Crunch-Time for Costa Hawkins
A
t the time of writing, tenant activists in Santa Ana have joined the ranks of those in Pasadena, Glendale, Inglewood and most recently Long Beach in failing to secure the required signatures to place Rent Control on the November ballot. In Santa Ana, the proponents of the initiative have through October 2018 to gather signatures in order to qualify on this initiative and should they qualify, the initiative will appear on the City’s next ballot. If not, they will be forced to re-submit their petition and start their efforts over again. Meanwhile, this clears the way for November as we come into crunch time for Costa Hawkins.
What’s at Stake
With just three months until the Gubernatorial Election, California property owners are facing one of the biggest threats ever with Proposition 10 and the potential repeal of Costa Hawkins. A yes vote would allow for statewide rent control, expanding rent
control to single family residences and condominiums and allowing rent boards to strip property ownersin rentcontrolled jurisdictions of their right to ask market rates for a vacant rental/ apartment home. A no vote would preserve existing Costa Hawkins protections for property owners and help to prevent the expansion of regulation and other impediments to new development that would exacerbate the housing shortage.
What to Know
While a repeal of Costa Hawkins would not immediately change your property rights in Orange County, it still poses a major threat to your interests. Not unlike the recent change in law related to recreational Marijuana consumption, Cities will be empowered to respond quickly in order to adapt and enact policies on rent control and likely ahead of lawsuits by activists. What’s more, the recent Long Beach and Santa Ana rent control initiatives were written to include the application of the repeal of Costa Hawkins in the event it were to pass. As our coalition grows, there is a robust alliance of social justice advocates, business groups, labor and trade unions who are opposed to the repeal of Costa Hawkins and through our membership in CalRHA we are aligned with the California Business Roundtable effort.

Costa Hawkins Cost-a Lotta
One of the most important aspects of a campaign like this is fundraising and it is not uncommon for the opponents (us) to outspend the proponents by 2 or 3 times. Recent figures suggest the AIDS Foundation/Weinstein-backed effort will spend in the $25–$35 million range which means we need to spend around $105 million in order to mount an effective opposition or defense. By now, you have received fundraising emails and letters and there is additional information included opposite this column. We are asking for a minimum contribution of $50 per unit and hope that you will not only contribute, but share the word with your friends, family and neighbors to help ensure we defeat Prop 10. Given the concepts and ideas currently being floated by rent boards in Santa Monica and the Bay Area, some of which include rolling back rents 10 to 20 years should the repeal come into effect, the outcome would be devastating for Californians and the economy. So while a yes vote on Prop 10 would simply make a bad problem worse, a no vote on Prop 10 will allow stakeholders to work with legislators on a practical solution for housing in California today and tomorrow.

he 1995 Costa–Hawkins (C-H) legislation is a state law that sets some requirements and limits for the 15 cities in California with rent control and those that adopt it in the future. A repeal of C-H will lift all restraints on local rent control laws. I want to talk briefly about its importance, what it does, the effects on your business and the fact that it’s under attack and what we can do about it. Tenant activists collected enough

signatures to place a measure on this November’s ballot seeking to repeal C-H. (This is named Proposition 10, Vote NO). C-H limits rent control in several ways: 1. It exempts single-family homes and condos from rent control, 2. C-H allows vacancy decontrol; in other words it allows the rent on a vacated unit to be raised to market rent, 3. It prevents cities from establishing rent control on units built after 1995. In addition to these limits being eliminated, a repeal of C-H would allow for appointed Rent Control boards, likely with heavy tenant representation, that effectively would create the potential for 435 different types of rules across the state. The effects on your business? If you own or manage rental housing, it will devastate your business by limiting annual rent increases and increases upon vacancy, even if you must or do spend thousands of dollars to turnover or substantially improve the unit. This will have a significant effect on your property value. To add insult to injury, you will be charged fees to fund your city’s rent control bureaucracy. Vendors will be impacted as owners will reduce or stop capital improvements as well as cut general maintenance expenditures. This will adversely impact wages and jobs performed by many workers who rent. Moreover, there is univer sal agreement by respected housing experts that it will stop the flow of capital for the construction of vitally needed new housing

units everywhere in California. There has been a groundswell of support for rent control as advocates promote the idea that rents are too high, while ignoring that not enough housing has been built for decades. Or that house prices have increased to affordability levels that are at historic lows. Or that operating expenses have risen. What can we do about it? As you know, AAOC is one of 10 member affiliates up and down California that comprises CalRHA. CalRHA represents 21,000+ members totaling more than 518,000 units. The purpose of CalRHA is to advocate in the best interest of the rental housing industry and address industry needs. The effort to repeal C-H tops a long list that we must defeat. As a member of CalRHA, AAOC has worked to help formulate a strategy and fundraising campaign to defeat this repeal effort. Our opponents have also strategized and are raising money to see that this repeal passes. It will be a very expensive campaign for both sides. If there has ever been a time to get involved, now is the time we must all spring into action. E
very election presents the opportunity for citizens to express their will on a variety of issues and candidates for public office. Whether or not to participate in community discourse is a matter of personal choice. Unfortunate or not, the voting history in California reveals a topsy-turvy decline in overall turnout in non-presidential elections. Civic responsibility often takes a back seat to personal pleasure, akin to avoidance of jury service. November 6, 2018 will present the opportunity to once again demonstrate the individual level of political interest. In addition to a slew of candidates for public office, ranging from the governorship on down to local offices, twelve measures have been certified by the Secretary of State as being eligible for the ballot. Among these twelve are seven measures proposed through the initiative process and three placed on the ballot by legislative action. Here is an early look at each of these. Proposition 1, the Veterans and
Affordable Housing Bond Act of 2018, would authorize issuance of $4 Billion in bonds, with $3 Billion to be used to finance various housing programs and $1 Billion specifically dedicated to veterans housing. Proposition 2 summits to voter approval $2 Billion in Housing and Community Development funds for distribution to counties through the No Place Like Home Fund to support permanent supportive housing for homeless persons with mental illness. Proposition 3 would authorize $8.877 Billion in bonds to fund specified water projects relating to storage and infrastructure improvements. Proposition 4 would authorize $1.5 Billion in bonds to fund constructions, expansion, renovation and equipping of qualifying children’s hospitals. Proposition 5 would modify existing property transfer requirements for homeowners 55 years old or severely disabled, adjusting the replacement properties tax base with the new prop-

Proposition 6 would require any measure to enact certain vehicle fuel taxes and vehicle fees to be submitted to the electorate for approval, thereby eliminating the recently enacted road repair and transportation funding measure previously approved by the legislature. Proposition 7 submits to the electorate the question whether to continue daylight savings time changes, there by making permanent Pacific standard time. Proposition 8 would place price limits on outpatient kidney dialysis centers and require periodic reports to the state regarding clinic costs, patient charges and revenue. Proposition 9 would divide the state of California into three new states, subject to federal congressional approval. Proposition 10 would repeal the Costa-Hawkins Act that currently restricts the scope of local rent-control policies, thereby allowing local cities and counties to limit rental rates upon vacancies and impose new limits on new construction and single-family homes. Proposition 11 would require private sector ambulance employees to remain on duty during state-mandated meal and rest periods without violating those labor laws. Proposition 12 would establish new standards for minimum space requirements for confining veal calves, breeding pigs, and egg-laying hens; requires cage free environment for egg-laying Sacramento — continued on page 19

Apparently they claim to be ‘disabled’ and that because they are ‘disabled’ they get to do whatever they want. Huge clouds of smoke literally billow out of their apartment! I’m concerned about lots of things, but mostly, the little girl who lives next door, I believe that she’s asthmatic. How much more of this must I, and the neighbors take?
The audacity of some medical ‘professionals’ to abuse and game the system by willfully proscribing the use of ‘medical marijuana’ to non-disabled fraudsters is an affront to all truly disabled persons. As of this writing, the use of marijuana, medical or otherwise, is still illegal under federal law however

the federal government has elected to stay any enforcement and prosecution for the use and or possession of ‘medical marijuana.’ California legalized the recreational use of marijuana, which allows for the possession of a limited amount of marijuana, for personal use, provided certain requirements are met. Marijuana smoking is restricted by location. It may not be smoked wherever smoking is prohibited by law, within 1000 feet of a school, recreation center, or youth center, on a school bus, or in a moving vehicle or boat. The right to ‘smoke’ marijuana in your apartment community is not automatic, and will depend upon the individual facts of each case. The use of non-medical marijuana is technically illegal under federal law, and as such, cannot be used or smoked anywhere, including your
community, and may be grounds for termination of their tenancy. The use of medical marijuana requires that the user be disabled, and the disability must be ‘verifiable.’ Additionally, the disabled individual must request a “reasonable accommodation” from you the housing provider prior to just lighting up. Once the disabled person makes the request for a reasonable accommodation, you are obligated to consider the request, and attempt in good faith to accommodate the request in a reasonable manner. The accommodation does not necessarily require you to ‘grant’ the request outright, but you must make a good faith effort to provide an accommodation that addresses the disability, but does so in such a manner that it does not unreasonably ‘burden’ you the housing provider. The courts will apply a “benefit to the requestor” versus a “burden to the housing provider” standard in determining whether or not you met you obligation to reasonably accommodate the disability. In
your specific situation, the initial hurdle for your new residents to surpass is to establish that one or both truly has a “verifiable” disability. A ‘doctors’ note provided it has not been forged, although highly suspect will generally satisfy the extremely low threshold here in California. The reasonable accommodation, their request to smoke willy nilly within the apartment, must be balanced with the ‘burden’ to you the housing provider, and those other residents that might be affected, i.e. the asthmatic child living next door. It is conceivable, and probably likely, that an asthmatic child when exposed to the smoke billowing from next door might have a devastating and fatal reaction. Certainly the neighbor child, with a truly verifiable disability, asthma, is entitled to be free of the exhaled smoke as a “reasonable accommodation” for her verifiable disability. When balancing the benefit to Cheech and Chong of being able to light up in their apartment, with the burden to you as well as
the extreme life threatening burden to the asthmatic child, courts would most likely find that a reasonable accommodation would be to prohibit the smoking of the marijuana within the apartment unit, or in any place that might affect the asthmatic child, or others with such a sensitivity to smoke, but provide an area within the community, possibly a portion of the outdoor common area that may be used for the smoking of their medical marijuana. Alternatively, there are alternative methods of delivering the active ingredient in marijuana, i.e. ingestion, pills or tablets, food based, etc. Remember, reasonable accommodation issues are extremely fact sensitive and the analysis is dependent on a proper review of the relevant facts. I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?
Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they
may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental property or to others. These general rental criteria can and should be applied equally and fairly to all applicants, and in compliance with all fair housing rules. Once applied, the best applicant should be accepted, not nec-
essarily the first to apply. I just put my single family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?
The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/ enclosure conform to all state and local codes and ordinances. The gate should be self-latching, and should be checked to ensure that it closes properly. Review your insurance policy with your broker to ensure that your coverage is adequate; consider an umbrella policy as well. Your broker can counsel you on coverage

limits; consider $3,000,000 as a minimum. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self-latching gate functions properly. Consider requiring that your tenants procure renters liability insurance as well. These requirements should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?
No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled
to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. I have a 100 gallon 79,000 BTU Water heater which is about 5 years old. The heater has trouble maintaining a normal operating temperatures and the flame is yellow. I would hate to buy another heater, what do you think is wrong? Greg
Dear Greg:
I think you have a couple of things at work here. First let’s address the yellow
flame as that might solve the entire issue. A yellow flame indicates that the burner is not getting enough air. That means there might be an obstruction from dust or cobwebs in the burner assembly. Follow the gas line into the burner assembly and note where the air comes into the burner. If there is no obstruction at the air duct, remove the gas line from the burner and inspect the gas orifice. It is not unusual to find lint or cobwebs clogging the orifice or
the gas line. (Gas line between the thermostat and the burner.) With a brush clean the burner ring. The cleaning should solve the yellow flame issue and greatly improve the efficiency of the burner. A second item to address while maintenance is being done to the water heater is to clean out the water tank. Most 100 gallon water heaters come with a clean out port on the side of the Maintenance — continued on page 16

Depending on the hardness of the water being fed to the heater, it is not unusual to remove one or more buckets of debris. The thick deposits on the bottom of the tank greatly impact the ability of the burner to heat the water. The clean out of the tank should be done once a year. Pigeons are driving me crazy! I have tried everything to get rid of the pigeons that have taken over eaves and patios at my complex. I have used fake owls, high pitch sound devices, goop to give the pigeons sticky feet and spikes everywhere. They just laugh at the spikes and walk and nest over them. Any advice will be welcome! Dear Jennifer:
Although your situation is beyond this; the first line of defense is not letting pigeons get a foot hold at your property in the first place. Talk to your residents and make sure no one is feeding the pigeons! It sounds like you have tried most of the common antidotes for getting rid of established unwanted pigeon flocks. Getting rid of pigeons is a war of wills. If you give up, they will return. The key is to make them as uncomfortable as possible and not stopping until they are gone. First thing to do is clean the area with bleach to remove any pigeon nesting smells and spraying any stubborn pigeons with a water hose over and over. If the area lends itself to be closed off, put up netting to keep the birds from entering the area. If the spikes are broken, replace with stronger ones. Check at your local farm supply or the internet for stronger better quality spike strips. The area must be monitored constantly until the birds have found a new nesting area away from your building and remember, this is a daily battle if the campaign is to be successful.

We are big fans of LED lighting and have used 120 volt half inch LED rope light to great advantage. Install the rope light under the eaves and out of the way. From the ground the light appeared to emanate out from the eaves and down the walls. The light is indirect and made for a very interesting look. The side benefit of the rope light was not only did it look great; it shed light in all the dark corners around the building. LED rope light is more expensive than the incandescent rope light, however, it is economical in the long run, it has a long service life and the rope does not get hot or even warm to the touch.

(Although less expensive, we do not recommend incandescent rope light.) LED Rope light comes in 150 foot rolls and with the proper rectifier in place, up to 1200 feet can be used from one electrical source. The light comes in cool white, natural white and warm white along with a variety of colors. LED rope light is perfect for under stairs, balconies and anywhere you need soft indirect light. Financial Lessons You Can Learn from Retirees

oes this scenario sound familiar?
• When the market is up, an investor feels good and buys stocks. • When the market is down, that same investor gets scared and sells.
Although reacting like this may feel right at the time, the problem is this scenario is unlikely to result in a profit. In fact, the goal should be just the opposite: buy low and sell high. Why do investors make this mistake? The reason may have a lot to do with us making investment choices the same way we do many important decisions: using both our heads and our hearts (i.e., logic and emotion). When there’s market volatility — including both market highs and market lows — our emotions tend to take over and we may make illogical choices going against our best interests. To avoid having your emotions control your investment decisions, you may decide to get into the market when

it’s down and out of the market when prices are up. This is known as “market timing.” While this approach may sound rational, the problem is this strategy is extremely difficult, even for experienced investors, to employ consistently. There’s an old saying: “No one rings a bell” when the market reaches the top of a peak or the bottom of a trough. Translated: Investors attempting to time the market usually find it tough to determine exactly when to make their move. Give dollar cost averaging a look. Rather than using either of these approaches, consider a strategy called “dollar cost averaging.” Dollar cost averaging is the practice of putting a set amount into a particular investment on a regular basis (weekly, monthly, quarterly, etc.) no matter what’s going on in the market. For example, you could invest $500 each month. In a fluctuating market, this practice lets you purchase addi-

tional shares when prices are low and fewer shares when prices increase. While you’re mulling dollar cost averaging’s potential merits, consider this: You may well be using the strategy already. If you participate in an employer-sponsored retirement plan, such as a 401(k) or 403(b), and contribute the same amount each payday, you’re using dollar cost averaging. Get help for when the going gets tough. One of dollar cost averaging’s greatest challenges is you have to stick with the strategy even when the market declines, and that can be difficult (see our previous discussion about letting emotions control your decision-making). However, during times like these, dollar cost averaging can be most useful by letting you purchase shares at lower prices. Because dollar cost averaging can be simultaneously more difficult and advantageous when the going gets toughest, consider turning to a professional financial advisor for help. He or
she should offer a voice a reason during these periods as you grapple with whether to adhere to the strategy. Like any investment strategy, dollar cost averaging doesn’t guarantee a profit or protect against loss in a declining market. Because dollar cost averaging requires continuous investment regardless of fluctuating prices, you should
consider your financial and emotional ability to continue the program through both rising and declining markets.

After finding an apartment and re-uniting with her children, she started work on her high school diploma, but she did not stop there. Ana Rosa worked toward a certificate in paralegal studies and was able to secure employment with a law office, where she continues to grow her career. “I have come a long way and I am so glad that that I took advantage of the opportunities that were given to me,” says Ana Rosa, whose next goal is to become a home owner.

Once he was able to secure his own apartment with a Section 8 Voucher, he was able focus on studying and tackle some of the toughest subjects like Math and Statistics and joined Garden Grove Housing Authority’s Family Self-Sufficiency (FSS) Program. In May 2018, Tracy received an AA degree in Human Services at Cypress College. Now, his goal is to find a stable employment in Human Services that will give him many opportunities to give back to the community. There were countless takeaways and my only wish is that every single AAOC member was in attendance to experience such a powerful conference. This was my first NAA conference and I was amazed at the size of the event. It’s a huge event, this one being attended by over 9,000 people from across the country. Attendees included; owners and managers, Association staffs and Executive Directors with almost countless vendor booths in the exhibit hall. This is my third year at the National Apartment Association Education Conference and second year volunteering; every year I’m blown away how the show tops the last one. From the wrapped sidewalks displaying “expo this way” throughout Downtown San Diego, and the never-ending expo floor. While volunteering I met some fellow industry peers from the North Valley Property Owners Association. However, the best was listening to Mike Rowe’s General Session. The topic was entitled “Property Positioning”, and included a discussion on Santa Ana rent control as well as the effort to repeal Costa Hawkins, the 1995 legislation that limits rent control from overreaching. his is the time of year that students around the country are preparing to enter or return to school. Who else needs to be educated? For those of us in property management, the answer is everyone: you, me, the general public, property owners, potential, current and previous residents, employees, industry associates and community vendors. We are educated from the time we are born. Other than the things that come to us instinctively, we have to be taught everything else by someone or through our own experiences. Education gives us the power to change our lives

Legacy Planning: Tools and Resources
T
he methods that you use in executing your legacy plan will vary depending upon your vision for the future and the assets that you currently hold. There are also factors related to income or tax issues that might need to be resolved, along with any accommodations to be made for the needs, abilities and goals of your heirs and beneficiaries. Different estate planning and wealth transfer strategies to be considered include: • Making a will with bequests to family members, institutions or charitable organizations • Creating a living or a more specialized type of trust • Purchasing life insurance or changing beneficiaries on existing policies • Establishing a foundation • Funding an endowment • Charitable giving and donations • Gifting to children, grandchildren or other heirs • Forming a family limited partnership There is no one-size-fits-all answer. This is a very personalized process. The important point, as I covered last month in my “Must Includes” article (Apartment News Magazine, July 2018 issue), is that you do something. At a bare minimum, in addition to a Last Will & Testament, you should probably create a Living Trust. Basically,

this is a written legal document through which your assets are placed into a trust. Under the terms of this document, you can continue to manage your own financial affairs during your lifetime. Or, if you prefer, you can designate a family member or a corporate trustee to manage the trust assets with you continuing to receive the income generated by those assets and/or any return on principal that you arrange. For the trust to be effective, you need to legally transfer your assets into that trust. So long as it is a Revocable Trust (and not an Irrevocable Trust), as the creator of that trust, you can later change which assets are held within the trust as well as any of the trust provisions and, even, the entire existence of the trust itself. A Revocable Living Trust often serves as a means of avoiding probate, which usually equates to a faster distribution of assets to your heirs. It additionally provides for a potential savings of probate and other costs; and, also, better protects the privacy of personal information that is apt to become a matter of public record in Probate Court. Be forewarned, however, there are costs involved in establishing this trust as well as potential taxes consequences related to property transfers.

Who might you plan to call upon? • Estate Planning Attorney who can you to structure your legacy plan and make sure that the documents are properly prepared and executed. (Be sure that this individual is well-versed in the laws and rules governing the locality(ies) where your property(ies) are situated.) • Real Estate Tax Specialist who can offer advice as to ways to avoid certain tax pitfalls and, based upon what you are planning to do, alert you as to potential tax consequences. • Financial Planner who might add suggestions in regards to charity giving, life insurance options, and beneficiary designations on retirement and investment accounts. • Non-Profit or Foundation Representative who can inform you as to the institution’s various methods for supporting or endowing a particular charity, university, college, hospital or organization. • Charity Evaluator and Rating Websites serve as a great thirdparty resource for learning more about how your philanthropic giving can best be put to use to create the difference intended. • Real Estate Advisor who can perform not only an estimate of value, but offer assistance in helping to
make sure that your properties are inheritance-ready. Keep that in mind that each expert is looking at your legacy plan from a specific perspective. Always remember that, more often than not, there is more than one way to achieve what you want to accomplish. Listen to the experts, but ask questions and make sure that they understand your goals. Most importantly, don’t overlook your heirs and your family. Just as when consulting with all of your other experts, you need to communicate with those for whom you are crafting your legacy, the dreams and desires that you have regarding their respective futures.
