A Shift to Renterdom
J
ust about everywhere you look nowadays, housing makes its way into the headlines. And whether the topic is rent, market values, new development, or buying and selling, columnists and economists are generally alike in their shared enthusiasm that something “big” is happening. But what’s going on today in 2015 is not the earthquake. It is the aftershock of 20 years of exceptional growth across
economic and population measures in a County once identified more as a bedroom community than business center. Today, we are a commerce capital, tourist destination, entertainment hub and an international point of entry. Yes, our little Orange County is growing up. More People Making More Money Census numbers show that Orange County’s population has grown by
48.56% in the decades since 1980. For comparison purposes, this exceeds the growth occurring in neighboring Los Angeles County by over 12% for the same time period. As the population has grown, so too has the Area Median Income (AMI), a number used by the Department of Housing and Urban Development to best represent an area’s median household income. $59,100. Today, in 2015, this number is $85,900. The increase in $26,800 over 20 years represents a 45% increase in household income. But with population and economic growth setting the table, fundamental shifts in the consumer outlook and preferences for housing have owners, operators, investors and developers scrambling to accommodate a growing demand for rental units. For Sale and For Rent By the Numbers All too often, the relationship between the for sale and for rent markets is overlooked in understanding the function of the housing market. And, in failing to understand the for sale market, one can only speculate as to what is happening in the for rent market. So while market home values have grown by 198% since 1995, but are off of peak values of 2005–2006 by 9.7% with interest rates near record lows at 3.75%, or more than 200 basis points (2%) lower than previous lows of 5.8% in 2005, there is an easily recognizable shift. We have seen homeownership rates peak at 55% in Orange County in 2005, but drop to 48.5% today in 2015, which is well below the national average of 63.4%. With cheaper money, discounted prices and increased buying power, we are not seeing consumers buying, we are instead seeing investors or speculators purchase to rent or to flip. Driving investor demand is the white-hot SFR rental market. Families and others who were once driven to own or to buy are now choosing to rent. And their
demand is not for multifamily housing, but for single-family residential housing. Not Just For New Grads During the economic downturn, we saw it all: from grown adults moving back home with mom and dad to families doubling up. But now, with jobs coming back and the economy improving, we are starting to again see the creation of new households. College graduates and young professionals are back in the market for their first place, growing families are choosing to pursue SFR rental opportunities and baby boomers are downsizing and perhaps opting for a pied a terre or second place. These are normal, natural occurrences within society that had been stifled by our lack of recovery following the great recession. But now, with a return to normalcy comes the opportunity to accommodate or respond to the growing need for rental housing that actually fits the needs of today’s renter. The Numbers Behind the Needs Multifamily occupancy rates are up from 94% in 1995 to 95.4% today. And while this incremental growth is positive, it does not reflect the roller coaster ride that was 2007–2011. Today, we see a 4.6% vacancy rate, which translates to more than 11,000 apartment homes in Orange County sitting vacant and ready for rent today, tomorrow, next week or next month. But the market occupancy rates and annualized rent growth of 3.9% also
suggest that the market is ready and waiting for new units to be brought online. While there is a glut of high-end, luxury product, we need the good old, garden style product that is most associated with Orange County. You know, somewhere between subsidized/ affordable and high-end luxury, which is where most OC households are. Smart building will also continue to incorporate public transit, specifically the train lines available from San Clemente in the south to Fullerton/ Buena Park in the north of Orange County, making trips to and from Los Angeles or San Diego on a daily basis and allowing for ease of commute. TOD or transit oriented development, as it is known, has long been the norm on the east coast but is fairly new to the southland. The LA to OC and OC to LA traffic flow is among the largest in the United States, so one would hope that developers have finally recognized the opportunity not just to meet their financial pro-forma but to help create workforce housing in transit oriented locations that will generate a true, high return for society for years to come. As a society, we have shifted to renterdom. And it’s not creating a housing crisis, more an epiphany for developers and consumers alike. But stop looking so surprised. Annual Interview with Myself
T
hank you for sitting down with us again for this interview. I can’t believe it’s been a year since we last spoke together. It’s always my pleasure to spend time with you people. Yes it’s been a fast but productive year. First question: year in review. What successes are you most proud of? It is always difficult to single out an event or program, so I’ll toss you a few.
Certainly the Annual Trade Show and Exhibition comes to mind. With record exhibitors and high attendance and lots of positive feedback in 2015, we are positioned well to step things up for 2016. And step things up, we will. In addition, this past year the Apartment Association saw two new large events: the Reverse Trade Show and the Economic Forecasting Breakfast. Both sell out events. So that tells me we are reaching
an audience that has been otherwise underserved. What, failure would you like to share? Ugh, you always ask that. I don’t dwell. I think it is safe to say that, like any reasonably competent executive, I have taken a shot at an idea or two over the year that didn’t pan out. You learn and move on. But if you need a failure, I’ll offer this: I have not yet conquered

road rage. Where do you see the apartment industry going in the year upcoming? I am certainly not an economist, (but we will have one at our 2016 Trade Show). I am an Independent Rental Property Owner. And like many landlords in OC, we have seen rents rise due to demand. Costs rise as well. And I see that trend tapering off a bit but nothing to indicate a reversal. Certainly housing is a regional issue and brings another set of pressures. We landlords don’t raise our rents. The demand to live in our beautiful buildings causes our rents to rise. What advice would you have for a new IRO just starting out? Engage in the Apartment Association. Don’t just join and carry the card. Attend our workshops, meetings, and business mixers. The support, counseling, and experience of your colleagues are your best tool for success. Does the association have anything new and exciting on the horizon? Stay tuned for a big surprise announcement for our 2016 Trade Show and Exhibition. Because I am Italian, and Italians believe business and food belong together, we have added a Business Mixer / hot and cold hors d’oeuvres reception that follows our monthly General Membership Meetings. who watch the clock and punch out at 5. This is my vocation, and a vocation that I have chosen. was Assembly Member Jones-Sawyer’s AB 396, a bill that would have made those with a criminal history a protected class. Another defeated bill was Senator Leno’s SB 364, which sought, once again, to prevent owners from lawfully going out of the residential rental property business under the Ellis Act. While all of the harshest bills were defeated, some bills regulating the apartment industry did pass. Those bills include SB 655, which makes the presence of mold in a dwelling a substandard housing condition, and SB 328, which requires more notice to be given to tenants when landlords use pesticides. Overall, despite another year of legislative attacks on the rights of rental property owners, our lobbying team successfully defeated the worst bills, while getting significant amendments on all other bills of importance. The following are the relevant 2015 legislative bills that were signed into law. To repeat, all except AB 1164 are effective January 1, 2016. Water Use & Conservation Bills AB 1 (Brown) Brown. Drought: Lawns. Chapter 62, Statutes of 2015. Prohibits local governments from imposing fines on property owners for not watering their lawns or for having a brown lawn during any period in which the Governor has issued a proclamation of a state of emergency based on drought conditions.
What to Know: It is okay to brown your lawn. Local governments can no longer penalize you for not watering your lawn. This common sense law allows landlords to continue doing their part to conserve water during this time of extreme drought without fear of consequence. AB 1164 (Gatto) Artificial Grass. Chapter 671, Statutes of 2015. This bill prohibits a local government from enacting or enforcing any ordinance or regulation that prohibits the installation of synthetic grass or artificial turf on residential property. Reasonable restrictions on the type of synthetic grass or artificial turf that may be installed on residential property are allowed provided that those restrictions do not do either of the following: (1) substantially increase the cost of installing synthetic grass or artificial turf, or (2) effectively prohibit the installation of synthetic grass or artificial turf. Effective October 9, 2015. What to Know: During this time of drought, many property owners are choosing to replace their lawns with artificial turf or grass to conserve water. Some cities, however, have ordinances restricting the use of artificial grass. This bill eliminates those restrictions in order to help property owners save water. SB 188 (Hancock) Delinquent Utility Bills. Chapter 270, Statutes of 2015. The bill makes permanent a law that allows a municipal utility district (MUD) to put a lien on the property
of a tenant or lessee who becomes delinquent in paying his or her water bill when the bill is in the tenant’s name. Landlords are still protected under the California Public Utilities Code Section 12822.6, which bars utility districts from collecting a tenant’s bill from a landlord when an account is established under the tenant’s name. Impact of Lobbying Effort: Originally, the bill had the potential of making landlords liable for a tenant’s delinquent water bill when the account was in the tenant’s name. CalPCG lobbyists worked with the author to ensure reasonable protections for landlords would be maintained. The author agreed and amended her bill accordingly. SB 555 (Wolk) Water Loss: Urban Water Suppliers. Chapter 679, Statutes of 2015. Each retail water supplier will be required, on or before October 1, 2017, and on or before October 1st of each year thereafter, to submit a completed water loss audit report for the previous calendar year or fiscal year to the state Department of Water Resources. What to Know: It is argued that water lines owned by urban water suppliers lose approximately 10–15% of water due to leaks in their system. The bill urges those suppliers to identify the leaks and perhaps fix them, thus saving millions of gallons of water. Smock/Kingston — continued on page 10

Smock/Kingston — continued from page 9 Low-Income Housing Bills AB 2 (Alejo) The New Redevelopment Law. Chapter 319, Statutes of 2015. The Redevelopment Agency was extinguished back in 2012; along with it went billions of dollars for low-income housing construction and rehabilitation. AB 2 brings Redevelopment back at a smaller scale under the Community Revitalization and Investment Authority. What to know: The dissolution of the Redevelopment Agency has affected housing in both the public and private spheres. Without funding to build lowincome housing, pressure has been building to regulate private rental housing to ensure affordability for low-income tenants. This bill relieves some of the pressure on private housing by creating a new funding stream to address infrastructure, affordable housing, and economic revitalization.

Medical Marijuana Regulation AB 243 (Wood), AB 266 (Bonta), and SB 643 (McGuire) Medical Marijuana Regulation. Chapters 688, 689, & 719 respectively, Statutes of 2015. These three bills make up California’s new medical marijuana regulatory scheme. The bills establish a comprehensive licensing and regulatory framework for the cultivation, manufacture, transportation, storage, distribution and sale of medical cannabis. AB 243 establishes the Medical Marijuana Safety Act. It requires the Department of Food and Agriculture, the Department of Pesticide Regulation, the State Department of Public Health, the Department of Fish and Wildlife, and the State Water Resources Control Board to promulgate regulations or standards relating to medical marijuana and its cultivation. It also requires various state agencies to take specified actions to mitigate the impact that marijuana cultivation has on the environment.

AB 266 enacts the Medical Marijuana Public Safety and Environmental Protection Act (MMSRA), which establish the Bureau of Medical Marijuana Regulation under the Department of Consumer affairs. The bill addresses licensing, enforcement, and regulation of medical marijuana. SB 643 among other things sets forth standards for punishing physicians who over prescribe medical marijuana. What to Know: If a landlord permits cultivation, manufacture, transportation, storage, distribution or sale of medical cannabis, the landlord may insist on requiring evidence of state and local government licensure as part of the lease agreement. Revocation or suspension of a local or state license terminates the ability of a licensee from operating. Marijuana is still considered a controlled substance. Health, Safety, and Security Bills AB 418 (Chiu) Abuse Victim’s Lease Termination Rights. Chapter 70,

Statutes of 2015. Under current law, a tenant who is a victim of domestic violence may abruptly terminate his or her tenancy so long as proper documentation is provided to the landlord showing the tenant’s status, and 30 days notice is given. This bill makes the right of abuse victims to terminate their lease permanent, and allows victims to provide only 14 days notice to terminate. Where multiple tenants rent a unit, and one tenant wishes to terminate his or her lease based on this law, landlords are not responsible for reimbursing the security deposit or the rent that has already been paid. Instead, joint and several liability principles apply requiring tenants to work out reimbursement amongst themselves. Impact of Lobbying Efforts: The bill originally required landlords to reimburse security deposits and rent to the terminating tenant even when other tenants continued to rent the unit. CalPCG lobbying efforts ensured that joint and several liability laws stayed intact. What to Know: Victims of domestic violence are already protected under current law, and may terminate their leases if necessary if 30 days notice and proper documentation is provided. This law merely speeds up that process, allowing tenants to terminate with only two weeks notice. In such a case, their safety is important, and landlords are to follow the new law, which allows a victim who makes the request and accompanies that request with a qualified police report or court order to terminate his or her lease in 14 days. Subject to local government just cause for eviction laws, landlords may consider evicting the perpetrator if that perpetrator resides on the property. AB 964 (Chau) & SB 570 (Jackson) Data Security Breach Notification. Chapter 522 & 543 respectively, Statutes of 2015. Current law requires a person or business conducting business in California, that owns or licenses computerized data that includes personal information, to disclose a breach of

the security system or data following discovery or notification of the security breach, to any California resident whose unencrypted personal information was, or is reasonably believed to have been, acquired by an unauthorized person. Encrypted data that has been acquired by an unauthorized user does not trigger a requirement to notify affected Californians. AB 964 defines “encrypted” to mean “rendered unusable, unreadable, or indecipherable to an unauthorized person through a security technology or
methodology generally accepted in the field of information technology.” SB 570 outlines more precisely how notification must be given to affected persons. What to know: The requirement to notify affected persons about data breaches allows people to begin taking steps to stop or limit the repercussions of being a victim of identity theft. The law, therefore, creates an exception to the notification rule for encrypted data, to encourage businesses to set up system to encrypt the data the business stores. The term encryption was not previously defined. AB 964 establishes a working definition. SB 570 ensures that the notification is clear and understandable. AB 1056 (Atkins) Ex-Offender Program Funding. Chapter 438, Statutes of 2015. Establishes the Second Chance Program to invest in community-based programs, services, and initiatives for formerly incarcerated individuals in need of mental health and substance abuse treatment services. What to Know: Landlords are always concerned about the safety of their tenants, their property, and their neighborhood. As California criminal justice laws become more lenient, and more and more prisoners are released early to address California’s prison overcrowding problems, there is a growing concern that crime will rise, especially crimes affecting safety and property. This bill is a possible good step in the right direction as its purpose is to ensure adequate funding for programs that help ex-offenders keep from reoffending. SB 328 (Hueso) Pest Control Notice Requirements. Chapter 278, Statutes of 2015. Under the new law, a landlord must notify a tenant 24 hours prior to applying any pesticide inside of a tenant’s dwelling, including over-thecounter pesticides that are generally available at Home Depot, Lowes, and other hardware stores. The written notice must include the pests to be controlled, the brand and product, the date, time, and frequency of application, the phone numbers for the state poison control agency, the local county health department, and the state pesticide agency. If a tenant requests immediate application of pesticides to address a pest problem, the tenant may agree to have the notice given immediately before applying the pesticide. 1 2

Neighboring tenants who may reasonably be affected by the use of foggers, aerosols, or when making broadcast applications, must also be given notice. When applying a pesticide to a common area, all tenants must be notified prior to application by posting a notice in a conspicuous area where the pesticide will be applied. Impact of Lobbying Efforts: The bill originally required landlords to provide notice to all tenants 48 hours prior to any application of a pesticide inside or outside any dwelling. CalPCG worked with the author to limit the notice requirements, and allow the tenant to waive the notice period when the tenant requires immediate application. What To Know: CalPCG has provided the Association a more detailed description of the bill and its new requirements. The most important thing to remember about the new bill is that landlords are now under a duty to notify tenants prior to applying any pesticides including those that kill unwanted vermin, and those used to kill weeds. SB 655 (Mitchell) Mold May Be a Substandard Housing Condition. Chapter 720, Statutes of 2015. Under the new law, the presence of visible mold in a dwelling may be considered a substandard housing condition. City and county building inspectors may issue a citation against a property owner for not addressing a mold problem under the circumstances specified in the new law. These circumstances are extremely important to be aware of and follow. Impact of Lobbying Efforts: CalPCG’s apartment association clients along with other regional apartment associations opposed the bill because no scientific based studies exist defining what levels of mold are unhealthy, or which molds among the 300,000 types that exist are harmful. That means there are no real standards to determine what molds and at what levels can be hazardous. The standard adopted by the bill is simply that if the mold is visible, and exists “to an extent that endangers the life, limb, health, property, safety, or welfare of the

public or the occupants”, then it may qualify as a substandard housing condition, given certain circumstances. Without scientific-based standards, it will be difficult, if not impossible, for landlords to know when mold “endangers the life” of a tenant. One of the critical amendments made to the bill absolves the landlord from his or her obligation to repair a dilapidation (mold), if a tenant fails to keep his or her rental unit “clean and sanitary as the condition of the premises permits.” How to Comply: If visible mold exists in a dwelling and the tenant submits a written notice alleging the existence of mold in the dwelling, landlords should investigate. The next step is to determine if the tenant failed to keep his or her rental unit “clean and sanitary” as the condition of the premises permits (See Civil Code Section 1941.2). A landlord is not in violation of the substandard housing law if a tenant failed to give written notice or maintain the property in accordance with Civil Code Section 1941.2. Anti-Discrimination Bills AB 447 (Maienschein) Property Insurance Discrimination. Chapter 432, Statutes of 2015. Under current law, property insurance providers may not discriminate by charging a higher premium or insurance rate based on a person’s class or characteristic. Protected classes and characteristics include sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation. This bill adds level or source of income, and receipt of government or public assistance to the categories that may not be discriminated against. An insurer may not use these characteristics for the purposes of creating a risk category, or charging a higher premium. What to know: Tenants aren’t the only ones who can be discriminated against. This bill protects landlords from discrimination by insurers based on their tenant’s income, and whether the landlords accepts public assistance, such as Section 8 housing funds. AB 622 (Hernandez, R.) E-Verify System Restrictions. Chapter 696, Statutes of 2015. The federal E-Verify system, administered by the United States Citizenship and Immigration Services, the United States Department of Homeland Security, and the United States Social Security Administration, enables participating employers to use the system, on a voluntary basis, to verify that the employees they hire are authorized to work in the United States. This bill prohibits employers from using E-verify unless specifically required to do so under federal law or authorized by a federal agency memorandum of understanding. The prohibition applies to checking on current employees, and employment applicants who have not received an offer of employment. The bill also requires employers to provide any affected employee any notification by the E-verify system issued by the Social Security Administration and the Department Homeland Security. What to know: The bill protects against unfair immigration practices and discrimination. AB 987 (Levine) Religious or Disability Discrimination. Chapter 122, Statutes of 2015. Prohibits an employer from retaliating or otherwise discriminating against a person for requesting a reasonable accommodation for a disability or religious belief, regardless of whether the accommodation request was granted. What to Know: There are legitimate reasons a person with a disability or religious belief may need or want a reasonable accommodation in the workplace. The bill ensures that employees are not treated unfairly for making the accommodation request. SB 600 (Pan) New Protected 1 4

Classes. Chapter 282, Statutes of 2015. The Unruh Civil Rights Act protects certain classes of people from discrimination. This bill adds citizenship, primary language, and immigration status to the list of those who are protected. The bill however does not require the provision of services or documents to be in languages other than English. Moreover, asking a person to verify their immigration status and discrimination based upon that verified status where required by federal law, is allowed. What to know: Businesses must always be aware of California’s everchanging discrimination laws. New classes are added regularly, and lawsuits can be lodged if an owner unknowingly discriminates against someone in a protected class. Statutorily identified classes under the Unruh Civil Rights law are not necessarily the same as those classes protected under the Fair Employment and Housing Act (FEHA). Under this bill, the new protected classes are not protected under FEHA. The trend, however, is that once a class becomes protected under Unruh, sooner or later, the class will be protected under FEHA. Disability Access Bills AB 1230 (Gomez) Funding For Disability Access Building Retrofits. Chapter 787, Statutes of 2015. Establishes the California Americans with Disabilities Act Small Business Capital Access Loan Program, to create a self-sustaining program to provide loans to assist small businesses in financing the costs of projects that alter or retrofit existing small business facilities, to comply with the federal Americans with Disabilities Act. What to know: Retrofitting a building to ensure compliance with disability access laws can be quite expensive. This new loan program will help some small businesses afford compliance costs. AB 1521 (Committee) Chapter 755, Statutes of 2015. Current law requires an attorney to provide a written

advisory with each demand letter or complaint sent to or served upon a defendant or potential defendant for any construction-related accessibility claim. This bill requires the advisory to include additional information regarding the rights and obligations of business owners and commercial tenants. In addition to the written advisory, the bill requires an attorney to provide a defendant or potential defendant of a construction-related accessibility claim with a verified answer form developed by the Judicial Council, which allows a defendant to respond in the event a complaint is filed. What to Know: The new notice requirements include information on attorney misconduct, and how to reduce damages. The bill is part of a broader effort to ensure that property owners are aware of their rights and responsibilities when it comes to disability access compliance. Other Residential Rental Related Bills AB 285 (Gallagher) Unlawful Detainer Assistant. Chapter 295, Statutes of 2015. Unlawful Detainer Assistants (UDA’s) are non-lawyers who provide advice and assistance to tenants on unlawful detainer issues for compensation. UDA’s must register with the county clerk in any county in which he or she maintains a branch office, in addition to the county in which his or her principal place of business is located. UDA’s will be required to fulfill a 15-hour continuing legal education requirement. The venue for any legal dispute involving an UDA must be in the county of the client’s primary residence. Additional oral and written disclosures to prospective clients must be provided, including a written “Notice to Consumer” document which must be signed and dated before entering into any contract for services or accepting compensation. (Sunsets on December 31, 2021.) What to know: The bill brings some commons sense regulation to a “profession” that previously had little D E C E M B E R

oversight and regulation. AB 1448 (Lopez) The Clothesline Law. Chapter 602, Statutes of 2015. Under the new law, a tenant may utilize a clothesline or drying rack in the tenant’s private area if all of the following conditions are met: (1) the clothesline or drying rack will not interfere with the maintenance of the rental property; (2) the clothesline or drying rack will not create a health or safety hazard, block doorways, or interfere with walkways or utility service equipment; (3) the tenant seeks the landlord’s consent before affixing a clothesline to a building; (4) use of the clothesline or drying rack does not violate reasonable time or location restrictions imposed by the landlord; (5) the tenant has received approval of the clothesline or drying rack, or the type of clothesline or drying rack, from the landlord. What to know: Tenants must seek the consent of the landlord to use an outside clothesline. The request and response should be in writing, and be kept by the landlord in the tenant’s file. Ultimately, tenants may not use a clothesline without first receiving the landlord’s approval. AB 802 (Williams) Energy Efficiency. Chapter 590, Statutes of 2015. Among other things, the bill states the intent of the Legislature is to have the CA Energy Commission (CEC) create a benchmarking and disclosure program to help owners of commercial and multifamily buildings above 50,000 square feet in gross floor area have a better understanding of their energy consumption. The benchmarking program for the buildings means buildings without residential utility accounts or buildings with five or more active utility accounts, residential or nonresidential. The CA Public Utilities Commission is authorized to provide incentives to offset costs of energy efficiency programs to bring buildings into compliance with mandatory energy efficiency codes for existing buildings. What to Know: Sharing energy

No obligation is created to share the data with prospective tenants, and there is no requirement to make energy upgrades at point-of-sale or point-of-lease. SB 761 (Hall) Airbnb Notice to Tenants. Chapter 239, Statutes of 2015. The bill requires companies like Airbnb to provide a specific notice to an occupant listing a residence for a short-term rental on its website that states, among other things, that, if the occupant is a tenant, listing the room, home, condominium, or apartment may violate the lease or contract and could result in legal action by the landlord, including possible eviction. What to know: Residential tenant lease terms often contain a provision prohibiting the subletting of the tenant’s unit without prior landlord approval. Despite this provision, some tenants rent out their apartments on websites
like Airbnb without notifying their landlords. This bill is an attempt to ensure tenants are aware that they may be violating their lease by subletting on websites like Airbnb. Landlords may want to review lease and rental agreements to assure short-term rentals are prohibited. AB 744 (Chau) Affordable Housing Developments: Parking Ratios. Chapter 699, Statutes of 2015. The bill places a cap on the parking ratios that local governments may impose on certain affordable housing developments. The bill adds several provisions to the state density bonus law by reducing parking ratios greater than .5 spaces per unit for a development that includes at least 20% low income or 11 % very low-income housing units and within one-half mile of a major transit stop. It also prohibits parking ratios greater than .5 spaces per unit it the development is a senior citizen property, is entirely compose of low or very low-income rental units and has a
paratransit or located within a mile of a bus line that runs at least 8 times per day. It is also designed to assist the construction of special needs housing. What to Know: Qualifying affordable housing developments could see a reduction in the cost of building lowincome housing and could be encouraged to build these developments. ‘disabled’ and that because they are ‘disabled’ they get to do whatever they want. Huge clouds of smoke literally billow out of their apartment! I’m concerned about lots of things, but mostly, the little girl who lives next door, I believe that she’s asthmatic. How much more of this must I, and the neighbors take?
The audacity of some medical ‘professionals’ to abuse and game the system by willfully proscribing the use of ‘medical marijuana’ to non-disabled fraudsters is an affront to all truly disabled persons. As of this writing, the use of marijuana, medical or otherwise, is still illegal under federal law however the current administration has elected to stay any enforcement and prosecution for the use and or possession of ‘medical

marijuana.’ California enacted the Compassionate Use Act which allows for the possession of a limited amount of marijuana, for personal use, provided certain requirements are met. According to the California Department of Justice, qualified patients and caregivers may possess 8 ounces of dried marijuana, as long as they possess a state-issued identification card. In addition, they may only maintain 6 mature or 12 immature marijuana plants. Local governments may allow patients or caregivers to exceed these base levels. In addition, marijuana smoking is also restricted by location. It may not be smoked wherever smoking is prohibited by law, within 1000 feet of a school, recreation center, or youth center, on a school bus, or in a moving vehicle or boat. The right to ‘smoke’ marijuana in your apartment community is not automatic, and will depend upon the individual facts of each case. The use of non-medical marijuana is illegal under both California and federal law, and cannot be used or smoked anywhere, including your community, and can be grounds for termination of their tenancy. The use of medical marijuana requires that the user be disabled, and the disability must be ‘verifiable.’ Additionally, the disabled individual must request a “reasonable accommodation” from you the housing provider prior to just lighting up. Once the disabled person makes the request for a reasonable accommodation, you are obligated to consider the request, and attempt in good faith to accommodate the request in a reasonable manner. The accommodation does not necessarily require you to ‘grant’ the request outright, but you must make a good faith effort to provide an accommodation that addresses the disability, but does so in such a manner that it does not unreasonably ‘burden’ you the housing provider. The courts will apply a “benefit to the requestor” versus a “burden to the housing provider” standard in determining whether or not you met

In your specific situation, the initial hurdle for your new residents to surpass is to establish that one or both truly has a “verifiable” disability. A ‘doctors’ note provided it has not been forged, although highly suspect will generally satisfy the extremely low threshold here in California. The reasonable accommodation, their request to smoke willy nilly within the apartment, must be balanced with the ‘burden’ to you the housing provider, and those other residents that might be affected, i.e. the asthmatic child living next door. It is conceivable, and probably likely, that an asthmatic child when exposed to the smoke billowing from next door might have a devastating and fatal reaction. Certainly the neighbor child, with a truly verifiable disability, asthma, is entitled to be free of the exhaled smoke as a “reasonable accommoda-

When balancing the benefit to Cheech and Chong of being able to light up in their apartment, with the burden to you as well as the extreme life threatening burden to the asthmatic child, courts would most likely find that a reasonable accommodation would be to prohibit the smoking of the marijuana within the apartment unit, or in any place that might affect the asthmatic child, or others with such a sensitivity to smoke, but provide an area within the community, possibly a portion of the outdoor common area that may be used for the smoking of their medical marijuana. Alternatively, there are alternative methods of delivering the active ingredient in marijuana, i.e. ingestion, pills or tablets, food based, etc. Remember, reasonable accommodation issues are extremely fact sensitive and the analysis is dependent on a proper review of the relevant facts. Always contact an experienced attorney when faced with a request for a reasonable accommodation, as the issues are typically complex and a reasoned response must be made in a timely manner.
I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?
Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they may change or evolve over time

depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental property or to others. These general rental criteria can and should be applied equally and fairly to all applicants, and in compliance with all fair housing rules. Once applied, the best applicant should be accepted, not necessarily the first to apply.
I just put my single family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?
The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/enclosure conform to all state and local codes and ordinances. The gate should be self-latching, and should be checked to ensure that it closes properly. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self-latching gate functions properly. Consider requiring that your tenants procure renters liability insurance as well. These requirements
should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children.

No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Handover of Control Calms House Republicans
O
ne of those characteristics of the United States’ experiment with democracy that we tout as a shining example for the rest of the world is the peaceful transfer of power. The fact that every four (or eight) years a new President takes office via the voting booth and not by the tip of a sword or barrel of a gun is pretty amazing. Similarly impressive was the handover of control of the House
Republican caucus (and by extension the House of Representatives itself) last month. Due in large part to the fact that Rep. Paul Ryan (R-Wis.) was willing to take the job of Speaker, a potentially divisive vote within the caucus was avoided. He truly was “the one” who could unite the caucus and put a pin in the intraparty squabbling which dominated for the past several months. Now, let’s see how long he
can maintain it. Former Speaker of the House John Boehner (R-Ohio) — as we speak likely stepping up to a golf tee somewhere in Florida — did Mr. Ryan a big favor by clearing away two of the biggest legislative landmines — the budget and the debt ceiling. Federal Focus — continued from page 24 Freedom Caucus, Mr. Boehner was free to negotiate a deal to take both items off of the table until 2017. This should also be considered a gift to the moderate House Republicans and those in tough reelection campaigns who will not have to take any more perilous votes in this area until after Election Day. The deal drew lots of fire, both on the process, which was not done through “regular order” of the Committees, and on the substance, which dropped the sequestration caps to allow increased domestic and defense spending. Still, it is now law and everyone can grumble but has to move on. Speaker Ryan is already working to put his own imprint on how the Congress functions by reportedly reaching out to Senate Republican leaders to discuss a joint policy agenda for 2016. Typically at the start of each year the parties in both chambers hold retreats to discuss the plan for the next 12 months. This year there was even a joint retreat of the House and Senate Republicans to try and coordinate activities after the GOP retook the Senate in 2014. Despite declarations of solidarity following the retreat, things devolved quickly. The reality of the differences between the two institutions crept in and House Republicans began calling for the Senate GOP to drop or significantly weaken the 60-vote cloture rule so that Democrats would be unable to block GOP legislation. Speaker Ryan understands the distinct culture and process of the two chambers and reportedly wants to craft a strategy which takes those into account. Meanwhile, as soon as then-Ways and Means Committee Chairman Ryan announced that he would run for Speaker of the House, jockeying began to replace him. Ultimately Rep. Kevin Brady (R-Texas) was chosen to replace Mr. Ryan. This is good news both for the apartment community and the real estate industry broadly. Chairman Brady has been a long-time friend to 2 6

the real estate sector and, thanks to the good work of the Houston Apartment Association, he knows and understands apartment housing. Mr. Brady has little time to acclimate to his new role as he will need to immediately begin negotiations on a pending highway funding measure and deal with 52 expiring tax provisions before the end of the year. On a longer time frame is the effort to reform the nation’s tax code which will not occur before 2017 but the foundation for which is being laid now. There has been some debate on whether tax reform has as good of a chance of success with Mr. Ryan as Speaker as it did with him as Chairman of the Ways and Means Committee. He is an admitted wonk on tax policy and fixing the tax code is a personal mission for him so one would think he will use his position as Speaker to drive the process forward. But, being Speaker is about 100 things, not one thing. Will Mr. Ryan have time to drill down on the details of a reform package while managing the House and the many factions of his own party? Or, will he be able to keep his distance from those details and just focus on keeping the train moving? We will see. A quick thanks to all of you who responded to our Call to Action on S. 1140, the Federal Water Quality Protection Act. This bill would force the Environmental Protection Agency to rewrite its “Waters of the U.S.” or WOTUS rule. Recall that this rule would greatly expand the federal government’s role in local land use decisions impacting development of all kinds, including apartment housing. Last month, the U.S. Court of Appeals for the 6th Circuit issued a nationwide stay on the rule effectively stopping its enforcement. This is not a permanent solution, however, and a new rule is still needed. Unfortunately, our efforts on S. 1140 were unsuccessful and the bill did not garner the 60 votes needed to proceed to an actual vote on the legislation. This is not the end of the story, so stay tuned for our next steps

on this critical issue. Finally, mark your calendars for the 2016 NAA Capitol Conference and Lobby Day which take place in March in Washington, D.C. NAA has a new and ambitious goal for next year’s event. We’re going to reach every one of the 535 Congressional offices — that’s 435 Representatives and 100 Senators — on Lobby Day on March 9. The Capitol Conference will be held the day before, starting right after lunch with an issues orientation and advocacy training followed by keynote speaker Joe Scarborough, a former member of the House and host of MSNBC’s Morning Joe. While members of the House will be in recess the week of March 7, NAA members can schedule meetings with their important key staff members in Washington and just importantly schedule meetings with all 100 members of the U.S. Senate, which will be in session. Run a mainline snake or hydro jet at least once a year. (A Friday evening main back-up is a disaster.) 4: Locate and mark the main gas or fuel oil shut-off valve. 5: Write down and post this information in a public area of your apartment building, including emergency phone numbers and how to get hold of management. Alternatively; post this information on the inside of a kitchen cabinet door in each rental unit. Dear Maintenance Men: I am starting my planning for a major kitchen cabinet remodeling project in
my rental units. However, I am having a difficult time making material and design decisions. What recommendations can you give? Allen Dear Allen When doing a kitchen or bath material selection, cohesive and functional design is important. Kitchen and bath rehabs are some of the most expensive work you can do in an apartment unit and proper planning is a must. In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly. Don’t let the cabinet fronts fool you. Manufactures designed their cabinets to look good at first glance. Keep in mind, being in a rental environment, the cabinets also need to hold up to abuse. Look at the actual construction of the cabinet box or frame. There is no need to use custom cabinets to fit your existing layout. The use of prefabricated modular cabinetry can
greatly reduce the time and cost to have a finished kitchen or bathroom. Using real wood cabinet fronts with 3/8” plywood sides is essential for durability. The drawer fronts and sides should be connected with a dovetail or other positive lock construction. Drawers that are held together by nails will not hold up to tenant abuse, nor will particle board constructed cabinets. On a side note; if you are gutting the kitchen or bathroom, use this time to relocate and add more electrical outlets and under cabinet lighting. Dear Maintenance Men: I am a property supervisor for a local property management company and I am looking for solutions to my maintenance issues. Invasive Mosquitoes Discovered in Orange County BY OCMVCD
G
arden Grove, CA. The Orange County Mosquito and Vector Control District (OCMVCD) is urging residents to report small black and white, day-biting mosquitoes. In mid-October, OCMVCD responded to complaints of mosquitoes in the City of Mission Viejo. A thorough investigation was conducted and the presence of invasive mosquitoes was confirmed. Additional requests for assistance by Orange County residents have led to the detection of these mosquitoes in
other cities: Mission Viejo, Huntington Beach, Los Alamitos, Garden Grove, Santa Ana, Orange, and Costa Mesa. “We applaud the public’s role in reporting mosquito problems to us,” said Mary-Joy Coburn, spokeswoman for OCMVCD. “ Our goal is to suppress populations of these mosquitoes wherever they are detected to limit their expansion into surrounding cities.” District personnel actively monitor and control invasive mosquitoes wherever they are found through door-to-
door inspections, source reduction, mosquito control, and education programs. The two mosquitoes that now impact Orange County residents are the yellow fever mosquito (Aedes aegypti), and the Asian tiger mosquito (Aedes albopictus). They are both small, black mosquitoes with white stripes on their legs. They can live both indoors and outdoors, and primarily bite humans. Mosquitoes — continued on page 34

Mosquitoes — continued from page 32 Female mosquitoes lay their eggs in containers holding as little as a teaspoon of water, such as the inside walls of small containers, including buckets, plant saucers, and even plants that can hold standing water. The eggs, which are laid just above the water line, can survive dry conditions for six months or more. The presence of these invasive mosquitoes increases the risk of residents being exposed to exotic diseases such as dengue fever, chikungunya, and yellow fever. These viruses are currently not transmitting locally. The invasive mosquitoes can also transmit dog heartworm. Once an introduction of the invasive species has occurred, residents moving materials from infested areas to noninfested areas may facilitate their spread. In order to stop the spread of this species in Orange County, OCMVCD is calling upon all residents to do their part by following these steps:
• REPORT any sightings of small, black-and-white mosquitoes, or if you are being bitten by mosquitoes during the day. Eliminate plant saucers and other unnecessary containers that could be a possible breeding source. • Clean and scrub bird baths and pet-watering dishes weekly and dump the water from overflow dishes under potted plants and flower pots. • Do not transport or share plant stems rooted in water.

We welcomed Danny Huynh from the Garden Grove Housing Authority that has dealt extensively with our members and has listened to concerns to help make the program in Garden Grove even better for landlords that participate. Judson Brown from the Santa Ana Housing Authority was extremely helpful in presenting options for property

Failure of the Manager to ask specific questions that will streamline the repair process is another setback that Maintenance Personnel face on a daily basis. Maintenance Personnel also should be responsible for asking questions of the Managers who have taken the information for the request and should document all details of the work they performed to be able to give specifics on how to avoid these issues in the future, if possible. These issues can be easily remedied if both Managers and Maintenance Personnel take a few extra minutes to make sure they are detailed. Managers will help the Maintenance Personnel by completely filling out the standard service request form, and Maintenance Personnel will help the Managers by fully understanding the task before reporting to the job site. Will 2016 be a Super El Niño Year? BY JERRY L’ECUYER AND FRANKIE ALVAREZ OF DEAR MAINTENANCE MEN
W
e have been living with drought in the Western United States for a long time now. So the prediction of a strong, wet El Niño year is quite appealing. Will it fill our reservoirs, recharge our aquifers, and bring us back to normal? Hard to tell; many experts say we may need multiple years of El Niño to be back to pre-drought conditions. First a short explanation by some of the experts as to what an El Niño condition is. An El Niño is a weather pattern
produced by unusually warm ocean temperatures in the Equatorial Pacific. The El Niño phenomenon is associated with extreme weather around the globe and in California it typically means a wet winter with higher than normal rain levels. As early as last spring, the National Oceanic and Atmospheric Administration (NOAA) was predicting a 60 percent chance that the El Niño conditions will continue all year. Now that we are much closer to the end of the year, the experts are predicting closer
to 100% that 2016 will being a strong or super “El Niño” year. Dr. Dough Gillham a Meteorologist, PhD tells us: “We are in the midst of a rapidly strengthening El Niño event which will likely peak later in fall as one of the strongest El Niño events on record.” El Niño has a reputation for bringing mild winters to much of the country, especially across the northern States. The two strongest two El Niño events on record prior to this year (1982–83 El Niño — continued on page 46

El Niño — continued from page 44 and 1997–98) were quite mild from the Pacific Northwest to the Northeast. Only the Southwestern States saw below average temperatures during those winters. However, a review of other El Niño winters shows that a strong El Niño does not guarantee a mild winter. A unique feature of the upcoming winter compared to other strong El Niño winters of the past is the expected persistence of the warmer-than-normal ocean-water temperatures south of Alaska. Some have referred to this feature as “the Blob” and it has been a key contributor to the dominant weather pattern across North America for the past two years. This pattern has been associated with extended periods of warm and dry weather in the West and two of the coldest winters in recent memory further to the east, especially in the Great Lakes and Northeast. If “the Blob” does indeed persist through the upcoming winter, then the threat for a cold conclusion to winter in the East will increase. Now that we know what an El Niño
weather condition is, how do we prepare for El Niño? First order of business is to take a long hard look at your apartment building and surrounding property. Inspect your building’s roofs, gutters, drains, flashing and trim overhanging trees. In other words, don’t wait for it to be raining to find out your roof is in poor condition. Get the work done now while it is dry and the roofing companies are not busy. Don’t forget about large trees that hang over your roofs. In wet windy weather, they can cause a lot of damage to a roof if a limb breaks or a tree falls because of soggy soil. Flat roofs are especially vulnerable to blocked scuppers and roof drains. The backed up water will find the slightest weakness in any roof system and may even cause a roof to collapse. Make sure the landscaping around your property is designed to drain away water quickly. Connect downspout extenders at the ground level. The extenders will direct water away from the building. Check for stucco cracks. A surprising amount of water can be sucked into a building because of damaged stucco. Clean out window weep holes to stop water from
finding its way through window frames and damaging interior walls. If you have wooden garage doors, check that the doors are painted or sealed and that the springs are in good order. The garage doors can get quite a bit heavier when wet or allowed to soak up water. A little bit of preventive maintenance now will save both you and your residents a lot of discomfort later.
