National Rent Control Under “Place to Prosper Act”

W

ell, we lost the battle over AB 1482 to stop rent caps and the imposition of just cause evictions in California. Just when you thought it couldn’t get worse, think again! The nightmare of over-regulation of the rental-housing industry and landlord bashing has moved to the national stage. New York Congressional Representative Alexandria OcasioCortez, who first caught my attention earlier this year with her anti-cattle rhetoric, blaming global warming on the cattle ranchers as part of her Green New Deal, has turned her attention to the rental-housing industry. If I didn’t have a beef with her then, I certainly do now! Just a few days ago, Rep. OcasioCortez announced her latest crusade, the “Place to Prosper Act,“ which, among other things, would place a three-percent cap on rent increases nation-wide. If you saw my President’s Message last month, you know that I stated that the five-percent benchmark in California

would most certainly be whittled down in the future to a lower number. Really? Three percent? How can our industry weather such an assault? A three-percent cap is absurd when you think about a few of the things that we, as landlords, are forced to absorb in our day-to-day operations. An article in the Los Angeles Times on October 3, 2019 mentioned that “Statewide reservoir water storage is 128% of average.” Well, a reasonable mind might conclude that water rates for consumers would be lowered this year. Think again. During times of drought, water agencies still raise rates, but as far as I know, do not lower them during surplus years. During the next drought in California, which is always right around the corner, water rates will surely rise more than three percent. Electricity rates for common areas increase year after year with no end in sight. For those of us in south Orange County, San Diego Gas and Electric is our service provider. press release from the Public Utilities Commission interesting. “Under SDG&E’s proposal, the electric bill for an average inland customer using 500 kWh per month would increase by $6.66 per month or 4.6 percent when compared to a 2018 bill.” Water and electricity are two common line items to our bottom line, not to mention property taxes. The next battle looming for the 2020 state legislative session and our state elections will be the dreaded Split Roll Property Tax and rollback of Proposition 13. Stay tuned! Preparing for Battle in 2020

T

he battle over rent caps and just cause evictions in AB 1482 (Chiu) may be over, but the war for the future of California’s rentalhousing industry is just getting started. Despite the overwhelming statewide defeat of Proposition 10 last November, the California Legislature dismissed the will of the voters and this year introduced and passed AB 1482. The new law, which takes effect on January 1, 2020, is already changing the way

rental property owners and operators are planning and preparing to do rent increases, handle evictions and more. Meanwhile, the rental-housing industry is preparing to defend itself on two fronts. Not only will it have to contend with continued legislative assaults, out of Sacramento, but it will also have another state ballot initiative that seeks to further weaken the industry and usurp more control in our business decisions. Housing Is a Human Right, the “housing advocacy division” of AIDS Healthcare Foundation, announced last month that more than 625,000 signatures have been collected in support of qualifying its “Rental Affordability Act” initiative for the November 2020 ballot. Signatures are still being collected to ensure enough valid signatures are collected before the December 23 circulation deadline. You may recall that this is the same organization that put Proposition 10 on the ballot in 2018. So, what will this latest state ballot initiative seek to accomplish? According to the Secretary of State’s ballot summary, the initiative: • Amends state law to allow local governments to establish rent control on residential properties over 15 years old. • Restricts rent increases on rentcontrolled properties to 15 percent over three years from previous tenant’s rent, in addition to any other increase allowed by local ordinance. • Exempts individuals who own no

more than two homes from new rent-control policies. • Provides that rent-control policies may not violate landlords’ right to a fair financial return on their property. A news release from Housing Is a Human Right, announcing the signatures collected, also included the following quote from director René Christian Moya. “The real estate lobby might have believed that the recent passage of AB 1482 was the end of the story. They’re wrong. The time for real rent control is now.” The rental-housing industry has a real war on its hands. It’s going to require all of us to do our part to protect and defend our interests from individuals, institutions and organizations that wish to inflict pain up on our industry and make rental property ownership and operation even more difficult. We are now 12 months away from the November 2020 General Election. May we call upon you to assist AAOC and the greater California rental-housing industry in this fight? What resources can you contribute to help the cause? The Future of Housing: When Rental Owners & Politicians Work Together (Part 2 of a 3-Part Series)

W

ith hundreds of cities and counties across America trying to deal with a dearth of housing stock, public officials at all levels are getting involved. Whether these policymakers are in the early stages of debate or actually implementing changes, rental property owners are being painted as the villains. As long as that narrative continues, the one’s with the most to lose will continue to be left on the outside of the discussion; with minimal opportunity for feedback. California Strategic Advisors has written a 3-part series that examines the future of housing and provides viable solutions to ensure rental property owners are substantial players in the process. Part 2 examines how rental owners have been advocates of tenants in the past. Becoming a subject matter expert in California policymaking requires knowledge and experience. As we discussed in Part 1 of our 3-part series, the Legislature currently views rental owners as the villain in this grand fight to secure affordable housing for all residents. Some of that sentiment is attributed to stories of tenants being kicked out of their homes after living there for twenty years or more; a situation that cannot always be avoided.1 The other reason is due to term limits. 1 Shalby, C. Legislators are turned over every 12 years, meaning that many do not know about all the positive things our owners have done to improve the lives of tenants. Remembering how we have worked with local governments and the state legislature helps equip us with the narratives that counter that sentiment. In this column, we will focus on how rental owners have been advocates for tenants and also how some government policies have indirectly benefitted rental owners in the long-run.

Reminding our legislators of stories like AB 976 is crucial to us taking back the narrative and once again becoming a driver in this policy development. Some contend government interference into property rights started with the landmark case of Pierson v. Post in 1805; determining whether a fox hunter’s prey constituted one’s property.2 Others would argue that government intrusion goes all the way back to the Roman empire when private property was subjected to government over-

sight.3 Regardless of when it occurred, the current overreaching oversight into rental properties is likely to continue with rental owners further losing their autonomy on how they structure their leases with tenants. The best way to combat this is reminding new legislators that rental owners have been advocates for tenants for a long time; long before they were state representatives. Many legislators and tenants forget that one of the strongest anti-discrimination policies related to housing came about due to rental owners seeking to protect their tenants. In 2006, the City of Escondido sought to bar the renting to undocumented immigrants and demanded property owners compile information about their tenants.4 While the issue was challenged Federally, several other nearby cities began to adopt similar measures and some rental owners started screening their tenants. In fact, the City of San Bernardino overwhelmingly voted on a ballot measure banning undocumented immigrants from renting units in the county.5 Rental owners responded to this demonstrative policy by introducing and solely sponsoring AB 976, which prohibited local governments from 3 Cicero, M. banning undocumented immigrants from renting property and prohibited owners from screening and/or compiling this data.6 This law has protected millions of undocumented immigrants, and has served as a strong barrier to ICE and their often nefarious deportation tactics. The bill was strongly supported by housing advocates, the ACLU, immigration advocates, and all the groups that are currently labeling rental owners as evil landlords. Unfortunately, none of the legislators from 2007 are still in office and the new policymakers only hear the angry outcries of labor unions and the media. Reminding our legislators of stories like AB 976 is crucial to us taking back the narrative and once again becoming a driver in this policy development. Government intrusion can rarely be a positive for rental owners, but a working relationship where collaboration from the onset is standard can yield amazing results. We are not the profit

driven evil scumlords the media claims, and stories like AB 976 help show our compassion and concern for our tenants. Additionally, working on legislation to ensure every unit has basic necessities like running water, smoke detectors, and sufficient security can improve the home value, decrease insurance costs, and help keep our tenants for the longterm. While some regulations may prevent the owner from not being made financially whole, our collaboration

Mopping Up After AB 1482 and Preparing for the 2020 Election Cycle

ational Level

The issue of rent control comes up at least once during every generation. Memories are short and economists must re-prove the fallacy of rent control about every 25 years. The current resurgence of rent control is a national phenomenon pushed by the social justice activists and progressive elected officials across the country as a “solution” to a housing crisis. At a recent National Apartment Association Government and Legal Symposium, the NAA described the spread of rent control legislation across the country. Oregon, New York and California have all passed various forms of rent control, and Colorado recently defeated a rent control bill.

Statewide Level

The last day to pass legislation for the 2019 session of the California State Legislature was on September 13. AB 1482, the rent control bill opposed by AAOC, passed the State Legislature on September 11 and was signed into law by Governor Newsom on October 8. Our Orange County state legislative delegation remained, with one exception, strongly against statewide rent control legislation on a bipartisan basis. Our state senators were particularly strong advocates for the multifamily industry during the session. Senators Pat Bates, John Moorlach and Ling Ling Chang voted NO on AB 1482 and Senator Tom Umberg effectively voted NO by abstaining on the bill. Unfortunately,

Riverside-based Senator Richard Roth (AAOC’s 2016 Legislator of the Year), who had expressed opposition to AB 1482 in conversations with AAOC weeks before the vote, reversed course and ended up voting YES. Orange County Assembly members Tyler Diep, Tom Daly, Stephen Choi, Bill Brough, Cottie Petrie-Norris and Philip Chen all voted NO on the AB 1482, while Fullerton-based Assembly member Sharon Quirk-Silva (AAOC’s 2018 Legislator of the Year), voted YES. She also went up to the microphone on the Assembly Floor prior the vote and encouraged her fellow Assembly members to vote in favor of the bill.

County Level

The Orange County Board of Supervisors have all, individually, expressed their opposition to rent control, but there are currently no rent control issues at the county level. The County did not take a position on AB 1482.

Municipal Level

Two Orange County cities have special elections on November 5. In Santa Ana, there will be a special election to fill the vacancy created when Ward 4 City Councilmember Roman Reyna resigned as a result of his falsely claiming to be a resident of the ward during the 2018 election. This special election will be the last time Santa Ana residents vote citywide for a specific ward (district). Starting in 2020, only registered

voters in each ward will vote for their own city council member. AAOC is supporting Phil Bacerra for the Ward 4 city council seat. Bacerra ran for the seat in 2018 and has been a consistent supporter of the multifamily industry. He is the only candidate for the seat who has stated that he is firmly against rent control. The city of San Clemente also has a special election on November 5 to fill the vacancy created when City Council member Steve Swartz passed away unexpectedly this past May. Swartz was a strong supporter of the multifamily industry and the AAOC Legislative Committee is currently reviewing the declared candidates to determine if there is a candidate who should receive the support of the association.

2020 Elections

Orange County has 34 municipal elections that will take place on November 3, 2020. There will be more than 75 city council seats up for election. The AAOC Legislative Committee has already begun the process of identifying, vetting and, in some cases, supporting individuals on AAOC’s list of prospective candidates. With all the new state laws in California, the members of each city council and their votes will be increasingly important to the issues that matter to the multifamily industry.

Questions & Answers I just closed escrow on a small building and I’m trying to figure out who’s who. I received the rental agreements, but the tenant information seems incomplete. The applications, the few that I’ve found so far, are old and outdated. I can’t seem to find any telephone numbers for the residents, and I’m not real sure that the names on the agreements are the same people who actually live in the units. I’ve read your articles before and I know the importance of reviewing the files and doing thorough due diligence before closing escrow, but this deal just happened too fast. Now that I’ve closed escrow, what can I do to clean up the records?

First things first, figure out what you know and what you don’t. Establish individual tenancy files, one per unit. Based on the limited information you have, write down the names and ages of the occupants, the terms of the rental agreement, written or oral, lease or month to month, rental rate, deposit on file, date paid through. Compile what-

ever contact information you have, home phone number, work and cell number. Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the information in your files and gathering any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues, than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new month to month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names

and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is non rent control, and a month to month tenancy, the rental rate and term can be set with either a thirty or a sixty-day notice of change of terms, depending on the extent of the change. It seems like my rental forms are getting longer and more complex. I’ve read in your previous articles of several disclosure forms that should be given to my residents. Can you summarize these forms for me so that I can be sure I’m doing it right?

Sure, remember this is California, the most litigious state in the country, so the following list is not static, it will change, and no doubt expand over time. If the rental unit was built prior to 1978, the landlord must disclose the presence of known lead-based paint and lead based paint hazards in the dwelling before the prospective tenant signs the rental agreement. You must also give the prospect a copy of the federal government’s pamphlet, “Protect Your Family from Lead in Your Home.” The pamphlet is available through your apartment association or by calling 800-424-LEAD. Landlords must also provide a copy of the notice received from their pest control provider detailing the pesticides to be used in an initial or periodic maintenance program. Residential property built prior to 1981 may contain asbestos. Although not specifically required,


unless you have ten or more employees, it is strongly recommended that landlords advise their tenants of the presence of asbestos and further inform them of the proper care of asbestos material. All landlords with ten or more employees must disclose the existence of carcinogenic materials to prospective tenants. The owner of a dwelling who knows that an illegal controlled substance, such as methamphetamine, LSD or its components, has been spilled or dumped on or beneath the dwelling must give a prospective tenant written notice prior to him signing a rental agreement. The owner of a dwelling who has applied for a permit to demolish the dwelling must give written notice of this to the prospect, and it must state the earliest possible date that the tenancy will end. Additionally, if your rental unit is located within one mile of a closed military base in which ammunition or explosives were used, you must give written notice prior to signing the rental agreement. Also, your rental agreement must contain certain specific language informing your new resident of the availability of the statewide database of registered sex offenders. Note that recent changes in the law will require new information to be provided in the lease effective January 1, 2020, your local apartment associations will have forms for their members to use late December. Never got around to installing the CO (Carbon Monoxide) detectors in my apartments. I know it was required as of January 1, but just didn’t have the time to install. Any rush?

Yes, a violation of the statute is an infraction punishable by a fine of up to $200 per offense. Before a fine is levied, the property owner must receive a thirtyday notice to comply. The greater risk is in the event of a CO poisoning inside your apartments causes a death, or worse severe brain damage in a child or

An intentional non-compliance with the statutory requirement can be very problematic for you and may actually provide grounds for your insurance carrier to deny your coverage. Best to get the required CO detectors installed as soon as possible. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, you can’t let the utilities be shut off. Your tenant’s actions are a breach of the

rental agreement and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises.

What is an economical method of cleaning concrete driveways and sidewalks? The concrete has oil stains, chewing gum and organic matter stains. John

Dear John:

There are a few things you can do to help clean up the concrete. Oil stains can be spot treated with cat or absorbent litter. Spread the cat litter over the oil stains and grind the litter into the stains with your shoes. Leave it for 24 hours and sweep up after. Chewing gum can be removed by chilling the gum with ice or CO2 spray and using a putting knife to lift and scrape the gum off the concrete. Use detergent and a stiff brush to remove the gum stain. Organic matter stains can be removed with power washer spray. If you have a large area of concrete to clean, use a power washer. Set the power washer to 3000 PSI and use the wide spray head. Be careful not to gouge the concrete with the spray; keep the hand wand moving. Softer material like brick will need less PSI or more distance between the spray head and the bricks.

Dear Maintenance Men:

During the recent rains, my building started leaking. I was surprised, as I recently installed a new roof. The odd thing about the leak is that it is only affecting the downstairs units. What is going on and how do I solve this? Michael

Dear Michael:

Water is a funny thing and tracking down leaks sometimes takes a bit of detective work. The first thing we would check is the roof. As you stated, the roof is new, but sometimes the odd flashing does not get caulked and the water finds its way down the side of a pipe, valley or junction area. Have your roofer double check all the flashings. Another issue to look for is water pooling around the foundation. If you have cracks in the foundation, water will find its way in. Be sure to clear any debris, dirt and leaves from around your building or anything that causes a water dam effect. Overgrown or old landscaping can contribute to leaks by trapping water or redirecting water to the building instead of away from it. Inspect the building’s stucco for cracks. We have seen small cracks in the stucco suck in large amounts of water. Pay close attention to the stucco between floors or on the edge of balconies. Balconies shed a lot of water which may cascade over the edge and flow back into the stucco where a hidden crack will allow the water to enter. If you have aluminum windows, check the weep holes that allow water to drain out of the window tracks.

I own a building that consists of all two-bedroom, one-and-three-quarter baths. The three-quarter bathrooms have a sink, toilet and bathtub, but no shower. I would like to convert them

to a full bath by adding a shower. How do I do it? Bill

Dear Bill:

This is a great upgrade to any unit. There are a number of ways to go depending on your budget and do-ityourself skills. The most economical and simple solution to adding a shower to a bathtub is to install a diverter spout that includes a one half-inch hand shower fitting. The hand shower can be sold separately or as a kit with the spout. Connect the hand shower hose to the spout and hang the showerhead on the wall. Other than installing waterproof shower walls, you are ready to go. The second option is a bit more involved, but a much better solution. Because most tub-only bathroom situations usually have no wall tile or “shower wall” material, gaining access to your existing valve & plumbing system should be easy. Let’s begin with the items you will need to start your project. If you have an existing twovalve system, now is the time to go to a modern single-valve set up. The easiest apartment application valve to buy is a shower/tub valve kit. There are many brands to choose from, depending on your budget. The kit will come with a valve, spout, shower arm and head. You will still need to purchase a one-half inch copper pipe, at least 56-to-59 inches long, a 90-degree brass elbow, slip to thread with ears to attach it to Maintenance Men — continued on page 18

Maintenance Men — continued from 16 the wall stud at the shower head. Be sure you have a full propane torch with solder and a fire extinguisher before starting the job. Now you are ready to install. Don’t forget to turn off the water. Since you will be installing new shower walls, don’t worry about damaging drywall. Cut a hole in the drywall, stud to stud, 12 inches high at the existing valve level. Then cut a four-inch wide strip of

drywall 59 inches up from the location of the existing valves. Now that everything is exposed, remove the old valves by cutting or by using the propane torch to melt the solder joints. Install the new valve in place, cut a one-half inch copper riser between 56-and-59 inches and solder to the valve. Solder the brass 90-degree elbow to the pipe and screw the elbow to a cross stud. If you could not find an elbow with ears, use plumbers tape or a pipe hanger to secure the elbow in place. Test your

plumbing installation for leaks. Install new drywall to cover your plumbing work and the tub is now ready for the installation of the shower wall material of your choice. The Many Cost Benefits of Earthquake Retrofits

S

outhern California this year observed the 25th anniversary of the Northridge Earthquake — a 6.7-magnitude blind-reverse thrust that in 1994 caused $67 billion in widespread damage. It was deemed, and remains, one of the nation’s most expensive natural disasters. We’ve learned a lot since then and thousands of structures have since been retrofitted to protect them and the people inside them against the next major earthquake. But there is still a lot left to do. Unfortunately, many apartment owners still feel they are better off doing nothing to protect their buildings. The following information will show that seismic retrofits make good business sense.

Save Up to $7 for Every Dollar Spent

Researchers at Caltech have determined that for every dollar spent in retrofitting soft-story structures, property owners could expect to save up to seven dollars, and that study didn’t factor in loss to contents, alternate living expenses or deaths and injuries — all of which would have significantly increased the cost-to-benefit ratios. In a separate study, the university determined that seismic retrofits are cost-effective when projected annualized loss would be reduced by 50 percent or more at a cost that would equal no more than 10 percent of the replacement cost of a building.

The Federal Emergency Management Agency found similar cost benefits in a two-year analysis of seismic retrofit scenarios applied to a variety of building types, including a scenario of a tiltup warehouse building in California. In this example the study found, “the benefit/cost ratio is about 10 without the value of life and about 12 with the value of life. The benefit/cost analysis suggests that a retrofit is strongly justified economically, even without including the value of life.”

Avoid Liability, Loss of Income

There are other strong economic factors to consider when weighing the cost benefits of a seismic retrofit. These include potential loss of income and liability associated with damage, death and injury associated with an earthquake. Loss of income can occur when commercial property is damaged to the point where it is no longer habitable. This can create severe financial hardship for property owners who not only lose their monthly rental income, but who are simultaneously facing the costs of recovery coupled with ongoing monthly payments associated with their original mortgage.

Risks of Doing Nothing

What risks to building owners face if they do not have their buildings retrofitted? Apart from the possible destruction of the building, there are liability issues to consider.

When it comes to the law, a twoyear study funded by the National Science Foundation’s Earthquake Hazard Reduction Program determined that liability is in the hands of a jury to decide. In a precedent-setting case in Paso Robles, two employees of a clothing store were crushed to death by falling bricks during an earthquake in 2003. The building had been ordered by the city to be seismically retrofitted, but the deadline to do it had not yet passed. A jury in the case found the building owner negligent, based on the fact that he had received a retrofit order, knew the building was potentially dangerous but had not taken action to correct the problem. The judgment was for $2 million. Taking action now could prevent future problems. If you are uncertain about the potential risks of your building, I suggest you do your due diligence and reach out to two or three licensed professionals for their advice. Do it today. Risk Management 101, Part One

I

t’s every landlord’s nightmare: A tenant who can’t, or won’t, pay the rent. You’ve invested in your property. You are obligate to continue to pay taxes, insurance, a mortgage, and maintenance, and you depend on that income. You provided a home for your tenant and you have a right to expect that tenant to keep their end of the deal. Now you’re involved in a time consuming and emotionally draining eviction process. In the best situations,

you will pay some legal fees and lose some rent. In the very worst situations, you could spend thousands in legal fees and lose half a year of rent before you get your property back. It’s clear that the risk of a tenant who fails to pay rent is a risk that needs to be managed. In business, risks are generally managed in ways that fall into one of four categories: 1. Risk Avoidance; 2. Risk Mitigation; 3. Risk Retention; and 4. Risk Transfer. Some

of these risk management strategies will not be very useful for landlords, while others can bring tremendous advantages in managing the risk of the non-paying tenant. In “Part One” of this article, we will address the first two risk management strategies: Risk Avoidance and Risk Mitigation. In “Part Two” of this article, next month, we will look at Risk Retention and Risk Transfer, and come to a conclusion about which strategies


are best when a tenant can’t — or won’t — pay the rent.

Risk Avoidance — Avoid it

Some risks are simply too large to take. Risk avoidance is the risk management strategy that is the most effective at managing the risk — simply avoid engaging the activity that gives rise to the risk. As anyone who remembers the movie Jaws, the most effective way to avoid being bitten by a shark is to simply stay out of the water! This strategy, however, also means that you will miss out on opportunities. The opportunity to spend a day at the beach with family, or, in the case of property owners, to make income by renting your property. While the residential landlord can avoid a non-paying tenant by staying out of the rental business altogether, it will be at the cost of the very reason the landlord is in the business in the first place — to receive an income from rents. Risk avoidance is thus obviously not a good strategy for anyone who is committed to the rental business and who depends on rental income!

Risk Mitigation — Reduce it

Mitigation is the action of reducing the severity, seriousness, or painfulness of something. In risk management terms, it is also reducing the likelihood that something bad will happen at all. Conscientious landlords run background and credit checks on their prospective tenants. They screen income levels, check on prior evictions, and evaluate the character of their prospective tenants as well as they reasonably can. These steps are all factors to help reduce the likelihood that the future tenant will default on the payment rent. Renters with higher income levels, strong credit history, and a history of making rent payments on time are thought of as less likely to default on their lease. Other strategies can reduce the financial impact of a rent default if it does happen. One is the collection and

holding of a security deposit. The deposit may be used to pay for all or some of the unpaid rent. Other, less traditional, strategies that can also help a landlord through the impact of a default and eviction. A standby shortterm line of credit, in the form of a bank loan or credit cards, can help a landlord cover the mortgage and other payments while the eviction takes place and until another tenant can be placed. Pre-paid legal expenses can make the cost of legal services associated with an

eviction less painful. Risk Mitigation is an effective and prudent strategy to manage the risk of the tenant who can’t, or won’t, pay the rent. Screening can help reduce the likelihood of a default happening, and security deposits and stand-by financing can help reduce the impact when it does happen. On the downside, these risk mitigation strategies require some expense and cumbersome processes and Risk — continued on page 44

Angels Night — continued from 24 AAOC members and their family and friends purchased tickets for the game and the festive, pre-game tailgate near the Big “A” in the parking lot. This year’s tailgate featured a gourmet taco bar offering an array of meats, salsas and sauces ranging from mild to wild, and additional toppings to make the perfect meal. It also provided an opportunity for the attendees to catch up with old friends as well as meet other AAOC members, enjoy some lively conversation, toss around the ball, play some cornhole, and just soak up the atmosphere. The fun didn’t stop in the parking lot, however, as guests then made their way into Angel Stadium and to AAOC’s designated field level section for the game itself. Despite the Angels losing to the Houston Astros, the afternoon and evening proved to be fun and memorable for all, capped off by an exciting post-game fireworks spectacular.

n August, United to End Homelessness empowered by Orange County United Way took on an ambitious goal: House 30 homeless families and individuals in just 30 days through their Welcome Home OC Program. This goal was achieved and the needed funding was raised to place 30 Orange County individuals and families into homes. Results like this, especially in such a crunched timeline, could only be possible by working together.

Viewing Your Property Condition from a Financial Perspective

L

ast month’s article, “Knowing Your Property: It’s More than Just the Obvious,” focused on avoiding nose-blindness to those physical changes that occur slowly over time and/or not falling into the trap of don’t fix it if it’s not broken. In that column, I shared with readers lessons learned and tips I’ve gained as an owner and in working with other owners. This month, I’m addressing the financial impact of not keeping your property’s appearance and amenities up-to-date. When my father and I worked on his book, Cash In on the Myths of Real Estate, we covered the rental income aspect of ignoring deteriorating property conditions. Basically, as stated in Myth 6-1, you need to stay current with changing trends or your property starts to look dated and less appealing to prospective residents. Over time, this affects not only the rent rates that you can charge, but also the quality of resi-

dents choosing to live at your property. Admittedly, it costs to change out countertops and cabinets, replace carpeting with solid surface flooring and update exterior color schemes. However, reinvesting in your property may provide some timely tax benefits. And, with today’s low interest rates, you might even want to look at refinancing. These are certainly topics worth discussing with your CPA, financial planner or real estate professional. You also need to carefully analyze where and how your property is positioned both in terms of the rental market for your given location and the role that property plays within your own real estate portfolio. Both are important considerations. First and foremost, each proposed improvement has to make financial sense. Will the improvement enable you to obtain a higher rent? That answer all depends on the local rental market and what particular amenities or upgrades

Do you really want to continue owning and maintaining this specific property at this location for another five to ten years? A “no” answer does not necessarily mean that you don’t make any improvements, it just says you need to do a further layer of analysis as to what improvements might make the biggest difference when you list the property for sale. Which brings up another financial impact aspect — what happens at the time of sale? Over the past several years, the Orange County real estate market has been booming. Properties attracted multiple bids and even those not in the best of condition sold quickly. However, now we are seeing signs of a slowdown. Properties are sitting on the market longer and buyers are showing more price sensitivity. So what does this mean to you as an owner? If you have not kept your property updated, chances are good to excellent you also have not been increasing rents. You might have several long-term residents who are paying rents at significantly under market rates. You think you are saving money because they aren’t complaining, but in the end this approach could cost you a pretty penny. As the market becomes more competitive, a buyer is less likely to a


purchase a similarly priced property with lower rents than one generating a higher monthly income. And, if dollars are going to have to be spent on improvements before rents can be raised, buyers will factor those costs into their purchase offers at amounts likely larger than what you could have paid if you had handled the work yourself. Thus, one of the unforeseen consequences of being nose-blind regarding the condition of your property is the disconnect between what you think your property is worth versus the reality of what price it will actually command. When the demand is high and values are rising, this is not so much of a problem. However, when there is a slow-down, you may be in for a bit of a shock when you go to sell. So, as I concluded last month, the value of your property is not just a matter of what’s happening with prices, it starts with you and the condition of your property.
