EXECUTIVE DIRECTOR’S MESSAGE
Get Ready. In-Person Events Return this Summer!
E
arlier this spring, an email survey was sent out to gauge AAOC members’ readiness to return to in-person events. Nearly 80 percent of the respondents said they would be comfortable doing so this year, and 42 percent of those respondents were ready to get back together immediately! The survey also reflected a strong preference for resuming in-person General Membership Meetings and education classes but that they continue to offer a live-streaming option. These responses were not surprising. In fact, they confirmed my belief that AAOC members would be ready to get back to face-to-face gatherings as soon as possible, but that they would also want to see AAOC continue presenting certain events online. It really is a “best of both worlds” situation for our members — near and far. During the past year, a number of AAOC members who no longer live in California, but who continue to own rental property here, have found themselves able to once again attend meetings and education classes thanks to these programs being presented online. In so doing, they have been able to receive more timely updates and engage remotely with our presenters on the legal, regulatory, and operational issues that still affect them and their business operations, even if they live hundreds or even thousands of miles away. So, where is AAOC headed during the second half of 2021? Well, I am pleased to announce that we are resuming in-

person events this month, starting with our Multifamily Mingle networking event on June 24th, followed by our Summer Cruise on August 12th, and then the AAOC Trade Show & Conference on September 30th. In between we will be testing out our hybrid model for presenting certain classes back in the AAOC office conference room while also live-streaming them on Zoom. This is also our plan for the General Membership Meetings when they resume in September, with limited inperson seating in the conference room and then the live-streaming option for everyone else. More details to come in the August issue of Apartment News. In the meantime, here is some additional information about the upcoming, in-person events that are already lined up for our members this summer.
Multifamily Mingle (June 24)
AAOC will present its first in-person event of the year on Thursday, June 24th, as its Multifamily Mingle comes to Hangar 24 in Irvine from 5:30–8 p.m. This free industry networking event is open to all multifamily professionals and we expect attendance to exceed 150 guests. It’s been 16 months since the mingle was last presented and there are a lot of local rental property owners, operators, and suppliers who are eager to reconnect with friends and colleagues as well as meet others for the first time. State Legislative “Solutions” Complicate California’s COVID-19 Recovery

s we continue to advocate for legislation in the State Capitol that will protect the interests of rental property owners and managers, we have faced an incredibly challenging year. Here are some of the successes we

have had stopping legislation that was proposed this year: AB 854 (Lee) — A bill that would prohibit property owners to withdraw their rental units unless they have owned the property for five and, under certain conditions, 10 continuous years. AAOC opposed this bill because: • Within the past 13 months, many property owners have not collected rent due to COVID-19, yet they were forced to remain in business with no income deriving from many tenants Those owners found that the non-payment of rent was not financially sustainable. Owners faced and are continuing to face mortgage default and inability to pay to maintain the property. Many owners and tenants are not benefiting from federal stimulus money, particularly all renters that are earning more than 80 percent of the area median income and all owners that are renting to those households. • The bill disincentivizes multiple property owners from improving and maintaining their property even though those property owners are liable under the implied warranty of habitability. Taking into consideration these past 13 months of rent forbearance, several maintenance and repairs have arisen, and many owners have not been able to comply with the law. Furthermore, improvements to a building usually

improve living conditions for tenants so it has a domino effect. Landlords legally are still forced to abide by the implied warranty of habitability. Repairing an air conditioning unit may be the only practical way versus upgrading the overall central energy efficient AC system for the whole building, which could have been a much better solution. • The bill’s prohibition of limiting one rental unit to be occupied by one owner can make it more burdensome, if not impossible, for property owners to stay afloat, purchase, finance, re-finance, occupy, and sell, especially in current times of COVID-19. Moreover, with the requirement of having the owner being forced to keep the property for a period of 5 years, it will prohibit owners from lawfully occupying their own property for an unreasonable period. Additionally, AB 854 would prohibit owners from allowing their children, parents, and grandparents from occupying the property for half a decade. We argued that we did not understand why an owner is barred from allowing their convalescing parent from living in the owner’s property during this time period. Parents may not be able to live or wait five years. • There have been several other measures the legislature has considered that are similar to AB 854. Former Sacramento — continued on page 8

Sacramento — continued from 6 Senator Mark Leno carried a similar bill (SB 364) just a few years ago. He proposed to limit the application of his bill to San Francisco. He argued that property owners removed just 300 rental units in the City while at the same time, thousands of new rental units were being constructed. Research showed that the units that were removed were owned by small owners. Those owners found that San Francisco’s laws were simply too burdensome and costly to remain in the rental housing business. • AB 854 will affect all cities and counties. Unfortunately, we are not aware of a need to adopt a law of this nature throughout our state. • The bill will result in corporate America owning rental housing. Small property owners will soon become an extinct class in our state. Small property owners will not be able to wait 5 consecutive years. Children who are heirs to their parents’ rental units will even have to wait 5 consecutive years.
AB 1199 (Gipson) — Massive tax on rental housing owners
AB 1199 proposes to impose an annual excise tax upon rental housing owners who: 1) own 10 or more properties that are single-family dwellings; or 2) own 25 or more properties that
are either single-family or multifamily dwellings. The tax rate would be 25 percent of the gross receipts of the rental housing owner that are derived from rental income. The bill effectively diminishes the state’s constricted housing stock. Unquestionably, this even further exacerbates the current and future housing crisis. Thankfully, the bill was not heard this year. It could, however, be heard next year. This is an extremely dangerous measure.
AB 255 — Rent relief; Commercial rental property unlawful detainers
On top of the many other relief measures taken to address financial difficulties for commercial and residential tenants and the American population, this bill aims to provide even further rent relief to commercial tenants by making it nearly impossible for commercial rental property owners to engage in an unlawful detainer without even knowing with certainty whether the relief measures received by the tenant were used for its intended purpose. Among the reasons to oppose AB 255: • In light of Governor Newsom’s proposal made on May 13, 2021 to set aside “$1.5 billion to a program providing grants up to $25,000 to small businesses harmed by the COVID-19 pandemic in California, allowing thousands more to get financial help,” there is no need for this bill because this is the appropriate remedy. It balances the
interests of both parties by making small business owners whole and the commercial rental property owners not even think about matters related to collection of rent and the sustainability of the business interests of both the rental property owner and the commercial tenant. • Governor Newsom made a proposal on May 10, 2021 projecting, “a $75.7 billion budget surplus” to be used as part of an economic recovery plan for millions more Californians and additional relief for renters. The plan would provide the greatest state tax rebate in American history amounting to nearly $12 billion in total for stimulus checks. Twothirds of Californians who make up to $75,000 annually will benefit from $600 direct stimulus payments — this also includes families with dependents and undocumented residents who will be eligible for an additional $500. This plan “triples California’s previous investment… sending payments to residents who didn’t get a check in the first round.” The governor also proposed to double rental assistance in the state by putting $5.2 billion to help low-income Californians directly impacted by the pandemic pay back 100% of their rent back. “California is not just back. California is roaring back,” said Governor Newsom after making the proposal.

• Senate Budget Chair and State Senator Nancy Skinner commented the following on the governor’s proposal, “because of California’s very progressive tax structure, and because most of our revenue comes from the wealthiest…we have money. Now, unlike other states, we are using that money to support the many Californians who’ve been hurt. We are in a position now to be able to provide more.” So, what more is needed? These efforts all indicate that the state has more than enough, if not a surplus of remedies, that address precisely what AB 255 is trying to achieve, and it is doing so by focusing on re-employing Americans and Californians, which is the appropriate action, not the drastic measures taken by AB 255. • There is no proof the remedy in AB 255 is needed due to the recourses taken by the President and Congress. The economy is coming back quickly and there is no proof that such extreme measures set out in this bill are necessary. – According to the Wall Street Journal, the federal government recently announced that there were over 8.1 million jobs opening the largest number of jobs in the last 21 years. There is no question that many of these job openings are from small businesses. Small businesses yearn to reopen and operate. This shows that small business owners want to restore employees and want to pay their property owners and other financial obligations they have. Unfortunately, this bill is not recognizing the desperate need to re-employ America.

potential tenant’s use due to decreased funds. As you can see, there is an insurmountable domino effect, that will not only deprive commercial rental property owners, but other tenants, who are ready to start a new business.

These packages have included forgivable loans, direct payments, tax credits, grants, expanded unemployment benefits and more.” • It is unclear what “hardship” really means for commercial tenants within the context of AB 255 when there have been all these COVID-19 relief measures stated above. • This bill will result in a drastic domino effect. If a commercial property owner does not receive revenue, they cannot pay their loans and their property may be taken away. The eviction process is already a lengthy process. With the new requirements of this bill, it will make it take even longer, which deprives the commercial property owners of rent whom, unlike the tenants, do not have the available relief measures stated above. This, in turn, makes commercial property owners unable to pay their loans to maintain their property in the first place. The lengthier unlawful detainer process, as well as the decrease in revenue for the property owner, also increases the waiting time if the owner is to re-let the premises to another potential tenant and makes it even harder for the property owners to look for a tenant if they cannot improve the premises for the
• As discussed above, President Biden, Congress, and Governor Newsom have taken the approach of helping the employee or former employee to get them back to work and not the draconian and potentially litigious method stated in AB 255. The civil courts have been closed for well over a year because of COVID-19. When the courts are re-opened, they are going to bleed heavily trying to figure out how to open the civil side of litigation and we do not need any more potential litigation that is easily addressed already through current and upcoming relief measures. • This bill will hurt the economy, rather than make it prosper, because it has potential long-term effects on new commercial centers. If potential commercial property owners know there is a precedent here for making it very difficult to obtain an unlawful detainer on commercial tenants, then they will take their business elsewhere, to another state or maybe even another country. This is something that in the current American Economy we just cannot afford. • AB 255 intends to create relief for commercial tenants without any evidence that it is going to help achieve anything and overlooks the surplus of already available aid to commercial tenants and small business owners. • In the government’s efforts to open America again, apart from the surplus of governmental aid to small businesses, the CDC has issued multiple guidelines including as to when people do not need to be

masked. Furthermore, the health director is taking action to remove social distancing requirements because, after all, we are trying to reach herd immunity. • All the above points are evidence of an entirely different approach that what is proposed by AB 255. The approach to restore our economy should be a joint effort and not the one-sided approach taken up by AB 255. This is a time for all Americans to work together. We asked the Legislature: Why is this bill needed when all of these other relief efforts are already present and under way, and more importantly do not encourage further separation amongst California small business owners and commercial property owners to restore the California economy? On a positive note, expect additional legislation to follow SB 91, the Emergency Rental Assistance Relief (ERAP) program. This will be clearly defined and acted on by the Legislature this month. We will keep you informed as to the material changes that will occur. At the heart of the ERAP program is paying back due unpaid rent during COVID-19 which. as of the date of this article, is struggling. We have presented doable solutions for the state and local governments that oversee implementing ERAP. This includes establishing a presumption that the application is true and correct submitted by the property owner. The tenant under this circumstance would have 15 days to respond to the government and dispute the content of the owner’s application. Should a tenant fail to respond during this time, the government would be required to proceed to process the application for rent relief. Political Chatter Heats Up this Summer
O
ver the summer of 2021, the local political activists will have two issues keeping the political gossip churning: 1) When will the date be set for the Governor Newsom recall election; and 2) When will the California State Redistricting Commission release the first draft of the new district maps for the 2022 elections? The recall campaign effort against Governor Gavin Newsom started in Orange County and is headquartered in Newport Beach. Some say the

beaches in Newport Beach were closed in 2020 as political punishment by the governor. It is no secret that Newsom does not hold Orange County in high regard, and it was one of the last counties in the state to be allowed out of the governor’s color-coded shutdown tiers in May of this year. The fundraising effort to collect recall petition signatures has been headquartered in Newport Beach since 2020. The California Recall Election laws were altered by the Democrats in Sacramento in 2017. The recall system is slightly different than when Gray Davis was recalled from office and Arnold Schwarzenegger was elected governor in 2003. Now, the California Secretary of State and the State Legislature have much more leeway as to when the actual election date is set, which will probably be sometime between August and November of this year. Regarding the state redistricting process, we know that California will definitely lose one Congressional seat when the new legislative maps are drawn at the end of 2021. The question is when will the draft maps be ready for public inspection and comment? The new census numbers will probably be delivered to California at the end of August, and it’s anybody’s guess as to how long the California Redistricting Commission will take to draw the maps. The tentative schedule is to have the public drafts of the statewide district maps completed by the second week in December, but it depends on the timing of the full census block

numbers arriving in California. There are rumors around Sacramento that the June 2022 Primary Election may be pushed further back into the summer if the maps cannot be completed by the beginning of 2022. Local political fundraisers are back, with in-person events quickly returning, and Orange County political activists will again be able to exchange information face-to-face. This will bring the political gossip back to a more normal, fevered pitch. It will be a long summer of political prognostication and handicapping, and that’s how it should be, instead of the stilted zoom calls we’ve endured over the past 15 months. AAOC has remained on top of the current antirental housing industry legislation making its way through State Legislature, but it will made easier to monitor once the Capitol Building reopens and the staff is back in their offices. No matter when the date of the Recall Election is set, the ripple-effect has already been helpful in moderating many of the governor’s actions this year. The continued speculation regarding the final redistricting maps has also had a moderating effect on some of the more radical anti-rental housing industry legislation in Sacramento. The elected officials know there is every possibility they may be drawn into the same district as one of their current, fellow elected officials, so they don’t want to be painted as “the radical.” The churning political gossip on these two issues will be front and center all summer.

caulking is dry.” Well, it doesn’t work and by the time you are driving away from the building, your resident is already taking a shower and your fresh caulking is washing down the drain. Your caulk should cure at least 24 hours before use. Water-based latex caulking is easy to use, but very susceptible to water until it is cured. Try using a silicone or polyurethane based caulking for doing tubs, showers, toilets, sinks or other wet locations. It tends to set quickly and will repel water during its cure time. Another solution we have found works well with very busy showers is to remove all the fixtures, including the showerhead & arm, valve handles and tub spout, before caulking. It’s a bit extreme, but effective. We then plug the showerhead and tub spout with a capped pipe, then caulk the tub/shower. We then come back 24 hours later and reinstall all the fixtures.

One more thought. If you have sliding shower doors for your tub, check the bottom track. If it is loose, do not caulk until the track is removed, cleaned and dried. Reinstall the track with new adhesive caulk to hold it down and caulk the edges to keep the water out.

My apartment building was built in the 1950s and has no insulation in the walls or ceiling. What do you recommend as the most cost-effective method of insulating the building? Sam
Dear Sam,
It is very common for older buildings to have no insulation whatsoever. As for where the best bang for your buck is concerned, ceiling insulation is the winner. For single story or top story units, ceiling insulation is very easy and inexpensive to install. Wall insulation is much harder and involves a more invasive approach. To illustrate the differences, ceiling insulation can be either batt insulation or loose fill insulation. The batt method is a bit more labor intensive and is less effective than loose fill. If you decide to use loose fill, be careful not to block ventilation holes or cover any through the ceiling light fixtures. Insulating existing walls typically involves drilling holes just below any fire blocks and blowing loose fill insulation into the wall cavity. Dear Robert:
It does seem bathrooms are sometimes designed as an afterthought. Sink, toilet, bath and that is it. A modern bathroom
will take into consideration the need for storage, electrical devices, personal hygiene, etc. The first item that comes to mind is installing a bath sink cabinet. An old-style cabinet might only have a set of doors under the sink. We find this is not adequate and a cabinet should have drawers along with access to under the sink. The drawers can store hair dryers and all manner of personal items. A unique system we like utilizes the space between the studs in the wall. Cabinet doors or mirrors can be used to cover storage in the walls. The wall storage is perfect for toilet paper, rolled up towels, toothbrushes, and most other small items. Install multiple towel racks on the back of the bathroom door for additional towel storage. The space above the toilet can easily accommodate an overhead cabinet for larger items. Reversing the swing of the bathroom door from inward to outward will greatly increase the usable room and make the bathroom appear larger. May General Membership Meeting Recap
D
isruptive residents, parking issues, loud parties, barking dogs, and recreational marijuana are just a few of the headachecausing issues that rental housing providers deal with on an all too frequent basis. The Apartment Association of Orange County’s (AAOC) General Membership Meeting on May 18 focused on “Finding Relief for Your Property Management Headaches” and addressed these and other property management issues, offering insight into possible solutions through the implementation of best practices and policies. Contributing to the discussion was a knowledgeable panel of seasoned multifamily industry professionals, comprised of Michael Brown, CPM, Director of Property Operations for
Advanced Management Company; and Ashley Godlewski and Kalie Mason, Regional Supervisors with Sullivan Property Management. Ashley Godlewski started the discussion with the “hot button” issue of service and emotional support animals. She emphasized the need to have set policies and procedures in place, and recommended implementing the “reasonable accommodation“ form available through AAOC. She also touched on the challenge of maintenance staff gaining entry into units when residents are refusing, stressing the importance of consistent communication, whether in-person or via email or text, and being readily available to answer any questions. Kalie Mason then addressed the issue of domestic disputes and related

disturbances, the importance of preparing complete and detailed incident reports, and that managers and owners should feel comfortable seeking legal counsel when these situations arise. Mason also touched upon the issue of children playing in public spaces and the potential safety risks it can pose. She suggested that “house rules and regulations” be distributed to all residents but not pinpoint any specific troublemakers or sources of disturbance. She also proposed a possible solution of keeping children’s activities in one designated area of the community. Finally, Michael Brown steered the discussion to an issue that many AAOC members have had to deal with — Meeting Recap — continued on page 20

Meeting Recap — continued from 18 collecting rent during the pandemic. He stressed the importance of being timely in issuing necessary paymentrelated paperwork and keeping detailed documentation. Brown is a big believer in trying to build strong relationships with residents and is a proponent of consistent communication, even expressing his belief that there is nothing wrong with overly communicating. In general, Brown has also seen an increase in the number of work orders during the pandemic, largely the result of residents spending more time at home, as well as an increase in reported theft, particularly catalytic convertors being stolen from automobiles. In this regard, Brown has sent out notices to residents on how to be more diligent in protecting their property. He shared that his company has installed Ring doorbells for enhanced security, and to address the increase in work orders an
ample inventory of appliances and parts is now maintained, to always be “at the ready.” Program moderator David Cordero then transitioned the panel to a discussion of other issues that typically cause headaches for rental housing providers. Starting with marijuana, the panel shared how some of their communities have adopted strong “no smoking” policies which has helped curtail its use, while in other communities they have suggested to their residents that there are other ways to enjoy the effects of marijuana without having to smoke it. Security was then discussed at length. All pointed out that residential theft has declined during the COVID19 pandemic due to more residents being at home, with Mason adding the pandemic has brought together a closer community, with people watching out for each other. The panel then shared their thoughts on comfort and emotional support animals. There was agreement

that fraudulent “emotional support animal” documentation can be easily secured on-line, and again it was recommended that using the reasonable accommodation forms from AAOC can help you stay consistent and compliant with Fair Housing laws. The topic then shifted to the issue of residents who fail to clean up after their pets on premises. Godlewski said she is not afraid to directly confront residents to do the right thing. Brown then mentioned a dog DNA registry that he is aware of that can process evidence and pinpoint the canine culprit, and that he believes in assessing fines for pet owners who commit such offenses. The reoccurring theme throughout the program was the critical importance of communication between rental housing providers and their residents, and that was how the panelists closed out the evening, in agreement that continual and consistent communication is of paramount importance, and that it is key to helping alleviate rental housing headaches. What’s the Right Legacy? Taking Time for a Family Talk
J
une marks not only the halfway point in the year and the official start of summer, but also a favorite familytime event — Father’s Day. For many of us, the fact that we can share this occasion in person makes this traditional celebration all that more special. We’re all coming out of a stressful, difficult period in our lives. This is true in both a personal and a business sense. Not surprisingly, for many of us, goals and priorities have shifted. When the planning begins for that family gathering on Sunday, June 20, give some thought to asking for a little time to sit down and talk seriously about new desires and hopes for the future. Many rental property owners have held onto their properties because they see this as their legacy. But with all that has happened over the past 18 or more months, is this still the right course of action? Last month, my article focused on taking a spring cleaning approach to each of your properties and making an honest appraisal of what needs to be done. The suggestion was to do a property walk and categorize to-do items as to repair, replace or refresh. Then, the task was to obtain some up-to-date cost estimates and look at what might or might not be the priorities. The last step in this process was to analyze the ROI (return on investment) of implementing any of the repair/ replacement/refresh items under consideration. This latter step required putting on your “investor hat” and taking more of a big picture look at the pur-

pose the property serves within your real estate portfolio as well as the longterm reasons for holding the property. A good number of apartment owners began purchasing rental properties thirty or forty years ago as a wealthbuilding tool and means of achieving financial independence. Over the years, those same investors often served as their own managers and, in many instances, handled their own repairs and make-readies. However, is this hands-on management still practical? A lot has changed during the last couple of years. Rent control not only established limitations on how much rents could be raised but also introduced new levels of complexity in management and planning. Then, the pandemic struck and even as restrictions have eased, the way that all of us conduct business has been transformed with online interactions that require certain technical skills and expertise. Making profitable ownership even more difficult are the skyrocketing costs for materials and replacement items, along with challenge of finding qualified professionals who are both reasonably priced and available. So the question now becomes, where do you go from here? Is selfmanagement still the right path — not just for yourself, but also for your heirs? First, perhaps, it is time to do some sharing and listening. You’ve had your own challenges that have probably reshaped your thinking about what you want to do over the years ahead. everyone else, you are probably ready to do some travelling. Your heirs have likely had their own epiphanies. Three Strategies to Increase Your Rental Property Cash Flow

or many small-to-midsized apartment owners, rent collections are requiring more effort, expenses are rising and many of the traditional methods of maintaining rental income are off-limits due to governmental restrictions. Although maximizing a rental property’s cashflow is a priority in normal times, it is even more important, post-COVID, where every dollar counts. The following three strategies can help maximize your property cashflow and improve your bottom line.
Interior and Common Area Upgrades
The most common way to increase property cashflow is through property renovations which lead to higher achieved rents. With more residents working from home, upgraded interiors are in very high-demand — the result is lower vacancy downtime and increased rents. Maximizing value is about selecting the best roofing contractor, who uses 1st quality materials with certified workmanship, all at an affordable price. Too often, property owners and managers fall victim to letting their guard down. Many roofing salesmen hope you skip the background check and make a knee-jerk decision to get a “deal.” Then, you’re unfortunately stuck with a problematic and leaky roof for years to come... At the same time, you’re busy managing your business and your personal life. You shouldn’t have to spend hours and hours getting “second” opinion after second opinion, and the good news is: you don’t have to. How to Verify Your Roofer is Qualified
The roofing industry is approaching $20 billion with almost 200,000 contractors. THAT’S big business. Unfortunately, they aren’t all reputable, and many customers get taken advantage of. To protect yourself, you first need to ensure your contractor is: • Licensed with a “C-39 Roofing Speciality” license from the California Contractors State License Board (CSLB) • Bonded with the CSLB • Insured with workers’ compensation insurance and at least a 1M General Liability policy • Reputable with a long list of referrals and proven pedigree Licensed — You should NEVER use an unlicensed contractor, and especially not for your roof. When you’re in your home or office building, you’re standing between gravity and the elements, and you don’t want to take a chance by letting your roofer cut corners. Once you identify a roofing con-

tractor that you’re interested in, the first thing you should do is contact the Contractors State License Board at www.cslb.ca.gov or at (800) 321-CSLB (2752) to ensure they have a valid license that’s been active for at least 20 years. After all, how can you believe a contractor with a 2-year-old license giving a 15-year guarantee? Bonded — While you might have a special bond with your Golden Retriever, California requires a different type of bond with all of its contractors. A Surety Bond is a contract between a roofing business, the licensing authority, and a “Surety Company” (think insurance company) that financially guarantees that the contractor does what they say they will. Why should you care? This benefits consumers (you) financially in the event of defective construction, legal violations, and other violations made by a bad contractor. You can view the CLSB bonding requirements on their website, and it’s vital (and legally required) that your contractor has one in place to protect you. Insured — Accidents happen, and you need to be certain that you are protected from the risks of personal injury and damage to your property. Any contractor that doesn’t have all of this information readily available has something to hide, and you should look elsewhere for your roofing needs. right? WRONG With so much to consider about your roofer, you can’t forget to make sure they’re using the right materials. No matter if it’s a new roof, re-roof, leak repair, or just regular maintenance, you need to ensure your roofer is using the highest quality of materials possible.
“But how can I tell good materials from bad? I’m not a roofer!”
Step #1 is to make sure the brand of shingles, tiles, or rolled roofing is from a manufacturer with a household name like CertainTeed Corporation, Owens Corning, or GAF Materials. Largescale, experienced suppliers have been in business for decades because their products perform well, and they’re experts in quality control. That said, not all finished materials are equal. Instead of wasting food, they may combine ingredients into a “special” soup of the day to limit waste. Manufacturers don’t want to waste either, so they sell flawed inventory at a discount. This is fine as long as your contractor isn’t buying them for your roof. Unlike the comparison above, your roofing materials must be perfect because you have to live with it for decades! But how do you tell good materials from bad? There are four grades for roofing materials: • 1st Quality • 2nd Quality (known as “2nds”) • 3rd Quality (known as “3rds”) • Reject Quality Manufacturers have a variety of reasons for downgrading the quality rating of what they’re producing. Errors can be related to poor reinforcement, a lack of proper asphalt content, appearance, and poor granule bonding, among other factors. Each flaw dramatically affects waterproofing and life expectancy. Out of everything mentioned so far about getting the most value out of your roof, this is one tip you cannot
How do you spot the differences? Talk to your contractor and ask them to confirm they will only use 1st quality materials for your job. If you ask and they no longer make eye contact, or even worse, try to convince you that “2nds” are ok to use, it’s time to put their quote in the shredder and move on to a highly ethical roofing contractor. Contractors with high standards will be proud to talk to you about the excellent quality of their materials and point them out in their quote. First quality materials always come wrapped from the factory with detailed labels showing their logo and a barcode. If you see materials with blank brown or white labels — or even worse, just wrapped in plastic without a label — there’s a 99% chance your contractor is using 2nd quality materials. One usual dead giveaway is the price. If you get a few quotes to compare and see one that is 15–50% or more below the others, they’re likely using 2nd quality materials. At the same time, a bid price in the same ballpark as others does not always mean good quality. Sadly, some roofers are bold enough to use cheap materials and charge you full price. Why Pessimism Pays in Risk Analysis
T
he best way to prepare for disaster is to ask, “What’s the worst thing that could happen?” When it comes to earthquakes, that means assessing damage from past experiences, identifying near-misses or “thank goodness that didn’t happen” scenarios, and searching out the best ways to counteract those possibilities before they strike. Gordon Woo, a theoretical physicist and resident catastrophist at Risk Management Solutions, took this concept and coined it “downward counterfactual analysis.” The goal in this approach is to develop foresight by studying events that could have turned out much worse. “It’s
not that you’ll know when something will happen; you just know that something is a possibility,” he told the seismic hazard modeling company Temblor. Catastrophe risk modeling began in the 1980s with the advent of affordable computers and has since grown in size and sophistication, Woo wrote in Frontiers in Earth Science in 1999. In the paper, he cites an EgyptAir pilot’s deliberate 1997 crash into the Atlantic as an example of this sort of planning. Had analysis been done to determine worst-case scenarios from that event, (the pilot flew out of JFK airport), the possibility of a plane crashing into a populated area of Manhattan might have emerged as a possibility two years before 9/11 happened, Woo said.

And the hillside communities of Laguna Beach, San Clemente and Santiago Canyon are prone to landslides that can be triggered in a major earthquake, potentially undermining the foundation of a home, or sliding into one. Liquefaction areas can be found throughout the county, most notably wherever water flows either above or below the ground such as the aquiferrich region of central and coastal Orange County, Garden Grove, Santa Ana, Irvine, Huntington Beach, and Yorba Linda, to name a few.
