I don’t know if many of you are aware, but today AAOC ‘s membership numbers continue to grow with over 81,000 units represented. Just for some historical perspective the number of units represented as of May 2010 was 56,706; which computes to a 43% increase. Having been a member for 20 years, I have always appreciated all that AAOC does for our industry. But it wasn’t until joining the Board of Directors did I recognize all that it does. A lot of the benefits are obvious to most: a huge annual Trade Show (46 and counting) a terrific monthly magazine — “Apartment News”, membership meetings and upto-date forms. s every landlord, including this one, all too well knows: so much of our multi-family housing industry is affected by laws and regulations coming out of the offices of our State Assembly member and Senators. This is exactly the reason that every spring time, the Apartment Association of Orange County and its Legislative Committee head north to Sacramento. This past month when I had the

pleasure of leading our association delegation in our Annual Sacramento Legislator Fly-In, held at the California State Capitol. With the help of Apartment Association of Orange County and Lobby Team of Jon Smock and Ron Kingston, whose monthly column appears here in Apartment News Magazine, we were able to meet with 14 members of the State Assembly and State Senate from Southern California.

In addition, we had added support with the attendance of our sister organizations though our affiliation with the California Rental Housing Association (CalRHA) and the National Apartment Association (NAA), assisting our efforts in Sacramento. Our leg team offered the reminder: the Apartment Industry in the OC remains a vital component to the overall economy: there are over 545,000 apartment homes in Orange County


which translates into $38 billion in economic activity. That economic footprint supports an estimated 950,000 Orange County jobs. O

n April 5 your association leadership joined with leaders of other independent California NAA affiliates to meet with their legislators in Sacramento to discuss several important bills of special interest to owners and managers of residential rental housing. The largely unspoken underlying theme, of course, is what legislative action may be taken to address the obvious and growing California “housing crisis”—too few homes for too many people with too few private or public resources to address current needs as well as a gigantic backlog of unmet need. The repeal of the redevelopment law—both cursed and praised—left a huge billiondollar hole in tax proceeds dedicated to construct and improve low and moderate income housing. The disappearance of that sustainable source of funding has fostered a number of proposals for replacement, some modest and others bold. It also has generated a call from some quarters for more and severe

regulation of rental housing. It is with that backdrop that your leadership approached this year’s Lobby Day in Sacramento. Legislators and their staff members were very cordial in making limited time available to address these important issues both in generality and specificity. We grouped to oppose several regulatory bills affecting both new and existing housing in juxtaposition with funding measures deserving of support notwithstanding their effect on taxes—a tough sell! As one might expect, we received mixed signals on the tax issue but largely favorable reactions on bills that we opposed. At the top of bills to oppose was AB 1506 (Bloom), which would repeal the Costa-Hawkins Act, a significant 22-year old housing measure that excluded from rent control single-family homes and all developments built after 1995 (or earlier if a rent control ordinance exempted new construction from a specific point in time), while giving

owners of existing housing stock in rent controlled communities the right to establish initial and subsequent rental rates. That 1995 Act was approved by the Legislature to put the brakes on local governments’ overreaching and strict rent control ordinances that were spreading throughout the State and negatively impacting the economy and the housing industry. Its repeal would usher in a new wave of local ordinances adopting the strictest forms of price and rent controls. The result would be catastrophic Following a similar regulatory trend are measures that would require inclusionary housing for moderate, low, and very low income levels in all new developments. These include in varying degrees of specificity and detail: AB 1505 (Boom), AB 915 (Ting) and SB 277 (Bradford). In many respects, the inclusionary housing requirements imposed on new construction are more onerous than a typical rent control ordinance because they require deed-


restricted occupancies based on income for up to 55 years or more. In total, the regulatory approach to the housing shortage by keeping rental rates artificially below market necessarily reduces the income stream for improvements, maintenance and repair of existing units, while, at the same time, negatively affecting the investment and development of muchneeded rental housing. Money, money, money. Where to get the funds necessary to address all of California’s many needs? State funding priorities are like shifting sands in the desert. Thanks to Proposition 98 and the education community, K-12 education funding takes the lion’s share right off the top of each years state budget. Everything else scrambles for secondor third-fiddle with barely more than a half of loaf left. At this writing, the Senate is poised to vote and send to the Assembly a multi-billion dollar transportation measure to “fix” degraded highways and roadways throughout the State. It constitutes a huge funding boost on top of an already very expensive State Department of Transportation. Where does housing fit in? Without question, California needs more housing. According to a recent report from the Assembly Housing and Community Development Committee, California has a housing shortage—we simply are not building enough homes to keep up with the high demand. This is particularly true for low-income rental units while middle-income households are priced out of buying

homes. Over regulation, high development and permitting costs and a lack of consistent public funding have contributed to California’s housing shortage. SB 3 and ACA 11 will help address California’s housing problems. SB 3 (Beall) would authorize issuance of bonds in the amount of $3 billion to finance various existing housing programs. Bonds add more debt and are costly one-time affairs, not long-term sustainable, but certainly satisfy a nearterm need. ACA 11 (Caballero) would impose a 0.25% tax on all retailers to be placed in a newly created “California Middle Class Affordable Housing and Homeless Shelter Account” in the state General Fund for the support of local and state programs that assist in the development or acquisition of housing. We support these bills not only because their passage will lead to a much needed boon in housing development, but also because these bills focus on building homes through bond and sales tax money instead of targeting the rental housing industry for regulation such as rent control and just cause for tenancy. The State must continue to address the housing shortage problem through investing in affordable home development and rehabilitation, rental and homeownership assistance and community development. Targeting our industry with more regulations and eliminating rental property owner rights and protections such as under the Costa Hawkins Act and Ellis Act

will serve to drive up costs, force rental property owners out of business and reduce incentives to build, maintain and invest in more badly needed housing. Our industry representatives did an outstanding job presenting compelling reasons to oppose AB 1506 and AB 1505 (Bloom), AB 915 (Ting) and SB 277 (Bradford) and support SB 3 (Beall) and ACA 11 (Caballero). time period to check title, condition and other issues. Once escrow is open, and you are satisfied with title, and the condition of the premises, contact the resident, confirm the terms of his tenancy, get a copy of his rental agreement, and prepare an estoppel certificate for the resident to sign affirming the tenancy agreement, amount of deposit, and affirming that he has no equitable or legal interest in the property.

Just opened up the mail, and what do you suppose was in it? A notice from my bank informing me that one of my tenant’s rent

check was returned unpaid because he placed a stop payment on it. Imagine that, it’s now mid-month, no warning, no phone call, the deadbeat didn’t even have the courtesy of letting me know he was going to stop payment on his check. It kind of makes sense though, he asked a couple of weeks back if I’d let him out of his lease early, guess his girlfriend has a nicer place and he wanted to move in with her. I called

We have a guesthouse in the back of our home. The place has been there forever. Anyway, after the kids went off to college, we started renting it out. The current tenant signed a lease to pay rent plus their prorated portion of the monthly utilities. We didn’t get a payment this month. I am getting ready to serve a default notice, but I want to make sure I do it correctly. He owes rent and the utilities. Not sure if I can include both on the same notice. How can I recover the utility portion? Also, what if the resident pays the rent, but fails to pay the utilities? The utilities aren’t much, should I just let him run an outstanding balance and either deduct it from his deposit when he leaves or maybe ask for it when it gets a bit higher?

First, the outstanding utilities should be paid timely and can be demanded through the service of a 3-Day Notice to Perform or Quit for Breach of Covenant. This notice should be served concurrently with your three day notice to pay rent or quit. The Notice to Perform would inform the resident of his default in payment of the utility charges, and would require that the tenant perform by paying the outstanding utility charges within three days. It’s never a good business practice to carry balances over from one month to the next. When the time comes for you to take action, your prior conduct of accepting late payments without objection could result in the court finding that you ‘waived’ your right to receive payment on time. Such a ‘waiver’ of your rights and remedies may prevent

Q&A — continued from 11 his phone number, got a recording saying that it had been disconnected. His cell phone works, got his voice mail, and left a message. I’m guessing that when I swing by later today, it’ll be empty. What do I do now? I don’t want to make any mistakes; can I just change the locks if he’s out?

You have a couple of issues that you need to resolve, first the issue of return of possession of the premises, and then, of course, getting you paid. If the tenant appears to have vacated when you visit the unit later today, then you must follow certain procedural rules before you simply change the locks. Ideally, you will be able to contact the tenant on his cell or at work. If you make contact, ask that the tenant confirm that he is out by faxing or emailing you written confirmation. If you are able to confirm that he has moved out, you will not have to follow the abandoned real property notice requirements, and will be able to

retake possession immediately. If when you visit the unit, and find that it is vacant, and if the rent is due and unpaid for fourteen days, and the tenant has not voluntarily surrendered possession, then you must serve a written notice of Belief of Abandonment of Real Property. The notice can be posted on the premises and mailed by regular mail to the tenant’s last known address, your property. You must wait eighteen days before you retake possession. If the tenant does not reply, in writing, by informing you of his address for service of an unlawful detainer within eighteen days, then you may retake possession, and change the locks. Once you regain possession, prepare the security deposit disposition form. If he skipped mid lease, he will owe the balance of the term, or until you mitigate your damages by reletting the unit, whichever occurs first. Hang on to the tenant’s check that was returned by the bank. Stop payment orders are only effective for six months, unless renewed by the

maker, which rarely happens. That means, in six months and a day, you can redeposit the check, and if there are sufficient funds, the check will clear. I recently had the pleasure of spending my entire morning watching small claims cases come and go, while waiting for my own. The more I watched, the more I realized that it is a highly “subjective” area, and prone to a lot of “creative” testimony. Needless to say, by the time my case was called my confidence level had been reduced several notches. I guess I did ok, at least better than most, but I’m not sure what I could have done that would have helped. Can you give me some pointers that will help me out next time?

If landlords and tenants are meeting in small claims court, it usually is because the tenant is suing the landlord over a security deposit, or the landlord is suing the tenant over damages done to the unit over and above the security


deposit, or some combination of the two. Whatever the underlying cause of action, there are many things a landlord should do that would greatly reduce the chances of being brought into a suit, or if a suit is brought, will greatly increase the landlord’s chance of prevailing. Proper tenant screening at the inception of the tenancy will effectively weed out the “habitual” litigant. By verifying past tenancies, many former landlords will volunteer past disputes, and their outcome, with you. Using the proper rental agreement will also aid you in a future lawsuit, by clearly identifying rights and duties of all parties during the tenancy. A properly completed move-in inspection form, signed by the tenant establishes a baseline in which to determine future damage. Proper documentation recording requests for repairs, actual repairs made, defining the cause of the needed repair, and correspondence documenting any alleged breach by the tenant, such as overcrowding, failure to clean or maintain,

or other misuse of the premises. Upon the tenants moving out of the unit, it is important to carefully prepare a moveout checklist detailing any and all damage to the unit. Excessive damage to walls, or carpet covered with pet stains or ground in dirt and oil. Remember that you are required to properly account for the security deposit within twenty-one days of receiving possession, charging the tenant only for damages and cleaning in excess of ordinary wear and tear. Stay away from any “standard cleaning fee”, only pass on proper deductions. If the tenant damaged it, don’t be afraid to charge him for it, conversely, if the tenant left the premises in the same condition as when he got it, then refund the deposit. Make sure that you attach copies of all receipts, including the name, address and phone number of the vendor doing the repairs, to the security deposit disposition statement. One last thing, if you go to court, be prepared, be organized, and be truthful.

Dear Maintenance Men:

I am having a dilemma; one of my downstairs units has a major plumbing problem. According to the plumber, the tub/shower drain beyond the trap is rotted and needs to be replaced. The plumber says the tub must be removed to complete the repairs. I’m afraid to approve the bid due to not only the cost and inconvenience to my resident, but my shower wall tile is in perfect condition. What are some of the steps to make sure this ‘rotted’ pipe is the issue before I give the plumber the OK? Joan

Dear Joan:

Most likely the tub may be compromised as well as the drain pipe. Most tubs have access behind them for pipe repair. You may want to get a second opinion as this is a major job. The shower tile is most times the “ouch” factor in a tub replacement. It is hard to see perfectly good tile go to waste. As a matter of fact, removing a tub is always a big job and we don’t blame you for being hesitant. We recommend doing a rooter service first. If the pipe is rotted or broken, evidence of mud or other debris might stick to the snake. Next, using a camera snake, you might be able to see the break and confirm the plumber’s diagnosis. The snake and camera will give you a good idea of the direction, distance and location of the break. This will come in handy when it comes time to make holes in your concrete. Maintenance — continued from 16 rooter line is clogged with mud, (Black sludge is normal in older lines) 2: The rooter cable cannot break loose the clog. (The cable tip may have found the hole in the pipe and is busy digging a tunnel in the dirt.) 3: The clog returns time and time again. 4: Waste water is found at the interior or exterior of the unit. With regards to your shower wall tile, simply cut the first two tile courses above the tub. You can break the tile along a natural grout line or use a ceramic tile saw to cut through the tile. After the tub is removed and reinstalled. Replace any of the drywall behind the tile with ‘HardieBacker cement board materiel and install the missing tile and grout to match.

I am updating my resident move-in

letter about the proper usage of the appliances in the unit and I have a question about coffee grounds. I have always heard it is bad to put coffee grounds down the garbage disposal unit, but don’t know why? The grounds are finely ground and should pass through the disposal with no problem, so why are coffee grounds bad? Robert

Dear Robert:

The problem with coffee grounds is most people just dump the contents of the coffee machine into the drain and don’t use enough water to wash it away. What happens with the coffee grounds, especially with back-to-back drains, is that the coffee grounds tend to pile up in the pipe as it goes through the wall. Over time it will pack the pipe completely. The garbage disposal does not have trouble with the grounds themselves; it’s what happens after they leave the disposal. Again, if the coffee grounds are fed slowly into the disposal with plenty of water running, the grounds will disperse and not compact in the

drain line. Unfortunately, we find most residents are not really patient enough and just dump the grounds and go.

It will capture how many calls were answered by a person during business hours. The data will also illustrate which days and times of day are the busiest. Many people just hang up and won’t leave a message when they hear a voice message so try to answer every call in person. Terrific Telephone Techniques — The goal is to give and receive as much information as possible in an organized way in very little time in a polite and professional manner that leads to an appointment to visit the community or a lease over the phone. You can create your own leasing script. We don’t want you to sound like a robot, but if you follow along with a script you won’t forget to ask important questions and to give each caller a brief description of the apartment interior and community amenities, invite them to tour and set

Examples: exceptional, unique, charming, cleverly designed, stylish, etc. Avoid using industry words. Replace complex, property, site and unit with community and apartment or home. Proper In-Person Greeting — Stand up to greet each prospect. Look them in the eye, extend your arm to offer a firm handshake, verbally introduce yourself and welcome them to your community. Guest Cards — Whether you use printed or computer guest cards, best practice is to fill out the guest cards for your prospects instead of asking them to do it. You can ask questions and make notes while making conversation. Record their “hot” buttons and note what is really important to them in finding their next home. These notes

will help you later during your presentation, tour and closing. Product Demonstration — We suggest you show your selected vacant apartment(s) before showing your model(s). This helps prospects envision their own furniture being placed in their new home. Use the information from your guest card and point out the features and benefits you already know will interest them. Take this time to build rapport and start closing the sale. Closing Techniques — There are several ways to approach closing the sale. You can set the stage for closing when you first speak to a prospect on the phone or at the beginning of an office visit before you ever leave the office by asking two key questions: 1. What other options are you considering? 2. If you see something you like, are you prepared to lease today? This will start the dialog you need to work your magic. NCAP will be applied to all new and existing public record data used by Experian®, Equifax®, and TransUnion® on July 1, 2017. While Experian® and the other bureaus “anticipate no change to bankruptcy public record data” since bankruptcies are typically filed with the

minimum consumer ID information, like SSN (which passes standard #1), this will affect civil judgment public record and tax lien data. In fact, the preliminary analysis by Experian® projects that about 96% of civil judgement data might not meet the new standards. For tax lien data, they’re expecting “as much as 50% of this data may not meet the enhanced PII requirements.”

As an estimated 96% of civil judgement data and as much as ½ of all tax lien data does not meet the new standards, records that do not comply with PII will be removed. This means, if a property manager or landlord’s rental applicant has a civil judgement record (like an monetary eviction), but that civil judgment data is incomplete in some way (for example, it’s missing the applicant’s SSN or date of birth), then that data will be removed. That eviction record will not impact the rental applicant’s credit score (FICO®, VantageScore®). So if you were depending on your applicant’s credit report to clue you in on evictions or other civil judgments, you will want to get that eviction data from a reputable source. This removal of unstandardized data, as an effect, is expected to slightly boost credit scores across the U.S. VantageScore® suspects in their initial impact analysis that (in worst case scenario) a little over 8% of the scorable U.S. population will have a change in score. FICO®, one of the most widely used scoring models, are expected to release an impact analysis within the next month. In the coming months insure that your tenant screening provider’s eviction and criminal data is up to par with your standards. As credit scores are expected to rise mid-year, keep track of your own score with https://www.annualcreditreport.com/index.action. You might be surprised (in a good way). A

ll too often we fall into traps that seem to make perfect sense, but in reality only hurt us. In many ways, that is why I wrote my book, Cash In on the Myths of Real Estate. After years of investing myself, working with clients as a real estate

broker, and talking with members in my various roles on the AAOC board, I realized that there are many popular beliefs that hold us back from achieving our goals. One of the most prevalent of these is, I think, at the crux of why so many

of us make less than optimal decisions regarding our rental properties. We approach these investment opportunities from a transactional basis rather than looking at the big picture.

Investing is a simple buy, sell, or hold decision.

Popular Belief: Your choice of options regarding a particular investment property are basically limited to buy, sell, or hold — especially when talking with a real estate agent. Bill’s Truth: Real estate agents represent buyers and sellers, so their focus is on those transactional aspects. However, as an investor, your perspective has to take into account not just the transaction itself, but how the action that you take is going to impact our wealth building goals. Ideally, you want to be working with an agent who is willing to go beyond the transactional basics and really delve into all of your options. A full review should take into account not just the choice of buy/ sell or hold, but also look at the ramifications of selling versus exchanging, as well as how a particular investment decision might further diversify your portfolio and/or provide a means to implement a possible gift of exit strategy.A good advisor should understand the specific objectives of the transaction under consideration and then, on your behalf, clearly outline all of your options as well as quantify how each action would impact your long-term financial goals. Cash In: Capitalize on the flexibility of real estate ownership.

Think about and run the numbers on all of your options.

So what are your options? As I stated in an earlier Apartment News Magazine article (June, 2016), it all starts with having a written real estate plan. This

provides the means for seeking out reasonable options and quantifying outcomes so that you can make decisions that help you achieve your goals.

The minute you hear the words, real estate agent/broker, you think that you need to be selling or buying. Most investors aren’t ready to make that


commitment, so they just hold on to what they have without realizing that “holding” is an option. Those investors have just made a decision without quantifying the outcome. Nor have they thought about other options — such as refinancing and pulling out some of the profits to use for additional investments, improvements or other purposes. Or, perhaps, they should consider exchanging into a different type of property ownership that offers an income stream with less hands-on work. The options you review and the conclusions that you reach all depend upon your plan and your objectives. This decision-making process applies whether you are in wealth-building mode or are more concerned about securing your cash flow and taking care of your heirs. However, be aware that these are two entirely different scenarios and as you transition from one to the other, some judicious repositioning may be required. In last month’s article entitled “Owning Forever,” (April 2017 issue of Apartment News Magazine), I touched upon legacy planning. Most people think that all they need is a will and possibly a trust, but those are really just the legalities. There is a lot more involved. As I ran through the process of trying to put together my own legacy plan, I realized that there are so many variables involved that there is no one solution or resource. You really need to sit down and have some one-on-one discussions with yourself, your heirs and with a number of advisors. Once again, my son Tim and I are teaming up to do some writing. Seven Tips for Attracting the Right Customers to Your Community

M

oving season is ready to launch with the warm summer months just around the corner. If you haven’t updated your models and clubhouse — it’s not too late. While the budget may be a concern, there are still several ways that you can minimize costs, maximize impact, and ensure that your apartment models and community spaces attract the residents that you want for your property. First, assess what must be done. Take a walk through your models and community spaces and take a good hard look at them from your customers’ perspective. Maybe they still look good, but have they been looking that same “good” for a year or two? What about your target demographic? Has it changed? Perhaps it used to be the first-time renter right out of college, and you’ve done a renovation this past year, and it is now the 35-year old professional. Every detail should reflect the living experience that prospective residents will enjoy if they rent a unit. A properly done model and clubhouse is a statement about the services and culture of the property, which allows the customer to visualize living there. Do you need to update your model but can’t afford a complete overhaul? You don’t have to change the entire model. Change out key pieces — perhaps the sofa, love seat and artwork. Check out the bedroom and consider the style of the headboard and furnishings and change out the soft goods. Replace the accent color on the bedroom wall, or perhaps add one. Many times, simple, subtle changes have a significant impact! Putting model apartments and clubhouse environments together can be an overwhelming task, but it does not have to be if you remember the basics. Here are some to inspire. 1. Know the dimensions of the room. Also, know the ingress points and the measurements of each. Be sure to include doors, hallway, and stair widths (if they are used to get to the room you are decorating). 2. Set the tone. Want energy in a room? Select the furnishings in different heights and sizes. If you want a more serene, calm environment, make sure the furnishings are the same height and scale. The ratio of the furniture to the size of the room is essential. There is nothing worse than walking into a model with furniture that is too large or too small. 3. Work the form. All spaces have form; whether the shape is oval, round, or square, etc. For instance, divide a long, narrow room into two squares. Use one end of the space for a conversational space with big lounge chairs and television and use the other for a different function such as a dining area.

4. Encourage conversation. Arrange the settings so that the area is a shared space. For example, two chairs facing a sofa, two love seats facing one another, or any arrangement that allows people to enjoy easy conversation. Consider the same thing in the dining area. Inclusive conversation is the reason that dining tables claim the middle of the room. 5. Take advantage of the view. Position the furnishings in front of a beautiful view. 6. Avoid the perimeter. Floating pieces are always best. Of course, we don’t all have the luxury of much space. Even so, you can place a large sofa along the wall and float chairs at angles facing it to create the feeling of more space. 7. Choose neutral colors. Choosing neutral tones for models and club houses extends the relevance of design. Use accent pieces like throw pillows, throws, artwork, and accessories to add trending color and textiles. Keeping these simple tips in mind, your communities can look professionally designed while creating a warm and inviting feel that suits the purpose of each space perfectly — and help attract the perfect occupants.
