COVID-19: Get Informed During this Unprecedented Time

T

he Apartment Association of Orange County (AAOC) is committed to keeping its members informed about the COVID-19 pandemic and what can be done to protect ourselves, our families, our employees, our residents, and others by helping mitigate the spread of this new, infectious disease. The Show Must Go On

I

hope this message finds you and your family, your employees, and your residents safe, healthy and surviving the statewide COVID-19 “Stay at Home” directive. The past month has certainly been one of great uncertainty and change as we’ve dealt with the impact of the Coronavirus pandemic in our daily lives. Social distancing; adjusting to remote working; operational challenges in your rental community; vendor availability issues; regular meetings now being conducted via conference call or webinar; employee questions and concerns; resident questions and concerns; grocery shopping challenges; store closures, and more. And compounding an already challenging situation, for those of us who are working from home and parents of school-aged children, we are also now learning how to balance work with our temporary bonus job of homeschool teacher. Like you, AAOC has had to make changes in response to the Coronavirus. While AAOC’s physical office is temporarily closed, our “virtual office” is open for business. Thankfully, the investments that we made last fall in modernized computer and telephonic technology has made it possible for our staff to work remotely and continue providing AAOC members with resident screening services, operational assistance, legislative advocacy, and core educational programming. You can still reach us by phone at (714) 245-9500, Monday through Friday, from 8 a.m. to 5 p.m. AAOC is also updating its web-

site daily, with information and resources to help its members work through their COVID-19 related operational questions and challenges. Unfortunately, AAOC has had to postpone or cancel some of its education classes and special events this spring. The first was last month’s AAOC Trade Show & Conference, which has already been rescheduled for Thursday, September 10, 2020 at the OC Fair & Event Center. Not so fortunate were the AAOC Golf Classic and the Stemware & Stallions PAC fundraiser, which have both been cancelled for the year. Other upcoming workshops and meetings have also been cancelled. Others, however, like the 11-week Certified Rental Housing Provider education program and our General Membership Meetings in April and May will go on — as webinars or webcast events. Rest assured, we are working to reschedule our other cancelled education workshops for later this year. More details will follow in the coming weeks and months. Evolving Issues: New Seismic Building Standards and Expanded Price Gouging Protections

I

f the state of California has its way, the California Building Standards Commission (CBSC) and the state Department of Housing and Community Development (HCD) may adopt building standards for residential and commercial buildings to be seismically braced, should AB 1997 (Nazarian) be signed into law. CBSC would be authorized to adopt regulations based on state “functional recovery working group” recommendations for non-residential occupancies and authorizes HCD to adopt regulations based upon the recommendations resulting from the same working group for all residential occupancies. The “functional recovery standard” that would apply to all existing buildings is defined as a “set of enforceable building code provisions and regulations that provide specific design and construction requirements intended to result in a building for which postearthquake structural and nonstructural capacity are maintained or can be restored to support basic intended

functions of the building’s pre-earthquake use and occupancy.” The new building code standards would be required to be adopted by June 30, 2023. Criteria used to adopt the new building codes would materially differ than today. The new standard that would apply would use “immediate occupancy” (IO) building performance objectives and, as such, would represent a substantial change from the current design philosophy for commercial and residential buildings that prioritizes occupant safety and not post-hazard functionality, to a design philosophy that also emphasizes preservation of building function and supports community economic and social objectives. Increasing performance goals for commercial and residential buildings would not be easily achieved. The development of an IO performance objective would require engagement from all levels of our communities and entail reallocation of existing effort, time, and financial resources. On another front, public safety electrical power shutoffs will affect residential rentals pursuant to Assembly Member Freddie Rodriquez’s AB 1936. Under current law, upon a proclamation of emergency by the president of the United States, governor, or upon the declaration of a local emergency by the executive office of any county, city or city and county, and for 30 days following the proclamation or declaration of emergency, it is a misdemeanor with specified penalties for a person, contrac-

tor, business, or other entity to sell or offer to sell certain goods and services for a price that exceeds by 10% the price charged by that person immediately prior to the proclamation or declaration of emergency. Mr. Rodriquez’s bill would specify that, for a proclamation or declaration of emergency made because of a public safety power shut off or because of an announcement that a public safety power shutoff will occur, the restrictions on increased price apply to housing, health care, medical supplies, emergency cleanup, home heating oil, building materials, transportation, freight and storage services, and gasoline for a period lasting until 72 hours after the restoration of power. So, how will that affect residential rentals you ask? Imagine how this would affect entering into a residential rental agreement and before the applicant takes possession of the dwelling unit. You simply could not increase the rent from the last month’s rent paid, that is above 10%, if you are not careful with the wording of your new lease. Thus, a word to the wise, be careful how you write your lease agreements. It is a given that you will not be able to allow the new tenant to occupy the unit should there be no power to the unit.

Finally, dealing with the spread of COVID-19 may present us all with certain liabilities associated with resident or employee illnesses related to their exposure. Contracting the virus from unrelated sources or via direct related sources such as employee travel, turnover work, material acquisitions, vendors, common areas and on-site amenities can be equally disastrous and may expose us to liability and certain obligations just the same. I would encourage you to seek legal counsel and advice on how best to protect against legal exposure. At the same time, contact your insurance broker for a review of existing coverage. A

s the California Legislature increasingly passes laws that require enforcement by local government, the fight for power at the local government level has intensified. In Orange County this year, so far, there are four major efforts that aim to recall local city council members. These recall efforts appear to be more about changing the power base in the cities rather than for any corruption or malfeasance by the elected officials who have been targeted. Local issues are often more complicated than they appear on the surface. Below is an overview of the current recall efforts in Orange County.

Westminster — April 7 Special Recall Election

Three members of the Westminster City Council, Kimberly Ho, Charlie Nguyen and Mayor Tri Ta are on the April 7 Special Election ballot for voters to decide if each should remain on the city council or be recalled from office. The three councilmembers are a voting majority on the council and political rivals within the Westminster Vietnamese community are trying to change the power base on the city council. The group organizing the recall is “Westminster United,” which is receiving most of its funding from a wealthy Vietnamese American from Los Angeles named Kieu Hoang. The special recall election is expected to cost the city approximately $318,000.

Santa Ana — May 19 Special Recall Election

The Santa Ana Police Officers Association spent $301,000 to qualify a recall of first-term City Councilmember Cecilia Iglesias. Iglesias was elected to the City Council in 2018 and she has described the recall effort as payback by the police union for her vote against an unbudgeted Santa Ana Police pay raise last year. It is estimated that the special election will cost the city and its taxpayers approximately $650,000. What makes this recall effort particularly intriguing is that Iglesias is running for mayor of Santa Ana this November and is not running for reelection to her city council seat. So regardless of the outcome of the recall election, a new individual will be elected to this council seat come the November election.

Santa Ana — Recall Threat Over Development at 2525 N. Main Street

The Santa Ana City Council recently approved a luxury apartment development at 2525 N. Main Street, adjacent to the Discovery Cube science center and museum, in the city’s third ward. Homeowners in the neighborhood near the project site are unhappy with the approval and they have been attempting to launch a recall of third ward City Councilman Jose Solorio, who voted in support of the project. At this time, no official papers have been filed to start the recall, but a lawsuit has been filed against the development by the local

homeowners’ group calling itself, “Santa Ana Citizens for Responsible Development.”

Irvine — Recall Threat Over Veterans’ Cemetery Location

Signature gathering is under way to try recalling from office Irvine Mayor Christina Shea and City Councilman Mike Carroll. UC Irvine professor and former city council candidate Kevork Abazajian is largely behind the recall effort. The professor claims that the city councilmembers have been stalling a proposed veterans’ cemetery due to their connection with housing developer FivePoint Holdings. The location of the cemetery has been the subject of controversy in Irvine for many years, but Shea and Carroll say Abazajian is simply trying to change the Irvine power base and plans to run for city council again. If the recall petition qualifies, it means a special election would be held this year to decide the political fates of Shea and Carroll. However, a special election would be duplicative, given that both incumbents are up for reelection in November. It would also be costly for the city and its taxpayers, at around $910,000. The Apartment Association of Orange County will continue to monitor these local recall efforts and the potential impact they could have on the multifamily industry. Questions & Answers I just opened up the mail, and what do you suppose was in it? A notice from my bank informing me that one of my tenant’s rent check was returned unpaid because he placed a stop payment on it. Imagine that. It’s now mid-month, no warning, no phone call, the deadbeat didn’t even have the courtesy of letting me know he was going to stop payment on his check. It kind of makes sense though. He asked a couple of weeks ago if I’d let him out of his lease early. I guess his girlfriend has a nicer place

and he wanted to move in with her. I called his phone number, got a recording saying that it had been disconnected. His cell phone works, got his voice mail, and left a message. I’m guessing that when I swing by later today, it’ll be empty. What do I do now? I don’t want to make any mistakes; can I just change the locks if he’s out?

You have a couple of issues that you need to resolve. First is the issue of return of possession of the premises, and then, of

course, getting you paid. If the tenant appears to have vacated when you visit the unit, then you must follow certain procedural rules before you simply change the locks. Ideally, you will be able to contact the tenant on his cell or at work. If you make contact, ask that the tenant confirm that he is out by faxing or emailing you written confirmation. If you are able to confirm that he has moved out, you will not have to follow the abandoned real property notice requirements and will be able to retake possession immediately. If when you visit the unit, and find that it is vacant, and if the rent is due and unpaid for fourteen days, and the tenant has not voluntarily surrendered possession, then you must serve a written notice of Belief of Abandonment of Real Property. The notice can be posted on the premises and mailed by regular mail to the tenant’s last known address, your property. You must wait eighteen days before you retake possession. If the tenant does not reply, in writing, by


informing you of his address for service of an unlawful detainer within eighteen days, then you may retake possession, and change the locks. Once you regain possession, prepare the security deposit disposition form. If he skipped mid lease, he would owe the balance of the term, or until you mitigate your damages by reletting the unit, whichever occurs first. Hang on to the tenant’s check that was returned by the bank. Stop payment orders are only effective for six months, unless renewed by the maker, which rarely happens. That means, in six months and a day, you can redeposit the check, and if there are sufficient funds, the check will clear. I’m looking at a single-family residence to purchase. It’s a pocket listing, no signage, not on the MLS. The agent claims it’s a great deal because the seller needs cash quickly, wants a quick escrow, and is willing to let it go for under market. The only catch is, the tenant doesn’t know the house is for sale, and the owner doesn’t want the tenant to know. He says that when I close escrow, I can serve my own notice to have the tenant leave, but he doesn’t want the tenant getting nervous and moving out if the deal doesn’t go through. It seems like a really good deal. I know the house, I’ve peeked in the windows, and it’s in incredibly great shape. What am I missing, what can go wrong?

Lots. You have actual notice of a tenant in possession. That means that you are bound by whatever rental agreement, or contract, exists between the owner and the existing resident. The tenancy agreement may turn out to be a fixedterm lease, for a long period of time, at less than market rent. The resident may have a lease with an option to purchase the house for a fixed sum, possibly less than what you are paying for it. There may be litigation between the parties relating to the premises, possibly mold or some other contamination issue that you may not be aware of. If the deal really is as described, then prepare a

purchase agreement providing a due diligence period allowing you a brief time period to check title, condition and other issues. Once escrow is open, and you are satisfied with title and the condition of the premises, contact the resident, confirm the terms of his tenancy, get a copy of the rental agreement, and prepare an estoppel certificate for the resident to sign, affirming the tenancy agreement, amount of deposit, and affirming that he has no equitable or legal interest in the property.

I just closed escrow on a small building and I’m trying to figure out who’s who. I received the rental agreements, but the tenant information seems incomplete. The applications, the few that I’ve found so far, are old and outdated. I can’t seem to find any telephone numbers for the residents, and I’m not real sure that the names on the agreements are the same people who actually live in the units. First things first, figure out what you know and what you don’t. Establish individual tenancy files, one per unit. Based on the limited information you have, write down the names and ages of

the occupants, the terms of the rental agreement, written or oral, lease or month to month, rental rate, deposit on file, date paid through. Compile whatever contact information you have, home phone number, work and cell number. Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the information in your files and gathering any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues, than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new monthto-month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is nonrent control, and a month-to-month tenancy, the rental rate and term can be set with either a thirty- or a sixty-day notice of change of terms, depending on the extent of the change. With the recent heavy rains, my apartments have experienced some roof leaks. Most of the leaks are minor, but there is a pretty big leak in one apartment. This is of great concern to me, because the roof is less than five years old, and has never leaked before. I even had it inspected prior to the rainy season by a competent roof inspector. The trouble is that the water leaked into one of my resident’s unit, and apparently caused a substantial amount of damage. The resi-


dent claimed that his stereo equipment, television, computer, furniture, and clothing were ruined. He even has pictures of the water dripping from the ceiling onto his stereo and television set. The resident is threatening to sue me if I don’t reimburse him for his losses. What should I do? Am I responsible for the resident’s personal property losses?

An owner is not generally liable for damage caused to the personal property of a tenant, absent negligence on the part of the owner or his agents. Provided a licensed roofing contractor performed the roof installation, you maintained the roof adequately, had it inspected on a regular basis, and were not on notice of any prior problems, you should not be responsible for damage to the resident’s personal property. Additionally, the tenant has an obligation to mitigate his damages when faced with a leaking roof. This basically means that if the leak was coming slowly through the roof, and the tenant knew about it, then he should have taken some measures to minimize the damage to his personal property. The fact that the resident had time to grab a camera and take pictures of the dripping water, while letting his television set, stereo and other belongings get soaked suggest the resident failed to mitigate his damages. In simple terms, the tenant should have moved his stuff, and grabbed a bucket, rather than watch it drip. trees that stop air flow or cause too much shade in these areas. The best way to remove the mildew safely is to use a power washer with a soapy solution that contains a mildewcide. Once the building is cleaned properly with the power washer, regular prep work can begin and the property painted.

Dear Maintenance Men:

During the recent rains, my building started leaking. I was surprised, as the roof is less than a year old. The odd thing about the leak is that it is only affecting the downstairs units. What is going on and how do I solve this? Michael

Dear Michael:

Water is a funny thing and tracking down leaks sometimes takes a bit of detective work. The first thing we would check is the roof. As you stated, the roof is new, but sometimes the odd flashing does not get caulked and the water finds its way down the side of a pipe, valley or junction area. Have your roofer double check all the flashings. Another issue to look at, is water pooling around the foundation. If you have cracks in the foundation, water will find its way in. Be sure to clear any debris, dirt and leaves from around your building or anything that will cause a water dam effect. Overgrown or old landscaping can contribute to leaks by trapping water or redirecting water to the building instead of away from it.

Inspect the building’s stucco for cracks. We have seen small cracks in the stucco suck in large amounts of water. Pay close attention to the stucco between floors or on the edge of balconies. Balconies shed a lot of water, which may cascade over the edge and flow back into the stucco where a hidden crack will allow the water to enter. If you have aluminum windows, check the weep holes that allow water to drain out of the window tracks.

The kitchen counter tops in my rental units are old and tired looking. I want to upgrade but I am confused about which counter top material would be best. Can you go over the pros and cons of some of the more popular counter top surfaces available? John

Dear John:

We are lucky today to have so many choices of countertop materials available. The four most popular materials are plastic laminate, granite, engineered stone and ceramic tile. Plastic laminate, better known as Formica Brand, is still the most popular choice for apartment counter tops. This is because the choice in colors is almost unlimited and the ease of installation keeps the costs down. With proper care, plastic laminate will last for years. Granite counter tops in the apartment industry are very popular and with good reason. The cost of granite has come down to reasonable levels and the upgraded look of a granite countertop is substantial. They are very tough and are resistant to staining, scratching and

scorching. Granite countertops will need to be professionally installed and sealed periodically. Engineered stone countertops are almost as popular as granite but are slightly more expensive. Popular brands are DuPont & Silestone. Engineered stone countertops are composed of quartz particles and resins and the surface is smooth, non-porous, and scratch resistant. They require less maintenance than granite. Engineered stone countertops

are not DIY friendly and will need professionally trained installers. Ceramic tile countertops have been around almost as long as plastic laminate. They can be installed by the average handyman, DIY person or contractor. They are heat and stain resistant. Ceramic tiles do need to have periodic maintenance to keep the grout lines clean and sanitary. From a management and maintenance perspective, we are finding granite countertops to be the top choice. The price difference between laminate and granite are close enough to warrant upgrading to granite. If you intend to hold onto your investment for a long time, granite will more than pay for itself. Earthquake Test — continued from 20 The Federal Emergency Management Agency (FEMA) found similar cost benefits in a two-year analysis of seismic retrofit scenarios in California. “The benefit/cost analysis suggests that a retrofit is strongly justified economically, even without including the value of life,” FEMA determined.

Avoid Liability, Loss of Income

There are other strong economic factors to consider when weighing the cost benefits of a seismic retrofit. These include potential loss of income and liability associated with damage, death and injury resulting from an earthquake. Loss of income occurs when commercial property is damaged to the point where it is no longer habitable. This can create severe financial hardship for property owners who not only lose their monthly rental income but are simultaneously facing the costs of recovery while still making their origi-

nal monthly mortgage payments. Seismic retrofits also provide an important value enhancement to buildings. A retrofitted structure is worth more because the projected life of the structure has been extended, based on its ability to withstand a major earthquake. Retrofitted structures also enjoy enhanced market value because they are safer and able to withstand the force of our region’s frequent quakes.

Risks of Doing Nothing

What liability risks do building owners face if they do not have their buildings retrofitted? It’s not enough to comply with laws that may or may not require retrofits, a two-year study funded by the National Science Foundation’s Earthquake Hazard Reduction Program determined. Ultimately, it’s up to a jury to decide whether a property owner acted reasonably to protect the public from a known hazard. In a precedent-setting case in Paso Robles, two employees of a clothing

store were crushed to death by falling bricks during an earthquake in 2003. The building had been ordered by the city to be seismically retrofitted, but the deadline to do it had not yet passed. A jury in the case found the building owner negligent based on the fact that he had received a retrofit order, knew the building was potentially dangerous, but had not taken action to correct the problem. The judgment, upheld on appeal, was for $2 million. United to End Homelessness: AAOC Members Are Already Making a Difference—Spring 2020 Update

S

ince 2019, United to End Homelessness has partnered with the Apartment Association of Orange County (AAOC) to educate rental property owners and encourage them to help bridge the housing gap for our most vulnerable population, as participants in the WelcomeHomeOC landlord incentive program. To date, the program has housed more than 150 formerly homeless individuals in 88 households. The new year began, and continues, with significant progress and success stories, as well as new areas of focus and goals for the program. Last November, Orange County became one of only two communities in California to receive the U.S. Housing and Urban Development’s (HUD) new Foster to Youth Independence Initiative (FYI) vouchers. Thanks to the generous donations from the Orange County community and a matching donor, sufficient funds have been raised to house all 25 former foster youth who currently hold an FYI voucher. Again, AAOC is playing an important role in this effort: To date, 14 former foster youth have been housed — and six of them have been housed in properties made available by AAOC members. As a result of this outpouring of generosity, these young adults now have a place of their own to call home. What’s more, the program covers their security deposits and furniture costs, and provides vital case management services.

Also in 2019, Orange County Assemblywoman Cottie Petrie-Norris secured $2.9 million in state funding to expand the WelcomeHomeOC program to house more homeless veterans in Orange County. United to End Homelessness is playing a central role in this collaborative effort to provide housing for homeless veterans who have a Veterans Affairs Supportive Housing (VASH) voucher. The 2019 Point in Time count, which is a count of sheltered and unsheltered people experiencing homelessness on a single night in January, identified a total of 311 veterans experiencing homelessness in Orange County. In 2020, WelcomeHomeOC will continue to make strides toward ending Veteran Homelessness. But we can’t do it alone — we need more rental property owners and operators to join the network and make rental units available so that greater numbers of homeless individuals, who desperately want to get their lives back on track, will have the opportunity to once again become self-sufficient. “As a business owner in Orange County, I feel I have a duty and a responsibility to help and support the community where I work and where many of my family members and friends live, and this community includes those individuals who may not have the ability to help themselves,” said Jeremy Fitzl, Managing Partner of L’Abri Management, a long-time AAOC member and a founding member of the

Fair Housing Month Briefing: California’s New Criminal Background Screening Regulations

A

s we enter into the 2020s, the fair housing statutory and regulatory environment in California has undergone some significant changes that became effective at the beginning of the year. Those changes include the adoption of the state’s first regulations regarding the housing provisions of the state’s Fair Employment and Housing Act (FEHA), the California law that addresses illegal housing discrimination. The California Code of Regulations, or CCR, was long ago established as a means of interpreting and clarifying how complex legislation shall be implemented and enforced, and to assist affected parties to stay compliant with those laws. It is the state-level equivalent of the Code of Federal Regulations, or CFR. While there have been regulations regarding the employment discrimination part of FEHA for many years, it was a lengthy process to establish a similar section for housing discrimination. The resulting first phase is not all-inclusive of the varied provisions of FEHA, and additional regulations are under consideration by the Fair Employment and Housing Council (FEHC), the state body tasked with promulgating regulations related to FEHA. However, the first phase of this process is likely to be seen as quite timely, because one of the housing-related practices it addresses is the consideration of criminal history information in assessing applicants’ eligibility. The use of criminal history in screening is very much a current and

emerging topic. For several decades it has been scrutinized and its use increasingly limited in the employment arena. HUD’s Office of General Counsel issued guidance on this topic with respect to housing in 2016, explaining that certain practices of criminal background screening in housing may amount to discriminatory conduct, due to their having a disparate impact, or discriminatory effect, on the basis of race or national origin. However, there have been no formal regulations on the topic developed at the federal level. A number of local jurisdictions have imposed limitations on the use of criminal background information in housing and its use has been raised in a number of recent fair housing lawsuits, arguing largely from the theory that certain broad practices have a discriminatory effect. The new group of regulations are far more detailed and comprehensive than any of their federal counterparts that may exist. They appear in Title 2 of the CCR beginning at §12005, with ‘Consideration of Criminal History Information in Housing’ appearing at Article 24, starting with §12264. Because they are still very much a work in progress, the FEHC will continue a process of proposing regulations that address other aspects of FEHA’s housing provisions. The numbering of the Articles, or various subjects, reflects this in that many numbers have been reserved for future topics. In addition to criminal background, the current regulations also address the following subjects:

• Article 1. General Matters (primarily definitions) • Article 7. Discriminatory Effect (also referred to as Disparate Impact) • Article 11. Financial Assistance Practices • Article 12. Disability The new subjects now under consideration by the FEHC are ‘Intentional Discrimination’, ‘Discriminatory Advertisements, Statements, and Notices’, ‘Consideration of Income’, and expanding the ‘Disability’ Article to cover reasonable modifications. As previously touched on, Article 24 may be the most initially significant, since the other topics have a more developed history of analysis and application. It also may be the most legally complex of the topics addressed. For that reason, the highlights mentioned here are no substitute for readers diligently studying this Article via the DFEH web site using the link shown below. Black Swan Delivers Mind Blowing Interest Rates

A

finance professor and former Wall Street trader, Nassim Taleb popularized the term, “Black Swan Event” in 2007 to describe events or occurrences that seemingly come out of nowhere and then have huge impact. Coronavirus would seem to fit the definition and indeed its impact has been profound in many quarters, including interest rates. As of this writing on March 8, 2020, the benchmark for long term interest rates — the ten-year treasury yield — has cascaded to the previously unimaginable low level of .76%. And by the time this article is being read in April, heaven only knows where it may sit. The pre-2020 all-time low was 1.37% in July 2016. Such is the extreme volatility that has gripped markets as the specter of coronavirus has absolutely clobbered expectations about global economic activity, sent investors into a tizzy and seemingly removed what was heretofore understood to be the bottommost territory that U.S. interest rates would ever touch. History teaches that any time worries about weakness in the U.S. economy take hold, interest rates can be expected to soften. However, this time it’s been more implosion than softening. To quantify, over just the last thirteen trading sessions, the 10-year yield has plunged a dramatic 81 basis points (.81 percent points). This is “flight to safety” on steroids, with investors bolting en masse out of

stocks and riskier assets and into the safest mattress on Earth, U.S. Treasuries. This realignment of large hunks of institutional capital ultimately accounts for the abrupt, massive decline in the benchmark 10-year rate.

Refi Frenzy

As disturbing as are the health and financial implications associated with this black swan, the lower interest rates do furnish a kind of a silver lining for some. Homeowners are now storming the banks at an unprecedented fever pitch to cash in on the suddenly lower mortgage rates. If a family refinances out of a $400,000 loan at 4.25%, 30-year fixed, to a 3.25%, 30-year fixed, their payment drops $227 per month, which buys a lot of water, toilet paper and other essentials that are now flying off Costco and Walmart shelves, as folks stock up for come what may. Many apartment and other commercial property investors will also refinance into lower rate loans, though those with adjustable rate mortgages may benefit by simply standing pat and letting their current interest rate fall as the indices to which their ARM loans are tied adjust downward. The oft used six-month Libor index is now 1.40% compared to 2.69% one year ago. Of course, many 5+ unit apartment and commercial property ARM loans have floor interest rates; once an ARM loan reaches its floor, the loan interest rate can drop no further regardless of downward moves in the index. One other refinance limitation for some 5+ unit apartments and commercial property owners is the existence of a pre-payment penalty, which virtually all have for some part of the loan’s life and, when in effect, puts an added cost on refinancing. By contrast, 1-to-4 unit properties do not carry pre-payment penalties, which accounts in part for the refi stampede occurring in that sector.

Impact on Apartments

If the coronavirus hits the economy hard for any length of time, low unemployment rates, which have been an ally of rental housing values for several years, will reverse course, some residents will start losing jobs and rent collections would suffer. But even if the current, very mild 3.6% local unemployment rate does begin rising, that won’t change the entrenched housing shortage which structurally keeps demand for rental units and occupancy high; as a consequence multifamily assets should continue to command a premium relative to most other asset classes where the supply and demand equation is less favorable compared to apartments.

Screening — continued from 38 screening policy has a discriminatory effect, those screening applicants on the basis of criminal history should be prepared to show that it is “necessary to achieve one or more substantial, legitimate, nondiscriminatory business interests, such as the safety of its residents, employees, or property.” Further, the implementing practice for the screening needs to “seek, consider, and use only criminal history information regarding directly-related convictions.” This means records of arrest or other non-adjudicated interaction with the criminal justice system, or matters that have been sealed, expunged or pardoned should not be used. Similarly, ‘blanket bans’ on convictions generally, or those that capture broad swaths of criminal law are not to be used. Instead, “in determining whether a criminal conviction is directly-related, a practice should include consideration of the nature and

severity of the crime and the amount of time that has passed since the criminal conduct occurred as provided in criminal history information.” The final element in defending the validity of criminal screening practices is a showing that “[t]here is no feasible alternative practice that would equally or better accomplish the identified business interest with a less discriminatory effect.” The regulation provides a framework for determining whether there is a feasible less discriminatory alternative, explaining that it must be a fact-specific and case-specific inquiry. It outlines five specific factors to be considered, and leaves open the possibility that a court could find other relevant factors. Perhaps key among the specific factors is “whether the practice requires consideration of mitigating information in determining whether to take an adverse action.” Essentially, a defensible policy regarding criminal screening needs to allow a person who may be denied

housing or a housing-related service an opportunity to provide mitigating information that might lead to a reversal of the denial. It provides six specific areas of information that may be included as mitigating information. These include the time that has passed since the conviction, the individuals tenant history before and/or after the conviction, and various factors that may have led to the criminal conduct. It leaves open the possibility that there may be other relevant factors the individual might offer as mitigation. In addition to providing much greater detail regarding the broad analysis just presented, the regulations also identify specific practices related to criminal history information that are defined to be prohibited outright. Estate Planning in 2020 & Beyond

A

properly funded but outdated estate plan is generally better than no estate plan at all. However, an estate plan that takes into account the current state of the 2020 tax laws and that is drafted with flexibility to weather future potential changes in the tax law is exponentially better. While your estate plan may have been excellently drafted to take into account the estate tax laws that were in place at the time your trust was drafted, there have been a great deal of changes to the tax laws in the last 20, 10, and even two years that have rendered many estate plans far from being tax optimized. A quick review of your plan could ultimately save you and your beneficiaries from paying a large amount of taxes in the future, and better protect the assets for generations to come. What’s Your Bottom Line In the Era of the New Norm?

O

ver the past three months, I’ve been addressing various aspects of “Surviving and Thriving with the New Norm.” Now it is time to look at the bottom line. As an owner and investor, what does living under rent control really mean to you? For those who have adhered to the best practices promoted by the AAOC and trusted real estate advisors, only a few adjustments are apt to be required.

However, for everyone else, changes will need to be made in order to sustain a positive return on investment (ROI). In January, when this series started, I cited four key action items. • Compare your current rents to market rates • Review your current tenant base • Look at deferred maintenance, legal or other liabilities

• Calculate the impact to your bottom line and evaluate your options We’ve taken a detailed look at the first three points, all of which are related to the principles of good property management and to the physical aspects of location and of the property, itself. Now it is time to put on your investor hat. This month we are going to take a long and somewhat hard look at your ROI and at the very fundamentals behind why you are investing in rental properties in the first place. Today, with all that is happening, no matter where your rental properties are currently positioned, it is critically important that you step back, look at the investment-driven variables and calculate what rent control’s effect on returns and values means to you. How do you do this? First, accurately measure the return that you are obtaining on each of your properties. This means looking at your cash flows (before and after tax) and

then adjusting those numbers for all that deferred maintenance you have been avoiding. The next step is to estimate expenses going forward over a five-year period. A good rule of thumb is to use 40% of rents as your operating expense ratio. On top of that, don’t ignore upcoming major expenses such as re-roofing, replacement of air conditioning units or exterior repainting. To gain an even more accurate perspective, you may want to re-read the first three articles in this series. Then, honestly evaluate exactly how each of your properties is actually performing. As a part of this process, you might want to contact a trusted real estate professional to establish the current market value for each property. Once you have the income, expenses and current value locked down, you will need to make a few assumptions about future rental increases, repair/maintenance cost increases, vacancy rates and interest rate changes. These are the numbers that enable you to calculate your internal rate of return (IRR). At this point, if you haven’t already done so, you also need to give some consideration as to the potential impact of rent control and other threats to income property ownership. Run some “what-if ” projections based upon what adjustments (if any) you think you should be making in terms of other potential costs from local ordinance changes, even greater limitations on rental increases and the impact upon values at the end of this five year period. With all of the above in mind, now put on your investor hat and do some further projections. Consider your current equity as cash in the bank. Calculate the return you are actually achieving based upon the total costs of ownership, time investment, tax implications and level of risk. Then, compare that return with what you might attain by applying your equity to other real estate options. Quantify the outcomes and determine if an alternative investment might put

you in a better position to achieve your goals regarding security, cash flow, appreciation and/or growth. There is no one single right or wrong answer. Everyone’s situation is different. The bottom line in this Era of the New Norm is that you need to be an aware and an informed owner and investor. Gone is the day (if it ever really did exist) when all you had to do was show up and collect rents. Be realistic and take the actions needed to secure your
