No Time to Waste… Keeping Up and Keeping On

B

y the time you read this, we will have already entered the third month of 2020. Yes, time flies!

Keeping Up…

The AAOC has prepared a year full of special events, seminars, and other educational opportunities to help its members prepare for and address challenges to their private property rights, the operation of their rental properties, and the long-term stability of their business. I would like to encourage all members to keep and reference the December 2019 and January 2020 issues of AAOC’s Apartment News magazine. Both issues feature extremely valuable content, with the contributors taking extra care to articulate, in an reader-friendly and digestible format, answers to many of the difficult questions our members may have throughout the year. In the December 2019 issue, AAOC state legislative advocate Ron Kingston offered a truly valuable read in his Sacramento Report, entitled “Implementing AB 1482 Statewide Rent Control and Just Cause Evictions.” This virtual road map for navigating California’s rent control and just cause eviction law is extremely helpful and should be kept as a quick-reference guide. In the January 2020 issue, AAOC Vice President of Government Affairs Bill Christiansen went into depth, in his Orange County Legislative Watch article, entitled “Big Changes for the 2020 Elections in Orange County,” about the county’s new vote by mail

system, as well as other changes affecting voter registration, voting options and ballot processing, and how it will impact our elections moving forward. The article also provided some interesting political insight into why California’s Primary Election was moved to earlier in the year and how that will affect California’s standing on the national political stage. Also, in the January 2020 issue, AAOC board member Stephen C. Duringer (Duringer Law Group, PLC), dedicated his Legal Corner question and answer column to addressing some of the burning questions rental property owners have about AB 1482. Additionally, a stand-alone article from Mr. Duringer entitled, “Tenant Protection Act of 2019 — Just Cause Eviction and Rent Control [AB 1482],” breaks down the different component of the law and offers additional guidance to rental-property owners. Finally, you may wish to reread the quarterly PULSE on the MARKET PLACE column, which is produced exclusively for Apartment News magazine by Nick Lieberman, president of Bona Fide Mortgage and a member of the AAOC Board of Directors. Nick provided us with his “2020 New Year’s Considerations for Orange County Apartment Values.” It contains all of the information at your fingertips with key financial data and an easy to read analysis of other considerations.

A Time to Work and a Time to Play

R

ental property owners and operators are some of the hardest working and personally vested people whom I have met in the business world. Independent owners who self-manage their properties, feebased management companies and their staff, corporate owners and their regional and onsite leasing agents and managers, maintenance techs, porters, and others. Likewise, I have found this same level of hard work and personal vestment in so many of the small business owners and employees who provide the products and services that help rental property owners and operator keep their communities operating smoothly, safely, and responsively. Whether they’re on the ownership/ operational side or the vendor side of the rental-housing industry, you have dedicated men and women who are committed to the work they do and keeping our industry strong. However, too much work without balancing it with some relaxation and fun is not good for anyone. AAOC has some events this spring and summer that can provide its members with some of that balance. The AAOC Trade Show & Conference on Thursday, March 26, at the OC Fair & Event Center, presents an opportunity for rental-housing providers and industry suppliers to do business in a relaxed environment while also having a little fun with the show’s theme: “Rental Housing: Roaring into the 20s.” Join us as AAOC travels back 100 years

What’s Next After Statewide Rent Control and Just Cause for Tenancy? each property including all limited partners, general partners, LLC members and shareholders.

AB 2406 will require you to register your units with the state in order to evict or raise rent.

N

o residential property owner that “operates fewer than five rental dwelling units” will be able to increase rent or evict a tenant unless he or she submits detailed data regarding the rental housing that he or she owns if Assemblymember Buffy Wicks is successful getting her bill, AB 2406, signed into law this year. So, let’s look at greater detail what the bill will propose to do. First, the state, namely the Department of Housing and Community Development, would create a statewide registry of residential properties. The registry would require every owner of five or more units on one or more properties to annually report invasive information that the state would collect. Failure to complete the report by an owner or manager would have severe consequences as previously noted. The rental registry form would include the following information: • The legal address of each property. • The year the owner acquired the property (which may be very difficult should a change of ownership occur during a fiscal year). • The occupancy status of each tenant. • The reason for termination of tenancy for each tenant. • The legal name of the owner(s) for

• The number and size of each unit, including the number of bedrooms, bathrooms, and approximate square footage of each dwelling unit. • The month and year that most recent occupancy began. • The total number of days the unit was rented during the most recent 12 months. • The amount of payments collected for rent and utilities during the most recent 30-day period for each rental units and the number of days the unit was vacant. • The month and year of the effective date of the last rent increase for each rental units and the amount of the increase. • The number of tenants that have been evicted from the owner’s units in the last 12 months. • Property owners would submit the completed form for each property, under penalty of perjury, on or before April 1, 2022 and on or before March 31 of each following year. The Department of Housing and Community Development estimates the start-up costs would be in excess of $20 million to procure an information technology system, to at a minimum provide an owner portal to submit information electronically. That same

department estimates the first-year costs to operate the system would be $8.7 million and ongoing costs of $7.9 million and need 53 staff to perform the required duties, management and maintenance of the program. Are you ready to submit matters that will invade the privacy of owners and tenants by disclosing addresses, utility costs, the number and size of their bedrooms and bathrooms? Some argue that owners and managers cannot enter the rental unit while it is occupied to determine square footage, etc. So, if a tenant refuses to grant access into their home, owners will be forced to choose which law to obey. Are you ready to make each tenant’s rent payment history public? This may include missed rent payments. And interestingly, the bill would require owners to disclose information about evictions when that information is more likely than not currently “masked” by the courts. This eviction information is a matter that tenants successfully sought to hide from the public and now it will be opened for public review.

y grandparents moved from New York City to Southern California in 1946. They grew up in high density New York City housing where they could hear their neighbors fighting, they couldn’t park their cars in front of their stacked buildings, and Mrs. Smith next door would hang her laundry on the fire escape ladder. crisis is getting worse. The status quo is not working. But as much as we like to complain about high housing costs, traffic congestion, and dwindling open space, we remain attached to an old version of the California Dream: single-family homes with big green lawns and swimming pools out of a David Hockney painting.” Yes, this is what most Californians work so hard to achieve for themselves and their families. This is their California Dream, but state lawmakers are creating nightmare scenarios for our communities. The Bay Area Progressives who are driving so much of today’s state housing policies are trying to tell us we need more high-density housing, even in communities where it doesn’t necessarily fit and is not necessarily wanted. Senator Scott Weiner introduced last year, SB 50, which would have overridden local zoning laws to allow the construction of high-density housing in most suburban neighborhoods in Orange County. His goal was to bypass local city plan-

ning approval processes and allow Sacramento to decide if high-density housing complexes could be built on your street. The bill was defeated by three votes just a couple of months ago. Scott Weiner and his fellow Bay Area politicians want to force the hands of local lawmakers in Southern California with top down policies that will result in them having to “defy” their NIMBY constituents and others who may not embrace the progressive “solutions” being proposed to solve California’s housing crisis. There are other and better ways to address the housing supply and affordability issues presently before us. Hopefully, state lawmakers will learn from the defeat of SB 50 and take a different approach that will respect local control and land-use decision making by our cities and their locally elected officials.

Questions & Answers I understand that when I serve my notices to pay or quit, I can post it on the door if the tenant isn’t home or doesn’t answer the door. I then have to mail it by regular mail. Is that correct? Am I missing something?

Yes that is correct, however there is a statutory requirement that you attempt to serve the notice at your resident’s place of employment, if known, before you post and mail the notice. Most folks don’t know that requirement and simply post the notice. A good tenant attorney or a seasoned judge will know the requirement and may ask the witness in court if they tried to serve the notice at the resident’s workplace prior to posting it. If the answer is no, then the court might rule in the tenant’s favor due to the failure to comply with the statutory requirement. If the truthful answer is that you are unaware of the current place of employment, then service by posting and mailing would be fine.

I received a letter from my local city code enforcement officer. It was a bit testy. In short, the code enforcement officer demanded that I allow him entry to one of my rental units in order to perform an annual city inspection. He even threatened me if I don’t comply. I’m not sure what to do, I am not aware of any issues and I have not been cited for anything. Do I have to allow him in?

As a general rule, we as housing providers want to cooperate with our city officials, and generally should assist in their good faith efforts to ensure that the housing stock is in good repair. The vast majority of city code enforcement officers respect housing providers and residents’ rights and enforce a ‘broken window’ approach to inspections. That is, if there is visible problem with housing, i.e. a broken window, then the inspector will concentrate on that particular building rather than engage in a blanket inspection of every unit in the

city, with or without any visible sign of dilapidation. You as the housing provider do not have a right of possession to the rental unit after you have entered into a lease agreement and provided the keys to your resident, and therefore you do not have the power to enter the premises except as narrowly provided for in CC §1954. That code section does not contain a provision allowing access to simply inspect. That right of possession belongs to the resident in possession. If you as the housing provider are notified of a ‘broken window’ or some other dilapidation, then as a responsible property owner, you would resolve the issue, repair as needed, and if the damage is caused by the resident, pass the cost on to the tenant as appropriate. If however, the inspector is simply demanding that you provide access for no other reason that his desire to inspect, then you can remind that inspector that state law does not provide you that ability, that absent a court order, the resident is in possession, not you, and that the resident is the person that the inspector should be communicating with and requesting access, not you. My apartment building has always been a nice and quiet community, no bother, no worries. Everyone keeps to themselves; never have complaints about behavior. Apparently they claim to be ‘disabled’ and that because they are ‘disabled’ they get to do whatever they want. Huge clouds of smoke literally billow out of their apartment! I’m concerned about lots of things, but mostly, the little girl who lives next door, I believe that she’s asthmatic. How much more of this must I, and the neighbors take?

The audacity of some medical ‘professionals’ to abuse and game the system by willfully proscribing the use of ‘medical marijuana’ to non-disabled fraudsters is an affront to all truly disabled persons. As of this writing, the use of marijuana, medical or otherwise, is still illegal under federal law however the authorities have elected to stay any enforcement and prosecution for the use and or possession of ‘medical marijuana.’ California enacted the Compassionate Use Act which allows

for the possession of a limited amount of marijuana, for personal use, provided certain requirements are met. The right to ‘smoke’ marijuana in your apartment community is not automatic and will depend upon the individual facts of each case. The use of medical and nonmedical marijuana is illegal under federal law, and cannot be used or smoked anywhere, including your community, and can be grounds for termination of their tenancy. The use of medical marijuana requires that the user be disabled, and the disability must be ‘verifiable.’ Additionally, the disabled individual must request a “reasonable accommodation” from you the housing provider prior to just lighting up. Once the disabled person makes the request for a reasonable accommodation, you are obligated to consider the request, and attempt in good faith to accommodate the request in a reasonable manner. The accommodation does not necessarily require you to ‘grant’ the request outright, but you must make a good faith effort to provide an accommodation that addresses the disability, but does so in such a manner that it does not unreasonably ‘burden’ you the housing provider. The courts will apply a “benefit to the requestor” versus a “burden to the housing provider” standard in determining whether or not you met your obligation to reasonably accommodate the disability. In your specific situation, the initial hurdle for your new residents to surpass is to establish that one or both truly has a “verifiable” disability. A ‘doctors’ note provided it has not been forged, although highly suspect will generally satisfy the extremely low threshold here in California. The reasonable accommodation, their request to smoke willy nilly within the apartment, must be balanced with the ‘burden’ to you the housing provider, and those other residents that might be affected, i.e. the asthmatic child living next door. It is conceivable, and probably likely, that an asthmatic child when exposed to the smoke billowing from next door might


have a devastating and fatal reaction. Certainly, the neighbor child, with a truly verifiable disability, asthma, is entitled to be free of the exhaled smoke as a “reasonable accommodation” for her verifiable disability. When balancing the benefit to Cheech and Chong of being able to light up in their apartment, with the burden to you as well as the extreme life threatening burden to the asthmatic child, courts would most likely find that a reasonable accommodation would be to prohibit the smoking of the marijuana within the apartment unit, or in any place that might affect the asthmatic child, or others with such a sensitivity to smoke, but provide an area within the community, possibly a portion of the outdoor common area that may be used for the smoking of their medical marijuana. Alternatively, there are other methods of delivering the active ingredient in marijuana, i.e. ingestion, pills or tablets, food based, etc. Remember, reasonable accommodation issues are extremely fact sensitive and the analysis is dependent on a proper review of the relevant facts. Always contact an experienced attorney when faced with a request for a reasonable accommodation, as the issues are typically complex and a reasoned response must be made in a timely manner. I have a hard-of-hearing resident. She uses a Ring Doorbell with camera but it doesn’t always alert her when someone is at the door. I thought of a doorbell with a flashing light. I know these types of doorbells exist but I can’t find one that directly replaces my doorbell with a bell and flashing light. There are several available that run on a battery and require another doorbell button to be added. With these, I worry the battery will die and I will be constantly changing it. Do you know of a flashing light/doorbell which would directly replace my existing doorbell? Thanks for your help. John

Dear John:

There are several different options on the market for you to choose from — both hardwired and battery operated. Quality battery operated devices use a 10-year, sealed lithium battery which helps to avoid constant change-outs. The installation of an audio/visual door alert for the hearing impaired comes in handy for knowing when to answer the door. Just as important, the installation of audio/visual CO and smoke alarms are critical for knowing when a hearing-impaired person should exit the door in an emergency. For hardwired devices, EdwardsSignaling Corp. makes a Hotel Room Annunciator Kit that easily replaces your existing doorbell and chime system for single button function and operates using your existing 24v transformer.

However, we recommend using the transformer included in the kit. The chime is replaced with the combination signaling horn and strobe light. Harris Communications also manufactures a very inexpensive Doorbell Strobe Signaler that readily connects to any 24v transformer and you simply replace it for your chime. For battery-operated or wireless doorbells and audio/visual “chimes,” Nutone and scores of other companies manufacture battery-operated doorbell buttons to replace your existing one and come with one or multiple audio/visuals alarms that plug into any 120v outlet. They are sold in kits and can be purchased for one room or the entire dwelling. When dealing with a batteryoperated system, chose quality over price. For fire, life and safety devices, Kidde, First-Alert and Gentex manufacture great combination CO and smoke alarms. They are ADA compliant devices for the hearing impaired and can be purchased as either battery operated or hardwired. The best part is they are available at any big box hardware store. Note: The big take away from this particular question is, anytime you are presented with maintenance issues that may lead to ADA requirements or “reasonable accommodations,” consider your approach and performance very carefully. This includes consulting with professionals. ADA requirements are very specific in regard to the installation and locations of devices and equipment.

What a great question! Yes, we do have a few tips. 1. We like to start at the top and check the roof for any winter-time damage. Check the flashing, roof transitions and fascia boards. Don’t forget to check any downspouts and drain covers. 2. Check all the windows and make sure they well sealed. Clean out the weep holes in any aluminum window frames and caulking on wooden windows. This is a good time to put a drop of grease on the moving parts of the crank out windows. Check screens for holes and replace any missing screens 3. Check the proper operation of all smoke and carbon monoxide alarms. Keep note of the original install date and the date each alarm was checked thereafter for your records. 4. Check the building’s siding, brick and stucco walls for cracks, peeling paint and rot. 5. Clean out air conditioning filters and vents. Remove any lint, dust and dirt from around A/C coils. 6. Wood floors take the most abuse of any wood product. The floors need to be protected from scratches, spills, foot traffic and any grit and dirt on the surface. Polyurethane finishes provide a hard, durable finish that wood floors require. Polyurethane is easy to apply, however it is best to use a natural bristle brush rather than a foam pad. The foam pad will leave air bubbles in the finish. Sand properly to remove any loose finish; this will allow the new finish to adhere properly. When applying the polyurethane finish, allow the first coat to dry overnight, and then sand it lightly with a 220-grit sandpaper. Always apply a second coat, but we recommend a third coat to ensure the best protection and look for your wood floors. We need Maintenance Questions!!! It’s important to arm yourself with the facts when assessing your options about earthquake safety. This makes sense, not only from a business perspective, but it also helps to build resiliency within our communities — and that benefits everyone. According to the Federal Emergency Management Agency, there are three factors to consider when determining your property’s seismic risk. They include: the level of the seismic hazard, the number of people affected by the hazard, and the vulnerability of these people and potential loss of property value to the hazards. The United States Geological Survey determined that 300,000 structures would be damaged in a 7.8 San Andreas earthquake. That’s one in every 16 buildings in our region. The composition of your apartment is therefore another important factor to consider. Building safety experts have determined the following building types to be most at risk of damage from an earthquake: Soft-story structures built before 1978: This style is common among apartment buildings, characterized by open parking on the ground floor and dwelling units built above. In some instances, the ground floor may be used as retail space and enclosed by windows that do not provide any structural support. These wood-framed structures are considered extremely vulnerable to

collapse in a major earthquake. Non-ductile concrete buildings built before 1977: These structures have concrete floors and/or roofs supported by concrete walls, columns and/or frames. Due to their rigid construction and limited capacity to absorb the energy of strong ground-shaking, these structures are at risk of collapse in an earthquake. In fact, non-ductile concrete buildings make up the majority of earthquake losses around the world. Because they are frequently used for office and retail uses that draw large numbers of people, the potential for death and injury with these structures is of particular concern. Tilt-up construction built before the 1994s: This type of building began in the early 1900s, but didn’t really catch on until the post-World War II construction boom. This cost-effective technique of pouring a building’s walls directly at the jobsite and then raising or “tilting” the panels into position was Earthquake Test — continued on page 24

Earthquake Test — continued from 22 and continues to be a popular way to meet California’s demand for new commercial buildings. The walls of a concrete tilt-up building can weigh between 100,000 and 300,000 pounds. Steel plates with headed studs are positioned into the forms prior to pouring the concrete to establish viable connection points that secure the walls to the foundation and the roof trusses to hold them in place.

Many tilt-up structures built prior to 1994 were constructed with limited or weak connections that have been proven to fail in an earthquake, causing severe damage and/or collapse. These building defects can be easily corrected with seismic retrofitting. Steel moment frame construction dates back to the 1880s with the very first skyscraper, the Home Insurance Building in Chicago, but this building technique was most commonly used in the 1960s to 1990s.

Steel moment frame construction is characterized by the use of a rigid steel frame of beams connected to columns to support the many floors of the structure. These structures, when built before 1996 following The Northridge earthquake, can sustain brittle fracturing of the steel frames at the welded joints between the beams and the columns. In fact, many moment frame buildings in Southern California reveal cracks and fissures in these frames and may be susceptible to collapse in a major earthquake. Unreinforced masonry buildings make up many of the older structures typical in downtown communities. They are characterized by walls (both load-bearing and not) and other structures such as chimneys that are made of brick, cinderblock, or other masonry materials not braced with rebar or another reinforcing material. URM structures are vulnerable to collapse in an earthquake, due to a general failure of the mortar or when portions of the masonry such as parapets peel from the building façade and fall onto the sidewalk below. There is the loan process, the seller, the residents, due diligence, escrow, title companies, and mountains of paperwork. Keeping informed about everything involved in the process is a daunting task, at best, for a prospective buyer. Nobody Gave Me — continued from 26 article will assist prospective owners in finding out about the possibility and validity of an existing lease before escrow closes. There are three basic types of notices indicating that there may be an existing lease for the laundry space: Actual notice — The prospective buyer knows of the existence of the lease. This is the case in most purchases. The buyer may receive information about, or a copy of, the lease from the seller, their agent, the escrow or title company, etc. Constructive notice — The lease may have been recorded in a County Recorder’s Office. The recorded information should come up in a title search. Note: Although the title search should show the existence of a recorded lease, it may not give the entire terms of that lease. The laundry company should be contacted to have a copy of the entire lease put in the escrow.

Inquiry notice — Most laundry companies have signs in the laundry rooms and/or on the machines with their company name, phone numbers, etc. California law is straightforward in saying that this clear and apparent possession gives the prospective buyer an affirmative duty to inquire as to the basis under which the vendor is in possession of the laundry space. When doing due diligence and walking the property, the laundry facilities should not be ignored. Let’s briefly discuss foreclosures. Not all leases are extinguished by a foreclosure process! Generally speaking, a lease is extinguished if that lease is subordinate to the foreclosed deed of trust. In a case where the lease is dated prior to the note that was foreclosed upon, the lease is generally considered senior, not subordinate to the foreclosed deed of trust. The lease would still be valid and in full force and effect. Again, not every case is clear cut, and there may be other circumstances to be

considered, but this a dependable “ruleof-thumb” tool. Generally speaking, Leases of Laundry Space “carry with the land.” If a new owner comes in, they are bound by the terms of the laundry lease currently in place, similarly to the rental leases with the residents. A purchaser cannot arbitrarily go in and cancel all the leases in place with the previous owner. There are cases where a purchaser of a property thinks the lease is not binding, and the laundry company contends that it is. In this case, the property owner should not remove the laundry provider’s equipment, just as the owner cannot go into an apartment unit and simply dispose of the resident’s belongings. The law mandates proper legal process be followed (i.e. An unlawful detainer action). “Self-help” remedies, such as denying residents and the laundry company access to the facilities or removing the Nobody Gave Me — continued on page 30

These actions could force the vendor to file a Forcible Detainer action, which could include recovering possession of the premises, actual damages, additional damages allowed by statute, attorney’s fees under the lease, and other relief allowed by law. Most laundry companies are more interested in discussing an amicable solution than proceed with litigation; however, they have the lawful right to enforce the terms of their lease. Bottom Line — If you cannot work something out with the current laundry company, get dependable legal advice to help you proceed accordingly. Contacting an attorney with experience in “contract law” is recommended and may save you time, energy and money in the long run. plus the change in cost of living, as measured by the Consumer Price Index (CPI), for all rent increases occurring on or after March 15, 2019. He also explained how the law also now requires landlords to have just cause in order to evict tenants who have occupied a unit for at least 12 months, or up to 24 months, when an adult tenant adds onto a lease (i.e. when there is a change in roommates). Exempt from the law

— at least for now — are single family homes, condos and townhomes that are operated as rentals. Duringer noted that if you issued a notice of change of terms, increasing the rent that resulted or will result in a new rental rate as of January 1, 2020, which exceeds the allowable percentage increase, then you should provide

Meeting Recap — continued from 34 notice to your residents as effective January 1, 2020. The new rental rate will also need to be reduced to the maximum allowable rental rate. For example, if your rent on March 15, 2019 was $1,000.00 and you subsequently increased it to $1,250.00, your maximum allowable rate on January 1, 2020 would be $1,083.38, if your property is located in the Los Angeles, Long Beach, or the Anaheim region, and you should notify your resident of this fact. Duringer indicated that the vacancy decontrol provisions established in the Costa Hawkins Rental-Housing Act is unaffected by AB 1482. When the unit becomes vacant, either after eviction or voluntary move-out, the rent can be adjusted to market rate, without restriction. However, the rent control initiative that has qualified for the November 2020 ballot seeks to eliminate these provisions.

Overall, Duringer expressed the belief that AB 1482 was poorly drafted and is confusing and vague. He believes it will be applied inconsistently by the courts and that we will see further changes in state law, that will affect rental rates, other property rights for owners and operators of rental property, and even a significant increase in taxes. In conclusion, Duringer strongly recommended that members obtain and use the updated 2020 legal and operational forms available from AAOC for their rental businesses and to contact the association if they have questions. Seattle Eviction Ban: No Facts, No Data, Higher Rents, More Evictions

I

n late January, a committee of the Seattle City Council edged closer to passing a ban on evictions from November to April because it is cold outside during those months. At best, the effort is misdirected compassion and at worst it is an effort to sow chaos in the rental housing market in order to gain power for a narrow band of tenant activists and Seattle’s socialist City Councilmember Kshama Sawant. More broadly and regardless of the motiva-

tion, the imposition of such a ban will fuel inflation in a housing market already struggling to produce housing because of excessive regulation. New Seattle Councilmember Tammy Morales summed up the heedlessness of the Seattle City Council best. “I appreciate that there is more data that we need perhaps to understand the scope of what we’re talking about better to understand the cost of what other programming what other funding we might

need to be thinking about,” she said. But, she said, “In my mind it really doesn’t matter if we’re talking about eviction by private corporations or if we’re talking about evictions of people from public housing or public entity or some private building.” Morales said the only concern was to keep people safe from the trauma of eviction. Eviction Ban — continued from 44 something that, evidently, in mind of Seattle City Councilmembers is a force of nature, or a crime against a tenant. Forget about the fact that people who rent private property for thousands of years have generally been obligated to pay for the use of that private property. Eviction is not a crime. Far from it. Eviction is the culmination of a costly effort undertaken through the court system by a property owner to remove a person holding private property for cause. The Seattle City Council’s behavior is fueled by politicians like Morales pandering to the left, free of the constraints of the facts or reality. If we don’t like something because it traumatizes someone, just ban it. I heard from a tax credit attorney and insurance broker who explained the impact of these “compassionate” moves by the Council. I asked what would happen with housing subsidized with tax credits and private housing. The

lawyer said, “The tax credit investors will not like it because it increases operating risk. But, remember, they will simply make developers escrow more money to cover the potential loss of revenue and protect their own yield. So it’s the developers who will need more financing sources to fund a larger operating deficit escrow, which means that private developers will have to come out of pocket or raise rents and that nonprofit developers (who don’t have anything at risk in these projects) will just ask the city and state to provide more subsidy.” (emphasis mine). And the insurance broker said, “We will likely propose to our carriers that they increase rates in Seattle, at least for these months” (emphasis mine). Who pays for those increases? Renters, of course. Keep in mind what I’ve pointed out many times, there are only 1,218 eviction filings recorded in 2017 out of 168,000 (or more) rental-housing units in Seattle. That’s a rate of 0.7 percent.

And actual removals? About half that number, 558. But this is data, something that Morales says doesn’t matter. It also doesn’t matter that there are millions of dollars in a fund supported by the Seattle Mariners and managed by the local United Way, that could easily help the probably dozens of people who might be facing homelessness in December, for example. Instead of addressing the underlying issues, poverty and inflation — when housing prices go up, people with less money suffer — the Council will try to protect the “victims” of eviction by causing rents to go up, then increase public spending when housing problems get worse. Rents will go up to support the measure that will help only a tiny fraction of people already dealing with rising rents. And when people paying rent see rents rise because of this ban, and wind up in eviction court because they can’t pay, the Council will suggest that with rising eviction numbers the solution is to, well, ban eviction altogether. This is why we’re heading toward an eventual collapse of the business of rental housing. Socialists would cheer that on. But what the destruction of the rental housing market will do is accelerate scarcity, boost prices, and thus, cause even more trauma and suffering among the people that these Councilmember claim to care about. Reality Check: Part 3 in How to Survive and Thrive with the New Norm

ontinuing with my series of articles on “Surviving and Thriving with the New Norm”, this month the focus is on the property itself. This is not a new subject, but it is one that takes on greater importance than ever. In many ways, rent control is forcing all of us to be better owners and managers. The four key action items that I am addressing are all ones that successful investors have been applying for years

perspective in my January 2020 article and then from a marketing viewpoint in February, this third action item is intrinsically tied to whether or not your property will appeal to potential tenants who are willing and able to pay market rents. Now, let’s get into specifics. About six months ago, I talked about “Knowing Your Property” and becoming nose-blind, which actually translates into no longer being able to see the realities of age deterioration simply because it has happened so slowly over time. Compounding the effects of what is actually happening is the “if it’s not broke, don’t fix it” trap. These are natural tendencies that all owners should avoid no matter the circumstances. However, as we enter a new decade and a new norm, it is crucial that you remove the blinders and take a serious look at the condition of your property. Even if your property is currently providing an acceptable profit or level of cash flow, you need to seriously consider the impact of major repairs or a need for capital improvements. No longer is there the flexibility of raising rents to any amount as an offset to cover these types of expenses. This situation becomes even more critical if there are legal liabilities or code enforcement issues involved. City ordinances requiring safety upgrades cannot be ignored. Nor, once enacted, do officials take into account the fact that the cost may be impossible to recapture under today’s constraints


upon rent increases. Consider, too, the fact that certain operating and repair costs are only going to increase over time. What about those old air conditioning units? As of January 1, 2020, producing or importing R22 Freon became illegal in the United States. Older units can still be serviced with recycled Freon but the limited supply will undoubtedly push up costs. Now also is the time to seriously work towards bringing your rents up to market rates. Under the current law, there are no constraints on how much rent you can charge a new tenant. However, if your property is not as well maintained or does not offer the comparable amenities, there is a very good chance that the tenants who can afford to pay the rents you would like to obtain are going to find a better property elsewhere. Marketability is the great Catch-22. And deferred maintenance is often the underlying culprit. In many ways, it is a vicious cycle that only trends downward. But now is the time to realistically evaluate what can and cannot be accomplished and weigh the costs involved. There is one other component to be considered and that is the area in which your property is located. You need to look at this from both a market rent perspective as well as from that of property values. What rates are other properties in your area commanding? If some properties are attaining higher rents, are those units truly comparable? Can you make sufficient changes to become competitive or are you locked in by virtue of not being as desirably located or able to offer certain, in-demand amenities? You also need to do some projections into the future. Is your location apt to continue to attract better residents or is the trend more towards a slow deterioration. A knowledgeable real estate professional should be able to provide not only value trends for your specific

location, but also know about proposed changes such as new incoming retail or business centers. This is reality check time. There are several property-related variables to be considered. Get the help you need, whether it is assistance in determining market rental rates, future values or simply another set of eyes that are not nose-blind.
