When Life Gives You Lemons…

T

his proverbial phrase has been used for decades to help encourage and create a can-do attitude in times of difficulty and misfortune. The hardest part of dealing with misfortune is the fact that we often had no role in its creation. Unfortunately, we are forced to find ways to cure or mitigate the negative effects while feeling powerless to control the outcome. Achieving success is wonderful but being negatively impacted by uncontrollable forces is quite the demoralizer. Today, we have a multitude of issues that are directly or indirectly affecting our ability to live, work and play. It is a terrible trifecta! Beyond the COVID-19 pandemic and all the turmoil it has caused, with the risk to our health, economy, businesses, and general well-being on a global scale, we have so many other industry related issues to tackle and overcome. On the legislative front, we have some of the worst local, state and federal legislative attacks on private property rights in decades. The COVID-19 pandemic has fueled many of the existing hot button issues and has further emboldened tenants’ rights advocates and organizations across the country, asking for everything under the sun, including “FREE RENT.” What began as a housing supply issue, morphed into a homelessness issue (no fault of our own) and is now rapidly becoming a “human rights” issue, if you listen to the other side and

allow them to control the narrative. Here is a quick look at what the rental-housing industry is currently up against. On the California General Election Ballot in November: The Rental Affordability Act (AKA Proposition 10 2.0) would allow local governments to expand rent control to housing that is more than 15 years old. It would also allow local governments to limit rent increases for a new tenant who moves into a vacant unit to no more than 15% over the next three years. California Tax on Commercial and Industrial Properties for Education and Local Government Funding Initiative (AKA Split Roll Property Tax Initiative) would chip away at the property tax protections afforded all California property owners under Proposition 13 (1978). If passed, this ballot initiative would raise nonresidential commercial property tax sites valued at more than $3 million to market rate. It would also be reassessed every three years. Single-family and multifamily properties are not affected, but they certainly could be down the road. The split roll property tax could generate between $10 and $12.5 billion in new state revenue annually, which supporters say would go directly to schools and local municipalities to pay for services. Additionally, here are some of the most problematic state legislative bills that

the rental-housing industry is fighting, as of May 2020: AB 828 (Ting) Moratorium on evictions and foreclosures. AB 1190 (Durazo) Victims of domestic violence: early termination of a lease. AB 1997 (Nazarian) Seismic safety retrofit mandate for all commercial and residential buildings. AB 2271 (Gabriel) UD tracking: Shriver Act. AB 2406 (Wicks) Statewide rental registry. AB 3088 (Chiu) Technical changes to AB 1482: calculating CPI. AB 3260 (Wicks) Security deposit to be paid of 6 months: destroys the security deposit law. SB 939 (Wiener) Prohibition of Evictions SB 1079 (Skinner) Prohibits a purchaser of real property from buying more than 3 properties at any foreclosure sale. Mounting Our Defense Against Rent Control

C

alifornia’s rental-housing industry has been dealing with the operational, financial, and political effects of COVID-19 for the past three months. Thankfully, conditions appear to be stabilizing as we head into summer. This certainly will be helpful as the industry has another threat that it must start to address in earnest, one for which each rental property owners’ and operators’ attention, engagement, and resources will be critical. That threat is the Rental Affordability Act, the statewide ballot initiative that would allow for the radical expansion of rent control at the local level, exacerbating the housing crisis and eviscerating the rental-housing industry in the process. This month, the Apartment Association of Orange County (AAOC) begins the first phase of its member mobilization and fundraising efforts to help defeat the Rental Affordability Act in November. AAOC will start by hosting informational member briefings in collaboration with the California Business Roundtable (CBRT), the organization that is running the Rental Affordability Act opposition campaign.

You may recall that CBRT also ran the successful campaign to defeat Proposition 10 two years ago. In addition to the briefings, AAOC will also be initiating a dedicated fundraising effort to assist the campaign in reaching voters and providing them with critical facts about the initiative. AAOC is calling upon each of its members to contribute generously to its “Multi-County Property Rights Political Action Committee,” so that the association can make an early and significant contribution to the campaign this summer. Keep your eyes open this month for a fundraising letter and email directly from AAOC. If you are wondering what is at stake for our industry if the Rental Affordability Act is approved by voters this November, let’s start with saying goodbye to Costa-Hawkins, as we know it. Most of the protections afforded to rental property owners under the Costa-Hawkins Rental Housing Act would be eliminated. Local governments would be empowered to enact vacancy control measures, which would prevent rental housing providers from raising rent to market upon the vacancy of a unit. It would also cap rent increases to no more than 15% of the previous tenant’s rent during the first three years of the next tenancy. Additionally, it would expand the total number of units under rent control each year by capping rents for properties that were built after 1995 and are more than 15 years old. Finally, owners of three or more single-family homes who operate them

as rentals, would now also have those rents capped. For those of you who are not fans of unaccountable and untouchable regulatory bodies and unelected bureaucrats telling you what to do, the Rental Affordability Act would also result in the creation of hundreds of rent boards, up and down the state, with the authority to dictate local rental-housing policy, property usage, and fee assessments upon owners. If you were on the fence a moment ago about making a financial contribution to help defeat this ballot initiative, then perhaps I’ve provided you with at least a few good reasons to write a check or make an online contribution. However, if you are still looking for additional reasons to contribute, please take a moment to read pages 48 and 49 in this month’s magazine. It is not an overstatement that rental housing providers stand to lose a lot financially if this initiative passes and that our industry would be forever changed. The repercussions would be disastrous for housing providers and their renters. If this is something that you do not wish to see happen, then I implore you to contribute today. Legislative Quest is Rental Housing Nightmare

D

o you remember “The Impossible Dream (The Quest),” a very popular song that was written by Mitch Leigh for the Broadway musical “Man of La Mancha?” Well, that “quest” may come true if the progressives prevail this year at the municipal, county and state legislative levels of government. Let’s look at a few remarkable bills that, if nothing else, as the idiom goes, will make your blood boil. SB 939 (Wiener) would act to tie the hands of commercial rental property owners in an inequitable, burdensome and deleterious manner. It proposes to amend existing law providing that, it shall be unlawful to terminate a commercial tenancy, during the pendency of the state of emergency proclaimed by our Governor on March 4, 2020. The bill, amongst other things, promotes unconscionability and oppression to disparate bargaining power by allowing a commercial tenant who wishes to modify a rental agreement to enter into negotiation with the landlord regarding a legally binding existing contract that was legally formed. If negotiations are determined to be unfavorable, then one party and only one party to the agreement (the tenant) is allowed to terminate tenancy at will with no additional economic consequence. SB 939 essentially ties the commercial rental property owner’s hands by forcing the owner to participate in inequitable negotiations where one party, the tenant, has all the leverage and the other party, the landlord, is forced to accept any term proposed or be subject

to unrestrained default. Oppression in the context of disparate bargaining power is where one party is forced to accept burdensome terms, those advanced by another party, and that are not justified by commercial necessities, as the cost of obtaining the contract’s benefits. The oppressed party accepts the oppressive terms, although aware of the consequences, because his bargaining power is such that he must do business on these terms or not at all. Furthermore, the freedom of contract doctrine rests on the assumption that parties to a contract are the best judges of the value to themselves of the reciprocal obligations in the contract. This assumption is realistic only so long as the contract represents real bargaining between parties with freedom of choice and consequent ability to negotiate in a meaningful sense. SB 939 provides for inequitable terms in that only one party to the agreement, the tenant, can elect to re-negotiate the agreement, although it was mutually agreed upon by both parties. Furthermore, if the tenant finds that the negotiation process has not yielded the desired outcome within thirty (30) days of the notice to negotiate, then the tenant, and only the tenant, can terminate the lease with no additional costs. Commercial rental property landlords and tenants have unique dealings that often differ from the terms of residential agreements. For instance, a factor that is often essential to such an agreement and must be accounted for

is premises improvement and fixture accommodation. Because such expenditures are often extremely costly, their outlays must be amortized and recovered over great periods of time, in most cases over a period of several years. In all cases, it is the landlord that finances this investment. The only guarantee that costs will be recovered is the contractual agreement entered into with the tenant. To allow the tenant to terminate this agreement with no obligation to provide the landlord restitution is the definition of unconscionability. SB 939 at best places the landlord in an unequal bargaining position, at worst it forecloses any means for the landlord to recover an investment while obliterating any right or interest protected by contract law or the Uniform Commercial Code (UCC). The suggestion that one party to an agreement is allowed to terminate it at will with no consequence, is inequitable, offensive and contrary to basic principles of equity established in contract law. Equity proceeds in the principle that a right or liability should as far as possible be equalized among all interested. Additionally, even the SB 939 provision that provides for a maximum of three (3) months of past due rent is unenforceable by a commercial rental landlord. This is because in section 1 subsection (d) of SB 939 states that, “The non-payment of rent that would been due during the state of emergency shall not be grounds for an unlawful detainer.” As such for the tenant there is no consequence for refusing to pay


even the three (3) months required by the provision. Effectively, making the only part of SB 939 that protects the commercial landlord, unenforceable. And another bill, that in our judgement would largely unravel the security deposit law. AB 3260 would mandate a landlord to authorize a tenant, as an alternative to paying the full amount of a security deposit before taking possession of the premises to satisfy the security by either obtaining and maintaining rental security insurance, surety bond, or paying the amount of the security in monthly installments over a period of not less than six months. Tenant advocates observe that many cannot afford to pay the security deposit and the first months rent when taking possession of a rental unit, particularly amidst the COVID-19 pandemic. One needs to become a student of security deposit insurance coverage, availability, affordability, and exculpatory clauses. The “student” will discover that there are less than a handful of insurers in the state, there are several exclusions from coverage, and the insurers that are approved by the Department of Insurance, are not acceptable to our industry. Surety bonds are not an alternative. They simply are not offered in the state. Where the significant danger exists is the suggestion that a new tenant will pay the security deposit over time. Default will not be easy to perfect. It will be next to impossible to successfully pursue an unlawful detainer. Should damage occur during that time, where a tenant stops paying the security deposit, it will be extremely difficult to financially recover. So, I repeat, will the “quest” to take control of the rental real estate market come true this year? Update on Local COVID-19 Policy Actions

E

very city in Orange County, including those with their own eviction moratoriums, will have seen their COVID-19 emergency orders end on May 31. That is unless the governor extended his statewide eviction moratorium executive order or the State Legislature took action between the writing of this article and the arrival of this magazine in your mailbox. The city of Anaheim is the only exception, with its emergency eviction moratorium having been extended to June 30. AAOC communicated its opposition to Anaheim’s proposed eviction moratorium extension in a letter to the mayor, explaining that the statewide eviction moratorium had effectively already been extended through the end of August. This was accomplished when the California Judicial Council issued a rule freezing most eviction actions by the courts and law enforcement for 90 days after the state’s emergency declaration expires on May 31. Despite there

being no benefit to taking such an action, the Anaheim City Council approved the extension on May 12. Meanwhile, in Santa Ana, AAOC and a coalition of housing providers mobilized in opposition to the blanket, citywide rent freeze that was established by an executive order of the city manager. The opposition was so strong that the issue was brought before the Santa Ana City Council at its meeting on May 5. Prior to the meeting, numerous emails and letters (including many from AAOC members) opposing the blanket rent freeze and questioning its legality (i.e. It violates the Costa Hawkins Rental Housing Act), were sent to the city council members. Despite the strong housing industry opposition, the Santa Ana City Council voted to uphold the rent freeze, with the provision that it would end on May 31, along with the other emergency orders included in the city manager’s executive order.

Looking countywide, as of mid-May, the County of Orange and 17 Orange County cities have received significant COVID-19 federal relief dollars through the CARES Act. Of particular note, the city of Anaheim voted on May 5 to commit $3 million of its federal relief funds for rental assistance. The mayor also included AAOC in the planning process with the city manager and the Anaheim Housing Authority, to design an effective system for distributing relief funds to best assist tenants and rental housing providers. Questions & Answers Most of my residents paid their rent in April, and again in May. I know it was difficult for many, reduced hours, furloughs, some were laid off, but most were able to pay their rent, many even paid early. I have a few who didn’t, some I haven’t heard from, haven’t returned my calls, kind of gone dark on me. I know that there is an eviction freeze in place right now, not much I can do till it is lifted, but what should I be doing? I can’t just sit around not knowing if they will pay or not. I am very concerned about

June and whether or not my luck will continue. What can and should I do?

At the time of this writing, second week of May, the courts are essentially shut down, except for limited exceptions. There are statewide eviction limitations in place, and many cities and counties throughout California have chimed in with their own unique requirements. Most of these restrictions are intended to protect those residents whose ability

to pay their rent has been impacted by the COVID-19 pandemic. Some actually require evidence of such adverse impact, and further require that the resident actually provide that evidence to the housing provider. Cities differ as to whether this evidence must be provided before the rent comes due, within a certain number of days after it was due, or whether the resident can wait until trial. Some jurisdictions don’t require such evidence. Also, as of this writing, the rent that is due and unpaid will be required to be paid to the lessor, in full, but that repayment is uncertain, and the time frames will vary depending on the city and or county. The California Legislature is crafting statewide guidance for this, however such legislation is not finalized. And if that’s not enough to make your head spin, all of these rules are in flux, they are constantly changing, ‘updated,’ amended, sometimes daily, and often the ending dates are extended! So, what do we do? Right now, communication with


your residents is imperative. Thank the ones who are doing their best to stay current, let them know how much you appreciate them. Follow up with those who are not paying in full or at all. Keep it professional, let your residents know that the pandemic affects all of us, that you are affected just as they are. For those who are impacted, try and negotiate a repayment plan for the deferred rent. Terms will vary depending on you and your resident, and the jurisdiction of your property, but repayment over three to nine months is typical. You will find that the vast majority of residents are suffering right now, as you are, and want to do the right thing. The majority will pay when due, some will make payment arrangements. Of course, there will always be those who will try and take advantage of the current situation. Those are the ones you want to identify as early as possible. If you are an active owner, you already know who these scoundrels are. For these residents, document your communication carefully. Communication should be in writing, and consistent with how you normally communicate with these residents. Confirm the rent that is due and unpaid. Confirm that you have offered to defer the rent. Confirm that the resident did not provide you with any evidence that the nonpayment was COVID-19 related. Additionally, if the resident is in default under other provisions of your lease, confirm those issues as well. Now is the time to document your interaction, and their lack of response if appropriate. When the courts reopen, and yes, the courts will reopen, this documentation will be necessary when you finally get your day in court. The judges will certainly be sympathetic, but that sympathy will be reserved for those parties who acted in good faith, and that includes both residents and housing providers. This is certainly a difficult time for all, but you will get through it. This also is a test of true character, you as the housing provider doing what you can to assist your residents, and the

character of your residents, doing what’s right and doing what they can to assist you. Above all, stay positive, trust your residents, communicate professionally and with compassion. You’ll find that the vast majority are good honest folks just trying to do their best and what’s right. The others, we’ll deal with when the courts reopen. One of my former tenants took me to small claims court over her security deposit. She

claims that I was unreasonable in spending all of it because she claims she had a cleaning crew come through the place before she moved out. I don’t know if she used a cleaning crew or a wrecking crew, because the place was trashed. Anyway, the judge in the small claims court apparently liked her, and I guess I lost my temper at the hearing. When all the dust settled, the judge ordered me to pay her! Go figure. Legal Q&A — continued from 13 appeal this decision if I want to. I basically wanted to know what happens in the event of an appeal, and whether or not I could have a lawyer handle it.

A small claims appeal is a “trial de novo,” that is, the appellate hearing will be a “new trial.” You, as the Defendant, essentially get another chance to prove your case. By and large, the structure of the proceeding is essentially the same.

However, on a small claims appeal, as opposed to the initial small claims proceeding, you may have an attorney represent you. In your situation, if you’re afraid that you might lose your temper again, call a lawyer who will talk about the case with you. Of course, there are times when it’s simply more cost effective to “go it alone,” when the amount you’re fighting over is less than the cost of retaining counsel. If this is the case for you, and you really feel that you were not treated fairly in the small

claims court, then appeal the decision. Just remember to take a deep breath out in the hallway. I am a resident manager of a 16-unit complex. I received a telephone call from a person wanting to rent a unit from our small complex. I asked the prospective tenant if she had any children. She got offended and told me, in no uncertain terms, that I could not ask that question. I replied by thanking her for her criticism and hung up the telephone. Is the prospective tenant correct that I cannot ask if she has any children?

Yes. Rather than ask how many children will reside in the unit, a more relevant question would be to ask how many occupants would reside in the unit. Most acts of discrimination in rental housing occur during the resident screening process. For this reason, it is prudent to put your screening procedures in writing and to adhere to them strictly and impartially. All rental units must be available to families with children. Furthermore, rules designed to discourage families from applying to rent may lead to the filing of discrimination complaints. Minimize the pre-screening over the telephone; you never know if the caller is truly a prospective applicant or just a tester from Fair Housing hoping that you will say something actionable. Each property owner, management firm, and organization has an opportunity to contribute in a meaningful way to helping our com-

pandemic. Demonstrating professionalism and compassion during this time can help change that narrative and start to shed the “greedy landlord” label that has dogged us for so many years. We may not have control over this misfortune or the impact it has had on our industry, but we can absolutely control our response. I’m attempting to remove old caulking from around a bathtub. Are there any tricks or chemicals to help with this job? Steve

Dear Steve,

Most bathtub caulking is either silicon or latex based. If originally installed properly, it should stick pretty well. Most household chemicals will not affect the caulking or help in its removal. The best method is to use a razor knife to cut along either side of the bead. Then pull the bead out by hand as you cut. The balance of the material can be removed with a flat razor, either along the old bead or perpendicular to the bead. After all the material is removed, use a damp rag to remove any loose bits. Before installing the new caulk, be sure the area is clean and dry. You can use a wet/dry vacuum to suck up any water left over from your cleaning.

Dear Maintenance Men:

I’m doing some long-term preventive maintenance with my building’s individual 30–40 gallon water heaters. Each unit has a water heater and I’m not sure of the age or condition of each unit. How long do most heaters last and what are some signs of imminent failure? Bryan

Dear Bryan,

The chances of a number of heaters failing all at once are very slim. Therefore, the cost of replacement can be spread over a period of time. The average life span of a typical 30 or 40-gallon waterheater is about 10-to-12 years. Some may last much longer depending on use and hardness of the water. Some signs that the end may be near are banging noises coming from the heater, low hot water supply, and long heater cycle times producing lukewarm water. At this point, you should start pricing a new heater. However, if you find water

pooling at the base of the heater, replace it immediately. It has failed!

I own a small apartment building with an average amount of landscaping around the property. I have a garden service that comes each week. They cut and edge and do what they’re supposed to do — I think — although they don’t spent a lot of time at the property. What should I expect from my landscapers or garden service? John

Maintenance Men — continued from 16 • Pull out weeds between the sidewalk cracks, walk around the building, including the alley. • Turn over the dirt in all the flowerbeds each week. • Pick up any trash around the property. • Broom, blow or hose down the walkways.

• Turn on the sprinkler lines, check for clogged heads, broken lines, etc. Check that the timer is set properly. • Cut, trim and thin any shrubs or bushes. • Maintain communication with the owner about problems or improvements. The above list takes time, a minimum of 30 minutes at a small property. If your landscape gardener completes the

list on a weekly basis, you could very well have the best-looking property on the block! That means higher rents. If you add colorful flowers, even higher rents! Finding a landscape gardener to do the above list consistently is not easy. Ask the Apartment Association of Orange County (AAOC) for recommendations or look in your neighborhood or city for properties with outstanding landscaping and ask who the gardener is. Have that gardener provide you a quote according to your “list.” Keep in mind a landscape company or gardener who provides the above services will charge more than a “blow and go” gardener, however your property will reflect their above average service. A once clear puddle has been muddied by the very abrupt opposite of the aforementioned circumstances and including stock market turmoil, an oil market in free fall, slowing rent growth and record job losses followed by unemployment claims. What started out as a public health crisis has now become a political problem. Let’s take a look at what that could mean for you and your real estate holdings.

unemployment premiums and stimulus money has helped to keep people and businesses afloat while closed, out of work or working limited hours, but many of these businesses and jobs will come right back when Governor Newsom decides to let us get back to work. Don’t expect big changes to the markets if we are back to work by July.

Times Change, Investment Principles Don’t

Multifamily residential properties, like other income producing properties, are valued by the quality and quantity of the income stream associated with them. Unless rent rolls start to show increased vacancy rates and lower economic occupancy (rental income/collections), don’t bet on values taking a hit. Occupancy rates have held steady year over at 96.2% in Orange County. Looking for a “deal” or “value”? You might find the best opportunities are here, right now, in the midst of the chaos.

No Concern Over Slowing Rent Growth

Yardi Rent Matrix published Orange County’s year over year rent growth at 1.8% for April 2020. This is just under half of what it was for March 2020 and other recent months. We’ve had a decade plus of strong rent growth, right up until the unemployment rate hit 14.7% virtually overnight. If you’re concerned about the what and why, you need a lot more help than I can provide in this 600-word column. Look for measured growth to continue throughout 2020 and into 2021. Remember

Sacramento Politicians Stepping on Property Owners

Perhaps one of the most ironic things to happen during the pandemic or forced stay-at-home is the fact that legislators have not only forced us to stay inside of our homes but they’ve also told us that we don’t have to pay. The governor’s directive opened up dozens of eviction moratoriums across the State, some forbidding property owners from requiring their residents to enter into a payment plan. This has created a handful of Assembly and Senate bills that would be even more devastating to apartment owners, including AB 828 that would award residents who didn’t pay their rent a 25% discount. Other problematic bills seek to grant commercial tenants the same protections afforded non-paying residential tenants. We seem to be turning the corner, with Arizona, Florida, Georgia, Nevada, Texas and other states reopening and now California slowly allowing businesses to re-open. Bottom line: unless legislators manage to mess things up, we will soon be back at it and the markets will have the COVID-19 impact bakedin. But if I’ve learned anything, its to never doubt the cluelessness or ineptitude of the State legislature. Only in California could we weather an international pandemic just to have elected officials tank the economy with the stroke of a pen.

Insurance Commissioner Orders 60-Day Grace Period for Policy Premiums

O

n March 18, 2020, in response to the substantial disruption caused by the COVID-19 pandemic, California Insurance Commissioner Ricardo Lara issued a Notice requesting all insurance companies to provide policyholders with a grace period of at least 60 days to pay insurance premiums. That means, insurance policies will not be cancelled unless and until 60 days past the payment due date.

The grace period covering late payment is now in effect until July 14, 2020. After July 14, 2020, if policy holders are unable to make their insurance premiums, they will be given a ten (10) day grace period before the policy is cancelled. Insurance Commissioner Lara warns, however, that the grace period is not a waiver or forgiveness of any premium due, and it is only an extension

of time in which to pay premiums. The grace period in applies only to cancellation or non-renewals attributed to a failure to pay premiums during the applicable grace period. If a policy is to be cancelled or non-renewed for any other allowable reason, the cancellation or non-renewal may be made pursuant to statutory notice requirements and for legally recognized reasons.

But at the beginning of the spring leasing season of 2020, during the height of the COVID-19 pandemic in the U.S., retaining existing residents took on even more urgency. “Retention is always important,” says Marcie Williams, President of Charlotte, N.C.-based RKW Residential, which operates more than 20,000 units across the Southeast. “But it’s especially important now. We’re looking at increasing retention as a way to offset the recent decline in leasing velocity due to COVID-19.”

Pandemic Stymies New Leasing Velocity

Stay-at-home orders have hit U.S. industries hard, and apartment leasing is no exception. In Chicago, for instance, the potential sales pace has been halved during a period that’s usually the busiest time of year for leasing apartments. “With the current crisis, new lease velocity is at 50 percent of projections,” says Aaron Galvin, CEO and Founder of rental brokerage Luxury Living Chicago Realty. Apartment operators all over the country are paying extra attention to retaining residents and finding ways to help them weather the storm until the

pandemic finally ends or at least greatly diminishes. “Retaining residents really helps with a lot of different costs of turnover, as well as just the sense of community when you can keep existing residents there,” says Dana Caudell, President of Property Management at Wellington, Fla.-based Bainbridge Cos., which operates 20,000 units. “So our strategy hasn’t really changed, but we’ve definitely been reaching out to those folks now.”

Flexibility With Current Residents

One of the first steps apartment community operators took when shelterin-place orders went into effect was to revisit the circumstances of residents who had already turned in notices to vacate, normally an unnecessary strategy during the spring leasing season. “We have been calling each resident that submitted a notice to vacate to confirm if their plans are still intact or if they are interested in extending their lease,” Williams says. “Compassion and flexibility [have] been the key to our success in rescinding approximately 20 percent of the notices.” Flexibility on all fronts has been a battle cry for operators across the country trying to deal with the ramifications of the pandemic. At Bainbridge, Caudell also says her teams have been reaching out to residents who had already handed in notices. Some people who planned to move have changed their minds

because of the virus, she says. “Even if we have already rented out their units to someone new, we’ll try to see if we can move that prospect into another available unit so our existing residents don’t have to move out.”

Keeping Renewals at Current Rates

A common tactic for many operators has been to offer renewals at current rental rates, without tacking on the 5 percent annual increase that has been the hallmark of this apartment cycle. “Rents aren’t frozen, but look, nobody’s giving out renewals with an increase at this point,” says Dan Wurtzel, President of FirstService Residential New York, which operates 20,000 rental apartments in the New York metro area, the epicenter of the COVID-19 crisis in the U.S. “Retention’s always a concern for us. But it’s an even bigger concern this year.” For residents who have been hurt financially by the pandemic, many apartment pros are offering special repayment options, without charging late fees. “We know that the health crisis will eventually ease and the residents that can benefit from a payment plan now will reward us in the future with a longer lease term and getting their payments back on track,” Williams says. “So we’re working on plans with them that benefit us both, while directing them to resources such as rent and food Boost Retention — continued on page 26

Boost Retention — continued from 24 assistance programs.” Operators are also being flexible when it comes to extending leases in the short term, especially for residents who are wary of committing to another 12 months of rent payments, given the current employment outlook, which has seen more than 26 million Americans lose their jobs. Caudell says she has some residents who haven’t been in their job long and are unsure if they want a long-term commitment. “So if that’s the case, we are offering extensions on renewals upwards of three months, without charging any type of short-term fees. We’re just trying to be as flexible as we can,” She says.

Renewals Up Amid Uncertainty

That strategy is paying off for Bainbridge, as Caudell reports some 80 percent of the firms’ residents are renewing, well above the industry norm of 40 to 60 percent. In Chicago, a similar trend was seen through April, particularly when operators held their rents level. “We are seeing a 10 to 15 percent increase in renewals from historical averages, especially [for] properties not increasing rents,” says Galvin. “This is helping to offset delinquency rates and limit turnover costs.” In student housing, increased flexibility has also paid off, especially for student renters who have little clarity so far on when school will be back in session this fall. “We’re definitely offering more concessions or incentives to renew for next year than we were on January 1 of this year,” says Ari Rosenblum, Co-founder and CEO of Miami-based Vie Management, an operator of 11 student housing properties across the eastern U.S. “What we’re seeing is that a lot of residents are thinking that school will start at some point, so instead of rolling the dice in August and trying to figure out where they’re going to live then, they’re taking care of it now.”

The key in that market, however, is to make it clear that students will be able to back out of their leases if their school in fact doesn’t open in the fall. “The number-one thing we’ve done is give people the ability to get out of their lease if school does not start,” Rosenblum says. “When we can allay that concern, we’ve been successful in getting people to re-up.”

Longer-Term Impacts

While those kinds of concessions can help both residents and operators in the short term, observers also point out that when markets normalize, the impacts of those steps will still be felt. “Short-term extensions usually come at a premium of $500 to $1,000 per month,” Galvin says. “But most owners are allowing short-term extensions right now with no premium because of the uncertainty for their residents. This empathy goes a long way, but the longterm effect of this strategy will adjust ideal expiration schedules and, in turn, impact the ability to raise rents in future years. It’s definitely the right thing to do for renters, but it will hurt the financials of the property down the road.” Nowhere is that more apparent than in the B and C rental markets, where residents are more likely to hold hourly wage jobs and thus be more prone to feeling the impacts of the crisis. For those reasons, owners in those markets are even contemplating a future where rents actually go down. “I believe our long-term tenants are more valuable now,” says David Hudgins, Co-founder of Los Angeles-based real estate investment firm HB Group, which operates a 36-unit, B Class property in Nashville, Tenn. “But because we don’t know what’s going to happen with the vacancy rate, or with the job market, what we’ll need to do to retain people or attract new residents may be [to reduce] rents.”

apartment operators also note that it’s during a crisis that covering the basics of property management can pay off with dividends. “Reliable renters have become even more important, because every fulfilled rent payment plays a crucial role in keeping properties afloat and able to pay their mortgages,” says Brian Davis, a property manager and the Co-founder of Philadelphia-based property management platform SparkRental.com. “Care packages with toilet paper, hand sanitizer, masks and nonperishable food go a long way in generating goodwill. Small gestures like that make good tenants think twice about moving. And, of course, it’s just as important as ever to remain extremely responsive.” Apartment operators say that retention is all about making residents feel connected and engaged in their communities. Therefore, many have been leveraging technology tools during the pandemic so residents and onsite staff can still interact, even with social-distancing measures in effect. “We’re always looking to do things for our residents to keep them engaged and to just promote that social feeling at our communities,” says Bainbridge’s Caudell. “What that means [right now] is going on Facebook or Zoom or virtual happy hours, or putting on a virtual online bingo night.” At RKW Residential, Williams has been leveraging tools to stay front of mind with her residents as well. The biggest difference now is the need to create ways to connect with our residents virtually, she says. “But our consistent and personal touch points remain the same as they did preCOVID-19, too. Our teams still pick up the phone, send personal notes and surprise gifts, and look for ways to create exceptional living experiences for our residents.” They represent one more opportunity, amid the great pandemic of 2020, to hold on to the residents you’ve got, while limiting the loss of rental traffic at the height of the spring leasing season.

Five Tips for Property Management Success

A

partment property management is getting more complex. It seems almost daily, there are new laws, regulations and rules to contend with. While the pace of change can be overwhelming, the following are five simple techniques to help ensure successful property operations. 1. Stay Organized As an apartment owner, make sure you’re managing your investment like the “business” that it is. First and foremost, maintain pristine property records that are routinely updated, organized and securely stored for future access. On the tenant front, create and save individual files that include all leases, rental payment ledgers, rent increase notices and lease expirations. It’s also important to create and save a written log of all tenant communications over phone, email and text messaging. 2. Know Laws & Key Dates California landlords must stay abreast of a dizzying array of laws and regulations at the federal, state and local levels. To keep pace, it is recommended that owners routinely educate themselves on basic landlord-tenant laws and fair housing guidelines. The AAOC provides a great service to its members in this area, including best practices for maintaining compliance. Additionally, it’s advisable that an owner create a trusted relationship

with a lawyer before any legal issues arise. By hiring a qualified legal professional, an owner can rest easier knowing that potentially complicated legal liabilities can be quickly resolved. 3. Embrace Technology Technology tools for apartment owners have greatly improved over the past several years. Online payment, screening, advertising, maintenance, resident communication and document storage now allow real-time owner visibility into property operations. These tools also allow tenants to easily engage with owners and create a more streamlined resident experience. There are several full-suite property management software providers including Buildium, AppFolio Property Manager and Yardi Breeze. 4. Proactive Maintenance & Inspections Keeping tenants happy and containing maintenance costs are both key ingredients of successful property management. For starters, performance of regular property maintenance and interior inspections insure that property and resident needs are addressed quickly and satisfactorily. Focus areas should include roofs and gutters, common area landscaping and lighting, interior smoke detectors, HVAC and plumbing systems. A basic maintenance and interior inspection checklist is also invaluable

An example he provided was the traditional property tour for prospective residents, and how now we should be look to virtual tours of properties and vacant units via Zoom, 3D renderings, or other platforms. He also recommended that rental property owners and operators work with tenants on a case-bycase basis to address their specific needs and situations. Marco Vartanian then offered guidance related to onsite operation and management issues, including recommending the temporary closure of all common areas, such as pools, gyms and playgrounds, to ensure everyone’s safety and health. He also addressed the increase in maintenance calls that many landlords are receiving, the result of more people staying in their homes, but emphasized that only the most

essential service requests should be performed. Protecting your staff and your residents should be our highest priority at this time. Vartanian also reinforced Gorman’s sentiment regarding working with tenants but pointed out that being fair and respectful will go far in the long run. He also recommended that full and complete documentation be kept of all conversations and transactions, including partial rent payments. Stephen Duringer, the final presenter of the evening, provide very informative remarks and indicated that we are coming out of a “stop sign/red light zone” which should gradually lift, with courts re-opening shortly and trials beginning the middle of June. However, courts will be faced with a backload of cases dating back to before the COVID-19 shut down began. He reminded members that after the governor lifts the current statewide eviction moratorium, there is a 90-day period for landlords/ managers to start collecting on any

Leading Through Crisis: How to Treat Your Employees While Navigating a Pandemic BY STEPHANIE ANDERSON

t can be said that it’s not organizations that deliver customer experiences, it’s the people who work for and represent the organization who do. If salary, benefits and professional opportunities are largely equal from one organization to the next, employee experience is what truly separates a company and ultimately determines its ability to effectively attract and retain top talent. How an organization treats its workforce is mirrored in how those employees treat the customers. In that regard, employee experience is critical to the bottom line and an organization’s ability to remain profitable far into the future. It is fair to assume how employees are treated has tangible effects on the viability of an organization. In these times of uncertainty, how employees are treated will be remembered for years to come. How a business chooses to respond amid a global health crisis will have a lasting impact on employee behavior, including engagement, productivity and loyalty. For employees, health and well-being, financial stability and job security are top concerns at present and employers can help address those fears in meaningful ways. A Crisis Management Strategy should place an emphasis on the employees and the work environment that has been cultivated. Six key areas of focus are included below as a starting basis for consideration and implementation.

1. Prioritize employee well-being. Start or promote a company wellness program, communicate availability of employee assistance programs, revamp policies on paid time off (PTO), encourage flexible work options and offer mental health support. For employees to take care of their residents and co-workers, they must first take proper care of themselves. Remember that some employees will not feel comfortable asking for help, so consistent communication encouraging use of resources pertaining to health and overall well-being is key. 2. Communicate, and then overcommunicate. There is a direct need to address the COVID-19 pandemic as it relates to employees and their concerns around their current situations. Leaders will need to be completely transparent about job security, financial challenges and what lies ahead for the company and its employees. Overcommunicating will assist with eliminating any assumptions or conjecture while also minimizing unnecessary stress and frustration throughout this difficult time. 3. Safeguard employees. Employee safety should be a top priority. Provide updated hygienic and safety policies for your workplace, as well as make available personal protective equipment (PPE) and require all employees to complete

training on proper use, removal and disposal. Discuss CDC guidelines for cleaning protocols and embrace these guidelines as a company standard. Understand that some employees will be hesitant to return to the workplace given the current situation, and empathy is important during the transition. 4. Give sincere thanks. Onsite team members are real heroes and should be treated as such. Use recognition to reinforce the contributions essential employees are making. A handwritten card, gift card, phone call and complimentary lunch are all easy ways to express gratitude. Additionally, announcements to all staff about these employees’ aboveand-beyond contributions can be made on a daily, weekly or monthly basis. 5. Provide flexibility. Offering flexible schedules and work-from-home options can assist those employees experiencing childcare issues or those who are high risk or reside with someone who is. It is important to stay ahead of this challenge by constructing a policy to assist employees through the consideration of flexible options that can be offered to affected employees and how to determine consistency and fairness on a case-by-case basis. It’s a challenging time for everyone, but the most important thing for companies to do right now is to take care of their employees. Remember that this is not a one-size-fits-all approach. Just as a crisis brings uncertainty and challenges, it can also be a time of opportunity and positive change.

If entry into a unit is necessary, allow for extra time to notify residents and be ready for the expense of extra cleanup or sanitation. If an apartment needs to be re-rented, consider creating a virtual tour and use that as the primary means of promoting the residence. Not only does this method of marketing reduce personal contact, it saves time. And, it enables prospective residents to do some prequalifying of their own.

The technology for virtual tours and other forms of interaction will continue to be woven into how we do business going forward. Smart owners will find ways to use this technology not only to keep residents safe, but to reduce expenses while providing an even higher level of service. Keeping current with changes in guidelines, regulations and laws is more critical than ever. With so much happening on so many different levels of government, it is vitally important to keep current and informed. As we are often told: “Ignorance is no excuse to break the law.” This means following not only what is happening with landlord/tenant laws, but also what we need to be doing and telling our employees, vendors and residents. Now is also the time to evaluate your personal financial situation and, most critically, the returns on your rental properties. Along with tracking your cash flow, you need to project what you expect may or may not happen in terms of collecting future rents and meeting the costs of repairs. You need to know your breakeven point, reserves and potential cash flow issues. Start conversations now with lenders if you foresee a potential problem. If you have not already done so, you may also want to take stock of your personal priorities. Maybe you are no longer driven by the need to self-manage your own properties. Or, perhaps your focus has shifted to accomplishing a few of those bucket list items or spending more time with family members and friends. Changes in priorities may additionally require an overall financial assessment and a review of your rental property portfolio. What return are you getting on your properties? What role is each property playing in helping you achieve your goals? Is that property still performing up to expectations? If not, why not? And, if your priorities have changed, what are your new needs and what steps should you take to enable you to achieve your new goals?

This is a transformative period out of which undoubtedly will come change. Exactly when and how that occurs — both on a personal, micro level as well as on a macro level is still to be determined. In the meantime, we need to do the best that we can and look for ways to make positive adaptations. Take the time to listen, try to understand other’s concerns, and then do what you can to help and realize that every situation will be different.
