Dear AAOC Members and Friends,
J
ust over four years ago I learned that I had been nominated to serve as President of the Apartment Association of Orange County where I would succeed my good friend and industry veteran Nick Lieberman in leadership. At that time, we had worked closely together on a number of AAOC projects, from budgets to membership to the State association that was still coming together. In our many meetings and discussions, we began to assess the needs of our Association and members and would address the changing face of our industry and the need for more educational opportunities, better information and a new appeal to our membership base. I think back to subsequent talks or discussions with other AAOC board and committee members in an effort to better understand the needs, wants and concerns of our industry and our association. One of the things that stands out most was a question posed by a fellow board member to the effect of: “we’ve seen similar ideas and concepts over time, but have never been successful in implementing them. What makes you different?” My answer was simple: I will refuse to fail and refuse to accept mediocrity in anything that our association is involved with. This was no small undertaking. Truth is, the difference has been and is in my approach, my experience and my desire to serve. So, in addition to running a growing management company with approximately 4,000 units in

7 states and 3 time zones, serving on the local planning commission, becoming a landlord and being a husband to my wife and dad to two young children, I went all-in and dedicated myself to AAOC. Working after hours and weekends with other volunteers, lobbyists and associations on public and legislative affairs, reaching out to new speakers to ensure top notch content and reaching out to prospective members in hopes of gaining their trust and membership as we continue to grow. It was not a simple process, but our staff and leadership at the association were top notch and game for the task. As a result, we were successful in selling out two reverse tradeshows, selling out two multifamily housing forecast breakfasts, co-hosting a number of industry mixers and shattering records with our 2016 tradeshow attendance. We changed the look of the magazine, launched a new website and enhanced the feel of our meetings by bringing in high level speakers such as attorney Matthew Burke from Pricewaterhousecoopers and former NMHC Chair Daryl Carter amongst others. And the best part of it all was hearing from you, our members, that something was abuzz at the association. That there was new life and new energy in the new programming and content and as a result, there was renewed interest. But programming and content is just a small part of what we do. As rental housing advocates, we were featured more than 10 times in the Orange

County Register in a 2 year period. I had 4 Letters to the Editor published on top of these features and even ghostwrote an article that turned into a feature for their Business and Real Estate Group. We were featured in Bisnow twice, RENTV twice, UNITS Magazine twice, once in Multifamily Housing News and featured in four different televised news stories as featured on CBS-2, NBC-4, KTLA-5 and ABC-7. Additionally, I was able to represent AAOC on more than 4 panel discussions focused on the Orange County multifamily housing climate. Also as advocates, we fought several legislative and policy battles at the State and local levels with cities such as Anaheim and Santa Ana related to service contracts, billing rates, parking issues, incentive programs and more. We were able to engage in thoughtful discussion and push back to ensure that AAOC members were represented professionally and with concern for their bottom line. To that end, we were also able to help our members secure a 50% savings in sewage rates in the North Tustin area by turning up the pressure in the heated IRWD versus East Orange contract negotiations. The commitment was more full-time than part-time job, but I am fortunate to be surrounded by great people who support me and allow me to better serve you. First and foremost, a big thank you to my wife Bianca for allowing me to leave early, come home late and spend a ridiculous amount of time
on the telephone and email. I love you and could not have done this without your support. To my parents and especially my dad, Paul, for involving me in this crazy business from the time I was 8 years old. I really had no hope to do anything that wasn’t real estate related, so I hope I’m doing a good job. A special thank you to Jun Sakumoto and Daryl Carter at Avanath who allow me be active and involved as a volunteer leader. Thank you to Lou, Veronica, Brianna, Debbie, Gissel and Janet for your enthusiasm, your teamwork, your patience for listening to my ideas and for ALL of your work behind the scenes. Thank you to my big sister (not Grandma) Valerie Teeter who is retired but not forgotten. Thank you to Nick Lieberman, Ray Maggi, Steve Duringer and James Wohrman for your insight, friendship, counsel and advice. Thank you to the Board of Directors and to you, our members, for your trust and confidence in allowing me to lead. So while my term is done, we are really just getting started. Understanding that legacy and the second or third generation entering the business is a concern, we will soon be adding more content to our Legacy line of programming and also launching the industry’s only, AAOC member’s only video library so that you can get tips and assistance on demand. Our industry is booming and our association is thriving. Thank you for sitting down with us again for this interview. I can’t believe it’s been a year since we last spoke together. It’s always my pleasure to spend time with you people. Yes, it’s been quite a year for the industry and our fair association. I have to begin with my thought

that this has been quite a productive year. As always, our first question: year in review. What successes are you most proud of? As always, it is difficult to single out an individual event or program, so I’ll list you a few. The 2016 Apartment Association of Orange County Trade Show and Exhibition enjoyed a whopping 26% increase in attendance. The 2016 Reverse Trade Show sold out in under

an hour. The Multi Family Forecasting Breakfast was at capacity attendance as has been the registration to our education classes. All this tells me we are reaching an audience that yearns for our programs and services…and that is a good thing. What, failure would you like to share? Ok, I’ll offer this one: Our industry, both locally in Orange County and statewide, has not yet been able to take
command of the discussion on multifamily housing affordability, specifically: how the operating regulatory climate and myriad of state housing law affect cost and subsequently, rents. We need to do a better job of educating policy makers, and opinion shapers in the media. Where do you see the Multi Family Rental Housing industry going in the year upcoming? I see a very competitive industry in 2017, on every level. Just as any High School football coach will tell you: competition yields excellence. That climate bodes well for the owner, the vendor, and the resident. What advice would you have for a new IRO just starting out? As I have always held: the support, counseling, and experience of your colleagues are your best tool for success. No where can you meet better colleagues than at Apartment Association
General membership meeting. They are a treasure trove for the independent rental owner. I know, I am one!
Thanksgiving dinner conversation was tough enough. I have many thoughts, but you’ll have to catch me at the lobby bar.

despite another year of legislative attacks on the rights of rental property owners, our lobbying team successfully helped to defeat the worst bills, while obtaining substantial amendments on all other bills of importance. The bills described in this Rental Property Owners and Mangers Guide are rental housing related bills that were signed into law in 2016. Some of the bills we supported, some we remained neutral, and some we opposed initially but moved to a neutral position after the author took significant amendments. Note: Unless otherwise noted, all bills discussed herein become effective on January 1, 2017.
2016 Legislative Bills Signed Into Law
AB 551 (Nazarian) Bed Bugs: The bill establishes new rules for addressing rental housing bed bug problems. Originally, the bill contained a host of unreasonable regulations on property owners, including a requirement to inform tenants of bed bug problems, regardless of how long ago the problem occurred. It proscribed unreasonable timelines for eradicating bed bugs. It also made owners liable for bed bug infestations that were caused by tenants. After much negotiation and advocacy by our lobbying team, the author made significant amendments. The law will require new leases and month-to-month rental agreements to include specific notice regarding bed bug identification, behavior, and biology and it will stress the importance of cooperation for prevention and treatment on and after July 1, 2017. All current tenants must receive the same disclosure notice by January 1, 2018. Our rental and lease agreements will be amended to include the disclosure requirement. A new bed bug addendum form will be added to the library of forms. The new law also prohibits an owner from showing, renting or leasing any vacant dwelling unit that the owner knows has a current bed bug infestation, and prohibits owners from retaliating
against a tenant for reporting a suspected bed bug infestation. The law does not impose a duty of an owner to inspect a dwelling unit or the common areas for bed bugs if the owner does not have notice of a suspected or actual infestation. After a unit has been inspected by a pest control operator (PCO), owners must notify the tenant of the unit of the PCO’s findings. The notification must be in writing and made within two business days of receipt of the PCO’s findings. All tenants must be notified when a bed bug infestation is found in a common area. Finally, tenants must cooperate with the inspection to detect and treat for bed bugs. AB 1750 (Dodd) Environmental Hazard Disclosures: The new law encourages, but does not require rental property owners and managers to provide their tenants with a booklet about common property-related environmental hazards. The booklet, entitled “Residential Environmental Hazards: A Guide for Homeowners, Homebuyers, Landlords and Tenants,” was created by the state, and provides useful information on common environmental hazards like asbestos, radon gas, lead-based paint, formaldehyde, fuel and chemical storage tanks, and water and soil contamination. The booklet, which has been used in single-family home real estate sales transactions for more than two decades, contains important information about common environmental hazards. Should owners and managers decide to deliver the environmental hazards booklet, the potential to provide misleading, inaccurate or wrong descriptions, definitions, or guidance about those hazards will be minimized. Additionally, owners and managers should be aware that the content of issues addressed in the booklet is deemed sufficient and no additional information is required to be disclosed. It should be noted, however, that providing the booklet does not relieve an owner or manager of his or her duty to notify tenants of any known harmful December 2016
hazard on the property and does not permit the owner and manager to rent an uninhabitable dwelling. The booklet will be available through the Association or at the following website: https:// www.cdph.ca.gov/HealthInfo/environh e a l t h / D o c u m e nt s / R a d o n / 2 0 1 1 HazardGuide.pdf AB 1928 (Campos) Landscape Irrigation Equipment: Under the bill, new landscape irrigation equipment standards will go into effect by January 1, 2019. The new standards involve new manufacturing labeling requirements, and ensuring that new irrigation equipment that is sold after the effective date established by the California Energy Commission (CEC) is water efficient. The bill ultimately establishes efficiency standards to help the consumers conserve water. To date, the CEC has not adopted regulations on landscape irrigation performance standards or labeling requirements because money has not been made available. The 2016–17 state budget contains $30 million for the CEC to implement the Water Energy Technology Program, which will provide funding for the development of innovative water saving technologies. AB 1934 (Santiago) Development Bonus: The bill establishes a “bonus” for commercial developers that partner with an affordable housing developer to construct affordable housing projects. Bonuses include density bonuses and regulation waivers and variances. Should a commercial developer partner with a housing developer through a joint project or two separate projects that have affordable housing, the local governments must grant the developer a development bonus. A development bonus could include: a 20% increase in maximum allowable intensity; a 20% increase in maximum allowable floor area ratio; up to a 20% increase in maximum height requirements or parking requirements or an exception to a zoning ordinance or other land use regulation. A CASp inspection can help minimize a property owner’s exposure to disability access liability. The bill requires commercial property owners or lessors to state on every commercial lease form or rental agreement executed on or after January 1, 2017, whether or not a CASp specialist has inspected the premises. Commercial property includes mixed-used developments that contain residential rental units. While CASp inspections are not currently mandatory for residential or commercial property, they may be soon. This bill represents the State’s continued effort toward ensuring CASp inspections become the norm. AB 2228 (Cooley) Code Enforcement Certifications: Requires the

Board of Directors of the California Association of Code Enforcement Officers (CACEO) to develop and maintain standards to become a Certified Code Enforcement Officers (CACEO). Standards include minimum training, qualifications, and experience requirements to become certified. These CCEOs will have enforcement authority for health, safety, and welfare requirements, whose duties will include enforcement of a statute, rule, regulation, or standard, and who will be authorized to issue citations or file formal complaints. CCEOs are a new class of code enforcement officers, with heightened powers, but also with more training and oversight. AB 2299 (Bloom) & SB 1069 (Wieckowski) Accessory Dwelling Units (ADU): An ADU, previously known as “in-law” units or “granny flats,” are additional living spaces on singlefamily lots that have a separate kitchen, bathroom, and exterior access independent of the primary residence. These bills require local governments to permit property owners to build ADUs in single-family and multifamily residential zones, so long as the ADU meets specific standards defined in the bill. Those standards include, but are not limited to, parking, height, setback, lot coverage, landscape, architectural review, and maximum size of a unit. As long as the standards are met, local cities and counties are required to approve the ADU. Property owners, who are interested in adding an ADU to their property, consult an attorney. AB 2362 (Chu) Notice of Pesticide Use in Common Interest Developments: Requires a homeowner association in a common interest development to provide owners or tenants with advance written notice whenever over the counter pesticides are applied to the affected separate interest(s) (dwelling(s)) or to the common area without a licensed pest control operator. That notice must specify: the pest or pest to be controlled, name and brand or the pesticide product proposed to be used,

the approximate date, time and frequency with which the pesticide will be applied and a statement regarding the toxicity of pesticides. The association or agent is to provide the notice at least 48 hours prior to the application if the pesticide is to be applied to the separate interest however it the pest poses an immediate threat to health and safety, thereby making compliance with the notification unreasonable the association or agent shall post the notice as soon as practicable but not later than one hour after the pesticide is applied. If the case of the pesticide being applied to the common area, the bill requires an association or its agent to post the notice in a conspicuous place in or around the common area in which the pesticide is to be applied. The content of the notice is very specific and is stated in the new state law. The new law does authorize the association or agent to agree orally to an immediate pesticide application if the tenant requests and the association or agent agrees the pesticide be applied before the 48 hour notice. In situations where the rental is in a CID, lease agreements should specify how and who is to provide the tenant notice. Additionally, the owner should notify the homeowner association or association manager who should be notified if a pesticide is to be used. AB 2406 (Thurmond) Junior Accessory Dwelling Units: The bill permits local governments to establish laws for the creation of “junior accessory dwelling units” (JADU) in singlefamily residential zones. A JADU is a unit that is no more than 500 square feet in size contained entirely within an existing single-family structure. A JADU may include separate sanitation facilities, or may share sanitation facilities with the existing structure. A JADU may include a separate entrance, and sound attenuation. Efficiency kitchens are required, where the kitchen must include a sink, cooking facility with appliances, food preparation counter, and prohibits a local government ordinance from requiring additional park-
ing as a condition of granting a permit. AB 2442 (Holden) Density Bonus for Constructing Housing For Certain Groups: Requires local governments to grant a density bonus when a housing developer agrees to construct housing for transitional foster youth, disabled veterans, or homeless persons. AB 2476 (Daly) Notice of Parcel Tax to Non-Resident Property Owners. The new law requires local agencies, including cities, counties, special districts and school districts, to provide a specified notice of a new parcel tax to non-resident owners within 30 days following a legislative body’s vote to place the proposed tax on the ballot. AB 2501 (Bloom) Density Bonus Application Time: Requires local government to adopt procedures and timelines to streamline the density bonus process. The new procedures include providing a list of all documents and information required to be submitted with the density bonus application, and notifying the applicant for a density bonus whether the application is complete. The bill also prohibits a local government from conditioning the submission, review, or approval of an application on the preparation of an additional report or study that is not otherwise described. AB 2515 (Weber) Water Efficient Landscaping: The bill ensures that regulations regarding water efficient landscaping are current and updated every three years. Specifically, it requires the Department of Water Resources to update the model water-efficient land-
scaping ordinance every three years, or make a finding that an update to the model ordinance is not a useful or effective means to improve landscape water use efficiency. This could have a profound impact on property owners who repair, remodel or improve exterior landscaping. AB 2819 (Chiu) Hiding Unlawful Detainer Records from Public View: Previously, unlawful detainers (UD) court filings were masked, or hidden from public view for 60 days following the initial court filing, and then were automatically unmasked and made public on credit reports unless the defendant prevails within the 60 day period. Under the new law, all UD filings will be permanently masked unless the rental property owner prevails at trial or a default judgment is obtained, because few UDs go to trial, and property owners rarely go back to court to obtain a default judgment, most UD filing records will remain hidden from public view. The permanent masking of this information will hinder rental property owners’ ability to assess a prospective tenants history of making or not making timely rent payments. Without an accurate record of UD filings, owners will have to consider new ways to assess the creditworthiness of an applicant’s rental payment history, including asking for bank statements and returned checks. Owners may also want to consider as an industry whether to adopt new reporting processes, in which owners report to the credit bureaus every time a tenant is late paying his or

her rent. Individualized reporting would help fill a void created by this new masking law. A Q&A will be written on the new law and will be available within the next 30 days. AB 2820 (Chiu) Price Gouging: The bill revises the definition of state of emergency and local emergencies for the purpose of criminal price gouging— increasing prices, including residential rental rates and towing services by more than 10 percent. The bill initially defined a “state of emergency” in such broad terms it could have included housing shortages and economic recessions resulting from policy decisions and regulation. Our amendments sharply limited the ability of a local government to declare a state of emergency and restrict rental increases. If that version of the bill passed, the State could have declared our recent recession as a state of emergency, and placed strict rent control on all residential rentals statewide. San Francisco would have been able to declare an emergency because of its housing shortage. State of emergency is not restricted and only applies to mean a natural or manmade emergency resulting from an earthquake, flood, fire, riot, storm, drought plant or animal infestation or disease, or other natural or manmade disaster. AB 2873 (Thurmond) All Building Inspectors to Become CASp Inspectors by 2020: Under the bill, starting January 1, 2020, all city and county building inspectors employed or retained by a local agency who conduct permitting and plan check services to review for compliance with state constructionrelated accessibility standards by a place of public accommodation with respect to new construction or renovation, including, but not limited to, projects relating to tenant improvements that may impact access, must be by certified access specialists. Requiring all city building inspectors to become CASp inspectors will help make the inspection and permitting process more efficient. Because all buildings need to be disability access compliant, it makes sense that buildings inspectors be trained to ensure that the buildings

they inspect are access compliant. To pay for the new mandate, the bill increases the fee from January 1, 2017 through December 31, 2019 for an application for a local business license from $1 to $4; however, in no case will the fee be less than $1 per business license on an indefinite basis. SB 7 (Wolk) Submetering and Residential Utility Billing Service Requirements: On January 1, 2018, water submeters are to be installed in new multifamily construction or mixed used commercial properties. In addition, tenants that are to be billed for actual water use through submeters are to receive a specified notice at point of rent concerning the billing and are to receive notice about water usage on each water bill. Owners will be permitted to charge up to $4.75 per bill for administrative processing. Repair and replacement of water related drips and leaks are to be completed within 21 days. Remedies for non-payment are restricted. Billing for excessive water

use is defined. Deductions from a tenant’s security deposit will be permitted if the tenant fails to pay his or her water bill. Grace periods to pay water bills are defined. Limitations on late payment fees are specified. The bill only applies to owners that have submeters. SB 269 (Roth) Technical Violations of Disability Access Laws: The bill allows qualifying small businesses to avoid liability for minor “technical violations” of disability access laws if they correct the violations within 15 days. “Technical violations” include certain interior signs (other than directional signs or signs that identify the location of accessible “elements, facilities, or features”), lack of certain exterior signs (other than parking signs and directional signs that indicate accessible pathways or entrance and exit doors), and the order in which parking signs are placed, the color of parking signs, the color of parking lot striping, faded or damaged paint on otherwise compliant parking spaces, and others. The new
law states that the above presumption of limited immunity affects the plaintiff ’s burden or proof and is rebuttable by a preponderance of the evidence showing that the plaintiff did experience difficulty, discomfort, or embarrassment of the particular occasion as a result of one or more of the technical violations. The bill also protects certain businesses in certain conditions from paying minimum statutory damages for construction-related accessibility claims made during the 120-day period after a CASp has inspected the business. SB 814 (Hill) Water Conservation: The bill prohibits excessive water use during periods of drought emergencies by metered residential customers in single family homes and multi-family properties where each unit is individually metered or submetered “by the urban retail water supplier.” Our amendments assure that penalties will not apply to multi-family properties where each unit is not separately metered or where each unit is submetered and the owner bills water to the tenant. It also requires water suppliers to implement ways to discourage excessive water use, including rate hikes, block tiers, water budgets, and rate surcharges.

ment and Housing (DFEH), is proposing broad new regulations requiring rental property owners to allow tenants to have “emotional support animals” (ESA) of all breeds and types to live with them in their units. An ESA is an animal that provides emotional support to persons with disabilities who have a disability-related need for such support. Although federal regulations already proscribe rules requiring owners to make reasonable accommodations to allow tenants to have ESAs living with them, DFEH’s proposal is concerning because of how broad the right to have an ESA is under the proposal, and the limited to non-existent authority owners have to deny a support animal request when the animal poses a threat to health and safety of other tenants, and to the property. Our lobbying team has been involved with the ongoing discussions on the state level, and will keep the association updated on its progress. Occupancy Limits: DFEH is also proposing new occupancy limits and standards. Occupancy limits the maximum number of tenants per unit an owner can establish. Currently, the occupancy limits are based on what is “reasonable.” Unofficially, reasonable occupancy limits in California is two persons per bedroom plus one additional tenant. The proposed new occupancy standards, however, would require owners to allow up to 15 people in a three-bedroom apartment. Apartments and neighborhoods are simply

iam the manager of a ten-unit building. Recently, some of the residents have been complaining about a foul and mysterious odor coming out of one of the units. No one has seen or heard from the tenant in weeks. Other residents told me that there’s a cat on the premises, but I don’t see any way for it to be able to get out. Finally, the resident below the unit has noticed some water staining in their ceiling. I’m afraid there may be a leak in the bathroom above. Can I take a look
inside the apartment to make sure everything is all right?
Yes. Civil Code 1954 allows an Owner or their agent to enter a dwelling unit upon reasonable notice, or immediately in case of an emergency. Specifically, in cases where you possess a “reasonable belief ” that an emergency exists, you may enter the dwelling unit without notice to the tenant. A water leak is such an emergency that if left unchecked
for twenty-four hours, would cause substantial damage to the building. In the absence of an emergency, you must post a Notice to Enter Dwelling Unit, twenty-four hours is deemed reasonable notice, but circumstances may allow for shorter notice. Based upon the circumstances you describe, a call to the local police authorities requesting that they accompany you may be wise.

Q&A — continued from 14 My building has been on the market for a while, waiting for a buyer. I received an offer and we opened escrow a couple of weeks ago. The buyer is doing his due diligence and is going through the books records. A couple of issues arose. First, the buyer’s inspection company is doing inspections of the units. My manager served written notices to all, and provided well over the required twenty-four hour notice of the upcoming inspection, most got at least three days prior notice. Well, one of my residents, a long termer, just sent me a letter warning me that if anyone enters “his” apartment he will sue everyone. Says he used to go to law school, that he knows his rights, says I can’t go in. Needless to say, this was unexpected. I have the inspectors and appraisers and the buyer scheduled to visit at the same time. The buyer is very hands on, and says he must personally inspect each unit. If he doesn’t let me in, it may jeopardize the sale, what do I do?
Your resident should have spent more time in school; he’s a bit confused. California law provides that residents must allow access to and entry for appraisers and prospective purchasers, among others, upon service of at least twenty-four hours’ notice. His failure to allow access violates California law and is a breach of your rental agreement. Your resident may need a little “prompting.” Prepare a Three-Day Notice To Perform Condition or Covenant direct-
ing him to comply with California law and the terms of your agreement by allowing access to the apartment at the already noticed date and time. Additionally, provided his tenancy is a periodic tenancy, and your property is not subject to rent control, a notice of termination of tenancy can be a great motivator. Prepare a Notice of Termination, and instruct your manager to serve it at the same time as the Notice to Perform or Quit. Let the resident know that provided he allows access as scheduled, you will rescind the notice of termination. But if he doesn’t, he should start packing. Given the alternatives, compliance almost always occurs. In the unlikely event he continues in his refusal, you have several options. Typically escrow instructions will preclude your evicting a tenant without the buyer’s consent once escrow is opened, check your escrow instructions to see if this applies. Most buyers would have no problem and will consent to his removal. The buyer and lender can be appeased by agreeing to a hold back in escrow of sufficient money to make any needed repairs to the unit, and or to cover eviction costs. Escrow instructions can be amended to allow for reimbursement for repairs, and costs, or a return of the retained money to you. I am currently in the middle of an eviction for a non-paying residential tenant. Usual thing, tenant didn’t pay rent, I served a
three day to pay or quit, he didn’t, I filed an eviction, he answered; trial is set for next week. Now he tells me that he filed bankruptcy over a month ago, before I filed the eviction, and that I have to start all over. Do I?
Not necessarily. Your state court eviction will be stayed (temporarily halted) until you get permission to proceed from the Federal Bankruptcy court. If you were not aware of the Bankruptcy filing when you served the three-day notice, and your eviction was filed in good faith, then you may petition the Bankruptcy court to annul the automatic stay, or in the alternative to grant relief from the automatic stay retroactive to the date of filing of the Bankruptcy. Most federal Bankruptcy judges will grant this relief if properly requested, allowing you to step right back into where you left off in your state court action. I encourage my tenants to pay rent by electronic funds transfer. I use the apartment association’s lease, which states “If Resident fails to pay the rent in full by the end of the 3rd day after it is due, Resident shall pay a late charge of $100.00 as additional rent…” One tenant seems to initiate the EFT later than the 1st day of the month, but I can’t be certain of what day it is, and if that day is a week-end or holiday, I see no sign of her payment in my bank until the following bank business day. Q&A — continued from 16 day of the month. Is her rent late? When is rent legally considered paid? If my tenant gives me a check on the 3rd day of the month, and that day is a Saturday and I deposit it that day, I can see a pending transaction immediately, but the funds are not available to use until the next bank business day. With a check, I know when the transaction is initiated and completed. With an EFT, I only know when the transaction is completed.
When rent is paid by ETF, it is considered received by you when it is credited to your account. It is immaterial when the tenant initiated the transfer, the date which the funds actually are credited to your account is controlling. In the case of a check or draft delivered to you, it is the date which you actually receive the actual check or draft. You have control over the funds/payment instrument upon deposit of funds or receipt of the actual check. Of course, the specific
terms of your lease control. Most leases require that the resident ‘deliver’ the rent to you on or before the first. This eliminates the old ‘check is in the mail’ excuse. However, some ‘creative’ landlords insist on writing their own ‘special’ terms on their leases, and if those special terms require the tenant to ‘mail the check to a PO Box’ or put it in a ‘drop box,’ then these terms may alter the date of payment, and in some cases, may shift the risk of loss in the mail to you the landlord rather than the resident. Additionally, if the account number provided for the resident to make his ETF to is incorrect and the delay is caused by the landlord’s incorrect instructions, then the resident will be provided additional time. For these and many other reasons, it is very important not to alter the language provided to you in your apartment association forms; they typically anticipate these types of situations.

FEDERAL FOCUS — THE NAA CONNECTION
Outlook Remains Mixed for the Apartment Industry
A
dd my name to the long list of individuals who did not take the candidacy of Donald Trump seriously and publically doubted whether could win a Presidential general election. My sin is even greater since I am inside the beltway and in “the business” of politics and policy. This is my job! How could I have not seen this coming? I could lay the blame for missing the signs of a Trump victory at the feet of pollsters and pundits on whom I rely to give me the best data and intelligence on the minds of the electorate, but that would be a cop out. Realistically, I think my bias against someone like Donald Trump was in place long before he became a threat. I, like so many in the machine of Washington, D.C., am disconnected from the working class voter in places like Pennsylvania,

Wisconsin and Ohio who gave President-elect Trump the White House. While my life and the lives of most of those with whom I am close have hummed along in the present economy, millions of others have watched their jobs disappear with little perceived care or concern from the political system and more precisely the two political parties. Their anger crossed party identification and found a home with Mr. Trump. Okay, so an epic fail on the part of people who should know better. Stipulated. What happens next? What can we expect from a Trump White House? And GOP majorities in both Houses of Congress? With hindsight now available to us, I think managing expectations is important here. Mr. Trump promised a lot of things on the campaign trail — the wall, mass

deportations, a blockade against Muslims (or some nuanced variation of that), special prosecutor for Hillary Clinton, large-scale tax reform and shredded trade agreements. In the first week of his pre-administration, Mr. Trump has already softened his rhetoric on several of these items. The wall may turn out to be a fence or simply stronger bordersecurity measures, “mass” deportations will be focused on criminals (something the Obama Administration does now) and continued pursuit of the Clinton email scandal is fading from the priority list. Certainly many in the body politic will be pleased if these moderations hold; however, others in the Trump coalition will not be happy. Time will tell if he sticks to his new Federal Focus — continued on page 22

moves by the President-elect to pull back on regulations issued by the Obama team will likely address several areas of concern such as Waters of the United States, the overtime rule and IRS rules on valuation of family-owned businesses. Bigger-picture issues such as the future of Fannie Mae and Freddie Mac, some areas of tax law and immigration reform have the potential to cut both ways for owners and operators of apartment homes. Thus, it is critically important that everyone get involved in NAA’s Advocacy365 program and commit to carrying the message of the apartment industry to their representatives in Congress. Advocacy365, as the name implies, is a year-round effort; however, there is one particular day when the industry combines forces in Washington, D.C. to show our strength and press the case for our concerns. The 2017 NAA Capitol Conference and Lobby Day takes place on March 7 and 8 at the JW Marriott in downtown Washington. There will be a

What else happens in a Trump first term will also be heavily influenced by the Congress, of course. And also contrary to expectations, the GOP held its control of the Senate and took only glancing blows to its majority in the House. We have one-party, Republican rule for the first time since 2006. While the control of the levers of power is not absolute (recall the cloture rule in the Senate), it is strong enough that we can expect a more streamlined path to passage for some legislative priorities — Obamacare repeal and regulatory reform, among others. For others, the path remains difficult but is more doable than was anticipated under a Clinton Administration — see tax reform. For our part, the outlook remains mixed for the apartment industry. Regulatory reform and independent
briefing on the issues, training on how to be an effective advocate and expert perspective on the new Administration from Presidential historian Doris Kearns Goodwin. There are more than 50 new Representatives and Senators who need educating on our industry and our issues and 485 incumbents returning for a new Congress and Administration who want to know where we stand. Please join us. This is an historic time for our country and we should take stock of that. There is also the reality of public policy concerns that must be our focus in the immediate term. I have a bathroom sink that is slow draining. I have already snaked the drain and found no stoppage. When I remove the pop-up assembly and have an open drain, water whooshes down with no problem. However, with the pop-up in place, water backs up into the sink and drains very slowly. Paul
Dear Paul:
Most bathroom sinks have an overflow hole near the top edge of the sink. This hole serves two purposes; 1: Acts as a safety drain to keep the sink from overflowing should the water rise above a certain level in the sink. 2: The overflow hole also serves as an air vent for the sink when the water levels are above the pop-up plug. The overflow hole allows air to escape through the drain and the water to evacuate more efficiently. What has happened is hair, toothpaste, grime etc. have built-up and sealed off the overflow drain where it exits just
below the pop-up assembly plug. Most snakes are too big to go through the overflow drain. Alternatively, a speedometer cable will work great or even a long zip tie will work. Push the cable or zip tie down through the overflow hole at the top of the sink and push any gunk out into the drain. Use water to help push the debris out the overflow drain, a funnel works great to direct a good flow of water. If you cannot get the overflow to drain, disassemble the main drain assembly to gain access to the overflow drain exit. Once the overflow drain has good airflow, the sink should drain a bit faster. If this does not solve the problem completely, look at restricting the water flow coming out of the faucet. Use a restrictive aerator to cut down on the GPM of the faucet.
Dear Maintenance Men:
My property has 100-gallon gas fired water heating that serves four units. It is about 8 years old. The tenants are complaining of very little hot water. I
have checked the tank and the thermostat is working, the water is hot. Are my residents making up stories? What am I missing? Thorne
Dear Thorne:
The water heater may need a bit of maintenance. The first thing to do is clean out the sediment at the bottom of the tank. This will require a shutdown of the heater for a couple of hours and some hands and knees work. Most 100-gallon gas water heaters have a clean-out port at the front of the tank. The port is either round or oval. Be sure to get a new clean-out port gasket before starting this job. Once the water is drained and the port opened, remove all the sediment from the tank. You can expect to haul out one to two buckets of calcium buildup. (Sediment removal should be done once a year.) Removing the sediment will greatly improve the heating efficiency the water heater. Because of the age of the tank; while you have the port open, check the inlet

dip tube and the anode rod inside the tank. If the anode rod is corroded, replace it by pulling it out from the top of the tank and inserting a new one. The anode rod is a sacrificial zinc rod that helps keep the tank from corroding. The second item to check is the cold-water inlet dip tube. Cold water entering the heater is routed to the bottom of the tank by the dip tube. If the tube is corroded, broken or missing, the tank will develop hot and cold areas, leading to complaints about short-term hot water. The dip tube is located inside the cold-water inlet pipe. Replacements for both the anode rod and dip tube can be found at most plumbing supply houses.

How do I remove candle wax or gum from my rental unit’s carpet? Janet
Dear Janet:
The best way to remove candle wax from a carpet is to use a hand held clothes iron. Put an absorbent paper towel over the wax and heat the area with a hot iron. The paper towel will absorb the wax as it melts. Be careful not to burn the carpet as an iron can melt certain carpet fibers and scorch others. Start on the lowest setting. Remove any left over stain by blotting the area with a small amount of drycleaning solvent. (Dry-cleaning brand names to look for: Guardsman Dry Cleaning fluid, Woolite Dry Cleaning Secret, Dryel or any dry fabric cleaner and in a pinch; lighter fluid.) Also, blotting with a mild detergent mixed with warm water may work. Make sure the detergent does not contain any alkaline or bleaches. Remove gum by either freezing the gum and removing it by pieces or using peanut butter to loosen the gum’s grip on the carpet. A product known as “Goo-Gone”, found at Home Depot, may be used to remove gum, tar, grease and glue. Use Goo-Gone sparingly, do not soak.

Signs Your Property Has a Pest Problem
T
here’s nothing worse than finding out that your rental has been infested with pests. From rodents to insects, knowing what steps to take to exterminate the infestation and prevent future outbreaks is a vital aspect of being a landlord. As some infestations are natural and some are caused by tenants, it’s important to understand where your responsibility lies with pest control, and know the warning signs of common pests.
Warning Signs
Unfortunately there isn’t one universal sign that shows that your property is infested with household pests. While you might discover rats through droppings and chewed up wires, you won’t discover cockroaches the same way. To identify which pest your property is infested with, you’re going to have to read up on the few warning signs common household pests have.

• Rodents When it comes to rodents, you can usually discover them near your property’s kitchen. Whether you can see it has torn into bags or boxes, or has taken nibbles out of exposed food, this is one of the easiest ways you can find out your rental has rats or mice. Keep a look out for potential nests. This can be in piles of newspapers, in couches and carpet, and in holes in the walls. Any nook and cranny can develop into a nest, so be sure to check behind your appliances as well. Finally, if the problem is significant, you should be able to tell if you’re infested if you see droppings or smell urine. • Squirrels As squirrels are much bigger than most rodents, you should be able to tell right away if you’re infested. Scratching sounds in the walls are

common. Check your attic or foundation. Squirrels are infamous for chewing through electrical wires, so you’re going to want to remove these pests as soon as possible. • Cockroaches First things first, if you see a cockroach in your property, then you’re probably infested. As roaches are nocturnal bugs, you’ll most likely discover them at night or in dark areas. You can also discover them by finding their droppings or eggs (which come in light-brown, cylindrical egg cases). Finally, just like with rodents, if you smell something musty then you’re going to need to investigate more. • Termites While termites are a direct threat to your rental property, they can go undetectable for a long time. As the pests eat and burrow through
wood, you can find them in your rental’s walls, floors, and foundation. They often enter into many homes through cracked or unsealed foundations. • Carpenter Ants While a few ants are relatively normal in a home, carpenter ants are another story. Just like termites, they burrow and chew through wet, rotted wood and can cause serious damages to your property. If you’re close enough to the hive, then you might even be able to hear them, but in many cases you’ll only discover them if you see them or the damage they’ve inflicted. Depending on your geographical location and climate, some pests might even be more prevalent in your rental’s particular area. For example, locations with high humidity are more susceptible to bedbugs than dry, desert climates. Additionally, certain areas on your
property might be more vulnerable to pest infestations, so regularly check your foundations, attics, and any other areas that might be moist and dark.
Whose responsibility is it?
While in some cases, infestations are drawn to your rental because the tenant insufficiently kept clean conditions, pests from the surrounding area should be expected. For example, if your property is in a remote area next to tall grass, it’s very likely you’ll attract rodents. Getting rid of (and warding off) these natural pests is your responsibility. For pests that are drawn to dirty conditions caused by the tenant, then the tenant might be financially responsible for eradicating them. That being said, as the landlord, you want to protect your property from significant damages and you might not want to leave the pest control to tenants who attracted the infestation in the first place. Ultimately, you’re going to need
to review your state and local pest control laws, and write out pest responsibility in your lease agreement. No landlord wants their property to have a pest problem. By knowing the warning signs, you prevent significant damages from occurring and further protect your property and tenants. When dealing with pest control, contact a professional and review your state’s pest control notice requirements. In California, landlords must notify the tenants 24 hours before applying any pesticides (even over-the-counter ones). Preparing for What’s Ahead

early every apartment owner that I talk to agrees that interest rates are going to rise at some point in time. Yet, unless they have a variable rate loan, which is a rarity in today’s world, or they are in the market to buy, those same owners do not foresee
any consequences to their own portfolio. So what is there to lose? Just talk with the people who purchased properties in 2006 to 2008. Many are only now seeing values return to what they paid. In terms of actual wealth building, their progress has been very, very slow.
For years, I’ve been tracking the markets and the economic news. My understanding of what is happening, along with the realities of the 18-Year Real Estate Cycle, serve as the foundation for one of my Other TOP Myths.
2-6 Prices cannot drop 40% or more within the foreseeable future. Popular Belief: Things are different now. A bubble burst can’t happen today. Bill’s Truth: Don’t be in denial. Prices have dropped dramatically in the past and they can do so again! Interest rate increases, dollar devaluation, bad economic news (both domestic and global) and all sorts of other trigger events can cause a significant decline in real estate values. You need to understand the 18-Year Real Estate Cycle and the important role that interest rates play in determining value. A two or three percent increase in interest rates can lower a property value by 20% to 30% or more. It is better to buy at the right point in the real estate cycle. However, sometimes a particular property may only become available at a given point in time. For example, near the top of the market in 1988, I purchased a property with a 40% down payment. Three years later, when interest rates started to increase, I faced cash flow problems and the property dropped to less than the amount of the loan. Thanks to a bridge loan from a partner and a refinance, the property was saved and is, today, the centerpiece of my portfolio. Whenever you buy, you have to carefully consider what variables are most likely to change within your anticipated hold period and start calculating your potential outcomes so that you can be prepared for what may happen in the future. Cash In: Know where you are in the real estate cycle and use this knowledge to your advantage.

From the viewpoint of most investors, if you are not buying in today’s market, you are fine. But that may or may not be true. What if there is another dramatic downturn and it takes ten more years for the market to cycle back up to the where it is today. You may have in your portfolio a property that is in a location that will never recover. And, that same property may be due for costly repairs. Even when a property is generating a nice cash flow, major repairs can quickly consume any and all profits. More importantly, do you really want to leave the current premium sitting on the table? Perhaps there are one or two properties within your portfolio that you should consider selling now. Rather than simply cashing out, you might check into ways to exchange into a holding that offers more diversification with a lot less work. You can even do a partial exchange and take just a portion of proceeds in cash. Yes, you will have to pay taxes, but only on that part of the capital gains. And, as many of us believe, taxes are only going to go up, not down. Consider, too, how that cash might be used. Perhaps now is the time that your children (or grandchildren) would appreciate some financial help. What about upgrades on one of your longterm hold properties? Or, as I am doing, create your own vulture fund for that time when prices drop to the point where buying in Orange County again makes sense. I personally see a 30% to 50% drop in prices in the near future. Who knows how near a future, but I’m prepared! Are you? The bottom line is, don’t be complacent. hen the looming threat to taxpayers is property tax increases, there is no one better to call, than the President of the Howard Jarvis Taxpayers Association, Jon Coupal. Originally introduced to California in 1978, Proposition 13 severely limited property tax increases and mandated that the maximum amount of any ad valorem tax on real property could not exceed 1% of the full cash value of the property. AAOC’s Legislator of the Year — Senator Richard Roth
T
he Apartment Association of Orange County is proud to recognize Senator Richard Roth as our 2016 Legislator of the Year Award. Through a challenging legislative climate, Senator Roth remains a steady advocate for our cause. During the 2016 legislative cycle, he authored Senate Bill 269, which addresses the many discrepancies in accessibility standards so as to help protect business and property owners from frivolous lawsuits and costly litigation. In recent years, commercial property owners became exposed to a variety of “drive by” lawsuits and through Senator Roth’s efforts, landlords are now protected. Prior to his election to the State Senate, Senator Roth served as an attorney with the National Labor Relations Board in Los Angeles, and later engaged
in the private practice of labor and employment law with Riverside-based firms for over 30 years. In addition to his civilian law practice, Senator Roth also served on active duty and as a Reservist with the U.S. Air Force Judge Advocate General’s Corps, retiring in 2007 in the grade of Major General after 32 years of military service. Among his military awards and decorations, Senator Roth is the recipient of the Air Force Distinguished Service Medal and the Legion of Merit. Senator Roth is chair of the Senate Budget Subcommittee on State Administration and General Government, and he chairs the Senate Insurance Committee. The Senator is also ViceChair of the Joint Legislative Audit Committee and serves as a member of the Joint Committee on Emergency
Management. He is a member of the following Senate policy committees: Budget & Fiscal Review; Health; Transportation and Housing; and Veterans’ Affairs. He also serves on the Little Hoover Commission and the Governor’s Council on California Military Future. Senator Roth represents the 31st Senate District and that includes cities such as: Corona, Moreno Valley, Norco, Eastvale, Jurupa Valley, Riverside and Perris. He and his wife Cindy live in Riverside.

Proposition 64:
The Marijuana Initiative— Employers’ Substance Abuse Policies Won’t Go Up In Smoke
O
ne of the many ballot propositions that faced voters on November 8 was Proposition 64, known as the “Adult Use of Marijuana Act.” If enacted, it would legalize the private recreational use of marijuana by persons 21 years of age or older. It will also make it lawful for each person to grow up to six marijuana plants for personal use. It will tax and regulate the growth and sale of marijuana as well. Proposition 64 was popular in preelection polling, causing many employers to wonder what impact it will have on workplace substance abuse policies if it passed. Fortunately, it appears that at least initially it would have little impact. The language of Proposition 64 is clear. Its intent is to allow public and private employers to enact and enforce policies regarding marijuana. The proposition goes on to state that nothing in its language shall be construed or interpreted to: • Amend, repeal, affect, restrict, or preempt the rights and obligations of public and private employers to maintain a drug and alcohol free workplace, • Require an employer to permit or accommodate the use, consump-

tion, possession, transfer, display, transportation, sale, or growth of marijuana in the workplace, or • Affect the ability of employers to have policies prohibiting the use of marijuana by employees and prospective employees, or prevent employers from complying with state or federal law. In addition, the proposition states that it shall not amend, repeal, affect, restrict, or preempt laws making it unlawful to drive or operate a vehicle while smoking, ingesting or impaired by marijuana. This language makes it clear that if the proposition passed, employers will still be able to enforce drug-free workplace policies, including a prohibition on marijuana. Employers will not be required to “accommodate” marijuana use, medical or otherwise; there is already a California Supreme Court case holding that employers need not accommodate the use of medical marijuana. Employers will also be able to continue drug testing of new hires and of employees upon reasonable suspicion of marijuana use. Employers, such as those in the transportation industry, that are required under Federal law to conduct random drug testing will be

permitted to continue such testing. Workplace substance abuse policies should prohibit employees from using, selling, possessing, or having illegal drugs in their system while at work, versus prohibiting employees from being “under the influence” of illegal drugs. This is because a drug test can confirm whether someone has illegal drugs in their system, while being “under the influence” is a more subjective standard. A person could test positive for drugs under the latter standard yet argue that he was no longer “under the influence.” Given that marijuana remains in a person’s system for up to 30 days after use, the question may arise of whether an employee who engages in legal recreational use of marijuana and fails a drug test weeks later has violated the employer’s drug abuse policy. The language of Proposition 64 suggests an affirmative answer. The proposition upholds the right of an employer to maintain a drug free workplace. Employees having a testable amount of marijuana in their system would not qualify as drug free.
