PRESIDENT’S MESSAGE B y F rank A lvarez P resident

Reflections

A

s we near the end of summer and look forward to the fall of 2020, many things come to

mind. For me, August, the end of summer, is always a time for reflection. It may be that August is my birth month and I am not sure how to feel about being another year older, which causes me to take inventory of the previous months. Reflecting on the previous months undoubtably leads me to evaluate my life in general, my accomplishments, contributions, and shortcomings, both personal and professional. Then there is that bucket list that I need to get to! Mostly, I am glad to have reached another milestone. As we age, our views on life and success change depending on how long we have been a participant in the rat race, or whether we have accomplished our goals and attainted the measure of success that we hoped for. One of the many benefits of being a member of the AAOC has been learning from the trials and errors, and the risks and rewards, of others. Throughout the many years I have had the privilege of engaging our members in great conversations, receiving edification from their counsel, and observing living, breathing examples of what it takes to be successful as both a housing provider and business owner. Whether it is at a General Membership Meeting, networking event, seminar or other education program, I have learned about our members as individuals and

their operations. I have learned so much from the novice and experienced professional alike. I use their experiences as both a learning and teaching tool that I can share with others in our industry. So, as I look back and consider the years of participation in our association, I am thankful to all those who have come before me and preserved our great association for the benefit of the future generations of housing providers, Product & Service Council members, and the rental-housing industry at large. Over the years, I have made friends, found mentors, and been inspired by individuals, and have also been fortunate enough to be the same for others. As my list of priorities evolve with age, one thing has remained a constant, my membership and participation in the Apartment Association of Orange County. My involvement as a member and service as a committee member, committee chair, and association board member has allowed me to educate myself in all things “Housing Provider” via the wealth of knowledge and experience of my peers. Through their mentorship, I realized that the currency of knowledge and experience is not for the keeping but to share freely and altruistically for the benefit of all. Thankfully, for me, teaching and sharing comes naturally, and I am an open book for all to read. It pains me that in today’s COVID19 climate many of us do not have the opportunity to meet in person and share our experiences through personal

interactions or have meaningful conversations that can lead to new friendships, business relationships or mentorship opportunities. This is why I want to encourage you to participate in the many online programs, virtual meetings, and webinars the AAOC is offering. It is my hope that in the absence of face-to-face interaction technology can help us bridge the gap and bring us together in different ways. 2020 Trade Show & Conference Cancelled

A

ugust marks sixth months since our lives began to change due to the COVID-19 pandemic. This period of uncertainty in which we find ourselves has brought forth in us a wide range of emotional and physical responses: concern, fear, hesitation, disappointment, sadness, frustration, anger, skepticism, and distrust, to name a few. Life, as we know it, has been upended and conditions continue changing on what seems like an almost weekly basis. None of us know when the current conditions will stabilize and a “new normal” will begin to take shape. However, I think we can agree that there will be a “new normal” and that it will necessitate flexibility in what we do and how we do it. As you are aware, the COVID-19 pandemic necessitated the postponement of the 2020 AAOC Trade Show & Conference, which was originally scheduled for March 27 at the OC Fair & Event Center. The show was resched-

uled for September 10, a date by which we believed conditions would have improved enough to allow the show to go on. Unfortunately, this scenario has not played out as we had hoped and therefore the decision has been made to cancel this year’s show. The health, safety and overall wellbeing of our trade show exhibitors, attendees, sponsors, seminar speakers, staff, volunteers, and others was AAOC’s priority when making this decision. However, also important was the consideration of our ability to present a show that would generate strong attendance for our exhibitors and seminar speakers; foster in-person relationship building and business development between our exhibitors and attendees; allow our exhibitors to provide realtime demonstrations of their products and services; and serve as a community-building event for the Orange County rental-housing industry. Current conditions, constantly evolving public health directives, and varying personal comfort levels and company policies regarding public gatherings simply does not make this possible at this time. So, at this point, AAOC now looks ahead to next year with hope and optimism that the trade show will be able to return, bigger and better than ever. To that end, I’m pleased to announce that the 2021 AAOC Trade Show & Conference has already been scheduled for Thursday, April 4, 2021, at the OC Fair & Event Center.

Those of you who know me know that I’m a “silver lining” kind of guy who is typically going to find something positive to come out of an otherwise negative or disappointing situation. Well, here we go. I’m also pleased to announce that AAOC is in the process of rescheduling its trade show seminars and presenting them as part of an online “Day of Education” later this fall. If you have enjoyed participating in AAOC’s general membership meetings, educational programs, and social gathering over the past few months via Zoom, this will be another opportunity for you to log on and bring AAOC into your home or office. So please keep your eyes open for official event details in the coming weeks via email and social media, as well as in the next issue of Apartment News. Despite this year’s trade show being cancelled and the difficult times we are facing due to the COVID-19 pandemic, our rental-housing industry remains strong. I

n just a few years, multiple local governments and the state of California have remarkably changed the manner, complexity, application and type of laws imposed on rental housing. One law is built on another. Restraining the operation, income and expense, management, decision to remain in business, and now the sale of all rental property are issues presently before us. Ability to provide valuable input regarding the significant changes in law and policy are severely restricted. Academic research regarding proposed changes in law have become secondary. Comprehensive resolution is driven by emotion. One state senator excoriated rental-housing owners and managers for

causing homelessness, and the severe lack of affordable and available housing. Local governments are encouraged to adopt more restrictive landlord and tenant laws. This is fact, not fiction. For example, in response to the COVID-19 pandemic, our governor encouraged local governments to adopt eviction moratorium ordinances. In response, over 200 cities and counties responded accordingly. At the state level, the California Judicial Council adopted 11 emergency rules on April 6, 2020. One of those rules indefinitely blocks evictions. Members of the state legislature introduced several amendments to bills in the closing days of this years’ session. Some of the bills would impose a pro-

hibition on unlawful detainer actions for any default in the payment of rent by any tenant claiming to be adversely affected by COVID-19. This article will focus on one issue that will affect the sale of all residential rental property. AB 1703 (Bloom) proposes to require rental real property owners to offer their property for sale to local governments and specific nonprofit entities before offering it for sale to any other entity. This remarkable proposed change in law will only have one policy hearing at which opposition testimony will be limited to a total of 4 minutes. AB 1703 would require an owner of residential real rental property, prior to offering the property for sale to any


purchaser, soliciting any offer to purchase the property, or entering into a contract for sale to notify every “qualified organization” of the owner’s intent to sell the property. Organizations that would be qualified includes every local government and defined non-profit entities (a California corporation whose “primary activity is the development and preservation of affordable housing). Each of these organizations would be given 10 days to notify the owner of “expressing an interest” in purchasing the property. Then, the owner would send a disclosure package to the entity. The entity would have 20 days following the receipt of the disclosure package to request a meeting with the owner to “confirm interest in purchasing” the property. Then, the entity would have up to 40 or 60 days (depending on the number of dwelling units) to submit an offer to purchase. Owner’s would be strongly encouraged to sell to the qualified entity. If an offer to purchase is not received in this time frame, an

owner may proceed to sell the property in the open market. However, offers to purchase by a private party would be required to be disclosed to qualified organizations. Those organizations would be given a first right of refusal by matching the private party offer. In our opinion, AB 1703 creates an impractical restraint on alienation of private property by mandating a restraint on sales for respective time frames that effectively prohibit an owner from the conveyance of a residential property. The bill essentially stops an owner from freely alienating their property without first submitting to a procedure that unreasonably delays the transfer of the property. This potentially results in an extreme diminution of sale of value. AB 1703 proposes to mandate a lengthy and complicated procedure that would permit a “qualified organization” (any city, county or non-profit) to purchase residential rental property before that property could be sold to any other entity.

The lack of specificity in defining the criteria that establishes a “qualified organization” fosters an environment for abuse. The bill also lacks objective criteria used to evaluate the status and/or merit of the qualified organization. AB 1703 does not take into consideration the practicalities or principles of commercial transactions. The organizations would be given the right to halt a valid sale to a private party and be given preferential consideration in the sales process without being required to pay a financial consideration. ORANGE COUNTY LEGISLATIVE WATCH B y B ill C hristiansen , V ice P resident of G overnment A ffairs

Three Months is a Long Time in Politics

T

he General Election on November 3 is less than three months away, but that is a lifetime for candidates, consultants, volunteers, and others during election campaign season. As we have already experienced multiple times in 2020, anything can happen in three months. As we get deeper into campaign season, keep your eyes open for AAOC’s list of endorsed, pro-private property rights candidates. After careful evaluations by the Legislative Committee, AAOC will endorse and its political action committee will contribute to a number of local and state candidates who support private property rights and the multi-family housing industry. The list will be disseminated to the AAOC membership via email and published in Apartment News. The Legislative Committee will also establish housing-friendly positions on state ballot propositions and any local initiatives in Orange County that could affect our industry.

The candidate filing deadline for local elections is August 6. The Legislative Committee will then send questionnaires to the candidates and conduct endorsement interviews, after which its list of endorsed housingindustry friendly candidates will be finalized and published. AAOC will also be leading the Orange County rental-housing industry’s effort to defeat Proposition 21, the statewide rent control initiative on the November ballot. Much more information about the campaign will be included in this publication, on the AAOC website, posted on social media, and sent to members via email. As you may recall from last month’s article, California is having its first entirely statewide vote-by-mail election this November. Ballots will be mailed to all registered voters starting October 5. time to review the list before the ballots need to be completed and returned to the Orange County Registrar of Voters. Counting the votes will not end on Election Night. In fact, the Orange County Registrar of Voters has until December 3 to make sure all ballots cast are counted. There will be thousands of ballots needing to be counted during this presidential election year, including mail-in ballots received up until the Friday after Election Day, provisional ballots of voters who registered on Election Day, write-in ballots and damaged ballots. These ballots will be counted during the 30-day period known as the Official Election Canvass. High voter turnout is anticipated for this election and we need every AAOC member to get their vote in on time. Questions & Answers I just closed escrow on a small building and I’m trying to figure out who’s who. I received the rental agreements, but the tenant information seems incomplete. The applications, the few that I’ve found so far, are old and outdated. I can’t seem to find any telephone numbers for the residents and I’m not real sure that the names on the agreements are the same people who actually live in the units. I’ve read your articles before and I know the importance of reviewing the files and doing thorough due diligence before closing escrow, but this deal just happened too fast. Now that I’ve closed escrow, what can I do to clean up the records?

First things first, figure out what you know and what you don’t. Establish individual tenancy files, one per unit. Based on the limited information that you have, write down the names and ages of the occupants, the terms of the rental agreement, written or oral, lease or month-to-month, rental rate, deposit on file, date paid through. Compile whatever contact information you have, home phone number, work and cell number. Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the informa-

tion in your files, and gathering any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues, than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new monthto-month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixedterm leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is nonrent control, and a month-to-month tenancy, the rental rate and term can be set with either a thirty- or sixty-day notice of change of terms, depending on the extent of the change. It seems like my rental forms are getting

longer and more complex. I’ve read in your previous articles of several disclosure forms that should be given to my residents. Can you summarize these forms for me so that I can be sure I’m doing it right?

Sure, remember this is California, the most litigious state in the country, so the following list is not static, it will change and no doubt expand over time. If the rental unit was built prior to 1978, the housing provider must disclose the presence of known lead-based paint and lead-based paint hazards in the dwelling before the prospective tenant signs the rental agreement. You must also give the prospect a copy of the federal government’s pamphlet, “Protect Your Family from Lead in Your Home.” The pamphlet is available through your apartment association or by calling 1-800-424-LEAD. Housing providers must also provide a copy of the notice received from their pest control provider detailing the pesticides to be used in an initial or periodic maintenance program. Residential property built prior to 1981 may contain asbestos. Although not specifically required, unless you have ten or more employees, it is strongly recommended that housing providers advise their residents of the presence of asbestos and further inform them of the proper care of asbestos material. All housing providers with ten or more employees must disclose the existence of carcinogenic materials to prospective tenants. The owner of a dwelling who knows that an illegal controlled sub-


stance, such as methamphetamine, LSD or its components, has been spilled or dumped on or beneath the dwelling must give a prospective tenant written notice prior to him signing a rental agreement. The owner of a dwelling who has applied for a permit to demolish the dwelling must give written notice of this to the prospect, and it must state the earliest possible date that the tenancy will end. Additionally, if your rental unit is located within one mile of a closed military base in which ammunition or explosives were used, you must give written notice prior to signing the rental agreement. Additionally, your rental agreement must contain certain specific language informing your new resident of the availability of the statewide database of registered sex offenders. As of July 1, 2020, all new rental agreements must contain statutory language as to whether or not the Premises are exempt from the new rent limitations and just cause eviction requirements. If you are not a member of your local apartment association, you should certainly consider it. Use the association’s forms, as keeping up with all of these laws and requirements will boggle the mind! I expect a vacancy to be coming up at the end of the month. I started advertising the unit and I put a sign in the window. Luckily, I’ve already received quite a few applicants. There are a few that sort of qualify, and I guess I could rent to one if I had to, but I’d like to continue with the ad and get a few more prospects to choose from. The thing is, this one applicant is getting pushy. She calls me several times a day, says that she knows she is qualified, that I have to rent to her because the unit is still available and she was the first to apply. Truth is, she probably does qualify, but I’m just not sure. I haven’t actually denied her, nor have I accepted her. I just need more time. Do I have to rent to her because she was first to qualify?

No, there is no requirement to rent to the first person to meet your criteria — yet.

There are misguided efforts to require us to do just that. Fortunately, they have not yet become law here in California. You are free to continue and accept additional applications from other candidates. From the pool of applicants, you may select the best and most qualified applicant, without regard to timing of receipt of the application. Often an owner will have a single vacancy and have many qualified applicants to choose from. A thoughtful review of all applicants and their qualifications will allow

you to select the most qualified tenant. Don’t let the pushy prospect bully you into making a premature decision. Street parking spaces are few and far between near my building. My apartment complex has just enough parking spaces for my residents to each have one space. If a resident has more than one car, they must try to park it on the street. Your community rules and regulations should specify your parking rules, specifically stating that only one vehicle may be parked on the premises, and that all

parking is assigned. Ensure that you have the proper signage at the entrances to the parking area. Most cities require the sign to contain certain restrictive parking language, plus the local police department telephone number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for its specific requirements, as they vary from city to city. Next, if you know the offender, then provide a written warning of the violation. Attempt

to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield of his car. If practical, take and save a photograph of the warning on the vehicle windshield, because the offender will always claim that you did not give prior notice before towing. If he fails to remove the offending vehicle, the car may be towed. I rented an apartment to four roommates quite a while ago. One of the four is now moving out, but the other three want to stay. The one moving out is demanding that I return his portion of the security deposit, he says that he paid it so he should get it back. Do I have to?

No, the security deposit remains with you as long as any of the roommates remains in possession of the rental unit. Often, owners and residents will enter into an agreement replacing one resident with another, thereby removing the one original resident from the lease. The agreement will further provide that the ‘new’ roommate pay the ‘old’ roommate his portion of the security deposit. Absent a written agreement to the contrary, the owner should retain the entire security deposit, then when all the remaining roommates vacate, the refund check should be made payable to all four of the original roommates named in the rental agreement. Dear Maintenance Men:

I have a nine-unit apartment building with a 100-gallon water heater that serves all of the residents. The problem is that only the about three-quarters of the units closest to the water heater get any hot water. The units at the other end of the building get warm or cold water. The heater seems to be working and producing hot water. How do I solve this dilemma? David

Dear David:

Sounds like your circulation pump is not working properly. Calcium or hard water deposits in the water heater and lines may also aggravate this problem. The circulation pump’s job is to bring hot water to all the units at the same time. When the pump is not working or is clogged, the hot water will take much longer to get to the units furthest away from the heater. The first step is to determine if the pump is working. Locate the pump near the water heater and check that the motor is plugged

into an electrical outlet. Next, touch the water lines on either side of the pump and determine the temperature. If it is working properly, the lines should be warm or cool to the touch, not hot. If the pipes are hot or very hot to the touch, the pump is not working properly. If the pump does not spin when plugged in, it may need to be replaced. If the pump motor is working, the pump may be clogged with debris. Remove the pump and clear out the lines. Take care to clean the line from the pump to the water heater. This is generally the problem. While you have things apart, this is a good time to clean out the calcium deposits in the water heater. Water heater clean outs should be done at least once a year depending on the hardness of the water in your area.

Dear Maintenance Men:

I am the new owner of a four-unit apartment building, and I have experienced repetitive sewage backups since I purchased the building about

a year ago. I am retired and do not have deep pockets. The plumber I use keeps urging me to install a 4-inch main line clean out, camera, and other things I don’t think I need. Why can’t the plumber just rooter the thing right? Maryam

Dear Maryam:

Your plumber is giving you good advice. Using the camera will determine exactly what the problem is and will help you decide the best course of action to solve your plumbing problem. The 4-inch clean-out will be your best bet to keep your drains clear on a preventive maintenance basis. We would follow the advice of your plumber and preform the following: 1, Hydro-jet — To clean your main line thoroughly 2. Camera the main sewer line to determine the actual cause of your problem (e.g. Roots, pipe break or crack, pipe collapse, etc.) 3. Install a 4-inch main line clean out with street sweep. Note: It may be necessary to install the 4-inch main line clean out before you can perform #1 and #2. This work may not be cheap, but in the long run you will benefit from lower plumbing bills, late night emergency calls, and happier residents.

I have a problem with moisture buildup and wall damage in my apartment bathrooms. The bathrooms do not have windows as they are constructed away from any exterior walls. They do have vent fans, but they don’t seem to do the job. How can I solve this problem? Bill

Dear Bill:

The first thing to check is whether your vent fans are working and not clogged with lint or dust. If the fan is operating properly, check the Cubic Feet per Minute (CFM) of air movement. The minimum number should be 50 CFM. If the bathroom is getting more than the average amount of use, you may want to replace the existing fan with one that has a higher CFM rating. We recommend using at least a 120-CFM fan.

Equally important, many bathrooms have two wall switches; one for the light and the other for the fan. If this is the case, we recommend combining the two switches into one. That way when the resident switches on the light, the fan will come on automatically. We find most residents will not turn on the fan if it has its own switch.

Select the Right Earthquake Retrofit Company

A

re you worried your apartment building may be seriously damaged in a major earthquake resulting in casualties and loss of your future income? If so, doing the proper homework will get you off on the right foot towards a successful earthquake retrofit project. The most important part of the process is selecting the right construction company to do your engineering design and construction. It’s very important to know if the companies you are considering are experienced in the type of specialized work you need done. Getting the answers to the following questions and many others will help you avoid the type of construction nightmares seen too frequently in the industry. • Are they properly licensed? • How long have they been in business? • How many similar projects have they constructed? • Are their customers satisfied? • Do they have a stable workforce? • Are their employees experienced in the jobs they perform? • Does the company have the necessary liability and worker’s compensation insurance necessary to protect you? • Is the company responsive to your

Apartment Management in a Post-COVID World

I

n the world of COVID-19, everything has changed for apartment owners, property managers and residents. With each California county and city employing different regulations for sanitation protocols, common area rules and essential maintenance services, the traditional routines of apartment management have been turned upside down. Common questions include: Can you open common areas and pools? How do you safely employ maintenance vendors and service providers? Could doing so put your residents at risk? How should you respond if a resident contracts COVID-19? If you’re an apartment owner, you likely have countless questions like these. Below are some of Sullivan Property Management’s best-practices for property operations in a postCOVID world.

Create a “Pandemic Plan”

Sullivan Property Management has now instituted a pandemic plan to ensure the safety and well-being of residents, employees and vendors. When developing your pandemic plan, decide on the objectives that are appropriate for your building, including: • Sanitation protocols to reduce the spread of infection • Continuity of property operations including common areas, building amenities, maintenance and leasing

• Communication protocols for residents, employees and vendors The CDC has published several best practices for sanitation and COVID-19 prevention guidelines which can be found on their website. It is also important to check with your specific city, as many COVID-19 regulations vary based on location.

Safety is Priority

Clearly document and communicate cleaning procedures and COVID-19 related protocols that you are employing to ensure the safety of residents and staff. It is also important to clean hightraffic areas and pools often. If applicable, temporarily close all non-essential common area amenities and remove any common area furniture to discourage social gatherings.

Perform Emergency Maintenance Repairs Only

As an essential service, property managers and owners are legally permitted to perform their work even if it requires face-to-face interaction. That said, it is important to communicate that during the COVID-19 state of emergency, all non-essential maintenance will be temporarily suspended. Examples of essential repairs include: • Leaking pipes or water heater malfunction • Leaking roof

• Inoperable furnace or air conditioner • Inoperable kitchen appliances • Backed up plumbing or sewage drains • Power outage In the event unit entry is required, all personnel should be instructed to wear gloves, masks and maintain a safe distance. It is also suggested, but not required, that tenants stand outside, while personnel are working in the unit.

A renter in my building is infected with COVID-19. What can I do?

Property managers and owners are legally not allowed to share another resident’s medical condition or disability with other renters. In the event you are alerted that one of your residents has tested positive for COVID-19, an appropriate response would be to further increase cleaning efforts and help county public health officials with contact tracing. In closing, while there is no perfect solution for managing apartments during a pandemic, you can help limit your risk and property liability by following the above guidelines. You will also demonstrate your commitment to your residents and their well-being. Done right, your actions today will be remembered and appreciated by your residents long after the pandemic subsides. Go to www. sclb.ca.gov, click on “check a contractor license,” search for the business name, click on the appropriate license number, then scroll down to the section dealing with workers’ compensation. Click on “workers’ compensation history.” If the posting states “exempt” click on the word for an explanation. Typically, this means that the company owner lists himself as the sole employee, and that no workers are insured under worker’s compensation. Without worker’s compensation, apartment owners may also find themselves on the hook for: • Liabilities associated with death or injuries of subcontractors or workers hired under the table • Financial liens filed against your property if the general contractor does not pay his subcontractors or laborers. Remember that general liability for contractors is based on a specific trade classification. Be sure that the company you hire is insured specifically for seismic retrofit work. If not, insurance companies may try to reject claims of

Multifamily Update: Delinquencies Low and Sentiment High

A

s real estate investors, we are always on the lookout for more and better data to help us make informed investment decisions. Over the past few weeks, there has been a slew of new data that multifamily investors must understand and digest. Much of this data is positive, which means holders of well-producing multifamily assets are in an economically advantageous position despite the ongoing pandemic. Here’s an overview of this new multifamily data, the impact of delinquency and sentiment on investors in this asset class, and the positive long-term trends in this sector.

Multifamily Delinquencies

According to the Mortgage Bankers Association’s (MBA) latest Commercial/ Multifamily Delinquency Report, delinquencies for the multifamily sector remained low. For instance, delinquency rates for the first quarter of 2020 in the commercial mortgagebacked securities (CMBS) category of

loans sat at 1.79%. This rate was at 2.07% in the fourth quarter of 2019, and at 2.61% in the first quarter of 2019. By way of historical comparison, this delinquency rate was 4.53% by the end of 2016, showing a robust lending sector even heading into 2020. Jamie Woodwell, the MBA’s vice president of commercial real estate research, commented on the news, noting, “This year’s first quarter marked the end of a long period of extraordinarily low and stable delinquency rates for commercial and multifamily mortgages.” Woodwell furthers, “With the onset of the COVID-19 pandemic and our social and economic responses to it, more recent data from MBA and others show increasing pressure on delinquency rates, particularly for loans backed by hotel and retail properties —where the impacts have been most immediately and dramatically felt.” It will be critical to keep an eye on delinquency rates moving forward as many real estate asset classes and inves-

Multifamily Sentiment

The Commercial Real Estate Development Association (NAIOP) released its June Coronavirus Impacts Survey results, showing strong sentiment toward multifamily acquisitions and development. According to the survey, the proportion of respondents who reported multifamily building acquisitions and development increased from May to June 2020. Specifically, reported multifamily acquisitions jumped since May, from 35% to 49%. That said, the recent National Association of Home Builders (NAHB) Multifamily Market Survey (MMS) found that confidence had weakened in the multifamily market in the first Delinquencies Low — continued on page 32

According to NAHB Chief Economist Robert Dietz, “Like other sectors of the housing market, the multifamily market has been greatly affected by the effects of the pandemic.” “On a positive note,” he added, “while multifamily construction has slowed significantly in the spring, rent revenue is coming in above some market participants’ expectations from a few months ago.” It will be critical for multifamily investors to keep an eye on secondquarter results from NAHB to keep a pulse on market sentiment.

Multifamily rents are another positive indicator of the health of this sector. According to the National Multifamily Housing Council (NMHC), 77.4% of renters had paid rent as of July 6. This is only a 2.3% decrease from the same time last year, despite the significant

economic headwinds facing most renters. This also compares to 80.8% of renters who had paid by the same time in June. Doug Bibby, the NMHC president, notes, “It is clear that state and federal unemployment assistance benefits have served as a lifeline for renters, making it possible for them to pay their rent.” “Unfortunately,” he added, “there is a looming July 31 deadline when that aid ends. Without an extension or a direct renter assistance program, that NMHC has been calling for since the start of the pandemic, the U.S. could be headed toward historic dislocations of renters and business failures among apartment firms, exacerbating both unemployment and homelessness.” As such, keep a close eye on the data for August and September rents as federal subsidies end and economies slowly reopen.

Analysis: The Covid-19 Emergency Should Not Lead To Rent Control

R

ent control in New York City began a hundred years ago as an emergency measure. Then it was overturned. Then it was brought back as part of price controls established during World War II, because there was an emergency. But 80 years later, New York City still has rent control. The almost century long maintenance of the policy is illustrative of how emergencies, real or not, can spawn interventions that long outlast the emergency. The endlessly beguiling temptation of trying to fix or democratize prices is once again dancing in front of politicians eager to please during COVID-19 response. I am a visiting fellow at The Foundation for Research on Equal Opportunity (FREOPP) and they have published my analysis of rent control with some updates for COVID-19. The COVID-19 crisis could end up leading to price controls on housing that outlive the pandemic. Already in many states, including my own state of Washington,

state and local government have imposed price freezes on residential and commercial rents. One can easily see, based on the history I cover in the analysis, how these freezes may become permanent, and lead to making eviction bans permanent too. In sharing this latest version of the analysis, I think it is important to emphasize two points. First, that consumers and governments want prices to stop going up — right now — is as understandable as passengers in an airplane wanting extreme turbulence to stop. In both cases, turbulence is not only uncomfortable it also feels life threatening. Inflation is most consequential to people who have fewer real dollars in their pockets or bank accounts; when prices “skyrocket,” these people and families lose the value of their dollar disproportionately. Inflation in housing in particular, undermines the social fabric, creating a feeling of uncertainty and crisis in households already deal-

ing with other financial hardships. Second, the notion of democratizing price is something I highlight as a rationale behind price control. This is an entirely rational instinct and one that, on its face, might make a lot of sense if one believes that price is set by individuals or groups. The notion that housing price is fixed by a cabal of wealthy property owners is a common one, best illustrated by the myth of the empty apartment building. Wealthy people from China buy up property with cash, empty residents out of buildings, then because they’ve emptied so many units, the reduced supply means prices go up — then the owners can gouge desperate people on the verge of homelessness. This myth is a myth in the worst sense of the word — it is more of a fever dream of a peculiar set of socialists. It is completely false — and racist. But if

one believes that price is set this way, then it makes sense to hold an election, have some people appointed by elected officials to sit down in a room and set price instead of the dark and shadowy figures that set it now. If price worked like the myth, I’d be the first to agree. But it the price system decidedly does not work like that. To return to the airplane analogy, price is nothing more than an altimeter, an important and useful measure. Knowing one’s relationship to the ground is critical successfully surviving a trip in an airplane. It would be stupid to shake a fist at the altimeter and the people behind it while it is reading out something we don’t like. It would be even more stupid to demand that it read out an altitude we do like, rather than grabbing the yoke and pulling up. Similarly, government can influence housing price with policy — allow more housing, of all kinds, everywhere, for people of all levels of income. The good news about inflation is that we know its cause — too much money chasing too few goods. Or, in the case of housing, too many people chasing too few units. While Milton Friedman considers production a bit player in the inflation drama, in the housing economy, it has stolen the show. This is because state and local government have one foot on the brake and one on the gas and are pressing them both to the floor; they limit production of housing with excessive zoning codes, and yet do things to stoke job creation. I am profoundly concerned that as the government pours out billions of dollars to relieve Covid-19 income losses dramatically increasing the amount of money in the economy, local governments are in the process of imposing fiats like eviction bans and price controls that will increase risk and decrease production. When Covid19 is over, and prices begin to rise, will politicians take their foot off the brake? Or will the production killing measures like eviction bans then be hallowed
