N
ot long ago, people would debate the substance and staying power of social media. Sure, you can keep up with friends, relatives, news outlets and interests, but what good can it do for business? Those who took time to think through, answer and act on their intuition were certainly onto something. Newspapers, both local and national, are struggling to stay afloat as a result of dwindling advertising income and just last week the Pennysaver abruptly shutdown. Advertisers are now looking for new platforms to market their products or services and social media is number one on their list. By the Numbers According to a recent study published by Balihoo, a marketing research firm, over 71% of social media participants indicated that they are more inclined to purchase a product from a company they follow online. Additionally, 15% of all consumers look for local businesses based on their reviews posted in various social media outlets. A staggering 91% of local searches use Facebook to find a local business, while 63% of all searches are more likely to do business with a company that has information or reviews posted on a social media site. Can you recognize the shift? It’s no wonder Apartments.Com just launched a $100 million dollar marketing campaign for their revamped website that is directed 4

towards nearly 100 million Americans who rent their homes. They are confident that they will reach nearly 95% of their target audience in the 18–49 age group. I’d say that’s an effective campaign.
it or not. I can’t tell you how many times I’ve talked to a business owner, service provider, management company or property manager who was angered over negative reviews that had been brought to their attention. When I ask whether or not they had accessed their property or company page before, the answer is generally no (accompanied by a puzzled look, of course). We live in the age of customer engagement and that customer experience begins online and offsite. Our customers expect to see a social media presence that mirrors the experience they will receive onsite. Are you prepared?
For the “Kids” People Social media is not just important, it’s here to stay. With over 1.44 billion active users, Facebook’s registered user base is larger in population than China and India. Stateside, more than 72% of all adults use Facebook on a daily basis and do so for upwards of 22 minutes. But enough of the statistics, sensational claims and suggestions, the reason most people and most companies choose to ignore social media altogether is because they just don’t understand it. They laugh it off as something that is for the “kids”. Or worse yet, they use an old marketing slogan or campaign on a new social media platform. Nobody uses Facebook, Twitter, Pinterest or Instagram to find out about a move-in special, but they do look at great pictures of a great view, great architecture, landscape, a swimming pool or something that cleverly ties in the surrounding community to the property’s location. Consider it a direct method of passive advertising.

rom time to time I like to turn the column over to another Orange County opinion shaper to help make the point. This month I offer to you the Editorial Board of the Orange County Register, who penned this piece. Public employee unions are leading a charge to take on what has long been considered a “third rail” of California
employees. It should be self-evident that this has little to do with fairness and everything to do with grabbing more money for public unions. This greed apparently is insatiable, even at a time when the state budget has increased 25 percent in the past three years and is running an estimated $4 billion budget surplus, largely as a result of the Proposition 30 tax increases adopted in 2012 that could cost tax-
politics: Proposition 13. The Make It Fair coalition, led by public unions such as the Service Employees International Union, California Teachers Association and California Federation of Teachers, proposes increasing property taxes for commercial properties. Make It Fair estimates that this change would result in an additional $9 billion a year in state revenue that would be available to dole out to public

payers as much as $50 billion over seven years. Just how much is required to achieve “fairness”? There is never a stationary target, only “more.” Perhaps they should ask instead: Is it fair that Californians are among the highesttaxed of any state? Is it fair that California’s tax and regulatory policies force businesses to operate in a business climate consistently ranked among the very worst in the nation? Is it fair that imposing higher property taxes on businesses will increase costs for them, leading to job losses, higher prices for consumers and businesses closing and leaving for other states? According to a March 2012 study from the Pepperdine University School of Public Policy’s Davenport Institute, adopting such a “split-roll” property tax would result in a loss of nearly 400,000 jobs and $72 billion in economic activity in the first five years. Other than the Prop. 218 restriction on local government taxes, Prop. 13 is arguably the only significant taxpayer protection left in California. It should be guarded jealously. Thank you Orange County Register. You help make the case for property rights here in Orange County and across the state. The fight to protect “The People’s Initiative to Limit Property Taxation” amendment to The California Constitution in June of 1978, otherwise known at Prop 13, continues on.

I
t’s always something with one particular tenant of mine. When he first moved in three months ago, he deducted about one hundred dollars from the rent because he said he had to fix a few things in the unit. I didn’t say anything at the time, I needed the unit rented, and I didn’t want to upset my new tenant. Since then, he has been able to find something wrong each and every month, deducting a little bit each month.
These certain circumstances require the tenant to give the landlord notice of the dilapidation before using the repair and deduct remedy. After giving notice, the landlord has a “reasonable time” to make the repairs, before the resident can unilaterally “repair and deduct.” Only defects that render the premises uninhabitable will qualify for this remedy. Tenants may only invoke this remedy twice in any twelve-month
I told him I didn’t think that was right, but he did it again this month. He says he is entitled to, that California law says he can “repair and deduct” for anything wrong in his apartment. Is this true?
No. California law, specifically California Civil Code Section 1941.2, provides that a residential tenant may make repairs and deduct the cost from the rent only under certain circumstances.

period, and each time the remedy is utilized, the tenant cannot exceed one month’s rent. In your situation, it appears that the tenant is abusing a privilege only available to tenants with serious dilapidations in their apartments. Without providing notice to you of the defect, and an opportunity for you to correct any serious defect, the tenant is not entitled to deduct anything from his rent. Provided you haven’t condoned his conduct, or waived your rights to accept the full amount of rent, you may demand that the tenant pay all amounts previously deducted, and become current.
My tenants and I seem to be able to work out our differences quite easily, but there are times when we disagree as to just who is responsible for making certain repairs to the apartment. Can you give me some guidelines that will help me decide if the repairs are my responsibility or the responsibility of the tenant?
Residential rental units must be “habitable.” In legal terms, “habitable” means the rental unit is fit for persons to live in and that it substantially complies with state and local building and health codes that materially affect a tenant’s health and safety. The law makes both landlords and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental agreement can determine who takes care of the minor repairs. California law lists several items that are required to maintain a habitable unit, these are effective water proofing and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facili-
ties, heating, and electrical in good working order; clean and sanitary buildings and grounds; adequate trash receptacles; floors, stairways and railings in good repair. Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, and smoke detectors. A landlord is also responsible for the installation and maintenance of the inside wiring for one telephone jack. Tenants must take reasonable care of the rental unit and the common areas. Tenants are responsible for repair of all damage resulting from their neglect, abuse, or acts by their family, guests or pets. Tenants must do all of the following: keep the premises “clean and sanitary,” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly, not destroy, damage or deface the property, not remove any part of the structure, Q&A — continued on page 14

I have a problem in one of my rental properties. The property has parking below the complex for the residents. Apparently, due to the rains, a leak occurred in the ceiling of the garage. The water collected in one of the ducts, becoming quite dirty and rusty. This water then leaked down onto a resident’s car. As it turns out, the car’s rear passenger window was cracked open and the water leaked onto several of the tenant’s personal belongings. Needless to say, the tenant threw a tantrum in the management office the next day. I apologized profusely and offered to have her car washed and detailed. She accepted. However, the next month, this tenant’s rent was $175.00 dollars short. Along with the rent, the tenant included a letter stating that she had deducted the cost of the damage to her personal belongings. Can the tenant do this?
No. A leak onto the automobile of a tenant has nothing to do with the ten-

stored in the leased premises. If the property left behind is less than $700.00 you may dispose of it after the above required time periods. However, if the abandoned property is worth more than $700.00 in fair market value, you must sell the property through a public sale. This requires you to publish the date and time of the sale in a newspaper of general circulation once a week for two consecutive weeks, with the sale the following week. If the tenant returns to claim the property, you must return it, but you can charge reasonable storage fees. Be aware that you may not hold the property as ransom for the rent owed, even if you have a judgment.

Here goes… I’m beginning to think there may be hope for our political system. As you recover from your shock at such statements of folly, you will recall the many times in my monthly missive where I have lamented the sorry state
seemingly impenetrable void. It was refreshing and reminded me that all is not lost. These two Representatives occupy the middle of their parties’ ideological spectrum. Such brave souls are increasingly squeezed out by the political base of both parties in favor of more extreme, “exotic” candidates, but these two

I’ve used up paragraphs crabbing about the new normal of partisan dysfunction, petty squabbling and seeming inability of our political representatives in Washington to address the growing list of problems facing the country. They leave the “red meat,” doctrinaire crusades to the extremists. Both will speak frankly about the weaknesses in the party apparatus that enable bad behavior by some and pull no punches when leadership gives in to partisan pressure. Bipartisanship is not a talking point to them, it is a guiding principle that is evidenced in the bills they co-sponsor and the votes they take. And the reason this gives me hope is that it actually might be having an effect. Case in point is legislation passed

we should also strongly support those members of Congress who are constructive players in the process. They understand that it takes collaboration and compromise to succeed and that it’s worth it to do so. What is also exciting about these two members of Congress is that they keep getting re-elected! Sure, they have large blocs of constituents on the far right and far left, but those voices are drowned out by the voters who appreciate a focus on getting things done, a lack of craziness and a willingness to work with those of different opinions. Imagine if other, like-minded voters made themselves heard at the ballot box in other districts and states. Hope springs eternal. As I have reported previously in this column, this was no small thing as a permanent solution eluded Congress for more than a decade. Many seniors lived in constant fear that at any time they would lose access to their doctors. Then, this past April, House Speaker John Boehner (R-Ohio) and House Minority Leader Nancy Pelosi (D-Calif.) stood tall against the most conservative and liberal voices within their respective caucuses to pass the “doc fix.” There were plenty of opportunities for either one of the leaders to fold under pressure but they chose instead to follow a compromise strategy. Moderate, pragmatic members of the House helped make this possible. Now I always say that any smart advocacy group does not discriminate among elected leaders and works with whoever supports their cause and gets the job done. That means knuckledragging conservatives or screaming liberals. As Bob Sugar says in Jerry McGuire, “it’s not show friends, it’s show business.” We will always support our allies wherever they may live on the political spectrum. However, when the challenges — for our industry and the nation — are so great, the outcomes so important and time to act so short,

The El Niño phenomenon is associated with extreme weather around the globe and in California it typically means a wet winter with higher than normal rain levels. The National Oceanic and Atmospheric Administration (NOAA) is predicting a 60 percent change that the El Niño conditions will continue all year. So how do you prepare for El Niño? Inspect your building’s roofs, gutters, drains, flashing and trim overhanging trees. In other words, don’t wait for the wet season to find out your roof is in poor condition. Get the work done now while it is dry and the roofing companies are not busy. Don’t forget about large trees that hang over your roofs. In wet windy weather, they can cause a lot of damage to a roof if a limb breaks or a tree falls because of soggy soil. Flat roofs are especially vulnerable to blocked scuppers and roof drains. The backed up water will find the slightest weakness in any roof system and even cause a roof collapse.
Dear Jennifer: Although your situation is beyond this; the first line of defense is not letting pigeons get a foot hold at your property in the first place. Talk to your residents and make sure no one is feeding the pigeons! It sounds like you have tried most of the common antidotes for getting rid of established unwanted pigeon flocks. Getting rid of pigeons is a war of wills. If you give up, they will return. The key is to make them as uncomfortable as possible and not stopping until they are gone. First thing to do is clean the area with bleach to remove any pigeon nesting smells and spraying any stubborn pigeons with a water hose over and over. If the area lends itself to be closed off, put up netting to keep the birds from entering the area. If the spikes are broken, replace with stronger ones. Check at your local farm supply or the internet for stronger better quality spike strips. The area must be monitored constantly until the birds have found a new nesting area away from your building and remember, this is a daily battle if the campaign is to be successful.

As you mentioned, the drought tolerant landscape will cost you less money in water and will be easier to maintain. The single greatest consumer of water in your landscape is the turf. Reduce the grass area to ease the burden on water. Xeriscaping is a term for a water conserving landscape. Some of the benefits of Xeriscaping is water saving, low maintenance, pesticide free, pollution free (no lawnmowers) and use of local native plants. You might want to consider using Ornamental grasses, as they are drought tolerant, look great and give your landscape a BUFFALO.AD.Resized:Layout 1

o you and your staff really know how to engage and interact with the customers? Do they even know what it means. Seems as though every year there’s a “new” word in Customer Service. And this year it’s been “engagement.” Engage the customer. What’s it mean? Or better yet: What does it not mean? The answer to what it’s not, is — it’s not, the customer service experience. Don’t confuse the two. They are

quite different. It is: Just as you might imagine…. when you might have popped “the question,” (or said “yes” if you were the one being asked), you normally went into what is called an ‘engagement’ period. That’s the time before the marriage. Time to better know and understand someone you’re supposed to spend a lifetime with. Sometimes it’s short and sometimes it’s a longer period of time. But usually there’s an ‘engagement’ period. And so it is with our customers. Before they can “buy,” before they can become our customer (before we ‘marry’ them), we need to get ‘engaged.’ Make sense? Or starting to? Right, you don’t just walk up to someone and say, “Hello” and then head for the altar. It’s the same idea in the sales and customer service world. There’s an old sales saying: “The customer has to buy YOU first, before they buy the product.” And it’s true.
You need to spend a bit of time ‘engaging the customer’ before they buy or use your services. The Engagement is the time to wine and dine the customer; not physically — but mentally, and emotionally. Yes, to be on your best behavior. And you usually are. But as in marriage, it need not, and should not, must not, stop there. I’ve never considered divorce (murder yes, not divorce.) However, those who have been through divorce coincidentally all shared a similar story to me. “They changed” I’ve been told. “They were so nice during the engagement period, but afterwards, it all changed.” I have always wondered why. Why be one way to get the customer and then another way after you get them? No wonder customers get upset. And when you think of it, in an engagement, you are each others ‘customers.’ So to make it a bit easier for you to Engaged — continued on page 26

I will expound on them in another blog. And also I’ll share more about the engagement. I wanted to keep this blog short, sweet and to the point. To engage the customer one simply needs to follow these engagement guidelines: • When a call comes in or a customer walks into your location, let them know they called or came into the right place! This is not brain surgery; just use those exact words. • Names are critical, of course. To gain a customers name, you need to introduce yourself first; then ask theirs. • Smiling is a condition of employment and grounds for termination. Can’t make that strong enough!

• We need to remember, the customer is not always right; they always think they are right. Deal with the situation that way and it’s much easier to handle.

It’s still not time to put the ring on the customers finger, but you’ll be headed in the right direction with these steps or ….“Rules of Engagement”. I’ve been doing this a long time. It all works. More later.
• Watch out for Killer Words. These are words that will stop a conversation. Or even kill the conversation. A few killer words to beware of, from our surveys are: “No problem,” “It’s not our policy,” “You don’t seem to understand.” We have plenty more of them to be sure. These happened to have gone right to the top.

Mr. Cummings recently was recognized by the Orange County Chapter with its highest honor, the Lifetime Achievement Award. The award has been given by the Orange County Chapter on only two occasions, and is given to a member who has been recognized as outstanding in his practice and who conducts himself with the utmost civility and decorum. Mr. Cummings is a member of the Irvine-based law firm Wesierski & Zurek LLP, whose senior partner Chris Wesierski is also a past president of the
preservation and promotion of the civil jury trial system, as well as to promoting standards of integrity, honor, ethics, civility and courtesy throughout the legal profession. Can Higher Interest Rates Derail Apartments? BY N IC K LI E BE R MAN
B
y virtually all measures, multifamily properties are running on all cylinders. Reviewing first quarter 2015 data…
• occupancy rates are a solid 95.1% in Orange County and 94.4% nationwide • rents continue to trend higher — RealFacts reports a robust 6.2% increase in overall asking rents in OC from Q1 2014 to Q1 2015, and that was one upped by a 7.1% year over year gain nationwide; • apartment sales transactions as reported by CoStar show that gross rent multipliers have ballooned to 14.12 in OC in Q1 this year, up from 12.83 in Q1 2014, while nationwide the multiplier reached a still impressive 11.76, up from 11.09 in 1st quarter 2014, as buyers continued to cherish residential rental income; • unemployment continues to fall — the 5.5% national rate is closing in on the Federal Reserve’s definition of “full employment” supporting the premise of a relatively healthy, sustainable environment to keep rental housing full for some time to come. Grateful investors recognize that things are pretty special right now in the apartment sector. These folks know about cycles and the ebb and flow of market conditions, and circumstances

beyond one’s control…like interest rates. Which leads us back to the headline above, and the question of whether long anticipated rate moves are about to take the apartment sector down a peg. In May 2013 the Federal Reserve dropped its first explicit hint that its exceedingly accommodative interest rate policy could be phased out in the not too distant future. Two years later, after seemingly endless speculation as to when the inevitable rate hike would be announced, markets still await formal Fed action. As of this writing (6-8-15), the benchmark 10 year US Treasury yield sits at 2.38%. That’s up from 1.91% at end of first quarter 2015, but below the 2.73% level when Q1 2014 concluded. The decade’s highest 10 year yield was 3.85% in early 2010. No one really knows where long term rates would “naturally settle” if the Fed reverted to a fully neutral monetary policy. Forecasters ultimately construct their projections around expectations for inflation. My personal sense is that the nastier version of inflation — versus the 2% range we’ve grown accustomed to — remains in hibernation for the foreseeable future. I view a more plausible increased inflation scenario as an inflation rate that rises from its current level of almost zero (the adjacent chart shows that CPI ended Q1 2015 actually declining .1% over the previous year) to perhaps a 3% CPI, with 10 year N E W S

Treasuries climbing to the 4–4.5% range, which in turn would take long term mortgages to the 5.5–6% level (1.5–2% above current levels). Would that turn the tables on apartment values? Unlikely, given the very strong fundamentals in today’s multifamily marketplace. To quantify, for every $1,000,000 in loan amount on a 30 year amortization @ 4.25% (a middle range for recent apartment rates), the monthly payment = $4,919 P & I. The payment climbs to $5,996 @ 6%, which reduces annual cash flow by $12,864 versus the 4.25% rate. Yes, that’s an appreciable hit, but it does not depreciate the intrinsic value of the underlying apartment asset whose rents will eventually adjust to offset a higher mortgage payment (with the possible exception of rent controlled properties). Unleveraged or low leveraged properties will be minimally impacted by rate increases; same goes for units with stabilized fixed rate financing in place. The exposed will of course be those with ARM loans. The apartment market is as sturdy an investment sector as exists at this time. Sure, if sharply higher interest rates unfold rental property valuations will slide a bit. But overall and over time, I expect the stable economic foundation upon which multifamily securely sits to preserve a steady growth pattern in pricing, regardless of oncoming higher rates heading down the track. A
lthough the odds of winning the lottery may be stacked against you, there’s a chance you’ll receive a large — perhaps unexpected — financial windfall at some point during your life. Regardless of how it arrives — inheritance, insurance payout, divorce settlement, retirement-plan distribution, sale of a business or company stock options — careful money management is critical to enjoying the money for years to come. Unfortunately, many windfall
or buy a new house or car. For this reason, the best course of action is often to leave the entire sum in a moneymarket account for the first six months. This requires a great deal of discipline, but you’ll avoid making irrational decisions and will give yourself time to evaluate your options and develop a solid long-term plan. Many people mistakenly believe that a large sum of money is the answer to all of their problems. In fact it often creates new anxiety and stress. By
recipients fail to use their newfound wealth wisely and are left with little or no savings — and lots of regret. To avoid joining their ranks, there are a number of important considerations to keep in mind when receiving large cash payouts. Avoid Sudden Impulses Most windfalls are squandered during the first days, weeks and months as recipients make impulsive decisions to quit their jobs, take exotic vacations,

W
ith the drought that California is facing, there is no better time than now to join the water use efficiency movement and stop wasting water! Stubborn leaks are common around the house, and they can be as easy to fix as tightening a nut or replacing a washer. Unfortunately, most homeowners don’t discover leaks until it is too late. A great way to detect leaks early is to read your water meter once a month. Your water meter is an excel-

A few key locations to pay attention to include: hose bibs, sprinkler heads, irrigation piping, and valves. Consider installing pressure-regulating sprinklers with high efficiency nozzles to control the amount of water being applied to your landscape and reduce maintenance at the head. Reducing high pressure also eliminates problems such as misting sprinklers, water lost to evaporation, and potential irrigation system damage. Another great resource you can utilize throughout the year is the Water Smart Home Program.
