AB 1482, as amended, Chiu. Tenancy: rent caps. Existing law specifies that a hiring of residential real property, for a term not specified by the parties, is deemed to be renewed at the end of the term implied by law unless one of the parties gives written notice to the other of that party’s intention to terminate. Existing law requires an owner of a residential dwelling to give notice at least 60 days prior to the proposed date of termination, or at least 30 days prior to the proposed date of termination if any tenant or resident has resided in the dwelling for less than one year, as specified. California Housing Continues Heading in Wrong Direction

I

hope this message finds you enjoying the last few days of summer. This year, our family celebrated our yearly vacation on our cattle ranch in Northern Idaho. A note of personal pride: my son and daughter, twin 13-year old’s, learned to drive equipment on this trip, discovering the hard work ranching requires. As many regions forecast a slowdown approaching the next election cycle, construction in the Idaho Panhandle is booming. The amount of timber trucks heading to the lumber mills was staggering and lends credibility to the belief that lumber is the leading indicator of the health of the region’s construction economy. I witnessed fantastic growth in Idaho, yet upon my return to California, I observed a marked slow-down in housing construction in both the multifamily and single-family residential sectors. This can be attributed to several factors. First of all, local opposition to projects continues to dampen builders’ spirits at the municipal and county lev-

els. Over-regulation by the state only further erodes investors’ and builders’ spirits. I believe nothing could be worse for the housing market and the state, which incidentally should be fueled by record low interest rates. I often wonder what legislators are thinking when they propose legislation to make their own required housing mandates difficult, if not impossible to achieve. Every person I know is concerned about the plight of homelessness and I say our local, county and state officials should let our industry do what it does best: provide high quality and safe housing for our residents. After all, as I mentioned in a previous article, we represent the largest small business component of our state’s economy. I often worry what tools the Federal Reserve will have at its disposal to fight a recession when the economy moves toward its next downward cycle. I’d like to turn to the efforts that your membership dollars and your participation support. The AAOC continues to fight alongside other local

associations that are members of the California Rental Housing Association (CalRHA), to oppose AB 1482 Tenancy: Rent Caps (Chiu.) As of this writing, the bill is in Senate Appropriations Committee and is scheduled to be heard on August 19. AB 1482, in its current form, reads. “The bill would, until January 1, 2023, prohibit an owner of residential real property from increasing the rental rate for the property more than once annually, and prohibit an owner from increasing the rental rate in an amount that is greater than 7% plus the percentage change in the percentage change in the cost of living, as defined, or 10%, whichever is lower…” Personally, I cannot think of any price controls that work to the benefit of all parties involved. I found myself pondering a metaphor to cattle ranching. Specifically, the effects of torrential rains that recently affected the planting of corn in the Midwest. Corn prices will undoubtedly rise and I will have to look for ways to compensate for the increased feed prices, either by ordering and storing feed now or by looking for substituting grains for finishing the herd. However, you will not see me demanding price caps on corn, as I realize this cap would affect hard-working farmers and their families. This same rationale is how I feel about rent control and price caps. I am a fourth-generation rental housing provider and a second-generation cattle rancher, and I want the best for this county, my family and for yours!

A Time to Lead in the Fight to End Homelessness

E

arlier this summer, the Apartment Association of Orange County (AAOC) took a significant step forward in its commitment to helping end homelessness in Orange County. After more than a year of collaboration, AAOC formalized a partnership with United to End Homelessness, a community-wide initiative empowered by Orange County United Way, and is poised to begin helping scale-up implementation of the Welcome Home OC homeless housing and wrap-around supportive services program. AAOC will focus its efforts primarily on raising awareness of the Welcome Home OC Program within Orange County’s multi-family housing industry and growing the United to End Homelessness network of rental property owners and operators who want to play a pivotal role in ending homelessness in our own backyard. How can these owners and operators

do that? By making critically needed apartment units available for rent to formerly homeless individuals and families, who qualify for special, federal housing vouchers set aside for Welcome Home OC program participants and have case managers providing wrap around support services. There are currently about 6,860 homeless individuals in Orange County — including 311 U.S. Veterans. Many of these individuals, including 80 veterans, have qualified for housing vouchers but cannot find a place to live. There simply are not enough rental units in Orange County where the housing vouchers are accepted for payment. This is where AAOC comes into play and where its members can make a difference. AAOC has been working with Orange County United Way, the Orange County Housing Authority and other community partners, since February 2018, to develop and fine tune the Welcome Home OC program. The goal of the program is to help qualified homeless individuals get into apartments and provide them with wrap-around supportive services provided by nonprofit entities, the county and other government entities. It has been designed to appeal to apartment owners and operators by providing them with meaningful incentives to make units available to the program. Some of the incentives include program participation signing bonuses, payment of unit holding fees, double security deposits, vacancy fees, and more.

The Apartment Association of Orange County and Orange County United Way will officially roll out the “Welcome Home OC” program at the AAOC General Membership Meeting on Tuesday, September 17, 2019 at Great Wolf Lodge. This will be an opportunity for members to learn more about the program and how it works, hear from rental property owners and operators who have already stepped up as program participants, have questions answered, and begin determining if they too are ready to make some of their units available for this cause. AAOC will also recognize and thank its members who have already joined the Welcome Home OC Network and made units available, as well the members of the AAOC’s Homelessness Task Force, which was formed over the summer to provide input and assistance in the development of the association’s member education programming about the initiative and its myriad of benefits. For the rental-housing industry, and specifically for the members of the Apartment Association of Orange County, we have an important opportunity before us to step up and meaningfully impact the fight to end homelessness in Orange County. It’s a time for our industry to lead on one of the most important issues facing us today. Playing Zone Defense “What does government have to do with (housing), you ask? Everything. Government is coach, referee, cheerleader, and fan in the game of housing.” — Alex Avery

I

n July, the New York Times published a column parroting the words of YIMBY (Yes In My Backyard) supporters and claiming that multi-family zoning was imperative to address the housing crisis. The column referenced a lack of affordable housing and noted that many cities and states are shifting away from the concept of everyone deserving a “home with a yard.” What the column fails to critique is how this alleged “housing crisis” was created. Curbed, a very leftist online website at least acknowledged part of the problem is rising material and unsustainable labor costs. Since 2004, construction costs have risen over 24% to build a new home. In San Francisco, for example, the cost of labor is 25.6% higher than the mean for the top 30 largest cities in America. The lack of housing to drive down costs is likely accurate, but it’s not due to single-family zoning. The problem is the numerous level of regulations and local government barriers that unions and other groups utilize to stall the process and drive up the costs. Let’s talk about San Bruno, California and the latest example of positive housing being rejected for no legitimate reason. Over the course of several years, the developer followed every guideline and request made by the City Council to seek approval for his 425-unit property; including, space for restaurants, shopping and affordable homes. After spending over $3-million on plans, studies, and red-tape, he was soundly rejected. His story is not unique.

But it highlights the problems with the current state of housing affairs in California. When someone can meet every rule, guideline, and request and still get rejected…well, it’s no wonder the state has a housing problem. Legislation like Senate Bill 50 (Weiner, San Francisco) and SB 529 (Glazer, Bay Area) claim to resolve this issue by allowing multi-family zoning in places where transit and low-incomes families reside. What these laws fail to acknowledge is the unique benefit from owning a single-family property. Studies after studies have demonstrated owning a home can greatly increase one’s socioeconomic status. This is not the rich getting richer. It’s families at the lower end of the financial spectrum being able to own property and utilize that property to increase their financial wherewithal. Let’s be clear, for some rental owners, the bill can be seen as a potential windfall. Properties that have the land space for more units could greatly benefit from being able to add capacity. How this will be done in a world where costs and regulations will continue to exist has yet to be discussed. Furthermore, the counter to this argument is the realization that these units will likely be placed in areas where single-family property owners are going to see their property values go down. That in turn will mean they could easily be put underwater on their investment. And, for rental property owners that could mean a huge change in their ability to secure loans or refinance.

The main thing to realize during this debate is that the Legislators are once again trying to shift the blame onto someone else. They have the authority to modify regulations, ease the development requirements, and streamline red-tape rules to make the process less costly. We both know that’s not going to happen. Instead, the state will continue try to find solutions that blame property owners, rental managers, and anyone else that is just trying to secure a future for their families. This is why we must stay vigilant and keep banging the proverbial drum. When Government Gets Involved…Watch Out. ‘Those who fail to learn from history are condemned to repeat it.’ — Winston Churchill

O

ur Sacramento politicians have declared a statewide “housing affordability crisis” and many cities in California are considering “temporary” and “emergency” rent control measures. In Orange County, the city councils of Anaheim and Fullerton have discussed emergency rent control measures for mobile home parks. Last year, the multi-family housing industry successfully defeated Proposition 10, a statewide ballot initiative to repeal Costa-Hawkins. This year, we are fighting statewide “rent cap” (or emergency anti-rent gouging) legislation and a petition is presently being circulated throughout the state to put rent control back on the ballot for the 2020 election. Petition circulators have been recently seen in many Orange County areas, trying to collect signatures. We must always be leery when elected officials claim to need temporary “emergency powers” to solve a crisis. In the January 1972 edition of

Orange County Apartment House News, known today as your Apartment News magazine, our good friend and CPA, Clem Morin, gave advice to rental property owners in his article “Rent Freeze Guidelines from the IRS.” In 1972, the nation was under an “emergency rent freeze” implemented under President Nixon’s “Wage and Price Control” program, which he had imposed nationwide the previous August. Nixon was attempting to stifle a sharp rise in inflation caused by the late ‘60s “guns and butter” policies of Lyndon Johnson’s Vietnam War budget, compounded with his “Great Society” welfare program. Clem’s 1972 article urged our AAOC members to delay any immediate action on residential rent increases until after the “Price Commission” had accepted recommendations from the “Rent Advisory Board.” A horrifying bureaucratic prospect for every rental property owner in the nation. The freeze was initially popular with the public but lost popularity after 1973, as the

negative impact of the Wage and Price Control policies became apparent. At the time, Nobel Prize-winning economist Milton Friedman correctly predicted that the price freeze would end, “in utter failure and the emergence into the open of the suppressed inflation.” This is exactly what happened. Economists of the era, Daniel Yergin and Joseph Stanislaw, explained in The Commanding Heights: The Battle for the World Economy, it was obvious that price controls didn’t work, as “Ranchers stopped shipping their cattle to the market, farmers drowned their chickens, and consumers emptied the shelves of supermarkets.” The subsequent rise in inflation, gas shortages and astronomical interest rates of the 1970s continued until Ronald Reagan became president and eliminated the remaining price controls. When our politicians invoke “emergency powers,” they will tend to abuse them in situations that were never envisioned when the powers were originally granted. “Temporary” rent control laws have a habit of becoming permanent. The big lesson is that the power of politicians over the economy should be limited.

Questions & Answers I heard that the time periods for calculation of a three-day notice to pay or quit is about to change, is that true?

Correct, not only the Notice to Pay or Quit but the Notice to Perform or Quit as well. Effective September 1, 2019, calculation of the days to perform will exclude Saturday, Sunday and other judicial holidays. After September 1, a Three-Day Notice served on Monday, will expire on Thursday, same as it is now, every day is counted. However, a

Three-Day Notice served on a Friday, will expire on the following Wednesday; Saturday and Sunday are not counted. This new law, AB 2343, applies to both residential and commercial tenancies. Additionally, the time period for responding to an unlawful detainer civil court action is extended so that Saturday, Sunday and other judicial holidays are not counted when calculating the due date for a responsive pleading. The result of this change is a delay in the eviction process.

My neighbor is driving me nuts. We have a fence that straddles our shared property line. Been time to repair it for years now, looks pretty bad, however I can’t get him to agree on sharing the cost to repair it. What do I do?

California enacted the Good Neighbor Fence Act back in 2013 to address issues like this. It creates a rebuttable presumption that adjoining landowners share equally in the cost of maintenance of boundaries and monuments between them. It also provides a procedure to follow to guide the parties toward resolution of the dispute. You must provide your neighbor thirty-days’ notice of your intent to incur costs to maintain the fence, and that there is a presumption of equal responsibility for the costs of construction. The notice should describe i) the nature of the problem, ii) the proposed solution, iii) the estimated costs, iv) the proposed costs sharing approach, v) the proposed timeline. The neighbor may agree or disagree. If he disagrees,

he must bring an action to determine if any adjustments are warranted. The court will consider: i) whether or not the financial burden is disproportionate, ii) whether the cost of the fence exceeds the value realized, iii) and whether the financial burden causes an undue financial hardship to the party. The court can adjust the financial responsibilities accordingly. I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge! How do I handle this?

Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental prop-

Once applied, the best applicant should be accepted, not necessarily the first to apply. I am a very conscientious landlord. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. This month I received a letter from one of my tenants telling me that I had no right to enter his apartment to look around, that he would not let me in. What do I do? Can I force my way in to do the inspection?

Your policy of doing annual inspections is admirable and is practiced by

responsible landlords throughout California. Most tenants welcome a responsible landlord’s actions in ensuring that all is well, and voluntarily cooperate in providing access upon the landlord’s reasonable request. It is clearly in the best interest of all to ensure that any maintenance issues are promptly addressed, and that a spirit of communication and co-operation exists between a landlord and his residents. Trouble is, your resident is right. There is no specific provision in California law requiring a resident to allow the landlord access to merely “inspect” the premises. California law states that a landlord can enter a rental unit only for certain reasons. Those reasons are in an emergency, when the tenant has moved out or abandoned the premises, to make necessary or agreed repairs, decorations, alterations, or other improvements, to show the unit to prospective purchasers, tenants, or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a

pre move out inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a landlord to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. This article is presented in a general nature to address typical landlord tenant legal issues. I just received a code enforcement violation letter for some problems that I was not aware of at my building. I typically keep my property in good order, but a few maintenance items may have slipped by. The violation letter has me very upset, as the problems mentioned are minor. How do I make this all go away? What do I do first? Bill

Dear Bill:

It is always a bit upsetting to have someone else tell you what to do with your property. The first thing to understand about a code violation letter is that it is not a personal attack. Look at the violation letter as an opportunity. The city is giving you a heads up to potential problems at your building. There may be a drug or gang issue that you were not aware of, or landscaping issues, or even deferred maintenance issues. Essentially, it is a wakeup call to

pay closer attention to your building & neighborhood. The first thing to do when you get a code enforcement violation letter is to call the city and speak to the code enforcement department. Make the call with an open mind and calmly get the facts. The purpose of the call is to let the code enforcement department know you are aware of the situation and that you are cooperative and willing to resolve the issue. Keeping the lines of communication open with the city is essential to solving your current issue. Should you need more time to compete the corrections, contact the officer in charge of your case and ask for an extension. The violation will not go away if you ignore it! Take before and after pictures of the repairs or issues. Upon correction of the violations, call the code enforcement department and let them know the work is complete. The faster they sign off on the violation letter, the better.

Dear Maintenance Men:

I am updating my resident move-in letter about the proper usage of the appliances in the unit and I have a question about coffee grounds. I have always heard it is bad to put coffee grounds down the garbage disposal unit, but don’t know why? The grounds are finely ground and should pass through the disposal with no problem. Can you enlighten me? Lenny

Dear Lenny:

The problem with coffee grounds is most people just dump the contents of the coffee machine into the drain and don’t use enough water to wash it away. What happens with the coffee grounds, especially with back-to-back drains, is that the coffee grounds tend to pile up in the pipe as it goes through the wall. Over time, it will pack the pipe completely. The garbage disposal does not have trouble with the grounds themselves; it’s what happens after they leave the disposal. Again, if the coffee grounds are fed slowly into the disposal with plenty of water running, the grounds will disperse and not compact in the drain line. Unfortunately, we find most residents are not really patient enough and they just dump the grounds and go.

Dear Diana:

A quick list of what should be in your family disaster preparedness kit: Flashlight with batteries; canned goods; a gallon of water per person; a knife; medications and blankets at minimum. Now, this works o.k. for a family, but

may not be appropriate for an apartment building. The residents may very well shelter in place during a disaster and be fine. What may be in danger is your property! Start with a bit of preventive disaster maintenance. 1. Locate the main water shut-off valve and any minor shut-off valves. Make sure the valves are in working order. If they are gate valves, it might be time to upgrade them to ball valves. Old gate valves are notorious for

breaking valve stems at the moment you need them to work. 2. Locate and clearly mark the main electrical panel. 3. Locate and mark the main sewer clean-out. Run a mainline snake or hydro jet at least once a year. (A Friday evening main back-up is a disaster.) 4. Locate and mark the main gas or fuel oil shut-off valve. 5. Write down and post this information in a public area of your apartment building, including emergency phone numbers and how to get hold of management. Alternatively, post this information on the inside of a kitchen cabinet door in each rental unit. We need Maintenance Questions!!! Conserve to Preserve Sun Setting on Some Solar Incentives

I

n 2015, Congress approved an extension of the Investment Tax Credit, adding an extra five years to previously approved federal solar tax incentives. However, that extension is about to start phasing out—barring a late-game legislative change. Through 2019, owners who install individual or commercial systems can deduct 30 percent of the cost from their federal taxes—with no cap. That deduction is set to step down beginning in 2020, though several federal legislators have advanced plans to either extend the ITC a few more years or even make it permanent. The “Sunshine Forever Act” introduced this past spring by Representative Charlie Crist of Florida would extend the ITC until 2029. It is currently under consideration by the Committee on Ways and Means. Plus, Senator Chuck Schumer of New York, the Democratic leader in the Senate, told President Trump in a letter at the end of 2018 that any infrastructure package in 2019 must include “permanent tax incentives for domestic production of clean electricity and storage, energy efficient homes and commercial buildings, electric vehicles, and modernizing the electric grid.” In practical terms, this could mean the indefinite extension of the ITC. If those extension pushes fail to gain traction, in 2020 the rebate drops to 26 percent and in 2021 it drops to 22 percent. In 2022, it drops to 10 percent and even that deduction will only be allowed for commercial systems. Property owners considering adding a solar system would be wise to do so

before this incentive is gone. The claim can come as soon as construction of the system is complete, not, as in previous legislation, when it is fully operational. Even though the extension is seemingly on the way out, U.S. Representative Mike Doyle of Pennsylvania recently introduced a bill to add energy storage installations to the ITC. Currently, energy storage solutions are only accepted if they are paired with a photovoltaic system. The new bill would also include storage systems powered by the grid, renewable energy or a combination of the two.

California’s Solar Incentives

Energy storage was at the forefront in Sacramento in 2018, when an extension to the Self Generation Incentive Program passed on the last day of the legislative session. SB 700 extends the existing energy storage incentive program to 2026 and adds $800 million to its coffers. The state also has a tax incentive for solar power storage and creation. Like the federal version, it has an upcoming expiration date. Section 73 of the California Revenue and Taxation Code allows a property tax exclusion for certain types of solar energy systems installed between January 1, 1999, and December 31, 2024. In 2011, the bill was clarified to include systems installed through sale-leaseback arrangements. Leased systems are not eligible under the federal program. According to the tax code, qualifying solar energy systems “are thermally isolated from living space or any other area where the energy is used, to provide

for the collection, storage, or distribution of solar energy.” Photovoltaic systems, solar water heating systems and solar thermal electric systems are included, but not solar pool-heating and solar hot-tub-heating systems. Solar creation and storage devices, power conditioning equipment, transfer equipment, and parts all qualify for a tax deduction at 100 percent of the value. Pipes and ducts that are used to carry both solar energy and energy derived from other sources only qualify for the exemption up to 75 percent of the full cash value. Additional Local Incentives

In addition to federal and state incentives, local utilities also offer additional programs that vary depending on the municipality. Southern California Edison, for example, only offers solar incentives for low-income customers and affordable housing providers. But certain Orange County cities offer other savings programs that are open to all. For example, in Irvine there are no permit and plan check fees for the installation of solar panels and solar hot water heating systems. Check with your local energy supplier to get up-to-date incentives in your area. ommunity management teams are in a unique position. It’s not your usual nine to five job and many community managers live on the same sites they are in charge of. Frequent phones buzzing, emails coming in, and employees with this question or that can begin to take its toll on even the most seasoned team leader. What you don’t want to experience is burnout. Following are a few tips for managing a work life balance in property management: Get your priorities in check. Analyzing and organizing your priorities can help save yourself a great deal of time and stress. Lay out all of the

community related tasks you must complete by the end of the day. Put them in order from most important to least important by comparison. It is important to remember that not everything on the list must be completed within a twenty-four hour period. There are always some issues that can wait another day. If emergency calls from residents come in during this time, consider them the same way. A broken plumbing pipe is a “right now” problem, while a stopped up drain could be a “tomorrow” problem if there aren’t enough hours in the day. Be quick after work hours. If you

receive an email or phone call that you must take after your designated work hours, try to make it as quick as possible. A short answer or a concise solution is all that is needed, and unless it is an emergency situation, a more thorough explanation can come tomorrow. Put trust in your team. 2020 Vision: Does the Investment Outlook for Apartments in Orange County Remain Crystal Clear?

n spite of the hostile legislative climate in the State of California, Orange County remains among the strongest performing markets for multi-family residential investments in the United States. Rising rents and declining interest rates have helped take asset values to record heights. But 2020 is an election year and in addition to the presidential election, there are likely to be two controversial California ballot initiatives for investors to fret over: The “Split Roll” Property Tax and “Prop 10: Version 2.0.” These initiatives will be among the issues discussed at the Apartment

Why Should You Care If Your Tenants Carry Renter’s Insurance?

I

n the event of a fire, your apartment building policy will exclude any property owned by your tenants. Your building will get rebuilt by your insurance company, but your tenants will have lost everything they own and chances are they will turn to you with the false belief that since they were living in your building, you will be able to provide coverage for their property. It is a heart wrenching conversation to have with tenants who are many times living paycheck to paycheck, to tell them that there is nothing your policy can do for them. A far better scenario, should a fire occur, would be to remind them that they took out that renter’s insurance policy you required and now they have somewhere to turn for the money to replace their lost and damaged property, and to provide temporary housing. When I was a new agent, I had a client who called me to report that there had been a fire in his four plex, one of the tenant’s children had found a lighter

and decided to experiment with it. He had our best policy and I immediately assured him we would have an adjuster out there right away. I was confident that he would be well taken care of by our claims team. However, his next question has stuck with me over 30 years later, “what about the family who lived in that unit, they lost everything, and they have no place to sleep tonight”. He could not believe we did not have something on our policy to help his long-time tenants who he knew were living paycheck to paycheck and did not have the luxury of an emergency fund for times like this. I met him and the adjuster at the building early the next morning. The family was there, they had come to try and sift through the rubble and find anything worth salvaging. The fire department was there doing their investigative work, so the family was sitting outside on the front lawn. Mom, Dad and two small children. As I introduced myself and saw that devastated

look in their eyes, I completely understood my client’s heartbreak that there would be no coverage to replace their belongings. I know for a fact that he gave them some money out of his own pocket to help them get relocated. From that point on I have made it my mission to inform my apartment building owners that they should require their tenants to carry renter’s insurance. Not only will it make the building owner a hero in times of unexpected disaster such as this, it has many other advantages to the building owner as well. Why should you require tenants to carry renter’s insurance? 1. In the event of a fire when they turn to you for guidance, you can remind them of that policy that they took out as a condition of your lease agreement. They will have replacement coverage for their destroyed/ damaged property and money to Renter’s Insurance — continued on page 36

liability cost and defense. How does this help you — this promotes a peaceful resolution between your tenants and helps to avoid you becoming involved in neighbor disputes.

Renter’s Insurance — continued from 34 get a place to live temporarily, with additional funds for meals, pet boarding, etc. These coverages are standard on the property portion of most renter’s insurance policies. How does this help you — your tenants will thank you for being caring so much to insist they have insurance! 2. If your tenants have their vehicle broken into, or their home broken into, and they lose expensive personal items, the renter’s insurance will provide them with the funds to replace these items so they will not have to replace them out of pocket. How does this help you — they will not be able to use this loss as an excuse as to why they can’t make their rent this month! 3. If your tenant takes his dog for a walk and she bites the neighbor, the renter’s insurance policy will provide coverage for the tenant’s

4. If your tenants have guests over and they are injured on the property, having the tenants file the claim under their own insurance may mean that you do not have to become involved. How does this help you — hopefully you will not have the tenants or their guests making a claim against your policy! Many tenants are unaware of what a renter’s policy can do for them. They also are usually surprised to find out that such a policy can cost as little as $150 a year. On top of that, many companies will provide a “bundling” discount off the auto insurance and sometimes that discount pays for all of most of the renter’s insurance premium! Many landlords are unaware of the

peace of mind a required renter’s policy can provide them. Some things to remember: 1. Make renters insurance a mandatory requirement included in your lease agreement. 2. Ask to be named as additional insured or additional interest on the renter’s policy so you will be informed if it should go out of force. AAOC Concludes its Summer Apartment Maintenance & Repair Series

T

he Apartment Association of Orange County (AAOC) recently concluded its Apartment Maintenance & Repair Series, which provides novice and seasoned multifamily housing professionals with practical knowledge and hands-on training to help them better operate and maintain their rental properties. From basic repairs and maintenance to a rehab of a single unit or complete building, the teams from Buffalo Maintenance and KD Electric helped the students figure out where to begin, what to do, and how to do it right. The four-week series was comprised of a different training module each week: general maintenance; plumbing;

decking; electrical maintenance, and repair. The students learned not only the nuts and bolts of each trade but also the proper terminologies and how to speak the language of maintenance. This is very important as apartment owners, managers and maintenance staff often interact with multiple trade vendors each day. Understanding the language of maintenance empowers them to make better informed decisions regarding the scope and cost of the work to be done. Week one focused on general maintenance, with instruction and hands-on repairs of drywall, texture, windows, doors, tile, vinyl and more. The Buffalo Maintenance team covered the basics

of proper inspections: inspect, identify and document; what maintenance technicians should know; routine maintenance vs. emergency maintenance; and basic framing and stucco repairs. Plumbing was the focus of the second week of class, with the Buffalo Maintenance team providing hands on training and demonstrations of routine residential plumbing repairs. They also provided tips for averting potential problems before they happen; discussed the tools and “tricks of the trade� to save time and money; covered the steps to repairing a problem drain (hydro jet vs. cabling/snaking) and the basics of copper pipe and PEX repairs, including tub and shower wall installation. Students spent their third week learning about decking, with the Buffalo Maintenance team providing instruction and hands-on demonstrations for repairing damaged decks and installing new ones, as well going over the differences between water resistant and waterproof systems. The fourth and final week of the series focused on electrical, with the team at KD Electric providing hands-on instruction and demonstrations of installations and repairs; covering the basics of wiring switches and outlets, protecting life and safety, and troubleshooting to save money; and discussing what maintenance technicians can do and what they should not do. Additionally, the students learned about preparing their properties for Section 8 electrical certification and


the basics of grounding their apartment buildings and why it is important. AAOC wishes to thank Buffalo Maintenance and KD Electric for serving as instructors and sponsoring this year’s Apartment Maintenance & Repair Series. Knowing Your Property. It’s More than Just the Obvious.

M

ost rental property owners are hands-on operators. Even those who hire professional property managers believe that they keep a close eye on the condition of their properties. But is this actually true? As we have seen in the popular “Febreze” commercials, we all tend to be nose-blind in one form or another. What we think is fine, may in actuality not be! This is a subject my father and I addressed in his book, Cash In on the Myths of Real Estate. While the myth above might seem to state the obvious, it is easy to fall into the if it’s not broke, don’t fix it trap. Taking this approach can create

serious legal and financial ramifications in the long run. First of all, by not reinvesting into improvements, you are taking a risk. As your property becomes less attractive, your quality of residents deteriorates. Sometimes this process leads to a downward spiral for the entire neighborhood. Also, there is the tendency to ignore the eventuality of major repairs. Reserve funds are not something that just condominium associations need to be concerned about. You, as the owner of an investment property, should be saving for such items as re-roofing, repainting the exteriors and trim, resealing and/or resurfacing parking areas, and replacing air conditioning units.

The longer that you hold a property, the greater is the likelihood of having to make some or all of the above repairs. A roof only lasts 15 or so years. Air conditioners, especially those using Freon, are probably due for replacement. One great method of getting an update is to walk your property with your insurance agent at least once a year. Agents who specialize in insuring multifamily properties can be an invaluable resource. They know what is covered and what isn’t as well as how age impacts that coverage. And, if you are using a property management company, require them to inspect every unit at least once a year and ask for a by-unit report. They should be

6-1 You know the condition of your property. Popular Belief: Hands-on owners are the ones who know the condition of their properties. Bill’s Truth: Residents and time have a way of changing things. Because this type of deterioration usually happens gradually, what is in your mind that you are seeing and the reality are often very different. Have someone conduct an independent evaluation of your property. Listen impartially and make changes as needed. Along with keeping up with normal wear and tear and the aging process, you also need to continue to meet the standards expected by prospective residents. If your property is not competitive in terms of the look, interior finishes, and amenities that prospects in your market are seeking, then you are probably going to have to adjust your rents. The more aware you are of what types of features command what types of premiums, the more accurately you can position your own rents and evaluate what the return would be from making improvements. By staying slightly ahead of the competition in terms of the property amenities as well as the features and finishes that your apartments offer, you also can ensure that your property remains a market leader that continues to attract prospective residents and commands top rents.
