We Got a Hot One!
I
f the recent weather is any indication of what summer has in store, it looks to be a hot one. And the only thing hotter than the heat is the sweltering Southern California real estate market. While a number of factors play into sales prices and activity, interest rates at 60 year lows are the primary driving force behind today’s bidding wars. Yes, interest rates and the concern over how soon and how much they will rise in the coming year is driving buyers bonkers. What started out as a guaranteed increase each quarter has now been scaled back. We can speculate that potential increases will be minimal and calculated, but would just be speculating. What we do know is that when the Fed talks, markets listen. A simple look at our local market and current investment activity says it all. Same Game, Different Names Sure, with institutional product you will often see the same five to ten investment groups chasing deals across different cities and state lines, but looking at transactions under 100 units in size we see a different story. That is, we see new faces and we see many faces. From cash heavy investors who have watched from the sidelines to the newbie who might have just cashed in on their stock portfolio and are intrigued by the four benefits, exceptional rent growth and low interest rate finance climate are pursuing multifamily with force. 4

International money, just a day away via wire, also continues to pour into multifamily and residential investments. This is changing the way many buyers are able to negotiate. In some cases, it is negotiating buyers out altogether. Just last week I missed out on a triplex in Orange that generated ten offers and sold for 15% above the asking price, all with minimal contingency periods. In order to proceed with the purchase I would’ve had to overpay, rush through the due diligence process and assume all the risk. For comparison purposes, this is definitely not the investment experience enjoyed by the E*TRADE baby. No, this is full contact and more prizefight than football. Sorry, There’s No Parking Here We are experiencing what could be one of the greatest seller’s markets in years. If you have a place to park your proceeds and have considered selling, you’d be hard pressed to find a better time to do so. But remember, if you are looking to trade up or trade into another property, finding a suitable upleg in today’s market can be challenging. You may want to secure your upleg before you proceed with your sale to ensure you end up better off. That’s not to say deals aren’t out there, but you definitely have to search for them. Remember, real estate is much more labor intensive than other asset classes and in order to make a move, it should be definitively worth your while. N E W S

Should you choose to proceed, do so with caution. Remember, you make your money when you buy, so negotiate hard and buy smart. And as for choosing when to sell, well, happiness is a positive cash flow. If you can’t replace it or increase it, don’t release it. Sometimes staying put is your best option and only you really know the answer to that. W
hen it comes to government affairs and lobbying, the location of the mightiest seat of power is right here at home. The State and Local lobbying efforts of the Apartment Association of Orange County remain ongoing, and they should. So much of our multi-family housing industry is affected by laws and regulations coming out of the State Capitol in Sacramento.
This past April, members of the Apartment Association of Orange County’s Legislative Committee visited the California State Capitol in conjunction with the Annual Sacramento Legislator Fly-In Meetings. For the Apartment Association of Orange County, our focus in Sacramento was on four key bills that would have adverse effects on the rentalhousing industry. With the help of
AAOC General Counsel and Lobbyist Jon Smock, whose monthly column appears here in Apartment News magazine, we were able to meet with 20 members of the State Assembly and State Senate from Southern California. Our legislative team offered the constant refrain: the apartment industry in Orange County is not small: there are over 545,000 apartment homes in the OC, which translates into $38 billion

in economic activity. That economic footprint supports an estimated 950,000 jobs. Jobs right here in Orange County. The four pieces of legislation we targeted were: Assembly Bill 396, Assembly Bill 551, Senate Bill 655 and Senate Bill 364. In the California Assembly, Assembly Bill 396 is authored by Assembly member Jones Sawyer. According to our lobbyist Jon Smock, AB 396 would make those with a criminal history a protected class under state discrimination laws. The bill, if enacted would force landlords to accept all ex-offenders regardless of the type of crimes they committed. Assembly Bill 551 is authored by Assembly member Nazarian. AB 551 would make the landlords responsible and liable for bed bug occurrences. If enacted a landlord could be subject to legal claims, damages, fines, penalties, or a diminution of value claim, even though the landlord did not cause the bed bug problem. And across the way in the California Senate, Senate Bill 655 is authored by Senator Mitchell. SB 655 would make the existence of any kind and any amount of mold in a residential renter unit a substandard housing condition. Landlord could be held liable whenever and mold is found. Senate Bill 364 is authored by

Senator Leno. We have seen then bill before and have defeated it in the past. But in Sacramento, bad ideas sometimes seem to have more lives that a cat! SB 364 would bar landlords from going out of business for at least the first 5 years of ownership. As well it would require landlords to rent their units and manage their properties during this 5-year period even if the landlord cannot or does not want to. Our organized meetings took us through 20 legislators’ offices and we offered our detailed and thoughtful oppositions. The face to face sit down between rental-housing industry partners and elected lawmakers of the state legislature, literally in the state Capitol in Sacramento has value, and I believe our collective voice was heard.

Orange County California is truly a political mosaic and always results in robust debate, fierce campaigns, and sometimes compromise. The elections this past November were significant in that the newly elected members of the State Legislature will serve under the new term limit rules. That is to say newly elected lawmakers may be eligible to serve for up to 12 years. That is a long time in power. • Mold as a substandard housing condition will lead to abusive litigation practices. Because SB 655 applies to all 300 hundred thousand species of mold that exist in the world without distinguishing between harmful molds or harmful levels of molds, landlords will be the subject of a new wave of abusive litigation practices. • Tenants will now be equipped with the right to sue for substandard housing conditions when any mold is present, including mold that is not harmful, mold from a tenant’s garbage bin, mold from a tenant’s old fruits and vegetables, and mold that is barely detectible. The second major bill in controversy would expose landlords to abusive litigation involving the housing of ex-offenders. AB 396 would in its latest iteration require property owners to engage in a time-consuming five-step rental process to accommodate possible consideration of ex-offenders, creating
a platform for litigation at every stage. Landlords have a legitimate nondiscriminatory purpose for checking the criminal background of prospective tenants, and denying tenancy when they pose a significant threat. They must be able to protect their tenants and protect their property. Felons who have been convicted of sex offenses, drug sales or manufacturing, property crimes, burglary, arson, robbery, assaults and other violent crimes, pose the greatest danger to the residents and the property. Moreover, felons who have multiple convictions, or those that could be deemed “career criminals” pose an even greater danger because of their potential to continue to wreak havoc in society. Finally, offenders whose crimes are more recent have not yet proved that they can behave properly in society. The bill, however, makes no distinction among types of crimes, number of convictions, or currency of the convictions. Yet, these are all important factors landlords must take into consider before putting their
tenants and property at risk. The recidivism rate in California is 65% According to the most recent California Department of Corrections and Rehabilitation (CDCR) report on recidivism (2011), three-year recidivism rates are 65%. (See CDCR 2011 Adult Institutions Outcome Report, hereinafter referred to as the “CDCR Report”.) That means 65% of individuals who are incarcerated, are either arrested, convicted of new crimes, or go back to prison within three years. Other significant statistics from the report include the following: • Inmates committed to prison for property crimes consistently recidivate at a higher rate than those committed for other crimes (69%). • Most felons who recidivate return to prison within a year of release (73.5%) Smock — continued on page 10

Smock — continued from page 9 • Re-released felons recidivate at a rate 19.5 percentage points higher than those released for the first time. • Younger felons recidivate at the highest rate. Inmates released at age 24 or younger return to prison at a rate of 71.9% • Recidivism rates increase with lengths-of-stay up to two or three years and decrease thereafter. Inmates with a length-of-stay between two to three years recidivate at the highest rate (69.8%). • Participation in in-prison substance abuse programs, combined with post-release community-based after-care results in recidivism rates (29.3%) that are much lower than those that did not participate in any substance abuse treatment program. Recidivism rates predicts future criminal behavior The CDCR utilizes a tool called the California Static Risk Assessment (CSRA) to help it predict an offender’s risk of being convicted of a new offense after release from prison. (See CDCR Report.) According to the CDCR Report, the CSRA does exceptionally well at predicting inmate recidivism. Based on criminal history, offenders are designated as having either a low, medium or high risk of reoffending. As predicted, using the model, the actual three-year recidivism rate for all releases
The United States Department of Housing and Development (HUD) requires landlords to deny tenancy to applicants who have committed certain crimes. The fact that HUD policy requires landlords to deny tenancy to felons not only supports our policy position on the issue, it is strong evidence that…Under HUD policy, landlords are prohibited from admitting an applicant if the applicant, or any member of the applicant’s household “has been evicted from federally assisted housing for drugrelated criminal activity.” 24 CFR Section 5.854(a). Landlords are also prohibited from admitting persons who have a pattern of illegal drug (24 CFR Section 5.854(b)(2)) use or are subject to lifetime registration requirements under a state sex offender registration program (24 CFR Section 5.856). HUD regulations also detail situations under in which landlords have discretion to deny admission based on criminal history. Under 24 CFR Section 5.855(a), landlords may deny admission to their projects if the applicant “is currently engaging in, or has engaged in during a reasonable time before the admission decision: 1) drug-related criminal activity; 2) violent criminal history; or 3) other criminal activity” that would threaten other residents or the owner.

Moreover, HUD has a “zero tolerance” approach to preventing lifetime sex offenders from receiving federal housing assistance. HUD, Notice H2009-11; PIH 2009-35(HA). Its stated policy is “ensure the highest levels of public safety in federally assisted housing facilities” and “maximize the safety of other residents.” Id. HUD policies are sound and enforced with strong support. It makes no sense that the owners of federal assisted housing properties can establish “discriminatory” rules based on criminal history, but private landlords cannot. Private landlords should be able to expect and ensure the same level of protections for their tenants as those enforced under federal rules. Among other important bills on the legislative agenda:

I
have an apartment building with a small work out area, kind of like a mini gym. There are a few exercise machines, a treadmill and some exercise mats. I’ve been worried about somebody hurting themselves and then suing me, claiming I was somehow negligent in maintaining the exercise equipment. I’m thinking about just turning it into a storage room. Is there any way I can keep the exercise room, the tenants
prohibition should only relate to the core rental unit, and does not necessarily extend to a non-core amenity, such as workout gyms, a recreation room or other entertainment amenity. room or entertainment facility, or other non-core amenity would be effective. The cases are fresh, the ink is barely dry, but the theory is well reasoned and should be upheld if challenged. This is good news for landlords in this crazy litigious world we live.

With a check, I know when the transaction is initiated and completed. With an EFT, I only know when the transaction is completed.
I encourage my tenants to pay rent by electronic funds transfer. I use the apartment association’s lease, which states “If Resident fails to pay the rent in full by the end of the 3rd day after it is due, Resident shall pay a late charge of $100.00 as additional rent…” One tenant seems to initiate the EFT later than the 1st day of the month, but I can’t be certain of what day it is, and if that day is a week-end or holiday, I see no sign of her payment in my bank until the following bank business day. That can mean I see the payment on the 5th or 6th day of the month. Is her rent late? When is rent legally considered paid? If my tenant gives me a check on the 3rd day
When rent is paid by ETF, it is considered received by you when it is credited to your account. It is immaterial when the tenant initiated the transfer, the date which the funds actually are credited to your account is controlling. In the case of a check or draft delivered to you, it is the date which you actually receive the actual check or draft. You have control over the funds/payment instrument upon deposit of funds or receipt of the actual check. Of course the specific terms of your lease control. Most leases require that the resident ‘deliver’ the rent to you on or before the first. This eliminates the old ‘check is in the mail’ excuse. However, some
‘creative’ landlords insist on writing their own ‘special’ terms on their leases, and if those special terms require the tenant to ‘mail the check to a PO Box’ or put it in a ‘drop box,’ then these terms may alter the date of payment, and in some cases may shift the risk of loss in the mail to you the landlord rather than the resident. Additionally, if the account number provided for the resident to make his ETF to is incorrect and the delay is caused by the landlord’s incorrect instructions, then the resident will be provided additional time. For these and many other reasons, it is very important not to alter the language provided to you in your apartment association forms; they typically anticipate these types of situations.
My problem is not with my tenants, but with the tenants in an eight unit apartment building down the street. I have a

My neighborhood used to be a nice quiet place, good hard working respectful tenants, well cared for buildings, no crime, no drugs, no gangs and no graffiti. About a year ago, a group of gang bangers moved in to the building down the street, and it started going downhill fast. The noise, the late night parties, the cars racing up and down the street…Before we knew it, a bunch of scary gang bangers started hanging out in front of the apartment building, drinking, loitering, and scaring the bejesus out of anyone walking by. They have to be selling drugs, lots of traffic, folks coming and going quickly, cars stopped in the street, kids running back and forth between the cars and the apartment building delivering little bags of stuff to the waiting cars. The good folks began moving out and it seems more gang bangers are moving in. The graffiti tagging started on the eight unit building, but seems like it is spreading throughout the neighborhood. My building has been tagged twice. My neighbors and I quickly remove it, but the owners and managers of the problem building just leave it. My residents can’t even take their kids for walks anymore! I’ve been losing my good tenants because of this, and it is getting harder and harder to rent my apartments when I have vacancies, seems like the good prospects get scared off when they see what is going on down the street. I don’t know what to do, I’ve

called the police, my neighbors call, nothing happens. What can I do?
The problems you are facing are becoming more and more common throughout California and in many other states. Local cities and counties are becoming less and less effective in controlling crime in many areas. Budget cuts, a lack of witnesses willing to testify at trial, a clogged and dysfunctional criminal court system more akin to catch and release, all contribute to the problems you are facing. Additionally, inexperienced and/or ignorant landlords that don’t actively manage their apartment buildings can quickly be faced with the seemingly out of control building that is adversely affecting yours. Left unattended, you can expect a further increase in crime, encroaching blight, a decline in your property values and a further loss in your sense of security. Fortunately, there are things that you and your neighbors can do to stop the bad behavior and return your neighborhood to how it used to be. There is strength in numbers. Organize as many of your affected neighbors that you can. Owners, residents, kids, anyone and everyone who has been affected by the nuisance behavior. Document the conduct. Each affected person should start and maintain a log of the nuisance related activity. Dates and times of the parties, extent of the noise, document any verbal or physical threats or assaults, witnessing of suspected drug activity. Take pictures of the loitering ne’er do wells, the suspected drug buyers’ cars, the graffiti, the trash and garbage that typically accompany this type of conduct. Keep logs of police calls and responses. Work with the local police and code enforcement officers to document and cite any violations. Contact your city council members to request assistance. Often, when city staff realizes that the neighbors are willing to stand up and ‘get involved,’ they tend to be much more helpful. Notify the owner and manager of N E W S

the offending property by sending a letter or a series of letters from the affected neighbors describing the problems that you and they are experiencing. Provide as many specifics as possible, be objective and be sincere. Provide a point of contact for the owner and manager to contact you or a group representative or attorney for the purpose of resolving the issues. Serve the letter on the owner of record and any management company that you believe is representing the owner. Provide the owner a reasonable time, i.e. thirty days, to take such necessary action to remedy the situation, or to indicate that he is willing to take such necessary action. If the owner or his managing agent responds, try and work together to solve the problems that you are all facing. Encourage the owner to take appropriate action, including but not limited to instituting active management practices, i.e. immediately remove graffiti, install needed lighting, remove trash and debris, etc. Encourage the owner to engage experienced counsel regarding any necessary warnings, termination of tenancies, evictions and training of staff. If the owner and his management staff are cooperative, this is the most effective and efficient way to resolve the issues present. If necessary, engage the services of a Mediator to help the parties work through any issues that are problematic. Most cities and counties have mediation services available free of charge. In the event the owner fails to respond and takes no meaningful actions, then use the litigation process as the last resort. The quickest and most effective California court available to resolve this type of matter is the small claims court. Most states have a process similar to California’s small claims court, check with your local civil court system for the process available to you. Q&A — continued from page 14 file and prosecute a small claims action against the owner of the nuisance building. The maximum claim per person in California is $10,000.00. Each affected person, ten, twenty, fifty or more, would then file a small claims case, request that all of the cases be consolidated and proceed to trial en masse. Small claims filing fees range from $30 to $75 depending on the amount of damages claimed. Trial will be set in approximately thirty days. Gather all necessary witnesses and evidence, including police officers and code enforcement officers that you have been working with. At trial, present your case establishing the nuisance, the owner’s failure to take necessary action to abate the nuisance, and detail your damages, i.e. lost sleep, fear and apprehension, damage to your property, decreased property value, lost tenants, vacancies and lost rents. The vast

majority of cases are successful, resulting in enormous judgments being entered against the offending owner which will certainly encourage the owner’s immediate cooperation or face seizure and sale of the offending property. be on track to raise “tens of millions” of dollars in the first 100 days of this year, mostly through his Super Pac “Right to Rise.” Recall that since the Citizens United decision by the U.S. Supreme Court, candidates can raise unlimited funds for their Super PACs, but cannot coordinate the activities of that entity once they are a declared candidate. That last bit is important since Governor Bush has not declared yet and can still raise money directly for and coordinate with Right to Rise. Governor Bush is also, in my opinion, the “establishment” candidate. He comes from an obviously well-established political family, is conservative though not extreme in his views and as a two-term leader of a state with the third most citizens and fourth most gross state product in the nation, has real executive experience. He should be a comfortable choice for a large portion of the Republican Party and, more importantly, a very plausible choice for the independents, undecided voters and maybe even a few Democrats during the general election. But, those attributes also make the Governor decidedly unattractive to many of the far right conservative and tea party voters in the GOP. They are looking for other options. As an aside, it’s worth noting that other Republican governors are contemplating Presidential runs. The mostoften mentioned is Scott Walker of Wisconsin who busted unions in his state and then survived their attempt to keep him from a second term. In addition, there is Ohio Governor John Kasich. Known to be energetic, a “doer” and sometimes testy, Governor Kasich has made no secret of his aspirations, spending a lot of time in primary states like New Hampshire and South Carolina. But even he admits that he must “reintroduce himself ” to the electorate and raise a lot of money. By way of historical reference, according to the Center on the American Governor at Rutgers University, 17 — or 40 percent — of the 43 American

Former Arkansas Governor Mike Huckabee (the other guy from Hope) is the clear choice for evangelicals and is marketing himself that way. Dr. Ben Carson, a retired surgeon, has zeroed in squarely on social conservatives. Former HewlettPackard CEO Carly Fiorina promotes herself as the true business candidate who can turn around the ailing national economy. Texas Senator Ted Cruz is the maverick who shakes the establishment at every opportunity and has his sights on a much smaller federal government. Florida Senator Marco Rubio is the young, smart, energetic leader who can attract the next generation of conservative voters. He also could help to bridge the gap with Latino voters who the past two GOP Presidential candidates lost by
primary in a single paragraph. Former First Lady, New York Senator and Secretary of State Hillary Clinton managed to clear the field of competition for the party’s nomination until the end of April when Vermont Senator Bernie Sanders entered the race. Senator Sanders is liberal and represents the progressive base of the Democratic Party. Also in this category is Massachusetts Senator Elizabeth Warren. Also a left-wing progressive, Senator Warren has solid star power within the base of the party and could mount a serious challenge to Secretary Clinton. What she does not have is access to the blizzard of Wall Street money that will almost certainly go to the Clinton campaign. The fun is just beginning, friends. His views on the Patriot Act, National Security Agency spying and interventionism overseas put him at odds with the more hawkish members of the Republican Party. But these views also put him in good stead with many tea party activists who are suspicious of domestic intelligence gathering by the federal government and are tired of wars in faraway lands. It’s telling that I can address the Democratic side of the Presidential

ear Maintenance Men: I was cleaning the kitchen stove in one of my vacant units and noticed the free standing stove tipped forward when I put a bit of weight on the open oven door. It looked a bit dangerous and was wondering how I can fix this issue. Rick

one of your resident’s children that found out about the dangers of a tipping oven. First let us explain what a tipping oven is: Most stoves with an oven are free standing appliances. The stove is placed in the kitchen, gas or electrical lines are installed and it is ready for use, very simple. The issue arises when a resident is using the stove and they or a child opens the oven door and puts 5:37 PM onPage 1 weight the open door. This causes
a cantilever effect which may pitch the whole stove forward causing the stove top pots or pans to fly off the stove and onto the person or child in front of the stove. Best case scenario is this causes a mess in the kitchen and worse case is a resident or child is badly burned or disfigured. Maintenance — continued from page 22 Mommy is cooking by using the oven door as a stepping stool or even more common, removing a turkey, roast or other large item from the oven and placing it on the open door. The extra weight is enough to tip the stove forward. The solution is an “anti-tip bracket” installed behind the stove. An anti-tip bracket is “L” shaped and usually installed on the floor and against the wall (towards the back of the stove) for one of the rear legs to slide into. Replacement parts are available at any hardware or home center stores, however, if not installed, there is a good chance, it is still in the plastic bag tied to the back of the stove. Shut off the circuit breaker or gas line feeding the stove, carefully slide the stove away from the wall, ensure a bracket Rear Leveling Leg
isn’t installed (the last time the stove was slid against the wall it may have simply missed the bracket) and if not installed, search around for the original plastic bag. Hopefully, the instructions and template is still in the bag. Keep in mind installing an antitipping bracket is both a resident safety issues as well as an owner liability issue. This is a $10.00 part and a ten minute install that will keep both you and your resident out of hot water. Dear Maintenance Men: Do you have a recommended schedule for doing property inspections? I’m concerned about liability and resident welfare. Steve Dear Steve: Routine property inspections are very important in our industry. Reduction of liabilities for the owner and safety of our residents is paramount. We recommend you set up an inspection routine to view the interior and exterior
of each unit twice a year. June and November are excellent months for these inspections for a number of reasons. An early November inspection is ideal before the rush of the Thanksgiving and December holidays which bring in the largest influx of people and activity in your building. Top of the list to inspect are smoke/ CO2 alarms, water leaks, and drain lines along with trip and fall hazards. If you don’t have a fire extinguisher service, we recommend contracting with a company in your area. The June inspections consist of the same items and for much the same reasons as above. It is very important to document each inspection by unit number, date and time and note the outcome of the inspection including if any item was repaired, replaced or serviced. Selling Small Apartments — Why It’s Not Always About the Numbers BY MICHAEL THORNTON
I
n 1987, one of my buyers taught me a valuable lesson about selling. He was an attorney looking to buy some apartments in Newport Beach. Newport Beach prices are so high, it’s hard to get cash flow without putting a large amount down and it was the same then. He wanted to buy with 20% down. I told him I could not make the numbers work for him with that amount down, that he would have a negative cash flow. He said to me, “Mike, I appreciate
that, but cash flow is not the reason I’m buying here. I’ve always loved Newport and I want a place where I can come down on the weekend to get away, strap on my Rollerblades and unwind. I know the numbers don’t work now, but eventually they will and that’s fine with me.” It was an “aha” moment for me and changed the way I do business. It’s not that the numbers aren’t important. They are. And if you were selling a 400 unit apartment property to the Irvine Company, it would be all
about the numbers. But I’ve found when you’re working with buyers of smaller apartments, quite often the numbers are not the primary reason people buy. You’ve heard the expression, “People make buying decisions based on emotion and support their decision with logic.” The same is true when selling apartments. I know there are some who insist it’s all about the numbers, that if the numbers do not support the property, well, good luck trying to sell it. But ask yourself, if it was only about the numbers, wouldn’t every investor be looking only in the lowest priced areas, which typically have the
highest proportion of rents to price? That’s why when selling property, it’s important to look for and be receptive to other reasons besides the numbers that can drive a buyer’s decision to buy — or not buy. The location of a property, ease of management and pride of ownership can all be important factors for an investor and outweigh the numbers in many instances. Sometimes it has to do with a buyer’s fear. Things like the safety of an area and property liabilities can cause
an investor to hold off, and until those concerns are addressed, you can talk about numbers until you’re blue in the face and many buyers will still not buy. Gross Rent Multipliers, Cap rates, price per unit, etc. are important and certainly need to be factored into a buyer’s decision to purchase. To maximize buyer interest, though, it is necessary to determine if there are other primary reasons or concerns that a buyer has. When selling a property, it can often spell the difference between a property that gets sold — and one that just sits on the market. W
hen was the last time you experienced exceptional customer service? What about when you felt you could have had a better experience? Did you take the time to post a review? Chances are, you probably posted a negative review when your experience was less than desirable. That is why, as owners and managers, customer service is key! Naomi Bailey of Naomi Bailey Performance Training gave examples of her experiences at different hotels that she stayed at as a national speaker. She gaged her levels of satisfaction and made decisions of where she would patronize again, and where she would not consider in the future. These satisfaction levels also apply to stores, restaurants, and even rentals! For this reason, it is vastly important to practice excellent customer service 100% if the time. Happiness
makes others happy, it’s contagious! That being said, one of the most important things that you need to ask is “what matters to my customers?” Ultimately, if you give them what they are looking for, they will be back for more. Listen to your residents and give them an opportunity to give you feedback. Naomi suggests using surveys and feedback tools to better understand what matters to your residents. This will create a bigger “fan base” of happy residents and a more positive community. Equally as important as good customer service is how you handle negative reviews. We all know that accepting criticism, even constructive criticism, can be difficult, but the way you respond to these reviews can make a difference. Act on your reviews. Acknowledge their concerns and think about ways to fix the issue and make it

Five Things You Can Do to Effectively Manage Resident Complaints BY ROMMEL ANACAN

leasing office wondering why he can’t “speak to the manager!” So what can you do...or what can you encourage your teams to do to manage these situations? After being in contact with thousands of people during my career, both onsite and at corporate, I have isolated five effective things that people can do when someone complains.

ave you ever heard the statement, “Customer service would be easy if it weren’t for those customers?” Sometimes that is just too true, isn’t it? After all we know that sometimes residents:
• Can be dishonest • And on and on and on and on The challenge that you face is even if a complaining resident is all of the above, you still have to deal with the situation don’t you? In other words, the fact that a resident may be all of the above doesn’t mean that you can just brush off their complaints. Well you could try but then you still have ‘Harold’ standing in the middle of the

that I believe all of us should learn is how to make other people feel important. If you are able to make an unhappy resident feel important, you will go a long way towards resolving any issues, even before you get to resolving the issue. I cannot tell you how many times I spoke with people who just needed to vent and feel as if they were important enough to be heard. And even when I couldn’t give these people what they asked for, I still got lots of “thank yous” and even some apologies after I took the time to make sure they felt important. Two: Remember it’s not a battle One of the most common mistakes that associates make is approaching a customer complaint as if it were a battle to be won or lost. How many times have you seen this when you’ve lodged a complaint with a company? Don’t you often want to say, “Look I’m not the enemy here, I’m just unhappy about this!” A battle with a resident is battle you cannot win, even if you’re right. And

the issue shouldn’t be about trying to prove who is “right” and who is “wrong” but how the issue may be resolved. And the more you fight with a customer, the less important you make them feel…which means they will continue to do what they have to do to prove they are important! Three: Lose the snark Four: Use some warmth When someone has a complaint, she often braces for “impact.” In other words, she expects the associate may give her some grief (especially if the resident secretly knows she was in the wrong), so she is prepared to dish it right back. Remember that scene in the movie Top Gun when one of the pilots says, “I’m going to guns!” An upset resident is often prepared to go to guns...so when an associate fires a round of snark, the resident is prepared to pull the trigger. Not the best way to diffuse a situation, huh?

When you’re genuinely warm and sincere with a customer, that can immediately diffuse things. I mean, how can someone argue with, “I’m so sorry. I see that we really fell short and I’d love to see what we can do to help you.” Five: Look for solutions As I talked about earlier, associates often see these situations as battles to be won; so the search for solutions takes a back seat to putting the customer in his place. But the truth is, there are always solutions to be found aren’t there? Sure, sometimes the solutions are not what the customer wanted initially, or what associates were able to do initially...but there are solutions everywhere. Savings based on variable speed pump compared to a single-speed pump running 10 hours per day at an average of $0.165 per kWh in a 32K gallon pool. Actual savings may vary based on utility rates, pool size, pump run time, pump horsepower, pump rpm, pluming size and length, pump model, service factor and other hydraulic factors. Text Messaging Most business text messages from organizations or companies rely on a 5 or 6 digit short code. However, text messaging can also be done over toll-free numbers or local business numbers in a particular area code. RokitNow can configure your existing toll-free number so you can send and receive text messages with it. If you need a new toll-free number or a new local number RokitNow can provide you with one as well. Using a toll-free number or local number allows you to do two-way text messaging where you can send and receive text messages from your prospects. Prospects will be able to call or text your leasing staff using the one phone number! Automated Responses RokitNow can setup automated responses for you based on keyword. For example, if a prospect texts the word “address” to your phone number they can receive an automated response back containing your physical business location. Text-to-Email and Email-to-Text RokitNow’s service makes it simple for your staff to view and send text messages. Every inbound text message sent from a prospect’s cell phone to your phone number can be converted into an email which is sent to your leasing staff ’s email address. Your leasing staff view the email on their computer, smart phone, or tablet and simply reply to the email — the email reply is converted by RokitNow back into a text message which is sent to the prospect’s cell phone. If you use email today to communicate with your prospects you can use email to send and receive text messages too! Web & Mobile Applications In addition to RokitNow’s text-to-email and email-totext service you can also view and respond to text messages using a web application that can be accessed on your computer, tablet, or smart phone. From the web application you can run reports and view your current setup as well. RokitNow also provides mobile applications for Apple iOS, Google Android, and Microsoft Windows tablets and smart phones. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible.
