Navigating California’s COVID-19 Rent Relief Program
L
ast month the state and qualified local governments finally kicked off a $2.6 billion dollar “COVID19 Rent Relief ” program funded by the federal government. The program was written to assist low-income Californians who are earning less than 80 percent of the area median income meet their unpaid rent to residential rental property owners. Property owners who participate in the rent relief program may be reim-

bursed for the renter’s unpaid rent between April 1, 2020 and March 31, 2021, if and yes, it is a big if, they agree to waive the remaining 20 percent of the unpaid rent during the period of time. Owners who choose not to participate in the program may only receive 25 percent of unpaid rent between those dates. This is not a course that owners should want to pursue! Eligible renters may, in addition to applying for past due rent, also receive

future rent assistance which will equal to 25 percent of their monthly rent which would cover rent through June 30, 2021. Combined with the assistance available for unpaid rent, future assistance will help renters remain housed once evictions protections expire. Sacramento — continued from 4 have accumulated from April 1, 2020 through March 31, 2021 will be paid 100 percent of cost, limited to a total of 12 months. Owner and/or renter applications must include specific information. Once an application has been fully processed, the owner and the tenant will be notified regarding the status of the application. Applications will be accepted on an ongoing basis, not on a first come, first served basis. In our case, local government is to accept and process the application, not the state of California. Part of the process is to assess eligibility. Does the tenant qualify? The first priority will focus on tenants having an income at or below 50% of the area median income. So, first things first. Find out if you are eligible. Second, amass the paperwork and information you will need to apply. For owners who have one or more eligible renters, you will be reimbursed for 80 percent of each renter’s unpaid rent, as noted, if you agree to waive the remaining 20 percent of their rent during that period. Owner’s must use all payments from this program to satisfy the renter’s unpaid rent. Renters must take steps to verify that they meet eligibility requirements and sign the application. Before applying, owners will need copies of one of the following:
• Mortgage statement(s)
– Property deeds
• Property tax statement
– Mortgage statement
• Copy of a property insurance “statement”
– Property tax statement
May we suggest that any confidential element should not be provided. Thus, the safest of the four previous requirements is the property tax statement. It is a matter of public record. If you have 10 or more tenants, there is a special form to complete. There are other elements that you would expect to complete when applying for rental assistance, which include: • Statement identifying the owner or the agent who has legal authority to lease the property. Once again, may we suggest that if you are the management company, you do not need to provide a copy of the actual management agreement. Evidence that you are the management company should simply include a short statement which is signed by the owner. • A completed IRS W-9 form. Government will report the rental assistance payment to the IRS as income. • To verify residence, one of the following: – Lease – State issued program ID with license – Government issued library card
• Property deed(s)
– Utility statements from the utility provider • To verify ownership, one of the following: (please choose carefully as previously noted):

– Insurance (face page) • To verify rent, one of the following: – A current signed lease which identifies the unit and rent payment amount (please redact all confidential information) – In the absence of a lease, evidence of the amount of rental payment may include: > Bank statements (there is a significant concern of providing a copy of bank statements) > Check stubs or other documentation that shows a pattern of paying rent. > Written attestation by an owner who can be verified as the legitimate owner or manager of the premises. The application process should be understood prior to submission. Processing can take as little as 10 days. The entire program must issue checks to owners by August 1, 2021. ORANGE COUNTY LEGISLATIVE WATCH B y B ill C hristiansen , V ice P resident of G overnment A ffairs
All Politics Is Local
“
All politics is local,” is a familiar phrase in the campaign and public policy world. Attributed to former Speaker of the House Thomas “Tip” O’Neill, who served as Speaker from 1977-1987, the quote applies to the use of political tactics to win elections or move public opinion on specific policy initiatives in local communities. Locally, in Orange County, the March 9 Special Election to fill the vacant Second District seat on the Orange County Board of Supervisors saw Costa Mesa Mayor Katrina Foley defeat long-time AAOC friend John Moorlach. Foley becomes the second Democrat on the Board of Supervisors, while Republicans still hold the other three seats and the board majority. This majority is significant because the supervisorial district lines will be redrawn at the end of this year using the 2020 Census population numbers. Foley’s seat will be up for election again in 2022 and Republicans retain a five-point voter registration advantage in the Second District. The Apartment Association of Orange
County’s (AAOC) Political Action Committee invests its member-donated dollars in support of local candidates seeking office at the municipal, county and state levels of government. As the federal and state governments pass increasingly progressive legislation that erodes property rights, harms small business and taxpayers, and cripples the rental-housing industry, it has become critically important that AAOC identifies and supports candidates who share the values of the association and its members, and who positions on key public policy issues align with the industry. At this point in time, thankfully, not one of the 34 cities in Orange County have rent control or vacancy control policies, city codes or laws above and beyond the rental housing laws of the State of California. As we begin preparing for the 2022 elections, the AAOC PAC will start to identify, interview, and invest in local candidates who, again, share our values and whose positions on key policy issues reflect support for our members and the rental

housing industry. Last year, 75 percent of AAOC’s endorsed candidates won election in November and we look to build upon that win percentage in 2022. AAOC has already been busy this year setting up meetings with the victorious candidates and forging relationships with these local policy makers who will potentially vote on rental-housing issues during their terms in office. The AAOC Legislative Committee has also been working with the NAA and CalRHA Legislative Committees to lobby our federal and state representatives on sunsetting eviction moratoria rulings and legislation. Many rental housing providers cannot remain in business much if they cannot collect rent or evict those renters who are abusing and taking advantage of the safety net established by the government. With the broader distribution of the COVID vaccine and the incremental loosening of California’s lockdown orders, hopefully our state legislators will start to refocus on other important public policy matters, rather than on those that will effectively cripple and destroy the rental housing industry. AAOC will continue fighting for its members and keeping them informed with up-to-date information and Red Alerts as the legislative session moves forward this year. Questions & Answers I’ve been doing my own prospective resident screening for quite a while now. I think I’m pretty thorough, but I’m just not sure anymore. I’ve been noticing more and more inconsistencies in the applications I review, and I even came across one who out-and-out lied about who she was! I’m concerned about all of the stories I’ve heard about identity theft. I just can’t afford to make a mistake. What can I do to weed out these undesirables and minimize my chances of being fooled?
Identity theft has been a growing problem for several years. Landlords have increasingly been victimized by prospects posing as someone else, using false or fraudulent information. Often times, these thieves take advantage of a desperate landlord, eager to fill a vacancy, or a newbie landlord, who hasn’t gone through the school of hard knocks yet. Completed and signed applications by all adults are a must. Verify the information provided. Personally inspect some form of U.S. government issued photo identification. Make a photocopy of the ID and keep it secured with your file. Verify that the social security or the tax ID number provided by the prospect is actually his number, and is valid. Run and thoroughly review an eviction and credit check through your apartment association. If practical, go outside to the prospect’s vehicle, and verify that the license number on the car he just drove, matches the license number he just wrote down on the rental application.

Many ‘hands on’ owners will actually visit the prospect’s current residence unannounced, prior to approval to ensure the prospect actually lives there, and doesn’t just sleep on the couch. You’d be amazed at what you will learn by a simple visit. Inform all prospective applicants that you have a policy of taking a picture of all residents for the tenancy file. Follow through with this policy and actually take a picture of all proposed occupants and keep the picture in your tenancy records. When verifying employment and residency, ask for a description of the person, and compare the description with the person who filled out the application. Ask for original utility bills, electric, telephone, cell phone, cable, anything with his name on it. All of these are tools that may be used in proper screening to avoid renting to an identity thief. Use these tools consistently, and apply them equally to all applicants, and your risk will be dramatically reduced. I like to give my residents an incentive to pay their rent on time. My rental agreement provides a discount to my tenants of $25.00 if they pay their rent timely. Specifically, if they pay on the first their rent is $900.00, but if they pay on the second or later it is $925.00. My question is, which amount do I put on the three-day notice to pay rent or quit if they don’t pay at all?

$900.00. Most courts would consider the additional $25.00 a penalty or a disguised late charge. The courts would reach this conclusion based on the terms of your agreement, that is if the due date, per the agreement, is the first, then the proper amount of rent to demand is that amount that was required to be paid on the first, specifically the $900.00. However, an incentive that encourages early payment, specifically payment before the first, would survive because the amount due on the first would be $925.00, but if paid prior to the first, only $900.00. My building has just enough parking spaces for my residents to each have one space. If a resident has more than one car, they must park it on the street. It has been working out fine for years but now I have this one tenant who refuses to follow the rules. He is constantly parking his second car in someone else’s assigned spot. I’ve told him several times, but he just ignores me. What do I do?
Your written community rules and regulations should specify your parking rules, specifically stating that only one vehicle may be parked on the premises, and that all parking is assigned. Ensure that you have the proper signage at the entrances of the parking area. Legal Q&A — continued from 10 number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for their specific requirements, as they vary from city to city. Next, if you know the offender, then provide a written warning of the violation. Attempt to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield of his car. If practical, take and save a photograph of the warning on the vehicle windshield, because the offender will always claim that you did not give prior notice before towing. If he fails to remove the offending vehicle, the car may be towed, according to the terms of your parking rules. My new tenants just moved in a monthand-a-half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to
moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?
No, you can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit — Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the

My pest control company has removed a beehive from my property. However, the bees have not left and the tenants are complaining about bees inside their units. I have sealed every hole, crevasse and crack I can find. Yet, the bees still find a way of getting into the units. What is missing or are these bees just too smart? Bert
Dear Bert:
We have had a similar problem at one of our properties. We also sealed everything we could think of and still the bees found a way in. You may want to look at your roof vents that service the bathroom & kitchen exhaust fans. The bees come down the vent and go into the voids between the ceiling and roof. Most fan boxes are not well sealed below the fan blades. Once they are in the ceiling, it is easy for them to travel
to different units, find a hole and drop down into the apartment’s living area. Because the bees may be discovered in an area far from the original entry point, it is hard to track down where they first came in. We now install screening at all bath and kitchen exhaust vent tubes. The material used is 1/8 inch square metal screening and is attached to the top of the vent tube at the roof level. Be sure to extract the hive and any honey you find or you

The kitchen countertops in my rental units are old and tired looking. I want to upgrade but I am confused about which countertop material will be best. Can you go over the pros and cons of some of the more popular countertop surfaces available? John
Dear John:
We are lucky today to have so many choices of countertop materials available. The four most popular materials are plastic laminate, granite, engineered stone, and ceramic tile. Plastic laminate, or better known as Formica brand, is still the most popular choice for apartment counter tops. This is because the choice in colors is almost unlimited and the ease of installation keeps the costs down. With proper care, plastic laminate will last for years. However, it can be easily scratched by knives or scorched by hot pots. Laminate counter tops can be easily installed by the average handyman, DYI person, or contractor. Granite counter tops in the apartment industry are very popular, and with good reason. The cost of granite has come down to reasonable levels and the upgraded look of a granite countertop is substantial. They are very tough and are resistant to staining, scratching, and scorching. Granite countertops will need to be professionally installed and sealed periodically. Engineered stone countertops are almost as popular as granite and are slightly more expensive. Popular brands are DuPont & Silestone. Engineered stone countertops are composed of quartz particles and resins and the surface is smooth, non-porous, and scratch resistant. They can be installed by the average handyman, DYI person or contractor. They are heat & stain resistant. Ceramic tiles do need to have periodic maintenance to keep the grout lines clean and sanitary.
From a management and maintenance prospective, we are finding granite countertops to be the top choice. The price difference between laminate and granite are close enough to warrant upgrading to granite. If you intend to hold onto your investment for a long time, granite will more than pay for itself.

You are in luck. There is a very simple solution. Every garbage disposal unit comes with a rubber drain deflector. When the deflector becomes old, the rubber hardens and stays open to the drain allowing spoons, forks and other items to fall into the drain, but more importantly, it allows sound to escape. Go to your local hardware store and buy a new rubber drain deflector. The disposal noise will almost disappear. Careful you do not forget to turn off the garbage disposal! Latest Stimulus Brings More Rental Assistance Special from the National Apartment Association
A
dditional funds will help close the growing gap of tens of billions of dollars of rental debt accumulated during the pandemic. On March 11, President Biden signed into law the newest COVID-19 relief package, the American Rescue Plan Act of 2021 (ARPA). Thanks to the tens of thousands who participated in NAA’s calls to action throughout the pandemic and at NAA’s Virtual Advocate Conference, Congress again addressed the industry’s critical call for additional emergency rental assistance and other federal financial relief solutions to help stabilize residents and ensure the continued viability of the rental housing industry. First and foremost, ARPA includes $21.55 billion in dedicated emergency rental assistance funding, which continues federal support of state and local rental assistance programs across the country. Combined with the $25 billion in rental assistance funding allocated in the Consolidated Appropriations Act of 2021, these funds are a significant step in closing the growing gap of tens of billions of dollars of outstanding rental debt that have accumulated during the pandemic. Plainly put, the funds are a lifesaver for both renters and housing providers who have been hardest hit. Additionally, the new law does not extend the federal eviction moratorium that remains in place until March 31, 2021 (note that NAA has ongoing legal challenges to the CDC eviction order, and that two federal judges have ruled

the order unconstitutional or unlawful in the past several weeks). NAA continues its federal advocacy work with Congress and the Administration to stress that extensions or expansions of the CDC’s order are not the right policy solution to the nation’s housing challenges. We steadfastly maintain the importance of balanced and sustainable housing policies like streamlined, targeted rental assistance to get the rental housing industry through the crisis and beyond. Furthermore, ARPA provides additional aid for both individuals and small businesses. The plan allocates a $7.25 billion boost to carry out funding of the Paycheck Protection Program (PPP) and Second Draw PPP, both of which are set to expire on March 31. Unemployment benefits received a sixmonth extension until September 6, 2021 and individuals receiving unemployment benefits will now receive an additional $300 per week. Individuals that make less than $75,000 and couples that make less than $150,000 per year will also receive one-time payments of $1,400 per eligible individual and dependent. The law also allows for some households to qualify for a reduced stimulus payment.

HUD’s Recent Revision of Discrimination ‘Because of Sex’
S
ince a 1974 amendment to the original 1968 Fair Housing Act (FHA), it has been illegal across the nation to discriminate in any housing-related activity ‘because of sex.’ Sex was added as a fifth basis covered by the FHA, which originally focused on race, color, religion and national origin. That change, brought about by the same law that among other things created the Community Development Block Grant (CDBG) program, was consistent with many changes in federal law outlawing sex discrimination that took place in the 1970s. As some will remember, during that time there was an ultimately unsuccessful attempt to adopt the Equal Rights Amendment (ERA) to the United States’ Constitution. Interestingly, due to the unintended consequence of an unsuccessful ‘poison pill’ attempt to scuttle the Civil Rights Act of 1964, the outlawing of sex discrimination in employment had been the law of the land for 10 years at the
time of the FHA’s amendment. That last fact is of consequence, because it is the judicial interpretations of the protection ‘because of sex’ available in the context of employment that have now given rise to an expansion by the U.S. Department of Housing and Urban Development (HUD) in how it will treat claims of discrimination ‘because of sex’ in the housing context. It should be noted that it is not that unusual that interpretations of anti-discrimination provisions of employment law have an influence on housing discrimination law. A substantial amount of the legal framework applied to analyzing and shaping housing discrimination litigation has originated from civil rights cases dealing with employment discrimination. Throughout most of its history, the basis of ‘because of sex’ had been fairly narrowly interpreted. Generally, it was viewed from the point of view that sex should be taken to mean a person’s gender as determined at birth. Differential

or adverse treatment shown to have been motivated by that gender were found to be discriminatory. Also, due to fact that women are overwhelmingly the victims of sexual harassment, courts had found in both the employment and housing contexts that ‘because of sex’ is applicable to address that harassment. Similarly, in the housing context it was found applicable to discriminatory conduct towards victims of domestic violence, who again are overwhelmingly women. However, until recently the interpretation did not extend to differential or adverse treatment based on person’s sexual orientation or gender identity. On June 15, 2020, the U.S. Supreme Court issued a ruling covering three cases that had arisen from and formed a ‘split decision’ within three different federal Circuit Courts of Appeals. In an employment case known as Bostock v Clayton County, by a 6–3 ruling, the Court determined that discrimination on the basis of sexual orientation or gender identity is necessarily also discrimination “because of sex” as prohibited by Title VII of the Civil Rights Act of 1964. In light of that ruling, fair housing advocates were quick to pronounce that litigation to address housing discrimination on the basis of person’s sexual orientation or gender identity, including a person being transgender, would be viable under the FHA, given its same use of the ‘because of ’ construction. HUD Revision — continued from 22 Now, with the new presidential administration in place, and as a result of President Biden’s Executive Order 13988 on Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation, HUD has issued a memorandum that has instructed its Office of Fair Housing and Equal Opportunity (FHEO) and its fair housing program grantees to interpret sex discrimination under the FHA to include discrimination because of sexual orientation and gender identity. The February 11, 2021 memorandum issued by Acting Assistant Secretary for Fair Housing & Equal Opportunity, Jeanine M. Worden, specifically instructs that “immediately, FHEO shall accept for filing and investigate all complaints of sex discrimination, including discrimination because of gender identity or sexual orientation that meet other jurisdictional requirements.” It requires grantees under the Fair Housing Initiative Program (FHIP), such as the Fair Housing Council of Orange County, to interpret sex discrimination under the FHA to include discrimination because of sexual orientation and gender identity. And for complaints originally filed with FHEO but referred to state and local agencies that process those cases through the Fair Housing Assistance Program (FHAP), their process must be consistent with the holding in Bostock. The state or local law under which the FHAP agencies operate either must explicitly prohibit discrimination because of gender identity and sexual orientation, which is already the case in California, or they must interpret existing sex discrimination

coverage to include discrimination because of gender identity and sexual orientation. An important thing to note is that HUD’s action is based on an Executive Order and an internal memorandum, neither of which has the same legal standing as a statute or even a properly adopted regulation. While the decision in Bostock is of significance in supporting the application of the FHA to sexual orientation and gender identity, it remains to be seen if those called to answer to complaints based on this interpretation of the FHA will bring judicial challenges to that interpretation. Such challenges might delay the resolution of those complaints, but at the same time they may also end in a complete affirmation of the correctness of the interpretation, making moot the need for formal regulation or statutory language. It is also possible that the Bostock decision will be the impetus to amend the FHA to explicitly include these bases. The Equality Act recently passed by the U.S. House of Representatives would do just that. It remains to be seen what portions of that bill might survive consideration in the U.S. Senate, but an alignment of the FHA with the holding in Bostock is perhaps more likely than not. So given the foregoing, is this new HUD interpretation of ‘because of sex’ of any consequence to California? As earlier stated, the state’s Fair Employment and Housing Act (FEHA), which is enforced by the Department of Fair Employment and Housing (DFEH), has explicitly covered sexual orientation since 2000, and gender identity and expression since 2012. DFEH has substantial experience in handling complaints for housing discrimination that have been filed on those bases. So, will the ability of victims of that type of discrimination to file with FHEO instead of DFEH have much of an effect? Well, it might. If FHEO decides to retain such complaints instead of referring them to DFEH in its capacity as a FHAP agency,

any complaints proceeding to a HUD charge of discrimination might then result in a filing in federal court. Either the complainant or the responding charged party, in a case that does not otherwise reach a binding settlement, has the right to remove it to federal court instead of having it heard by an Administrative Law Judge. The complainant is then essentially represented by the U.S. Department of Justice, which brings the case on behalf of the United States of America. The alleged victim of the discrimination then may choose to intervene as a plaintiff and secure their own counsel. Another difference is that in the federal process there is no mandate for an attempt to reach a mediated settlement before proceeding to a court filing, as there is in the state process following a charge. State complainants who do not mediate in good faith may forfeit their right to have DFEH represent them in state court. In general and for several reasons, fair housing advocates have a preference for litigation in the federal courts rather than state ones, but of course that being readily available will depend on the choice of HUD to retain a complaint or refer it to a FHAP agency. Only time will tell whether this recent change by HUD will result in any meaningful impact for California victims of housing discrimination on the basis of sexual orientation or gender identity. April Reckoning Time: Really Looking at the Numbers

pril is often the month when our income and expenses, along with our profits and losses, take on a definite reality as we prepare to submit our tax returns and, in some instances, write one more check to the Internal Revenue Service. For 2020, owing more tax dollars is not apt to be much of a concern. And, although minimizing tax liabilities may be a benefit gained from owning a rental property, it should not be the driving force behind that investment. Bill Gorman, in the first chapter of his book, Cash In on the Myths of Real Estate, cites as one of his TOP Four Myths: “A tax time review is all that is needed.” In many ways, a portfolio review at tax time is counterproductive. When working on your tax returns, the focus is on minimizing tax liabilities rather than on performance and profit potential.”
both economic and real estate-related events that have affected property performance. Generating a profit from the day-to-day operations has become a challenge. For the most part, rents have stagnated, while expenses have increased. Collecting past-due rents has become increasingly tenuous and extended eviction moratoriums have further impacted how long it will take for an actual return to some degree of normalcy. These are all well-recognized facts. Now, with all the 2020 numbers readily available, it is time to do some pro forma quantifying and return on investment (ROI) analysis. However, rather than just looking just at the reported numbers, the focus needs to be on using that data and deciphering the trends to make informed projections. This shift into an investor viewpoint may require some additional assistance. When Bill wrote about Myth 1-2, he recommended: “When tax time rolls around, you may want to make an appointment not just with your tax preparer, but also with your real estate advisor. In addition to an update on market trends, rents and property values; the two of you should also be analyzing how well your real estate investments are doing in terms of meeting your financial goals.”
Additionally, an annual tax-time review is, from Bill’s perspective, insufficient. Although the multifamily real estate market has tightened considerably, there are still buyers and the lack of inventory has kept prices from dropping significantly. The pandemic has had a dramatic impact. Even with the roll out of vaccines, everyone continues to live with uncertainties. Priorities have changed and so have future goals. This applies not just to each of us personally, but to our children and to their children. It really is time for some re-evaluation. Reckoning is defined as the action or process of calculating and estimating something, but that is not necessarily all that needs to be done. Along with looking at property performance financials and projections based upon the numbers from your 2020 tax returns, a full portfolio review should also take into account how well those properties and/or various available options serve to secure the future that you want for yourself and your family. March General Membership Meeting Recap

AOC members were treated to a “bonus” general membership meeting last month, as ongoing COVID-19 restrictions and the slow rollout of vaccinations forced postponement of the annual trade show until later in the year. The bonus meeting in March – usually a “dark” month – was an opportunity for AAOC to offer its members something to fill the void. It also provided an opportunity for AAOC to recognize its members who are celebrating their 10th, 20th, 30th, 40th and 50th membership anniversaries in 2021. Members enthusiastically seized the opportunity to attend the online meeting and “Ask the Experts” their legal, maintenance, and property management questions. The expert panel, comprised of Stephen Duringer (Duringer Law Group, PLC), Frank Alvarez (Buffalo Maintenance) and James Wohrman
(FDC Management), imparted valuable information, tips, and sage guidance on a wide range of topics, with an obvious focus on COVID-19-related situations and scenarios. Stephen Duringer kicked off the program with a general legal update and then discussed the different rental assistance programs that are presently available (including the cities of Anaheim, Irvine and Santa Ana) and that the state’s rent relief program would be rolling out March 15. He indicated that there is $2.6 billion in rent relief funding available, which would provide 80 percent of a residents’ rent arrears to their landlord during the covered time period, if the landlord agrees to forgive the remaining 20 percent. There is also an option by which tenants can receive 25 percent of the rent they owe between April 1, 2020 to June 2021, to pay their landlord and be able to maintain pos-

session of their unit when the eviction moratorium ends on June 30, 2021. Duringer indicated that landlords can apply for multiple programs, and will be screened accordingly, to avoid double dipping. He also pointed out that about 94 percent of landlords are receiving rent payments. James Wohrman followed Duringer and discussed property management issues and the experiences his company, FDC Management, encountered during the early days of the pandemic. He equated it to a “bad body blow.” When the pandemic hit, FDC Management immediately gave a temporary pay raise to employees, as well as a five percent discount for three months to residents. Wohrman indicated that 98 percent of residents have been “stand-up” about paying throughout the pandemic. Meeting Recap — continued on page 30

Meeting Recap — continued from 28 Wohrman stressed the need for continued “human interaction” despite the pandemic, and how FDC’s leasing offices remained open but with boundaries established to ensure appropriately safe distancing. Units continued to be shown in person, but in a contactless manner, and FDC maintained close ties with its team members via lively video chats. Wohrman also indicated the importance of utilizing a Ratio Utility Billing System (RUBS) to help with overall costs. Finally, Frank Alvarez talked about the maintenance and repair work that his company has done during the past year. He indicated that service requests have increased 80 percent during the pandemic, with plumbing, electrical and appliances being the top three areas. There was initial tenant reluctance about
service staff entering their units to do the repair work, but in time that tenants felt more comfortable with the precautionary safety and sanitary measures being taken by Buffalo Maintenance. Alvarez pointed out that material costs are escalating, including plywood which typically costs $38 but has risen to $72, due to earlier southern California fires and trade issues with Canada. He talked at length about SB 721, the legislation that was signed into law in 2018 and requires an inspection of decks balconies, and other elevated wood structures in apartment buildings, by January 1, 2025. He warned that while this date may down the road a bit, it takes time to get an inspection, and urged members to complete this sooner than later. Is Your Building on Stable Ground?

ow vulnerable is your apartment to earthquake damage? If it is located within a fault, landslide, or liquefaction zone, it may be at risk — and a combination of any of these could be disastrous. Active earthquake faults in Orange County run along the coast and mountain ranges, hitting places such as Huntington Beach and Yorba Linda. And the hillside communities of Laguna Beach, San Clemente and Santiago Canyon are prone to landslides that can be triggered in a major earthquake, potentially undermining the foundation of a home, or sliding into one. Liquefaction areas can be found throughout the county, most notably wherever water flows either above or below the ground: In the aquifer-rich region of central and coastal Orange County, Garden Grove, Santa Ana, Irvine, Huntington Beach, and Yorba Linda, to name a few. Liquefaction amplifies the impacts of seismic waves produced during an earthquake. The ground reacts like Jello-O: jiggling, undulating, and putting the structures built upon it in jeopardy. The United States Geological Survey has published an interactive map online, enabling the public to search by property address to determine the earthquake risks associated with specific land parcels. Return on Investment and the Covid Relief package
W
ill U.S. citizens and taxpayers get their anticipated money’s worth from the $1.9 trillion they will spend on the Covid legislation signed into law by President Biden in March? That $1.9 trillion price tag breaks out to about $6,000 per person, meaning, in a sense, that each American is putting up $6,000 of their net worth to cover this spending. That’s a gargantuan ask of America’s current and future taxpayers relative to historical social spending outlays. The entire U.S. economy was roughly $21 trillion in 2020 as measured by Gross Domestic Product (GDP). This makes the Covid package by itself ~9% of last year’s GDP, a prodigious percentage indeed. But just because the scale of the spending measure is record-breakingly high doesn’t make it a bad idea, or unworthy. As with all ventures, large or small, it’s about returns, and getting bang for the buck commensurate with resources expended and risks taken. We’ll note here that in the economic disaster of a year that was 2020, U.S. GDP fell about 3.5%, which constitutes the largest economic contraction the nation has experienced since 1946. Ten million American jobs withered away under the stress of the pandemic. That woeful situation, in concert with the election results of November 2020, set the stage for this behemoth spending package. In essence, the Biden fiscal stimulus plan is designed to put a floor under the U.S. economy that will, theoretically,

allow sufficient economic traction to take hold which will in turn enable the nation’s private sector to re-assert itself and deliver sustainable, long term GDP growth, and as byproduct of that, get America back to full employment. As the adjacent chart shows, we finished 2020 at a painful 6.9% national unemployment rate. A return to the 3.9% unemployment rate that we enjoyed at the conclusion of Q4 2019, or something close to that, is the goal sought. Unlike the experience of deploying funds to purchase an apartment building, where analysis exists in the realm of cap rates and projected future cash flow, the returns on the Covid Relief package will not be as neatly quantifiable. That being said, it IS clear that an enormous bet is being made here that science and medical expertise can keep Covid and its nefarious variants at bay long enough to achieve herd immunity and allow the economy to fully and safely re-open. But the stimulus spending needs time to take root in order to maximize its effects. If science wins and a significant Covid resurgence is avoided, then the stimulus spending will have the opportunity to allow the seeds it plants to sprout. On the other hand, a major virus spike could end up making Covid relief legislation merely a gigantically expensive band-aid rather than a foundational building block. For now (as of the writing of this article on March 18) it appears that investors are putting their money on April 2021
science and vaccines. Almost all U.S. equity markets are at or near all-time highs, suggesting Wall Street expects a strong economic recovery without significant Covid interference. The fact that the Covid relief spending will flow disproportionately to lowerincome Americans is the novel aspect of this legislation. It contains the supposition that getting money into the hands of the poor and disadvantaged will translate to greater social stability and a resultant strengthening of the underbelly of the economy. The elements of a social safety net embodied in the plan reflect somewhat of a European model, versus the traditional American approach. For apartment owners, Covid relief should almost certainly be a boon. It puts money in the pockets of tenants, which facilitates the payment of rent… that looks like a win for landlords. As to the macro view, the spending strategy ostensibly provides the platform on which heavy pent up consumer demand can meet up with and embrace the many business efficiencies and innovations that have been quietly developing over the past year; and that is a formula for a springboard recovery and extended productivity, again, assuming Covid remains relatively contained. So yes, there’s legitimate sticker shock over the price of this legislation. But if America is able to right itself and fully engage its economic firepower using stimulus money as fuel, the returns — financial and societal — will justify the investment.

California’s Balcony & Deck Inspection Law Get Ready to Comply with SB 721 Senate Bill 721 requires multifamily residential buildings with three or more dwelling units to have their balconies and other exterior elevated elements inspected by January 1, 2025, and every six years thereafter. Wood-based external elevated structures, including decks, porches, stairways, walkways, and entry structures that are more than six-feet above ground level must be inspected by the state-mandated deadline.
