Happy Holidays
W
ith a new year rapidly approaching, I’ve been spending quite a bit of time reflecting on my goals as your AAOC President. I’m excited to share a few thoughts on one of AAOC’s priority objectives and a few upcoming supportive opportunities. I am proud of the opportunities our association offers in regard to keeping members aware and engaged in our rapidly evolving and often challenging

business environment. In 2024, AAOC and I are committed to further refining and continuing to improve our delivery of services and benefits to you, our esteemed members. To do this, I’m humbly asking you to help us help you. For instance, after a meeting in early November in Dana Point, I look forward to speaking with our state senators and assembly members this upcoming legislative session regarding commercial liability insurance and the difficulties rental housing providers are having in obtaining and renewing their insurance policies. I am asking you to send me your thoughts, concerns, and personal experiences regarding this necessary but increasingly challenging component of our business. (Note: The items that carriers are focusing on, and the depth and breadth of their on-site inspections, are of particular interest.) Coming to Your Election Ballots in 2024
Y
our vote will count next year, and it may be argued that your vote will make the difference on certain measures directly affecting the rental housing industry. That is, of course, if you care about how much you will be taxed on your income, a repeal of the Costa Hawkins Rental Housing Act, and the need to provide affordable housing. Here are the known measures that will appear on the March 5, 2024 Primary Election ballot, and some of the measures that should be of particular interest to the rental housing industry that will appear on the November 5, 2024 General Election ballot. Each ballot measure will be reviewed and considered by AAOC, as it may: • Affect residential rental housing. • Further the goals and objectives of the rental housing industry. • Necessitate a position of support, oppose or neutral. For the March 5, 2024 Primary Election, two particular measures have been certified for the for the ballot by the Secretary of State. 1. The first measure would create the Behavioral Health Infrastructure Bond Act of 2024, subject to voter approval, and authorize $6.380 billion in general obligation bonds to finance permanent supportive housing for veterans and others, as well as unlock behavioral health treatment and residential settings

for individuals experiencing homelessness or at risk of homelessness with severe behavioral health challenges. It would also streamline ministerial review for projects funded by the bond. It may be argued that this is a pro-housing bond measure affecting homeless individuals. 2. The second measure revises and recasts the Mental Health Services Act as the Behavioral Health Services Act if voters approve amendments. It clarifies that county behavioral health programs are permitted to use the Act funds to treat substance use disorder conditions and restructures current funding buckets, and it improves oversight and accountability of use of the funds that are made available to the program. This is a complementary measure to the above-mentioned bond act. Some would argue that a redirection of state funds is necessary to improve the state approach for housing interventions that could include rental subsidies, operating subsidies, shared housing, and family housing for those that meet specific housing needs criteria. For the November 5, 2024 General Election, here are some of the measures that should be of particular interest to the rental housing industry that have been certified for the for the ballot by the Secretary of State.

1. Description: $18.00 Minimum Wage Initiative (Increases minimum wage to $18.00 an hour) In March 2016, the California State Legislature passed Senate Bill 3 (SB 3) to increase the state’s minimum wage to $15 an hour. Gov. Jerry Brown signed the legislation on April 4, 2016. SB 3 required an annual increase in the minimum wage until the amount reached $15 on January 1, 2022, for employers with 26 workers or more, and January 1, 2023, for employers with 25 workers or less. Thereafter, SB 3 provides that the minimum wage increases based on changes in the U.S. Consumer Price Index (CPI-W). The ballot initiative would increase the state minimum wage to $18 an hour over several years. Like SB 3, the ballot initiative would increase the minimum wage at different speeds depending on whether an employer has 26 or more workers or 25 or fewer workers. For employers with 26 or more workers, the minimum wage would reach $18 on January 1, 2025. For employers with 25 or fewer workers, the minimum wage would reach $18 on January 1, 2026. Also, like SB 3, the minimum wage would be tied to the CPI-W after reaching $18.

amendment on the ballot. That amounts to a minimum of 54 votes in the California State Assembly and 27 votes in the California State Senate, assuming no vacancies. Amendments do not require the governor’s signature to be referred to the ballot. This amendment was introduced as Assembly Constitutional Amendment 1 on December 5, 2022. On September 6, 2023, the state Assembly passed ACA 1 in a vote of 55–12, with 13 absent. On September 14, 2023, the state Senate passed ACA 1 by 29–10.

Employee Civil Action Law and PAGA Repeal Initiative [Repeals the Private Attorneys General Act (PAGA)] The initiative would repeal the Private Attorneys General Act (PAGA) and replace it with a new law—”Fair Pay and Employer Accountability Act.” The law would double statutory and civil penalties for willful violators; require that 100% of monetary penalties, rather than the current 25%, be awarded to harmed employees; and provide resources to employers to ensure labor compliance. The law would require that the Division of Labor Standards Enforcement (DLSE) be a party to all labor complaints filed with the Labor Commissioner. It would not award any attorney’s fees, which are currently awarded under PAGA. It would also require that the state legislature fully funds the DLSE to meet the division’s requirements by law.
4. Pandemic Early Detection and Prevention Institute Initiative (Increases the income tax by .75% for 10 years and creates the California Pandemic Early Detection and Prevention Institute) The initiative would amend the California Constitution and enact a law to increase the income tax by 0.75% for individuals with income over $5 million for 10 years and dedicate revenue to the California Institute for Pandemic Prevention, the Community Pandemic Response Fund, and the School Disease Spread Prevention Fund. The Legislative Analyst’s Office estimated that the state revenues from the tax would range from $500 million to $1.5 billion annually.
Currently, under PAGA, employees have a private right of action to collect civil penalties for violations against the state’s labor code without state intervention on behalf of the employees. Before pursuing a lawsuit under PAGA, an employee must first notify the state of the alleged violation. If the state does not investigate the violation, the employee may proceed with the lawsuit.
The new institute would be established in the constitution and would be tasked with awarding grants related to pandemic prevention initiatives. The initiative provides a wind down provision where after the tax expires in 2032 the institute may continue to operate for another five years. If funds remain after the 15-year period, the institute would be able to continue to operate but would not be authorized to administer grants.
3. Lower Supermajority Requirement to 55% for Local Special Taxes to Fund Housing and Infrastructure Amendment: ACA 1 (Lowers the threshold from 66.67% to 55% for local special taxes to fund housing projects and public infrastructure) A two-thirds (66.67%) vote is required during one legislative session for the California State Legislature to place a constitutional

Housing Act) The initiative was designed to repeal the Costa-Hawkins Rental Housing Act enacted in 1995. The act prohibits rent control on single-family homes and houses completed after February 1, 1995. The act also prohibits rent control laws that mandate what a landlord can charge a tenant when they first move in. By repealing the act, the initiative would allow cities and counties to limit rent on any housing and limit the rent for a first-time tenant. Any local laws currently inoperative under Costa-Hawkins would take effect upon its repeal. Note: AAOC has adopted a position to oppose the last two ballot initiatives that was clearly rejected by the voters of the state 6. Remove Voter Approval Requirement for Public Low-Rent Housing Projects Amendment: SCA 2: (Repeals constitutional requirement that voters approve publicly funded housing projects at certain rent levels) The ballot measure would repeal Article 34 of the California Constitution, which was enacted in 1950 via Proposition 10. Article 34 requires local voter approval of rental housing projects that are intended for persons of low income and that receive funding or assistance from the federal and/or state government. Therefore, the ballot measure would allow rental housing projects that are intended for persons of low income and that receive government funding or assistance to be developed, constructed, or acquired without a local referendum. The constitution defines person of low income as “persons or families who lack the amount of income which is necessary (as determined by the state public body developing, constructing, or Sacramento — continued on page 10

The constitution defines low-rent housing project to mean “any development composed of urban or rural dwellings, apartments or other living accommodations for persons of low income, financed in whole or in part by the Federal Government or a state public body or to which the Federal Government or a state public body extends assistance by supplying all or part of the labor, by guaranteeing the payment of liens, or otherwise.” Publicly funded projects where less than 50% of the units are for low-income households are exempt from Article 34’s voter

The initiative would amend the California Constitution to define all state and local levies, charges, and fees as taxes. The initiative would also require new or increased taxes to be passed by a two-thirds legislative vote in each chamber and approved by a simple majority of voters. It would also increase the vote requirement for local taxes

proposed by local government or citizens to a two-thirds vote of the local electorate. The increased vote requirements for new or higher taxes would not apply to citizen-initiated state ballot measures. Currently, state tax increases require approval by a two-thirds vote in each chamber or a simple majority vote at a statewide election. 8. Vote Requirements for Initiatives Requiring Supermajority Votes Amendment. ACA 5. (Requires initiatives that change vote thresholds to supermajority votes to pass by the same vote requirement as is being proposed) A two-thirds (66.67%) vote is required during one legislative session for the California State Legislature to place a constitutional amendment on the ballot. Questions & Answers With all the rapid-fire changes taking place over the last several years, what would you say are the top things a landlord should do in connection with his or her landlordtenant relations?
That’s a fair question. Right off the bat, I suggest all owners review their leases. Regardless of the location of the property or whether it falls under a “rentcontrol” or “just cause” jurisdiction, every owner should determine whether their leases have all the mandatory disclosures, any language required by a rent control or just cause ordinance, and, more importantly, whether the lease has an “uncapped” attorneys’ fee provision. Such a provision will usually have language stating the “prevailing party” in a lawsuit is entitled to their “reasonable attorney fees.” If the rental agreement has an “uncapped attorneys fee” provision, owners should immediately serve a 30-day change in terms of tenancy capping the attorneys’ fees or removing it altogether. My experience is that in most eviction cases, the majority of tenants’ rights attorneys won’t really go through with a jury trial where the maximum amount of money they could expect is $500 - or nothing at all. Instead, they will bluff until the end, and often go through all the motions as if they really intend to do a jury trial, then settle on the day of trial. In other words, using a lease with a capped attorney fees provision (or changing the terms of the tenancy to cap or remove the attorney fees) dimin-

ishes the odds of a costly jury trial. My brother and I own a 10-unit apartment building. One of my tenants who has been with us for about 5 years now just informed me that she received a job offer back east and will be vacating within the next 10 days. When I asked about the rent for the month, she informed me that she would not be paying rent beyond the date on which she vacates and that I should take the rent for the 10 days out of her security deposit. I thought I was entitled to 30 days’ notice and the rent that accrues for those thirty days. Am I wrong about that?
Simply stated, the law requires a thirtyday notice from the tenant in order to terminate the tenancy (unless you specifically agreed to a shorter period). Even if she gives you less than thirty days’ notice, she is still liable for the full thirty days of rent. In the event you manage to turn the unit and rent it out before the 30 days expires, she would be entitled to a credit for the number of days within the 30-day period that the new tenant occupies the property. In other words, if you relet the property on day 20 of the 30-day period, she would be entitled to a credit for the 10 days the new tenant occupied the apartment. I own a small four-plex with four parking spaces. All my tenants have a provision in their rental agreement that tells them they have only one space per apartment, and if

they need additional parking for a guest, it has to be on the street. I have a tenant who has lived at the building for many years and has always complied with the parking requirements. Well, he recently got engaged to a young woman who I approved as an additional occupant. However, ever since she moved in, she’s been parking in the neighboring tenants’ spaces. I’ve asked her a couple times not to park in any space other than the one assigned to his apartment, but she simply smiles and ignores me. The other tenants are starting to complain about it. What can I do?
Your rental agreement likely addresses the parking rules, and they should be followed, especially in a small building with limited parking spaces. Assuming your agreement lays out the rules of the road, and that you have the proper signs up at the property, I would start with a written warning to the original tenant. “Remind” him that his lease contains a provision regarding parking that has to be followed by everyone in order to keep the peace at the property, and let him know you expect him and his fiancée to play nice with the neighboring tenants by parking in their assigned space rather than their neighbors’ spaces. If that doesn’t work, you can either serve a Cure Covenants notice, or you can have the car towed away. If you decide to have the car towed (to avoid the aggravation of an eviction) you will have to follow the proper procedures. For example, most cities have specific statutory language that must be
included on the sign that tells people you will tow their car if they violate the parking rules, as well as the Vehicle Code section that provides for towing of unauthorized vehicles. In most instances, you must also include the police department telephone number. It wouldn’t hurt to send him and her an email warning them about it to document the situation in case you end up having to tow her vehicle. Once the correct signs are up, and you have given them a “reminder” or two, if she continues to violate your parking rules, you can tow the car at their expense. I recently had new tenants move in a little more than a month ago. The lease says they are responsible for the utilities which were supposed to be put in their names before they moved in. I guess I should have checked before I gave them the keys, but I didn’t and now I’m paying for it. I just received the electric bill in the mail and, you guessed it, it’s still in my name! I imag-
ine it’s just an oversight, but still, they need to correct it. I’ve tried reaching out to them on their cell phones and through email, but they seem to be ignoring me. Admittedly, I don’t want to pay the bill, but unless I do, it will get shut off and I’ve heard I’m not allowed to let that happen. What would you do if you were in my shoes?
Well, you are correct about the utilities; you can’t simply ignore the bill and let the electricity be turned off. However, there is something that can be done about it. You can serve a “Notice to Perform Covenant or Quit” notice in which you demand that they comply by switching the electricity into their own names and reimbursing you for the money you paid for the bill. If you chose to draft the notice yourself, be sure it includes the specific provision and language of the lease requiring them to put the utilities into their own names and direct them to do so. Then you need to tell them what to do, specifically, in order to cure the breach. For example,
you must tell them that they have to put the utilities in their names and pay you whatever you’ve had to pay the electric company. In the event your property is located in a jurisdiction that has specific requirements in connection with notices for a breach of a material term (also known as Cure Covenant Notices), you should check the ordinance to be sure your notice complies. For example, some jurisdictions require the date and time of the violation to be included in the notice, as well as the name of a witness which, in this case, would be you. In the event your tenants chose to ignore you or refuse to transfer the electricity into their name by the expiration of the notice, you could then file an eviction. Remember that in most jurisdictions, the tenant will have three days to cure the violation which does not include Saturdays, Sundays, or judicial holidays. Nor can the notice expire on those days. I have a building with studio units that sport modern LED pot lights in the ceiling. The issue I’m having is the color of the lighting. The lights are warm yellow and take away from the modern feel I want for the units. What can I do to fix this issue without replacing every fixture. Paul
Dear Paul:
I think we can help! The fact that you have modern LED pot fixtures already in place will make the transition easy. The current light color you are using sounds like a warm white or around 3,000 degrees Kelvin. Warm white light gives a very cozy and homey feel, but it is not very modern. It is closer to an incandescent bulb. We recommend using a Daylight White light or 5,000 degrees Kelvin. The light will be crisper and more in line with sunlight. We don’t recommend going past 5,000 degrees Kelvin in temperature as the light becomes too blue in color and is not pleasant in a home environment.
Remove an existing LED bulb from the pot light fixture and bring it to any home center’s lighting section. You want to match the style of bulb you currently have and purchase new bulbs in a higher color temperature. The home center will most likely have a light display showing the different light colors in degrees Kelvin. Now just pop in the new bulbs into the fixtures and you will see a dramatic change in the look of your units. Kelvin Color Temperature Scale for Light Fixtures • 2,000K–3,000K: Gives off a warm white/yellow glow (candlelight hues) • 3,100K–4,500K: Gives off a bright, cool white glow • 4,600K–6,500K: Gives off a crisp daylight glow (white/bluish hues)

We are refurbishing a property and plan on replacing all the exterior trim and facia boards, etc. I want to use real wood for the facia and trim pieces.
What type of wood do you recommend? This property will be a keeper and I want to do it right. Jack
Dear Jack:
As important as the proper exterior grade lumber is, the proper installation of the trim and facia boards is equally important. Keeping the weather out of the wood, seams and joints greatly extends the life of any wood trim. The moisture content of the wood is also important. A good benchmark is a moisture content between 15% and 20%. If the wood contains sap, it is too wet, and conversely, a kiln dried wood is too dry. A quick list of recommended exterior grade lumber are as follows: • Douglas Fir—Most popular and reasonably priced. • Redwood—Great for trim. Weather and insect resistant. • Western Red Cedar—equivalent to redwood for weather and insect deterrents. Rot resistant and stable.

I own an older apartment building with lath and plaster walls. After doing a plumbing repair in a wall, I’m finding I don’t have the skills to do the proper lath and plaster repairs. What do I do? Jim
Dear Jim:
Fake it! Use drywall for the repairs. Cut
the plaster walls back to the nearest wall stud. Lath and plaster walls are usually about quarter of an inch thicker than standard half inch drywall. Use the old wood lath you removed or furring strips as a spacer between the wall studs and the new drywall. The wood lath or furring strips will take up the difference in thickness between the two wall systems. Finish the repair by using drywall tape along the repair edges, then mud, sand, and paint. No one should know the difference once you are done.

Hanukkah, Christmas, New Year’s Eve, and other year-end holidays mean more people than usual walking on your property. Is your property safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter wind or rain. Check your decking for cracks or damage and inspect the exterior stairways for wear and tear. Inspect all your garage door springs, winter wind and rain may make them heavy causing the door to close or fall unexpectedly. As a precaution, always replace both garage springs at the same time and throw away any used springs. Never install used garage springs. Check all property lighting and timers. Another Reason to Stay Debt Free in a 1031 DST Exchange
I
t seems like everyday there is another reason showcasing the reason why more and more investors are choosing to stay debt-free when investing in Delaware Statutory Trust (DST) properties in a 1031 exchange.
Headlines Show Dangers Surrounding Leveraged Real Estate
Just look at any business or real estate-related publication, and you will see the headlines are full of examples of real estate firms that have been forced to relinquish assets because they succumbed to the lurking liabilities of leverage. In many cases, these firms were led by highly skilled executives with years of experience and files of successful transactions. However, even these world-class real estate firms are creating a case for staying debt-free.
Here are just a couple of examples in the news to illustrate the point: • Recently, one large firm was forced to give a large office campus in the Southwest back to lenders after the private investment firm stopped making the payments on its roughly $300 million loan on the office campus. • One of the nation’s largest real estate investment firms located in the Midwest is struggling with the bitter taste of lender foreclosure after its bank filed a roughly $100 million foreclosure lawsuit against the real

estate firm over a recent investment gone awry. • After failing to repay its loan on a Class B complex in the South, an international investment firm was forced to turn the asset over to the lender. • One global real estate firm recently handed back a large East Coast building to its lender after the building’s anchor tenant left the building. • Fannie Mae recently announced it was prepping for possible losses in the multifamily housing sector as lenders anticipate loan losses from developers and private equity players who used heavy leverage within the multifamily housing sector5. • In the hotel sector, a prominent New York City hotel developer is facing foreclosure after failing to repay a mezzanine loan to a private equity group. • An upstate New York lender recently announced it was going to move forward with foreclosure proceedings after the owner was unable to make payments on a large self-storage facility near Midtown Manhattan. The most recent example comes from Yahoo! Finance whereby a major real estate investor has defaulted on $161 million dollars of loans tied to an office portfolio in the Washington DC

area that it owns. Just a thought, but maybe this portfolio would have been better suited as a debt-free acquisition to protect investors from default and a complete loss of equity. Also, debt-free DSTs provide protection from a balloon payment associated with loan maturity, which many real estate firms are very concerned about in today’s market.
Stay Debt Free — continued from 20 much more of a reality. Here are five specific reasons why debt-free DSTs should potentially be a part of a 1031 exchange investor’s portfolio today. 1. Debt-Free DST Assets Provide Investors with Zero Risk of Lender Foreclosure. DSTs without debt are considered by many to have a much lower risk
2. Debt-free DSTs Give Sponsors More Flexibility to Respond to
Unforeseen Circumstances. On a leveraged property, many asset management and leasing initiatives require lender approval before they can be executed. This limits the real estate operator in the speed at which they can operate the property and, at times, may limit the options available to them. In a debt-free DST setting, however, there is no lender that needs to approve an asset management or leasing initiative, so the sponsor has the ability to potentially act quickly on behalf of the property and thereby investors. 3. Debt-Free DSTs Have No Monthly Debt Service to a Lender. A leveraged DST has monthly debtservice payments that must be made first and in full each month, allowing remaining funds to be paid out to investors. In economic downturns, an asset’s revenues may be reduced. The equity investors in a leveraged DST bear the burden of this revenue reduction because debt-service payments must still be made, potentially impairing investor monthly distributions. 4. Debt-Free DSTs Provide Investors the Ability to Diversify a Portion of Their Portfolio into Unlevered Assets to Lower Potential Risk. Many entrepreneurs who have invested heavily in the stock/bond markets turn to all-cash/debt-free Delaware statutory trust properties as a strategy to diversify away from stocks and bonds. Since these products do not contain the risks of a loan, they are especially interesting to direct cash investors. 5. ‘King Of Beers’ Models Quake Resilience
F
ew might think to turn to a brewery for lessons on earthquake resilience, but the Anheuser-Busch company knows the subject well. When its brewery in Van Nuys suffered significant damage in the 1971 Sylmar earthquake, the company decided to invest $11 million in retrofitting structures at the site to withstand the next major temblor. It was a good decision because disaster struck the region again in 1994 with the Northridge quake. Even though the brewery was located just a few miles from the epicenter of the devastating 6.7-magnitude Northridge temblor, the retrofitted structures in its compound were not damaged. The brewery quickly returned to nearly full operations following minor cleanup and repairs. Anheuser-Busch estimated it would have suffered direct and business interruption losses of about $750 million from the Northridge earthquake without the retrofits, the California Seismic Safety Commission reported after the fact. This averted damage of more than 60 times the actual cost of the brewery’s retrofit program. Businesses are extremely vulnerable to the risks presented by earthquakes— and this in turn threatens the life, livelihood, and well-being of the communities those businesses serve. Imagine if your apartment building collapsed or was red-tagged after an earthquake. You’d still be responsible for paying off any loan without revenue coming in from tenants to cover those

expenses. Recovery costs would most certainly max-out your insurance deductible—and if you don’t have earthquake insurance, you’d be entirely on your own. Knowing this, business leaders have joined forces with the government to raise awareness of society’s shared need for building safety. “If everyone does their part, Los Angeles will be more prepared—better equipped to emerge from any challenge, better than before,” former Mayor Eric Garcetti said on The Resilience Advantage, a webinar series sponsored by Optimum Seismic bringing together experts from many fields to discuss earthquake threats and solutions. In 2015, Garcetti signed into law what was at the time the nation’s most sweeping seismic retrofit ordinance. Since then, more than 8,000 of 14,000 vulnerable buildings have been retrofitted. “We understand that the decisions we make today are going to shape the lives of our children and grandchildren,” he said. “That’s why we’re working to build a more resilient and prepared city.” Maria Salinas, president and CEO of the Los Angeles Area Chamber of Commerce, agreed. “As we’ve faced the challenges of the pandemic, we’ve learned much about our communities, our economies, and our institutions,” she said. “Angelenos have always known the danger of events —from wildfires to earthquakes and everything in between. The need for greater resiliency is evident.”

Media reports of the Northridge quake focused on the dramatic visuals —the flattened apartment buildings, collapsed freeway overpasses and grotesquely twisted steel-framed structures—all of which showed the extent to which an earthquake can damage a structure. But these images do little to illustrate the magnitude of widespread suffering caused by the quake. A year and a half later, 25% of the businesses reporting damage from the quake said they never recovered. Risk analyst Barbara Stewart calls the over-arching economic impacts of a major earthquake “The Ripple Effect.” “A catastrophic earthquake will have a national impact, and there will be national damage,” she wrote in a report for the National Academies of Science. She summarized those impacts in three categories: (1) disruptions to supply lines, (2) shocks to financial markets, and (3) drain on the insurance system. “There has been very little study of these consequences for obvious, very understandable reasons,” Stewart said. “It is quite human to focus on the suffering and physical damage that occurs immediately after an earthquake. Catch Me If You Can... And I Bet You Can’t! Fraudsters are more sophisticated than ever—staying up to date on compliance can help limit exposure.
I
t would be much simpler if fraud fell into a singular bucket. For instance, if fake paystubs were the only nefarious items property teams regularly encountered, things would be much easier to manage. Unfortunately, multifamily associates also grapple with altered social security cards, inflated bank statements, synthetic IDs, fake employment records, and more frequently than ever, fake assistance animal documentation. All have the capability to negatively impact the bottom line, but according to panelists at the 2023 Apartmentalize session “Catch Me If You Can…And I Bet You Can’t,” properties are now better equipped to combat the various types of fraud. “Of the more than 3 million financial documents that we’ve scanned over the past few years, we’ve discovered that

one in eight is fake,” says Daniel Berlind, CEO of Snappt. “And fake financial documents are responsible for 25% of evictions. When you consider that the average eviction cost is about $7,500, it’s a huge issue.” An estimated 10 million fraudulent documents are submitted to the apartment industry annually, which equates to approximately 1,200 per hour. Berlind noted that advancements on Adobe make editing documents easier than ever before, which is why many altered documents appear genuine at first look. “Fraud is potentially responsible for rising rents, because it effects the bottom line,” says Pat Patterson, Director of Multifamily for PetScreening. “All costs incurred by a community factor into where the rates have to be set.” What can the industry do to combat it? Investing in Apartments: Seizing Opportunities in a Changing Landscape
I
n a world where inflation is reshaping the economic landscape and causing the cost of capital and the prices of everyday essentials to surge, apartment owners are finding themselves in a favorable position. The ever-increasing costs of goods and services, from a basic loaf of bread to a beloved Big Mac, have led investors to search for stable avenues to safeguard their financial portfolios. This is where the apartment rental market emerges as a promising haven for smart investors. Consider the significant shifts that have taken place since 2019, before the pandemic swept across the globe. Back then, a loaf of bread cost a mere fraction of what it does now, having inflated by a staggering 55%. Milk prices have seen a 31% hike, while ground beef and favorite snacks like potato chips and a 2-liter soda experienced a soaring increase of 34% and 48% respectively. Even the iconic Big Mac witnessed a remarkable price jump from $3.79 to $5.17 during this period. At the same time, wages have not kept pace, increasing an average of just over 3% since 2019. As these figures illustrate, inflation has squeezed wallets and left consumers grappling with higher expenses. While the pace of inflation may have eased slightly, the reality of elevated prices remains a lasting fixture. Real estate, notably the apartment rental sector, has been greatly affected by these dynamics. Examining the Home Price Index by Freddie Mac reveals that the Los Angeles/Orange County metro

area has witnessed an impressive 40% surge in home prices since the summer of 2019. This upward trajectory in home prices, combined with soaring interest rates, has reshaped the concept of entry-level homeownership, gradually reducing the availability of affordable options. A glance back at 2013 serves as a telling narrative of the shifting goalposts in the Orange County real estate market’s lower echelons. During that period, 48% of all closed detached home sales remained below $500,000. Fast forward to 2019, and this proportion dwindled to 23%, with only 608 detached homes falling within this price range. As we charge through 2023, the scenario has evolved even further, with only 9% of sales and a meager 16 detached homes sold below $500,000. Just the notion of acquiring a detached home for under half a million dollars has become a thing of the past. These statistics starkly underline the acute shortage of affordable housing options in the current market. The scarcity of affordable homes, increasing interest rates, and falling savings rates, have been drivers behind the decadelong increase in average age for firsttime home buyers in the U.S. to 34 years old. In today’s market, if someone is lucky enough to find an entry level home for $500,000, assuming a down payment of 10% ($50,000) at today’s 7.5% interest rate, their monthly mortgage, taxes, and insurance would total around

White House Announces Executive Order on Artificial Intelligence

The order proposes increased regulation of rental housing providers.
O
n October 30, 2023, President Biden signed a wide-ranging executive order seeking to increase regulation of artificial intelligence (AI) across industries nationwide. The President’s move broadly hopes to “ensure that America leads the way in seizing the promise and managing the risks of ” AI. Importantly, the order does not constitute immediate policy change, but rather directs agencies across the federal government to develop guidelines and frameworks. The White House outlines areas in the executive order that will impact housing providers, including efforts to: • Ensure AI advances equity and civil rights; • Better protect Americans’ data privacy, including from the risks posed by AI; • Mitigate the harms and maximizing the benefits for American workers, intending to prevent employers from undercompensating workers, unfair

application evaluations or impinging on workers’ organizing and • Promote AI innovation and competition (e.g. modernizing immigration procedures for skilled immigrants and nonimmigrants to work in the US).
Advancing Equity and Civil Rights
In the order, President Biden directs the U.S. Department of Housing and Urban Development and the Consumer Financial Protection Bureau (CFPB) to combat unlawful discrimination enabled by automated or algorithmic tools used in housing decision-making and issue guidance within 180 days of the date of the order. These actions are intended to impact the use of resident screening systems and advertising of housing and help avoid violations of federal law. The order also encourages the Federal Housing Finance Agency and the CFPB to use their authorities to ensure that their regulated entities use appropriate AI tools, evaluate under-

writing models for bias or disparities affecting protected groups and automate collateral-valuation and appraisal processes to minimize bias. Additionally, the National Apartment Association (NAA) applauds the White House in calling for a bipartisan data privacy legislation, which will promote a national standard reducing compliance costs of multi-state housing providers. The president’s action today provides another opportunity for the industry to shape the policy landscape to support valuable operational tools for housing providers to better achieve our shared goals of increasing the availability of housing. NAA continues its advocacy to ensure the voice of the rental housing industry is represented as federal regulators contemplate policy changes. Operators can also consider removing verification tasks from onsite teams by partnering with a service that can effectively handle them, she said. And whether handling onsite or outsourcing, teams should always treat the requests as valid until proven otherwise. “Always start from a place of ‘yes’ with accommodation animal requests,” Thornberg says. “It will save you a fair housing complaint, which can be something of a time suck and is so unnecessary.” Because of what it offers, the apartment sector will always be ripe for fraud attempts. That’s not even considering potential employee fraud, such as embezzlement, timecard manipulation or collusion with suppliers. California’s Balcony & Deck Inspection Law Get Ready to Comply with SB 721 Senate Bill 721 requires multifamily residential buildings with three or more dwelling units to have their balconies and other exterior elevated elements inspected by January 1, 2025, and every six years thereafter. Wood-based external elevated structures, including decks, porches, stairways, walkways, and entry structures that are more than six-feet above ground level must be inspected by the state-mandated deadline.
