Property Management What are the responsibilities as the property manager? • Collect the rent. • Take the calls from the tenant. • Arrange for repairs. • See that the repairs are done properly. • Send appropriate notices to the tenant for late or nonpayment of rent, violations of the rules, etc. • Do or oversee evictions. • Get your approval for major expenses. • Inspect the property occasionally. • Provide you with an accounting of all money received and disbursed monthly or quarterly, as well as keep a client trust account for owner money. State law regulates property managers much as it does real estate agents. And every state is different. • And whatever else you agree upon between you. In fact every responsibility of the property manager is agreed upon contractually. Approximately how much would it cost to have the property managed and maintained by a property manager? Starting point is about 5% of the gross rents and it goes up to a maximum of 10%. But that is just part of it. Some property managers will charge you a set-up fee, for advertising a vacant unit, for trips to the property. Find out what their fee schedule is before you use them. Call several property management companies to ask about their fees. Don’t suggest anything to them, let them try to sell you. They will tell you what is important to them, what they believe their best service is. Then compare that with the others you call. —Rentalpropertyreporter.com

Attorneys If, like many landlords, you own or manage only a few rental properties, you are unlikely to have a lawyer on staff or even “on retainer” (where you pay a lawyer in advance to handle routine questions and issues). Fortunately, you shouldn’t need to constantly consult a lawyer or even keep one in the wings, “just in case.” You do have to be able to recognize those situations when expert help is needed -- even if it’s just for some advice and coaching. Here are some of the most common scenarios that will benefit from a professional’s review or help. Evicting a Tenant Many landlords try to evict a tenant themselves, often with success. You may be better off hiring a lawyer if: •

this is your first eviction

the tenant is fighting the eviction and has a lawyer

the tenant is an employee whom you’re firing

the tenant is filing for bankruptcy or

you must comply with rent control or housing program rules for eviction.

Being Investigated or Sued for Illegal Discrimination You don’t need a lawyer every time a prospect or tenant accuses you of illegal discrimination. In fact, landlords who diligently comply with fair housing laws can still get these accusations from prospects they reject or tenants they evict for legitimate business reasons. But if a prospect or tenant sues you for discrimination, or if HUD or a fair housing agency agrees to investigate a claim, you’ll probably want to consult a lawyer. HUD administrative law judges can award a civil penalty of $16,000 per violation for first-time offenders, in addition to actual damages, attorneys’ fees, and other relief. Your liability can be much higher if your case goes to court or you settle.. A lawyer can help you resolve the dispute and end the investigation or lawsuit as soon as possible. Sued for Injury or Illness If a tenant or guest sues you and claims that he/she got hurt or sick because of your carelessness, you’ll almost certainly want to hire a lawyer to defend you. Any lawyer you hire will be emotionally detached from the case and experienced in effectively negotiating these types of situations. Fortunately, if you have liability insurance and pay your premiums, your insurer should provide you with a lawyer to defend you against personal injury claims. Audited by the IRS or the State If you made a serious mistake on your taxes that the government hasn’t yet noticed -- for example, you didn’t report certain income or you took deductions for which you’re not entitled -- hiring a lawyer before the auditors uncover the mistake can help you avoid a potentially damaging and embarrassing situation. —By Ron Leshnower

Appliances & Laundry Services With every rental property, landlords must think about maintaining each part of the unit, from the walls and windows to the electrical and plumbing systems. One significant area that landlords deal with is the unit’s appliances. Because there is no single approach to appliances—from providing them in the first place to keeping an inventory or repair list on them—many landlords struggle with the ins and outs of appliances. This appliance guide for landlords can help streamline your efforts in approaching and dealing with appliances, from start to finish. Appliance Inventory Lists When it comes to managing and monitoring a rental property’s appliances, you should take a certain approach to ensure that they are inventoried and well-maintained. Some landlords don’t find a need to document anything about the appliances, and simply have a “wait until it’s broken” attitude, but you will save time, money and stress if you develop a start-to-finish approach to your rental property’s appliances. An appliance inventory list is a comprehensive document that tracks the purchase, repairs, inspections and more for each appliance in a rental property. There are many all-in-one forms available to keep this task from being time-consuming and it keeps all the relevant information in one convenient place. You can go online to find one or create your own. Remember the more rental properties you have, the more appliance inventory forms you need to keep you from getting confused and stressed about what’s going on. Construction, Restoration & Consulting If you are hiring a contractor to build your new building or for a major remodel, the selection of this builder or remodeler is a major decision! Allow plenty of time to interview and research at least two, preferably three companies before making your choice. Hours invested at this stage can save you time and money down the line. Check References. The most professional contractors will want you to check their references. Talk to other clients; get a list of some of their clients dating back three to five years. Visit a construction site if you can. You will get to see who their subcontractors are and see if they too appear to be professional. Meeting the subcontractors will also allow you to see the quality of the workmanship you will be receiving. Ask the subcontractors about the contractor’s integrity. How long have they worked with this contractor? Experienced contractors have strong relationships with top quality subcontractors and architects. Last, you may want to visit the builder’s office. Is it well staffed and organized? Do you feel welcome there? You want to make sure you have the right chemistry with the contractor or remodeler you choose. Two- way communication and mutual respect is key since you may be working with this contractor for many months on your project.

Flooring Floor preparation You should expect typical floor preparation charges to prevail, unless there is more floor preparation needed than usual. Floor preparation charges are typically $25-$35 per hour. You should expect to pay about one hour of floor preparation for every ten yards of vinyl/carpet installed. Floor repairs Upon the discovery of any unforeseen floor damage, installer should notify the manager at once. You should specify that the manager must approve any additional charges for floor repairs in writing. Carpet seams You should expect that carpet seams should not be too obvious. A well-done carpet seam should be hard to notice. It should not stick out like a sore thumb. If a carpet seam looks bad it should be brought to the attention of the installer as soon as possible. Proper seam placement is important. The worst place for seams is in heavy traffic areas; every attempt should be made to place seams in low traffic locations. Timely completion You should expect that all carpet and vinyl installation jobs would be completed in one day,Unless other arrangements have previously been made. Completed job All new carpet should be vacuumed (not all installers will vacuum) and all carpet and pad scraps should be hauled away. The walls should all be nicely tucked in. Seams should be neat and not have any loose strings sticking up. The carpet should be stretched in tight and there should not be any loose areas. All new metal should be installed. Lending Institutions Apartment building loans are a lot like other residential real estate financing. It all starts with a property, borrower and lender, and it all ends, if all goes well, with a closed loan and newly purchased or refinanced property. Here’s a guide to what borrowers need to know about how to buy and finance apartment buildings:. How to qualify The most important property metrics are: •

Net operating income: The annual income, minus expenses that a property generates from its operations

Debt service coverage: Measure of cash flow relative to debt payment obligations

Loan-to-value (LTV) ratio: A measure of the loan amount relative to the value of the property

Loan terms and types Apartment loans can be long term (25 or 30 years) or short term (five, seven or 10 years). Interest rates can be fixed, variable or hybrid, which start out fixed and then reset or become variable after a specified time period. Shorter-term loans can be renewed or refinanced at the end of the initial term, though the interest rate likely will adjust and some fees could be involved. “When the loan matures, the rate is probably going to change,” Kreutz says. “It could be fixed for three or five years and then adjust at some point. You’re probably going to be dealing with at least one rate change throughout that time period.” Loan amount Most lenders offer apartment loans from $1 million or $2 million up to many millions. LTVs top out at 70 or 75 percent, which means the borrower needs a 25 or 30 percent down payment to buy (or that much equity to refinance). A lower LTV usually gets a lower rate. Fees Borrowers typically pay a loan origination fee and customary closing costs, including appraisal, title and escrow costs, plus expenses for any inspection, environmental or other due diligence reports. Property insurance is a must. Flood insurance will be required if the property is located in a government-designated flood zone. —Marcie Gefner

Real Estate Apartment Market Tightens Amid Soaring Housing Prices, Spurring Builder Activity —Marcus & Millichap High barriers to homeownership and continued job growth stemming from corporate expansion will keep the Orange County apartment market flourishing through 2016. Demand for multifamily space is supported by a growing renter population made up of young, working-class adults seeking a live-work-play lifestyle. These residents want to live in high-density employment and entertainment hubs where high housing prices and the prohibitive cost of a downpayment make homeownership out of reach for most. Security & Towing Deciding What Kind of Security Should Be Hired — It is important to know that hiring a security contractor, whether limited or extensive, armed or unarmed, is a serious business and not to be taken lightly. Different kinds of security guards are appropriate for different situations. One important issue is whether you would like security at your site to be provided by a uniformed or plainclothes guard. The main goal for hiring a uniformed security guard is deterrence. The main goal for hiring a plainclothes security guard is apprehension. After deciding what kind of security to hire, you must determine whether the security guard should be armed or unarmed.There are many costs and benefits to be considered when choosing an armed versus unarmed security guard. The following should help you analyze the issue and determine what is in the best interest of your institution. Armed Security Guards — It is important to determine if hiring armed security guards meets your institution’s expectations for security. Realize that armed guards may utilize deadly force. Determine the training qualifications the security guards have with firearms. Determine the contractor’s policy on the use of weapons with regard to deadly force. Keep in mind moral questions when hiring an armed security guard. You should determine whether the members of your institution will accept an armed guard on the premises. Please note that special care should be taken if your institution serves many young people. Schools should be particularly concerned with the message an armed guard conveys to students, parents and staff. Consider the cost effectiveness of an armed guard. They are much more expensive than unarmed security, due to licensing and training requirements. Decide whether the presence of a weapon may escalate the possible use of force and violence which otherwise may not occur. Insurance maybe adversely affected by the presence of an armed guard. Unarmed Security Guards — Use of deadly force is neither desired nor required. Unarmed security guards often provide the same deterrent as armed guards without the risk of deadly force. The protection afforded by unarmed guards is less expensive and may incur less liability and insurance.
