafter. He learned the business from the ground up and went on to build a portfolio that consists of more than 500 owned units and 2,000+ under management through his company, MPMS. Ray Maggi — continued from 19 building (The Orleans) today and if you ever get a chance, ask him about the roof system he created for it. Ray joined the Board of Directors at the Apartment Association in 1975 and was responsible for many “firsts”. Legislative advocacy at the state and local levels was his forte and he became known for his knowledge and understanding of the numerous bills put

forth each session that would impact the industry. AAOC Past President Vicki Binford recalls this insight, “not only would he read the bills, he would study them and analyze them — he was critical in helping with so many things, especially the Prop 65 safe harbor.” And it didn’t stop there. Maggi also had the foresight to recognize the need for a Political Action Committee and spearheaded its formation. He was relentless in negotiating with legislators and also in seeking the big checks needed to fight costly battles such as rent control.

Longtime AAOC Executive Director Valerie Teeter had this to say, “AAOC has seen great benefit from his loyalty, tenacity and dedication — not just the Association, but the rental housing industry as a whole.” Maggi’s efforts at AAOC soon expanded to include leadership roles at the California Apartment Association (CAA) and also the National Apartment Association (NAA). The industry has changed over the years, but the history and insight that Ray carries with him has not. ur September General Meeting featured Adam B. Summers, a Research Fellow at the Independent Institute and an expert on the perils of Proposition 10 and rent control. As we all know, the entire state of California, especially the multi-family housing industry, would suffer tremendously with the passing Proposition 10, making it extremely important to educate at any chance we get! As members filed toward the ballroom of the Great Wolf Lodge before they were greeted with “No On Prop 10” yard signs and a number of our Product & Service Council Members who had set up information tables in the reception area. AAOC President Nicholas Dunlap kicked of the well-attended meeting by thanking our evening’s sponsors

In our state, government regulations account for over 25% of the costs to build a new single-family home. n 2018, we have seen the war for talent increase. In each of the past few years, there has been an increase in the work load among the contractors and handymen. They are hiring more workers and increasing their prices. It’s good news for contractors, but it’s increasing harder for owners, operators, and developers to get con-

tractor bids in their budget and the nomic growth grew past 4% in the secwork done on schedule. The jobs are ond quarter of 2018. 18 years, I have built many relationships with owners, clients, and friends. And once I started investing in and operating my own apartments over the years, it came to my attention very quickly that I needed a good contactor for capital improvement projects as well as regular maintenance. As most people might do, I started asking around and doing some research. It also became crystal clear that asking all those owners, clients, and friends if they knew of a good handyman was like asking them if I could borrow their only car for a month. The fact is it’s rare for a good handyman or contractor to be shared freely by others who are also using them. The combination of rising rents and low vacancy is causing owners and operators of multifamily to spend more on construction, and capital improvements such as interior and exterior renovations. Personal disposable income grew by 5.4% over the last year, and wage growth in the first half of 2018 is at its highest level of 2.7% since the recession. All of this causing increased pressure on owners and operators in finding well priced and qualified contractors. Single family and multifamily developers don’t have it any easier with developers set to deliver a 7.5% increase in supply, and demand expected to increase by 19%. The race to find the best qualified contractors, while staying on time and under budget is on. Here are some do’s and don’ts to hiring a contractor. Always hire a licensed contractor. That means checking the license on the internet to make sure it’s valid and from the proper entity. If a worker gets hurt, there could likely be increased liability for an owner who hired an unlicensed contractor to complete the work. Always get a written bid, in fact you should get multiple competing bids to review. Ask for and check contractor references. This is easy to ask for and do, but most people do not do it. You should also check the quality of the contractor’s materials. Ask them about the different materials, so you can compare the bids apples to

apples. Don’t trust verbal agreements. Get them in writing. Where should you look for a contractor? Well you can always ask around as I mentioned before. You can ask your fellow property owners or the broker you are working with. I get requests from owners fairly often. You can look in your local multifamily association magazine, which will have at least a few contractors advertising in it. There are also many websites to search such as

Thumbtack, Angie’s List, Home Advisor, and more. Gather All Your Assets

nvestment planning is like doing a jigsaw puzzle except the pieces don’t always come in one box—often you have to gather them from a variety of sources. When putting an investment plan together, you have to combine information on assets, debt, insurance, and more to form the full picture of your financial life. However, people often forget about or lose some of their investment planning puzzle pieces, and then the picture is never really complete. It’s one reason why many people don’t have a complete picture of their financial life, says Elizabeth “Liz” Bartley, Sales Advisory Consultant at Wells Fargo Advisors.

Why the full picture really matters

“From an investment standpoint, you don’t really have a good gauge of how much risk you could potentially be taking,” if you aren’t looking at all of your holdings in conjunction with each other, Bartley says. It’s not just investments. Loans, including any student loans, business loans, or mortgages, may impact your overall plan, too. Without this full picture, individuals and their financial advisors end up doing their investment planning based on what amounts to faulty information. And that can result in a risk profile or asset mix that doesn’t represent your desires or needs. This is especially common among

people who have assets spread across numerous financial institutions—you may have several 401(k) accounts from different jobs maintained at a variety of institutions, some online investments in another place, and your primary portfolio you maintain with your financial advisor. “Understanding how much debt you have versus assets is a starting point for making improvements and creating more wealth over time,” Bartley adds.

Putting the pieces together

So how do you collect everything you need? Financial advisors often start with a checklist of important information, Bartley says. Even when most of your assets are with a single company, there’s still information to gather from other sources. Ask your financial advisor to keep copies of this information, which can function as a backup for your records. That’s especially valuable, Bartley says, in case anything happens to you. Your complete financial picture may include: • Investment accounts with other institutions. This could include qualified employer-sponsored retirement plans (QRPs), such as a 401(k), 403(b), or governmental 457(b), still at previous employers, and IRAs.

• Checking and savings accounts. • Assets you own, such as your primary residence, a second home, rental property, and valuables— antiques, jewelry, or an art collection. • Debts, including your mortgage, credit card balances, and other loans and lines of credit. • Other investment vehicles, such as long-term care insurance, annuities, and life insurance policies. • Trust funds. • Rental income or other earnings beyond your primary source of income. • Social Security statements. Defining a Successful Sales Transaction from Cash In on the Myths of Real Estate

ome investors approach buying and selling as a game where there are winners and there are losers. To these individuals, if you are not winning, you are losing. However, in real estate there truly can be two winners. Based upon the unique goals and time horizons of each party,

However, sometimes you need to step back, take a deep breath and figure out what you really want from a sale. Price isn’t everything. Other con-

Negotiation is an art. Smart investors are willing to give on some points in order to gain agreement on other considerations that they deem of equal or more importance. One of the key factors in selecting an agent is his or her ability to negotiate on your behalf. When putting your property on the market, discuss with your agent what you really want to achieve and what concessions you might be willing to make. Clearly communicate both your needs and your wants. Then, before entering into any negotiations, review all of the particulars of the offer and weigh each one in terms of what you and your agent believe is critical to achieving your desired outcome. Stay focused on your endgame and do not take the process personally. The investment community is actually smaller than you think. You are likely to find yourself entering into another transaction with either the same buyers and/or their agents. Be professional and polite. Always take the higher road. Cash In: Make sure that your agent is skilled in the art of negotiations and fully understands your position.

As pointed out in Myth 4-3, the first step is to work with your real estate agent to clearly define what you want and need to achieve with the sale of your property. The sale should be

treated as the means to an end, not the end itself. The question to ask is — will this price or these terms get me where I want to be? Remember, too, that the signing of the contract is only the beginning. Throughout the entire process there are often further issues to be negotiated.
