This Isn’t Yesterday’s Housing Crisis
T
oday’s housing market is challenging to say the least. Challenging for buyers, challenging for renters and challenging for those looking to understand what exactly is driving the limited inventory and rising price phenomenon that is being experienced across the multifamily and residential property sectors. For those looking to compare what’s going on today in 2015 to what we experienced in 2007, keep looking. Key fundamentals point toward sustainable growth this time around and that’s causing concern for everyone from experts to everyday people alike. Blame Barney for Your Woes Let’s start first with the for sale market of the residential real estate sector. Driven by low interest rates, bidding wars have become the norm. First time homebuyers using FHA financing are struggling to compete with all-cash buyers and thanks to the last downturn, even well-qualified, high net worth individuals are having difficulty getting approved for financing. Thank DoddFrank for choking the lending industry like only two non-expert bozos could. This is one of the most glaring differences between now and then. Legislation has made it difficult for even well qualified and well-capitalized buyers to borrow money in today’s market and this in turn is slowing activity and increasing competition.

Why Buy if You Can Rent? With jobs on the rise and more Americans working than at anytime in the past 5 years, we are starting to see less of the doubling up or multigenerational households we saw during the downturn, less kids moving back home after college and more people signing leases. As a result, apartment occupancy rates and market rents are up across the country. Even as the for-sale residential market appears to offer attractive opportunities to would-be buyers, many lack the savings for an initial deposit and down payment. When carrying costs are considered, renting is still cheaper than owning in most major markets across the US — Orange County and Los Angeles included. Have a Bowl of Cap Rate Crunch As you’d imagine, increased occupancy and increased rental rates are taking gross revenues to new heights. Factor in near record low interest rates and an influx of new and familiar buyers competing over minimal on-market inventory (most deals are trading offmarket) and you find yourself at the root of the investor’s dilemma in today’s market. Even those who generally avoid real estate investments are interested. Stock market money is big, with cashheavy buyers looking to tap the four benefits and avoid the volatility of Wall Street. Low interest rates and even lower capitalization rates are creating chal-

lenges for those looking to use positive leverage to benefit their investment strategy. According to REIS, we’ve seen 3.5% year-over-year rent growth, down from 5.1% the previous year. While I certainly don’t think we are headed in the wrong direction, I think that rent increases will begin to taper as we absorb newly developed units in the rental space. But don’t expect new product to negatively impact property values. OC is stronger than ever. With the fed recently leaking a staff forecast report that suggests a rate increase of 0.35 basis points will take place before year end, it certainly seems we can tolerate the increase. However, the fed should exercise caution as the markets (though recovering) are still fragile and need handholding. This measured first step is what we have expected all along, but it’s the concern over how things will progress once this step has been taken that has everyone’s attention. While rates in the mid to high 4% range are not bad, they will likely cause a price dip in the residential and multifamily property sectors. As for things cooling off, don’t expect ice cubes. This should be much more of a microwave to room temperature progression. After all, that’s what the fed intended to do. R
ecently I was watching my wife, a licensed broker, fill out the necessary paperwork required to close a deal on a building. I tried to count how many times initials and signatures were needed to get through the process. Her response to me was, with guffaw, “When my Mom and Dad started in this business, rental agreements were one page long. Now I need a binder.”
It started me thinking about regulations, bureaucracy, and paperwork. At what point do our requirements to be protected in this industry overshadow our ability to be successful? Then I started looking to history for some perspective. World War II in its entirety, from the American experience, lasted from December 7th, 1941 to September 2nd, 1945…less than 4 years. In that
time we mobilized the Nation — We uniformed 15.5 million people, built a two ocean Navy, built over 50,000 aircraft a year, built over 100,000 armored vehicles in 1944 alone, and launched a Liberty Ship every day. We liberated North Africa, Sicily, Italy, France, Belgium, Holland, Luxembourg, Norway and Denmark, conquered Germany, and swept across the Pacific Ocean.

We built the most expensive project of the war, the B-29 bomber. We then built the second most expensive project of the war, the atomic bomb. The war ended in less than 4 years, and then we demobilized. With all that progress in that short period of time, one might be surprised to know that in today’s world, it takes 15 years to open an ocean water desalinization plant in Huntington Beach. So…is it any surprise that it takes six pages to rent a two bedroom in Buena Park? and authors over the past five years or so. And then there is a newcomer late to table (AB 723), requiring landlords to give notice regarding their responsibility to install water saving devices in advance of the effective dates of compliance, a whole new legal concept. These issues will be dealt with in the coming weeks. Before leaving Sacramento, however, legislators forwarded for the Governor’s consideration a few dozen generally noncontroversial measures. Culled from these are a few of general interest that were approved and are reported here for your information. One bill, AB 987, was a laser strike on a very narrow area of employment discrimination law, specificly, retaliation. Invalidating recent court rulings to the contrary regarding an employee’s request for accommodation related to the person’s religious belief or observance or physical or medical disability, this legislation adds two paragraphs to a general anti-discrimination statute

stating that it is illegal “to retaliate or otherwise discriminate against a person for requesting accommodation under this subdivision, regardless of whether the request was granted.” Another bill, AB 370, arrives just in time for the upcoming campaign season. This bill strengthens and clarifies current law regarding misinformation affecting incumbency by explicitly including “campaign materials” in a general prohibition against a candidate who (1) “Assumes, pretends, or implies, by his or her statements, conduct, or campaign materials, that he or she is the incumbent of a public office when that is not the case.” Or (2) “Assumes, pretends, or implies, by his or her statements, conduct, or campaign materials, that he or she is or has been acting in the capacity of a public officer when that is not the case.” Senate Bill 335 requires an insurer who charges an additional earthquake insurance premium or deductible because a dwelling fails to meet certain

building requirements relating to earthquake bracing to refund to the insured upon completion of a required improvement the additional premium or deductible paid prorated as of the date the approved inspection record is received by the insurer. Assembly Bill 1 prohibits a city, county, or city and county from imposing a fine under any ordinance for failure to water a lawn or having a brown lawn during a period for which the Governor has issued a proclamation of a state of emergency based on drought conditions. Assembly Bill 304 clarifies several provisions relating to last year’s “sick leave accrual” bill, the Healthy Workplaces, Healthy Families Act of 2014, generally providing that an employee who, on or after July 1, 2015, works in California for 30 or more days within a year from the commencement of employment is entitled to paid sick

Smock — continued from page 9 days to be accrued at a rate of no less than one hour for every 30 hours worked. This bill would require that the employee do that work for the same employer in order to qualify for accrued sick leave under these provisions. Existing law entitles an employee to use accrued paid sick days beginning on the 90th day of employment. This bill would authorize an employer to limit an employee’s use of paid sick days to 24 hours or 3 days in each year of employment, a calendar year, or a 12-month period. The bill would require an employer to calculate paid sick leave based upon an employee’s regular rate of pay, total wages divided by total hours worked in a 90-day period, or the wages for other forms of paid leave, as specified. Employers are required to keep records for three years documenting the hours worked and paid sick days accrued and used by an employee and to make those records available to the Labor Commissioner
upon request; however, this bill would provide that the employer has no obligation to inquire into or record the purposes for which an employee uses sick leave or paid time off. The bill also makes other technical and conforming changes and was enacted as an urgency measure effective upon its approval on July 13, 2015. Assembly Bill 418 shortens from 30 to 14 days the notice provisions authorizing a tenant to notify the landlord in writing that he or she or a household member, as defined, was a victim of an act of domestic violence or sexual assault and that the tenant intends to terminate the tenancy, thereby relieving the tenant/victim of further responsibility for payment of rent. hat do you think about the practice of allowing a tenant to directly deposit his rent check into my checking account? Seems simpler than requiring him to mail it to me, then my having to go and deposit it into my bank. I know a few owners that do this and it seems to work out well. Any problems with this?
Seems logical, save a stamp for the
tenant, save a trip to the bank for you. This practice has worked just fine for some landlords that have tried it, but has resulted in disaster for many. In a perfect world, your perfect tenant will deposit the entire rental amount promptly on the first of each month, each and every month without fail. For all of those landlords whose crystal ball tells them that this is the tenant that will never fail, never have a problem,
then those landlords may consider this practice. For the rest of us, in this imperfect world, there are unlimited ways that this practice can go wrong. Consider when your tenant doesn’t pay the rent when due. You serve a three day notice for the monthly rent, say $1200. On the third day, not having all of the rent, your tenant deposits $50 to your bank account. You just took a partial payment, thereby voiding your

three day notice, back to square one. What if the deposit of $50 is the day before your unlawful detainer trial? Same result, you accepted a partial payment, voiding your notice and defeating your court action. For these and many other reasons, this may not be a good management practice for the vast majority of landlords. Sure you could close the account when you serve your notices, or you could state on your notice that no partial payments will be accepted, and the tenant is not authorized to deposit any funds after expiration of the notice, but you would have to strictly enforce this procedure, and not waive any written procedures that you have established. For those that still want to do this, then consider using a sweep account that maintains a zero balance and is definitely not one of your operating accounts. Your written procedures should provide that the procedure is merely an accommodation that it is an optional procedure for payment that may be eliminated at any time without notice. And yes you should provide a physical address as the alternative place where payment may be delivered by the resident. The procedure should also state that only full payment may be deposited by the residents check, a money order or cashier’s check, no third party checks should be deposited. Deposits may be made on or before the due date, and only full payments are authorized, no partial payments. It should further state that payment after the due date must be pre-authorized by you in advance of the deposit. This pre-authorization requirement minimizes the risk of payment, and therefore waiver, after a lease or termination notice expires, or after the resident is served with a default notice.

Sure, remember this is California, the most litigious state in the country, so the following list is not static, it will change and no doubt expand over time. If the rental unit was built prior to 1978, the landlord must disclose the presence of known lead based paint and lead based paint hazards in the dwelling before the prospective tenant signs the rental agreement. You must also give
the prospect a copy of the federal government’s pamphlet, “Protect Your Family From Lead in Your Home”. The pamphlet is available through your apartment association or by calling 1-800-424-LEAD. Although not specifically required, unless you have ten or more employees, it is strongly recommended that landlord’s advise their tenants of the presence of asbestos and further inform them of the proper care of asbestos material. All landlords with ten or more employees must disclose the existence of carcinogenic materials to prospective tenants. The owner of a dwelling who knows that an illegal controlled substance, such as methamphetamine, LSD or its components, has been spilled or dumped on or beneath the dwelling must give a prospective tenant written notice prior to him signing a rental agreement. The owner of a dwelling who has applied for a permit to demolish the dwelling must give written notice of this to the prospect, and it must state the earliest possible date that the tenancy will end. Additionally, if your rental unit is located within one mile of a closed military base in which ammunition or explosives were used, you must give written notice prior to signing the rental agreement.

Her daughter asked if I would install grab bars in the shower and in the bathroom, and kind of implied that I must do it at my expense because of the ADA requirements, whatever they are. Now this resident is very sweet, but I just cannot afford to spend the money, my husband and I are barely making it as it is. Do I have to allow my resident to install the grab bars and do I have to pay for the cost?
A landlord must allow a disabled tenant to make reasonable modifications to the rental unit to the extent necessary to allow the tenant full enjoyment of the premises. The tenant, not the landlord, must pay for the modifications. As a condition of making the modifications, you may require the tenant to enter into an agreement to restore the premises to their original condition upon termination of the tenancy. You cannot require an additional security deposit in this situation, but you can require the tenant to pay a reasonable estimate of the restoration cost into an escrow account.

In this upside down world we live in today, this actually is a growing trend in law enforcement. Rather than prosecute the criminal, many law enforcement agencies are taking the lazy way out and threatening the law abiding landlord, forcing them to evict the resident. Rather than locking up the bad guys, just shuffle them off to another community. If the police are certain he is dealing drugs, why isn’t he in the “gray bar hotel”? If the letter you received is inconsistent with your experience with your resident, follow up with the police department by asking for documentation supporting their claim. Have there been arrests on the property? Have illegal drugs been found there? Ask other residents in the building, gather independent information. If the information you gather supports

nd then there were…17? The GOP field for President of the United States continues to expand and thank goodness! I had been wondering why a one-term, purple-state governor who last served in public office a decade ago was not yet part of the field. Check that box. Meanwhile, the rhetoric from the candidates now resembles one of the more entertaining episodes of Morton
Downey, Jr. Denigrating an entire race, dismissing the military service of prisoners of war and likening the Iran nuclear agreement to a replay of the holocaust are apparently the preferred tactics for making sure you poll in the top 10 of candidates and can participate in the GOP presidential primary debates. This clown show is a big win for the Fox television network that will air that first debate to a likely record

audience. As far as the candidates themselves, I’m not sure who wins — the one who keeps it classy and stays above the incendiary commentary or the bomb-thrower who “tells it like it is.” Perhaps more interesting (aka disturbs me to my core) to me is that a recent focus group of New Hampshire GOP primary voters revealed that the Federal Focus — continued on page 18

While it’s still early and the only way to know for sure is to wait for the votes to be counted, I was clearly wrong about the psyche of the American voter. While not as dramatic, the Democratic side of the equation is also expanding though so far the spotlight

is really focused upon Senator Bernie Sanders (I-Vt.) versus former Secretary of State Hillary Clinton. The coronation that was anticipated for Secretary Clinton as the presumptive candidate is now in question as Senator Sanders speaks to one packed house of primary voters after another. Could the liberal left, like their cousins on the right, begin taking hold of the primary process? Secretary Clinton may need to tack left to keep up with Senator Sanders before ultimately coming back to the middle if she survives to the general election. Sound familiar? Oh, and this just in, Vice President Joe Biden is not necessarily out of the game. Reports are that he has not ruled out a run if the Clinton campaign implodes. Meanwhile, back at the ranch in Washington, D.C., it’s that time of the election cycle where I usually say something about the clock running out on how much Congress will be able to accomplish because of the campaign. That is especially true this time for four reasons. First, there are so many sitting members of Congress running for their party’s presidential nomination that inevitably the rhetoric gets tainted. Second, this is the end of the Obama era so pols on both sides of the aisle are especially amped up about the presidential race. That impacts focus,

rhetoric and available bandwidth. Third, there was already very little on which the President and the GOP Congress could agree which means those issues where there still may be a compromise to be made will take up most of the oxygen in the room. Finally, we are once again in a situation where control of the Senate is in play. A net loss of five seats will cost the GOP control and there are 22 Republicans running for re-election and two who have already bowed out. The candidates and the party need time to campaign at home and are incented to avoid any controversial votes that could undermine those campaigns. The good news is that the Administration has generously provided us with lots of regulatory proposals to occupy our time and resources. The list includes: overtime pay, high-efficiency furnaces, affirmatively furthering fair housing, disparate impact, small area fair market rents, Waters of the United States and more! These more reactive efforts are coupled with our proactive work on emotional support animals, employee criminal background checks and music licensing. NAA members and staff are hard at work positioning the industry to secure some improvements in all of these areas. Speaking of disparate impact, last

When I remove the pop-up assembly and have an open drain, water whooshes down with no problem. However, with the pop-up in place, water backs up into the sink and drains very slowly. Paul

Dear Paul: Most bathroom sinks have an overflow hole near the top edge of the sink. This hole serves two purposes; 1: Acts as a safety drain to keep the sink from overflowing should the water rise above a certain level in the sink. 2: The overflow hole also serves as an air vent for the sink when the water levels are above the pop-up plug. The overflow hole allows air to escape through the drain and the water to evacuate more efficiently.

What has happened is hair, toothpaste, grime etc. have built-up and sealed off the overflow drain where it exits just below the pop-up assembly plug. Most snakes are too big to go through the overflow drain. Alternatively, a speedometer cable will work great or even a long zip tie will work. Push the cable or zip tie down through the overflow hole at the top of the sink and push any gunk out into the drain. Use water to help push the debris out the overflow drain, a funnel works great to direct a good flow of water. If you cannot access the overflow to drain, you will need to disassemble the main drain assembly to gain access to the overflow drain exit. Once the overflow drain has good airflow, the sink should drain a bit faster. If this does not solve the problem completely, look at restricting the water flow coming out of the faucet. I checked the water heater and it is operating properly. What do you think the problem is? David Dear David: The first thing we would check is the circulation pump for proper operation. Calcium or hard water deposits in the water heater and lines may also aggravate this problem. The circulation pump’s job is to bring hot water to all the units at the same time. The first step is to determine if the pump is working. The pump is normally found next to the water-heater. Check that the motor is plugged into an electrical outlet. Next, touch the water lines on either side of the pump and determine the temperature. If it is
working properly, the lines should be warm or cool to the touch, not hot. If the pipes are hot or very hot to the touch, the pump is not working properly. If the pump does not spin when plugged in, it may need to be replaced. If the pump motor is working, the pump may be clogged with debris. Remove the pump and clear out the lines. Pay special attention to the line between the pump and the water heater. The pump tends to impact this section

While you have things apart, this is a good time to clean out the tank deposits, which may be contributing to the slow hot water issue. Water heater clean outs should be done at least once a year. Denying an Applicant: What Landlords and Property Managers Need to Know BY CARYN BENNETT
I
n a perfect world, any time a resident moved out, a new and equally perfect resident would be waiting to move in. A brief chat would suffice as assurance that the new resident would be ideal for the community, a handshake and keys would be exchanged. Unfortunately, we do not live in a perfect world. In the real world, poor decisions are made and mistakes happen. Perhaps the applicant’s actions in the past affected his or her credit,
criminal or even employment history. Perhaps the landlord or property manager has mistakenly “shaken hands” with the wrong resident, resulting in a stressful and costly experience for everyone involved. A prospective resident completes an application specifically granting permission to pull a credit report and background history, which is then screened to generate a consumer report. The resulting consumer report is then compared to your written rental criteria,
allowing for a consistent decision to be properly implemented. If the applicant proves to be the perfect candidate, the move-in process begins. However, not everyone is perfect. Sometimes, the applicant falls short of your criteria such as with a low risk score, a low income to rent ratio, or too many collection accounts. Generation Y: Our Next Generation of Renters BY ELAINE SIMPSON
G
en Y, also known as the Millennials or Echo Boomers were born between 1982 and 1995. This generation is considered the largest and most powerful group of consumers, leaders, advocates, renters, entrepreneurs and students the U.S. has ever seen. Many of this generation are just entering the workplace and rental housing market. Due to the economy and less job stability, the Millennials are choosing to either continue to live with their parents or are moving back
in after a short stint of living on their own, maybe the Gen Y generation should be renamed the Boomerang Generation. Living with parents or family is the new normal for the Echo Boomers in the tough economic times. So in households that can afford it, parents and families are making it possible for their Gen Y family members to live at home and save money and in some circumstances assist parents in meeting their budget obligations. Our younger renter is now not just
choosing between several apartment communities they are now choosing what type of living arrangements they are seeking. Mom and dad are now a feasible and very acceptable option for our Gen Y renters. This is very different from the Gen X renter who was eager to move out and would often be embarrassed if they needed to remain living under the same roof as their parents. Generation Y — continued from page 30 Mom & Dad, the Affordable Housing Industry has to realize and take a position that will attract the newest generation of renters. The best way to do this is to understand how the Gen Y’s cultural experiences have influenced his or her communication style and life choices. Understanding the Generational culture of the Millennials will allow for better marketing to our young renter as well establish a connection and a level of trust that will encourage resident retention and reduce resident turnover. It is believed that people develop a peer personality through shared influences and events that occur during their formative years approximately ages 10 to 18, which impacts their generation value system and methods of interaction. It is important to consider the following: • What were the events of the typical Gen Y’s childhood?
• What changes did they lead to? • What values or beliefs were created by those events? Understanding the values and life experiences of the Generation Y renter will create a stronger marketing campaign and allow for site staff to connect and build a better rapport with your younger renters. Keep in mind that generations transition over time and they do not change abruptly. The descriptive norms and trends do not fit all people of the Gen Y population, they are just guidelines. Remember that not every member of the Gen Y generation will exhibit all of the characteristics described for their generation, but it is fair to say that many members have these tendencies. Also, members born very early in the Gen Y generation will often have more in common with the proceeding X Generation and may take on a bridge status between the X Generation and the Y Generation.
The Echo Boomers generation was brought up during a time where most parents worked outside the home leaving them in day cares. This environment taught this younger generation to be independent and self-sufficient. This generation was exposed to more group interactions through playgroups, team sports and other group activities than the previous generation. This was due in part to their parents using day cares and other activities to occupy the Gen Y’s time. The Millennials experienced technology as a way of life. Generation X had technology grow into their lives and Generation Y never did without it. The older generation was slow to adapt and use technology as a social tool. The Generation Y group had technology as a normal part of live and do not know what it is to be without a computer, cell phone or any other electronic device the older generation had to adapt into their lives. The speed of technology and information couple with rapid delivery systems has made this generation expect things to be done faster and better. The advent of social networks and electronic communication gave this younger generation exposure to more detailed information about each other than the older generation. The Gen Y can thrive on electronic communication and prefers this type of communication than face-to-face conversation. Generation Yers prefer using the Internet as a means of learning and making purchases. They are exposed to vast amounts of information, music, and media than the older generations. Generation Y is prone to communicating via electronic devices and is capable of multi-tasking while carrying a text messaging conversation. The Gen Y is trendy and very social
but also socially conscious. They are more apt to use smart phones, laptops and tablets for their apartment search and gravitate towards social media, rating sites, apartment community websites and Craigslist as their resource of choice. If they do not have a smart phone or their own lap top, the Gen Y is resourceful and will seek out the use of the computer at their local library or use the computer in the computer center of the apartment community they currently reside in. Often, it is thought that lower income households do not have computers, but Pew Internet Study, 2010 shows that households with less than $30,000 annual income 40% have broadband at home, 57% use the Internet and 75% own a cellphone. Another Pew Internet Study, Washington, 2011 found that Latinos and African Americans are more likely than the general population to access the Internet by cellular phone so they don’t necessarily have to have access to a computer.
When communicating with Generation Y group for marketing purposes and/or for customer service reasons use action words and humor to peek interest. Keep the message clear, concise and short, the Gen Y typically will only read the first couple of lines in an ad and often will only read the subject line of an email. The call to action should never include a phone number or having to call someone, real friends text. The Echo Boomers are a visual group so use pictures, icons and videos to draw them into your apartment community. The Millennials prefer text communication or email if necessary, they do not want to be contacted via the telephone because it infringes on their privacy. Generation Y group appreciates feedback and being kept updated on the latest developments and remember to seek their feedback. Keep in mind what is important to Generation Y — continued on page 37

any businesses, including landlords, do business under fictitious business names. An individual, partnership or other legal entity owns the real property under one name but the property is often known to the public under a completely different, usually more appealing name. For example, the legal owner of a rental complex may be Diversified Holdings, LLC but the property is commonly known and identified as Rolling Meadows Apartments. All of its adver-
tisements and marketing materials reflect the name Rolling Meadows Apartments and the residents make their rent payments to Rolling Meadows Apartments instead of the legal owner. California law requires property owners who use fictitious business names for their apartments to register and file those fictitious names in the County where the property is located. The fictitious business name statement MUST be filed and published within forty (40) days of commencing business.
California Business and Professions Code ยง17910 et seq. This means that if a rental property has recently been sold, the new owner must file a fictitious business name statement in order to legally transact business (collect rents, enter into lease agreements etc.) under the fictitious name. The new owner may change the fictitious business name but the prior fictitious business name must first be withdrawn or abandoned by the former owner of the fictitious business name.

Dire Consequences for Failure to Comply Failure to comply with the law has dire consequences, especially related to legal action. Of significance is the fact that the landlord cannot legally file an eviction action against a non-paying tenant or file a counter-claim against the tenant if the tenant files a small claims action against the landlord for return of a Security Deposit or sues the landlord for some other cause of action. Savvy tenants and defense counsel can easily determine if a landlord has complied with the fictitious business name requirements by conducting an online search. If non-compliance with fictitious business name law is discovered during litigation, it will cause a serious delay in the litigation and will most likely result in serious losses of rents and may even require the landlord to pay attorney fees and costs to the opposing side if the case is lost or dismissed at trial. Forgetting to file a fictitious name statement or not knowing that it is

required is no defense.

Simple Procedure to File a FBN Statement It is relatively simple to file and publish a fictitious business name and most of the time it can be done online at the County Recorderâ&#x20AC;&#x2122;s web page. The fictitious business name filing will generally be effective for five years and can be renewed for a nominal filing fee. It is highly recommended that property management companies verify with their client/owners that the properties they manage for them are in compliance with the law as they owe a fiduciary duty to their client/owners to act in their best interest by protecting them from unnecessary legal risks. Landlords who fail or forget to comply with the law run the risks set forth above and could be exposing themselves to serious legal problems that could have been avoided with the exercise of due diligence.

Pools & Spas are Not the Enemy during this Drought! BY ALAN SMITH

ackyard pools and spas are part of the California culture. But with our state in the fourth year of severe drought, many residents, and even some city councils, are looking twice at pools, wondering if they are making things worse. The short answer is, no, they’re not. While it might seem counterintuitive, pools and spas, and their surrounding decking, actually use significantly less water than a lawn of comparable size. Independent studies, including one done by the Santa Margarita Water District, prove that a well-maintained pool uses about as much water as droughtresistant landscaping. Even the year a pool is constructed and filled, it still uses less water than the grass it replaced. These facts haven’t stopped some from trying to scapegoat our industry, including the city of Laguna Beach, which recently imposed a ban on pool construction, without any public notice or discussion on its merits. Had the city done research and run the numbers, it would have found out that its new ban
will actually mean less water savings. The pool and spa industry agrees with Gov. Jerry Brown, who has said that drought regulations should not pit one industry against another, nor should regulations unfairly target one specific sector. A ban on pool and spa construction or filling does just that. According to news reports, in the past five years, 92 pools have been installed in Laguna Beach. Those pools used approximately 1 acre-foot of water to fill. To put that into perspective, that’s about as much water as a golf course uses each day. This figure amounts to 1/100 of 1 percent of the city’s annual water use and is less than the local carwashing facilities that recycle their water use annually in Laguna Beach. The pool and spa industry has been working on improving our water conservation efforts for more than a year. In early 2013, the California Pool and Spa Association created the “Let’s Pool Together” public education campaign, which provides tips to homeowners about ways to save

Checking for leaks is also vital, and lowering your pool or spa’s water level will decrease splash-out and minimize your need to add water. Automating Your Hot Water System (for free!) Does This Sound Like Your Building?
In multifamily buildings, there is a room/area we rarely visit. Yet, in that room/area there is an opportunity to literally put thousands of dollars per year in your pockets—instead of the pockets of our friendly utility providers. No, I am not leading up to a costly renovation, in fact, no renovation whatsoever. And for a limited time, under a SoCal Gas Company rebate program, I am talking about a product that is being offered at no-cost and will permanently lower your central hot water gas bills, by automating the process of recirculating hot water through your building. According to the California Energy Commission (CEC), an average of one-third of all energy used for multifamily water heating is lost in the hot water distribution pipes mainly due to uncontrolled hot water circulation. These dollars go down the drain, so to speak, before a single drop of water pours from your tenant’s tap. What is wrong with this picture? Let’s visualize a visit to your water heater room that serves the units in your buildings. The first item that catches your eye is the boiler/hot water tank. I would be willing to bet that the burner is on or will turn on in a few minutes. Oh, since we are visiting during a weekday, let’s assume that most of our tenants are away at work. OK, so now why is the gas burner turning on when there are likely only a few people at home? If our burner and circulation pump were controlled by an intelligent system, it would only come on when needed, based on actual demand. This excessive burning of natural gas to heat water no one is using, according to the CEC, represents thousands of wasted dollars each year per building Now, let’s look for the other wasted energy costs. Adjacent to the hot water tank is a small electrically driven pump. We won’t have to wait for it to turn on, it is running as we speak, and guess when it will stop? Never. That’s right dear building owner, you’ve been paying for the electricity to run those pumps non-stop from the date you bought your buildings. Now ask yourself: Does this pump need to run continuously? The answer is no! That is why the CEC has identified this area as wasting $300 out of every $1,000 we spend for hot water each year. As presently engineered, this pump’s job is to keep a continuous flow of hot water to each of our units through a recirculation hot water pipe that is designed as a distribution loop. As freshly heated hot water is pumped out from the burner, to all the units, the cooled water in the pipes returns to the burner to be heated and sent back out. This is a never-ending process that wastes $300 out of every $1,000 we spend per year. Now think, why are we paying a lot of money to circulate hot water to all of our tenants, regardless of whether our tenants are present, and if they are, whether they plan to use it or not? What if you could control the operation of your pump, reduce unnecessary water heater firing, all without compromising on the service 5 0

of hot water to your tenants? Is there a better and cheaper way? Absolutely! Adding a demand recirculation control to your buildings hot water pump is the most effective way in reducing standby losses in a central hot water system. This is why demand controls for multifamily buildings are the new CA Title 24 prescriptive requirement for all new multifamily buildings in California and available for retrofit through a number of utility programs.
