I

f this sounds familiar, it is because it is the slogan of the bravest and most powerful fighting force on the face of the earth, The United States Marines! Make no mistake, today, we are fighting for our families, businesses, customers, industry, and livelihoods. Marines are taught to overcome any obstacle, physical or mental, in order to survive the ever-changing landscape of battle. This serves them well in the chaos of combat and will serve us well in this trying time. Currently, we have all been pried from our comfort zones and thrust into a climate of unpredictability and uncertainty, not knowing exactly how to navigate these uncharted waters or exactly where we will land. Thank goodness there is strength in numbers! Being an active member of our great association (AAOC) brings me comfort and hope for our combined prospects. If ever there was a time to be unified and support one another, this is it.

AAOC is calling upon all its members, including the Product & Service Council, to look within our association before outsourcing any services, to keep our loyal and dedicated service providers afloat during this difficult time. Many of our service providers have supported our association and members through their generous contributions to our education programs, seminars, special events, and general membership meetings to name a few. Plus, they have stepped up as sponsors, advertisers, and even volunteers. Their contributions have strengthened our association and allowed for its continued growth, provision of trusted service, sustained financial stability, effective engagement on the political front, and more. We are all suffering to some extent, but I ask that we share the pain, the wealth, and the glory to come. The Apartment Association of Orange County was built for its members by its members, and we will be sustained by the same cohesive approach.

Improvising

Early in the onset of this pandemic, the AAOC Board of Directors was faced with difficult decisions on how to proceed with scheduled events and association operations in the event of a quarantine or some other response that would have the effect of a shutdown. Information, guidance, public policies, and industry news was changing on a daily — if not hourly — basis, which

required us to continually update our communications and our response plan. The AAOC executive director and the staff were tasked with coordinating necessary event cancellations, postponements and rescheduling, negotiating with venues, preparing to work remotely, and a slew of other important activities to help mitigate the effects of social distancing measures. We used nearly every tool at our disposal, short of smoke signals, to communicate and disseminate information amongst ourselves and to our members.

Adapting

The AAOC staff moved quickly to mobilize its operations and its remote communication systems. The recent investments that were made in the association’s phone system, its network infrastructure, and other system and software upgrades paid off quickly, as it made it possible for the office to close and the staff to work remotely, delivering seamless service to our members and the entire association. Small investments were also made in video equipment and video conferencing technology that allowed AAOC to quickly begin conducting audio and video conferencing, meetings, webinars, classes, and more. We are now able to collaborate on multiple platforms using an array of tools, mobile devices, laptops, desktops, tablets and even the good old telephone. President’s Message — continued on page 11

Bridging the Physical Distancing Gap

W

ho would have thought that just six weeks of physical distancing would have had such a significant impact on the way that so many of us do business? For those of us who are presently working from home, perhaps the dining room table or your favorite chair in the family room has been transformed into your de facto home office. Maybe your cell phone has found itself relegated to your nightstand or coffee table, as videoconferencing on Zoom or GoToMeeting has become your new primary and preferred means of communication. If you are still working onsite at a rental property, you may have transitioned from providing guided tours to offering self-guided or virtual online tours to prospective residents. Maybe your maintenance and repair duties have been limited to only critical jobs that involve health, safety and habitability issues, with all elective projects being shelved, while protective masks, gloves, and other gear have become the norm and part of your everyday uniform. For AAOC, perhaps the greatest impact on how we do business, aside from the temporary closure of our physical office and our staff working from home, has been the change in how we present member education programs, informational meetings, and other events. After our initial postponement six weeks ago of events for March, April and May, we began assessing our options for rescheduling and even repackaging certain programs as webinars or live

steamed events. We found ourselves in unchartered territory as AAOC had never presented online programming before, but we were committed to restoring this very important member service as soon as possible. And with the support of the board of directors and some valuable technical guidance from one of our newest PSC members, Arize, this is exactly what we have done. In April, AAOC kicked off its 11-week Certified Rental Housing Provider (CRHP) Education Program with course instruction having transitioned from a classroom setting to a weekly webinar every Wednesday morning. I am pleased to report the transition has gone smoothly and the students have reached the half-way point in their training. The association also presented its General Membership Meeting on April 21 as a webinar and members have been enthusiastic and supportive about the meeting being held online. Coming up this month, AAOC will present at least five additional webinars for its members. Our next Welcome Home OC education and engagement meeting as well as a Utility Management webinar presented by Livable will be presented on Thursday, May 14. The following week, our rescheduled Workplace Harassment webinar will be presented on Monday, May 18, in addition to a Managing Your Small Business webinar and our General Membership Meeting on Tuesday, May 19. Finally, AAOC will present its Passing the

Torch seminar on Wednesday, May 27. While our hope is to be able to present this as an in-person event, AAOC and the panelists are ready to present it as an online webinar if local and state directives still prohibit gatherings of 10 or more people. The COVID-19 health crisis not only required AAOC to take immediate steps to restore its education programming as quickly as possible, but it also provided the impetus for the association to begin looking more concretely at its delivery of programming moving forward. To facilitate this process, AAOC President Frank Alvarez last month established a Technology Task Force, under the leadership of board member Laurel Dial, that will evaluate AAOC’s existing technology resources, identify investments that are needed to support expanded online delivery of programming, and make recommendations that can be implemented over time. I look forward to working with the task force in the months ahead and moving AAOC in a more innovative, technology-focused direction, that will position it to provide even greater value to its members through expanded educational opportunities — both online and in person. AB 828: A Deadly Threat to California’s Rental Housing Industry

B

y now, every Californian is familiar with COVID-19. But, are they familiar with the response by the California Legislature? A few of the responses by members of the Legislature should catch your attention. If fact, you may experience a bit of indigestion immediately after reading about a few of the bills presented herein. Let’s start with AB 828 (Ting) which proposes to amend existing law, providing that a state court, county sheriff, or party to an unlawful detainer case in California shall not accept for filing, or take any further action including but not limited to executing a writ of possession, any unlawful detainer action except those relating to breach of covenant not related to payment default or relating to nuisance or waste, during the current state of emergency and up to fifteen (15) days following. The amendments additionally provide that any unlawful detainer matter that is not in one of the excepted categories, and has already been set for trial hearing, settlement conference or in person appearance, is hereby continued until further notice.

Why oppose the bill? AB 828 eliminates all means for a property owner to recover economic loss or the operational costs associated with running rental properties, by foreclosing their ability to litigate unlawful detainers and in so doing will lose substantial rental income due to nonpayment of rent. This has adverse consequences for thousands of Californians — not just owners. AB 828 leaves no means for a rental property owner to recover operational costs or any losses related to the operation and management of the rental property. This proposal inequitably shifts the burdens of the ongoing economic crisis, created by the COVID-19 pandemic, to the property owner with no consideration of their ability, or lack thereof, to shoulder such burdens or sustain ongoing operations. By not providing for a procedure that reviews rental matters between landlords and tenants on a case-by-case basis, but instead impeding the channels of litigation by prohibiting the bulk of unlawful detainer actions, AB 828 stifles efficient business dealings. AB 828 not only erects a wall or barrier to commerce by restricting the traditional negotiating and bargaining process between landlords and tenants, but it also hinders property owners in the ability to effectively operate, while in the midst of a crisis, by cutting off essential resources and limiting the path to recourse. In the limited circumstances where a hearing may be convened, only in

situations where the defendant stipulates to the entry of a pursuant order, the property owner is left bearing the entire burden of establishing a material economic hardship, merely to recover a sum that the tenant has legally incurred and has previously obliged to tender. AB 828 unjustly deflects a duty that should be borne by the tenant, that of establishing a material economic hardship that justifies breach of obligation and shifts that duty to the owner. The language of AB 828 states verbatim “the court shall bear in mind the Legislature’s intent that the common economic hardships resulting from the Covid-19 virus is not the fault of any one person or group of people and so must ordinarily be borne by both landlords and tenants.” However, by requiring that landlords have to establish a “material economic hardship” in order to recover the amounts they are legally owed and that are essential to the ongoing ability to operate, the burden of this crisis is being placed unfairly, inequitably, and one-sidedly on property owners with no attempt to establish a middle ground that would be equitable to both parties. The burden of proof required by either or both parties should be equally burdensome; it is inequitable for one party to enjoy the benefits of a “presumption,” while the other is tasked with providing proof to meet an arbitrary, unqualified standard. AB 828 establishes “material economic hardship” in order to determine an owner’s/landlord’s entitlements.


However, such a standard is quite arbitrary, undefined, and vague leaving no direction for one to assess what constitutes a “material economic hardship.” As such, the standard for what constitutes such a hardship is left to the discretion of the trier of law on a caseby-case basis. Leaving no objective criteria to aid in determination, or to put an owner/landlord on notice of the criteria required. The result is a landscape of uncertainty, where an owner would never know prior to actually attending a hearing if his/her current circumstances would qualify them for a position of “material economic hardship.” Making it virtually impossible to plan and budget economic resources. To require an owner to operate in such a climate under such circumstances is unfair and creates an obstacle to efficient operations. And if that was not enough…this should catch your attention: AB 828’s provision to reduce rent by twenty-five percent (25%) for a twelve (12) month period, would effectively bankrupt the rental housing industry, leaving owners without recourse. Our members and affiliates provide service to renters in residential communities. Such service is interdependent on the work provided by a host of others including maintenance personnel, plumbers, electricians, technicians, roofers, painters, and many others that contribute to the efficient and necessary management of a residential property. Most, if not all, of the economic obligations associated with running and maintaining a rental property are met through the timely collection of rental income. Any strain on the ability to secure such resources directly results in an inability to meet such operational obligations. As such a rental reduction, such as that proposed in AB 828 calling for an arbitrary 25% reduction in rent, for a twelve (12) month period would effectively cripple owners and decimate the rental housing industry.

Should it be enacted, such an order would trigger not only the foreclosure of many rental housing properties, but possible suspension of day-to-day operations throughout the industry. The reality that many owners face is an environment with rising cost and a significant diminution in revenue. Most owners enjoy restricted and limited access to revenue as a result of recent legislation, aimed at the rental housing industry. Consequently, as they strive to make economic and operational adjustments that would enable them to weather the financial turbulence, uncertainty and circumstance provide increased and greater burdens. AB 828 arbitrarily establishes a twenty-five percent (25%) reduction in the rent amount owed citing no rational or reasonable basis for determining that a twenty-five percent (25%) reduction would be appropriate and required in all cases. AB 828 cites no evidentiary support in determining that a twenty-five percent (25%) reduction in rent is warranted or required in every case in which a tenant claims he or she is adversely affected by Covid-19. Clearly, tenants are not all the same and will have varied circumstances that will require a variety of solutions that must be tailored to each specific need. An arbitrary amount or percentage, determined in a vacuum, and not contemplated by an assessment of the facts or circumstances germane to the appeal, would be an inefficient and erroneous approach that may potentially exacerbate the issues. Additionally, just as arbitrary as the percentage of rent reduction is the amount of time AB 828 proposes that the reduction be in force, a twelve (12) month period. As with the amount, there is no direction for determining when and in what circumstances a twelve (12) month period should be applicable. Because the threshold for qualification in order to be granted such a reduction, is so low and in many cases will be presumptively granted for almost every tenant, the need to justify May 2020

the values and time periods proposed is of great importance. And another bill, this one authored by Senator Nancy Skinner: SB 1079 authorizes acquisition of residential properties by eminent domain if the property has been vacant for at least ninety (90) days and is owned by a corporation. The California Constitution permits private property to be taken or damaged for public use only when just compensation is paid. SB 1079, as currently drafted, would establish eminent domain and “right of first refusal” procedures that run afoul to both current state and federal law. Our arguments are solid. SB 1079 acts to unconstitutionally deprive a residential property owner of “just compensation” by a replacement of the current “just compensation” standard with a mandate ordering property owners to accept the “lowest assessment” of the property value obtained by a local agency: SB 1079 provides no standard with which to evaluate the merits of the provider of the “lowest assessment.” As such, the language in SB 1079 as it relates to “the lowest assessment obtained for the property by the local agency,” is vague and ambiguous: SB 1079, as written, makes no provision or exception for special or unforeseen circumstances such as a property that is in the process of remodel, repair, or restoration; a property that is in the process of applying for licensing and acquiring permits; a property that is extremely damaged due to acts of God or other uncontrollable circumstances. The Importance of AAOC Legislative Advocacy During the COVID-19 Emergency

O

ne of the many benefits of belonging to the Apartment Association of Orange County (AAOC) is our constant attention to state and local issues that affect the rental-housing industry. AAOC is looking out for its members interests on a daily basis, particularly as we respond collectively to the COVID-19 emergency. The AAOC office may physically be closed at this time, but we are working remotely and very much open for business. Our attention to the public policy goings on in Sacramento and here in Orange County and our level of engagement is as focused and active as ever. In these extraordinary and challenging times, we have had to alter course a few times over the past month to make sure your interests stay in front of both our elected and non-elected officials. In many cases during this emergency, we have found that nonelected officials can impact our indus-

try as much, if not sometimes more, than those whom we vote into office. In Santa Ana, for example, it was the non-elected city manager who exercised power in early April, as the city’s director of emergency services, to freeze rents via executive order, not by a vote of the city council. AAOC had its legal counsel review the action and assess whether it was within the city manager’s authority. Subsequent to legal counsel’s review, AAOC and a coalition comprised of local housing industry allies, business community organizations, and taxpayer-protection advocates submitted a letter to the mayor and city council requesting immediate revisions to the city’s manager’s executive order that affects rental housing providers. AAOC has also been monitoring local COVID-19 eviction moratorium proposals and engaging with city elected officials and non-elected staff to ensure its members would not be unreasonably affected. Thankfully, the moratoriums that have been adopted by a handful of Orange County cities have not gone beyond the provisions contained in the statewide moratorium enacted via Governor Gavin Newsom’s executive order on March 27. Meanwhile, at the county level, AAOC engaged Orange County Treasurer-Tax Collector Shari Friedenrich in early April and urged her to waive late charges, fees and other penalties for rental property owners who, due to COVID-19 impacts, could

not pay their property tax by the April 10 deadline. More than 100 AAOC members responded to our Red Alert and sent emails to the Treasurer-Tax Collector’s office urging her favorable consideration. The pressure applied by AAOC and its members resulted in the Treasurer-Tax Collector modifying her previous position and agreeing to consider waiver requests on a case-by-case basis. At the state level, AAOC has been working with Orange County’s state legislators to ensure that they keep the interests of the rental-housing industry in mind as legislative bills are deliberated while the COVID-19 situation plays out in the background. A number of problematic bills had already been introduced prior to COVID-19. Now, that situation has exacerbated the extreme and radical positions that many progressive lawmakers hold regarding the rental-housing industry. Our hope and intention is that our Orange County state legislative delegation fights with us and for us on a bipartisan basis. Also, due to the COVID-19 emergency, our annual Legislative Advocacy Day in Sacramento had to be cancelled last month. However, we are working with our lobbyist, Ron Kingston, and our statewide California Rental Housing Association (CalRHA) to defend against some of the harmful legislation coming out of Sacramento, including AB 828 by Assemblymember Phil Ting of San Francisco. Among the


provisions in this COVID-19 related bill is allowing for judges to impose 25% rent reduction for residents, as well as interpret and establish what an economic hardship is for both a tenant and a landlord. Plus, it creates a past-due rant payment plan scenario where tenants pay an amount not to exceed 10% of the balance due each month until the past due rent is paid in full. This is another instance where AAOC’s relationships with the members of the Orange County state legislative delegation will be very helpful as we fight this bad legislation. This is the year that direct advocacy will be critical to the survival of our rental-housing industry. AAOC will continue to fight on the front lines, while asking its members to also engage and make their voices heard on a wide range of public policy issues. Questions & Answers I own a 40-unit building in a high crime neighborhood. I have done extensive work on the building to reduce the risk of crime to my tenants. We installed fencing with locked gates, increased the common area lighting and cut back on the shrubbery and vegetation that blocked views in the interior walkways. Last week we started implementing a neighborhood watch program. I was thinking of attracting new residents by advertising my building as a “security” building. Any problem with this?

Yes. The improvements that you have made to your building are commendable. Actions like yours and other responsible housing providers will do wonders in the battle against gang related activity and other criminal conduct. You must be cautious in how you represent your building and the surrounding community to new or existing tenants, however. California courts are quick to saddle housing providers with liability for rep-

resenting to their current or prospective residents that their complex is “secure” or “crime free.” Courts have held that by advertising or informing residents that they live in a “security” building that the housing provider is held to a higher standard of care in that he is essentially warranting that the tenant will not suffer the effects of crime. It is important that in all your rental advertising, brochures and rental agreement that the housing provider does not create an implied warranty of security. A prospective resident recently applied for one of my rentals. He seems nice and all, but when he filled out the application, he left a blank where his social security number should go; he said he didn’t have one. He had a California driver’s license, and something called a Matricular Consular card. He seemed a bit combative when we discussed this issue, said that his attorney said I had to rent to him, that I couldn’t discriminate against him, as long as he

could afford the rent. Must I rent to him? How do I verify any of his information?

Proper tenant screening results from the proper use of a variety of tools. Credit reports and eviction reports are two of the best tools available to predict the ability of the prospective tenant to perform his obligations. Qualification of a resident goes far beyond ensuring that “he makes enough money” to pay the rent. Verification of past rental history, tenant stability, and verification of his ability to honor his credit obligations, as well as determining the likelihood of his continued employment are all fair game in evaluating a prospect. Like it or not, our country’s system of storing information on each of its citizens, uses a person’s social security number as the primary identifier. A Matricular Consular card is merely an identification card issued by a foreign country and is not valid for identification in the United States. In order to


work in the United States legally, one must have a social security or a taxpayer identification number. It is illegal for an employer to hire an individual without a valid social security or a taxpayer identification number. Identity theft is rampant in California, and it is incumbent upon all credit providers, including housing providers, to ensure that the person that fills out the credit application truly is who he says he is. Many tenant’s rights advocates, and that is exactly what they are, advocates, advancing the rights of tenants at the expense of housing providers, insist that it is discriminatory to require a social security number when evaluating a prospect. You, as a housing provider, have a legitimate business purpose in determining the credit worthiness of a proposed resident, and not only to predict his ability to timely meet his rental obligations, but you must determine his ability to continue to meet those in the future. Further, in the event you had to pursue this individual in the future due to a breach of the agreement, you must assess the risk in searching for and locating this individual should you need to collect a past due amount. A consistently enforced policy of requiring a social security or a taxpayer identification number in order to screen your prospective residents does not violate Fair Housing laws and does not constitute illegal discrimination. My tenants and I seem to be able to work out our differences quite easily, but there are times when we disagree as to just who is responsible for making certain repairs to the apartment. Can you give me some guidelines that will help me decide if the repairs are my responsibility or the responsibility of the tenant?

Residential rental units must be “habitable.” In legal terms, “habitable” means the rental unit is fit for persons to live

in and that it substantially complies with state and local building and health codes that materially affect a tenant’s health and safety. The law makes both housing providers and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental

agreement can determine who takes care of the minor repairs. California law lists several items that are required to maintain a habitable unit, these are effective water proofing and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facilities, heating, and electrical in good Legal Q&A — continued on page 14

Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, and smoke detectors. A housing provider is also responsible for the installation and maintenance of the inside wiring for

one telephone jack. Tenants must take reasonable care of the rental unit and the common areas. Tenants are responsible for repair of all damage resulting from their neglect, abuse, or acts by their family, guests or pets. Tenants must do all of the following: keep the premises “clean and sanitary;” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly; not destroy, damage or deface the property;

not remove any part of the structure, dwelling, facilities or equipment; must use the premises as a place to live, and use the rooms for their intended purpose; and notify the housing provider when dead bolts and window locks don’t operate properly. What types of repairs can I require the tenant to take responsibility for?

A housing provider and tenant can agree, in writing by the rental agreement, to allocate responsibility for minor repairs between them. Often housing providers and tenants may agree that certain items, amenities, will be the tenant’s responsibility to maintain. These may include refrigerators, washing machines, pools or spas, air conditioning, and minor plumbing issues.

I am a very conscientious housing provider. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. Your policy of doing annual inspections is admirable and is practiced by responsible housing providers throughout California. Most tenants welcome a responsible housing provider’s actions in ensuring that all is well, and voluntarily cooperate in providing access upon the housing provider’s reasonable request. It is clearly in the best interest of all to ensure that any maintenance issues are promptly addressed, and that a spirit of communication and co-operation exists between a housing provider and his residents.


The trouble is your resident is right. There is no specific provision in California law requiring a resident to allow the housing provider access to merely “inspect” the premises. California law states that a housing provider can enter a rental unit only for certain reasons. Those reasons are in an emergency, when the tenant has moved out or abandoned the premises, to make necessary or agreed repairs, decorations, alterations or other improvements, to show the unit to prospective purchasers, tenants or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a pre-move out inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a housing provider to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. This article is presented in a general nature to address typical landlord tenant legal issues. Dear Maintenance Men:

I have a multi-unit apartment building with a 100-gallon water heater that serves all the residents. The problem is that only the nearest units to the water heater get any hot water. The units at the other end of the building only get cold water or it takes a long time to get hot water. The heater seems to be working and producing hot water. How do I solve this dilemma? David

Dear David:

Sounds like your circulation pump is not working properly. Calcium or hard water deposits in the water heater and lines may also aggravate this problem. The job of the circulation pump is to bring hot water to all the units at the same time. When the pump is not working or is clogged, the hot water will take much longer to get to the units furthest away from the water heater. The first step is to determine if the pump is working. Locate the pump near the water heater, check that the motor is plugged into an electrical outlet. Next, touch the water lines on either side of the pump and determine the temperature. If it is working properly, the lines should be warm or cool to the touch, not hot. If the pipes are hot or very hot to the touch, the pump is not working properly. If the pump does not spin when plugged in, it may need to be replaced. If the pump motor is working, the pump may be clogged with debris. Remove the pump and clear out

the lines. Take care to clean the line from the pump to the water heater. This is generally the problem. While you have things apart, this is a good time to clean out the calcium deposits in the water heater. These deposits may have caused the clog in the first place. Water heater clean outs should be done at least once a year depending on how hard your incoming water is. Check with your city water department or local water district to determine the hardness of the water in your area. If the calcium buildup continues to be a problem, consider adding a water softener to your system.

Dear Maintenance Men:

One of my residents is requesting a grab bar for the shower/tub. What do I need to get and how do I install it safely? Bob

Dear Bob,

This is a subject that is surfacing more and more as our residents are getting older. The use of handrails and safety bars help to provide stability and extra support required by the elderly and people with limited mobility. Shower and bathroom safety grab bars are available in a wide variety of configurations, colors and finishes. The most common is the stainless steel or chrome finish. Installation of grab bars must be done securely. The bars must be able to support a dead weight pull of 250 pounds. The preferred method is to bolt directly into the wall studs. This is

not always practical, as the stud might not line up where they are needed. Grab bars can be mounted vertically or at an angle to match wall stud spacing. Horizontal installation can be difficult because stud spacing and bar size do not always match. If finding studs becomes a problem, alternate installation methods are available. If your walls are in good condition and have not been compromised by water intrusion, you may use large toggle bolts. If you have access to the back side of the shower or bath walls, insert a backer plate or add a new stud for an anchor point. Safety grab bars can be found at any local hardware store.

I need to replace a dishwasher and I am little intimidated by the process. Can you walk me through the installation process? Mac

Dear Mac,

The installation of a dishwasher is not as complicated as it looks. Turn off the electricity leading to the machine. Turn off the water at the main shut-off. If your dishwasher site is not pre-plumbed with a separate water valve, remove the existing hot water angle stop valve under the sink and install a doublethreaded angle stop/shutoff valve under the kitchen sink. Use a stainless steel braided flex water line to hook up to the dishwasher. You may need to buy a Maintenance Men — continued on page 18

Maintenance Men — continued from 16 fitting to screw into your dishwasher to accept the hose (most new machines do not come with the fitting) or remove the existing fitting from the old dishwasher. Next, connect the drain line from the dishwasher pump motor outlet to the garbage disposer inlet. Don’t forget to remove the “knock-out” in the garbage disposal inlet. It is important to install an “Air Gap” between the dish-

washer and the garbage disposal. The air gap is installed next the faucet and stops the water from draining back into the dishwasher by siphon action. If you are unable to install a true air gap device, loop your drain line over the dishwasher before hooking up to the garbage disposal. Both methods will prevent debris from sucking back into the machine. Look for the small electrical box under the dishwasher, remove the cover and pull out the wires.

Connect your wires or pig tail (a wire with a plug on one end and bare wires on the other end) to the machine. Be sure to hook up the green “ground” wire for safety. Carefully push your machine under the counter. Once in place, adjust the legs by turning them in or out to level the machine. There should be two tabs at the front top of the dishwasher; use these to secure the machine to the countertop with screws. Now turn on your water and electricity and test your dishwasher and check for leaks. We need Maintenance Questions!!! The 2010s — The decade that was…

I

f you want to take a break from COVID-19, read on. My last article addressed the effects of AB 1482 and rent control. This month, I want to look at the past decade and the pace at which rents and expenses went up versus gains in apartment and house prices. Much has been written about OC and SoCal rent increases gaining at a rate exceeding CPI in the last decade. Renters faced nine years and 35 consecutive quarters of rent increases dur-

ing the 2010s. At this same time, apartment values as well as house prices recovered from the recession spectacularly well and were currently near alltime highs before COVID-19. Before we look at some numbers, I must say that some of these numbers might be skewed since mostly high-end product was built. Naturally, most of these high-end units offer amenities that our older buildings lack. Consequently, the figures reported in

local print skew toward the high side as those owners/managers tend to have a more well-heeled resident and may push rents more aggressively compared to most owners reading this article. According to Costar, rents increased around 35.11% during the decade. Remember some of this was “catch-up” from stagnant or drops in rents due to the Great Recession that preceded the Craig’s Corner — continued on page 22

Craig’s Corner— continued from 20 2010s. However, this is inconsistent with a recent article in our local newspaper that stated rents increased 43%–53% in the four counties in the So Cal region. Moreover, it stated that rents in LA and Orange Counties climbed to an average of $2,100. I would opine that most of our rental units are more along the lines of workforce housing and our rents are far below this mark and a lot more affordable. One key indicator that nobody seems to write about is what the apartment owner’s CPI has been during the decade. If your plumbing costs, wages, lumber costs and/or paint costs have risen commensurate with the much quoted CPI of 3%± during the decade, please drop what you’re doing and give me a call. For the decade, my rents increased about 30+% while my maintenance expenses doubled. Looking at the 2010’s decade through the eyeglasses of an apartment broker at Morgan Skenderian, while rents

increased 35% or even 53% (pick a number), apartment prices doubled. Pricing continued to rise until COVID19, as investor interest in Orange County had yet to wane. Most of the deals coveted were for older “valueadd” properties needing some work or upgrades. With the world awash in cheap money, there was a lot of money competing for limited inventory, and pricier deals that didn’t pencil out at 5–6% mortgage rates made sense at 4%. Moreover, contributing to these price gains was a compression of cap rates from 5.7% to 4.1%. It’s a fact that homeownership has steadily dropped in California and Orange County since 2006, which contributed to lower vacancy factors and healthy rent increases. Without a major increase in housing units being built, especially workforce units, it’s hard to see things changing long term. Jonathan Lansner of the Orange County Register recently stated that California house prices rose 120% in the

2010s vs. 26% in the 2000s. The average California house buyer now pays 2.2 times what a typical U.S. house costs, whereas the average over the past 50 years was 70% more than the typical U.S. house. Of course much of this has led to more renters, lower vacancy rates and consequently higher rents and prices. In closing, rents increased steadily in the 2010s, but underperformed apartment and housing price actions. Most predict that rent growth will decline in the following years and rent control efforts have already started. “Proposition 10 — 2.0” has qualified for the November ballot and activists in Santa Ana are gathering signatures to put a rent control initiative on the city ballot. Moreover, COVID-19 has thrown all markets into uncharted territory that’s never been experienced and can’t yet be quantified. Next Steps: What Owners and Operators Should Consider

e are all still deep in the trenches of adjusting our operations to the challenges presented by the COVID-19 pandemic. It may seem that day-to-day modifications and on-your-toes thinking is the best one can accomplish given the regular changes happening. However, leaders need to begin thinking about postCOVID-19 life and how the forwardthinking decisions made now will have the greatest impact on operations in the future. The following scenarios suggest a range of possible outcomes as the COVID-19 crisis evolves. It is too soon to tell which of these—if any, or others, or some combination—will emerge, but resilient leaders are preparing now for what the future may hold. The human and financial impact on a company, its residents and its property operations can be devastating if the recovery process is not included in the overall business continuity plan. Checking-in on your employees should

be a vital part of your weekly, if not daily, goals. Additional considerations should be given to human resources policies, transitioning employees back to work if moved to remote work and identifying any need for Employee Assistance Programs or counseling. For those employees still serving on the front lines of your business during this time, it’s an immediate priority to follow updates from the Centers for Disease Control and Prevention (CDC), government and other public health officials to ensure they are protected and supported as much as possible, even after the pandemic hits its peak. Deferred maintenance will factor significantly as we emerge from shelter-inplace policies. Filter changes, apartment inspections, delayed capital expenditure projects and postponed service requests are just a few items that may have been delayed as many communities are only responding to emergency requests at present. Depending on how long the

Property Meld, a computer software company in South Dakota, has provided data that suggests residents are withholding 22 percent of service requests, while property management firms are prioritizing emergency work resulting in a 32 percent decline of work being completed. As we head into the summer months of HVAC calls, turnover season and potentially re-opening amenities, you will need a plan in place to strategize the maintenance workload once shelter-in-place orders are lifted. Consideration of resident screening qualifications is another aspect to evaluate. Because of this pandemic, potential residents may suffer financial hardships that can equate to lower credit scores, late payments and possible bankruptcy. To maintain occupancy while also ensuring residents are qualified, should you consider changing your rental criteria to accommodate credit blemishes and poor owner/operator references? If you use a third-party credit screening service, should you consider lowering your scoring model? If your company executes a credit screening for employment applications, be mindful of any hardships that could have affected a credit report. It’s also important to make note of the recent changes incorporated into available positions that may require a different skill set or personality. Changes could include increase in technology usage, interpersonal skills that require extra attention for distant connecting, and organizational skills that allow prioritization to be at the forefront. Of course, the priority concern when thinking ahead is the financial and economic impacts that will directly result from COVID-19. Strategic conversations will need to take place to consider how to offset loss of income and unexpected expenses. Watching and anticipating portfolio delinquency will be a large factor, and plans should be put into place to determine how the property mortgage will be paid in the event of negative cash flow. Speaking with your lender as soon as you are

aware of financial challenges for making future payments may assist. Your company should be familiar with local and federal regulations to include eviction moratoriums for renters. While the easiest areas to cut expenses may turn to resident events, property marketing and employee training, it is advised that your company to be careful on trimming costs that reduce company value. Your employees and residents alike will need more encouragement and motivation in the months to come as they navigate this new normal. Market rent may change as a result of supply and demand in the economy downturn. Renewal lease offers may need to be evaluated with the intent for reduced or no increase to monthly rent instead of the budgeted increase if occupancy is a concern. This will be market-specific and should be evaluated on an ongoing basis. It’s important to take emotion out of pricing and build a pricing strategy with a balance

of science and operational expertise. For properties on revenue management platforms, this can still be a solid strategy for pricing if the 2008 recession is any indication of the systems’ successes. Thoughts for continued reflection: • What would you need to do differently to move your company forward post-pandemic? • What changes can you make in your daily operations? • What changes have you made in response to this pandemic that may continue to be implemented to have a greater impact in the future? • What capabilities, partnerships and strategies do you need to learn more about?

Treasury Encourages Businesses Impacted by COVID-19 to Use Employee Retention Credit

ashington—The Treasury Department and the Internal Revenue Service have launched the Employee Retention Credit, designed to encourage businesses to keep employees on their payroll. The refundable tax credit is 50 percent of up to $10,000 in wages paid by an eligible employer whose business has been financially impacted by COVID-19. “We encourage businesses to take full advantage of the Employee Retention

How Is the Credit Calculated?

Wages taken into account are not limited to cash payments, but also include a portion of the cost of employer provided health care.

How Do I Know Which Wages Qualify?

Retention Credit — continued from 34 Employers with less than 100 employees: If the employer had 100 or fewer employees on average in 2019, the credit is based on wages paid to all employees, regardless if they worked or not. If the employees worked full time and were paid for full time work, the employer still receives the credit. Employers with more than 100 employees: If the employer had more than 100 employees on average in 2019,

then the credit is allowed only for wages paid to employees who did not work during the calendar quarter.

I Am An Eligible Employer. How Do I Receive My Credit?

Employers can be immediately reimbursed for the credit by reducing their required deposits of payroll taxes that have been withheld from employees’ wages by the amount of the credit. Eligible employers will report their total qualified wages and the related

health insurance costs for each quarter on their quarterly employment tax returns or Form 941 beginning with the second quarter. If the employer’s employment tax deposits are not sufficient to cover the credit, the employer may receive an advance payment from the IRS by submitting Form 7200, Advance Payment of Employer Credits Due to COVID-19. Eligible employers can also request an advance of the Employee Retention Credit by submitting Form 7200.

Employee Retention Tax Credit: What You Need to Know Overview The employee retention tax credit is a broad based refundable tax credit designed to encourage employers to keep employees on their payroll. The credit is 50% of up to $10,000 in wages paid by an employer whose business is fully or partially suspended because of COVID-19 or whose gross receipts decline by more than 50%.

What You Need to Know About Termites, Fumigation and Tile Roofs

W

hile fumigation is an initial solution, it does not combat re-infestations. Localized treatments involve the injection of termiticides directly into the infested channels of the timbers, as well as the topical application of chemicals. This is commonly known as “drill and treatment.� This process not only controls the colony itself, but also provides a barrier against re-infestations in the specific area. It is then followed up with an injection of Drione to all accessible attic areas. This is performed to minimize re-infestations. Without the benefits of periodic inspections and treatments, the potential for dry wood termites and subsequent inspection almost always results in a recommendation for fumigation. When termite infestations are not identified and controlled from the exterior and infestations are permitted to enter a structures interior, they will swarm and re-infest attic areas and the interior; this is usually when a fumigation is recommended. It is important to understand that fumigation does not affect existing subterranean termites, fungus, or dry rot conditions. Dry wood termite swarming season occurs each year around September and October. They will swarm and reinfest to start new colonies; a common misconception is that during the dry wood termite swarming periods, the alates or winged termites (swarmers) fly from one area to another. In fact, they transport themselves through thermal

guidance provided by the prevailing air currents. This explains why fumigation tarps can be removed and the same day new colonies can swarm and re-infest the immediate areas or relocate in the same susceptible areas of adjoining or adjacent structures. We live in Southern California. Dry wood termites reproduce here. The goal should be, when possible, to perform localized treatments to control the infestations to prevent structural damage. Take the high cost of fumigation and apply that savings to any recommended repairs. Once identification of infestations and structure damage is performed, recommendations can be made to remove the infected wood material from the property and replace with new, leaving the structure free and clear of active infestations. However, concerned parties will be required to work with a structural pest control company with a construction background or licensed as a general contractor. Warranties and certifications can be issued stating that the property is free and clear of active infestations to lenders for escrow. A fumigation process requires workers to walk and drag heavy tarps across tile roofs; tile roofs are not designed to be walked upon. When fumigation workers carry heavy tarps and walk on the roof, they can damage the tile roof shingles and puncture holes in the felt membranes underlayment (which is applied over the plywood sheathing under the tile). tured in the felt paper, you must remove the tiles and replace the felt underlayment. The felt underlayment paper is for waterproofing the plywood sheathing and is the life of the roof which protects the interior of a structure from moisture. The purpose of the tile is to protect the felt membrane from the elements. Replacing the broken tile will not correct leaks when the felt paper in damaged. You must remove the tile, replace the damaged felt underlayment and reinstall the tile to correct active leaks. Fumigations can create long-term roofing problems after your escrow has already closed. Unfortunately, this problem has become a common occurrence in the industry. Roof releases are required to be signed by the owner or agent of the property, which releases companies from any roof damage and liability exposure that may be caused through the fumigation process. It is necessary to emphasize tile roofs are not designed to be walked upon. The interest of the responsible parties is best served by investigating alternative methods to fumigations by competent people who are qualified and capable to issue necessary warranties and certifications on all work performed. What’s the risk to you?

Much of that depends on the type of apartment building you own, the year it was constructed, the type of soil it stands on and its proximity to an earthquake fault. The closer you are to a fault, the more likely you are to be impacted by seismic activity. Here in Southern California, the junction of the San Andreas and San Jacinto faults creates a very scary seismic scenario where both might rupture simultaneously, causing what scientists say could be an epic magnitude-7.5 earthquake. Southern California faces a greater threat of earthquake loss than any other region in the state, according to two recent sources: the USGS and a U.C. Berkeley study performed on behalf of the California Geological Survey. These conclusions were based on an updated catalog of past and recent earthquakes, including last year’s Ridgecrest temblors. Focusing on Lessons Learned

lthough I am writing this article for the May issue of Apartment News, it is only the first of April and who knows what will have happened before you actual read what I have written. That said, there are some early lessons to be learned just from the first three weeks of what has become a monumental change in all our lives. • Communication means listening as well as talking • Good, reliable resources are a must

entire purpose of a call. You cannot fix every problem, but you can lend your ear and your time. When you need to communicate something specific, there is now, more than ever, a need to achieve a balance between coming out with edicts that might sound harsh or insensitive versus not getting your message conveyed or saying nothing at all. Think about whom you are addressing and their concerns, then try to communicate your needs and requirements as empathetically as possible. This applies not just in business, but in your personal world as well. Word of warning regarding the latter, no matter how hard you try, there are times that what you say may backfire on you! Right now, we are being bombarded by news in every direction. Yet people

still feel like they aren’t getting the information that they want and need. Facts help give people a sense of control. But when there is so much conflicting messaging, people don’t know who to believe or trust. Reliable information sources are a must. However, do not fall into the trap of only listening to just one source. Call upon your personal network of trusted advisors. Force yourself to view the opinions coming from different perspectives. The AAOC website is another fabulous resource. For those who know me, patience does not run in the family. Yet with so much happening so quickly, I have come to recognize that my priorities are not always going to be met on the schedule that I would prefer. When there is not a lot that can be done to hurry up a situation, then you need to take a breath and find a way to cultivate patience and make it work for you. When you discover the answer, let me know. Having a support system is another key component. This is true no matter what is going on in the world, but especially when there is a crisis. Without a support system, you are facing an uphill battle. The good news is that all of us have resources and people out there who can help us on one level or another. Ask yourself, as well, who you can help support. Reach out to those who perhaps you haven’t talked to in years. It is amazing what you will discover. At the same time, I am also learning to refine my “go-to” systems. Yes, there are back-ups, but now I am looking at ways to more seamlessly put those resources in place. At the bottom line, now is the time to recognize the importance of planning. Preparing for the next crisis is very apt to be a big part of our lives going forward. I have no doubt that we all will be better positioned for the next event. I’m already taking notes about what — when the world returns to a degree of normality — I need to look into and put in place. Prioritizing the items on this preparedness list further gives me a

sense of what really is important, although I also accept that those priorities may change. Planning doesn’t and shouldn’t just involve a crisis. Legacy planning, organizing that next vacation, purposefully creating more family time, and scheduling time for the things that you want to do, not just the “must-dos.” These are the plans we should all look forward to making soon. For now, I am focusing on the good

things that I can control. Family dinners, walking the dog and reaching out to old friends and clients just to say hello.
