Rent Control Defies Basic Economics!

T

he headline above and ensuing editorial appeared last year in the OC Register’s Sunday Editorial section, and today, with the ongoing developments in Sacramento and tactics of pro tenant groups, seems quite prescient. The editorial opined that despite all of the housing-related talk, these groups have apparently yet to learn that more government involvement, making housing more expensive and less profitable, is never going to solve the state’s decades-long housing affordability problems. As you probably know, AB 1506 which would repeal the Costa Hawkins Act and expand rent control laws across the state was defeated in the assembly housing committee. However, tenant advocacy groups have filed a proposed November ballot initiative to repeal the Act. In a nutshell, Costa Hawkins is a state law which was enacted back in 1995 that prevents cities and counties from adopting harsh rent control polices including: 1. Regulating initial rental rates established after a change in tenancy — known as vacancy control, 2. Rent control on housing built after 1995, and 3. Rent control on single-family homes. Repeal of this act would devastate the rental housing industry! Initial enactment of many rent control ordinances in California occurred in the late 1970’s when rising real estate values and surging interest rates made single-family homes less affordable. Disappointed buyers often moved into apartments creating a severe shortage

in apartments and rents went up. We still have a housing shortage and affordability problem in 2018, and many of the dynamics that occurred in the 1970’s are still at work. So how does rent control defy basic economics? Lower rents sound great if you’re a current renter, but price controls make it much more difficult for future renters to find housing. Reducing the profit that developers and landlords receive, compared to market rates, diminishes or eliminates the incentive to build additional housing in the first place. Sure a small number of renters who are lucky enough to obtain belowmarket apartments will benefit, but many others will not and they will be left with less affordable options than would exist without rent control. In some cases, rent-controlled buildings have been replaced with pricier, and more profitable, types of housing and rentals have been taken off the market or converted to for-sale units. Moreover, rent control diminishes the quality of housing since landlords have less cash flow with which to make upgrades or to keep their units current with the times. Regular maintenance also tends to suffer as landlords have less financial incentive to make timely repairs and improvements. Not to mention there’s even less incentive to do so given the excessively high demand for rental units in the market today and probably tomorrow. Rent control has never built a new unit. The real focus throughout the

his year California will see efforts and legislative activity directly aimed at our industry, the likes not seen before in a generation. As members of the rental housing industry, you have seen and fought this before. Let’s face it, California is a beautiful place, but sometimes she is not an easy state wherein to do business. Next month, The Apartment Association of Orange County and its Legislative Committee will head north to Sacramento for our annual advocacy Fly In. I will be leading our association delegation to the California State Capitol. With the help of Apartment Association of Orange County and Lobby Team of Jon Smock and Ron Kingston, whose monthly column appears here in Apartment News Magazine, we will be meeting with members of the State Assembly and State Senate from Southern California. In addition, we will have the added support of the participation of The California Rental Housing Asso-

ciation (CalRHA) and the National Apartment Association (NAA). Both organizations will assist us in Sacramento. We will have organized meetings taking us through over 15 legislators’ offices and will offer our detailed and thoughtful opinions of the bills at hand. The face to face sit down between rental housing industry partners and elected lawmakers of the state legislature, literally in the state Capitol in Sacramento has value, and I believe our collective voice will be heard. We need to send a strong message to our lawmakers. The apartment industry in Orange County is a vital component to the overall economy: there are over 545,000 apartment homes in Orange County which translates into $38 billion in economic activity. T

he legislative attention to housing issues over the past year has given rise to an incredible surge in political advocacy of all stripes. If “the meek will inherit the earth,” as some say, one might speculate as to the planet’s condition in the aftermath of scorchedearth-style extremism in this battle Royale. If there is one constant theme that emerges from all the rhetoric surrounding California’s newly recognized “housing crisis,” there is plenty of blame to be spread around lots of different players. Tenant advocacy groups have mobilized an imposing force with a single message of hope for relief from spiraling costs of rent, and many point to the rental property owner as being the culprit who caused the condition. Their immediate solution: rent control, repeal the 1995 Costa-Hawkins Act that placed restrictions upon local government’s ability to enact the strictest forms of price controls on rental properties. That proposed solution was embodied in Assembly Bill 1506 (Bloom), which failed passage just last month in the Assembly Committee on Housing and Community Development. And the same effort is embodied in an initiative proposal cleared for circulation by the Attorney General with the following description: EXPANDS LOCAL GOVERNMENTS’ AUTHORITY TO ENACT RENT CONTROL ON RESIDENTIAL PROPERTY. INITIATIVE STATUTE. Repeals state law that currently

restricts the scope of rent-control policies that cities and other local jurisdictions may impose. Allows policies that would limit the rental rates that residential-property owners may charge for new tenants, new construction, and single-family homes. In accordance with California law, provides that rent-control policies may not violate landlords’ right to a fair financial return on their rental property. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: Unknown, but potentially significant, changes in state and local government tax revenues. Net decrease more likely than net increase. Potential increase in local government costs of up to tens of millions of dollars per year in the long term, likely paid by fees on owners of rental housing. [Bold in original.] The prospect of continuing legislative battles in the shadow of a looming ballot fight gives rise to determined groups of rental property owners to mobilize a resistance to the challenges ahead. This is an All Hands on Deck moment for owners everywhere to understand exactly what is at stake in the coming months as the dialog heats up. Years and years of inadequate housing supply has matched deficiencies in roads and highway maintenance, water and sewer needs, and a host of other infrastructure needs that have simply failed to match a burgeoning 21st

Century society. Moving away from the Number One priority on every rental owner’s list of issues that merit attention, we turn to tackle another leftover challenge that has gained traction this year. Senate Bill 721 (Hill) passed the Senate late last month, meeting the constitutional deadline for passage of bills in its house of origin. The bill would require property owners of 3-units or more to hire a qualified inspector every six years to inspect 15% of all exterior wood supported or stabilized walking surfaces above six-feet from the ground, including decks, balconies, porches, stairways, walkways, entry structures, and their supports and railings. There are a number of shortcomings in this proposal and they are cause for real concern. We outline here only a few of the many reasons why the measure requires additional attention to its detail. Owners are already subject to rigorous inspection and maintenance standards. Existing statute, regulation, and case law provide a whole spectrum of inspection and maintenance requirements that developers and owners must abide by to properly construct and operate ownership and rental property. Additional inspections are redundant and unnecessarily costly. Instead of requiring regular state-mandated inspections, the legislature should focus on strengthening inspections that are already in existence, and amending the building code to ensure better Smock/Kingston — continued on page 10

Smock/Kingston — continued from 8 materials are used. Balcony and deck tragedies are preventable without regular statemandated inspections. One of the central culprits in the recent Berkeley and Folsom balcony and stairway collapses was dry rot. Experts agree that certain changes to the building code and to inspection standards during the construction and permitting process are necessary. Proposals include using better, stronger, and more durable material, and better weatherproofing technologies and techniques. The State has since implemented new emergency building code regulations to address some of these issues. We support these approaches, because they provide concrete prevention tactics that can easily be incorporated into the building design and permitting process. SB 721, on the other hand, requiring regular and costly inspections is extreme, redundant, and unwarranted. Many local inspection programs already exist. Many cities and counties have already adopted residential rental inspection programs requiring regular inspections of rental property. To the extent these inspections include or are amended to include inspecting decks and balconies, they should be exempt. Inconclusive inspection reports will be problematic and are not addressed in the bill. SB 721 requires owners to fix any decks or balconies that are in need of repair or replacement, hazardous, structurally deficient, or noncompliant

as determined by the inspector. In many cases, however, the need for repair will be inconclusive because the structure is hidden behind a wall. Inspectors will likely report their determinations as inconclusive followed by a statement indicating that further testing, including destructive testing, is required to make a determination. Destructive testing is incredibly expensive and intrusive because it literally requires destroying and tearing down walls. The bill does not address inconclusive inspections and reports. If owners will be required to conduct destructive testing every time a report is inconclusive, the time and expense will be extraordinary. We oppose such intrusive testing based on inconclusiveness. Mandatory retention of records is unnecessary. SB 721 requires owners to keep records of all inspection reports indefinitely. Indefinite retention of records appears by all counts to be unprecedented. Property owners are required to make disclosures of material defects and repairs made within a reasonable amount of time, but records of such repairs do not need to be kept by the owner. Any significant repair that requires pulling a permit will be documented at the local recorder’s office. Similarly here, any major repair to a deck or balcony will likely require pulling a permit, and as such will be recorded. A mandate to keep all inspection reports for all eternity creates unnecessary liability, and is itself unnecessary to achieve the goal of the bill. No appeal process. The bill is silent

on how owners can object to, oppose, or appeal a decision of an inspector or local government about the need for a repair, and with regard to fines, penalties, and liens. Due process commands that owners have a fair process to contest determinations made by state and local governments. Incentives. The bill creates new inspection mandates without providing any incentives or cost offsets to help owners manage the high cost of inspections and repairs. We urge the author to consider ways the state and local governments can help owners achieve structurally safe decks and balconies by offering incentives, rebates, tax writeoffs, and other cost offsets. One approach would be to ensure owners are protected from liability after going through the inspection process and making repairs to comply with the law. A process for indemnification, immunity or a liability shield would help incentivize owners to be proactive to make sure their decks and balconies are up to date and well maintained. Q&A — continued from 12 some other provision that may alter or restrict your rights. Seems like I’m replacing screens and clearing drains on a regular basis for one of my residents. At the end of the day, I’m not sure if I have more money going out for repairs than I have coming in as rent! How do I control the repeat repairs and expenses?

It’s very important to create a baseline with your tenants. Upon move in, ensure that you use the move in inspection checklist provided by your apartment association. Itemize any and all defects or items that are in need of repair, and note any non-habitability items that have pre-existing damage that you are not required to and do not intend to repair. Ensure that all habitability items are promptly corrected and that you document that fact by entering it into your maintenance log, and have your

resident sign off that the work was completed satisfactorily. Your rental agreement will identify who is responsible for what repairs and maintenance items. Make sure your review these responsibilities with your tenants so that they are aware of what is expected of them. Often landlords shift the burden of small plumbing stoppages to the tenant, while retaining responsibility for main line blockages. Your rental agreement should state that the apartment is equipped with the requisite screens, and that the resident has inspected them and agrees to maintain them during the tenancy. I’m accepting applications from prospective residents for an upcoming vacancy. I’m kind of surprised at the response I’m getting from my advertisement. Lots of calls, and lots of interest. A fellow in a wheel chair applied, and asked if I allowed cosigners. Says that because of his injury, he can’t work full time, and that his parents

help him out with the rent. I have always had a strict no co-signer policy, just seems like too much hassle, so I told him that I was sorry, that I did not accept co-signers and wished him good luck. Now I think that maybe I should have handled the situation differently, should I have?

Yes, even though you have a policy of not accepting co-signers, there are exceptions for persons with a verifiable disability. Federal and State law provide that a no co-signer policy may be a violation of the Fair Housing Act as applied to a person with mobility or other verifiable disability. You would be required to “reasonably accommodate” the disabled person by making an exception to your no co-signer policy, as the courts would likely find that the benefit to the resident greatly outweighs the burden to you of allowing a co-signer. quite a while ago. One of the four is now moving out, but the other three are staying. The one moving out is demanding that I return his portion of the security deposit. Do I have to?

No, the security deposit remains with you as long as any of the roommates remains in possession of the rental unit. Absent a written agreement to the contrary, when all the remaining roommates vacate, the refund check should be made payable to all four of the roommates. I’ve been thinking of installing a drop box somewhere on my property so that the residents can put their rent checks in it. I’m thinking I’ll save them a stamp and get the rents sooner. Any problem with doing this?

Many landlords do exactly that, most with absolutely no problems whatsoever. If you are considering the practice, it is very important to install a secure box

that cannot be removed or broken into, and provide your residents with written procedures regarding the use of the drop box. Specifically, inform the residents that use of the box is optional; that they may use it for their convenience, but that there always is a risk of loss or theft. Rent will not be considered paid until you actually receive their check. And of course, never deposit cash. Also provide the residents with a physical address where they can personally deliver the rent, not a PO Box, if they prefer not to deposit the rent into the drop box. By not requiring the use of the drop box, the resident will bear the risk of loss, until you actually receive the rent. If you mandate the use of a drop box, and fail to provide a physical address for payment, or require payment to be made to a PO Box, courts will find that the risk of loss transfers to you upon their placement in the drop box, or in the mail. One of the maintenance chores I do are caulking and sealing shower/tub fixture flanges and shower walls. My problem is getting the caulking to dry before a resident uses the shower. Any Suggestions? David

Dear David:

A lot of people will say: “Just tell the resident not to use the shower till the caulking is dry”. Well it doesn’t work

and by the time you are driving away from the building, your resident is already taking a shower and your fresh caulking is washing down the drain. Your caulk should cure at least 24 hours before use. Water based latex caulking is easy to use, but very susceptible to water until it is cured. Try using a silicone or polyurethane based caulking for doing tubs, showers, toilets, sinks or other wet locations. It tends to set quickly and will repel water during its

cure time. Another solution we have found works well with very busy showers is to remove all the fixtures, including the showerhead & arm, valve handles and tub spout, before caulking. (A bit extreme, but effective) We then plug the showerhead and tub spout with a capped pipe. Then caulk the tub/ shower. We come back 24 hours later and reinstall all the fixtures. One more thought; if you have slid-


ing shower doors for your tub, check the bottom track. If it is loose, do not caulk until the track is removed, cleaned and dried. Reinstall the track with new adhesive caulk to hold it down and caulk the edges to keep the water out.

Install lighting in areas prone to graffiti. Motion activated lights also work well to deter vandals. (If you have a sense of humor, install motion activated water sprinklers.) 3. Planting vines or bushes along a wall or the side of the building is a good long-term solution. As the landscape grows, it will make it more difficult to graffiti your walls. 4. Use an anti graffiti paint. The graffiti will easily wash or wipe off making repainting a thing of the past.

The smell may come from a number of places. 1. The first and easiest to check is the rubber splash guard that keeps things from falling into the disposal. Remove the rubber splash guard and turn it inside out. Clean out the debris that have collected and wash with soap and water.

2. Use a small toilet type bush with soap and scrub the inside of the garbage disposal. This will remove any slime build-up. (For safety reasons, shut the garbage disposal off at the breaker or pull the plug.) 3. Remove the drain trap and clean out any sludge. Many times the horizontal pipe between the trap and the wall may have hard deposits coating the inside of the pipe. The deposits will collect food and

debris that may slow the drains considerably. 4. If you have a dishwasher, check the drain line leading from the air-gap or dishwasher to the garbage disposal. It may be full of sludge that will cause a smell to come through the air-gap located next to the faucet. Clean or replace any pipes with deposits or sludge. Check both drain lines for the above problems. 5. Now if you wish, run the garbage disposal with a few slices of lemon and it should smell good and stay that way. Once in a while, throw some ice cubes in the garbage disposal unit to help scrape away any debris. Rent Control Would Make California Housing Crisis Even Worse

D

uring World War II, while New York City was crowded with GIs waiting to be shipped to Europe to fight Hitler, it adopted a “temporary” rent-control system in 1943. Despite the impending end to the war just a couple years later, “temporary” effectively became permanent. Nearly eight decades later, rent control still plagues that city — and many others — by discouraging the only solution to any shortage: producing a greater supply, in this case, more housing. I bring this up because some politicians in California again are pushing rent control as a “solution” to the state’s housing shortages and homeless crisis. Commendably, on January 11 the Assembly Housing and Community Development Committee failed to pass AB 1506, by Assemblyman Richard Bloom, D-Santa Monica. It would have allowed cities to impose what’s called “extreme,” or “vacancy control,” rent

control, limiting a unit’s price even when a tenant moves out. Ironically, Bloom’s home city of Santa Monica already imposes some of the strictest rent controls in the state — yet, according to a report updated January 18 by Apartment Guide, it has the highest rents in the entire United States. At an incredible $4,799, a dinky flat in the Socialist Republic of Santa Monica, as some call it, is even higher than the Big Apple’s $4,563! Other rent-controlled Golden State cities on the most-ludicrously-expensive list include San Francisco (6th worst, at $3,880), West Hollywood (22nd, at $3,180) and Berkeley (25th, at $3,121). The rent controllers don’t get that limiting market forces only prods owners to convert apartments into condos, or tear them down and put up singlefamily or other housing. But, shrinking the number of apartment units reduces supply, which raises rents. If apartment

Why are we even discussing this inappropriate solution? Because the “deep-pocketed Los Angeles activist, Michael Weinstein,” as the Sacramento Bee described him, is “bankrolling a proposed November ballot initiative” to allow cities to impose “extreme” rent control. Sometimes we have to help people from themselves. This effort must be opposed. I urge the members of the Apartment Association of Orange County to lead the fight against this misguided proposal. Reasons Why Good Tenants Don’t Renew Leases

W

hy must good things come to an end? That’s the question you ask yourself when a model tenant decides that they don’t want to renew their lease. Now you’re back to the beginning, searching for another renter who will hopefully pay the rent on time, respect the property, and actually be pleasant to deal with when making maintenance calls. But why do good tenants leave in the first place? Sometimes tenants have to leave for reasons beyond your control. Maybe their financial situation has changed, their job relocated them, or the space isn’t big enough for their growing family. Maybe they need a change in scenery, the neighbors are annoying, or they want to be closer to home. Personal circumstances change all the time, and there’s no guarantee that the lack of renewal relates to the property. However, there are some factors that could push them to look for a different property in the area: 1. Lack of Trust As your parents always told you growing up, trust is a must. If you

can’t trust a tenant to keep the property in good shape or they can’t trust you to have repairs done in a timely manner, there simply cannot be a lasting relationship between the two. It’s important for renters to be able to trust you to take care of the property, and to feel comfortable dealing with you. Reach out to your current tenants, or start off a new tenant relationship on the right foot by providing a small welcome gift.

Another thing to consider in our ever technology obsessed society would be to offer options such as online rent payments, which would make your tenants life easier come the first of the month.

2. Lack of Communication Communication is key. Tenants like to be in the know, and a simple text can keep them up-to-date with the status of repairs or easily answer any questions they may have. If they find it difficult to get in touch with you or feel that you don’t share enough information with them, then they won’t want to continue renting your property. Be sure to encourage two-way communication, and your renters will appreciate it.

4. Increase in Rent It’s understandable to have to raise the rent to keep up with market demands, but there is no guarantee that your tenant will be happy with it. Big surges in rent price is likely to stop renters from renewing a lease, much more so than small increases. Consider working with your tenants to come to a compromise if they are unable to adjust to the new rental amount. Be sure to reference popular rental sites beforehand in order to view the comps your renter is sure to review after receiving their rental

10 Reasons Why Beneficiary Designations Are Important

B

eneficiary designations can provide a relatively easy way to transfer an account or insurance policy upon your death. However, if you’re not careful, missing or outdated beneficiary designations can easily cause your estate plan to go awry. We often complete these designations without giving it much thought, but they’re actually important and deserve careful attention. Here’s why: Beneficiary designations take priority over what’s in other estate planning documents, such as a will or trust. For example, you may indicate in your will you want everything to go to your spouse after your death. However, if the beneficiary designation on your life insurance policy still names your ex-spouse, he or she may end up getting the proceeds.

Where you can find them

Here’s a sampling of where you’ll find beneficiary designations: • Employer-sponsored retirement plans [401(k), 403(b), etc.] • IRAs • Life insurance policies

• Transfer-on-death (TOD) investment accounts • Pay-on-death (POD) bank accounts • Stock options and restricted stock • Executive deferred compensation plans Because you’re asked to designate beneficiaries on so many different accounts and insurance products, it can be difficult to keep up. However, it’s worth the effort; failing to maintain the beneficiary designation on that 401(k) from three employers ago could mean money will go to the wrong place. When you first set up your estate plan, go over all the designations you previously made and align them with your plan. After that, you should review and update them regularly — a least once a year.

Because beneficiary designations are so important, keep these things in mind in your estate planning: 1. Remember to name beneficiaries. If you don’t name a beneficiary, one of the following could occur: • The account or policy may have to go through probate court.

This process often results in unnecessary delays, additional costs, and unfavorable income tax treatment. • The agreement that controls the account or policy may provide for “default” beneficiaries. This could be helpful, but it’s possible the default beneficiaries may not be whom you intended. 2. Name both primary and contingent beneficiaries. It’s a good practice to name a “back up” or contingent beneficiary in case the primary beneficiary dies before you. Depending on your situation, you may have only a primary beneficiary. In that case, consider whether a charity (or charities) may make sense to name as the contingent beneficiary. 3. Update for life events. Review your beneficiary designations regularly and update them as needed based on major life events, such as births, deaths, marriages, and divorces. 4. Read the instructions. Beneficiary designation forms are not all alike. Don’t just fill in names — be sure to read the form carefully.


5. Coordinate with your will and trust. Whenever you change your will or trust, be sure to talk with your attorney about your beneficiary designations. Because these designations operate independently of your other estate planning documents, it’s important to understand how the different parts of your plan work as a whole. 6. Think twice before naming individual beneficiaries for particular assets. For example, you establish three accounts of equal value and name a different child as beneficiary of each. Over the years, the accounts may grow unevenly, so the children end up getting different amounts — which is not what you originally intended. 7. Avoid naming your estate as beneficiary. If you designate a beneficiary on your 401(k), for example, it won’t have to go through probate court to be distributed to the beneficiary. If you name your estate as beneficiary, the account will have to go through probate. For IRAs and qualified retirement plans, there may also be unfavorable income tax consequences.

f you attended the AAOC General membership Meeting January 16, you learned a lot about what AAOC has been doing for you, plus important tips about keeping us all out of trouble. If you were not there, here is a recap for you. Steve Duringer addressed our various challenges and commended our membership for involvement in our legislative work. Our Legislative Misfortunes. Legislation adverse to our industry is often the result of our own behavior. Reflect on the consequences of your decisions regarding your residents. No one is telling you what to do, and you are the keeper of your own conscience.

However, large rent increases and arbitrary evictions are two examples where our industry is vulnerable to the wrath of disgruntled tenants and the legislature. One example: We are restricted in our ability to use the 30-day termination of rental agreement, because of the rash actions of one rental owner in central California. He had a lot of low-income rental units. For some business reason, perhaps to renovate his units, he gave about ninety families 30-day notices to move, all at one time. There were not enough vacancies in that rural area, and these families had no place to relocate. They complained, and now we have a law requiring us to give 60-day notices

instead of 30-day notices. Due to the advocacy of AAOC, we persuaded the Legislature to allow us the ability to continue to give 30-day notice to residents who live with us less than one year. We argued that we use this notice to remove disruptive tenants, as their behavior usually exhibits itself early in the tenancy. If I recall correctly, the Los Angeles Rent Control was precipitated by extremely large rent increases given by one large landlord. Our State Legislative Efforts. In the past year, the State Legislature passed

Our industry is very vulnerable to adverse legislation. AAOC members are welcomed to join or sit in on the meetings of our Legislative Committee. They are held on the second Tuesday of each month at 4:30 PM at the AAOC offices. AAOC worked for years to combine with other California rental associations, to present a joint legislative effort in Sacramento. We now have CalRHA (California Rental Housing Association) and members of our Board regularly attend their meetings. Through CalRHA,

we have the help of three lobbyists who join forces to advocate for us. They watch, oppose, or suggest amendments to various bills relating to our industry. All those bills are created to restrict our freedom to conduct our rental business in an economic and profitable manner. Local Legislative work. Our volunteer Board of Directors maintains close communication with staff and councils in many cities. The recent inclusion of rent control as a factor to ameliorate homelessness, in a workshop paper created in a large Orange County city, caught the attention of our Board members. They were able to get the subject of rent control expunged from the workshop paper and from the ensu-

ing discussions. State Rent Control: This is a manyheaded dragon. Our recent defeat of AB1506 (the bill to repeal Costa Hawkins,) is a great sign of our power and solidarity. But we must fight in every single city in California, and know the hearts and plans of every councilman and every city staff person. We have worked so tirelessly on legislative issues that AAOC is now a respected heavy hitter locally and in Sacramento. No other rental association has been as productive as AAOC. The Legacy Myth

A Continuation of the Family Story

F

or the past 24 months, my father, Bill Gorman, has written a series of articles based upon his book, Cash In on the Myths of Real Estate. Now it is my turn to talk about a topic that is important to me, my family and the families of my clients — Legacy Planning. My understanding of this subject derives not just from personal experience, but from research, serving on the AAOC Board of Directors, and working with our clients. As a CPA and entrepreneur, I learned how to run the numbers, look at all the options and make informed decisions. In a sense, that is the very same disciplined approach that I am taking as a real estate broker at WR Gorman & Associates. Most people think that legacy planning and estate planning are basically the same. But that is not really the case. Don’t get me wrong. Estate planning is important and requires selecting the right will or trust as well as making sure

that you have the proper legal structure to execute your plan. A good estate attorney will be able to help you get everything in order. However, an attorney should not be your first stop in the process. Actually, it all starts with you. Legacy planning is identifying how you want to be remembered and then, formulating the means to create the type of impact that you want to make — both during your lifetime and afterward. The objective is to develop a solid foundation for the future that you hope will evolve. At the same time, you need to secure your assets in a fashion that will ensure that those assets will always be there to fulfill the legacy that you envision. The process begins by spending some self-evaluation time and asking yourself those hard questions. What do you want to have happen to your properties? What purpose do you want your wealth to serve? What is your hope for

the future of your heirs and their heirs? Then, you need to seek out the right resources to help you execute your wishes. The answers will come from many different sources — your tax attorney, your CPA, your investment broker, your real estate advisor, your heirs, your spouse and, most importantly, yourself. The difficult part is to ask the right questions and to remember that this is not a static process, nor one set in stone. Here’s an info graphic that might help: Your Wishes & Goals

Are there any maintenance or other deferred liabilities? Tax Concerns — Will probate or other taxes force a sale? Have you done everything possible to minimize taxes? The Legalities — Are your will and trust up to date? Are you holding title in the most beneficial manner?


There are numerous resources available to guide and assist you through the legacy planning process. Rather than relying upon one specialist to put your entire plan together, use your trusted advisors according to their particular areas of expertise. If you want your legacy to extend beyond your immediate heirs and beneficiaries, you might consider some type of philanthropic giving. Most universities, colleges and hospitals have foundations or planned giving departments that help arrange for charitable gifts or donations. Non-profit organizations and charities often have information on their websites as well as individuals to contact regarding how to specifically phrase your bequest. If you own income properties, consulting with your real estate advisor should be included in this process. A real estate expert can provide you with not only a current evaluation, but help you make sure that your real estate holdings are well-secured and properly aligned with your legacy wishes and goals. Finally, your Legacy Plan must be communicated to your heirs. Your legacy might not be welcomed as envisioned if the first time your heirs learn of your wishes is after you are gone. Reading this article is a good initial step and I would encourage you to continue along the pathway of asking questions and seeking advice from a variety of trusted advisors.

Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. In many cases, the inspector finds a problem, tells the insurance underwriter and the policy is cancelled. This usually necessitates the apartment owner to go into a non-standard market for a year or more with substantially higher premiums. This is why it is crucial that an inspection is done prior to being quoted by an insurance company. Avoid having a cancelled policy due to the “bugs” being found after the policy is in place.
