T

he above quotation is attributed to New York Yankees catcher Yogi Berra during the 1961 season, after Mickey Mantle and Roger Maris yet again hit back-to-back home runs. Now, in 2021, it’s like “déjà vu all over again” in Santa Ana, where tenant activists have once again pushed their oppressive rent control agenda in the city. Both last year and in 2018, the tenant activists attempted to place rent

control measures on the city ballot. Both times they failed to garner enough qualifying signatures. Despite AB 1482 taking effect last year and establishing a statewide rent cap of 5% plus the change in the Consumer Price Index (CPI), the tenant activists deemed that insufficient and demanded that Santa Ana restrict rent increases to 3% or 80% of CPI — whichever is lower. They pushed this proposal with the city council, knowing that the current council is friendlier to their efforts than Santa Ana voters collectively. By now you are likely aware that the Santa Ana City Council approved rent control and just cause eviction ordinances at its meeting on October 19, 2021. You are also likely aware that AAOC and its coalition partners sprang into action very quickly to counteract this council action. That same week, a signature gathering effort was launched seeking to qualify a referendum that would subject the ordinances to a vote of the people in 2022. I’m confident that we will gather the necessary number of signatures to make this happen. Even if you don’t own or operate property in Santa Ana, I encourage you to support AAOC’s effort to stop rent control from taking hold in the city. If we don’t succeed in stopping it, Santa Ana could represent the first domino to fall, with other cities to follow in Orange County.

return to service as AAOC president. Rest assured, I’m just pinch hitting for Frank Alvarez, who needed to sit out a couple of months as president this year to be eligible to serve a new term in 2022, consistent with the AAOC bylaws. As first vice president, I’ve gladly stepped in to serve as president for the balance of the year. Frankie has been instrumental in leading AAOC through all the trials, tribulations and changes that COVID has presented over the last 20 months, and we are fortunate to have him coming back as president next year. Our AAOC staff members also deserve a standing ovation for their hard work in making many changes on the fly to ensure a vibrant AAOC during this chaos! And to you, our members, thank you for continuing to support AAOC through all the twists, turns, and redirections. For example, the AAOC Trade Show & Conference, traditionally presented in March, was presented this year in September. Many changes, both obvious and not so obvious, were made to put on the show, and staff did a wonderful job. It was great to finally see so many recognizable and friendly faces in person! The trade show floor had a steady flow of foot traffic throughout the day, the seminars were well attended, and there were many satisfied exhibitors and attendees. We look forward to our 2022 show returning to its traditional spring timeframe and will have details to share with you in the coming months.

Time to Start Preparing for Your Balcony & Deck Inspections

J

ust three years from now — ok, January 1, 2025 — state law requires minimum inspections for the exterior elevated elements, including balconies and decks, of buildings with three or more multi-family dwelling units. At the minimum, residential rental property owners/agents are to have the inspection of each type of exterior elevated element that, if found to be defective, decayed or deteriorated to the extent that it does not meet its load requirements, would, in the opinion of the inspector, constitute a threat to the health or safety of the occupants. Assessment of the load-bearing components and associated waterproofing elements of a sample of at least 15% of each type of exterior elevated element may be done using methods allowing for evaluation of their performance by direct visual examination or comparable means of evaluating their performance. Evaluation and assessment must address each of the following, as of the

threat to the safety of the occupants, and whether preventing occupants’ access or conducting emergency repairs, including shoring, are necessary. An initial inspection is to be completed by January 1, 2025, and every six years thereafter. The inspector conducting the inspection is to produce an initial report and, if requested by the residential property owner/agent, a final report indicating that any required repairs have been completed. A copy of that report that recommends immediate repairs, advises that any building assembly poses an immediate threat to the safety of the occupants, or that preventing occupant access or emergency repairs, including shoring, are necessary, must be provided by the inspector to the owner/agent and to the local enforcement agency within 15 days of completion of that report. Reporting to the local enforcement agency is a material change in law. Local enforcement agencies may determine whether any additional information is to be provided in the report and may require a copy of the

initial or final reports to be submitted to the local jurisdiction. Copies of all inspection reports must be maintained in the building owner’s permanent records for not less than two inspection cycles and must be disclosed and delivered to the buyer at the time of any subsequent sale of the building. Inspections can be performed by a licensed architect, licensed civil or structural engineer, a building contractor holding any or all of the “A,” “B,” or “C-5” license classification issued by the Contractors State License Board, with a minimum of five years’ experience, as a holder of the aforementioned classifications or licenses, in constructing multi-story wood frame buildings, or an individual certified as a building inspector or building official from a recognized state, national or international association, as determined by the local jurisdiction. The inspectors must be hired by the owner/agent and may not be employed by the local jurisdiction while performing these inspections. Inspections and corrective work can be performed by the same licensee. The purpose of the inspection is to determine that exterior elevated elements and their associated waterproofing elements are in a generally safe condition, adequate working order, and free from any hazardous condition caused by fungus, deterioration, decay, or improper alternation to the extent that the life, limb, health, property safety, or welfare of the public or the occupants is not endangered. Owners of all buildings containing three or more multi-family dwelling units are to have inspected exterior elevated elements that include load-bearing components. Load bearing elements are defined as components that extend beyond the exterior walls of the building to deliver structural loads from the exterior elevated element to the building. Finally, an “exterior elevated element” is defined as the following types of structures, including their supports and railings, balconies, decks, porches,

stairways, walkways, and entry structure that extend beyond exterior walls of the building and which have a walking surface that is elevated more than six feet above ground level, as designed for human occupancy or use, and rely in whole or in substantial part on wood or wood-based products for structural support or stability of the exterior elevated element. So, a word of advice: identify the licensed firm as soon as you can. It may

30 Days to Stop the Spread

I

know that phrase probably evokes a range of emotions, given everything we’ve dealt with since the emergency of COVID-19 last year. Thoughts of lock downs, personal and professional losses, maybe even a paralyzing sense of dread while we patiently sit, helplessly watch, and timidly wonder: • How long this will be around? • How far will this go? • Who else will be affected? • What do I have to do? • What can I do to be safe? • How can I keep my tenants safe? • How will I afford all of this? We are now 20 months down the road from when the harsh realities of COVID-19 first set in. Now, for Santa Ana rental-housing providers, a second wave of harsh reality has set in following the city council’s approval of rent control and just cause eviction ordinances. AAOC and its coalition partners have been given 30 days to stop the implementation and spread of these harmful policies, and the stakes couldn’t be higher. 30 days to stop the spread. Following the Santa Ana City Council’s hasty decision to impose rent control and just cause eviction on multi-family housing providers in the city, we were given 30 days to gather enough voter signatures to qualify a

referendum, with the hope of placing the issue on the ballot – our last chance to stop rent control and just cause eviction from being solidified as the law of the land. Spurred by the momentum they gained after these ordinances were approved in Santa Ana, tenants’ rights activists feel they now have a path forward to target rental property owners in other cities and hamstring their ability to provide quality housing. 30 days to stop the spread. To qualify this referendum, we need to collect more than 12,000 valid signatures from registered Santa Ana voters in just 30 days. By the time you read this article, we will have likely reached the half-way point in the process. The tenants’ rights activists in Santa Ana twice attempted to gather enough signatures to placed rent control initiatives on the ballot. They failed both times, but their closest attempt came a mere 600 signatures short. While they were granted 90 days to collect enough valid signatures — we only have 30. 30 days to stop the spread. Along with our coalition partners, AAOC has mounted a substantial effort to get us across that goal line. Our goal is to gather 18,000 signatures to help ensure were ultimately have enough valid signatures to submit for verification by the city clerk. Collecting 18,000 signatures in 30 days means we must average 600 signa-

tures a day. Our coalition has assembled a team of professional and volunteer signature gatherers who are working in Santa Ana every day — from morning to night — gathering signatures and moving us closer to our goal. They are in shopping centers, walking neighborhoods, and reaching out to people in high-density areas throughout the city. As of this writing, we are one week into the signature gathering effort and the early results are very encouraging. By the time you read this, we will be nearing the end of our 30 days to stop the spread. But there is still time. Our deadline for submitting signatures is November 19th. If you can volunteer some time to help gather signatures, please contact us. If you own or operate rental property in Santa Ana, please share information with your employees and residents about the threat that rent control and just cause eviction poses. I understand that Governor Newsom recently issued another Proclamation of a State of Emergency on October 22, 2021, and that it might restrict rent increases in parts of California. Does this affect my properties here in Orange County?

No, the October 22, 2021 proclamation declared a State of Emergency in Siskiyou County and Trinity County due to the River Complex Fire; in Kern County due to the French Fire; in Tuolumne County due to the Washington Fire; in Mendocino County due to the Hopkins Fire; and in Tulare County due to the Windy Fire and KNP Complex Fire. If you own or manage properties in these affected areas, rent increases over ten percent are prohibited during the pendency of the state of emergency. Emergency declarations issued by the Governor are generally available on the Governor’s website at gov.ca.gov. For information about local declarations of emergency, please contact your local city or county emergency authority or sheriff ’s office. As with all other covered goods and services, following a declaration of emergency, the statute generally prohibits landlords from increasing the price of rental housing by more than 10% of the previously charged or advertised price. For rental housing that was not rented or advertised for rent prior to a declaration of emergency, the price cannot exceed 160% of the fair market value of the rental housing as established by the U.S. Department of Housing and Urban

Development. For rental housing advertised or rented on a daily basis, such as an AirBnB or VRBO listing, the daily price may not be increased by more than 10% following a declaration of emergency. For rental housing advertised or rented on a daily basis prior to a declaration of emergency but offered on a full-time or monthly basis following a declaration of emergency, the price may not exceed 160% of the fair market value of the rental housing as established by the U.S. Department of Housing and Urban Development. A landlord may not justify an otherwise unlawful price increase by providing additional services such as gardening, cleaning, or utilities, or because they are now offering a shorter lease term. Similarly, a landlord may not charge more than the allowable price because an insurance company offered to pay a higher price. Finally, the statute also makes it a separate misdemeanor for a landlord to evict a tenant and then rerent the property at a rate that the landlord would have been prohibited from charging the evicted tenant under the price gouging statute. One of my former tenants took me to small claims court over her security deposit. She claims that I was unreasonable in spending all of it, because she claims she had a cleaning crew come through the place before she moved out. Well, I don’t know if she used a cleaning crew or a wrecking crew, because the place was trashed.

Anyway, the judge in the small claims court apparently liked her, and I guess I lost my temper at the hearing. When all the dust settled, the judge ordered me to pay her! Go figure. The little paper says that I have time to appeal this decision if I want to. I basically wanted to know what happens in the event of an appeal, and whether or not I could have a lawyer handle it.

A small claims appeal is a “trial de novo,” that is, the appellate hearing will be a “new trial.” You, as the Defendant, essentially get another chance to prove your case. By and large, the structure of the proceeding is essentially the same. However, on a small claims appeal, as opposed to the initial small claims proceeding, you may have an attorney represent you. In your situation, if you’re afraid that you might lose your temper again, call a lawyer who will talk about the case with you. Of course, there are times when it’s simply more cost effective to “go it alone,” when the amount you’re fighting over is less than the cost of retaining counsel. If this is the case for you, and you really feel that you were not treated fairly in the small claims court, then appeal the decision. Just remember to take a deep breath out in the hallway. I just sent out my annual rent increases to all my residents. Because times are tough, I delayed sending them out, and I kept the increases minimal. She claims that I was retaliating against her, and that the rent increase notice was not valid. She says that she won’t pay it, and that I violated the law by even giving it to her. Something about her deducting $6.50 from her rent three or four months ago for a leaky faucet. I remember that she shorted the rent, but I didn’t really mind, she took care of the dripping faucet herself. What does this mean, what is “retaliation?” Did I do something illegal by serving my annual rent increase notice?

No. Although there are strong protections in place for certain tenant conduct, your resident is confused. A landlord cannot punish a tenant for exercising a “legal right.” The law offers tenants certain protections from retaliatory evictions and retaliatory acts. California law will infer that a landlord has a retaliatory motive if he seeks to evict the

tenant or take other retaliatory action within six months after the tenant has exercised certain protected rights, including using the repair and deduct remedy, complaining about the condition of the unit to a public agency, after giving the landlord notice, or after filing a lawsuit based upon the condition of the unit. The tenant must prove that she exercised one of these rights, in the past six months, and that her rent is current. The landlord may counter the tenant’s claims of retaliatory conduct by establishing that he did not have a retaliatory motive. If the landlord’s actions were based on a valid reason, and not in response to the tenant’s exercise of a protected right, then a court would find that the landlord did not retaliate. If your annual rent increase was consistent with past practices, didn’t solely target this individual tenant, was based upon objective business reasons, and was not meant to “punish” this resident, then your rent increase would most likely not be deemed retaliatory. I am a resident manager of a 16-unit complex. I received a telephone call from a person wanting to rent a unit from our small complex. I asked the prospective tenant if she had any children. She got offended and told me, in no uncertain terms, that I could not ask that question. I replied by thanking her for her criticism and hung up the telephone. Is the prospective tenant correct that I cannot ask if she has any children?

Yes. Rather than ask how many children will reside in the unit, a more relevant question would be to ask how many occupants would reside in the unit. Most acts of discrimination in rental housing occur during the resident screening process. For this reason, it is prudent to put your screening procedures in writing and to adhere to them strictly and impartially. All rental units must be available to families with children. Furthermore, rules designed to discourage families from applying to rent may lead to the filing of discrimination complaints. Minimize the prescreening over the telephone; you never know if the caller is truly a prospective applicant or just a tester from Fair Housing hoping that you will say something actionable. oil stains and grind the litter into the stains with your shoes. Leave it for 24 hours and sweep up after. Chewing gum can be removed by chilling the gum with ice or CO2 spray and using a putty knife to lift and scrape the gum off the concrete. Use detergent and a stiff brush to remove the gum stain. Organic matter stains can be removed with power washer spray. If you have a large area of concrete to clean, use a power washer. Set the power washer to 3000 PSI and use the wide spray head. Be careful not to gouge the concrete with the spray; keep the hand wand moving. Softer material like brick will need less PSI or more distance between the spray head and the bricks.

Dear Maintenance Men:

I have given my residents information on how to prepare a personal emergency preparedness kit for their families. My question for you is, does my apartment building need an emergency preparedness kit? And if so, what should be in it? Diana

Dear Diana:

A quick list of what should be in your family disaster preparedness kit: flashlight with batteries, canned goods, a gallon of water per person, a knife, medications, and blankets, at a minimum. Now, this works o.k. for a family, but may not be appropriate for an apartment building. The residents may very well shelter in place during a disaster and be fine. What may be in danger is

your property! Start with a bit of preventive disaster maintenance. 1. Locate the main water shut-off valve and any minor shut-off valves. Make sure the valves are in working order. If they are gate valves, it might be time to upgrade them to ball valves. Old gate valves are notorious for breaking valve stems at the moment you need them to work. 2. Locate and clearly mark the main electrical panel. 3. Locate and mark the main sewer clean-out. Run a mainline snake or hydro-jet at least once a year. A Friday evening main back-up is a disaster. 4. Locate and mark the main gas or fuel oil shut-off valve. 5. Write down and post this information in a public area of your apartment building, including emergency phone numbers and how to get ahold of management. Alternatively, post this information on the inside of a kitchen cabinet door in each rental unit.

I want to create a seating and relaxing area in the middle of my building’s courtyard. My thoughts are to use decomposed granite and eliminate the current grass area. How do I go about installing the surface without making a mess or a future headache for myself? Bryan

Dear Bryan:

Decomposed granite, DG for short, is a great way to add a durable, natural and water wise surface. A few things you need to know before you get started. The key word in DG is “Decomposed.” In other words, this granite is decomposing.

stabilized DG is much cheaper, but it will decompose, create dust when dry, and slush when wet. To properly install DG, dig down three inches overall and use a wood, rock, or brick border to keep the edges of the DG from crumbling. As an option, lay down a weed barrier cloth under the DG. Apply DG in one-and-a-half inch layers, water down (don’t flood) and tamp or use a heavy roller to compress the DG. Wait eight hours between layers

to let the DG settle. Repeat the above for each subsequent layer. When installed properly, the DG surface will be rock hard, stable, dust free and will allow water to drain. What is a Delaware Statutory Trust and Why So Many Real Estate Investors Are Interested in Them?

W

e recently participated in the 50th Annual Apartment Association of Orange County Trade Show & Conference, in Costa Mesa, and were pleased to see so many people stopping by our booth asking about Delaware Statutory Trust 1031 exchanges. However, because we found ourselves answering the same questions again and again from some very experienced investment property owners, we thought it might be a good idea to write about the three most commonly asked questions we heard that relate to DST 1031 exchanges, including: • What is a Delaware Statutory Trust and what are the associated risks? • What can a Delaware Statutory Trust do for me? • Do I have to have a Delaware address to invest in a Delaware Statutory Trust? First, of course you don’t have to live in Delaware to invest in a “Delaware Statutory Trust”. Delaware was the state where the law defining a DST and its structure was created, and what’s so special about this real estate investment vehicle is that it’s blessed by the IRS to qualify as “like-kind” investment property for the purposes of a 1031 exchange. Internal Revenue Code (IRC) Section 1031 allows investors to postpone paying tax on the gain of a relinquished property by reinvesting the proceeds in similar property as part of a qualifying like-kind exchange.

What is a Delaware Statutory Trust?

A Delaware Statutory Trust is a real estate ownership structure that allows multiple investors to each hold an undivided beneficial interest in the holdings of the trust. The term “beneficial interest” means that investors hold a percentage of the ownership, and no single owner can claim exclusive ownership over any specific aspect of the real estate. The laws of DSTs allow the trust to hold title to one or more investment properties that can include commercial, multifamily, net lease, retail, office, industrial, self-storage, etc.

Potential Benefits of a Delaware Statutory Trust Eliminating the day-to-day headaches of property management Many participant investors in DST 1031 properties are at or near retirement and are tired of the hassles that real estate ownership and management often bring. They are tired of the proverbial “3 T’s” of multifamily residential real estate: tenants, toilets, and trash, and just want to move away from actively managing properties. The DST 1031 property provides a 100 percent passive ownership structure, allowing investors to enjoy retirement, grandkids, travel, and leisure, as well as to focus on other things they are more passionate about instead of property management headaches. Obviously, as with all forms of real estate investments, there is an underlying level of risk that investors should be

aware of including things like economic downturns, vacancies, tenant repairs, etc. Tax deferral using the 1031 exchange Many of our clients have wanted to sell their apartments, rentals, and commercial properties for years but haven’t been able to find a property to exchange into and just can’t stomach the tax bill after adding up federal capital gains tax, state capital gains tax, depreciation recapture tax and the Medicare surtax. The DST 1031 property solution can potentially provide investors an ability to move from an active to a passive role of real estate ownership on a taxdeferred basis while still potentially receiving passive income. Also, because a 1031 exchange has very tight timelines (45 days to identify exchange property and 180 days to complete the exchange), DST investors can close quickly and complete their exchanges within 3 to five days as opposed to having to wait 30, 60, 90 days to purchase another outside property. Investors are strongly encouraged to consult their CPA and tax attorney regarding the potential tax advantages as well as risks associated with any DST 1031 exchange properties. Furthermore, investors are encouraged to read the entire Private Placement Memorandum (PPM) for a full discussion of the risks and business plan of each offering. Increased cash flow potential Many investors of real estate may be unhappy with the amount of cash flow


they are receiving due to recent eviction moratoriums, under-market rent structure, multiple vacancies and/or that the raw or vacant land is sitting idle and unproductive. DST 1031 exchange properties provide an opportunity for investors to potentially increase their cash flow on their real estate holdings via a tax deferred 1031 exchange. This potential passive cash flow can come about from regular monthly payments from their DST 1031 investments. All real estate investments provide no guarantees for cash flow, distributions or appreciation as well as could result in a full loss of invested principal. Portfolio diversification by geography and property types Often, 1031 investors are selling a property that comprises a substantial amount of their net worth. They want to reduce their potential risk and instead of buying one property (such as another apartment building) or a single NNN building (such as a Walgreens or Taco Bell) they decide that investing into a diversified portfolio of DST 1031 properties with multiple locations, asset classes (property types) and tenants is a better fit for their goals and objectives. Ever-Increasing Complexities

A

t the September 21st meeting of the Apartment Association of Orange County, Ron Kingston, the AAOC’s state legislative advocate, gave an excellent and indepth presentation entitled, “New and Very Important Laws Affecting Rental Property — What’s Next?” From Kingston’s perspective, the “What’s Next?” relates to even greater restrictions from legislation that rental property owners may face in 2022 and beyond. However, the immediate concern lies with how rental property owners can best adapt to the already-established future as outlined during his presentation. One very clear message is that owning properties has become a much more complex undertaking than it ever was in the past. Last January, I recommended making “Get the Facts” as the #1 New Year’s Resolution that apartment owners and investors should adopt for 2021. That requirement continues to hold true; but,

even with the “facts” in hand, some of the complexities of the new laws require further expert assistance. In summing up his thoughts about AB 832, Kingston stated: It has become extremely difficult for a rental property owner to regain possession of premises or reimbursement for COVID-19 rental debt, so it is recommended that you retain competent counsel to assist in successfully regaining possession and maximizing a money judgment. With all the different documentation, language and timing needed to comply with the new rules, new forms and new procedures introduced with the signing into law of AB 832, the reality is that few, if any, owners can tackle this process themselves. And, even after the COVID 19 Recovery Period ends on March 31, 2022 (assuming no additional extensions), regaining possession may still be a challenge. AB 1487 has established a commission to award grants to nonprofits providing legal assistance to prevent tenant evictions or displacements. This new law also allows for targeted outreach to buildings and neighborhoods to advise tenants of their legal rights to prevent or mitigate “displacement.” What are an owner’s options or best protections? Back in February 2020, Tim Gorman wrote an article about “Practicing Purposefulness” as the second part of his series on “How to Survive and

Thrive with the New Norm.” The focus of this piece was on being in tune with those who live on your properties. As he stated, “you need to be on top of what is happening with your tenants and to take the actions that you are permitted promptly and decisively.” That advice is doubly true today. Additionally, although circumstances change as we have all learned from the past year, careful pre-screening of prospective residents remains one of the best protections you can take against future problems. That said, even screening practices need to be updated. As Kingston noted during his presentation, the Department of Fair Employment and Housing Council (DFEHC) has adopted new regulations regarding the aggregation of an applicant’s income. It seems like at almost every turn, there are new requirements and rules. And the reality is — more changes are likely to occur next year, if not sooner. So, what do you do? If you have always been a hands-on owner and do-it-yourselfer, now might well be the time to consider a professional property management company. Thought also should be given to the how and why of your ownership position. If you have been keeping your properties as a legacy for your heirs, then perhaps a property management company is a solution that will relieve stress not just for yourself, but for your entire family. Guest Commentary: Is Housing a Right or a Commodity?

T

he City of Santa Ana recently approved rent and eviction control ordinances that are far more restrictive than current state law. The city council hearing on September 21, 2021 was a stage for tenant activists to voice their concerns. Their mantra was “Housing is a Right.” They advocate that those who cannot afford the housing they want should receive it without paying its value as determined by the market rent. Many reasons were cited: avoiding homelessness, helping the community, health and safety of the recipients, and others. These reasons were also cited at the next two city council meetings that followed. All are noble goals, but to refute any of those concepts labels one as heartless. Defining housing as a “right” rewrites our social structure. As an example, healthcare is now a “right.” Both healthcare and housing are commodities, and they were commodities before advocates began redefining them as rights. But government — not the medical industry — made treatment available to those

who could not afford it. The medical industry was not required to provide doctor care, medicines, or hospital care for free or at reduced rated. It is true that rates are negotiated, but they are not set by government — or activists. Let’s go further down this path of increasing “rights.” Other commodities that could be redefined as rights include food, public transportation, vehicles, and fuel. Those are also necessary for a quality of life, health, employment, and safety. Will they be next? If a commodity is not affordable to a group of people, do they have the right to receive it for free or at a discount? It seems like they do, according to the activists. What’s next? Will grocery stores and auto manufacturers be required to reduce or freeze their prices? Conscripting or seizing a product is confiscation, and that is supposed to be illegal and unconstitutional. Housing may or may not be a “right,” but it certainly is a commodity. It is produced by purchase or construction. It requires upkeep, repair, management, money,

and labor. It can be rented or sold. It is indeed a commodity. The providers of the commodity are not the cause of the unaffordability. The marketplace creates the imbalance. As with medical treatment, if housing is now deemed a right, then taxpayers should underwrite the cost of providing the desired housing. The housing industry should not be decimated or nationalized into a government entity. On a larger scale, elements in our nation are rewriting many concepts. Large companies swallow up business opportunities. They are destroying the opportunities that used to help courageous, hard-working people join the middle class by investing their time and savings. Personal failure to thrive in our economy is now blamed on intangibles. The notions of equality and meritocracy have been redefined. It is now wrong to discuss how peoples’ innate abilities and ambitions, and the sacrifices they are willing to make, are also contributing factors in their economic position and ongoing advancement. The current view is on equality of outcome, which means someone else must supplant the conditions that impact the lives of those who struggle and are less fortunate. Ultimately, the cost of supplying housing, as a “right,” must be paid by taxpayers as a whole, not by the providers of the commodity of housing. October General Membership Meeting Recap

I

n the spooky spirit of the Halloween season, the Apartment Association of Orange County (AAOC) presented the third annual installment of “Property Management Horror Stories” at its General Membership Meeting on October 19, 2021. The spooky “story tellers” of the night included Frank Alvarez, Operations Director & Co-Owner of Buffalo Maintenance, Inc.; Jessie Childers, Regional Supervisor of Santa Fe

Management; and Melissa Ke, a second-generation independent rentalhousing provider and AAOC member. Alvarez started the program by sharing some basic tips and strategies for helping rental-housing providers avoid horror stories in the first place. He advised being proactive and visiting your rental property on a regular basis, along with making the onsite staff more accountable in general. He emphasized asking more questions of staff, inspecting the property from top-to-bottom, inside and outside, all units and all common areas. Childers relayed a horror story of her own, that involved a boyfriend of a resident assaulting another resident, stealing from him, and being an overall terror to the community. She reported that it took two months, during COVID, to finally evict. What did she learn from this experience? She relayed that careful and detailed documentation of events is key, along with securing a good attorney.

Ke’s horror story took many ghoulish twists and turns. It involved residents owing $20,000 in back rent; blocking garages; having friends over for noisy parties. Notices were served to no avail. She finally found an attorney who will be taking on the case and seeking resolution. Ke learned that she needed to be firmer with residents from the get-go. Childers added to this, emphasizing that relationships with tenants need to be strictly professional, and to pay close attention to credit scores for all applicants. Alvarez concluded the evening by reminding the audience that everyone is an ambassador to their rental communities and that diplomacy is key. He also gave further tips on overall safety and upkeep of their properties. He also recommended keeping landscaping well maintained, making sure the drains and rain gutters are kept free flowing, and that property lighting is GMM Recap — continued on page 34

fter an 18-month hiatus due to the COVID pandemic, which included an initial postponement, then a cancellation, followed by a springtime rescheduling, another postponement, and finally a new fall date, the Apartment Association of Orange County’s Annual Tradeshow & Conference came roaring back and made

its triumphant return on Thursday, September 30, 2021, at the OC Fair & Event Center in Costa Mesa. The exhibit hall was filled with energy and enthusiasm as 110 show exhibitors and close to 800 people reconnected and got back into the swing of doing inperson networking, discussing the products and services that keep rental-

Soft Story Seismic Retrofitting What is soft story seismic retrofitting & why/how should you get started?

What is Seismic Retrofitting?

Soft story seismic retrofitting is adding lateral load resisting components to buildings with a more stiff top story than bottom. Often these are buildings with “tuck-under” parking built before 1978, which is when the building code was changed for new construction in California. The new code included adding elements to take lateral forces from major earthquake events.

Benefits of voluntary retrofit?

No one has a crystal ball to see when or where the next major earthquake will strike. Buildings which withstood the Northridge earthquake are now another 25 years older. Your liability is greatly reduced in the unfortunate event of a building collapse which causes loss of life by being proactive. Based on a study completed by FEMA, the probability of collapse is reduced from 30% to 5% by completeing a soft story seismic retrofit on a building built before 1978.
