The Age of Renting?

W

e all know of the acute housing shortage and affordability issue facing OC, California and many areas nationally. For several months I’ve looked at different reasons this problem has evolved and continues to evolve with seemingly no solution in sight. The reasons I pointed out were due to supply shortages that have persisted for many years. This month, I want to take a look at the demand supply of the housing equation At October’s General Membership Meeting, a panel of experts discussed concepts, policies and legislation that could help to solve California’s housing shortage. This was a great meeting, well attended and included audience participation. The concepts and policies presented addressed the supply side of the equation and it’s obvious, that without question, OC and California need more housing. However, this month, I want to take a look at the demand side, which has helped produce strong rental occupancy rates and has pressured rents upward to the point many are yelling for rent control and/or inclusionary zoning laws. Have we seen a fundamental shift from home ownership to renterdom? Home ownership rates and affordability in California are at historic lows. The 2016 home ownership rate for the LA-OC metropolitan area sits at a national low of 47%. San Jose is at 50% (2nd lowest), and San Diego at 53.3% (5th). Why is this? Zillow conducted an analysis earlier

this year that outlined the following reasons or barriers why renters can’t buy a home. The numbers in () indicate the percentage of renters around the U.S. citing barriers to buying a home. 1. Affording the down payment is the #1 reason: (67.9% in US) 72.2% of those surveyed in OC said this was the reason they couldn’t buy a home. Zillow placed the LA/OC median home value at $590,000; which results in a 20% down payment of $118,000. The median income is $64,806. That puts the down payment at 182% of income. Obviously saving funds for a down payment is a huge impediment to buying a house! 2. Qualifying for a mortgage (53.2%) 3. Debt (50%) 4. Job security (38.5%) 5. Not in a position to settle down (20.1%) So how does all of this affect the rental housing market? On the supply side, there’s been an insufficient number of rental housing units built for decades. On the demand side, homeownership rates in California are at historic lows and barriers to buy are at a high. So people wanting to live on their own must rent. It’s simple economics that an undersupply of housing coupled with huge demand squeezes occupancy and rents higher. How long will this continue? It’s probably safe to say that continued

shortages of new housing will be built. On the demand side, 40% of Americans age 18–34 (excluding college students) are still living with their parents or relatives. This is the highest percentage since around 1940. They very much want to be homeowners, but their financial circumstances are preventing them from living on their own or buying. This demographic is the largest group of potential homeowners in the U.S. Can you imagine if they all could and decided to move out at once? There would be a huge rush of demand without a lot of supply and prices would really spike. And how would this impact our occupancy levels and rents? This issue is the hot issue currently in this state. With prevailing attitudes and politics in Sacramento and locally, along with the cost to build new housing, it’s hard to imagine that this won’t be a big problem with far-reaching ramifications for a very long time. ecember means it is time for the annual interview with myself.

Thank you for your time again, it seems the year has flown by. I am always happy to spend time with you people, unlike that fake news organization across the street. In all, I’d say It’s been a good year for the Association and our industry in Orange County… rents are up, rates are down, and they’re not moving the ocean. That said, it has not been without its challenges. First question: Year in review. What are you most proud of? As I have said it is always difficult to identify a single item, I will say I am very proud to have overseen the reconstitution of our Product and Service Council Committee. They are an integral part of so much of what we do here at the Apartment Association. Under the Chairmanship and leadership of Board Member Frankie Alvarez, who’s column “Dear Maintenance Men” appears monthly in the magazine you are currently holding, the committee has developed networks and programs that benefit both rental properties owners and rental property service suppliers. It certainly has been a positive feedback channel for us and a win-win for our members. Any failures, we know this is a tough one for you? Only one: Keeping government at bay.

California housing law continues to increase cost of additional housing and subsequently, that ol’ supply and demand curve affects rents and affordability. In the end, Sacramento creates bad public policy and it’s the landlord who catches the heat. We need to do a better job of educating policy makers on basic economics and common sense. Where is our industry going in 2018? My crystal ball sees a continuingly competitive industry in 2018. I grow concerned when I hear owners worrying more about government regulation than the private operations of their own buildings and businesses. If it’s been a while, re-take them. Come to our social events and meet other members and owners: they are a gold mine of helpful information. I can say that with certainty because I am one! What’s new in AAOC programs and events for 2018? The Apartment Association General Membership Meeting has a new home. They will be held at the Great Wolf Lodge in Garden Grove. Truly a beautiful property and one I believe members will enjoy. Our signature education programs: the 11-week Certified Rental Housing Provider (CRHP) Program will be offered twice in 2018. This year’s Industry trade show and education

seminars will include the spectacular Apartment All Stars. And the aforementioned Product Service Council Committee has some very fun social events planned as well. The Reverse Trade Show was again a sell out in 2017 and continues to grow. These trends tell me we are reaching our goal of providing programs and services to our target audience, truly a good thing. SACRAMENTO REPORT

New Laws

L

ast month we quoted the text of one significant new bill affecting required tenant notices regarding properties located in special flood zones. That was just one of the 135 rental property-related bills our lobbying team identified and tracked out of several hundred bills that were introduced in the California Legislature this year. Among the tracked bills, 60 were considered “top priority” bills because of their potential to immediately impact the residential rental property industry in a significant way. Several top priority bills were among the 859 signed into law, but not before they were amended to address many of our rental property concerns. This month and next, we review residential rental housing related bills that were signed into law in 2017, most of which will go into effect January 1, 2018 (unless otherwise noted).

New Housing Development: Process, Policy, Finance, Oversight & Construction

AB 72 (Santiago) State Oversight Over Local Housing Element. Each local government housing element provides an analysis of a community’s housing needs for all income levels, and strategies to respond to provide for those housing needs. It is a key part of a city’s overall General Plan. This bill gives the state Department of Housing and Community Development (HCD) oversight and enforcement authority over local housing element findings and decisions to determine whether

cities and counties are in compliance. If violations are discovered, HCD is authorized to notify the Attorney General for prosecution. The purpose of the bill is to ensure local governments comply with their housing elements, and promote the continued growth of housing development. AB 199 (Chu) Prevailing Wage Exemption for Private Residential Development. Prior law required private residential projects built on private property to comply with public works laws and regulations, including the payment of prevailing wages, only if the projects were paid for in whole or in part out of public funds, and pursuant to an agreement with a (now dissolved) redevelopment agency. This bill merely updates that law, requiring private residential projects to comply with public works laws and regulations if they are built pursuant to an agreement with a successor agency to a redevelopment agency. AB 678 (Bocanegra) Changes to the Housing Accountability Act (HAA). The purpose of the HAA, also known as the “Anti-NIMBY Act,” adopted in 1982, is to limit the ability of local agencies to reject or stall housing developments. The HAA helps to ensure that municipalities do not unfairly hinder the development of new housing projects, and ensures housing construction continues during housing shortages like the one California faces today. The current enforcement mechanisms of the HAA, however, are inadequate to

achieve compliance in many cases. This explains why the HAA was rarely used or of interest to the public. According to the author: “[o]ne of the most significant barriers to the construction of new housing is unjustified local resistance from NIMBY (Not in My Backyard) groups. In a recent report, the Legislative Analyst’s Office confirmed that new housing construction faces community opposition, ‘because it often is perceived as bringing negative changes to a community’s quality or character.’ Using these types of unreasonable arguments, ‘no growth advocates’ and NIMBYs have significantly curtailed housing construction, which significantly worsens the jobshousing imbalance in our communities, in contravention to state law.” This bill makes a number of changes to address the problem, including increasing the burden of proof necessary to reject a development project, increasing fines against local agencies acting in bad faith, and eliminating the ability of a local agency to disapprove or condition approval of a project based on a change in zoning or general plan occurring subsequent to completed application. It makes other substantive changes to HAA, all of which will serve to help remove barriers to housing development. AB 1505 (Bloom) Inclusionary Housing. After many failed attempts, inclusionary housing is now law. Local governments may now require as a condition of development that a certain


percentage of new units (in San Francisco the percentage is as high as 33%) be price controlled at below market rates for fifty years or more. The bill represents a carve out from the otherwise intact Costa Hawkins Act which continues to prohibit cities and counties from implementing rent control mandates on new housing projects and developments. AB 1568 (Bloom) Enhanced infrastructure financing for affordable housing. The new law establishes the Neighborhood Infill and Transit Improvements (NIFTI) Act in the Enhanced Infrastructure Financing District (EIFD) law and allows EIFDs to receive sales and use transaction and use taxes to be used for affordable housing purposes if a local government decides to allocate the revenues to the EIFD. The revenues would be used to fund an area that is an infill site, and requires the 20% of the funds to be used for affordable housing purposes. Only an EIFD that is coterminous with

a city or county that formed the EIFD can use taxes in this manner. NIFTI provides local jurisdictions with the authority to finance infrastructure and low and very low income for rent or purchase affordable housing using new sales and use taxes in addition to property tax increment. Price restrictions on rental housing shall remain in effect for no less than 55 years and 45 years for owner-occupied units. SB 2 (Atkins) $75 Fee on Real Estate Recordings For Affordable Housing Fund. Establishes the Building Homes and Jobs Trust Fund (the Trust Fund) within the State Treasury. Imposes, beginning January 1, 2018, a $75 fee on every real estate instrument, paper, or notice, that is required or permitted by law per each single transaction per parcel of real property, excluding real estate instruments, papers, or notices recorded in connection with a transfer subject to a documentary transfer tax or with a transfer of real property that is a residential dwelling to an owner-

occupier. The fee imposed may not exceed $225. Experts estimate that the new recording fee will raise approximately $250 million a year. Half of all proceeds in 2018 will support homeless programs. Beginning in 2019, 70% of all proceeds will be used by local government housing programs. Competition for the available proceeds will be fierce. The bill defines real estate instrument, paper, or notice as a document relating to real property, including but not limited to the following: deed, grant deed, trustee’s deed, deed of trust, conveyance, quit claim deed, fictitious deed of trust, assignment of deed of trust, request for notice of default, abstract of judgment, subordination agreement, declaration of homestead, abandonment of homestead, notice of default, release or discharge, easement, notice of trustee sale, notice of completion, UCC financing statement, mechanic’s Smock/Kingston — continued on page 10

Projects reviewed ministerially require only an administrative review designed to ensure they are consistent with existing general plan and zoning rules, as well as meet standards for building quality, health, and safety. Most large housing projects are not allowed ministerial review. Instead, these projects are vetted through both public hearings and administrative review. Most housing projects that require discretionary review and approval are subject to California Environmental Quality Act review, while projects permitted ministerially generally are not. This bill creates a streamlined approval process for infill projects with two or more residential units in localities that have failed to produce sufficient housing to meet their regional housing needs (RHNA) numbers. The streamlined approval process requires some level of affordable housing to be included in the housing development. To receive the streamlined process for

housing developments, the developer must demonstrate that the development meets a number of requirements including the payment of prevailing wage. Localities must provide written documentation to the developer if there is a failure to meet the specifications for streamlined approval, within specified periods of time. If the locality does not meet those deadlines, the development shall be deemed to satisfy the requirements for streamlined approval.

ADU and Efficiency Unit Laws

AB 352 (Santiago) Efficiency Unit Protection & Expansion. In an effort to expand the development of efficiency or micro units as a measure to address the State’s housing shortage, this bill prohibits cities and counties from enforcing unnecessary and burdensome restrictions on such development. The bill prohibits local governments from limiting the number of efficiency units within one-half mile of public transit, within one mile of a

University of California or California State University campus, or within one block of a car-sharing vehicle. AB 494 (Bloom) Changes to ADU Review Process & Standards. Accessory Dwelling Units, or ADUs, are additional living quarters on singlefamily lots that are independent of the primary dwelling unit. Previously known as accessory apartments, accessory dwellings, mother-in-law units, or granny flats, ADUs are either attached or detached to the primary dwelling unit, and provide complete independent living facilities for one or more person. ADU laws were revamped and updated in 2016 to ease some of the local barriers to development of ADUs. AB 494 makes a few necessary changes to the 2016 ADU law to help clarify the law and help local government implement the new laws without significant burdens. Changes include the following: a) An ADU may be rented separate from the primary residence, but may not be sold or otherwise conveyed

from the primary residence. b) Parking requirements for ADUs may not exceed one parking space per unit or per bedroom, whichever is less. c) Removes the option for local agencies to prohibit offstreet parking in setback areas or through tandem parking where that parking is not allowed anywhere else in the jurisdiction. d) Allows a local agency to require replacement parking spaces in any configuration on the same lot as the ADU when a garage, carport, or covered parking structure is converted to an ADU. e) Defines “tandem parking” as two or more automobiles that are parked on a driveway or in any other location on a lot, lined up behind one another. Smock/Kingston — continued from 11 f) Provides that no setback shall be required for an existing garage that is converted to a portion of an ADU. The purpose of this and other ADU laws are to help address California’s housing shortage, and make it easier to develop and rent ADUs. SB 229 (Wieckowski) ADU Laws. According to the author, SB 1069 (Wieckowski, 2016) significantly eased the barriers to the construction of ADUs. As a result, local agencies now ministerially review an ADU application within 120 days, can automatically approve applications to convert existing spaces to ADUs, provide exemptions for parking requirements, charge proportionate or no connection fees or capacity charges, and provide exemptions for fire sprinkler requirements. The language in SB 1069, however, caused confusion around some of its most significant provisions.

This bill clarifies that an ADU may be rented separate from the primary residence, but shall not be sold or otherwise conveyed separately from the primary residence. This bill also includes special districts and water corporations in provisions regarding fees to ensure that no charges for connection fees or capacity charges occur when an existing structure is converted into an ADU. This bill also more clearly defines tandem parking, clarifies that an ADU may reside on a lot with a proposed or existing single-family dwelling, and permits HCD to review and comment on ADU ordinances.

Immigration & Citizenship Policy

AB 291 (Chiu) Property Owner Penalties For Disclosing Tenant Immigration Information. The bill enacts the Immigrant Tenant Protection Act of 2017, which establishes various forms of punishment and penalties against property owners for disclosing or threatening to disclose immigration

or citizenship information of prospective tenants, tenants, and those known to be associated with them. It also prohibits disclosing immigration and citizenship status for the purpose of harassing, intimidating, retaliating against, or influencing a tenant or prospective tenant. Thus, it clarifies the state law on retaliatory eviction and harassment. Penalties include 12 times the rent, injunctive relief, and notification to the district attorney for prosecution for extortion. The new law also allows non-profit organizations to have standing to sue property owners to enforce tenant rights with respect to these new immigration information rights, and allows for attorney’s fees and costs. AB 299 (Calderon) Statewide Ban on Compelling Owners to Collect & Report Tenant Immigration Info. The bill, which our association co-sponsored and supported, bars all Smock/Kingston — continued on page 14

Smock/Kingston — continued from 12 state and local public entities from compelling rental property owners and managers to compile, disclose, report, provide any information, or to otherwise take any action, including denying accommodations, based on the immigration or citizenship status of a tenant or prospective tenant. Previously, only cities and counties were barred from compelling owners to divulge and collect tenant immigration information. Owners continue to be prohibited from collecting and reporting such information on their own. The purpose of the bill is to protect tenants from discrimination, and to protect owners from being forced to discriminate against their tenants. Rental property owners will continue to be authorized to request information or documentation necessary to determine or verify the financial qualifications of a prospective tenant and to determine or verify the identity of a prospective tenant.

AB 1690 (Judiciary) Immigration Status Deemed Irrelevant to Issue of Liability. This bill establishes that for the purposes of enforcing state labor, employment, civil rights, consumer protection, and housing laws, a person’s immigration status is irrelevant to the issue of liability in a civil suit, and that no inquiry shall be permitted into a person’s immigration status, unless it is necessary in order to comply with federal immigration law.

Service of Process

AB 1093 (Chen) Service of Process. The bill allows service of process on the first delivery when the only known address is a private mailbox obtained through a commercial mail-receiving agency.

Safety & Disclosure Laws

SB 442 (Newman) Pool and Spa Safety Feature Requirements. This bill requires newly constructed or remodeled swimming pools at private single-

family residences (including single family homes that are rented) to incorporate at least two of seven specified drowning-prevention safety features. It also requires home inspections conducted as part of the transfer of a property with a pool to include an assessment of whether the pool is equipped with adequate safety features. The safety features are: a) an enclosure separating home access points from the pool and meeting specific requirements with respect to height, gaps, latches, and any features that could serve as handholds or footholds, b) a removable mesh fence meeting specific standards set by the American Society for Testing and Materials (ASTM), and equipped with a self-closing, self-latching gate that can accommodate a lock, c) a pool cover meeting specific ASTM standards, d) exit alarms on all doors that provide access from the home to the pool, e) self-closing, self-latching Smock/Kingston — continued on page 16

Smock/Kingston — continued from 14 devices, with release mechanisms placed no lower than 54 inches above the floor, on all doors that provide access from the home to the pool, f) a pool alarm designed to sound in the event of an unauthorized entrance into the water and independently certified as meeting specific ASTM standards, g) another feature providing as much or more protection than the above devices and independently verified as meeting ASTM standards. AB 646 (Kalra) Flood Disclosures. Requires rental property owners to make several new disclosures to tenants, including whether the property is located in a flood hazard area if the owner has actual knowledge of such information. Disclosures will be required for every lease or rental agreement beginning July 1, 2018. “Actual knowledge” includes, but is not limited to the following: a) the owner has received written notice from any public agency stating that the property is located in a special flood hazard area or an area of potential flooding, b) the property is located in an area in which the owner’s mortgage holder requires the owner to carry flood insurance, c) the owner currently carries flood insurance. Other mandatory disclosures include the following: 1) that the tenant may obtain information about hazards, including flood hazards, from a specified website maintained by the Office

of Emergency Services, 2) that the tenant should consider purchasing renter’s insurance or flood insurance to insure his or her possessions from loss because the landlord’s insurance does not cover such loss, 3) that the landlord is not required to provide additional information concerning flood hazards to the property and that the information provided by this bill is deemed adequate to inform the tenant. The purpose of the bill is to ensure tenants are aware of any potential threat that the property may flood. According to the author, tenants are oftentimes not aware if a property is prone to flooding or has had a history of flooding prior to signing a rental agreement. Owners are advised to include a sentence in their rental agreement forms that states the owner either does or does not have actual knowledge that the property is in a flood hazard zone. Owners must also include disclosures 1–3 (above) in all rental agreements. AB 1521 (Bloom) Notice of Expiration of Rental Restriction Assistance. Requires owners of expiring affordable rental properties to accept any market-rate purchase offer from a qualified preservation entity that intends to maintain the property’s affordability restrictions. The bill also requires owners of properties in which affordable housing rental restrictions will be expiring after January 1, 2021, to provide notice to prospective tenants at the time they are interviewed for eligibility, and to existing tenants of the

expiring rental restrictions by posting notice in an accessible location of the property.

Employment Law

AB 1008 (McCarty) Criminal History Information In Employment Hiring Decisions. Prohibits an employer of five or more employees from inquiring about or considering a job applicant’s conviction history prior to a conditional offer of employment. The purpose of the bill is to give those with criminal convictions in their past a better chance at landing a job. The new law gives applicants with a criminal record the opportunity to be judged on their qualifications, not their criminal histories. Once a conditional offer has been made, however, there is nothing preventing an employer from conducting a background check and utilizing that information to make hiring decisions. Employers intending to base at least part of their decision to not hire an applicant based on the applicant’s conviction history must make an individualized assessment of whether the applicant’s conviction history has a direct and adverse relationship with the specific duties of the job that justify denying the applicant the position. Factors that must be taken into consider include all of the following: (i) the nature and gravity of the offense or conduct, (ii) the time that has passed since the offense or conduct and comSmock/Kingston — continued on page 18

Employers must also provide written notice to those it intends to deny employment on the basis of their criminal history that identifies the disqualifying conviction, and contains the conviction history report. The notice must also inform the applicant of his or her right to respond to the notice of the employer’s preliminary decision before that decision becomes final and the deadline by which to respond. The explanation must inform the applicant that the response may include submission of evidence challenging the accuracy of the conviction history report that is the basis for rescinding the offer, evidence of rehabilitation or mitigating circumstances, or both. Applicants have five days to respond before an employer may make a final decision. Five additional days are granted if the applicant notifies the employer in writing that the applicant disputes the accuracy of the conviction history report, and is taking specific steps to obtain evidence supporting that assertion. A final decision to deny employment that is at least partly due to an applicant’s conviction history must be noticed in writing to the applicant. The final notice must include any existing procedure to the employer has for the applicant to challenge the decision, and inform the applicant of his or her right to file a complaint with the department. The new law does not apply to a position with the state or local agency, or other employer required by law to conduct a background check, a criminal justice agency, or a farm labor contractor. Rental housing owners must follow these new hiring rules or risk being sued. Owners are advised to assess state law regarding liability and safety of tenants, guests and invitees balanced against the new requirements. AB 1701 (Thurmond) General con-

tractors and subcontractors to be jointly liable for unpaid wages, including fringe benefits. The new law will apply to contract entered into on and after January 1, 2018 to a general contractor for any debt owed to a wage claimant that is incurred by a subcontractor. The Labor Commissioner may enforce the liability against a direct contractor through either a civil action or administrative process for the dispute of unpaid wages. For private works, the civil actions are to be filed within one year of: an owner recording a notice of completion of work of improvement within 15 days of the work being completed, an owner recording a notice of continuous cessation of labor on work of improvement or actual completion of work. The direct contractor may request and the subcontractor shall provide: payroll records which at a minimum contain the information required under existing law for paystubs and information that includes the project name, name and address of the subcontractor, anticipated start date, duration and estimated journeymen and apprentice hours and contact information for its subcontractors on the project. SB 258 (Lara) Cleaning Product Right To Know Act of 2017. This bill creates the Cleaning Product Right To Know Act of 2017, which requires manufacturers of cleaning products to disclose specified chemical ingredients on a product label and on the manufacturers Web site. According to the author, “[c]leaning products are used by millions of Californians every day and contain thousands of chemicals — many of which are toxic and have been associated with cancer, asthma and other respiratory damage, skin allergies, and reproductive, developmental, and hormonal changes. Many are poisonous. This bill requires cleaning product manufactures to disclosure the chemicals used in their products. The disclosure will help inform rental property owners, tenants, and janitorial service employees and/or companies about the

chemicals used in the products that are found or used on the property.

Other Housing-Related Laws

AB 1691 (Judiciary) UD Reporting. The bill removes a law that was deemed unconstitutional 20 years ago. Specifically, Civil Code Section 1785.13(a)(3) prohibits consumer credit reporting agencies from reporting unlawful detainer actions unless the lessor was the prevailing party. Shortly thereafter, a business dedicated to reporting unlawful detainer case outcomes, U.D. Registry, sued the State of California on the grounds that Civil Code Section 1785.13(a)(3) violated the First Amendment to the U.S. Constitution. U.D. Registry prevailed. The California Court of Appeal for the 4th District held that the Legislature could not, consistent with constitutional free speech principles, restrict the ability of credit agencies to report lawfully obtained truthful information contained in court records open to the perusal of everyone. (U.D. Registry Inc. v State of California (1995) 34 Cal. App.4th 107.) The California Supreme Court declined a petition for review of the decision, leaving it standing. Since that time, the statute has been void and unenforceable. Nonetheless, it has never been repealed and remains part of the California Codes. This bill repeals it and removes it from the code. SB 173 (Dodd) Department of Real Estate. The bill removes, as of July 1, 2018, the California Bureau of Real Estate (CalBRE) from the Department of Consumer Affairs (DCA) and instead renames the Bureau the Department of Real Estate (DRE) and places it within the Business, Consumer Services, and Housing Agency (BCSH). The reorganization is a cost saving and efficiency measure. Licensing disclosure requirements will change due to SB 173 becoming law. SB 598 (Hueso) Utility Disconnections. This bill requires the California Public Utilities Commission (CPUC) to adopt rules, policies and regulations


with the goal of reducing the statewide level of gas and electric utility service disconnections for nonpayment by residential customers and extends special considerations to residential customers who have specified medical conditions or who have a member of the household with those conditions. Questions & Answers Help! Seems like everyone wants a pet or two, and they’ll say anything to get one! I had a prospective tenant with two cats apply, when told of our no pet policy she said she’d leave them with her mom and then signed our lease prohibiting pets. Never mentioned any ‘disability’ and she certainly showed no signs of any disability. She moved in, apparently hiding the cats, until we discovered them during an emergency plumbing repair. When confronted, she asked if there was any way she could

keep her ‘pets’. She said she could even get a ‘sappy’ note written for her, that the ‘Fair Housing Act’ required me to allow the cats because she is ‘disabled’ and entitled to a ‘reasonable accommodation’. My manager said he’d consider whatever she wished to provide. Five days passed; no note. My manager followed up, she said she forgot. Seven days later, still nothing. If she truly is disabled and needs help, then sure, I’d certainly consider her request. Jeesh, both my wife and I are in our 70s and would

probably be considered disabled nowadays! We have several tenants, who are disabled and we have allowed pets and such. We then served a three-day notice to perform or quit to remove the pets, she vacated. Did I handle it properly? What is this Fair Housing Act anyway? And what exactly qualifies as a ‘disability’?

Q&A — continued from 20 with a disability to include (i) individuals with a physical or mental impairment that substantially limits one or more major life activities; (ii) individuals who are regarded as having such an impairment; and (iii) individuals with a record of such an impairment. The term “physical or mental impairment” includes, but is not limited to such diseases and conditions as orthopedic, visual, speech and hearing impairments, cerebral palsy, autism, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, Human Immunodeficiency Virus infection, mental retardation, emotional illness, drug addiction (other than addiction caused by current, illegal use of a controlled substance) and alcoholism. The term “substantially limits” suggests that the limitation is “significant” or “to a large degree.” The term “major life activity” means those activities that are of central importance to daily life, such

as seeing, hearing, walking, breathing, performing manual tasks, caring for one’s self, learning, and speaking. A “reasonable accommodation” is a change, exception, or adjustment to a rule, policy, practice, or service that may be necessary for a person with a disability to have an equal opportunity to use and enjoy a dwelling, including public and common use spaces. Since rules, policies, practices, and services may have a different effect on persons with disabilities than on other persons, treating persons with disabilities exactly the same as others will sometimes deny them an equal opportunity to use and enjoy a dwelling. The Act makes it unlawful to refuse to make reasonable accommodations to rules, policies, practices, or services when such accommodations may be necessary to afford persons with disabilities an equal opportunity to use and enjoy a dwelling. To show that a requested accommodation may be necessary, there must be

an identifiable relationship, or nexus, between the requested accommodation and the individual’s disability. A housing provider can deny a request for a reasonable accommodation if the request was not made by or on behalf of a person with a disability or if there is no disability-related need for the accommodation. In addition, a request for a reasonable accommodation may be denied if providing the accommodation is not reasonable — i.e., if it would impose an undue financial and administrative burden on the housing provider or it would fundamentally alter the nature of the provider’s operations. effectively meet the requester’s disability-related needs. In the case that you are involved with, your tenant completed a rental application for the rental. In the application she indicated that she had two ‘cats’ as pets. She made no mention whatsoever of any purported ‘disability’ or ‘handicap’ and any such purported disability or handicap was not apparent. When you advised her of the community’s restrictions on pets, she agreed to leave the cats with her mother and affirmed that she would not bring them onto the Premises. There was no discussion or request regarding any purported disability or any request for accommodation based upon such purported disability. Your tenant then executed a written rental agreement detailing the terms and conditions of her tenancy. The lease expressly prohibited the bringing or maintaining of a pet on the premises without the Lessor’s prior knowledge and express written consent.

Contrary to the express terms of the lease, your tenant brought the two cats onto the Premises without asking for, nor receiving the required written consent. She concealed the cats’ presence on the Premises, never admitting her breach, and never requesting permission. The breach of her lease was discovered by you during an emergency plumbing repair. When confronted with the discovery of her violation, the offending tenant asked if there was any way that “she could keep her pets.” She then stated that she would get someone to “write a sappy note” for her. Your resident manager responded that he would consider whatever information she wished to provide. Five days later, hearing nothing from the tenant, your manager followed up with her asking for the “note.” The tenant said “she forgot to ask for the note” and provided nothing further. Seven days later, hearing nothing further from tenant, your manager again followed up with the tenant, without result.

Although no formal request for a reasonable accommodation was ever requested by your tenant, you properly considered her actions as an implied request for a reasonable accommodation, and you correctly engaged in a review and evaluation of the facts as they were presented to you. To that end, you considered the evidence before you: i) the intentional and knowing breach of the written lease by your tenant; ii) the concealment of the cats in an effort not to be discovered; iii) the lack of diligence by your tenant in producing any credible supporting evidence of her alleged disability; iv) the lack of credible evidence verifying that your tenant was a person with a verifiable disability and such verifiable disability substantially impaired one or more major life activity; v) the lack of any evidence establishing a nexus between any purported disability and the necessity for “two cats” as opposed

Further, you considered your tenant’s statements relative to getting a ‘sappy note’ in evaluating the credibility and genuine need for a disability related accommodation. Your actions show that you recognize the very real need for a disabled person to enjoy the full use of his or her rental premises. The truly disabled individual is deserving of protections and it appears that you recognize and willingly provide such accommodations when needed. Sadly, there are people in this world who abuse and game the system for their personal benefit in their deceitful attempt to exact an advantage and ‘get their way’ by posing as something they are not. Based upon the facts you provided and following the above factual analysis, it would be reasonable for you to conclude that your tenant’s actions were undertaken to ‘game the system’ in an attempt to keep her cats in direct violation of the written rental agreement which she willingly agreed to and signed. It appears that you properly engaged in the requisite dialog with Complainant, followed up repeatedly for promised information which was not provided and evaluated the information that you had available to you.

We have a guesthouse in the back of our home. The place has been there forever. Anyway, after the kids went off to college, we started renting it out. The current tenant signed a lease to pay rent plus their prorated portion of the monthly utilities. We didn’t get a payment this month. I am getting ready to serve a default notice, but I want to make sure I do it correctly. He owes rent and the utilities. Not sure if I can include both on the same notice. How can I recover the utility portion? Also, what if the resident pays the rent, but fails to pay the utilities? The utilities aren’t much, should I just let him run an outstanding balance and either deduct it from his deposit when he leaves or maybe ask for it when it gets a bit higher?

First, the outstanding utilities should be paid timely and can be demanded through the service of a 3-Day Notice to Perform or Quit for Breach of Covenant. This notice should be served concurrently with your three-day notice to pay rent or quit. The Notice to Perform would inform the resident of his default in payment of the utility charges, and would require that the tenant perform by paying the outstanding utility charges within three days. It’s never a good business practice to carry balances over from one month to the next. When the time comes for you to take action, your prior conduct of

accepting late payments without objection could result in the court finding that you ‘waived’ your right to receive payment on time. Such a ‘waiver’ of your rights and remedies may prevent you from enforcing your late fee provision or demanding payments on time. Our studio units have under counter refrigerators. One of the fridges does not cool and I believe it has a Freon leak. Can this fridge be repaired? Is it worth repairing? Will it leak again? Lou Yes the fridge can be repaired, however you may want to consider the 50/50 rule. If the repairs reach fifty percent of the replacement cost, it is best to replace the item. If the appliance is a name brand, most likely the replacement parts are available. Common issues related to non-cooling are compressor failure, refrigeration line breakage or crack due to vibration and thermostat or capacitor. The compressor is the most expensive to repair or replace and will most likely go over the 50/50 rule. A leak in the refrigeration line is the hardest to repair properly and has the most likelihood of repeat failure. The thermostat and capacitors are typically easy fixes.

My resident called and stated the toilet is not flushing properly. I have replaced the flush valve and the flapper valve. The toilet is still slow to flush. What have I over looked? Phillip You might have any number of issues at play. First, make sure the flapper valve is letting through enough water. If it flops down too soon, be sure the toilet flush handle is not loose or that the chain or line connecting to the rubber flapper is tight enough. The chain connecting to the flapper should have about an inch of play. You want the flapper to open wide enough to float a few moments before it falls back down and closes off the flush valve. If the flapper is working properly, check that the holes under the rim are not clogged. If you live in an area with very hard water; calcium may buildup in the drain holes under the bowl rim. clogged rim might not allow enough water through the rim to start the vortex motion and slow the evacuation process. Use a stiff toilet bush and a vinegar solution to help remove the calcium buildup under the rim. Lastly is an item lodged in the toilet trap? The items we find most often are small toys, rags, etc. Use a toilet auger to push your way through the trap and clear or pull back any obstructions. A toilet auger is a special tool that has an offset hand crank, a long sleeve handle and a special auger bit at the end to break through a clog or retrieve an obstruction. The auger bit is connected via a flexible shaft to a crank handle that you control. Its reach is about 3 feet. The auger can be found at any hardware

Also make sure they turn on the water before using the disposer and put down small amounts of food at a time. Instruct your residents to not use the disposer as a trash can and then turn it on when full, it will clog. Christmas and other holidays also mean more people than usual walking on your property. Is your property

safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass or landscape near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter snow, wind or rain. Check

your decking for cracks or damage and inspect the exterior stairways for wear and tear. Inspect all your garage door springs, winter wind and rain may make them heavy causing the door to close or fall unexpectedly. Check all property lighting and timers. Remember: Preventive Maintenance is cheaper than Emergency Maintenance! Maintenance Tip: If you had a leak or water intrusion last rainy season and did not fix it…It will most likely leak again this season. Just because it stopped raining does not mean the leak went away! nly you can decide if claiming Social Security at age 62 or waiting to claim later makes more sense. Lifestyle and philanthropic intentions, marital and employment status, and gender are all factors.

When do you claim?

If you’re in a position to think through your Social Security claiming schedule, do it. It could mean thousands or tens of thousands to your annual retirement income. Here’s your choice: You can start receiving monthly payouts at the qualifying age of 62 like many people. Or you can hold out for a bigger payout down the road. It’s your call — and it could be a game-changer in retirement. Though an immediate need for funds will usually trump other considerations, delaying Social Security for just eight years — until age 70 — could mean up to 30% more from Uncle Sam every month. Some key considerations will likely factor into your claiming strategy:

If 60 is the new 40, then 80 is the new 60. Longer life spans are only part of the story, though. The rest of it plays out every day in 21st century lifestyle

and retirement expectations, not to mention philanthropic intentions or plans to help out the family or grandchildren. hen a tenant dies, knowing how to proceed with the duration of the lease agreement or rental payments, returning or withholding a security deposit, and relocating your tenant’s personal property is crucial to avoiding stress and legal liabilities. Death isn’t a fun topic to talk about — but knowing your rights to regain the rental property is a big part of being a landlord. Plus, it doesn’t hurt to be prepared just in case. Be aware that you will need to

adhere to your state and local laws. Some states, like California, require landlords to follow specific steps to regain a property after a tenant’s death — and these requirements can vary depending on where your property is located. While this article will contain some general principles that apply to developing policies and procedures for managing deceased tenants that lived alone (or were the sole person on the lease agreement), review your state’s laws and talk to your attorney before apply-

Acquiring Rental Payments or Terminating the Lease

When a tenant passes away the responsibility of the lease agreement falls upon the deceased’s estate (which is oftentimes handled by the tenant’s family — such as their spouse, child/ children or parent). Moving forward after a tenant has died depends on the terms of the lease agreement, your state’s laws, and any negotiations made between you and the executor of the tenant’s estate that can be proven using verifiable means (documentation, most likely). Quick Tip: Your lease should have an emergency contact section, in case you discover your tenant has died. If you want extra insurance, add a separate section where your tenants can add the contact information of their executor of their state or ‘next of kin’. • Month-to-Month Generally, the estate is responsible for paying all the rent owed to the land-


lord. Since they’ll be cleaning out the rental property and dealing with the tenant’s possessions, they may choose to negotiate when the lease ends. If you want to end the lease, the official written notice of your tenant’s death can act as a 30-day notice. Quick Tip: Make sure you get an official written notice that the tenant had died from the estate! This might take some time as the tenant’s family processes the death, so be patient and ask politely. • Annual As we said above, the estate is responsible for the lease agreement. This includes all the rental payments until the lease expires. That being said, most estates (or family members) don’t want to pay for an empty rental, and you might want to get new tenants into your property. If this is the case, negotiate with the executor of the estate. This could mean a situation where the executor pays the rent until you’re able to

screen applicants and start renting to new tenants.

Handling the Security Deposit

You should handle the security deposit like you do normally — to cover unpaid rent, property damages, or other costs that were established in your lease. The remaining deposit should be given to the executor of the estate. Unfortunately, if the security deposit doesn’t cover all the damages, you’ll have to work with the executor to cover the cost(s).

Providing Access to your Tenant’s Property

Most states give the landlord the right to secure the property (a.k.a. changing the locks) once you find out about the tenant’s death. If the executor of the lease wishes to enter your rental property, work with them to set up a time to give them access to the deceased tenant’s possessions. If possible, accompany them to the property.

Quick Tip: If you believe there might be disputes surrounding the estate, consider writing down a list of everything removed and keeping track of who accessed the property and when. In this tricky situation, remember that patience and kindness can go a long way when negotiating with the tenant’s family or estate executor. Moving forward, be sure to look up your local laws and give yourself a little personal time. Loosing someone, no matter how close you were, is tough and you deserve a second to grieve as well. October General Membership Meeting Recap

T

he October Membership Meeting was attended by many AAOC members ready to learn more about the housing affordability outlook for 2018 and beyond. An excellent panel of professionals with experience in the industry, Cesar Covarrubias, Executive Director at Kennedy Commission, and Nicholas Dunlap, Senior Vice President of Property Management at Avanath Capital, shared their knowledge and experience. Helping to facilitate the evening was John Seiler, Press Secretary for Senator John Moorlach. The panelists discussed concepts,

policies, and legislation that may help to solve California’s housing shortage. Talks of rent control battles were also part of the discussion. Nicholas Dunlap mentioned that it’s a misconception to think rent control will curtail rising housing costs. Maintenance suffers at rent controlled properties and people don’t keep up their buildings because they don’t see a return on their investment. We will continue to make fighting rent control a legislative priority. More Metrics: More Uses and Abuses (Part Two of a Three-Part Series) from Cash In on the Myths of Real Estate

I

n the previous, October 2017 article that I wrote for Apartment News Magazine, I introduced the topic of metrics. These are the tools that investors use to determine the value (or worth) of a property. As I noted last month, metrics are often unknowingly used and abused. The

last chapter of my book, Cash In on the Myths of Real Estate, is devoted to the opportunities and pitfalls that can occur when applying different types of metrics. Myth 9-3 addresses four of the most often misused metrics — cash-on-cash, capitalization rate, gross rent multiplier, and price per door. Although

each is useful in its own fashion, the biggest drawback with all four of these metrics is that they focus only on one year of operations. The first article covered cash-oncash. Now I want to move onto what is, perhaps, the most misunderstood of these metrics — capitalization rate.

9-3 Cash-on-cash, cap rate, gross rent multiplier, and price per door are the best ways to evaluate income properties. Continuation of Bill’s Truth: 2. C apitalization Rate is what percentage of the price a property returns if the property is owned free and clear. The capitalization rate is a function of net profit determined by the formula:

Capitalization Rate = Net Operating Income (NOI) / Price

The numbers that go into determining the capitalization rate are all derived from a one-year pro forma based upon figures attained at a given point in time. The lower the NOI is in relationship to the price, the lower the capitalization rate. For example, $100,000 NOI with $1,000,000 price equals 10.0% capitalization rate. Lower the net income to $50,000 and the capitalization rate is reduced to a 5.0% cap rate. As a result of how real estate professionals and investors utilize this tool, capitalization rates tend to be clustered into one figure for a given submarket and type of investment property — i.e. fourplexes versus duplexes. In a sense, the metric becomes what I would call the market capitalization rate — i.e. an average of the capitalization rates of recently sold, comparable properties within one given area. Extreme caution must be taken when using a market capitalization rate. Variables such as vacancy factors and expenses can be under-reported and repairs often deferred, all of which can significantly skew the actual value. For example, if a property has a reported net operating income (NOI) of $100,000 and the established capitalization rate for that market area and property type is 5.0%, then the value of the building would be calculated at $2,000,000 ($100,000 divided by 5.0%). Later, if the actual NOI is determined to be $95,000, the value of the building would drop to $1,900,000 and you could have potentially overpaid for your purchase by $100,000. A capitalization rate also can be thought of in terms of risk. The conclusion is that the higher the risk, the higher the desired return and, thus, the higher the capitalization rate. In theory, this approach to the capitalization rate can be expressed as: interest rate plus desired profit plus risk. As a result of this approach, capitalization rates tend to rise and fall in the same direction as interest rates, although not necessarily on a one-to-one ratio.

Capitalization rates are often applied by appraisers to determine how their calculated value of a property compares with similar properties. However, as already discussed, unless extreme caution is taken, those numbers can be easily skewed by under-reported expenses or other factors that might impact the net outcome. Even more critical to the issue is that the capitalization rate still only looks at a value as per one specific, given point in time. Although some say that you cannot predict the future, I am a firm believer that you need to make projections and include those potential outcomes in your analysis process. In the third article of this series, I’m covering the wrap-up to Myth 9-3 which reviews two more metrics, gross rent multiplier and price per door, along with what is, to me, a much better tool to use — IRR or Internal Rate of Return. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. This usually necessitates the apartment owner to go into a non-standard market for a year or more with substantially higher premiums. This is why it is crucial that an inspection is done prior to being quoted by an insurance company. Avoid having a cancelled policy due to the “bugs” being found after the policy is in place.
