PRESIDENT’S MESSAGE

Housing Providers: Advocates for Affordability? “In no state, metropolitan area or county in the United States can a full-time worker earning minimum wage afford a modest two-bedroom apartment.” — NLIHC Study, 2016

C

alifornia lawmakers made big headlines earlier this year when they decided to increase minimum wage to $15 per hour by the year 2022. And while many business owners are concerned about the impact this will have on operating costs, from a housing perspective it won’t help much at all. In a report recently published by the National Low Income Housing Coalition fittingly titled “Out of Reach 2016”, the relationship of housing and income was further broken down and evaluated by what’s known or referred to as the “Housing Wage”. That is, in a state, county or city, what does an individual need to earn per hour to afford the fair market rent on an apartment home.

Summing Up the State

HUD uses the term Fair Market Rent (FMR) to arrive at a payment standard for a particular market area. You may be familiar with this term if you have worked with a Housing Authority in processing a Section 8 voucher. The FMR is the amount of rent that the Housing Authority (with HUD Funds) will pay. In California, the State’s FMR for a twobedroom apartment is $1,487. In Orange County, it’s $1,672. In Los Angeles/ Long Beach, it’s $1,490. In San Francisco,

it’s $2,289. In Bakersfield, it’s $826. These averages, though brought down by the likes of Bakersfield and a handful of others, were high enough to earn California the title of third least affordable place to live in the United States.

Too Much or Not Enough?

What’s interesting, in reviewing and studying the data, is that even in areas with a higher minimum wage, most workers still earn far less than the housing wage. For example: in Seattle, minimum wage is $13 per hour, but the housing wage for a 1 bedroom is $23.56 and for a 2 bedroom it’s $29.29. At minimum wage, it would take more than two fully employed people to cover the rent for their household. As a State, California has a $9.37 gap between the $28.59 two-bedroom housing wage and the $19.22 renter wage currently being earned. In Los Angeles County, the housing wage to afford the FMR for a two-bedroom apartment is $28.65. In Orange County, the housing wage is $32.15, which means that it would take a household of 3.2 minimum wage earners to afford the FMR of $1,672 on a two-bedroom apartment home.

What About Buying?

With all of this taking place in the rental sector, what does it mean for those interested in purchasing a home? According to a July 2016 report comparing the costs of renting to owning, key REIT markets such as Los Angeles, Seattle, the NYC Metro area and San

Francisco boast a high-end rental average of $2,310 per month that is approximately 27% lower than the cost of homeownership ($3,150). And remember, that cost excludes maintenance and other holding costs. Part of California’s problem is the lack of available, suitable and developable land and the other part is that the process can be so daunting, drawn out and expensive that it just doesn’t happen. On the rental side, there is just not enough affordable housing available and the statistics clearly demonstrate that. With more than 420K rental households in Orange County according to census data and federal standards indicating that a household should not spend more than 30% of its income on rent, the affordable rent for a renter at the mean renter wage of $18.44 per hour is $959 per month. So while we can work to advocate for reform to programs such as Section 8, we must also work with our elected officials, policymakers, state and local agencies to ensure that we are working to create affordable opportunities for our workforce, for seniors and for families. In doing so, we will help to ensure not only that things get done, but get done right. After all, the solution is not just to build more, instead it’s to build smart. and remediation scheme to deal with suspected bed bug infestation. It is loaded with specific time lines for particular steps to be taken in the process from suspicion to verification to eradication. Among its provocative features is a mandate to employ a pesticide eradication specialist (PCO) upon the mere suspicion of bed bugs being the cause of a tenants’ reported insect bite. That’s an expense that could be replicated multiple times without limitation. Also, the measure requires owners to distribute within one year of enactment to every tenant in California an informative brochure describing the nasty little creatures and their proclivities. That’s a huge expense to be borne by owners. All in all, the bill is an incubator for new litigation issues and is opposed by AAOC and other real property interests.” [March 2016 Apartment News] The latest iteration of AB 551 circulated by the author in draft form would dispense entirely with the detailed timelines and many of the specifics of the prior version, but continues to impose significant costs upon all owners for delivery of a specified notice to every tenant in California of the evils of this nuisance bug. The revised proposal also introduces new issues into the mix of problems associated with compliance, including new costs for more frequent PCO involvement. Maximum engagement in this bill has been a high priority for your lobby team. Keep tuned. These pages have been filled for the

past several months with descriptions of other measures of particular concern to owners and managers of residential rental housing. Also from March, Senate Bill 7 has had a recurring presence this year since its defeat last year on the Assembly Floor by a 29–28 vote. The comprehensive measure dealing with water submeters in rental housing remains on the Assembly File pending its possible reconsideration following last year’s narrow defeat. Very recent changes proposed by several interest groups have revived active discussion regarding the many issues involved in this legislative proposal. Senate Bill 814, dealing with imposition of penalties for excessive water use by residential customers, is awaiting final Senate approval before sending it to the Governor. More will be forthcoming on this issue as it intersects with Senate Bill 7. Requiring a set-aside for low income housing in new construction is likely in limbo. Assembly Bill 2502 mimics AB 1229 (2013) which sought to allow local governments to impose belowmarket low income housing set-asides in new residential development projects and nullify the landmark Palmer decision that successfully challenged the efforts of the City of Los Angeles to impose these adverse conditions. That bill was vetoed in 2013 and this year’s bill is stuck in the Assembly Local Government Committee way past

applicable deadlines for action. Final Senate action on Assembly Bill 2819 will likely be known by the time this publication is read, but is not known as of the date of this writing. The bill would modify the “60-day masking rule” dealing with closing public access to court actions involving unlawful detainer (eviction) cases. The measure would provide that UD court records remain closed to public access indefinitely thereafter unless the property owner prevails and presents the appropriate paperwork to close the case by judgment or stipulation of all parties. It is strongly opposed by AAOC and many other independent apartment associations. These are the most prominent bills of current interest that have surfaced in this session and about which much has been written and discussed, including a need for active member involvement in and timely responsiveness to RED ALERTS as they are promulgated. eems like it’s getting tougher to manage my commercial buildings. Delinquencies are up, and so are vacancies. One of my larger tenants in my industrial complex just came to me and said they may have to close down. I really don’t want to lose them, been a good tenant for years, and are good at what they do. What can I do to salvage them?

Increasing delinquencies and vacancies are on the horizon for many owners in

the coming months. In markets where it may be tough to find a replacement tenant, many owners are electing to offer rent deferments to tenants. Rather than waiving rent due, or entering into permanent rent reductions, many owners will offer their existing tenants an opportunity to temporarily pay a reduced sum as rent for a certain period of time. The ‘deferred rent’ is then amortized over the remaining term and is repaid in the future. Ensure that any agree-

ment to defer rent is placed in writing and signed by all parties. Most of my rental properties are residential multi family, but I have one small retail strip center in Los Angeles that I own as well. Q&A — continued from 10 same three-day notice to pay rent or quit that I use for my residential properties?

Commercial and residential landlord tenant laws differ in many ways. One major difference between the two is the ability to accept partial rent payments after service of a notice to pay rent or quit for a commercial property, and not for a residential property. Provided the necessary language is included in the commercial notice, you may accept a partial payment without waiving your notice, and may proceed with an unlawful detainer action without having to re-serve a new notice. For that reason, all commercial notices to pay rent or quit should contain language stating that in the event a partial payment is made, it will not act as a waiver of your right to commence an unlawful detainer action. If you have served a notice that does not contain the proper language, and your tenant tenders a partial pay-

ment, you may immediately provide the tenant with a letter acknowledging the partial payment, but also stating that the partial payment will not act as a waiver of your right to proceed with an unlawful detainer action. Other than that, review the cure periods stated in the default portion of your lease. Typically the cure period for non-payment of rent or other monetary sums due is three days. Failure to provide proof of insurance is typically three days as well. Most commercial leases will allow ten or thirty days to cure a non-monetary breach. Ensure that the forms that you intend to use are consistent with the terms you have negotiated in your lease agreement, as the terms of your lease will control. I’m in escrow to purchase a small regional shopping center, and am in the middle of conducting my due diligence. I’ve gone through the leases and am having some difficulty verifying the terms of some of the

tenants’ obligations. My agent, nice guy but a bit green, isn’t much help. He just wants escrow to close so that he can get paid. The seller appears to be disorganized, but not sure if he is giving me the full story. How can I be sure I’m getting the straight story?

Thorough due diligence is absolutely critical to ensuring that the deal is one that makes sense to you. A good real estate agent and his broker will actively assist you in ensuring that your requests for information are properly responded to, and will assist you in conducting your due diligence. Contact your broker and request that he assign a more seasoned commercial agent or broker to assist you in the transaction. Depending on the size and complexity of the transaction, you may wish to retain the services of a real estate forensic accounting firm to verify the financials. Ensure that you have complete copies of all existing tenants leases as well as all

Q&A — continued from 13 addenda. Estoppel agreements signed by each of the tenants as well as the owner, affirming all of the terms of the tenancy, including any options are a must. A site visit and individual meetings with each of the tenants is advisable as well. It’s amazing what a five minute conversation with each of your soon to be tenants will reveal. I have a tenant who just skipped out last weekend. He’s been behind in his rent, but I was working with him and he was catching up. Got an email this morning from him, it confirmed that he was out; it said he left the keys in the unit. Guess I’m kind of glad he’s gone, won’t have to go through the eviction process, but now what? He’s only two years into a five-year lease, and I don’t have any prospects. What is my next step?

First thing is to confirm he’s out, pick up the keys and change the locks. Document

the condition the unit was left in, by taking several pictures of the premises. If there is damage, take detailed pictures of the damage. You will need to provide an accounting of his security deposit within thirty days since it is commercial property. Now that you have possession of the premises, you have an obligation to mitigate your damages, that is, to attempt to relet to minimize the loss that you are sure to incur. Ensure that you maintain a log and document your actions in attempting to relet the premises. If you retain the services of a broker, ensure that he or she does the same. Your former tenant is responsible for the remaining term of the lease as well as any costs that you will incur in reletting the unit. These additional costs might include advertising fees, signage, broker’s commissions, tenant improvements for the replacement tenant, and the difference in rent for the remainder of the term in the event the replacement rent schedule is less than your existing rent schedule.

An Incredible Year for Grassroots Advocacy

W

e’ve reached the mid-point of the second session of the 114th Congress, but in many ways it feels like the end of the session. Most of the heavy legislative lifting that can get done before the elections has been completed. The campaign for the White House and 435 public service jobs in the House and 34 in the Senate has taken every bit of oxygen in the room. There are only a handful of legislative days left in the year during which

only the red-label tasks will get accomplished. There will, of course, be a flurry of legislative activity during the post-election “lame-duck” period before Congress adjourns sine die, but that almost feels like an entirely different legislative session since whatever happens is dependent upon the outcome of the election. Regardless, for the apartment housing industry this has been an incredible year for grassroots advocacy. In March, NAA hosted another

Federal Focus — continued from 16 grassroots outreach later in the spring has generated real results in all areas. In July Congress passed and sent to the President’s desk the “Housing Opportunity through Modernization Act.” Top among this legislation’s key components is a reform of the inspection process for apartment homes to be rented by someone using a Section 8 voucher. Now, units that have been inspected in the previous 24 months do not have to be inspected again before a voucher holder moves in. This will eliminate weeks of delay for low- and moderate-income families trying to find a home and thousands of dollars of lost revenue for apartment owners and operators. Reform of the ADA litigation process also made significant progress during the first half of 2016. The “ADA Education and Reform Act of 2015” would address a growing trend of “drive-by” lawsuits against owners of

commercial and residential real estate intended to generate fee settlements rather than address a genuine ADA design deficiency. The legislation preserves the goals of the ADA while providing owners 120 days to correct any deficiency before litigation can begin. Thanks to strong advocacy efforts, this bipartisan legislation passed out of the House Judiciary Committee with the support of Republicans and Democrats. This is a critical step that increases the chances of final action before the end of the year. Finally, legislation to expand private market flood insurance coverage options is halfway towards passage by the Congress. The “Flood Insurance Market Parity and Modernization Act” would help address the limited — and typically expensive — sources of flood coverage in the private marketplace. Most importantly, it would increase the protection of apartment communities across different markets and whenever it is needed. The bill passed the House of Representatives unanimously and is

now in the hands of the Senate. Based on our experience with Section 8 voucher reform, such a strong bipartisan showing in the House dramatically increases our chances of positive action in the Senate. As you can see, this year has been marked by strong advocacy performance by ourselves as advocates on reasonable, targeted and bipartisan policy initiatives. But our work is not over. There are many more policy concerns for us to tackle both this year and when the new Congress and Administration arrives in 2017. And speaking of 2017: Make sure to mark your calendars for the 2017 Capitol Conference and Lobby Day on March 7–8. opens just fine. But as you can imagine, I only remember to open it gently after my hand slips off the knob. Is this an easy fix? Gary

Dear Gary:

This can be an easy fix. Nine out of ten times the hinge is loose on either the jamb or the door. Tighten all the hinge screws and if a screw spins freely; change it with a bigger screw with more bite. Next try “adjusting” the hinge. Replace a regular hinge screw with a long 3 inch screw that will reach through the door jamb and into the rough framing. Gently tighten the screw, pulling the hinge and door jamb tighter against the rough framing and pulling the door with it. Next, if that does not work completely, “adjust” the latch side of the jamb by using long screws through the jamb into the rough framing. This should create just enough space to allow the door to swing open without incident. Following the Crowd from Cash In on the Myths of Real Estate

T

here’s a certain comfort in being among like-minded individuals and in knowing that others are taking your same course of action. Yet, all too often, we become complacent within our own comfort zones and forget to do our homework.

Even when actively seeking to acquire new properties, the tendency is to follow the trend, rather than question the actual metrics and potential outcomes. Although it seems somewhat counterintuitive, following the crowd can be a dangerous investment practice. Even

more importantly, looking for contrarian opportunities can pave the way not to just wealth, but also to greater security. I delve more deeply into this topic in my book, Cash In On The Myths of Real Estate.


2-7 Following the crowd is profitable. Popular Belief: Many investors presume that they are exercising prudence and good judgment when their actions mirror everyone else’s. Bill’s Truth: Investors seem to be most comfortable buying when everyone else is buying and, as soon as they perceive the start of a sell-off, they rush to get out of their properties before prices hit bottom. All too often, investors do not understand what they are buying. They get caught up in the crowd mentality and only focus on what they see the market doing, not on the actual numbers. When buying, you need to take a realistic view as to current cash flow and the IRR based upon a specific holding period and the ability to sell when the time is right. If you overpay for a property, your holding period is apt to have to be extended and that can dramatically impact the return on your investment. Some investors may simply be in denial. They get caught up in the exuberance of the moment and do not consider the possibility of any downside. And, it takes time and effort to monitor and analyze the market. Less experienced investors often feel uncertain about their reading of the market and hesitate to make decisions based upon their own perceptions.

Do not let the lemming mentality override your ability to take a contrarian action. Be able to identify when the crowd is wrong. Buy when nobody wants to buy. Sell when everybody wants to buy. This means that you cannot allow yourself to be spooked by bad market conditions. You have to watch and weigh what is happening very carefully, because you do not want to start buying too soon. Let the bubble totally deflate. This is a slower process than you might think. You also can use the arbitrage of submarkets to spread your investment base. And, you can reduce your risk exposure by holding properties that are positioned in different phases of the 18-Year Real Estate Cycle. Cash In: Have the courage to be a contrarian. Read, study, and learn the market nuances that guide insightful investors in calculating an intrinsic value that they can then compare against market value.

Recognizing and taking advantage of contrarian opportunities is so important that it is the last “As Bill Says” quote in my book and also printed on the back of my business card: The crowd is right most of the time, but when they’re wrong at the wrong time, there are contrarian opportunities for you and risks for the crowds. Beware of Attractive Nuisance Dangers on Your Apartment Building Property

t may surprise you that you are responsible for preventing injuries to occupants of your property under the age of 18 sustained as a result of man-made conditions called “attractive nuisances.” These attractive nuisances might include features of buildings, unguarded swimming pools, equipment or other things that are potentially attractive to trespassing minors. Curiosity thrives in those under the age of 18. They’re drawn to danger. Hazards irresistibly attract the youth all while presenting hidden dangers. Property managers and owners can

In addition, all safety equipment should be stored and locked at the end of each shift to avoid trespasser tampering.

Four Signs It’s Time to Raise the Rent

R

aising the rent on a property is never easy. All property managers worry about renter retention and the stress of having to attract new renters with a higher price point. However, raising the rent also allows you to improve your facilities, balance your operational costs, and make more profit. There are some pretty good signs that it is time to raise the rent. If you keep these in mind when pricing your rentals, you should be able to retain your current renters and attract new ones.

Neighboring Properties Are Raising Their Rents

It is always a good strategy to watch the competition. If neighboring properties have raised their rents, it’s probably a good time for you to raise yours as well. Though this isn’t always a rule. Sometimes neighboring properties will come under new ownership or overestimate their property values. Other times they offer more amenities at their

properties. So you want to make sure they are comparable properties and that their rental spaces are full and they have good retention. This can be hard information to find but you can learn through thorough market research and MLS affiliates.

You’ve Improved Your Amenities

If your property has undergone recent upgrades and renovations or you have expanded the amenities and services provided, you can look at raising the rent. When raising the rent based on additional amenities, you need to weigh the operating cost of these amenities. Some amenities like a business center or a picnic area required less operational costs than amenities like a pool or a doorman. Also consider the attraction of your amenities, some amenities like ceiling fans do not have the same luxury value to residents as a hot tub. So consider these factors if you are considering an amenities-based rent increase.

The Neighborhood Is Booming

The neighborhood is the best indicator if it is time to raise the rent. Sometimes neighborhoods experience an unexpected boom. This can be the product of new businesses moving into the area. Employees of these businesses will want to live close to work and will want housing in the area. Other times a neighborhood can become trendy. This can be a product of everything from gentrification to a boom of local retail shops or even simply a young professional crowd liking the area. In these cases it is smart to raise the rent because the local economy can support the increase.

Client’s Responses

The most often overlooked sign that it is time to consider a rent increase is from prospective clients. When showing a property, gauge how they react. If they say things like “this is a lot of space for this neighborhood” or “we should take it, I bet these apartments fill up fast,” anything that indicates the value is
