It’s Still A Great Time to be in the Apartment Business!

W

hat drives the value of our apartments? Some might say a few factors include: rents, expenses, interest rates, capitalization rates, market conditions, and supply and demand. In my January message I cited that rents and values have risen dramatically since the early 1980’s. What’s happened in the last 3 to 5 to 10 years and where are we now? AAOC addressed these topics at the AAOC February General Membership meeting. He also interviewed OC Register business writer Jonathan Lansner about this and much more. Here is some of the information he presented. Rents—Since the “Great Recession” when rents stagnated and even dropped, rents have been in high gear making up for lost time. Over the past three years, OC rents have increased around 15% or so which has far exceeded wage increases during that time. This is so even though approximately 214,000 jobs were created over the last 4 years but 40% of them were near minimum wage. Hence a lot of our residents have doubled or tripled up. Expenses—They have also risen! As an apartment owner, I wish my expenses had risen commensurate with annual government inflation figures that have been far south of 2% since the recession. Let’s see, insurance, utilities, supplies and labor—2%? Prices/Values—Since 2005, gross multipliers have grown from around 13X to about 15X, which equates to a difference of $200,000 for each $100,000 of annual gross scheduled income. Please do the math based on your situation. Class B buildings in OC were priced below $200,000/unit in 2006 and now are almost $250,000/unit. This rise in value has been partially caused by a lack of inventory, and (like the stock market) a chase for yield in a low interest rate world. At these lofty values does it make sense to sell? Our

situations obviously are different and what makes sense for one doesn’t for the other. In closing, we as apartment investors and managers have many challenges we deal with like keeping up with changing laws and regulations, tenant problems, maintenance problems and bounced checks. To help navigate through these challenges AAOC is here to support investors and managers with forms, tenant screening services, education, vendor referrals and legislative advocacy. Our industry has changed over the last few decades and while we can all cite plenty of reasons why this industry can be difficult, not many are cashing out and leaving the business. n a past life, I proudly served 3 Members of Congress, both in Washington D.C. and California, for over 15 years, so, I consider myself a creature of The Hill. It is always fun to have the opportunity to return to my old stomping ground in an official capacity. Dubbed the “CAP CON,” each year thousands of apartment industry professionals, NAA affiliate members, staff, and volunteers travel to Capitol Hill and literally walk the “Halls of

Congress” to lobby their lawmakers, educate legislative and policy staff, and show the strength of our industry. This past month, I had the privilege of leading a team from the Apartment Association of Orange County at the National Apartment Association Capitol Conference. As always, the “CAP CON” is an impressive display of force and the numbers of industry professionals present provides a strong optic to the Member of Congress.

According to NAA Statistics, more than 100 million Americans rent. Up to half of all new households formed this decade could live in rental housing. Everything that happens on Capitol Hill can impact our ability to meet this demand for apartments, so it’s critical that Congress understands and appreciates the apartment industry’s unique needs when it comes to housing finance reform, tax reform or any number of policies under consideration.


This year’s focus in Washington D.C. was threefold. First, to promote economic growth and investment in rental housing without unfairly burdening apartment owners and residents. This can only be accomplished with real tax reform. Second, there is some basic housekeeping that needs to be done in this nation. The National Flood Insurance Program needs to be reauthorized before it expires on Sept. 30, 2017. This effort will go far in preventing disruptions in the marketplace. And finally, the Americans with Disabilities Act needs to be reformed. The law needs to include provisions in which a business owner has the opportunity to cure an alleged deficiency prior to the initiation of a “drive-by” lawsuit. The apartment industry contributes substantially to the housing market and the economy at large. We strengthen communities and grow local businesses. In fact, apartments and our Executive Director Lou Penrose and Chairman of U.S. House Foreign Affairs Committee Congressman residents support more than 25 million Ed Royce. jobs across the country.

Floodgates

A

bout the same time that floodgates and emergency spillways were attempting to corral an abundance of water at the Oroville dam and the Don Pedro reservoir, the Capitol was inundated with a flood of a different kind—legislative proposals introduced en mass to beat the self-imposed deadline for bill introductions. Imagine, over 850 bills of all different stripes in the last day alone. What a way to celebrate a President’s Day weekend! Your legislative team has identified for close scrutiny and ongoing monitoring about 150 bills of the roughly 2600 bills introduced this year. As usual, some these bills have a direct effect on the ownership and management of residential rental property while others are more inclusive in scope. These pages will report from time in brief or in depth on the more significant bills affecting the apartment industry. We start the discussion here with several of the most outrageous bills noted to date. AB 1506 (Bloom) would repeal the

Costa-Hawkins Act, a decade-in-themaking measure to place restrictions on local government’s ability to enforce overly restrictive rent control ordinances. The Act was designed to curb the excesses of early Berkeley- and Santa Monica-styled rent control ordinances, exempted all new construction and single-family homes, among other provisions. Its repeal would devastate the housing industry because it would allow local governments to adopt restrictive and punitive forms of rent control. AB 1505 (Bloom) would authorize local ordinances to require, as a condition of development of residential rental housing units, that the development include a certain percentage of units affordable to and occupied by households that do not exceed the income limits for moderate income, lower income, very low income, or extremely low income households as specified by certain cited sections of the Health and Safety Code. AB 982 (Bloom) would amend the

Ellis Act, regulating the permissible limits on local governments’ authority to regulate the ability of a rental property owner to go out of business, to require a minimum one-year notice to all residents as opposed to seniors and the disabled who must receive a notice at least one-year in advance of the landlord going out of business AB 1585 (Bloom) would establish in each local jurisdiction a new layer of regional zoning approval for certain affordable housing projects that meet specified standards relating to local housing needs and fast track a comprehensive permit approval process that includes public hearings and appeal to the State Department of Housing and Community Development. SB 277 (Bradford), similar to AB 1505 (Bloom), would authorize local governments to require inclusionary housing affordability standards for all new developments. AB 915 (Ting) and AB 932 (Ting) also relate to similar local government housing affordability


mandates in all new developments. AB 199 (Chu) would require all private residential projects built on private property pursuant to an agreement with the state or a political subdivision to meet the requirements of projects that are defined as “public works” under existing law, thus imposing payment of prevailing wages or PLA agreements on these private projects. AB 1667 (Friedman) would require urban water suppliers to install separate dedicated landscape water meters on all existing service connections for industrial, commercial and residential property, requiring massive retrofit replumbing, with varied completion dates depending upon the nature of the structural improvement on the property and the square footage of irrigated landscapes. AB 291 (Chiu) contains several separate and detailed provisions relating to various prohibitions in the landlordtenant relationship regarding the known or perceived immigration or citizenship status of a tenant or occupant. Among other provisions, it would create a tenant’s cause of action for damages in the amount of six times the monthly rent for unauthorized disclosure of such information and provide affirmative defenses in UD cases. AB 1242 (Grayson) would require an owner or agent of residential rental property having 16 or more units to reside at the property or within 5 miles of the property. It also would require written disclosure to every tenant by February 1, 2018, the name, telephone

number and email address of the property owner or agent. Much more about these significant bills of interest will be discussed in greater detail as they progress through the committee process in this legislative session. Turning attention to other bills of interest, we note in passing that our jointly sponsored bill on immigration described last month, AB 299 (Calderon), conflicts in several meaningful ways with AB 291 (Chiu) mentioned above. Some other measures in no particular order of attention include the following. AB 62 (Wood) would require all public housing agencies to implement a policy by July 30, 2018, to prohibit the smoking of tobacco products in all public housing living units, interior areas, and outdoor areas within 25 feet of the units except in designated smoking areas. AB 1569 (Caballero) would provide a detailed process to be followed by landlords and tenants for dealing with ADA accommodation of animals on the rental property where the disability or the disability-related need for the animal is not apparent. It provides a step-by-step interactive procedure to validate important criteria. SB 2 (Atkins) would create a separate fund in the State Treasury for support of affordable housing development by imposition of a $75 fee on the recording of every real estate instrument, paper, or notice required or permitted to be recorded, not to exceed a total of $225 per single transaction. SB 3 (Beall) would authorize the

issuance of $3 Billion in bonds to be used for financing various existing housing programs as well as infill infrastructure financing and matching grant programs. ACA 4 (Aguiar-Curry) would lower from 2/3 to 55% the vote required to authorize general obligation bonds to fund the construction, reconstruction, rehabilitation, or replacement of public infrastructure or affordable housing projects, if the proposition proposing that bond includes specified accountability requirements. Please help! I have an issue with one of my neighbors regarding the fence that separates our two properties. Never had a problem before, when the fence needed repairs, one of us or both of us would simply fix it, and split the cost. should be shared, and the proposed timeline for the work. The presumption of equal responsibility can be overcome by a preponderance of the evidence, and the courts must “consider” these factors specified in the statute: i) If the burden on one landowner is disproportionate to the benefit; ii) Whether the cost of the fence would exceed the difference the fence would make to the property value; iii) Whether a party would suffer an undue financial hardship given its financial circumstances; iv) The reasonableness of the particular proposal; and v) Any other appropriate equitable factors. The determination of reasonableness must include the extent to which the costs appear unnecessary or excessive, or result from one neighbor’s personal aesthetic, architectural, or other preferences. If the presumption of equal responsibility is rebutted, the court may order contribution of less than an equal share or no contribution. I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?

Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too

restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. Q&A — continued from 11 I was recently contacted by a utility company asking to modify its overhead easement. The document they sent for review allows them to install fencing underneath, is that normal? The area they want to use runs across an unused portion of my land, but I was planning on expanding my existing parking lot into the area, can they restrict that?

The holder of the overhead easement generally does not have the right to control the surface of the land beyond its needs to maintain and repair its overhead facilities. Thus, the easement holder may not be able to install fences on the surface that unreasonably restrict the servient owner’s use. The servient owner may be able to install a parking lot in the easement area if cars are parked in the area only intermittently and are easily removable. Also, the fee owner may install fences to control the easement area if they do not obstruct the utility company’s use of the easement and if reasonable access is provided. This is a factual question, and the decision will depend upon your individual situation. The fee owner should be able to use the surface area for purposes that do not interfere with the overhead easement. The written

agreement will control, and should be carefully reviewed to ensure that the easement does not adversely affect the value of your property. Seems like more and more of my prospective residents have past due balances on their credit reports and outstanding collection accounts. Years back I wouldn’t even consider someone with a collection account, but if I did that now, I’d have an empty building! What do you think?

According to a study released by the Urban Institute, 35.1 per cent of folks with credit records have past due debt that is in collection. That’s one out of every three people you see on the street. Unpaid rent, student loans, credit cards, gym memberships, cell phone and medical bills are most common. As a Lessor your task is to weed out the applicants to determine which of the several will be the ‘best’ pick for your property and will more likely than not comply with the rental terms and honor the obligations created. Past articles have described the screening process and the criteria you should have established. Regarding debt and collection accounts, consider the amount outstanding, the type of debt (i.e. medical vs rent), whether or not the prospect

voluntarily disclosed the obligation, and whether or not he/she is making an attempt to re-pay the obligation. Trust is key, a prospect who volunteers the information and is making an attempt at satisfying the debt is preferable to the applicant who doesn’t disclose the collection account, denies the obligation when asked or who blames the past landlord or other creditor for misdeeds. Of course, in an ideal world, all prospects would honor their credit obligations, pay their debts when due, and be honest and truthful in the application process. I have just finished rehabbing a rental unit. I replaced counter tops, cabinets, baseboards and so on. Even though the unit is freshly painted with new carpets, the unit still looks unfinished. The base boards don’t always follow the wall contours exactly and the cabinets also have small gaps where they meet the wall. What can I do to make my work look professional? Julia

Dear Julia:

We are going to let you in on a “professional” secret and it is called painter’s caulk! Painter’s caulk typically comes in a tube and is applied with a caulking gun. Run a small bead of caulk along the baseboard and with your finger push the caulk between the wall and the gap you are trying to fill. Using a damp sponge or rag, wipe up any excess caulk. Painter’s caulk can be used to hide a multitude of installation sins.

Almost anywhere two dissimilar materials meet; painter’s caulk can help hide the transition. Painter’s caulk is not limited to just baseboard, use it to make cabinets and door trim look custom installed. Fill nail holes without making a big flat spot on your wall. My building has redwood fencing and patio decks. Both the fencing and decks are in good condition, however the “red” in the wood has faded with exposure to the weather. The wood looks grey now. How can I bring back the redwood look back without buying

A Redwood deck or fence may be young and fit, but they do tend to grey prematurely. Luckily, the solution is not too hard. There is a chemical called oxalic acid which will help give the wood its youth and vitality back again. Most hardware stores will stock a product called cedar and redwood cleaner/ brightener. It may be under the brand name of “Olympic Cedar and Redwood

Deck Brightener” Be sure your deck or fence is clean before treatment by using a TSP and water solution. (TSP is a heavy duty powder cleaning solution available at any hardware store or supermarket.) After cleaning, be sure to read the deck brightener product’s instructions before use. For safety and wear gloves and goggles. Mix the product’s solution with water into a pump up sprayer. Wet the deck or fence with the solution and using a nylon brush or broom, scrub the wood evenly, working harder on stained areas. Let the solution stand for about thirty minutes and rinse off with a strong stream of water. Let dry and the wood should look brighter. It might not look brand new, but it will look much better.

My current vacancy was long occupied by a heavy smoker. Every surface is sticky with brown nicotine and the smell of smoke is overwhelming. How do I get rid of the smell and keep it from coming back? George

Dear George:

Cigarette smell is very hard to remove even after painting and cleaning the carpets. Chances are if the resident was long term, the carpets, drapes or blinds will need to be replaced. Remove the carpets, pad and tack strips. The tack strips are wood and can absorb and release the smell of smoke, urine etc. Thoroughly clean the floors with soapy water mixed with bleach. After cleaning the floors, it is not a bad idea to paint or use a primer to coat the flooring. One of the best ways to remove the nicotine residue from the walls is using old-fashioned elbow grease! Again, wash the walls with soapy water using a brush or rag. Adding TSP (a powdered cleaning solution available at most hardware stores) or using a degreasing agent will help in the cleaning. If you have flat ceilings, wash them too. If you have “acoustical” or “pop-corn” type ceiling, that’s a problem. By its nature, Maintenance — continued on page 18

You will need a primer coat and a minimum of two coats of paint. If the smell is still present, give it another coat of paint and let the unit air as much as possible. Don’t forget to wash the windows and window frames. You will be amazed at how clean the aluminum or vinyl windows will look after a good cleaning.

hey are conversation diverters. Just as the words always and never are. Customers and friends will challenge and doubt you with those words. Killer words make your customers, and potential customers, veer away from the real point of your conversation. So best we eliminate them from our routine and vocabulary. It’s not easy to do. If it were easy to do, everyone would be doing it…and we know everyone isn’t doing it.

Here are the top rated killer words. Remove them from your sales and customer service conversations and watch the scene (personal and business) go smoother. “No Problem.” — This is a biggie. The customer is thinking, “When was I a problem?” Believe we can thank the ‘islands’ for this one. When we take a cruise, and ask for anything, what’s the first thing the waiter says when we want 4 desserts? Right, “No problem.” Well on the cruise it may be okay; however, back

Take the time to say, “This might take a bit longer than I’d like it to. Tell me about…” and then ask a benign question that will take some time and let the customer talk. “Calm Down.” — Oh man, does this one make the hair on the back of their neck stand up. In any movie or TV

show I’ve watched lately when someone is told to “calm down,” the next words are, “Don’t you tell me to calm down.” Now you’re in an argument. There are times when the client may need to vent. Your job is to listen and come in at the appropriate time with sympathetic and empathetic wording. You telling a customer how to handle their actions isn’t a great idea. Get rid of the expression “calm down.” “It’s not our policy.” — Ouch! Okay, okay, most every company has policies

The policy should be rephrased so it starts off in a positive way. “Reject gently.” And rephrasing policies are a good way to soften the blow and explain in a more TLC way what will happen. Next time you find yourself saying, “That’s not our policy,” stop! Regroup and reword. Buffer it with, “Let me see what we can do. Normally the policy of the company doesn’t allow last minute changes; however, I’ll double check.” (The request should be restated so the customer hears you’re going to go to bat for them.) “Let me double check” are powerful words. “Yes, but…” — Hmm, what’s wrong with that? We all say it. Well, what’s wrong with that is the minute we say, “yes, but,” the client knows something negative is coming. If you have ever said, “I love you so much, but…,” usually there is a condition coming, isn’t there? Here’s one way to change that: “Yes, we can do that. There is, however, a $50 additional fee.” Doesn’t that sound better than, “Yes but…”? Most people have phrases and sayings they don’t like or that aggravate them. Keep a list of your killer words (along with ours) and avoid them. Other killer words on the list are: • Can I be honest with you? (No. lie to me, please.) • What was your name again? (The same as it was last time. I said it 20 seconds ago.)

Seal Coating — continued from 30 this article we will focus on seal coating and its place in the maintenance plan. First we want to address the difference between seal coat and slurry coat. The main difference between slurry and a seal coat is that slurry is thicker than a seal coat. It uses larger aggregate in its mix while a seal coat contains smaller aggregates. Slurry coat is generally used on high-traffic roadways and streets where vehicles travel at higher speeds meaning in most cases it would be overkill for the parking lots in a community. Slurry coats require longer time to cure, are about twice as expensive and leave a much coarser and rough surface than a seal coat. However, if your pavement is bad and has major structural damage, neither slurry nor a seal coat will help resolve the issues. Seal coating should be considered for a variety of reasons. First and foremost, it protects and prolongs the life expectancy of your community roadways.

The sealant prevents the surface from becoming porous and separating along seams and end cracks. Seal coating also enhances the aesthetic appeal of a community roadway. Over time, the surface of asphalt pavement oxidizes and becomes gray or faded in appearance, especially in sunny Southern California with our high UV rays. Seal coating provides a vibrant black finish that nicely contrasts with striping, clearly distinguishing pavement markings. It helps to beautify your community and make it appealing to current residents and potential new buyers. Prior to pavement sealing, any structural failures or liability repairs must be completed. All potholes must be removed and replaced, cracks must be cleaned and filled, and oil spots cleaned or primed. It is advisable to wait a minimum of 6 to 12 months after your parking lot has undergone large surface-area repairs before seal coating. This timeframe should be adhered to even if your parking lot is brand new.

Waiting allows the surface to cure properly and the oils from the original pavement or newly overlaid surface to dissipate. For maximum benefits thereafter, seal coating should be applied on a regular basis, about every 24 to 48 months. Secondly, determine if the pavement is a good candidate for sealing. In some cases a parking lot may already contain too much sealer, commonly known as over-sealed. If there are too many coats of sealer or if sealer has been applied too often, your parking lot may be slick and dangerous. Seal coat will wear off the tops of the rocks in the asphalt first but will stay in-between the voids. Even when seal coat wears off the tops of the rocks this doesn’t necessarily mean your parking lots may be ready for another coat of sealer. Finally, a word of caution: seal coating is not designed to be a solution for Seal Coating — continued on page 34

Seal Coating — continued from 32 sealing cracks over 1/8-inch thick. Rather, it is a protective measure intended to extend the life of your asphalt. Seal coating should only be performed under the proper conditions. Sealer is a water-soluble green product and, until the drying process is complete, it is vulnerable to rain, sprinkler water run-off and traffic. As a result, sealer should be applied during clear conditions and only at the appropriate temperatures. During application and for 8 hours afterwards, the recommended air pavement temperature should be at least 55 degrees Fahrenheit. When the temperature rises above 95 degrees Fahrenheit, however, sealant becomes tacky and additional time may be required for curing. Although seal coating is a rather quick application process, the drying and cooling time is lengthy (traffic should be kept off a newly sealed surface for a minimum of 18–36 hours). If this time frame is not strictly adhered

to, car tires may lift uncured sealant from the surface leaving patches of unsealed pavement. It is also important not to use sprinklers, hose down, or wash the area for 48 hours before and after work is completed. To alleviate any parking or driving inconveniences to residents choose a contractor that will complete the seal coating application in phases or sections, preferably during off-peak hours for residents. Prior to applying sealer, the surface must be free of all dirt and debris. A reputable parking lot maintenance contractor will use a wire broom and/or a high-powered blower or sweeper to ensure a clean surface. Next, black-out spot oil primer should be applied to any oil or fluid-stained areas to ensure better adhesion of the seal coat to the surface. Please note that some oil spots may have already penetrated deep into the asphalt and started to deteriorate it from within. If this should occur; fulldepth removal and replacement of the asphalt should be the preferred solution. Sealer application involves a spray

or squeegee technique. Typically, spraying is executed by applying 3-foot passes of spray overlapping every 1½ feet throughout the roadway. The second technique involves the use of a squeegee. When using this method, material is pushed down into the porosity of the asphalt. This process is also completed by applying 3-foot passes overlapping every 1½ feet. To improve traction provided by the sealant, three to five pounds of sand are added to each gallon of product. There are also additives available to expedite curing time. For best results, all manufactures recommendations should be followed. These recommendations usually include applying the first coat by squeegee and the second coat by spray. It is important that the proper total thickness is applied with slightly more material used in the first coat. Transparency…always a good thing in market economies?

W

asn’t a trick question. The answer is, yes, the natural laws of transactional business in free market systems prefer a transparent environment. Your corollary concept: Markets hate uncertainty. Together these maxims acknowledge that marketplace transparency enables more effective use of resources, more reasoned decision making by participants and, as a consequence, increased likelihoods of long term productivity, a desirable outcome in every society. Naturally, this does not mean that every marketplace participant will access every bit of accessible data. But with at least the sense of transparency among market participants a level of confidence activates; the mere perception of openness and transparency makes us assume deception is less likely and enhanced system-wide trust ensues. Why is this an important phenomenon—this “sense of transparency”? Because perceptions of trust among market participants are a lubricant to the moving parts in a capitalist economy. This is no small thing in a $19 trillion+ annual GDP behemoth like the US. We want transparency to oxygenate the air. So, for investors, consumers, taxpayers, employees, government officials or whatever hat myriad of hats one may wear in whatever kind of marketplace one may participate (often multiple) the free flow of information and the transparency thereof will generally help

markets operate more efficiently, ultimately contributing to better standards of living in market economy, democratic nations. The flip side of all this transparency cheerleading says that we must nevertheless be cautious about legislatively imposing it. There are costs and slowdowns, at least in the short term, when disclosures and transparency are dictated by government to market participants. Yes, it is possible for public sector regulations to botch things up in “fixing” a situation. This is the sketchy part for society in managing itself. How much mandated disclosure is truly effective and appropriate?

Accountants Under the Spotlight

An interesting take on this question of disclosure and the forms it takes recently emerged from the Public Company Accounting Oversight Board (PCAOB), a nonprofit corporation created by Congress in 2002. In case you’re not caught up on your PCAOB reading, as of January, 2017 for the first time ever, the personal name of the senior individual responsible for the audit of a US public company’s financial statements will henceforth be made known to shareholders. Previously the accounting firm’s name was all that was required on the audited statements. We love this move by a public agency in striking a blow for transparency and for its spiritual cousin, accountability. The fact that individuals April 2017

responsible for audits that feed into publicly traded securities markets can no longer sit behind a veil of anonymity should incentivize these highest-level-inthe-world bookkeepers to be all the more on their toes and do their best. Sorry, anonymity breeds a degree of complacency in our book. You try harder when your name is on the work product. This new rule also sharpens the understanding of those who will make investment decisions or recommendations predicated on those very audited financial statements. Now there’s a name, face and human profile attached to the signature on the bottom line, for whatever insight that may provide in evaluating the audited statements of Apple, Boeing, Exxon, Walmart and all the other big boys. Kudos to the PCAOB for this low cost, transparency additive. One less shadow for the marketplace to deal with.

Rent surveys

When it comes to openness and transparency in the rental housing industry, credible rent surveys are one of the key data points that give landlords and tenants that earlier discussed “sense of transparency” in the marketplace. The rental data on the adjacent chart reveals that “average rent level” for apartments across Orange County were $2,065 monthly in Q4 2016, and

Rental Payment History Puts the Brakes on Serial Skippers

or apartment operators, it’s among the most frustrating—not to mention costly—of outcomes. A resident skips out on his or her lease before it’s up, leaving behind an unexpected vacancy as well as no small amount of unpaid rent. Renters fail to satisfy the terms of their leases for a variety of reasons. Some may feel they don’t have a choice after suddenly losing their job. Other residents—known in the industry as “serial skippers”—make skipping out on leases a habit and seem determined to abuse the system by hopping from one community to the next, while meeting as little of their financial obligations as possible at each stop. “We generally don’t even call them “serial skippers,” says Marc Raskulinecz, Senior Vice President of Property and Asset Management at Newport Beach, Calif.-based CORE Realty Holdings Management. “We call them “people who are chasing the next deal.” Regardless of the term deemed most descriptive, operators seek to protect themselves from serial skippers in several ways. Typically, they use credit scores, employment history and cur-

rent income levels to assess the likelihood that an applicant will meet the terms of his or her lease. Today, many apartment managers are also incorporating propects’ up-todate rental payment history in their evaluations or lease applications—and are finding the information to be powerful protection against skippers. “This data has been a tremendous help to my company,” says Michael Johnson, Executive Vice President at Memphis, Tennessee-based Alco Management. The operator uses rental payment data that Experian RentBureau collects every 24 hours from participating managers, electronic rent payment services and collection companies. “Anybody who’s skipping out is going to show up in this database first,” Johnson says. “It’s going to hit the database before it hits their credit report, just because of the time it takes to go through a collection agency. We find people through this service who are not honoring their leases—either they’re delinquent or they have skipped—and we won’t rent to them.” There’s sound reason for Alco’s approach. According to a study by

Experian RentBureau, how an individual has paid rent in the past is a strong indicator of how that person will pay rent in the future. Lease default rates for prospects with a positive rental payment history (meaning one with no skips or unpaid balances) are only 5.96 percent. On the other hand, default rates for prospects with one prior unpaid balance jump to 23.20 percent. Those with two or more rental debts (meaning they are likely serial skippers) have a default rate of 35.20 percent, nearly six times higher than applicants with positive rental histories.

The Many Effects of Skippers

Multifamily operators say it’s critical for managers to use all the resources available to them to prevent skippers from leasing at their communities because of the considerable financial havoc they can wreak. As Johnson notes, not only does a lease skip leave a community without the rent it was expecting, but it creates other unplanned financial exposures as well. “There’s the turnover cost because you’ve got to turn the unit after someone leaves,” Johnson says. “Also, there


are probably increased advertising costs, because not you’ve got more units to fill.” Less obviously, skippers can also affect the morale of a community, according to Johnson. “If you have a lot of that happening in the same property, it creates some perception among your other residents that something’s wrong.” He says. “People are moving out too fast, and it makes other residents ask, “What’s going on with this property?” Just as rental payment history can help prevent skippers from renting at a community in the first place, so too can it help collect from former residents who left a community owing money and are now applying for a lease at another property. Like Alco Management, CORE Realty Holdings Management Inc. contributes to and accesses rental history. “When we began reporting the data, we started to get more people who were calling and trying to settle past debt,”

Seal coating does more than just make our asphalt look nice and new. It has functions that help extend the life of your asphalt and help you plan better for the future expenditures. Community managers and their board members should always have a reserve on hand in order to tackle the larger projects that will arise in the future. Owning Forever from Cash In on the Myths of Real Estate

ased upon my own conversations and observations, I would say that a significant number of AAOC members have owned their current property (or properties) for ten or more years. In fact, I’ll venture to guess, some still hold title to the very first rental prop-

providing. You also need to know what is happening in the marketplace and what other options might be available. This is where having a trusted advisor can be of immense help. In additional to


providing you with current sales comps and rent surveys, that individual should be keeping you updated as to local, regional and national economic trends. Part of your decision-making should be predicated upon a balancing of your entire real estate portfolio. If you own multiple properties, there may be one trophy property that you maintain as a long-term hold. The goal should be to have that property free-and-clear or with minimum encumbrances so as to generate whatever cash flow is needed. With a stable base, you now have more flexibility to consider selling, trading or leveraging your other holdings as opportunities become available. That said, your advisor needs to keep you informed about possible contrarian moves and alternative investments that are in keeping with your needs and goals. Remember, too, that goals and circumstances can change. In last month’s article entitled “Getting Ready—Tax and Other Times” (March 2017 issue of Apartment News Magazine), I talked about trigger events and the importance of conducting portfolio reviews whenever there is a change in personal or external circumstances. You may also want to look at your property from a legacy planning perspective. Is this particular investment one that your heirs are going to want or even be able to manage? Be realistic in terms of where they are in their lives and their time commitments. And, when in doubt, ask. You may not like the answer you get, but perhaps that is a signal to you that some type of adjustment is needed. Again, legacy transitioning and helping to acquaint your heirs with the benefits of rental property ownership may be another area where your advisor can be of assistance. About the Author: William R. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums.
