Our program of seminars is really spectacular: Stephen Duringer kicks off at 9:30am packing hours worth of information into his one-hour “Legal Update – Building a Better Community”. Kate Good of the Apartment All-Stars follows next at 11:30am with “Constructing Positive Resident Experiences” When is the last time a resident contacted you or your manager about something they appreciated and were grateful for? Kate will speak about reconstructing management practices with a more consumerfriendly focus. The last seminar of the day is the very popular, informationpacked and 7th Annual Rental Housing Economic Forum at 2:30pm, moderated by Nick Lieberman with an outstanding panel. Any one of these seminars could be a day’s worth of invaluable training and information! love this California as much as anyone. But let’s face it, this is not an easy state wherein to do business. As members of the rental housing industry, you have heard this before. But this past year California has seen a host of efforts and measures aimed directly at our industry the likes not seen before in a generation. In Alameda, a city measure passed that imposed rent control, cause evic-

tion elements, and mandatory relocation fees. More rent control and cause eviction law in East Palo Alto and Mountain View. In Oakland and Richmond measures that require preapproval from city of rent increases, and limitation on reasons tenants can be evicted, respectively. Now you may be saying to yourself: “sure but this is par for the course for the Bay Area of The Golden State, we

are safe here in Orange County.” I disagree. All the measures listed above were proposed and campaigned on as addressing the area’s “affordable housing crisis.” Within a month, The Apartment Association of Orange County and its Legislative Committee will head north to Sacramento. I will be leading our association delegation in our Annual Sacramento Legislator Fly-In, held at
the California State Capitol. With the help of Apartment Association of Orange County and Lobby Team of Jon Smock and Ron Kingston, whose monthly column appears here in Apartment News Magazine, we will be meeting with members of the State Assembly and State Senate from Southern California. In addition, we will have the added support of the participation of The California Rental Housing Association (CalRHA) and the National Apartment Association (NAA). Both organizations coordinate to assist us in Sacramento. We need to send a strong message to our lawmakers. The Apartment Industry in the Orange County is a vital component to the overall economy: there are over 545,000 apartment homes in Orange County which translates into $38 billion in economic activity. That economic footprint supports an estimated 950,000 Orange County jobs. If you want to get involved with our

UD cases on existing tenants or occupants for determining either identity or credit worthiness. Senate Bill 277 resurrects a contentious land use issue that has occupied courts and the Legislature over the past several years. It would would authorize the legislative body of any city or county to adopt ordinances to require, as a condition of development of residential rental units, that the development include a certain percentage of residential rental units affordable to, and occupied by, moderate-income, lower income, very low income, or extremely low income households, as defined by existing provisions. Assembly Bill 199 would require private residential properties built on private property pursuant to an agreement with the state or a political subdivision to meet all the requirements of being a “public works” project, i.e., bidding, union labor, etc. Assembly Bill 62 would require all public housing agencies to implement a policy of “no smoking” of tobacco products in all public housing living units, interior areas and outdoors within 25 feet. Generally conforms to federal HUD guidelines. Senate Bill 2 would impose a $75 fee to be paid at the time of recording of every real estate document required or permitted to be recorded, per each single transaction per each single parcel of real property, not to exceed $225. Funds are to be sent quarterly to the Department of Housing and Community Development for deposit
in the Building Homes and Jobs Fund, which the bill would create within the State Treasury. The funds are to be used for a variety of activities generally related to housing production and rental and ownership opportunities. Assembly Bill 181 would increase the renter’s credit beginning January 2017 to $240 (joint filers with less than $100,000 income) and $120 (for income less that $50,000) and require FTB to adjust gross income for inflation binning in 2018. Assembly Bill 150 would prescribe various notice requirements for a plaintiff to follow before filing an ADA action, including at least 6 months’ notice and preclude a filing if the defendant has made a good faith effort to correct the alleged violation. Senate Constitutional Amendment 3 would create an additional exception to the 1% limit for a tax rate imposed by local governments’ bonded indebtedness that is incurred for library facilities approved by 55% of the voters instead of the 2/3 vote now required. Senate Constitutional Amendment 4 would provide a program to ensure that affordable water is available to all Californians and that water conservation is given a permanent role in California’s future. There are a number of bills dealing with employment issues of concern and also a host of spot bills dealing with housing and other issues that have yet to be fleshed out. Also of interest is the absence to date of significant bills that have not yet been introduced. Topping

that list is a revival of a mandate to accept all Section 8 voucher-holding tenant aspirants. The current state law is very clear on this subject: there is no violation of the Fair Housing Act based on “source of income” because, despite the misleading “voucher” nomenclature, the rental assistance does not flow to the tenant applicant and is not income to the tenant applicant. The issue, which has been debated and rejected by the Legislature on several occasions, will arise again largely because of a very recent trial court decision from Los Angeles that upheld a local Santa Monica city ordinance that expressly referred to Section 8 vouchers as being within its independent “source of income” definition. There will likely be much more discussion on this issue in courtrooms and legislative halls as owners meanwhile contemplate more than perusal of the 4,000+ pages of federal HUD compliance rule governing Section 8 “vouchers”. certain protections from retaliatory evictions and retaliatory acts. California law will infer that a landlord has a retaliatory motive if he seeks to evict the tenant or take other retaliatory action within six months after the tenant has exercised certain protected rights, including using the repair and deduct remedy, complaining about the condition of the unit to a public agency, after giving the landlord notice, or after filing a lawsuit based upon the condition of

the unit. The tenant must prove that she exercised one of these rights, in the past six months, and that her rent is current. The landlord may counter the tenant’s claims of retaliatory conduct by establishing that he did not have a retaliatory motive. If the landlord’s actions were based on a valid reason, and not in response to the tenant’s exercise of a protected right, then a court would find that the landlord did not retaliate. If your annual rent increase was consistent with past practices, didn’t solely target this individual tenant, was based upon objective business reasons, and was not meant to “punish” this resident, then your rent increase would most likely not be deemed retaliatory. I just put my single family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?
The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/enclosure conform to all state and local codes and ordinances. The gate should be self latching, and should be checked to ensure that it closes properly. Review your insurance policy with your broker to ensure that your coverage is adequate; consider an umbrella policy as well. Your broker can counsel you on coverage limits; consider $3,000,000 as a minimum. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self latching gate functions properly. Consider requiring that

These requirements should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?
No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement

identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. I’m looking at a single family residence to purchase. It’s a pocket listing, no signage, not on the MLS. The agent claims it’s a great deal because the seller needs cash quickly, wants a quick escrow, and is willing to let it go for under market. The only catch is, the tenant doesn’t know the house is for sale, and the owner doesn’t want the tenant to know. He says that when I close escrow, I can serve my own notice to have the tenant leave, but he doesn’t want the tenant getting nervous and moving out if the deal doesn’t go through. Seems like a really good deal, I know the house, I’ve peeked in the windows, and it’s in incredibly great shape. What am I missing, what can go wrong?
Lots. You have actual notice of a tenant in possession. That means that you are bound by whatever rental agreement, or contract, exists between the owner and the existing resident. The tenancy agreement may turn out to be a fixed term lease for a long period of time at

less than market rent. The resident may have a lease with an option to purchase the house for a fixed sum, possibly less than what you are paying for it. There may be litigation between the parties relating to the premises, possibly mold or some other contamination issue that you may not be aware of. If the deal really is as described, then prepare a purchase agreement providing a due diligence period allowing you a brief time period to check title, condition and other issues. Once escrow is open, and you are satisfied with title, and the condition of the premises, contact the resident, confirm the terms of his tenancy, get a copy of his rental agreement, and prepare an estoppel certificate for the resident to sign affirming the tenancy agreement, amount of deposit, and affirming that he has no equitable or legal interest in the property. What is the difference between Cement and Concrete. I hear people use both terms to describe a sidewalk or building. I understand there is a difference, but don’t know which one means what! George
Dear George:
Great question! Many people including those in the building industry mix the two terms up. Cement is a binding agent used to hold other materials
together. You may have heard the term “Portland Cement”. Portland cement is not a brand name, but the generic term for the type of cement used in almost all concrete today. Portland cement is a mixture of ground sintered limestone or calcium, silicon, aluminum and iron all ground into a very fine powder. Concrete is a mixture of aggregate, gravel, sand and Cement. Mixed together with water and you have Concrete, a stone like material. Another way remember which is

which: Cement has a soft “C” sound like soft powder and Concrete has a hard “C” sound like a hard sidewalk. Cement and the resulting concrete has been around for a long time. The process goes all the way back too Ancient Macedonia and was used extensively by Roman Empire to build the aqueducts, the Pantheon and many other Roman structures. I am replacing a number of rotted pressure-treated 4x4 fence posts on my property. Why do some posts rot and other do not. I cannot see any rhyme or reason for one post to be good the other bad. How can I avoid this trouble in the future? Kent
Dear Kent:
The issue of the rotting posts lies in the
Tree Growth Rings and their location. The rotting posts may have centered growth rings. If you look at the 4x4 post end, the growth rings will be either centered or not centered. A centered growth ring is common in post made from a peeler core. The tight centered growth rings of the peeler core will not accept pressure treatment as well as a post with off-centered growth rings. Chances are the fence you are repairing may have a mixture of peeler core posts and off-center growth
ring posts. A Peeler core is the byproduct of plywood manufacturing. A log is turned on a lathe to produce plywood veneer and the center that remains is called a peeler-core. When buying pressure treated post, look for off-center growth rings.
Dear Maintenance Men:
I am trying to do my part to conserve water and have found my toilets are the biggest offenders. The toilet constantly fills every five or ten minutes. I have replaced the fill & flapper valves but the problems persist. I’m at my wits end about this! What can I do besides replacing the toilets? Benjamin
Dear Benjamin:
Leaks at the Flush Valve are possibly caused by a damaged flush valve seat which may have a hole or the rim is pitted or cracked. The seat is the large drain hole at the bottom of the tank. A temporary repair may be to sand the seat with a steel wool pad or wet/dry sandpaper. This will remove the calcium build-up. If the seat is damaged, replacing the seat will be the next option. “Fluidmaster, Inc” makes a Flusher Fixer Kit that can be cemented directly on top of your old worn flush valve seat. This is a quick fix that may not work on all toilets. If the seat kit does not work, you will need to replace the valve seat. This can be accomplished by removing the tank from the base of the toilet: Turn off the water to the fill valve, disconnect the water line and remove any water from the tank. Maintenance — continued from 16 Unscrew the two or three brass bolts under the tank and carefully lift the tank off. Once the tank is removed, turn it upside down. Remove the rubber “Spud” washer from the tank. Spin the large nut from the threads and then push the valve seat through the tank. Reverse the procedure when installing the new valve seat. Always install a new “Spud” washer and new brass bolts and washers. Be sure your toilet tank is installed level, as this will aid in its operation. The new flush valve will give the rubber flapper a smooth seat for a positive seal.

Here are several of our best simple and inexpensive community curb appeal tips for this spring: Plants — spring is a time of rebirth so plant some new colorful flowers and hedges. 5 Biggest Voicemail Mistakes You’re Probably Making

A
re you guilty of terrible voicemail etiquette? Chances are high the answer is yes. When was the last time you listened to your own voicemail message? It’s probably been a while. So now’s a good time to check it to be sure you’re not guilty of the following bad choices. If you are, set a resolution to change your recording this minute to avoid these common mistakes:
1. “Hi, I’m not here right now.”
Well, that’s obvious. This a boring and useless statement. Instead, why not live a little? Let your callers know where you are, not where you’re not. Tell them, “I am in the office all this week” or “I’m in a sales meeting till 3 pm.” Also let them know if you do or don’t check messages. Tell them when you’ll be back.
2. “Your call is very important to me.”
Seriously? This phrase is an all-time waste of space, Friedman says. The caller, of course, is thinking, “Well, if I’m so

darned important, where are you?” Maybe the call isn’t so valuable to you after all. So lose this statement.
3. “I’m sorry I missed your call.”
How dull. Of course you’re sorry you missed the call. (Although, in truth, there may be some calls you’ve purposely screened and are not a bit sorry you’ve missed.) It’s okay to leave this phrase out. The sentiment is a kind of a given. Use the time for more valuable information such as where you are and when you’ll return, who they can call, or how they can reach you best for more information.
4. “I’ll call you back as soon as possible.”
Everybody says it. But it’s not interesting and is definitely not fun. And most assuredly your “as soon as possible” and the caller’s “as soon as possible” will not be the same. In truth, most people don’t return calls in a timely fashion (and perhaps not at all). If you’re telling your callers you’ll call

them back, be sure you do. If you don’t want to return the call, have someone from your organization return it upon your behalf or let the caller know in your message to reach out via text or email instead. Promising to return a call and not doing so is like using your turn signal on the freeway and moving the other direction instead. It’s a breach of promise, and it’s downright rude. Don’t be guilty of this.
5. You provide no alternative route.
Offer the caller another name or extension. Or invite them to text you or tell them how to reach you on email. The main point here is to offer a reasonable alternative when you’re not available, and–even better–to use the time and space to say something memorable or interesting to your caller instead. Getting Ready — Tax and Other Times

arch traditionally marks the arrival of spring, which for some people translates into a frenzy of deep cleaning and for others

into digging in the garden. March is also the time when we gather together all of those numbers and receipts for our tax preparer.
This is such a prevailing practice that it landed among my “Bill’s TOP Four Myths” in Chapter One of my book Cash In on the Myths of Real Estate.
A tax time review is all that is needed.
Popular Belief: Whether consciously or by default, getting ready for that annual tax preparation meeting is often the only time that investors analyze what is going on with their real estate investments. Bill’s Truth: Aside from celebrating your birthday and similar anniversary events, once a year is not sufficient — especially in reference to reviewing the performance of your investment properties. There are any number of possible trigger events that require a full portfolio review. Many of these are economic or real estate-related, such as a change in interest rates or in local market conditions. Or, these triggers may be personal occurrences such as the death of a spouse or parent, divorce, a job change, or a change in one’s health. Depending upon the nature of the event, you may also want to reevaluate your cash flow needs, longterm investment goals, risk tolerance, and other considerations.
The most important trigger events are market-driven. Be ready to act when you can make more money. Cash In: Don’t ignore trigger events. Actively manage your portfolio to maximize your returns.
In many ways, a tax-time review of one’s investment properties is almost counter-productive. As you are sitting across the desk from your tax preparer,

even if he or she is a CPA, the focus is not really upon performance, but rather upon tax consequences. Although minimizing one’s tax liabilities may be a

benefit gained from owning a rental property, it should not necessarily be the driving force behind that investment.
So, when tax time rolls around, you may want to make an appointment not just with your tax preparer, but also with your real estate advisor. In addition to an update on market trends, rents, and property values; the two of you should also be analyzing how well your real investments are doing in terms of meeting your financial goals. This is also a great time to look at your options. Perhaps, now is when you should consider selling or exchanging into a property that can improve cash flow/security with less daily management headaches. Or, you may want to consider refinancing and using some or all of that cash to make improvements and upgrades. There are all types of possibilities and no one right or wrong answer. You, with the help of your trusted advisors, need to evaluate what works best for you and your particular circumstances. As I mentioned in Myth 1-2, circumstances can change and when they do, that is called a “trigger event”. Trigger events can be personal or, if not more important, market-driven. Stay alert and be willing to listen to your real estate advisor who should be following local as well as national trends and projections. Again, it is not a matter of necessarily taking action, but rather of taking the time to look at what may have shifted in terms of your options and opportunities. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. This is why it is crucial that an inspection is done prior to being quoted by an insurance company. Avoid having a cancelled policy due to the “bugs” being found after the policy is in place. Don’t Let the Bed Bugs Bite!

iterally, bed bugs are on the hunt for a food supply, and unsuspecting people are the main entrée for these blood-sucking creatures. Bed bugs are wingless insects, oval in shape. These creatures range in color from brown, or rusty red to almost white. One out of five people in the U.S. are in contact with someone who has or has had bed bugs. It is nearly an inevitable situation owners of apartment buildings will have to face. Bed bugs can dwell in bedding, mattresses, and freely travel to unsuspecting locations by suitcase and boxes. The plague of bed bugs can involve wall cavities, carpets, and furniture. Property owners are obligated to provide the best protection from any bed bug infestation. Renters are entitled to have a peace of mind by simply knowing they’re off the menu for a bed bug invasion. This can be accomplished by establishing a protocol for eradication of the incursion of bed bugs. Apartment owners providing rental leases and agreements should especially be proactive in adapting an eradication program. According to a recent univer-

sity research, bed bugs are already showing resistance to powerful, professionally applied pesticides. In addition, not all pesticide methods and applications are lethal enough to kill the bed bug eggs. Therefore, knowledge is the key to understanding how to wipe out the blood-sucking pests. For that reason, information is available to learn more about non-toxic approaches for eliminating such pests and their eggs. Some additional sources for fact finding information can be found on the websites of the California Department of Public Health and the California Department of Health Services. Such methods employed should be from successful, licensed and experienced companies. There is considerable documentation citing the temperature and time correlations necessary to kill bedbugs and their eggs. Several sources (Usinger 1966, Gulmahamad 2002, Quarles 2007) report that adults and nymphs die within 15 minutes at temperatures greater than 113°F and 60 minutes to kill eggs. Raising room temperatures above the thermal death point and

maintaining that temperature for several hours normally eliminates a bed bug infestation. One should consider using a product that will penetrate into cracks and crevices, force heat into beds, bedding, mattresses, furniture, electronics, wall cavities, etc., and kill bed bugs where they reside. This is important because adult bed bugs have been shown to live up to a year on a single blood meal, and may simply go to a small, dark space away from mattresses to live and reproduce. The importance of decisive action based on a protocol for eliminating a rising nuisance and possible health hazards among apartment communities is foremost among tenants and their loved ones. The obligation is beyond a legal one, it’s simply the humane and right thing to do. I
t’s not what you gross, it’s what you keep! Ask any capitalist and they will explain how simple yet clouded this philosophy can be at times. We read constantly about companies with increased sales, a merger, or the addition of new locations, but rarely about net profit. Personally, I get excited about learning how cost was reduced generating more net profit- each dollar saved is a full dollar that hits the bottom line. Whereas for each “NEW” dollar grossed through expansion/growth, only 10 cents traditionally goes to the bottom line (in a normal 10% net margin business). I would much rather have a dollar than 10 cents! But we are seeing a change. After the Great Recession every company looked to lower expenses just to stay afloat, it was a matter of pure survival! Well a funny thing happened along the way — as business improved over the past couple years and revenues grew, the lean and mean philosophy continued in many of the companies bringing much higher margins than pre-recession. The name of the game was to grow, but do so conservatively and strategically. It’s a very similar phenomenon to the folks who survived the Great Depression; when things improved they never forgot how tough times were and always felt that uncertainty could again be just around the corner. Procure America takes this philosophy to the next level and provides business owners a platform to outsource efficiency, effectiveness and bottom line profitability in specific areas common to most apartment owners. By conducting thousands of audits and reviews, we have identified three unappreciated operating expenses that significantly impact the bottom line with property management and owners of all size. Utilities, Waste Management and Banking Fees too often are viewed as fixed costs with no options or recourse, yet you do have options. Utilities: The U.S. Energy Information Administration (or EIA) projects energy consumption to increase 48% by 2040. This number even includes future technology innovation for conservations purposes and cost can be mitigated with technology; but what is almost always overlooked are the actual tariff and tax rates being paid per Kilowatt hour. Scrutinizing your tariff and tax rates from the utility company can identify alternatives you qualify for that result in lower power, water, gas and sewer cost without any operational changes nor investment. Our company focuses on CPUC (California Public Utility Commission) regulations, interpretations and rulings to ensure you are on the most favorable rate possible. More often than not we are able to identify alternative rate structures that result in dramatically lower cost. From multifamily housing rates, to low income and senior housing programs and more, there are many tariff alternatives that reduce cost. Additionally each city has their own assigned hauler operating under unique contract points and fee structures. Add in that this industry is renowned for “margin creep” practices by the service providers, and you have a recipe for cost savings when in the hands of an experienced professional. Our audit team comes directly from the hauling industry and bring a deep understanding of haul rates, operational efficiencies and bill auditing. Attention to invoice compliance is a must as we encounter mistakes and misbillings in a large percentage of our clients’ invoices. When it is all said and done our clients average 38% gross savings in this cost category along with an increase of capacity and service levelsanother win-win-win. Banking fees: Over the past decade use of electronic payment for rents has skyrocketed and so have the fees. Interchange management, client profile, level 1 versus level 3 reporting, all continue to convolute this environment. Our Treasury practice group is staffed by former bankers and processors who find significant variance in the client’s actual applied rates versus the “advertised” fees presented by the processing community during the sales process. We commonly see 50% to 300% variance in the rate “highlighted in the sales presentation” versus the true rate in the reconciliation statement. This industry is complex and known for irregularities in terms, fees and structures. Our average savings is north of 40% in this segment and better yet, can be attained without investment, processor or operational changes. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible.
