f you’ve been following the newspapers or AAOC email updates, you are likely aware that Tenant Activists in Santa Ana have filed a Notice of Intention to Circulate a Petition adopting Rent Control within City limits. And while it is currently in the administrative stages with the City, we’ve been busy behind the scenes. Sure, AAOC has been a longtime friend to the City and has committed significant resources to participate in an

affordable housing workgroup, but the tenant activists want none of it and are gunning for rent control. Not only is this a real threat, but we have a heck of a battle ahead of us.

What’s Next

Historically, our industry has had a tendency to telegraph its punches. That is, we’ve communicated so much to our own that our agenda ends up getting into the hands of our foes. Not this time. What you should know is as follows: the City has yet to certify the initiative (required for organizers to obtain signatures) and once certified, they will have until August 10th to get the signatures of 12,000 registered voters in order to get on the November ballot. If they do not make the November ballot, they will likely make the next ballot: a special election.

enact some of the strictest rent controls in the Country and would roll back rents to November 2017 rates. Increases would be limited to no more than CPI and in the event the Costa Hawkins repeal passes in November, Santa Ana would actually have New York-style Rent Control where a vacant unit can automatically charge the market rate. You would also lose the ability to give notice, go out of business and do other things (without paying exorbitant fees to your residents). Speaking of fees, Santa Ana rental property owners would be expected to pay for and cover the ongoing administrative costs. Perhaps the worst part about it all is that this group would form a Rent Stabilization Board that is autonomous and not under the purview of the City Council or City Management. The tenant activists would get 4 seats on the board, our industry would get just 1.

Call to Action

This is a dogfight and we must be vigorous in defending our rights. We will be circulating additional email correspondence and will depend on your support and contributions to defend our rights and defeat this measure. Rent control doesn’t belong in our country and it doesn’t belong in Orange County. We must fight smart and fight hard to defeat this initiative. Together and with your support, we will have our best shot.

Your Education is More Important Than Ever!

A

AOC has prided itself for many decades educating its membership on various subjects both far and wide. With the rental housing industry continually under assault and owners in the cross hairs more and more from legislation and regulations coming out of Sacramento and locally, AAOC is as busy as ever educating membership. To validate whether our education is indeed relevant and important, I picked up the Apartment News from May 2003 to take a look at how things have changed in 15 years. Perusing this May 2003 edition, I quickly saw the title of The Sacramento Report: “No Shortage of More Bad Ideas in Sacramento”. This Report cited that some in the Capitol had urged Democratic leadership to focus their attention on the state budget crisis, but instead legislators were plowing through virtually every code section in California law to propose statutory changes of one flavor or another. Sound familiar? Personally I think the axiom “the more things

change the more they stay the same” also rings true here. In May 2003 new issues affecting the rental housing industry included: 60 day notices, premove out inspections, cracking down on neglectful landlords, and the ban of smoking tobacco in the indoor and outdoor common areas of multifamily housing. Now as then, current legislators don’t seem motivated to attack the spending problem in the state, but instead wantonly plow through state code to upend the rental housing industry. Instead of those aforementioned and comparatively insignificant issues of yesteryear, today we’re talking issues such as rent control and just-cause evictions, just to mention a couple. Unfortunately, both are hot topics due to the behavior of a few bad actors. We’ve all read the headlines about $500 rent increases or arbitrary evictions which, real or not, galvanize pro tenant groups and journalists so legislators spring into action and reprise “No Shortage of More Bad Ideas in Sacramento”.

Now back to education — AAOC’s education committee has been finetuning its already full programming to be more effective and proactive. It’s vital we continue to educate ourselves on issues pertaining to our industry. This should include Legislative Issues; which is typically the theme for our January and October General Membership Meetings (GMMs). Other classes to consider include: Workplace Harassment, Passing the Torch and Legacy Planning, and Fair Housing. These are all held at the AAOC offices. We believe so much in the importance of education, that as part of “Membership May”, we will be offering “Intro to Fair Housing” a 30-minute webinar at no charge. We are offering this to celebrate the 50-year passage of the Fair Housing Act. This webinar training includes: new Fair Housing Guidelines, multiple handout materials, and a certificate of completion that you can add to LinkedIn and email directly to a Supervisor. Spring Meetings

I

t’s that time again. Springtime. That’s when legislative policy committees have a first look at dozens and dozens of new proposals that affect every California resident. And that’s when it’s time to repeat what has now become an annual ritual: Association leaders meet personally in Sacramento with their legislators on important bills affecting the rental housing industry. At this writing on the cusp of this year’s planned meeting, it is expected that as in years

past AAOC’s leadership team will meet in Sacramento on April 10 and 11 with fellow leaders from other regional associations affiliated with NAA. Major bills of significant interest will be the topics for discussion with legislators and their staffs. Like other industry groups whose leaderships and members meet regularly with their representatives, the group will focus on policy issues only. Each participant is reminded not to stray into forbidden territory where money and politics collide. It is a serious violation of law and common sense to discuss both in a common meeting on or off campus, and money can never be discussed under the dome. The policy issues selected by the group for discussion this year included three bills of significant detriment to the rental housing industry that were culled from a longer list of other bills of concern. The Legislature’s uncommon heightened interest in rental housing

issues this year made the choice more difficult than in years past. The limited time legislators make available for this activity in Sacramento is constrained by many other responsibilities involving committee membership and ongoing hearings on their own bills. Hence, a few minutes with each legislator to hit the high points on a few bills is about all one can expect. Legislators meet regularly with a variety of constituent groups to discuss many diverse issues throughout the year. We commend all of our legislators and their staffs for being gracious with their time and attention to the positions articulated by the group. Why these particular bills? The unlawful detainer process has deteriorated from expeditious recovery of possession to a costly and ugly extortionate slugfest. Reform of some kind is overdue. Smock/Kingston — continued from 8 this year would exacerbate this problem by extending several important time lines in the UD process. For other negative bills, it is a choice of picking in relative terms a few really, really awful bills from among several other bad bills that affect the housing industry. The order of magnitude or severity of interest is subject to debate. Pick your poison. There also is the issue of scope, that is, are rental housing providers targeted alone or just swept up in a larger universe? And, if we are the targets, how pervasive is the circumstance? Also, can our position be explained and easily understood without lengthy commentary? With these characteristics in mind, consider the three primary measures targeted for discussion this year. Assembly Bill 2343 would establish by clear and specific language an unprecedented right not to pay rent for any tenant who joins a tenant association or advocacy organization (not defined) and claims retaliation. Specifically, owners may not evict or increase the rent of a tenant who is part of a tenant association or advocacy group for 180 days following a retaliation claim by that tenant regardless of whether that tenant is current on his or her rent. The bill also requires owners to provide free rent to rent defaulting tenants up to 14

days longer than under current law before eviction actions can commence. Specifically, the three-day notice to pay or quit is increased to ten days. Notice to quit for other violations of the lease contract, including illegal subletting, nuisance, illegal dumping, or any other illegal activity, is increased to five days. Finally, a clerk of the court my not enter a default against a tenant who fails to contest the eviction, until 14 days have passed which is designed to intentionally delay a defaulting tenant who is keenly aware that he or she has not paid rent for months and who is to move thereby freeing up the rental unit for another occupant. AB 2925 would require every termination notice to state a reason for the termination, turning a local issue into a sweeping statewide one-size-fits-all mandate, substantially limiting the right of all rental property owners across the state to terminate leases with the standard 60-day or 30-day notice. Extinguishing a lease will now require all owners to have “just cause” or “good cause” and go through the expensive unlawful detainer (UD) legal process, which entails hiring an attorney, filing the UD with the court, utilizing a process server to serve the tenant, making court appearances, and often using the local sheriff ’s department to evict the tenant. Stating the cause(s) to terminate

a lease under the bill is extremely problematic for tenants, property owners and the courts. The courts will be exposed to thousands of additional civil filing where a tenant disputes any reason stated in the 30-day or 60-day notice. Assembly Bill 2364 upends the Ellis Act agreement by doubling the number of years (from 5 years to 10 years) an owner must keep his or her units off the rental housing market. Specifically, any owner in a rent-controlled jurisdiction, who chooses to bring his or her units back on to the market after going out of business via the Ellis Act, must offer his or her units to the same tenant at the last rent-controlled rate previously offered should the owner go back into business during the 10-year period. As a result, this bill will effectively assure owners will never go back into re-renting the residential dwelling units. With the specter of rent control spreading across the state through the pending initiative or local process, the measure has legs beyond the current communities that have rent controls in place. Other bills that raise considerable concern include: Assembly Bill 2219 would prohibit a landlord or a landlord’s agent from refusing to accept payment from a third party of a tenant’s rent if the third party does not reside on the premises and provides the landlord or agent with


a signed acknowledgment that acceptance of the rent does not establish a landlord-tenant relationship between the landlord and the third party. Assembly Bill 2618 would require the Department of Real Estate to administer a certification program for landlords and property managers, as defined, to provide education to landlords and property managers on fair practices and tenant rights. The bill would make this certification effective for a period of 2 years. The bill would authorize the department to identify and approve appropriate providers of the educational coursework, as specified. The bill would make a person who acts as a landlord or property manager without first having obtained certification from the department subject to a specified civil penalty. SB 1427, which would modify “source of income” housing discrimination language to specify that a federal Department of Housing and Urban Development Veterans Affairs Supportive Housing voucher (VA style Section 8) is a source of income. These are among the most prominent bills of interest that have surfaced in this session and about which much will be written and discussed, including a need for active member involvement in and timely responsiveness to Red Alerts as they are promulgated. have been a property manager for many years. As a matter of practice, when I serve 3-Day notices to pay rent or quit, I always attach a letter outlining the rent owed along with the late charges for a total due and owing. Most tenants understand that since their rent is late that they have incurred late charges. Yet recently, I had a Judge rule for the defendants stating that my notice was inaccurate because of the confusion created by the two different amounts requested between the 3-Day

Notice and the attached letter. Was the judge right and what do I do in the future?

Assuming your three-day notice to pay rent or quit was valid, the attached letter requesting a different amount than that requested on the 3-Day Notice creates an ambiguity that will be decided in favor of the Defendant. For example, if your 3-Day Notice to pay rent or quit demanded rent of $1,200.00 for the month of April and then your attached

letter states that the tenant owes $1,200.00 plus a $50.00 late fee for a total due and owing of $1,250.00, what amount must the tenant tender to cure the default? Thus, the ambiguity will render the notice defective. In the future, you should instead, prepare both a 3-Day Notice to Pay Rent or Quit, for the rent, plus prepare and serve a 3-Day Notice to Perform Covenants or Quit for the late charges. By demanding the rent on one notice along with a demand for late

charges on the other, the tenant is obligated to comply with both. When I serve 30-Day or 60-Day Notices to Vacate, I normally wait until the tenant pays their rent for the month before serving them to ensure that the owners will not be out that month’s rent. Well, I recently was told that after serving a 30-Day Notice that I could serve a 3-Day Notice for rent if the tenants do not pay. Is this true?

Yes. Despite the existence of the Termination Notice, a tenant is still responsible for the rent during the notice period. Thus, if you serve a 30-Day Termination Notice to Vacate on July 1, the tenant is still responsible for the rent through July 31. If the tenant does not tender their rent for the month of July, you may serve a 3-Day Notice to Pay Rent or Quit requesting rent for July. However, be careful when you are calculating the dates that rent is due. If you served a 30-Day Notice on June 20 to expire July 20, then the tenant does not owe rent for the whole month of July but rather a prorated portion for 20 days of July’s rent. If the tenant were to pay July’s rent in full and you accept, your 30-Day Notice would be waived. I aggressively manage my properties. I find that by requiring all the tenants pay rent on the first of the month and not giving them a grace period, I have far fewer evictions and vacancies. Thus, if a tenant does not pay their rent by the first of each month, I serve them a 3-Day Notice to Pay rent or Quit on the second of the month. Most of the tenants are responsive and those that are not are evicted quickly with minimal loss in rents. However, last month, after serving a 3-Day Notice to Pay Rent or Quit and the tenant failed to comply, I contacted an attorney to initiate the eviction process. He informed me that I was premature in serving the notice as the first of the month fell on a weekend and the tenant had through Monday to pay me the rent. Is he right?

Yes. A 3-Day Notice to Pay Rent or Quit is only effective if it is served after the rent demanded becomes due. However, if the rental due date should fall on a weekend or holiday, the tenant has through the next business day to tender the rent in compliance with the rental agreement. For example, if the rent is due on the first of the month, it is normally deemed late on the second of the month if not received. However, if the first should fall on a weekend or holiday, the tenant has through the next business

day to tender the rent, or Monday for purposes of our example. Your 3-Day Notice would be premature if the first fell on a weekend and you served the notice on Monday. Yet had you waited until Tuesday to serve the notice, your notice would be valid. I guess I am becoming hard in my old age because I am finding that it does not pay to Q&A — continued on page 14

Q&A — continued from 13 work with tenants when it comes to paying rent. I used to accept money from tenants even after I served them with a notice for non-payment of rent. I thought that it was helping me because I would not be out so much money every month. As it turns out, it was a lot more work and very little difference in income. So now I do not accept any money after the expiration of a notice. Am I okay by not accepting rent?

Yes. After expiration of the notice period, there is no obligation by the landlord to accept any sums, either a partial payment or payment plus additional charges. If the landlord chooses to accept partial funds they must serve a new notice for any unpaid balance in order to proceed forward and file an unlawful detainer. Of course, if the landlord accepts payment in full at any point, then the notice and remedies of forfeiture thereunder are waived.

When serving notices, our policy is to “post-and-mail” whenever possible to avoid confrontation. Now, my attorney is telling me that the law requires that I try personal service first before posting and mailing. Is she correct?

Yes. Under California Code of Civil Procedure section 1162, a 3-Day Notice may be served by the following methods: (1) A copy of the notice may be delivered to the tenant personally; (2) If the tenant is absent from his or her place of residence and usual place of business, a copy may be left with a person of suitable age and discretion at either place, and a copy mailed to the tenant at his or her place of residence; or (3) If the places of residence and business cannot be ascertained, or a person of suitable age or discretion cannot be found, a copy of the notice may be affixed in a conspicuous place on the property, a copy delivered to a resident (if one can be found), and a copy mailed to the tenant at the location of the property.

Note that method (2) may be used only if method (1) was tried but failed to reach the tenant. Method (3) may be used only if methods (1) and (2) were tried but failed. Thus, “post-and-mail” should not be your standard policy for service of a 3-Day Notice when personal and substitute and mail service were not attempted. Removing a large piece of glass or mirror can be spooky. Safety first, be sure you are wearing eye protection, gloves and a sleeve long sleeve shirt or jacket. Next, use duct tape diagonally in both directions on the face of the mirror. This will help keep the mirror whole if it cracks or breaks. If the mirror is glued to the wall; cover the glass with a blanket or tarp and tape it to the top edge of the mirror. Be sure to cover the entire mirror top to bottom. You are now ready to remove the mirror and should it shatter, the blanket will contain the shards, protecting you and making the clean-up much easier.

Help Protect Your Finances in a Natural Disaster

rom blazing wildfires and floods to hurricanes and tornadoes, natural disasters make frontpage news whenever and wherever they happen. Less headline-worthy are the financial repercussions that follow, which tens of thousands of people are dealing with right now. These types of tragedies are unavoidable — the most you can do is prepare to minimize the time it takes to put the pieces of your life back together. Creating a plan that addresses your finances and insurance beforehand can make it easier to recover from a devastating event. 1. Stockpile savings. Maintaining an emergency fund with three to six

months’ worth of savings is a key part of any household budget. But it’s also important in an emergency: Funds that you can draw on quickly and easily can be a lifesaver in the wake of a natural disaster. Also consider keeping a few hundred dollars in cash on hand to see you through if your area loses power or banks and ATMs are out of commission. 2. Gather key documents. Make sure you have important legal and financial documents with you if you have to evacuate. These may include copies of insurance policies and even bank account numbers. Keep these documents easily acces-

sible, as you would flashlights and spare batteries. That way you’re less likely to leave them behind — even if you have to abandon your house quickly. 3. Protect your credit. Part of protecting your finances involves protecting your credit. Include the contact information for your creditors — such as your mortgage lender, credit card companies and utilities — in your financial preparedness kit. If you have to evacuate, reach out to your creditors as soon as possible to request a temporary reprieve from payments. Make sure you reach out to your employer as well, to provide as much warning as possible if you won’t be able to work in the aftermath of a disaster. 4. Review your insurance. Your insurance policies can help you recover financially from a disaster, provided you have the right coverage. Review your property, flood, life and disability insurance policies once a year when you receive the new documents from your insurer. And don’t focus only on your deductibles and coverage amounts — pay attention to the riders as well.


For instance, does your property insurance cover temporary food and housing costs if you’ve had to evacuate but your home is undamaged? If you miss work for a week because you’ve had to evacuate, will your disability policy cover your lost income? Talk to your agent about covering any gaps in your policies, and make sure you know whom to contact and what documentation you’ll need to file a claim.

warnings or reminders to tenants who have received notices from their landlords and are at risk of eviction. If it is proven that a tenant violated their lease, the tenant may be terminated from the Section 8 program. Because of long waiting lists and limited funding for the program, it is virtually impossible for a tenant to get back on the Section 8 program once they have been terminated. Therefore, Section 8 tenants have a lot more to lose in an eviction and are motivated to be good tenants.

Safeguard Against Lost Rent during Eviction

Unfortunately, not every tenant (Section 8 or otherwise) will live up to their lease agreement and you will be forced to evict. If this occurs with a Section 8 tenant, the housing authority will continue to pay the housing authority’s share of the rent throughout the eviction process until the date the tenant moves out or is locked out.

In today’s hot rental market where rents are increasing faster than incomes, tenants are adding wage earners to their household in order to afford the rent. Throughout southern California, families are doubled or tripled up in two and three bedroom units. Overcrowding is bad for a landlord’s bottom line as it increases utility costs, places additional wear and tear on the unit, causes parking problems, and leads to conflicts between neighbors. By renting to a Section 8 tenant, you will not be faced with overcrowding. The housing authority restricts the number of individuals allowed in the unit according to the number of bedrooms in the unit, and by basing a Section 8 tenant’s rent portion on their income, the tenant does not need to add additional people to the unit in order to afford the rent.

Other Incentives

If you are not yet convinced that the Section 8 program can improve your

bottom line, a number of southern California housing authorities offer a range of extra services to Section 8 landlords, such as signing bonuses, free educational workshops, payment of damages exceeding the security deposit, payment of rent to hold vacant units, and payment of tenant security deposits. How to Reach Occupancy Goals as a Team

with others in the area? If not, why not and what can you change? If they have two bedrooms, two bath floor plans and yours are only two bedroom, one bath, there is nothing you can do. However, if they have a concierge and you don’t, perhaps you could ask your leasing team to offer a few extra “services” in the office such as making reservations for residents. If they have a community garden and you don’t, consider finding a place within your community to create one for your residents or teach them how to do container gardening. Each one of your team members should go visit your competition and come back with ideas.

Before establishing team goals, quickly determine what is not working and eliminate those programs and their associated costs. Stop and think about what factors are limiting your success in filling your building. There usually is no single thing that is holding you back, so it is essential to talk to every one of your team members to get their perspective and feedback. For example: • Does your community compete well

• Does your community appeal to everyone? Why or why not? Drill down on any cancellations and reasons for move-outs and keep a list of why the applicant cancelled and where the move-out rented. Review these with all team members. If someone wanted a bigger apartment and you did not have any; that is a reason for move out beyond your control. If the reason was bad customer service or waiting too long

for maintenance to fix something, then you have issues to discuss with the team. Look at the building itself. Is it clean? Do you need to dress it up a little or even a lot? • Does your community have social or communication problems? What are they? An example of a communication problem might be that a resident complaint or work order did not reach the manager or maintenance supervisor in a timely manner in order to respond to the resident or complete the maintenance request per policy. If this happens, you must look at who is taking messages and how they are relayed. Review processes and operations. Modify, eliminate or replace the ones that are not working. • What are you doing to encourage a better brand image? Review your marketing efforts. It might be time to create a new brochure and update your community website. Send your leasing staff members off site to do outreach marketing. Are you utilizing all of your free or low cost resources?

Outline Specific Goals for Each Person

It’s up to you to determine what factors will ultimately lead to improvements within your location that will lead to better economic occupancy. Once you know what each member of your team needs to do to help you earn that goal, create objectives for those people. Keep in mind, though, that you need to create fair goals for everyone. This includes for your property managers, leasing professionals, and maintenance staff. 1. Outline specific goals for each person or team. Ensure that these goals are fitting for each person.

3. Every step or objective needs to be specific, outlined, and understood by the person who will be doing it. 4. You need to have a measurable way of tracking success. Whether you want your leasing manager to make 5 cold calls a day or you want your property manager to meet with area planning commissions, you need to ensure the goals are measurable so you can track success. 5. Work closely with them, not just to encourage and show support, but also to understand their needs and to learn what they are finding out throughout the process. Most importantly, you want to be their motivator since their achievement is going to help your business.

Property Considerations in Preparing Your Legacy

A

t the heart of your legacy are the properties that you own and the knowledge you pass down to your heirs. In all likelihood, your properties are what provided you with both the wealth that you now enjoy and the means to ensure a better life for your heirs. In previous Apartment News Magazine articles, I addressed the difference between estate planning and crafting a legacy. Then, I focused on the importance of looking at Your Goals & Wishes — not just from your own perspective, but from that of your heirs, as well. A legacy is something that you bequeath to others to be carried forward either in your memory or as a future that you envisioned. For that to happen successfully, you have to put all of the pieces into place and make sure that everyone is willing and able to fulfill your wishes. Which raises a very important question — are your properties going to be a part of your legacy? If the answer is yes, then some extra thought and planning is needed.

When your properties serve as the bedrock to your legacy, you need to make certain that that foundation is secure. Have you taken the steps necessary to ensure that a change in economic or other policies — regionally, nationally or globally — will not destroy all that you have worked so hard to create? Just as when you were working on Your Goals & Wishes, consulting with a knowledgeable and trusted advisor can provide an all-important added perspective. Among the question to address in terms of safeguarding your legacy should be:

• Are the properties within your portfolio still serving the purpose intended, both individually and as a whole? If not, why not?

Can your property operate without you? Are there any maintenance or other deferred liabilities?

• Do you need some diversification, either in terms of location, levels of participation and/or types of properties in which you are invested? • How balanced is your overall portfolio? In regards to your real estate portfolio: • Do you have a written real estate plan and have you discussed that plan with your heirs?

• Is it time to make some type of change either to better secure your legacy or better align your position with the needs and abilities of your heirs?

On a property-specific level, you need to consider: • Can your property operate without you? • What is the status of your cash reserves? Are they sufficient? • Are there any deferred maintenance issues that should be addressed? • Is the documentation for the property and residents organized, current and complete? • Is there an easily accessible list of trusted advisors and vendors? • What steps have you taken to mitigate any potential legal liabilities? • Do you have the right insurance coverage and is that coverage in sufficient amounts?

Other Inheritance Issues Regarding Real Property

When you are planning to bequeath real property to your heirs, there also are a number of special considerations: • Do you foresee any potential issues if your heirs have to share ownership? • If there are mortgages or liens on the property, can they be assumed without penalty, acceleration of any clause or interest rate changes? And, what are the due dates? • When leaving a particular property to multiple heirs, what happens if


one person wants to sell and the others want to continue holding onto the property? • If a property requires a lot of handson work or oversight, do provisions need to be made to ensure that this burden doesn’t create future problems that might derail your original wishes and intent? • Will your heirs be able to pay all of the taxes necessary for keeping the property and will such a payment be equitable for all involved? • If you share in the ownership of a property, are there potential conflicts between your estate plan and how the other property owners plan to use or distribute their interest in the property? A successful legacy takes work, planning and communication. Not addressing these types of questions could easily put Your Wishes & Goals in jeopardy. Schedule an appointment with a trusted advisor. Go through the questions and obtain his or her insights. You may also want to discuss ways to get your heirs either more involved or better informed as to the wealth-building benefits of owning income-producing real estate.
