Be Prepared for the Unexpected
O
n July 4, a 6.4 magnitude earthquake centered in the Searles Valley jolted Southern California. The quake was a foreshock of a quake that would hit the following evening, measuring 7.1 on the Richter Scale, the epicenter of which was near the town of Ridgecrest. The July 5 quake was felt as far north as the San Francisco Bay area and as far south as Baja California. We should all be thankful that no fatalities occurred as a result of these two large quakes. These significant earthquakes underscore the importance of management teams being knowledgeable about their buildings and how to operate essential systems in times of confusion and emergency. Most notably, our managers should know how to turn off gas and water mains, as these utilities will most likely be compromised during substantial seismic events. Owners and staff should also be trained on how to open rolling access gates so residents
and emergency first responders can access your property. Above all, we must be able to remain calm and thoughtful, as many residents will likely be distressed and confused. Interestingly, early reports indicate that structures in the Ridgecrest area, built after the 6.7 Northridge earthquake of 1994, suffered little or no damage. Several months ago, my company began the process of seismically retrofitting a 198-unit complex in North Orange County. This complex was built in the 1980s and has tuck-under parking, also known as “soft-story construction.” Earthquake insurance for this type of construction is remarkably expensive and has extremely high deductibles. Preliminary analysis suggested to me that the seismic retrofits are not only affordable, but also provide the long-term benefits of an improved and safer structure. I will provide you with more information about this particular retrofit in future articles.

In summary, natural disasters, including earthquakes such as these, provide a reminder that we all need to be prepared for events that may occur unpredictably, with little or no warning, in regard to location or intensity. Current earthquake early warning systems such as ShakeAlert are in their infancy but may be able to provide a few additional moments of warning. Even in light of such systems, the best thing you can do is to be prepared by having enough food, water, and medication, stored securely but accessibly, to survive for three days. It is highly recommended that you have an out-of-state contact where family members can check in, seeing as phone service and utilities will likely be disrupted over a wide area. A radio is also highly recommended in case internet access and smart-phones are offline. Keep in mind that Trona, a small community near the epicenter, is still without water service as of the writing of this article. Fresh batteries, first aid kits, and functional flashlights are other essentials. Personally, I also try to keep my gas tank half full, as you could have trouble finding a working gas pump. As the Boy Scout motto firmly reminds us, “Be Prepared!”

Reflections on the NAA Apartmentalize Conference
I
recently had the opportunity to attend my first National Apartment Association (NAA) Apartmentalize conference, along with my fellow AAOC team members Bill Christiansen, Debbie DiBernardo, and Sandy Gimpelson. We were among the over 10,000 multifamily industry professionals from around the country who converged at the Denver Convention Center for three full days of educational workshops and training sessions, leadership development seminars, networking and brainstorming opportunities, and dynamic keynote speakers who inspired, motivated, and entertained. Of course, there was also the truly firstclass trade show that featured hundreds of exhibitors promoting a wide-range of products and services. Walking the expansive exhibition hall was physically exhausting but emotionally exhilarating, as I saw example after example of the technological innovation that is happening in the multi-family industry. The industry is being transformed by a plethora of new
devices, apps, equipment and services that are helping to make the jobs of multifamily property owners and operators easier and more efficient. In addition, these technological advancements are providing opportunities for competitive advantages in the rental market, as properties can be modernized and made even more appealing and marketable to today’s technology-driven prospective residents. What’s more, this technology is becoming more accessible to property owners and operators of all sizes, meaning our entire industry stands to benefit as we see greater adaptation. Equally as impressive as the trade show were the educational and networking opportunities afforded to the conference attendees. More than 80 workshops and seminars were presented over the three days, with there being literally something of professional relevance and value for everyone. Each day offered informative sessions with panel experts addressing a range of topics, including marketing, leasing, maintenance and operations, human resources,
executive management, career development, research, technology and data, industry trends, legal and legislative issues, affordable housing and more. Another notable educational and networking opportunity was the ability for attendees to schedule “brain dates” as a means for industry colleagues to meet each other, share ideas and information, troubleshoot problems and challenges, or provide mentoring or career guidance. The NAA Apartmentalize Conference was an outstanding experience and opportunity for your AAOC staff to acquire and share information and ideas, connect and reconnect with industry colleagues, as well as identify additional resources that will help them continue working effectively and purposefully in the advancement of the association and the member services and programs that AAOC provides. If ever you have an opportunity to attend a future Apartmentalize conference, I would highly recommend it as an investment in your personal and professional growth.

Rent Control Across the Country A Point in Time Assessment of State’s Rent Control Laws and How It Might Impact California
E
very day a new article seems to be published detailing the extreme challenges for Californians in this current housing climate. Stories of rent being increased tenfold are becoming the traditional narrative, even though rental owners know these stories are the exception to the rule. Unfortunately, as we always say, narratives matter and tenant advocacy groups have done a tremendous job inciting their base and organizing support. The result has been over 200 bills introduced by California legislators, but other states are also dealing with these issues, and California legislators are watching closely.1 Why? Because states model states. Legislators will feel emboldened as other state legislatures continue to make substantial reformations to their own housing policies. With a few months left in the first year of this legislative session, amendments are being discussed daily and the efforts of other states illuminates what is coming next for Californians. To truly understand, we should look at how New York and Oregon are tackling the issues in their respective states.

that continues to be in effect to this day.2 Amended a few times over the years, the law was set to expire this year. Obviously, the law was never going to actually sunset. Anything that starts as an emergency and lasts over four decades is just pretending to be temporary, and no one is fooled. So, when the time came to renew the provisions, housing advocates utilized the opportunity to make the provisions far more punitive on rental owners. Legitimate exemptions relating to vacancy decontrol were completely removed, and the ability for rental owners to raise rent has become near impossible.3 The new provisions are comprehensive; and at a minimum, substantially limit the ability to raise rents beyond 7.5% while removing any income requirements. tially limiting the ability for a rental owner to ever raise the rent. New York will no longer permit a rent increase above 7.5% or average of last five years, whichever is lower.5 This number does not include allowances for inflation and increases could be below 7.5% if the rental board has only been allowing 2% increases every year (common in New York). Furthermore, the bill limits local rent control boards from approving any vacancy bonuses or maintenance pass-throughs that not are not in compliance with the state’s requirements. Those pass-through requirements only allow a 2% rent increase for all major capital improvements, and it expires after set amount of time.6 The new law will eliminate vacancy decontrol and severely limit personal use exceptions. For example, one of the more egregious provisions is removing the vacancy decontrol exception for high-earners (consecutive years earning over 200K).7 Previously, rent caps could be removed for tenants making 200K or more for consecutive years, in order to prevent wealthy tenants from abusing the affordable housing provisions. class tenants.8 As groups like the Stanford Business School have suggested that rent control can lead to gentrification, it will be interesting to see how many advocates respond to high-earning tenants getting another opportunity to consolidate their wealth.9 The bill also removes vacancy decontrol provisions that allowed owners an automatic 20% rental increase bonus when the tenant moves out. Regarding personal use exceptions, it is common in California to allow a rental owner to evict a tenant so the owner or a family member can occupy the property. reason.”10 It is unknown how one would define property rights when owning appears to be no longer relevant. The new provisions also create a plethora of ways for tenants to stall or delay being evicted. Before an eviction occurs, the owner is mandated to provide a 14-day notice demanding the rent (on top of additional notices already required to be provided to the tenant). Once the eviction proceeding begins, the judge may provide the tenant with a one-year stay on eviction if the tenant cannot find similar rent in the same area or would face hardships. How a low-income tenant is to find affordable housing when tenants making over $200,000 a year have equal access is unknown, and New York state legislative staff did not address this point during their analysis of the bill.11 10 A8281, supra, 2017-2018 Session. 11 A8281, 2017-2018 Session. The judge’s discretion has received ample news coverage, as many in and out of New York are concerned about how this will be implemented.12 Aside from the judicial empowerment, the tenant is permitted an automatic 14-day adjournment of the eviction to help them find a new home. The tenant can also cure all of this by paying the undue amount on the day of the hearing; forcing rental owners to pay legal fees for what amounts to a delay in paying rent. Finally, the eviction warrant must also come with a 14-day notice (even though the court proceedings and all evictions effort prior would have appeared to create ample notice to the tenants).

Last year, Oregon passed a first-innation rent control law that applied across the state. Part of that law prohibited rental unit increases of 10.3% plus CPI. For context, in California, legislators are considering 7.5% + CPI with a hard cap at 10% (See AB 1482).13 In other words, California is proposing an even more stringent cap than Oregon. Unfortunately, Oregon is already beginning to feel the squeeze. A report by a local news group in Oregon noted that owners are only allowed to raise rent once a year, preventing them from a phased-in approach that would benefit the tenants.14 Instead of addressing the need for less regulations, the state decided to add another band aid to the problem. Specifically, “…overhauling local zoning codes to allow for the production of less expensive housing options like duplexes, triplexes and townhomes. The measure lifts local bans on these denser housing options, paving the way for possible future

development.”15 The bill will be law, as the Governor has been supportive of affordable housing and faces pressure from groups that helped her get elected. Known as House Bill (HB) 2001, the legislation eliminates single-family zoning in large Oregon cities.16 As some have noted, “the bulk of the provisions wouldn’t take effect until 2020, with the extra time intended to allow city planners to revise their zoning code.”17 HB 2001 would require cities with 25,000 or more residents to permit the development of all middle housing types and adds townhomes to the definition of middle housing. Previously, townhomes were excluded from Oregon’s definition due to the difference in how property for townhomes are shared. The state takes a more nuanced approach for smaller cities. Specifically, cities with 10,000 or less are still provided the authority to deny permits for duplexes and above. may seem like a minimal change, but this would be akin to California telling the city of Long Beach they could no longer deny requests for multi-family units, regardless of the specific justifications for said denial. While all cities in Oregon currently permit these types of homes, the underlying implication is that local governments are no longer about to create single-family zoned areas.18 The increase in production could be good for the housing stock, but the market value of single-family homes in these impacted areas are likely to drop significantly. The response by local governments has been mixed, with most not pleased with the new ordinance laws. Lisa Batey, a Milwaukie city councilmember, noted, “The state can’t know what your local infrastructure issues are…One city might have parking and infrastructure issues and one might not. In a state lauded for being too liberal, California is at least taking a more measured approach to the process. As noted above, 200 housing bills were introduced this cycle yet many have already been shelved or removed from discussion.21 Even bills that appeared to have the votes to make it to the governor, such as Senate Bill 50 (Senator Weiner), have been turned into twoyears bills to allow for more discussion. SB 50 would have taken some of the local planning authority from cities and counties, in an effort to increase multi-family housing development. The bill raised too many concerns from both sides; environmentalists were concerned about the streamlining of CEQA requirements and developers realized a 10-story home in a previously single family zone would destroy

the market value for property owners.22 The end result of the bill stalling in the Senate Appropriations Committee is that the remaining bills (about two dozen), no matter how controversial, are being seen as the only chance for resolution. The likely outcome for California is about a dozen bills that take incremental steps and maybe one or two very comprehensive bills. AB 1482 by Assemblymember David Chiu is one of the bills most likely to cross the finish line, given the amount of work that has gone into the bill’s components. Legislators who voted in support of the hard rental increase of cap of 10% felt the bill was preventing gouging, noting that average rental increases are typically 2–5%. of capital improvements or owner protections on problematic tenants, legislators felt the bill was a reasonable compromise to the solution; had the bill not been amended in the Senate, it likely would be law by the end of August. The problem for housing advocates is that they may have bit off more than they can chew; recent amendments now include just cause protections and relocation assistance for qualified tenants (basically the language of AB 1481).23 assembly members supported AB 1482 but never voted on AB 1481, a classic implication that the just cause bill would have died on the Assembly Floor. By Chiu taking a failed bill and putting it into his housing vehicle, some Assembly members will take it as a slap in the face. Whether that aggressive approach will cost housing advocates their “reasonable” package remains to be seen. 23 AB 1482, supra.

over 15 years old; thus, mitigating the protections inherent in CostaHawkins.25 Furthermore, it allows rent increases on rent-controlled properties of up to 15% over three years from previous tenant’s rent above any increase allowed by local ordinance. In other words, vacancy decontrol would be eliminated. The initiative is likely not to pass, given how badly previous iterations have been defeated; however, the threat of this as a ballot measure can be leveraged to amend AB 1482 down to 5% rent increase caps or to ensure the governor signs AB 1482 and other bills related to affordable housing.
Reading the Tea Leaves
The old adage, “When people are free to do as they please, they usually imitate each other,” is especially true for the crafting of legislation. A typical housing bill can take months, if not years, for the elements to be debated and vetted; justifying why many state legislatures choose to copy language from another state. Reinventing the wheel makes no sense when other states have already researched the issue and helped identify the political challenges the bill is likely to face during the process. Media is no longer central to one’s state and knowing that national sentiment is in favor of a certain housing solution weighs heavily on California legislators. New York’s law is infinitely more restrictive than California’s proposed solutions, but that merely means California legislators will feel emboldened to push their compromise. For many advocates and stakeholders, the thought is, “if New York can abolish vacancy decontrol completely, then surely California can place a statewide rent cap on all multi-family properties.” This is likely why Assemblymember Chiu chose to add the language from AB 1481; believing that this bill compared to the solution approved by other states is still a shot across the bow and not the direct attack on rental owners. He may be right, but it will be up to rental owners to demonstrate why the housing situation in California is unique to this state. Based on the efforts of the governor, it’s a hill that rental owners may need to be prepared to die on. The Importance of Having Pro-Private Property Rights Elected Officials in Orange County
T
he AAOC Legislative Committee and the AAOC Political Action Committee (PAC) have been active this year, engaging directly with our local elected officials and preparing for the 2020 election cycle. In this current political climate, we see housing-related public policy issues like rent control, rent freezes, just cause evictions, just cause car-towing, relocation fees, and others being brought up with increasing frequency at the municipal and county levels. The people who we elect to our 34 city councils and five county supervisorial districts are the one making decisions that directly impact our industry. It is critically important that strong, pro-private property rights candidates are elected to office in Orange County. A recent example of the importance of having a pro-property rights majority city council is in the city of Anaheim, which recently broke the record for its longest city council meeting — 3 a.m. adjournment — because of an “emergency” rent control ordinance that was on the agenda. The proposal was placed on the agenda by Councilmember Jose Moreno, who recruited 100 “protestors” to show up at the meeting with preprinted signs and pre-arranged scripts for public comment. The proposal was ultimately defeated on a 5–2 majority vote, led by pro-property rights Anaheim Mayor Harry Sidhu. Our Orange County cities are in direct contrast to many neighboring Los

Angeles County cities, where private property rights are under constant attack by their elected officials. A few weeks ago, the Santa Monica City Council decided rent increases would be limited to 2% this year, with a maximum monthly increase of $44. In June, Culver City’s council voted 4–1 to move ahead with implementing a temporary rent freeze and consideration of permanent caps on rent hikes. The City of Inglewood recently voted for a rent control measure that caps rents at 5% per year, while the Los Angeles County Board of Supervisors voted earlier this year to cap rents at 3% per year in unincorporated areas, for pre-1995 buildings. Our political system is a representative democracy. We elect our officials to make policy decisions and enact laws on our behalf, and we must continue to support local, pro-private property rights candidates. The famous economist Adam Smith said, “The first and chief design of every system of government is to maintain justice: to prevent the members of society from encroaching on one another’s property or seizing what is not their own. The design here is to give each one the secure and peaceable possession of his own property.” It is imperative to involve our AAOC Members in AAOC’s efforts to support and help elect local, pro-private property rights candidates to office. The 2020 election cycle is going to be critically important to the multi-family housing industry and fundraising is

You have every reason to be concerned and are wise to prepare. Our industry, as well as our livelihood, is under attack from all sides. At the federal level, policies implemented by unelected bureau-

crats at the DOJ and HUD a few years back are severely hindering our ability to properly screen applicants. The limitations on the use of criminal background reports, coupled with the changes in the reporting of adverse credit information limits the information available and the tools that housing providers have historically used to effectively screen prospective residents. At both the state and local levels, there is a very real possibility that rent restrictions may be in place in the very near future for the entire state. Although the rent caps being discussed in the halls of Sacramento may seem manageable today, there is nothing to prevent the cpi plus seven per cent proposal (as of this writing) to be changed to cpi plus five, or three, or two …For those housing providers that are already subject to some form of rent control, they are mildly comforted by the wisdom of vacancy decontrol that has been in place since Costa Hawkins was enacted in 1995. Vacancy decontrol, the ability to

reset those rent controlled units’ rents to market upon a vacancy, functions as a pressure release valve, as limited as it is, that provides some relief to the outrageous limitations that full blown rent controls bring. The protections provided by Costa Hawkins are in the cross hairs of many and are currently under assault. Proposition 10, which our industry rallied to defeat last year by over a two to one margin, is already being brought back again for a repeat performance in 2020 as a similar albeit a slightly less onerous version, Prop 10 redux. As onerous as rent controls are, they pale in comparison to eviction controls, just cause eviction ordinances, rent boards, tenant unions, and the requirement to pay relocation benefits to residents who are asked to vacate. Relocation assistance can range from the equivalent of one month’s rent up to amounts in excess of $23,000. Legal Q&A — continued from 16 anything other than an involuntary redistribution of wealth from housing providers to tenants. The assault on housing providers continues with the provision of free legal counsel to tenants facing eviction. What should be a limited and efficient method of removing problematic residents has in many ways turned into a circus, with courtrooms functioning more like a Moroccan bazaar, where the demands from these represented tenants approach unconscionable levels, with the all too common jury demand, all the while encouraged by a judiciary seemingly unwilling or unable to effectively meet out justice as required. The continued assault on Prop 13, the imposition of split roll taxes, the relaxing of the standards and the lowering of the vote threshold to impose parcel taxes, will all adversely affect our bottom lines, and in many cases will adversely affect our property values.
Given the current legislative climate in Sacramento, a super majority in the hands of legislators that historically have not had our collective interests in mind, it is sure to be a rough road going forward, at least for the foreseeable future. Now more than ever before, we must stand united as an industry, and remain united in our fight to preserve our rights as housing providers to continue to do what we do best. As housing providers, we have willingly invested our time and treasure in the provision of the housing stock, of providing the very real and the very necessary housing for the residents of California. Government does not do what we do, there are countless examples of failed government housing projects across the country. We have taken risks over the years by investing and improving the housing stock under our care. Most housing providers are hard-working decent, responsible and caring individ-
uals who recognize the great responsibility that comes with being a housing provider and take pride in what we do. The vast majority are committed to doing the right thing and manage their properties responsibly. As an industry we educate our own, we share our knowledge with the less experienced, we encourage education and training and foster responsible ownership. So how do we prepare for this brave new world approaching? We do what we do best, we perfect our craft, we stay alert and informed about the new rules and regulations headed our way. The game of owning and managing real estate continues, however the rules they are a changing.’ Now more than ever before, thorough tenant screening is an absolute must. Understand that our tools are being limited, however they are still available. Use them. Know that prospect well before you agree to hand over the keys. optional, they are mandatory, they should be utilized in every prospective resident screening and decision process. Be active in the management of your properties, recognize the early warning signs of aberrant behavior, maintain your properties as required, document and record evidence of tenant misbehavior, take pictures of damage caused, document lease violations, keep logs and notes of conversations and incidents with residents. Minimize the use of ‘text messages,’ rather use email or do it old school, actually draft and send letters. Text messages are often reactive, emotional, and not well thought out. Email and letters provide you an opportunity to control the message, affirm your willingness to do as required, and document the tenant’s indiscretions and failure to perform as he or she is required. Maintain control of the communication process. Keep it professional, objective, never make it personal. Ensure that you are properly insured, a general liability policy, coupled with both a personal and a commercial umbrella are absolute must haves. Consider employment practices and fair housing defense coverage as well, as these are generally excluded from basic policies. Consult an experienced insurance broker for review of your existing policies and adjust as necessary. For those that hold multiple properties, as in all investment vehicles, diversity is key. Diversity in type of asset, location of the holdings, and balance. Your investment portfolio should spread the risk inherent in any one particular investment vehicle to multiple asset classes. Now is not the time to be over leveraged, 50 to 60% loan to value can carry you through some rough times. Of course, carefully choose your

My tenants are complaining of too many false alarms from their smoke alarm. This often happens when they are cooking or there is a lot of steam present from a humid bathroom. How far away should a smoke alarm be from both a kitchen and bathroom? Lisa

The general consensus is that a smoke detector should be place about 20 feet from the kitchen and stove area and about 10 feet from a bathroom door that contains a shower or bath. However, this all might change soon. There is a new generation of smoke
alarms on the horizon that will detect smoke signatures and determine a cooking or steam event from a fire event or smoldering synthetic material fire. The UL Laboratories are currently testing this new generation smoke detector and have rules in place that, after 2020, they will only list and recommend the new “Smart” smoke detectors. Hopefully that will be the end of standing on a chair and fanning your smoke detector to stop it from screaming. Keep in mind, regardless of type of the detectors, they should be placed inside the bedrooms, in the hallway and in the living rooms. I have a main sewer line that is causing me a lot of trouble. The plumber is suggesting I have the pipe replaced using a “trenchless” pipe replacement method. Is this a good idea? Will it work? It’s not cheap, either! Ben
Dear Ben:
It really depends on the pipe and where it is on the property. Keep in mind that replacing a sewer line using the traditional method of digging it up and
trenching is not easy, and it may cause major disruption to your property’s landscape. Not to mention, if the pipe goes under driveways, walkways and other obstacles, it could make the job even more difficult. Trenchless pipe replacement is now a tried and true method of pipe replacement. It typically involves a thorough cleaning of your existing pipe, making sure there are no roots, breaks, or disruptions along the pipe. The trenchless system involves the use of a flexible liner, coated with resin, that is blown or pulled into the damaged pipe and inflated. The resin then hardens, creating a pipe within a pipe that is jointless and corrosion resistant. From a cost point of view, trenching, the more traditional way of replacing the sewer pipe, may be less expensive. There are good arguments for both methods, depending on extent of the infestation. If the termites are isolated to one or two areas of the structure, with a high degree of certainty they have not spread, spot treatment is a great option. If the termites are found in many areas of the property, they may be in hidden areas where spot treatment is not effective. In that case, tent fumigation will be the only way to ensure the termites are eradicated. If you are in a real estate transaction, we would almost always go with fumigation, just for peace of mind. Great Wolf Lodge in Garden Grove. The first step in being successful is to determine what resonates with you and then carve out the time to brainstorm with yourself, in writing, and determine how you can implement what you want to achieve. This necessitates focusing on your weaknesses —what is

Marie Kaplan Appointed to AAOC Board of Directors

he Apartment Association of Orange County (AAOC) is pleased to announce the appointment of Marie Kaplan as the newest member of the Board of Directors. Kaplan was appointed by a unanimous vote of the board in June and was formally seated in July. Kaplan has more than 25 years of experience in the multi-family housing industry, beginning her career as a leasing consultant and working her way up
to regional property management for the better part of the past decade, with companies including Advanced Management Group, Western National Group, and ConAm Group of Companies. Craig Kirkpatrick Reappointed to AAOC Board of Directors
T
he Apartment Association of Orange County (AAOC) is pleased to announce the reappointment of Craig Kirkpatrick (Morgan Skenderian Investment Real Estate Group) to the AAOC Board of Directors. Kirkpatrick was unanimously voted back to the board in May, after having stepped down last year to serve as the association’s interim executive director. He was first appointed to the board of directors in 2009 and
served as AAOC president in 2017 and part of 2018. Kirkpatrick recently joined Morgan Skenderian Investment Real Estate Group, which focuses exclusively in the sale, exchange and disposition of multifamily properties. His career, however, has spanned all aspects of the multifamily housing industry. He started in multi-family brokerage more than 30 years ago with Ronson Realty Investments and has been an apartment broker with
large companies, as well as his own company, Multi-Units Brokerage, Inc. Kirkpatrick was also an on-site apartment manager early in his career and later owned and operated a property management company. Renters Now Have More Options to Go Solar

A new state program makes solar a reality for more Southern California Edison customers.
R
enters often don’t have the chance to benefit from rooftop solar. This is especially true of renters who live in areas suffering from the worst air pollution. There’s good news, though. Several state programs now let renters benefit from clean, solar energy. Qualified customers can receive solar energy through the state’s new Solar on Multifamily Affordable Housing program. Southern California Edison apartment owners in environmentally
impacted neighborhoods can receive incentives to help install new solar systems. In turn, tenants living in those buildings reap the rewards of clean, affordable solar energy. Tenants and building owners receive credits on their utility bills from the electricity generated by the solar panels. “Southern California residents who live in areas with the worst air quality, and would benefit the most from clean energy, often don’t have the chance to
benefit from clean energy programs and technology,” said Jessica Lim, SCE’s principal manager of Product Management. “SOMAH will give more of our customers access to clean solar energy.” Qualified customers can receive solar energy through the state’s new Solar on Multifamily Affordable Housing program. With both options, SCE purchases additional clean solar energy on behalf of Green Rate customers. The solar energy comes from California solar providers located in SCE’s service area. Customers can sign up for a Green Rate online or by calling 1-866-701-7867. They can de-enroll from the program at any time without penalty. Finally, customers have the option to take part in renewable energy projects in their community through SCE’s Community Renewables Program. Earlier this year, SCE signed the first solar developer, SharedSolarCA, to this program.
The SharedSolarCA community solar project will be in Lancaster. It will provide 3 megawatts of solar energy, enough to power more than 1,000 homes. The project is expected to be fully operational in December. Interested customers may sign up to receive solar energy from SharedSolarCA’s Lancaster community solar project through its website. Through SCE’s Green Rate, customers can opt to use more renewable energy to power their homes and businesses. When customers choose a Green Rate, they help reduce greenhouse gas emissions because they are using carbon-free energy sources. While California’s electricity has become increasingly green, it still accounts for about 19% of the state’s greenhouse gas emissions. Residential and business customers have two Green Rate options to choose from: a 100% renewable energy option and a 50% renewable energy option.

Maximizing Your Real Estate Return: Cash Flow or Leverage?
M
any apartment owners who started investing in multifamily income properties during the ’70s, ’80s and early ’90s understood the value of using their equity along with other people’s money (i.e. leveraging an existing property to buy another). However, when the market took a significant downward shift, investor’s appetites towards leverage soured. In 1990, the average cap rate of Orange County income properties (3–24 units) was 6.3%. Over the next few years, cap rates rose steadily to a high of 9.6% in 1997. Concurrently, rental rates flattened and vacancies grew. Cash flow was tight and many owners were forced to sell at dramatically reduced returns. As a result of this market shake up,
many surviving owners focused on paying down debt and holding on to their properties as best that they could. Eventually vacancy rates dropped and rents increased. Cash flow was now healthy and owners were happy with their new safe strategy. But is that really the way to build wealth? When I worked with my father on his book, Cash In on the Myths of Real Estate, we took a look at the trends and what was actually happening in regard to ROI (Return on Investment). The reality is that a property with little or no debt provides, on average, a 1% to 2% cash-on-cash return. Even as property values continue to rise, until that gain in equity is taken off the table, it does not exist. If the market shifts, there is a risk in circumstances forcing

a sale much lower values and that gain is lost. Those investors whose properties now carry little or no debt, rarely see themselves as having to sell. Over time, their focus shifted from wealth building to wealth preservation. And, to them, continuing to hold on to properties that are generating an acceptable cash flow is the safest course of action. This is a common and dangerous myth. Older properties often have significant deferred maintenance issues that potentially carry massive financial and, even, legal ramifications. By not improving or maintaining a property, it eventually becomes more and more difficult to raise rents and attract quality residents. Frequently the entire neighborhood begins to degrade and values
6-6 I am maximizing the return on my investment. Popular Belief: The best way to make as much as you can from an income property is to maximize rents and reduce expenses. Bill’s Truth: Focusing on the higher rents and reducing expenses is critical to running profitable properties. However, to really optimize your return, you need to look at return on equity. Your equity in your property should be considered money in the bank. A fully paid-off property is good for security and cash flow, but not necessarily the best way to ultimately build wealth. Your equity can help you acquire multiple properties. Consider using a portion of your equity to add more properties to your portfolio. Cash In: Make sure your equity is working for you.

With the Orange County real estate market shifting, now is the time to talk with your trusted advisors. In last month’s issue of Apartment News magazine (July 2019), I talked about 1031 tax deferred exchanges and various opportunities. Among those that I mentioned are large, Class A apartment communities held in properly structured Delaware Statutory Trusts. These DST’s are just one of a number of ways to increase security and improve your return. At the bottom line, maximizing your return is a key component of not just wealth building, but also of wealth preservation. Take the time to explore your options and take action as needed. Protecting and restoring a buildings’ “envelope” is crucial to the long-term viability of the building. In construction, the physical enclosure of a building and environmental separator is referred to as the building envelope. The building envelope usually consists of its roof, subfloor, exterior doors, windows, and exterior walls. From wind and rain, a building envelope needs to be able to withstand the elements. In addition to the building envelope, cracked and deteriorating decks and balconies can also cause water intrusion issues such as wood rot, mold, and structural failure of the deck or balcony. Cracked stucco can cause several types of damage from water intrusion including swelling, wood rot, mold, paint failure, and further cracking. Acrylic paint, found mostly on all apartments and condominiums, is 5–8 mils thick. Ultraviolet rays remove 1 mil of thickness of an acrylic paint every year. Used to restore a weathered painted stucco building, an elastomeric wall coating is 12–16 mils thick, bridges cracks in stucco, and waterproofs the building.
