How Section 8 Housing Fits In
H
ow big of a deal economically is section 8 housing to Orange County? At present the program sends over $200 million per year to OC landlords, which is not chopped liver. About 20,500 rental units participate, perhaps impacting roughly 5% of rentals in the county. So called “section 8” rentals, refers to residential rental units where the US Department of Housing and Urban Development (HUD), subsidizes the tenant’s rent payment (the term “section 8” ties to the HUD regs). The program is administered for HUD at the local level by “public housing agencies”. In OC there are four: three cities, Anaheim, Garden Grove and Santa Ana, plus the county of Orange (which also admins for thirty-one cities). The purpose of the program is to assist very low-income families, the elderly and the disabled to afford decent, safe and sanitary housing in the private sector. Tenant income can be no greater than 50% of median income for the area, and 75% of participants must be at or below 30% of median income. According to the Orange County Housing Authority Fact Sheet, the average annual income for recipients of section 8 assistance ranges from $14,524 to $18,923. When recipients of the subsidy are approved under the program they are issued a “housing voucher”. A family 4

tenant’s verified income as the tenant’s share of rent. The remainder is paid by the local housing authority. Local housing agencies determine a “payment standard” — the amount generally needed to rent a moderately priced dwelling unit in the local housing market. This benchmark governs how much subsidy the housing authority will contribute. The housing authority also conducts a “rent reasonable” test before approving the rent amount negotiated between landlord and tenant. “The test includes gathering three rent comparables”, explains John Hambuch, manager of the Orange County Housing Authority. “Sometimes comps can be units in the same owner’s building. Staff also makes phone calls, knocks on doors, and uses the internet to find comps” (sound familiar?). The economics have worked well for Ehle’s properties. He indicates that his section 8 units have always achieved “at least market rent”. Yes, there is some red tape, he acknowledges, but the overall experience working with local housing authorities has been good. A couple of heads ups to apartment owners: Notice to terminate a section 8 tenancy is 90 days and sometimes there is a wait time on inspections for new tenants. The program is in such high demand among renters that the waiting
or individual with a voucher is responsible for finding suitable housing where the owner agrees to rent under the program. Danny Huynh, manager of the Garden Grove housing authority, advises that his city pays on average about 70% of the rent the landlord receives, while the tenant covers the other 30%. In Garden Grove the program typically pays between $900 to $1,000 per month per section 8 unit. “I like the program,” says AAOC member, Jerry Ehle, who owns thirty units in OC and has consistently had section 8 tenancies the past twelve years. “About half my units are section 8”, he advises. Among other positives, investor Ehle appreciates the fact that section 8 tenants “tend to stay in place longer”. The section 8 “Housing Assistance Payment Contract” that landlords must sign requires initial and then annual inspections by the housing authority. Ehle considers the inspections a positive because (1) they’re free and (2) they’re thorough. On one recent inspection a non-working oven was discovered. Turned out the resident, a bachelor, never cooked and had never attempted to turn on his oven. Ehle was grateful to be advised about the broken oven issue and immediately repaired it (no word on whether it’s been used yet). joined the chorus of elected leaders who are speaking out and announcing their communities stand behind Proposition 13. For some time now, Proposition 13 has been under attack by a group of tax activists based in San Francisco. They want to divide, conquer and ultimately overturn the state’s landmark taxpayer protection. It’s nice to see our local property rights leadership at City Halls here in Orange County rally.
They are in fact, landlords. I don’t have the numbers yet, but I learn anecdotally of more and more instances of people “just renting out the condo”. Perhaps this may be a “temporary phenomenon” of landlord status, or the beginning of a new professional opportunity for these newly minted landlords. But the fact remains that the Apartment Association of Orange County has all the services and resources to serve the needs of these individuals. We should seek them out, and welcome them in. As I have said in this column in past months: the Apartment Industry in Orange County is not small—over 545,000 apartment homes in Orange County…$38 billion in economic activity…an economic footprint that supports an estimated 950,000 jobs.
More Financing for Fourplexes U.S. Congressman Ed Royce of Fullerton introduced a bill that would provide relief for credit unions by lifting the member business lending cap for certain residential loans. Titled “The Credit Union Residential Loan Parity Act,” the law would treat loans financing the purchase of a 1–4 unit building as real estate loans rather than business loans, as they are currently treated by banking regulators.

s the calendar year reaches the halfway point the legislative year is just a little bit over the mid-year hump and nearing the finish line. May 30 marked the deadline for getting most bills out of their house of origin and moving on to their consideration by policy and fiscal committees in the second house. Too early to determine the fate of those that survived their first major vote, but most appear to have been treated as “works in progress” rather than finished products. Begging season in full flourish. With the likelihood of an on-time state budget being in place, the Legislature is on track for its July recess to be followed by a busy August session to conclude its work for this year. Not there yet, but just a few months shy of packing up and heading out for electioneering. A recap of dozens of bills of special interest will be forthcoming in the next

The bill has been substantially amended to limit its provisions to single family rental properties and contains other limitations helpful to landlords.
few months as their fate unfolds. One of them, certainly, will be Senate Bill 1439, roundly opposed by all viable property interests. It squeaked out of the State Senate on a 21–13 party line vote after an agonizing display of power politics that forged highly suspect promises of change. The bill stumbled on its first vote, 16–16, and was placed on call for another try hours later. The second attempt also faltered, 18–19, three votes short, and it was placed on the next day’s calendar for yet another try. It finally passed the Senate 21-13 and the exercise will be repeated in the Assembly in the weeks ahead. The entire Orange County and Riverside area delegation voted against this anti-landlord bill. Here are some of the other issues of interest mentioned in recent articles that remain of interest or concern to AAOC and its allies.

ownership information on alleged vacant property and listing the property ownership information with the district attorney or city attorney to seek law enforcement assistance in dealing with squatters. It passed the Assembly on an overwhelming 68–3 vote. • AB 1522 provides a process for mandating employer-paid sick days for employees who work in California 7 or more days in each calendar year; sick days to be accrued at a rate of one hour for each 30 days’ of employment and useable after 90 days of employment. The measure passed the Assembly on a 52–23 vote. • AB 2372 would modify existing law relating to transfer of ownership interests for property valuation (tax) purposes. The bill passed the Assembly on a 57–13 vote. • Senate Bill 935 would increase the minimum wage, on and after January 1, 2015, to not less than $11 per hour, on and after January 1, 2016, to not less than $12 per hour, and on and after January 1, 2017, to not less than $13 per hour. The bill would require the automatic adjustment of the minimum wage annually thereafter, to maintain employee purchasing power diminished by the rate of inflation during the previous year. The adjustment would be calculated using the California Consumer Price Index, as specified. The bill passed the Senate on a 21–12 vote. Assembly policy committee will very likely be reconsidered in the waning days of this legislative session. Senate Bill 750, is a bill intended to require installation of water meters or submeters in each unit of newly constructed multi-unit communities. The bill as introduced and as amended does much, much more, including extensive provisions relating to billing, inspection, repair, liability and a host of other significant problem areas of concern. AAOC and other interest groups are opposed to the bill unless these and other major issues of concern are appropriately addressed. Here is a short list of just a few of those items needing some resolution. • The proponents have inconsistently touted the measure as applying only to new construction, or new submeter installation, but the language in the bill would require massive retrofit of thousands existing structures having water submeters at astronomical costs of hundreds of thousands of dollars. This disconnect obviously needs to be straightened out.

• The bill requires that certain information regarding water costs be provided to a prospective tenant prior to executing a rental agreement. Timing of disclosure is an issue, and a building’s or prior tenant’s water use may or may not be relevant to a decision to rent. There are additional privacy issues with such disclosures. • The bill requires compliance with all laws regarding installation, operation and maintenance, including the retrofit requirements of Senate Bill 407 (2009), which has a delayed operative date to 2019 and independent enforcement provisions.

ardly ever rains here, but the recent sprinkles seemed to find their way in and have caused some roof leaks. Most of the leaks are minor, but there is a pretty big leak in one apartment. This is of great concern to me, because the roof is less than five years old, and has never leaked before. I even had it inspected prior to the rainy season by a competent roof inspector. The trouble is that the water leaked into one of my resident’s unit, and apparently caused a substantial amount of damage. The resident claimed that his stereo equipment, television, computer, furniture, and clothing were ruined. He even has pictures of the water dripping from the ceiling onto his stereo and television set. The resident is threatening to sue me if I don’t reimburse him for his losses.
he should have taken some measures to minimize the damage to his personal property. The fact that the resident had time to grab a camera and take pictures of the dripping water, while letting his television set, stereo and other belongings get soaked suggest the resident failed to mitigate his damages. In simple terms, the tenant should have moved his stuff, and grabbed a bucket, rather than watch it drip.
What should I do? Am I responsible for the residents’ personal property losses?
An owner is generally not liable for damage caused to the personal property of a tenant, absent negligence on the part of the owner or his agents. Provided a licensed and qualified roofing contractor performed the roof installation, you maintained the roof adequately, had it inspected on a regular basis, and were not on notice of any prior problems, you should not be responsible for damage to the residents’ personal property. Additionally, the tenant has an obligation to mitigate his damages when faced with a leaking roof. This basically means that if the leak was coming slowly through the roof, and the tenant knew about it, then

to pay rent or quit, the $1,200.00 or the $1,150.00?
Most courts would require that the three-day notice only demand the $1,150.00 because that is the amount that you agreed to accept of payment was made on or before the first of the month. Most courts would consider the additional $50.00 a penalty or a disguised late charge. The courts would reach this conclusion based on the terms of your agreement. If the due date, per the agreement, is the first, then the proper amount to demand is that amount that was required to be paid on the first, specifically the $1,150.00 rather than the $1,200.00. However, an incentive that encourages early payment, specifically payment before the first, would survive because the amount due on the first would be $1,200.00, but if paid prior to the first, only $1,150.00. In that specific case, a three day notice demanding $1,200.00, the amount due on the first, would be appropriate.
No, the security deposit remains with you as long as any of the roommates remains in possession of the rental unit. Absent a written agreement to the contrary, when all of the remaining roommates vacate, the refund check should be made payable to all four of the roommates. I have the misfortune of a classic problem tenant. The noise, the parties, and the trash…I don’t know where to begin. She’s paid her rent late for each of the past three months. The lease has a late fee provision, charging and additional $50.00 if the rent is not received by the 5th. She’s been paying both the rent and the late fee well into the second week of the month. Last month, the first of the month fell on a Saturday. So I served her a 3-Day Notice to Pay Rent or Quit on the 2nd, was that proper, or should I have waited until after the 5th of the month to serve the Notice?
If rent is due on the first of the month, and the first of the month falls on a weekend or a holiday, the tenant has until the next business day to pay the rent. The rent is considered late the following day. In your case, since the rent came due on a Saturday, the rent due date would roll to Monday, and the rent would be considered late on Tuesday. A three-day notice to pay or quit served prior to Tuesday would have been premature and invalid. Regarding your question about whether or not you must wait until after the 5th of the month to serve due to your late charge provision, the answer depends on the specific language used in your rental agreement. If your lease states that “rent is due on the 1st of the month, but will be considered late if not paid by the 5th,” then your lease defines when rent is late, and a notice served prior to the rent becoming late would be premature. I am a resident manager of a pretty big complex in Southern California. Lately, we have encountered problems with tenants hanging towels over the balcony to dry. the resident to permanently remove the offending towels. If the tenant fails to comply with the Notice, then you may proceed with an unlawful detainer. Failure to follow up on your Notice sends the wrong message to the offending tenant.

Yes. Depending on your tenancy documents, you have several options as to how you may wish to handle this situation. Most communities will have rules and regulations prohibiting the hanging of towels on the railings, they are not only an eyesore; the moisture damages the wooden railings. A warning letter with a copy of the rules and regulations sent to the resident generally solves the problem. Make sure that all communication you have with your tenant is in writing, and that you keep a record of all correspondence you send. If the resident still doesn’t get it, provided your tenancy agreement prohibits hanging towels, you can serve a three-day notice to perform or quit, instructing

Typically, I am afforded some time to speak to a membership meeting, Leadership Lyceum or other gathering and share some information or observations on what’s happening in Washington, D.C. vote of support. Following the Republican “revolution” in 1995, just such a vote was held (term limits were part of the “Contract with America” used at that time to unify Republican candidates across the country) but fell well short of the needed votes. This was a moment where the proverbial rubber met the road. The more recent tea party “revolution” notwithstanding, I believe that members of Congress still would not vote against their own best interests or the perceived best interests of their constituency. They want to stay in office until their “work is done” and cutting that short because of an arbitrary deadline interrupts that work. This applies to members of Congress at all points along the political spectrum, by the way. One popular argument against term limits is that it is the right of the voters to re-elect the same people to representative them, no matter the consequences. I agree with this argument. In fact, if the people were truly outraged with the state of affairs in Congress they would press their own representatives to support a constitutional amendment to impose term limits. Since they have not, can we assume that there is no support for this? The challenge is that while voters would likely overwhelmingly support limiting the term of other members of Congress, they do not want to limit the term of their own. So what is a citizen
no shortage of gallows humor at the level of gridlock or craziness that pervades the federal policymaking process. Stand-up comedians have made careers from the material they get out of Washington. During a recent affiliate visit, I discussed the current election cycle and the overwhelming percentage of incumbents that would win re-election this fall and the relatively few Congressional seats that are competitive. A member commented that she felt the only way things would get done was if there were new members of Congress serving in office. She then asked if I thought she should put her efforts behind the term limits movement to try and change the system by limiting members of Congress to a specific number of years in office. Because we are often discussing as an association how to impact the political system to achieve our goals, I thought I would share my two-part response to her inquiry. First, I think there are disincentives for members of Congress and voters to actually support term limits. While several states and even local governments have term limits on their elected representatives, the U.S. Supreme Court has ruled that states cannot institute the same on their federal officeholders. Imposing term limits on Representatives and Senators is a constitutional change which must start in the House of Representatives with a two-thirds N E W S

advocate to do? The second part of my answer was to suggest that what is worth focusing our attention upon as voters is the process for re-districting in the states. This is a structural change that took hold in the last decade and, in my view, has contributed to the deterioration in problem-solving capabilities in Congress. After every decennial census, the states undergo a redrawing of the lines for their Congressional districts. This is intended to respond to changes in population (some states gain seats in Congress while others lose seats), ensure compact, contiguous districts and perhaps keep local units of government within the same district. In practice, however, the process has been used by both parties to draw lines that create almost impenetrable partisan strongholds that virtually guarantee one-party control until the next decennial census. You know this process as gerrymandering and it
has become increasingly easy due to improvements in technology and mapping. As a result, in at least five states the “opposition” has been relegated to just a few districts while the majority controls the rest of the state. Moreover, the only way majority incumbents can lose is to a primary opponent from their own party. This tactic has been used by Democrats in states where they control the legislature and by Republicans in states they control. I prefer the approach that Arizona, California, Hawaii, Idaho, Montana, New Jersey and Washington have adopted which is to give the district drawing process to an independent or bipartisan commission. The goal is to reduce the impact of partisan politics. While far from perfect, it has to be an improvement upon what has been done in some of the 34 other states where the legislature draws the lines. If the goal of “compact and contiguous” congressional districts is met through these independent or bipartisan
entities then you typically have heterogeneous districts not solidly in one party’s hands. That can organically mean fewer extremists of either party. While it does not guarantee more moderates, it does increase the chances that the representative of that district must take into account a wider pool of perspectives than just those of his or her own party. Extrapolate that to Congress and you would have less polarization and more discussion to solve the big issues facing the nation. That should be something we all want. Dear William: A number of things may be at work here. Unit overcrowding is generally the main reason for moisture & mildew build-up in an apartment unit. Because of the overcrowding, the residents, take more showers and baths, throughout the day and evening. Often to hide the excess people in the unit, the resident will keep all the window covers closed and the widows shut, effectively keeping the moisture from escaping. Add a windowless bathroom into the mix and the problem is compounded. Mechanically, we suggest you inspect the vent fans in the bathrooms. Make sure they are not clogged with lint or dust. If the fan is operating properly, check the CFM or Cubic Feet per Minute of air movement. The minimum number should be 50 CFM. If the bathroom is getting more than the average amount of use, you may want to replace the existing fan with one that has a higher CFM rating. We recommend using at least a 120-CFM fan. Equally important, many bathrooms have two wall switches; one for the light and the other for the fan. If this is the case, we recommend combining the two switches into one. That way when the resident switches on the light the fan will come on automatically. We find most residents will not turn on the fan if it has its own switch. Lastly of course, is to get the resident to open a few windows and let some fresh air in.

Dear Maintenance Men: Over the years, the sidewalks around our building have accumulated a fair amount of chewing gum residue. We are looking for a good method to remove the gum and the gum deposit. Once clean, is there any surface treatment to prevent gum from sticking? Ryan Dear Ryan: There are a number of ways to remove gum from a brick or concrete sidewalks. Spray the gum with an aerosol freezing agent or place dry ice on the gum for a few minutes. The gum will become very brittle and should be easier to pry off the surface with a putty knife or scraper. It may take a few tries to remove all the gum. If there is any gum remaining, spray WD-40 or vinegar and let it soak to dissolve the remaining gum. Use a scraper or stiff brush to remove the rest of the gum. After all the gum is removed, use a power sprayer to deep clean and remove any gum residue. If you still have discoloration on the concrete, use muriatic acid & water mixture to bleach the concrete. To keep the gum from sticking to the concrete or brick sidewalks in the first place; use a waterproofing sealer on the sidewalk to reduce the likelihood of the gum sticking to the surface. Dear Maintenance Men: I keep hearing about PEX tubing as an alternative to copper tubing when n

it comes to re-piping my rental units. What is the difference between PEX and copper tubing and why use one over the other? What are the pros and cons? Aldridge Dear Aldridge: First let’s define what PEX tubing is. PEX is a cross-linked polyethylene pipe. (It looks and feels like plastic pipe.) The PEX pipe is resistant to extreme temperatures, stress, pressure and chemicals attacks such as acids and alkalies. This makes PEX pipe suitable for both hot and cold water systems and can be used in below freezing condition and is suitable up to 200 degrees Fahrenheit. The pipe is extremely flexible and easy to install.
Pros and cons of using PEX: Pros: 1: Versatile and user friendly, can be bent around corners & snaked through walls.

2013 Prop. 65 Private Settlement Summary Shows Widespread Lawsuit Abuse Continues BY TOM SCOTT — EXECUTIVE DIRECTOR, CALIFORNIA CITIZENS AGAINST LAWSUIT ABUSE
E
very year the Attorney General’s office releases an annual summary of the private settlements of Proposition 65 cases brought by private plaintiffs. The office has been doing this since 2000 and the summaries are based on reports submitted to the Attorney General as required by law. The summary shows total penalties, attorney fees, other funds collected, and includes a brief description of actions defendants were required to take to remedy alleged violations. For years, CALA has been posting these annual summaries and discussing the outrageous attorney fees. Specifically, we have pointed out how a certain group of individuals and organizations collect huge sums of money by filing shakedown Prop. 65 lawsuits up and down the state. So here are the numbers from

and costs totaled $1,153,000 or 85%. Another attorney, Anthony Held had 18 settlements totaling $551,000 and his attorney fees and costs totaled $485,000 or 88%. It is outrageous that these attorneys are abusing the law to get rich. There was one point of light in 2013: AB 227 by Assemblyman Mike Gatto was signed into law. This new law will eliminate some of this abuse, but as new chemicals get listed and new regulations are proposed by OEHHA, the problem of Prop. 65 lawsuit abuse is probably only going to get worse. The Governor wants the shakedowns to stop, but they appear to be moving along faster than his beloved high speed train. This is part of the reason CEOs rank California as the worst place to do business. We should be focusing on job creation and shutting down the shakedowns.
the 2013 Proposition 65 Settlement Summary. In 2013, there were 352 settlements, and total payments of $17,409,756. Of that $17.4 million, non-contingent civil penalties accounted for 15% ($2,680,059), payments in lieu of penalty were 11% ($1,998,435), and — wait for it — attorney fees and costs were a whopping 73% ($12,731,262). Just like every year, the attorneys are generating millions in fees from shakedown lawsuits, and our small businesses are paying the price. When you break it down further, the picture becomes a little more appalling. One attorney, Russell Brimer, had 60 settlements in 2013, with total payments of $2,430,101. His attorney costs and fees totaled $2,004,871 — 83% of his settlements. The Consumer Advocacy Group had 25 settlements totaling $1,364,000, and their attorney fees

May General Membership Meeting Recap

ith the drought continuing and rain nowhere in sight, our May General Membership Meeting had a very timely topic! Greeting members as they arrived were our fabulous PSC members, many of which brought prizes for the evening’s attendees. The AAOC staff also got in on the fun by arranging a few plants to raffle as well. Our meeting had two sponsors, Axiometrics, and Chase Multifamily Lending, represented by Robert Fox of Team Fox. He educated our members on classes they can take to better position themselves on proper soil preparation and ways to reduce water use by half. MWDOC offers free property audits to evaluate and determine if the property is eligible for the Turf Removal Rebate Program. The Water Smart Landscape Program is also a great way to bridge the relationship between the owner, manager, and landscape provider. This program effectively establishes a monthly water budget based on water consumption by using a dedicated water meter. This is a more accurate way to determine whether your property is over, at, or below monthly budget. Frankie Alvarez of Buffalo Maintenance went into detail about the new and improved foliage available for beautifying your property. He said owners spend a large amount of their budgets on landscaping and they are hesitant to change their landscape to “grow” with the ever-changing weather elements and impacts. The common myth is that updating a property’s landscape is a huge expense. The reality is that it is actually more cost effective, and there is an added benefit of water savings. He said you could consider this upgrade as an investment that
maintenance cost. It is amazing how far drought tolerant landscaping has come. Our hope is that our members will make these changes and purchase these plants and succulents to help save water. If we all do our part, we can save the little resources we have left. Another thing to consider, besides these plants, is the time of day you should water. Try to water landscape in the early hours of the day and avoid watering during windy conditions, as the water tends to blow onto paved surfaces or evaporate. Inspect your system for clogged, broken or missing sprinkling heads, replace where necessary, and connect them tightly to prevent water from pooling in puddles and possible harming plants. Selecting a WaterSense labeled irrigation controller to replace a clock timer can also reduce water usage by 20% as these products use local weather data and only water landscape when needed. his can happen when you least expect it: An unhappy resident has just arrived in your leasing office while your telephone is ringing, budgets are due in 25 minutes and six future residents are waiting to tour your wonderful apartment community. Time to panic, right? Not a chance! Read this article and use these three easy steps to handle an unhappy resident while turning them into a raving fan. Listening carefully: The moment you realize you have an unhappy resi-

TIP FROM THE COACH: Before addressing the concerns from your resident, let’s be certain we understand what’s at stake when handling resident problems and why it’s important to handle each resident as if they were liquid gold. A typical resident pays $800 per month or $9,600 per year. In addition, anticipate that each of your current residents will refer two prospects a year to your apartment community, which represents another $19,200 in new revenue and if each of these referrals send you two more referrals this year, that’s another four more new residents at $38,400 annually. So, $9,600 + $19,200 + $38,400 = $67,200 in potential new revenue, per resident,
per year. Can you clearly see why we must convert unhappy residents into raving fans? Diffusing the situation: Once your resident has shared with you exactly why they are unhappy, start your half of the conversation by thanking them for their comments. Next, say to your resident, “Let me see if I understand you completely.” Restate this person’s concerns as you slowly read from your notes. Reading your notes slowly does two things: 1) It gives your resident a chance to calm down; and 2) It shows that you were truly listening to what they had to say and are ready to take action. Now, apologize if you or your team made any mistakes and look for at least one or two points with which you can agree. By conceding a point or two right away, you show that you are not defensive about their concerns and that you really want to solve their problems, not duck blame or make excuses.
TIP FROM THE COACH: Whenever you are interacting with a current resident or a future resident, customer service experts call this a “moment of truth”. When you are dealing with an unhappy resident, this is called the “pinnacle of performance”. SuperStars in the property management profession do not mind handling an unhappy resident because they see this as an opportunity to shine—to win this resident’s long-term loyalty. Converting an unhappy resident into a raving fan: OK, now comes the easy part. Ask your unhappy resident exactly what action steps they would like to see you take. Promise your resident that you will do everything necessary to fix or handle the concerns they have shared with you and tell them exactly when and by what time, they can expect the problems to be handled. Motorola calls this, “underpromise, over-perform” and they have used these magic words to create a multi-billion dollar company. Next, take the time to either call this resident or visit them in-person, to tell them the concerns they had shared with you are now fixed and resolved. In addition, take a few minutes to write a small note apologizing again for their unhappiness and thanking them for expressing their concerns. At last, your resident should be completely satisfied that you have addressed their important concerns and you have earned their respect and goodwill.

he hazy interpretation and policymaking efforts affecting e-cigarettes has permeated the apartment industry. As localities debate the definitions and limitations of e-cigarettes’ growing use, community managers—particularly those who market their properties as “smokefree”— are undergoing due diligence concerning how to respond. “Most of our properties are smokefree,” says Scott Wilkerson, CIO, Ginkgo Residential, Charlotte, N.C. “E-cigarettes have not been a problem, so far. The science is still an open question, but they do not produce second-hand smoke or start fires.” Virginia Love, Vice President, Leasing & Marketing, Waterton Residential, Chicago, says it’s likely that her company eventually will ban them so it can maintain its “smokefree” claim. “This is an issue still to be discussed for the long term,” Love says. “We just have not gotten to the point yet of making a decision.” Representing a tiny fraction of money spent on tobacco products in the United State, e-cigarettes are expected to be a $1.5 billion industry in 2014, according to BusinessWeek. One anonymous property manager in south Florida wrote on an online

They provide a nicotine fix, and include only traces of “tobacco-specific nitrosamines” in samples tested by Environmental Protection Agency, which can cause cancer under certain conditions and in sufficient amounts. The Food and Drug Administration (FDA) on April 24 proposed rules that would give it greater powers in regulating electronic cigarettes. Following a 75-day public comment period, the age limit to buy the products is expected to be at least 18. States could choose to set it higher. Health warnings would also be required and manufacturers would be required to register all their products and ingredients with the FDA. They would need to provide scientific evidence before claiming direct or implied risk reduction with their product.

irst a disclaimer: This column typically deals with property sales & values and I know precious little about either. Sorry. During my 25 years in multi-family property management, I’ve focused exclusively on growing rents and maintaining assets. In the past twenty years our investors have sold only two of our 30+properties. Buying and selling (especially selling) just isn’t our business. On the other hand, rental income is the basis for rental property value and on this point I do have something to share based on data from our uniquely homogeneous set of 4,000 class-B garden-style apartments in Southern California. This is an especially good set of properties for deriving regional comparisons because all were built by the same builder using very similar designs and similar locations. Now then, if you’ll take a look at the attached chart, I’ll get to the point. Do you see the steep dark red line? That line is our gross rental income per unit in Ventura County for the past 3+ years. As a long-time resident and property owner, I do love Orange County, but… In each of the past two years the rental income growth rate in Ventura County has outpaced all of our other Southern California regions by as much as double. It is quite a turnaround from the days of the Great Recession which clobbered Ventura so very badly. Still, by the late “aughts” the region stabilized and has since roared back stronger than any of our other local regions thanks to continual strong market rate increases

and improved, now 98%+, occupancy. Oddly, that last bit is a bit of a problem. Income growth might taper next year in Ventura County simply because there is little to no room left to make gains through improved occupancy. From this point forward all new income gains must come from increases in market rents and, especially, lease renewal rents. While this sounds like an enviable problem, and it is, raising renewal rents requires strong resident relations and education efforts if rental rate gains are to continue without creating excess turnover. While property managers are addressing that challenge, development follows rents and I can’t help but believe that our next challenge will be increased competition. County rents could possibly so closely approach Orange County rents as the chart suggest. These readers, especially those in south-county can relax. This isn’t a comparison of ALL rents in each county. To keep the regional comparison as like-for-like as possible, the properties in this data pool are limited to our twenty to thirty-five year-old class-B garden-style communities common to all four regions. By definition, this eliminates the newer chrome, aspirational hipster, and Tuscan style communities that have dominated Orange County construction in the past decade. There isn’t a like group of these properties in Ventura County. Yet. James Wohrman is President of FDC Management, Inc., a owner and fee-manager of over 4,000 apartment units in Southern California and Texas. His observations, for what ever they are worth, are based on 25 years experience managing a wide range of class-A and class-B apartment communities.

f you’ve been thinking about selling your business, you should put a solid sales plan in place even if you don’t act on it right away. According to Fred S. Steingold, business attorney and author of The Complete Guide to Selling a Business, planning in advance is the ideal scenario. “A business owner should start planning for a sale at least four years in advance,” he says. Early planning can enhance the market value of your business while also helping you

Business owners can become motivated to sell for many reasons — approaching retirement, a lucrative buyout offer, or a desire to try something new. Reducing costs is imperative, even if it means lowering your salary and closing expense accounts. Then determine how to generate the income necessary to show two years of increased profits prior to the sale. Other value-enhancing strategies include:
• Creating a list of long-term contracts or clients that underscore your market strength With these strategies complete, it’s time to work with a broker to determine a realistic price for your business. To do this, you’ll use an industry formula, your average earnings and the recent sale prices of comparable businesses.
A complete buyout, which may allow you to reinvest the proceeds or use them to start a new business venture
• Maintaining the premises and equipment
•
Accepting an “installment” buyout with scheduled payments,
• Tightening your credit standards
•
Agreeing to a lower price, plus
•
Agreeing to consult or work through a transition period, which may be important if your business depends on service relationships
•
Selling an interest in the business, which lets you defer capital gains taxes
If you accept an “installment” purchase, keep in mind that it is important to check the buyer’s credit history and be realistic about his ability to succeed in providing future payments. Steingold suggests protecting your interests by retaining shares in the business, with ownership reverting to you if the buyer defaults; requiring the buyer to secure the purchase with other assets; or requiring the buyer to provide an acceptable guarantor or co-signer.
Choosing the Best Sale Option How you structure the sale determines how you’ll receive the proceeds — and pay taxes on them. Some options and considerations include: •
• Securing a long-term lease or leaserenewal option if your business site is critical to your bottom line
a percentage of future profits, which splits risk between you and the buyer
and severing ties with weaker accounts

NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester.
