Take Action (Legislatively)

A

s 2017’s legislative activities are heating up in Sacramento and locally, I wanted to make you aware of a very important legislative tool that has been developed through CalRHA. First a short recap: You may recall that in my July message I wrote that our most important and impactful work is legislation and the AAOC volunteers and staff that make that work so effective. With the Democrats enjoying a supermajority this year, there are 140 bills being monitored by AAOC and its legislative advocates. Legislative activities have a lot of moving parts and there is strength in numbers when it comes to communicating with legislators and local officials. AAOC has joined with 10 other local apartment associations to form California Rental Housing Association (CalRHA). Today CalRHA represents the interests of 18,209 members of affiliate state associations. To leverage this number of members, through CalRHA, we have developed a

very effective email tool to voice our opinions on proposed legislation to our elected representatives. Its called Voter Voice and here’s how it works: AAOC will send out two links with our RED ALERT. One delivers you straight to the registration form. The second lands you on the “Take Action” page. that shows intended recipients of your email and prepares a measured, well thought out response. If you agree, then send the message. This is a tool that landlords have needed for a long time. However, I need to stress that, since we cannot and do not release your email addresses or information, you need to register for this tool. It is fast and easy to use, gets your opinion out there, and with enough of us using it, will do a much better job of helping to protect our industry. In summary I will quote the verbiage at the end of the RED ALERTS you are sent: AAOC is your biggest advocate for the rental housing industry. Because there is power in numbers, AAOC is also a member of the California Rental Housing Association (Cal-RHA). AAOC uses sophisticated “Calls-toAction” when your representatives need to hear from you on legislation. For bills of major concern, Cal-RHA will also use “Calls-toAction” to make the voice of the rental housing industry heard in the halls of government. Pet Policy Gone Wild

N

ew “assistance animals” regulations proposed by the Fair Employment and Housing Council (FEHC) will likely cause heartburn in the rental housing community. The attempt to bring clarity in the murky area of service and support animal need versus fraud is fraught with ambiguity. It is understandable why rental property owners are confused about the law, existing and proposed. Unless you’re a lawyer who regularly studies these issues, it is hard to know where one assistance animal law begins and another one ends. When does “reasonable accommodation” become unreasonable? Ultimately, rental property owners are scared of being sued, and therefore often choose to allow support animals onto their property, even when they suspect fraud is being perpetrated on them. But owners have very important, reasonable, and necessary reasons for having a no-pets policy. Animals can be dangerous, spread disease, interfere with the quiet enjoyment of others, and damage property. An owner’s right to keep animals off a property, unless to accommodate a person with a real need, therefore, must be protected. Unfortunately, current laws, including future laws under this Proposal, fail to protect owners from those fraudulently gaining access for their animals to rental properties. Rental housing owners and managers support and understand the need for providing reasonable accommodations to those who legitimately need an emotional support animal, as these animals (or “comfort animals”) can provide a

therapeutic benefit to those with a mental or psychiatric disability. We also recognize that service and support animal fraud is rampant and easily perpetrated under our current laws and regulations. More and more individuals are pretending their pet animals are legitimate service or emotional support animals when in fact the person has no legitimate need for the animal, or the animal itself is not legitimately a service or support animal. Ultimately, that is the main concern we have expressed in regard to FEHC’s Proposal: the proposed regulations do little to protect rental property owners from fraudulent requests for support animals. Support and service animal fraud is widespread in our society. Fake assistance animals are everywhere. Multiple news reports suggest that it is more than a few bad apples that are perpetrating the fraud. Rental property owners should not be forced to accommodate people who are perpetrating fraud on them, nor should laws and regulations facilitate such fraud. Unfortunately, this Proposal, does just that, because it contains few if any, effective anti-abuse mechanisms to prevent people from gaming the system. People requesting a reasonable accommodation for a support animal should have a legitimate disability that requires them to have a support animal. They should have a real diagnosis and prescription for a support animal by a real medical or mental health professional with expertise to give an opinion about the disability at issue and the need for a service or support animal.

The disability diagnosis and need for a support animal should also be current. Anyone with a real disability and a real need for a support animal should have this kind of documentation. Without these standards, there are no standards. Anyone could self-diagnose, tell their friends or “peer support group” they have a disability and a need for a support animal, and then use that friend or group as a source to verify their disability. Alternatively, a person who was diagnosed with a disability five years ago, and who might not currently have a disability or need for an accommodation, could use that stale prescription to game the system. We are sure that this is not the way the law is supposed to work. We submitted on behalf of the Association detailed comments on the FEHC’s Assistance Animal Proposal, including a number of ways the Proposal is deficient in preventing fraud and subject to abusive conduct: • Diagnosis or assessment by a licensed medical or mental health professional is not required. • The need for a support animal is not required to be a current need. • The person verifying a person’s disability or need for an accommodation does not need to be a medical or mental health professional or need to have specific training or education about support animals. • When an owner knows about a disability but not the need for an accommodation, the owners should

In short, the needs of property owners and other tenants are not properly accounted for or taken into consideration, and the Proposal should be amended to better reflect the realities of landlord-tenant relationships and the respective needs of each group.

Q&A — continued from 10 difficult to properly screen a prospective applicant. It is almost impossible to make good business decisions without good data. Remember, credit reports are merely tools, as are eviction reports; they certainly are not perfect, and getting less so now, however they are still tools to be used, just be aware of the glaring weaknesses inherent in these reports. Just closed escrow on a ten-unit building in Southern California, nice area, nice tenants, everybody is current, no rent control, life’s good. Going through the tenancy documents, I noticed that all the tenants are month to month tenancies, close to market rents but the security deposit on file is only $300.00 per unit. I’m thinking of serving a change in terms of tenancy bringing all of the security deposits up to the equivalent of one months’ rent. What do you think, can I do that? Is that a good policy?

The short answer is, yes you can do that, you can change the terms of tenancy and require that each tenant pay the equivalent of one month rent as the security deposit. The better answer is rather than raising the security deposits, it is better to implement a small rent increase of say $50.00 or so per month. Security deposits are simply held by you for the benefit of the tenant, they are not yours to keep. The increased rent is yours to keep. Many tenants would prefer to pay an additional $50 or so in increased rent rather than having to come up with an additional $900.00 or so in additional security deposit. Many tenants might simply move when asked to pay an additional $900.00 or so within a month’s time. Remember, rent and security deposits held are inversely proportionate. If your rents are below market, tenants are generally willing to pay a bit more than market as a security deposit to secure the rental. The converse is true as well, if your security deposits are lower that market, tenants are generally

willing to pay a bit more than market rent to maintain the rental. I just received the most curious letter. Seems my local police department has identified one of my residents as an undesirable, they say he’s suspected of being in a gang and is dealing drugs. They say that if I don’t evict him, the police will prosecute me for allowing a criminal to operate on my property. I may even lose the property! The family has been there for several years, other than a couple bounced checks they have been model tenants. Help, I cannot afford a vacancy right now, what do I do?

Q&A — continued from 12 dent. Rather than locking up the bad guys, just shuffle them off to another community. If the police are certain he is dealing drugs, why isn’t he in the “gray bar hotel”? If the letter you received is inconsistent with your experience with your resident, follow up with the police department by asking for documentation supporting their claim. Have there been arrests on the property? Have illegal drugs been found there? Ask other residents in the building, gather independent information. If the information you gather supports your resident’s involvement in criminal activity, take action immediately. Consult your attorney to determine if you have enough facts to support a three-day nuisance notice, or if a thirty day or a sixty-day notice is appropriate. Remember, a letter from the police department is not sufficient evidence in court to base a nuisance notice on, testimony from percipient witnesses will be required.

Most of my residents pay on time and their checks are honored by their banks. Lately, it seems that I’ve been getting many checks from small banks, even some internet banks with no real offices, many I’ve never even heard of. I recently had one returned insufficient funds over three weeks after the check was deposited! Do I have to accept these types of checks? Should I require that all my tenants pay by cash or cashier’s check? What about direct deposit?

You can control the method of payment and the types of payment instruments that you will accept. If your tenancies are month-to-month, you may change the terms of the tenancy agreement to establish different payment methods or to require payment by certified funds. Service of a thirty-day notice of change of terms will suffice. It is generally not a good business practice to accept cash as payment for rent, due to the increased risk of robbery, theft or other criminal conduct. Many owners allow residents to make direct deposits or transfers to

the owner’s bank account. There are many benefits to this arrangement, but many drawbacks as well. If you do allow the resident to make direct deposits, then establish an account separate from your personal general account, and establish clear guidelines instructing the resident when and how to make deposits. Suggested guidelines would state that you will not accept a partial payment without prior consent; that the resident is not authorized to make a direct deposit after service of a threeday notice to pay rent or quit or a notice of breach of a covenant of the lease, or for any period of time after expiration of a notice of termination of tenancy. Once your payment terms are established, stick to them and require the residents do the same. This article is presented in a general nature to address typical landlord tenant legal issues. “Preventive Maintenance” is a term I hear a lot and don’t really understand. I do my own maintenance and fix issues as they come up and any “extra” maintenance just sounds like more work and expense! What am I missing? Bryan

Dear Bryan:

On the surface “preventive maintenance” may sound like unnecessary work done

in an already busy schedule. However, that could not be further from the truth. Both on a large or small scale, preventive maintenance or “PM” for short is a huge money saver not only in parts, but also in time and labor. An unplanned breakdown is never convenient. The chances are high of a breakdown happening on a Friday or weekend evening after hours. This is the time when the building is under the most pressure as everyone is home. Planning for a breakdown is the first step in avoiding an unplanned breakdown. Look at your apartment building with a critical eye and list everything that might go wrong at some point in time. This list would include: water heaters, hot and cold water supply lines, faucets, drains, garage door springs, heating and air conditioning, etc. At minimum you should have on hand repair parts for all the items on your list along with the tools to do the work. If you want to get ahead of a potential breakdown, figure

out the estimated lifetime of each item and schedule either a service date for the item or replacement of the item before a potential breakdown. As an example: A one hundred gallon water heater without maintenance may last between six and eight years. The same water heater with yearly maintenance of cleaning out the calcium buildup in the tank, inspection of the Zinc rod and burner assembly might last as long as ten to fourteen years. Another less extreme example might be cleaning out the main drain lines once a year before the big holiday season. It is much cheaper to have a plumber service your building on a Tuesday morning than on Thursday Thanksgiving night.

Maintenance — continued from 16 fancy front-loading washing machine and now the pipes are banging. This did not happen with the regular top loading machines. Not only is the noise annoying, but also, I am worried this might cause a water line break. The resident’s love their new machine and I don’t want to tear into the walls, so what can I do to remedy the pipe banging issue? Victor

Dear Victor:

The reason for the pipe hammering is because of a rapid opening and closing of a water valve. Most washing machines and dishwashers use a fast acting solenoid to control the water valve. The water starts and stops very suddenly causing the pipes to move. The new popular front loading washing machines also use a solenoid to control its water valves, but they open and close many times during the cleaning cycle, so the hammering is more noticeable

and damaging. The simplest and least expensive remedy is to install what is called a “Mini-Rester” laundry hammer arrester. The “Mini Rester” is installed either at the washing machine’s hot and cold valves, or directly to the back of the machine’s inlet nipples. The job can be done in the time it takes to un-screw the hose from the hose bib or machine and reinstall the hose back onto the machine or hose bib with the Mini Rester in between. These hammer arresters can be found at any hardware store and should be about $20.00 each. You will need one for the hot-water side and one for the cold-water side. The “Mini Rester” is designed as a single fixture remedy. If the problem continues, a larger water hammer arrester will need to be installed.

Dear Maintenance Men:

I am planning to install a new sprinkler system in the lawn area of my apartment building. How do I estimate the number of heads and how far apart do they need to be? John

Dear John:

First, get an accurate measurement of the area you want to install the sprinkler system. Transfer the measurements to graph paper. Decide on a scale such as one square of the graph paper equals one foot or maybe if you have a large area, one square equals five or ten feet. Draw the dimensions of the area you are planning to irrigate. Next decide what type of sprinkler head you will be using such as impact sprinkler (Rainbird type), brass heads or pop up, or rotary heads such as Toro offers. The manufacturer will list the water spray radius. If you want the diameter the head will cover, multiply by two. But, knowing the radius should be enough for this purpose. The spray coverage should overlap each head between 80 and 100 percent. What this means is; if the sprinkler head has a spray radius of 10 feet. Each sprinkler head should be spaced 10 feet apart. That is called head to head spacing. If you deviate greater

than 80 percent, you may get dry spots at the times you need the water the most; such as during summer heat and windy conditions. Stated another way, sprinkler “A” should wet sprinkler “B” and so on. On the graph paper grid the circles should intersect and touch each sprinkler head. Don’t forget the more sprinkler heads you have the more you will need to pay attention to both gallons per minute (GPM) and water pressure supplying your sprinkler system. The sprinkler manufacture should have a chart showing how many sprinkler heads can be controlled by one valve depending the GPM at a certain water pressure. Comparing IRA Choices: Roth vs. Traditional Which one is right for you?

W

ith the decline of corporate pensions and the aging U.S. population putting stress on the Social Security system, the burden of saving and planning for retirement falls increasingly on individuals. This is especially true for younger Americans. Yet, navigating the retirement savings account options as well as investment choices can be a daunting task. But taking the time to understand these choices can go a long way toward paving the way for a more secure retirement down the road. Most financial planning experts agree one of the most important retirement savings steps to take is to fully fund your 401(k) or other employersponsored retirement plan. If you’re not able to contribute the maximum amount, consider contributing as least as much as the employer’s matching amount, if available. Otherwise, you’re leaving free money on the table. If your employer doesn’t offer a retirement savings plan or you’re able to save more, consider contributing to an Individual Retirement Account (IRA). Many people don’t realize you can contribute to an IRA even if you already partially or fully fund your 401(k) — you just may not be able to deduct your contribution. There are two main types of IRAs — Traditional and Roth. One is not better than the other — each offers distinct features.

Traditional IRA

With a Traditional IRA, you must be under age 70½ to contribute and you or your spouse, if married filing jointly, has earned income. Contributions may be tax deductible and earnings grow tax-deferred, meaning you pay taxes at the time the money is withdrawn or distributed, presumably in retirement. If you make non-deductible contributions, a portion of each distribution will not be taxable based on the percentage of before-tax and after-tax amounts in your Traditional IRA. Please note that distributions taken prior to age 59½ may be subject to a 10% IRA tax penalty. There are no limits on income in order to be eligible to contribute, but account owners must begin taking required minimum distributions (RMDs) at age 70½.

Roth IRA

With a Roth IRA, there are no age restrictions for contributions. But you or your spouse, if married filing jointly, must have earned income. Contributions are not deductible. However, earnings may be withdrawn tax and penalty-free provided: (1) the Roth account has been open for at least five years and you are age 59½ or older; or (2) the distribution is a result of your death, disability, or using the first-time homebuyer exception. Unlike Traditional IRAs, Roth IRAs

have no RMDs. Please note that distributions taken prior to age 59½ may be subject to a 10% IRA tax penalty and ordinary income tax. There are, however, limits on income in order to be eligible to contribute. If your income is too high to contribute to a Roth IRA, you can always contribute to a Traditional IRA, assuming you are eligible. Even if you can’t deduct your Traditional IRA contribution, you can take advantage of tax-deferred growth potential.

How taxes affect your decision

Now that you have an understanding of Traditional and Roth IRAs, you can decide which one works best for you. And, remember, you can contribute to both types of IRAs in any given year, as long as your total contributions don’t exceed the annual maximum. The primary driver of your decision is taxes. Assuming you’re eligible to contribute to both a Traditional and a Roth IRA, you need to decide if you’d prefer to get a tax break now for contributing to a Traditional IRA or put after-tax dollars into a Roth IRA and take tax-free withdrawals later, assuming you have met conditions to do so. It’s important to know you cannot convert only your after-tax dollars — instead, a portion of each conversion will contain both before-tax and aftertax amounts. The benefits of tax-free income in retirement may justify the cost to convert. Key factors to weigh in your decision to convert include your current income tax rate and expectations for future tax rates as well as availability of funds to pay the taxes associated with the conversion. Roth conversions can be complex. We recommend you consult with your tax professional and Financial Advisor before converting your Traditional IRA.

Aspiring To Be…

W

hen we are young our hearts and souls are filled with aspirations to be something greater than what we currently are... As youngsters we often dream and fantasize about our futures, what our lives will look like and of course our fabulous careers. Some say they will become doctors, some will be soldiers, ballerinas or even fire fighters. While there’s a special place on this earth for each and every career and job title, whichever one we choose, we just know we are going to be the very best at it. Oh to be young again! As we soar through life we find our place, our niche if you will, and sadly somewhere along the way after we’ve established our careers the aspirations tend to taper off. Have we become masters at our craft that we no longer aspire to be the best? Have we gotten comfortable and complacent that being the best is no longer something that matters? Or is it simply that we just no longer aspire to be once we’ve reached our goal? We humans are fallible to a point as life certainly has its way with each and every one of us. Sometimes it is very

positive and we get to ride that wave of success, Hooray! But like everything, life too has a tendency to balance itself out and sometimes we get derailed. As a community director I realize that I’m not curing cancer or calculating the next space mission to the moon, however that doesn’t mean my place here is not as significant. Nor does it mean that I should no longer care about my position or the service I give. While it’s easy to get lost in our day to day tasks, to lose focus, or even get derailed, we simply sometimes just no longer aspire to be… The worst thing we can do however, is to give up. I recently read a devotional titled “Keeping the way”. While this message was spiritual in nature it was actually quite applicable to everything in life. In comparison being able to attend the NAA Conference would be comparable to being in fellowship among my industry peers. As a human I am far from perfect, however one thing I am certain of is in order to get anywhere in life one must take a step…. So starting with step one, while I cannot go back in time, I most

certainly can reclaim that portion of my youth when I aspired to be amazing. The hardest part of getting someone to rent your vacant space might be over… but instead of switching to autopilot, use the weeks between lease signing and the move-in date to create a packet of information for new tenants. A move-in packet has two benefits: it ensures you have all the paperwork you need in one place and it will help your new renters feel like they’ve established a personal connection with you right off the bat.

What to include:

Copy of the lease signed by both parties — This is exactly what it says, a copy of the legally binding contract that has been signed and dated. Move-in checklist — In the first few days after a tenant moves in, it’s crucial to walk through the apartment with them and make a note of any existing damage or wear on a move-in checklist that itemizes each feature in a rental. That way, you’ll know exactly what to charge a renter when they move out and they will be aware of their responsibilities for damage incurred. Note: If you’re a Rentler+ user, we have a lawyer-

Instructions for paying rent — Make it easy for a new tenant to pay rent for the first time by covering all the payment methods you accept and any late fees incurred for not paying by a certain date. a unit in a larger apartment complex, make a map of the building with the emergency info highlighted. For homes, you can include a sheet with information about where fire extinguishers are located and instructions for testing fire alarms. Maintenance request forms — Having a form for maintenance requests is crucial. That way you have a record of what needs to be done and the process is streamlined for everyone. Include a few copies in your packet (Rentler+ users have access to verified maintenance request forms to make it easy). Lead paint disclosure — If your house or apartment complex was built before 1978, you are legally obligated to include a lead paint disclosure form. You will also want to include some safety guides for living in a house where lead paint exposure is possible. Find these forms online or through your Landlord dashboard if you’re a Rentler+ user. Guide to the neighborhood — Go the extra mile and create a sheet of paper with the nearest hospitals and their phone numbers, any special information about safety measures (i.e. “The road in front of this complex is shut down one Saturday in June for parade routes.”) and maybe even a list of the closest places to get takeout food. Put all the information you’ve compiled in a cheap plastic binder and give it to your new renter when you hand them the keys.

Raising Rents: It is Not Just About Cash Flow

ll too often longtime owners become complacent about their properties. They have paid down the loans and their cash flow is good. At one time or another, they may

have monitored rent rates in their neighborhood, but after a while, doing so seemed less and less important. They may or may not have been raising rents, but at some point the amount of each increase diminished. Sound familiar?

In my book, Cash In on the Myths of Real Estate, I talk about raising rents as a part of the selling process. But whether you are selling your property or not, the relationship between rents and value remains the same.

Raising rents before you sell is a bad idea.

Popular Belief: Raising rents causes tenants to move out, which leaves vacant units that are a detriment to selling the property. Bill’s Truth: Actually, raising rents is the first step that you should take as soon as you decide to sell and before you put your property on the market. Rents determine value. Charging below-market rents reduces the value of the property. Almost all lenders and buyers request a property’s current rent roll and apply the gross rent multiplier (GRM) method of determining value. Some credit may be given with the expectation of being able to raise rents to market rates, but the likelihood is that the lender will be less willing to make a larger loan based upon future rather than current rents. For example, a $50 per month increase in rents on an $800,000 fourplex results in a difference of $2,400 per year ($50 x 4 units x 12 months). Using a gross rent multiplier of 14, the increase in value equates to $33,600 ($2,400 x 14)

If you want market value for your property, you need to be getting market rents Cash In: Raise your rents to market value to get the best price possible.

Even if you have no intention of selling, not raising rents is a dangerous practice. Not only are you becoming complacent, so are your residents. Perhaps you wake up one day and realize that your

rents are $150 or $200 below market. If, for several years, you have not implemented any increases, catching up becomes extremely difficult. Even a relatively nominal increase of $50 a month can seem like a lot to someone

who has not seen their rents change for several years. So, the resident gives notice. Turnover is not necessarily bad. But if the same resident has been occupying the same unit for years and years, there is going


to be a lot of work needed to rectify normal wear and tear as well as to bring the residence up to a market-competitive level. You can always choose to simply do some cleaning, paint the walls and, perhaps, re-carpet, but if the interior appointments are dated or not comparable to what is being offered in your area, then obtaining market-rate rents will be a challenge. More likely than not, you will end up either offering a discount or settling on rents $50, $75 or, even, $100 lower than those at other nearby properties. Once again, you are fighting an uphill battle. Be advised, too, that when your amenities and interior appointments are not market competitive, the property is less apt to attract the quality of resident that you might desire. This can become another slippery slope. So what is your answer? Consistently raise rents and take the chance of turnover or don’t raise rents and face not only a loss in value, but potential deterioration of the entire property? My recommendation — even if you have absolutely no intention of selling — is to always keep your rents market competitive. Not only will this approach help to maintain the value of your property, it provides you with the means and the motivation to consider improvements that will help you attract and retain great residents. And, there’s added benefit — you are not only securing your property for your own purposes, you are doing so for your heirs. A well-maintained property that is market competitive is a fabulous legacy and a great introduction to all of the reasons each of us got involved in buying apartments in the first place. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. Changing the way you manage your property

A

fter becoming a landlord, Jason Bangerter started to notice certain pain points in the rental industry; like how hard it was to find a tenant he trusted and how much time it took to manage the day-to-day things. “Even collecting rent was way more time consuming than I could have imagined,” said Bangerter, who is the founder and CEO of Rentler. “I hadn’t screened my tenants well enough, so every time they paid rent I would jump in my car and drive straight to the bank to cash their checks because I didn’t know if it would go through.” He wasn’t alone. The lack of time and resources are why people who get into real estate investing often end up quitting. Bangerter saw a problem in the rental industry and wanted to fix it, so he got a team together and set out to create a complete tool for landlords who were going through the same thing. “I thought there would be something out there to help me manage it, but as I started looking around for tools to use...I didn’t find any. So I figured, let’s just create it,” said Bangerter. Rentler was founded in 2011 with the understanding that renting should be smarter, faster, and easier for landlords and tenants alike. Since then, it’s grown into a platform for millions of users by providing software tools and a listing service that makes renting better for everyone involved. “We started Rentler because we noticed that the rental industry served either tenants or landlords, but never both. We built Rentler from the ground up, constructing strong relationships between tenants and landlords to create a solid base,” said Bangerter. Online payments One of the most noteworthy free tools Rentler offers is the ability to collect rent online and automatically report payments to boost a tenant’s credit history. Plus, Rentler takes care of reminding your tenants that rent is due and automatically adds late fees if it’s not paid on time. “I used to have to chase down paper checks for 12-15 hours during rent week,” said Kim Rizzi, a property manager from Salt Lake City who uses Rentler regularly. “I found Rentler and immediately loved how user friendly it was. Collecting rent now takes no longer than two hours.”
