Vote No on Prop 10: In Full Swing

S

ixty days from the 2018 Election and the push to preserve Costa Hawkins is in full swing. The campaign officially kicked into overdrive after Labor Day and our Statewide coalition is raising funds, writing checks and educating the general public on just how bad things could get with a repeal of Costa Hawkins. You’ve received our emails, our print solicitations and attended our programs, but we are not stopping there. We need your support now more than ever before. And we’ve got yard signs! Don’t worry, this will all make sense after you read the next paragraph.

Accidental Landlords Especially Impacted

As written, the initiative would allow for rent control on single family residences or condominiums. Think of all the “accidental” landlords who would suddenly be burdened with the cost and headache of navigating a new regulatory regime. The newly married couple who retained a former bachelor

(or bachelorette) pad, or the son, daughter or family member simultaneously mourning the loss of a parent and sorting out their estate. Welcome to regulatory nightmare! Some will undoubtedly sell, some will hire a management company and the return rates will diminish because what is already a labor-intensive investment class has become even more labor intensive to operate.

Prop 10 Passage Will Decimate Home Values

It doesn’t stop there. Think of the negative impact Prop 10 will have on home prices if the only potential buyer is a would-be occupant and not an investor. Home values would most certainly decline as a class or buyer-type would disappear from the marketplace. Less competition from buyers would ease demand and result in the cooling off of home prices. Generally with investment real estate, as the properties grow in size, so to do the sophistication levels

of the owner/operators. Condominiums and Single-family residences are among the simplest of entry-level investment opportunities. A repeal of Prop 10 would be most devastating for those who rely on the income and value from their investments the most. So we took the lead and in line with our “No on Prop 10” campaign message have created the slogans for a series of yard signs. I’ve got mine and you can get one, a few or many that will fit your needs by making a small contribution to our Multi County Property Rights PAC. Don’t deny the housing crisis but acknowledge it as a shortage and 3. Don’t get into a “landlord vs. tenant” narrative. Last Chance

O

n the cusp of beginning the last 4 weeks of this 2-year legislative session, your lobby team gears up to address the remaining important measures affecting residential rental property owners and managers. Looking back on the entire spectrum of the topsy-turvy proposals that arose in these many months of activity leading up to this final showdown, it is somewhat of a relief to find only a few important property-related bills remaining on the calendar. That’s good news in light of our engagement in nearly 400 of the 4,829 proposed bills and constitutional amendments covering both years of this legislative session.

The 2018 tenant attack on rental property interests kicked off in spectacular fashion with the failure of 2017 carryover Assembly Bill 1506 to gain approval of the Assembly Housing Committee in January. That bill would have repealed the Costa-Hawkins Act, now the object of initiative Proposition 10 on the November 2018 ballot. There followed a series of anti-owner measures to impose onerous restrictions on the management of rental properties. We review a few of these to measure how far we have come this year to these final weeks. Assembly Bill 2618 would have required the Department of Real Estate

to administer a certification program for landlords and property managers, as defined, to provide education to landlords and property managers on fair practices and tenant rights. The bill would have made this certification effective for a period of 2 years and authorized the department to identify and approve appropriate providers of the educational coursework, as specified. The bill would have made a person who acts as a landlord or property manager without first having obtained certification from the department subject to a specified civil penalty. Sacramento — continued from 8 measure was held in the Assembly Appropriations Committee. Assembly Bill 2925 would have required every termination notice to state a reason for the termination, turning a local issue into a sweeping statewide one-size-fits-all mandate, substantially limiting the right of all rental property owners across the state to terminate leases with the standard 60-day or 30-day notice. Extinguishing a lease would have required all owners to have “just cause” or “good cause” and go through the expensive unlawful detainer (UD) legal process, which entails hiring an attorney, filing the UD with the court, utilizing a process server to serve the tenant, making court appearances, and often using the local sheriff ’s department to evict the tenant. Stating the cause(s) to terminate a lease under the bill is extremely problematic for tenants, property owners and the courts. The courts would be exposed to

thousands of additional civil filing where a tenant disputes any reason stated in the 30-day or 60-day notice. The measure failed passage on the Assembly Floor. Assembly Bill 2364 would have required any owner in a rent-controlled jurisdiction, who chooses to bring his or her units back on to the market after going out of business via the Ellis Act, to offer his or her units to the same tenant at the last rent-controlled rate previously offered should the owner go back into business during the 10-year period. As a result, this bill would have effectively assured that owners will never go back into re-renting the residential dwelling units. With the specter of rent control spreading across the state through the pending initiative or local process, the measure has legs beyond the current communities that have rent controls in place. The author attempted a belated compromise, but the effort came too late. The measure failed passage on the Assembly Floor.

Assembly Bill 2219, as introduced, would have required an owner or manager to accept payment from a third party of a tenant’s rent without qualification. The measure was amended in several respects to assure that the third party does not reside on the premises, to limit the timeliness of acceptance, and provide the landlord or agent with a signed acknowledgment that acceptance of the rent does not establish a landlord-tenant relationship between the landlord and the third party. At this writing, the measure is pending Assembly concurrence in Senate amendments. That brings us to Assembly Bill 2343 which, as introduced, would have provided substantially longer periods of free tenancy for defaulting residents before the UD process could commence or conclude. A series of amendments have whittled the bill down to its current version, providing for 3- and 5-court day notices instead of 3- and 5-calendar days. The principal remaining issue with this bill is why apply additional court

days to notices to correct a tenant’s nonrent curable default? The bill is pending for vote on the Assembly Floor. Another pending measure is Assembly Bill 1427, which would mandate owner participation in the voluntary federal Department of Housing and Urban Development Veterans Affairs Supportive Housing voucher (VA style Section 8) or face liability for housing discrimination against veterans. The bill would modify “source of income” housing discrimination language to specify that a VASH voucher is a source of income. The current state law is very clear on this subject: there is no violation of the Fair Housing Act based on “source of income” because, despite the misleading “voucher” nomenclature, the rental assistance does not flow to the tenant applicant and is not income to the tenant applicant. The issue, which has been debated and rejected by the Legislature on several occasions, arises this year in the context of veteran housing.

Finally, what may turn out to be the most ongoing costly bill of the session, if enacted, is Senate Bill 721. The bill would require property owners of 3-units or more to hire a qualified inspector every six years to inspect 15% of all exterior wood supported or stabilized walking surfaces above six-feet from the ground, including decks, balconies, porches, stairways, walkways, entry structures, and their supports and railings. We identified a number of shortcomings in this proposal and submitted detailed amendments for the author’s consideration. Senate Bill 721 is pending a hearing in the Assembly Appropriations Committee. Four weeks to go, with several very important measures of general interest likely to be decided in these closing days. Fires and fire-suppression activity are front-page news every day, with huge costs in materiel and human lives. Public utility and insurer liability are up for consideration. The long-standing felony-murder rule is being chal-

lenged, as is the peace officer standard for justifiable use of deadly force. And DMV has taken its lumps with public outrage reaching legislative ears. It’s a long, hot summer with only a few weeks left to address myriad issues of public and private concern. I received an offer and we opened escrow a couple of weeks ago. The buyer is doing his due diligence and is going through the

books records and all of that. A couple issues arose. First, the buyer is doing his inspections of the units and we gave all of the residents plenty of notice of when the buyer and his inspection people would visit each unit. My manager served written notices to all, and provided well over the required twenty-four-hour notice, most got at least three days prior notice. Well, Mr. Thinks He Knows It All in one of the apartments just sent me a letter warning me that if anyone enters “his” apartment he will sue everyone. Says he used to go to law school, that he knows his rights, says I can’t go in. Needless to say, this was unexpected. I have the inspectors and appraisers and the buyer scheduled to visit at the same time. The buyer is very hands on, and says he must personally inspect each unit. If he doesn’t let me in, it may jeopardize the sale, what do I do?

Mr. Thinks He Knows It All is mistaken. California law provides that residents must allow access to and entry for appraisers and prospective purchasers, among others, upon service of at least twenty-four hours’ notice. His failure to allow access violates California law and is a breach of your rental agreement. Your resident needs a little “prompting.” Prepare a Three-Day Notice To Perform Condition or Covenant directing him to comply with California law and the terms of your agreement by allowing access at the already noticed date and time. Additionally, provided his tenancy is a periodic tenancy, and your property is not subject to rent control, a notice of termination of tenancy can be a great motivator. Prepare a Notice of Termination, and instruct your manager to serve it at the same time as the Notice


to Perform or Quit. Let the resident know that provided he allows access as scheduled, you will rescind the notice of termination. But if he doesn’t, he should start packing. Given the alternatives, compliance almost always occurs. In the unlikely event he continues in his refusal, you have several options. Typically escrow instructions will preclude your evicting a tenant without the buyer’s consent once escrow is opened, check your escrow instructions to see if this applies. Most buyers would have no problem and will consent to his removal. The buyer and lender can be appeased by agreeing to a hold back in escrow of sufficient money to effect any needed repairs to the unit, and or to cover eviction costs. Escrow instructions can be amended to allow for reimbursement for repairs, and costs, or a return of the retained money to you. I have a dilemma. I rent a townhouse to three roommates, two girls and a guy. They all signed a one-year lease just four months ago. I got a call the other night from one of the girls, she told me that the guy had moved out a week after they moved in, after the three of them had some sort of disagreement. She said that he called her the other day and said he wanted to move back in this weekend. She spared me the details, but she sounded afraid of him. The neighbors told me some stories about the guy, sounds like we’re all better off if he isn’t around. She asked if she could change the locks and not let him in. I’m not sure what to do, if he’s locked out, won’t he just come to me and ask for a key? What do I tell him?

The one-year lease agreement provides each of the three occupants the right to occupy and use the premises for the entire term of the lease, or until terminated. No one tenant has greater rights than any other. Any action, absent a court order, by one or both of the girls to deny the third roommate entry would be actionable. If the remaining two roommates are truly afraid of the

third, they should immediately seek a restraining order barring him from coming near the townhouse. The restraining order, if done properly, will allow you to refuse to provide him with a key to the changed locks, and will keep him away from the premises. He will, however, still be contractually obligated to perform the obligations, but the restraining order will prevent him from living in or visiting the unit.

I think I’m ready to join the ranks of landlords here in Southern California. I placed an offer on a twelve-unit apartment building, the seller accepted it and I’m currently in escrow. I’m now about to conduct my due diligence. Is there anything special that I should be aware of when reviewing the property or the rent roll? Legal Q&A — continued from 13 When doing your due diligence, it is important to review all existing rental agreements and other contracts that affect the building. A practice that is becoming more and more common in smaller multi-family complex transactions is to require that estoppel statements be prepared and signed by both the seller and the occupants of each unit. When you compare these signed estoppel statements with the written agreements, and with the seller’s representations, you will be aware of any discrepancy. This has the added benefit of affirming the terms of the rental agreement either written or verbal, and confirming rental amounts, due date, names and number of authorized occupants, and the amount of security deposit currently being held for each unit. A buyer is required to make a reasonable inquiry and investigation as to the amount of security deposit held. If the buyer fails to inquire, then the ten-

ant may prevail in an action against the buyer for return of deposit, even if the deposit was never transferred to the buyer in escrow. As crazy as it sounds, the law provides that a tenant may prove the existence of a security deposit by documentary evidence or merely by a declaration in certain circumstances. In addition to a thorough review of your tenancy agreements, inspect other contracts relating to the property. If you see a laundry room, inquire as to who owns the machines. If the machines are leased, request a copy of the laundry lease agreement, and contact the laundry company to confirm the terms. Parking is very tight in the neighborhood around one of my buildings. My apartment building has fourteen units and fourteen parking spaces. There is just enough parking for each of my residents to have one space. If a resident has more than one car, they must park it on the street. It has been working out fine for years but now I have

this one tenant who refuses to follow the rules. He is constantly parking his second car in someone else’s assigned spot. I’ve told him several times but he just ignores me. What do I do?

Your community rules and regulations should specify your parking rules, specifically stating that only one vehicle may be parked on the premises, and that all parking is assigned. Ensure that you have the proper signage at the entrances of the parking area. Most cities require the sign to contain certain restrictive parking language, plus the local police department telephone number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for their specific requirements, as they vary from city to city. Next if you know the offender, then provide a written warning of the violation. Attempt to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield

of his car. If practical, take and save a photograph of the warning on the vehicle windshield and on the offender’s apartment door, if applicable. The offender will always claim that you did not give prior notice before towing, so ensure that you document the warnings well. If he fails to remove the offending vehicle, the car may be towed. I’m still a bit confused about the security deposit disposition form, and whether or not I must include receipts. Can you summarize it for me?

The method of accounting for security deposits after a tenant has vacated your rental unit is defined by statute. California law requires that certain documentation be provided to the departing tenant under certain circumstances. The law requires that landlords prepare and send an itemized statement, within twenty-one days of the tenant returning possession detailing

all deductions from the security deposit. If the deductions for repairs and cleaning exceed $125.00, then the landlord must provide copies of receipts and invoices along with the itemization, along with the name, address and telephone number of the vendor who did the work or provided the supplies. If the repairs cannot be completed within the twenty-one-day time period, you may provide an estimate of the work needed within the twenty-oneday period. Upon completion of the work, you must provide receipts and invoices within fourteen days of completion. The law provides that an owner and his employees may perform the work themselves and charge a “reasonable” fee. The law is clear as mud as to what that reasonable fee may be, suffice it to say that owners should maintain logs and time sheets to justify time spent on repairs and the reasonable hourly rate charged.

I am getting geared up for painting my 4 unit apartment building and noticed a “chalky” substance on my stucco and wood siding. I am concerned that painting over it may not be good and could eventually bleed through again. I tried pressure washing it and cleaning but it keeps coming back. Please help! Ron

Dear Ron:

The “chalky” surface comes from the existing paint on the building breaking down from old age and sun damage. The pressure washing will remove some of it, however as you have noticed, it comes back. The solution is to use a “clear chalk sealer”. It can be applied by roller, airless gun, even a garden pump up sprayer. It is easy to use and cleans up with water. The clear chalk sealer can

be found at any home improvement center or paint store.

I just inherited my parents building and was planning to upgrade two units on a tight budget when I discovered that 80% of the walls are covered in wallpaper. I really cannot afford to remove all that wall paper. Can I just prime and paint over it? Jenifer

You can paint over the wallpaper; however we highly recommend you do not. Painting over wall paper will cause a number of issues. If the wallpaper is made of paper; painting may wet and loosen the glue holding the paper to the wall. This may cause the paper to sag, bubble or ripple and the seams to standout. Future removal of the paper will be greatly hindered by the new layer of paint. Painting a vinyl or washable paper (washable paper has a thin coat of plastic film or vinyl over the paper.) will be difficult as the paint might not adhere to the vinyl and peel at a later date. Painting over vinyl may also cause mildew to develop under the wallpaper because of the moisture of the paint. Removing the wallpaper on a budget may require you to do some of the work as opposed to contracting it out. A solution may be as close as your local home improvement center. They carry any number of wallpaper removal tools, including renting a wallpaper removal steamer. If you still decide to paint; repair any damaged wallpaper, add adhesive to loose paper and sand down all the seams to minimize them showing through the paint. Use joint compound on textured wall paper and to fill holes etc. Seal the wallpaper using an oil-based sealer with an enamel undercoat. Finish by using an interior latex paint of your choice.

During the roof inspection, pay close attention to the flashing. Flashing is used to transition between the roofing material and the building or a change in roofing direction or angle. Flashing can also be found where pipes or a chimney come up through the roof. The flashing is sealed with roofing tar and water

leaks can form when the sealing tar cracks or separates from the building or the flashing material. Look for curled up roof edges on composition roofs, low spots on flat roofs and bird nests in tile roofs. Check all roof drains and cut away any trees branches that are touching or overhanging the roof. While you are inspecting the roof, check the gutters. Winter storms have a way of loosening gutters and filling them with gunk thereby causing them to lose their pitch and pool water. Pooling or over-

California Rental Properties: An Opportunity When Utilities Are Not Included

tility costs are rising without any sign of slowing down. Accountability for consumption is now a key responsibility of rental housing providers to show tenants how their behavior impacts the environment as well as their wallet. Education plays a powerful role in influencing the outcome of tenant consumption behavior. When utilities are not included, accountability can start with adopting a Ratio Utility Billing System (RUBS) as a standard business practice. A RUBS

program fairly divides utility costs such as waste, sewage, water, and more amongst tenants, based on occupancy, square footage, or a combination of other factors. Housing providers that implement RUBS empower tenants to make informed decisions on conservation in resource constrained states. communities to mobilize. When landlords and tenants are both exposed to massive hikes, together they can seek out conservation and cost mitigation solutions. On the issue of water alone, often there is absolutely no incentive to cut back despite orders by the state, primarily because water utility usage is often wrapped up in the rent payment. Exasperating the situation, you will find tenants do have little regard for their buildings consumption, because they do not see the bill. A 2015 survey of Los Angeles apartment owners showed that while other sectors made large water conservation efforts during California’s historic drought, water usage in apartments remained unchanged, and in some cases even went up despite the Governor’s 25 percent conservation order. The solution to rising utility costs that will empower tenants to conserve is implementing RUBS. The program’s method of sharing the costs of utilities with tenants uses an approved formulabased methodology. Other factors include building amenities such as laundry units, landscaping requirements, in unit amenities and more. RUBS does not require the upfront investment of submetering for each unit, so conservation is very much a community building effort, in addition to being affordable The State of California has no laws for or against the use of RUBS because the California Public Utilities Commission (CPUC) determined that rental housing providers are not selling a utility. RUBS is merely a means to pass through utility costs in a fair and equitable manner. An increasing number of rental housing providers are now adopting RUBS billing programs, and tenants are becoming more accustomed to paying for their own usage. These programs can be implemented in multi-family buildings, HOA’s/condominiums, commercial buildings and mixed-use buildings alike.

An Example How RUBS Returns

According to Britt Miller, Principal at RedBridge Partners: “Our RUBS program has allowed us to recoup $8,895 in utility expenses over the past 12 months, and a projected $14,250 over the next 12 months. Not only does this help us with our cash flow (it’s like us adding 3.5 parking spaces to our garage), but just as important it adds $316,666 in value to our building using a conservative 4.50% cap rate. If we keep up with our current trajectory and unit turns,

we should realize $745,000 +/– in incremental value through this program (almost 4.5% of the building value).”

The Threat of Rent Control and Rising Utility Costs

Steps for Maintaining a Thriving Family Business

As you meet and talk with various experts related to the different steps within the legacy planning process, you need to continue asking questions and communicating what it is you hope to accomplish. And, you need to listen. You may discover that adjustments are going to be needed. Perhaps your heirs are not in a position to run your properties the way that you might wish. Or, there may be some tax consequence or some title issues. In last month’s Apartment News article (August, 2018), I included a list of resources. As appropriate, seek out the help of others. And, as I’ve said so many times before, don’t forget to talk with your family and heirs. Remember, too, that no one has all of the answers and there may be several different ways to achieve your objectives.

So why a circle? Because this process is a dynamic one. It doesn’t end when all of the documents are finalized and signed. Just as with life, itself, there are times when changes and re-evaluation may be needed.

Many VPs in Property Management use a “dynamic” email template where only a portion of the email can be customized by the onsite manager. The marketing directors work with the onsite manager as what local information to include in the changeable portion of the template. Your web folks can set this up. Goodman Real Estate in Seattle uses email marketing to draw residents to events. Their main focus for resident events is to partner with local businesses (for example, local artists) and draw folks to their community for the event. Their last event was a blood drive and they gave away a Kindle (and collected contact information for people who attended the event and entered the drawing). Holli Beckman, The VP of Marketing for WC Smith, has an effective e-campaign in place where the emails point prospects to her blog. The blog keeps folks interested and engaged with the company. This converts to leases. One apartment community hosted an effective “win a Schwinn” promotion.

The main goal was to capture email addresses from prospects. Prospects entered the contest via an iPad and the email addresses were linked to be automatically imported to MailChimp (an e-Marketing program). One company surveyed residents and only 3 of 800 residents wanted notification via text. Survey your residents to see what method they would prefer. Naturally make sure you contact your prospects and residents in their preferred means of communication and that they have given you permission to follow up in that method. He has traveled as a guest lecturer in South Africa for the International Republican Institute and was appointed by President Bush’s campaign team as the Executive Director of the Arizona Republican Party. He was subsequently appointed as the statewide Victory Director for Governor Arnold Schwarzenegger’s reelection effort. Lifetime Achievement Award — William R. (Bill) Gorman

O

ver the next several months we will countdown our Lifetime Achievement Award winners: Bill Gorman, Rick Julian and Ray Maggi. In December we will award the 4th Lifetime Achievement Award. On December 19, 2017, William R. (Bill) Gorman was awarded the third AAOC Lifetime Achievement Award. Bill was born and raised in the Chicago area and it was there that he first ventured into real estate investments. While attending Purdue University, Bill joined the ROTC because it paid $50 a month and he needed the money. He attained an Engineering degree from Purdue and later a MBA from Northwestern. While working for Allis-

Chalmers in downtown Chicago, and having always lived in rentals, Bill decided it was time to own a home and bought a converted duplex in La Grange, Ill, not far from his work. The impetus for that decision was that as a renter he was forced to move when his previous landlord wanted to upgrade and raise the rent. Bill moved to a company that was later acquired by Beckman Instruments, and in 1968 he was transferred to California and Orange County. Having sold his duplex at a large profit, Bill realized real estate was the best way to attain financial independence. In 1968 he used his profits from the duplex to buy a 16-unit apartment

complex in Fullerton and joined AAOC that year. In 1973 he became a licensed California Real Estate Broker. Always a Bill Gorman — continued on page 46

Bill Gorman — continued from 44 learner a heart, Bill has been an avid reader and student his entire life, and has particularly been impressed by articles and studies related to real estate cycles. He continued his research into this topic and, upon reading Phillip Anderson’s theories; he became a firm believer in the 18-Year Real Estate Cycle. Real estate cycles along with Intrinsic value, compounding and contrarian investing are four of the key concepts in Bill’s 2016 book “Cash In on the Myths of Real Estate”. Bill Gorman’s involvement with AAOC runs deep and wide. AAOC began in 1961 and Bill became a member with AAOC in 1968. He participated as an exhibitor in AAOC’s Second Annual Trade Show and his company, WR Gorman and Associates continues to be a trade show supporter. He has held numerous AAOC Board positions and served as President 1988–1989. Bill is one of eight Director Emeritus. He has

been a speaker at numerous AAOC Trade Shows and meetings and continues to be a long-standing contributor to our “Apartment News” magazine. In terms of hobbies, Bill was an avid softball player for many years, playing over 300 games a year. In the past few years he has left the field, and his hobby is now focused on his lifelong passion for helping others achieve the financial freedom he has. Bill loves to talk with people, sharing his insights and providing guidance. He really enjoys working with multi-generations to determine the best way to leave a Legacy and pass wealth from one generation to the next. He also loves telling bad jokes. When asked what one piece of advice he would give fellow members, Bill replied; Read, Study, Quantify and Evaluate Your Options with respect to all pertinent risk/reward factors.
