Confronting Your Own Mortality...For Your Estate’s Sake
Y
ou don’t slay the goose that lays the golden egg, or so goes the age-old folktale. For investment advisors in today’s economy, few adages are more fitting when describing the struggle for wealth following the death of a family member. In some instances, an individual’s wealth is bolstered, but in others it is created overnight. While those who are more knowledgeable regarding investments, financial markets and tax consequences are less in need
of support or advice, those who lack the financial expertise or insight regarding the performance of markets and or investment classes might soon find themselves squandering their one shot at a lifetime of wealth. Common pitfalls include shortsightedness over an asset’s continued growth potential, a lack of asset-specific expertise on the part of the inheritor or mistiming the market. Although discussing one’s mortality is not the most com-

The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester. forting of topics, taking the time to plan ahead, advise and strategize on a course of action following your death could ultimately be the determining factor in what prevents your heirs from squandering what you worked for and keeps you from rolling over in your grave. A Tale of Two Siblings Two of the more unfortunate scenarios I have experienced this year consisted of siblings who inherited large interests or sole interests in their father’s commercial real estate holdings. For both sets of siblings, the assets they had inherited represented the most valuable assets left in their family’s estate. Needless to say, both groups proceeded to make rookie blunders in the process of wasting away the wealth recently bequeathed upon them. One group decided to sell offmarket and on the advice of an inexperienced broker did not even market the property to the general public. The result? They left over $800,000 on the table during the sale. The other group wasted hundreds of thousands of dollars suing one another as they were unaware of the distribution of shares that their father had left behind. Each sibling felt they should have or would have received more than the other (picture Walmarton-Black Friday-like rage). Clearly, it would have been more prudent to dispose of the asset instead of suing one’s sibling. But you know the saying, “A fool and his money…” Now for the cake topper: neither party familiarized themselves with the tax implications they would face for having sold at this time. Again this resulted in the debit of costs in the high six figure range, further diminishing the already reduced profits. Indeed, dad would not be happy. What’s Earned Vs. What’s Inherited Wagering on the behavior of an individual new to wealth is a crapshoot at best. To some it is an added personal savings buffer, but for others it spells new jet skis and vacation homes. Often times, this champagne taste contradicts the conservative
approach to personal finance held by a benefactor. In order to educate your heirs on a particular investment’s significance to your estate, start by providing the story behind the asset. When and why did you acquire it? What financial return does this represent to you and what would the market bring? While it is unlikely that the market would produce a greater return than the one currently in place, if greater returns are feasible and attainable by trading or exchanging, why not recommend that as an option? And while there is no guarantee on whether or not your heirs will heed your advice post mortem, do not fear. It is not unheard of to require a majorityrule system when there are multiple heirs involved. Or, consider appointing an advisory board of sorts that will weigh in and advise on any imprudent moves being made. An advisory board, consisting of conflict-of-interest-free professionals, would likely authorize the repositioning of debt on an asset

They are the final frontier: at a recent general membership meeting, guest speaker Adam Probolsky characterized the apartment owners in Orange County as the last vestige of the cowboy; truly entrepreneurial and open frontier minded when it came to business. It drives their success and, by it, drives the ingenuity of a healthy rental housing marketplace. They are risk takers: handing over keys to a stranger. Enough said. These common traits make the stories of each of these industry professionals, whether they are corporate level or IRO, all the more interesting to know…and a pleasure with whom to work. I have not counted them all up, but I will venture to say an historic number of Orange County City Councils are now constituted by a majority of freshman councilmembers. And by now they are crossing over the traditional honeymoon phase and are getting ready for their first 100 days report card. We at the office of government relations

“
Hope for the best but prepare for the worst” might be an appropriate theme to have in mind as we enter into the beginning phase of the new 2015–2016 Legislative Session. Even before the ceremonial opening in December, newly minted and returning legislators opined on a growing number of issues they intend to tackle this year. And the first several days’ bill introductions proved their case. Among the early introduction of bills of particular interest to owners and managers of residential rental housing are measures relating to water, taxation, wages, housing, immigration and marijuana, among others. Here is brief look at these and other issues likely to come in the near future as this new session gets under way.
Water Senator Wolk is back again with the makings of a reprise on last year’s SB 411, a water submeter bill that evoked intense discord in the housing industry. This year’s version is SB 7, poised to be a vehicle for negotiation on the mixed elements of this measure. Senate Bill 20 (Pavley) opens to public inspection records maintained by the State Department of Water Resources regarding water well digs and other information pertaining to maintenance or abandonment of water wells. Assembly Bill 1 (Brown) would prohibit a city, county, or city and county from imposing a fine under any local maintenance ordinance or other relevant ordinance for a failure to water a lawn or having a brown lawn during
a period for which the Governor has issued a proclamation of a state of emergency based on drought conditions. Wages Assembly Bill 11 (Gonzalez) would revise the definition of an employee under the Healthy Workplaces, Healthy Families Act of 2014 to, as of July 1, 2016, include providers of in-home support services. That Act entitles employees to paid sick days accruing at a rate of no less than one hour for every 30 hours worked. Assembly Bill 67 (Gonzalez) would enact the Double Pay on the Holiday Act of 2015 that would require an employer to pay at least 2 times the regular rate of pay to an employee for work on a “family holiday” as defined

(December 25 or the fourth Thursday of November). Senate Bill 3 (Leno) would increase the minimum wage, on and after January 1, 2016, to not less than $11 per hour, on and after July 1, 2017, to not less than $13 per hour. The bill would require thereafter the annual automatic adjustment of the minimum wage, commencing January 1, 2019, calculated using the California Consumer Price Index. The bill would provide that its provisions not be construed to preclude an increase in the minimum wage by the IWC to an amount greater than the formula would provide, to result in a reduction in the minimum wage, or to preclude or supersede an increase of the minimum wage that is greater than the state minimum wage by any local government or tribal government.
Corporate Tax Law, and to examine the impacts of a lower and simpler Personal Income Tax Law. Assembly Bill 2 (Alejo) is a spot bill stating the author’s intent to enact legislation that would authorize certain local agencies to form a community revitalization authority within a community revitalization and investment area, as defined, to carry out provisions of the Community Redevelopment Law in that area for purposes related to, among other things, infrastructure, affordable housing, and economic revitalization, and to provide for the financing of these activities by, among other things, the issuance of bonds serviced by tax increment revenues. Senate Bill 45 (Mendoza) also is a spot bill stating the author’s intent to enact legislation that would authorize local governmental entities to use tax
Taxation Senate Bill 8 (Hertzberg) states legislative findings regarding the intended Upward Mobility Act, key provisions of which have not been articulated yet, but are intended by the author to expand the application of the Sales and Use Tax law by imposing a tax on specified transactions and services, to enhance the state’s business climate, to incentivize entrepreneurship and business creation by evaluating the

increment financing for the development of economic planning, infrastructure, and educational facilities. ADA Compliance Assembly Bill 52 (Gray) would limit the maximum liability for statutory damages in a construction-related accessibility claim against a place of public accommodation to $1,000 for each offense if the defendant has corrected all construction-related violations that are the basis of the claim within 180 days of being served with the complaint and the defendant demonstrates that the structure or area of the alleged violation was determined to meet standards or was subjected to an inspection, as specified. The bill would also provide that specified statutory damages in a construction-related accessibility claim against a place of public accommodation that is a small business, as defined, may only be recovered if the place of public accommodation is granted a 180-day stay of court proceedings to meet specified requirements. Assembly Bill 54 (Olsen) would, when a plaintiff brings a claim alleging a violation of a construction-related accessibility standard within 3 years of a change in that standard, allow a plaintiff to collect statutory damages only if the violation is not cured within at least 60 days following a specified written notice or demand letter.
Miscellaneous Assembly Bill 34 (Bonta) is a spot bill designed to establish a comprehensive and uniform state regulatory structure to govern the cultivation, processing, testing, and distribution of medical cannabis. This measure joins a chorus of past and future efforts across the country to expand upon the recreational use of marijuana, as just recently embraced in Washington and Colorado. Among the many other issues likely to come in the near future are those pertaining to:

ost of my challenges come from my residential tenants. I have a question about handling a commercial property situation. I am about to enter into a ten year term lease for an industrial unit in Southern California. The unit has been vacant for quite some time now and I don’t want to lose this deal, seems like good tenants are kind of few and far between lately. We’ve agreed on just about all of the deal points
except a couple. At the last minute the tenant requested the lease be prepared with a subsidiary of his company rather than the parent company, saying it is for ‘tax reasons.’ Additionally, he wants to make the use provision extremely broad rather than specific allowing him to do just about anything in the premises without having to get my permission. He knows I need to lease the space, but I’m not sure I want to give in on these points,
what are my options?

Q&A — continued from page 14 considering certain requests. Generally, parties meet somewhere in the middle of a request, allowing certain concessions, but protecting the interests of the Lessor. The tenant’s last minute request to substitute a subsidiary in its stead is an attempt to shift the risk away from the financially stable parent company, and obligate a less financially qualified entity, often times a mere shell, with relatively few assets. Screen the proposed replacement tenant as you would any proposed tenant to determine if it meets your rental criteria. Is it an existing concern or a new entity recently formed solely for the purpose of signing this lease? Is it an independent business concern, generating its own revenue stream? Does it have assets of its own? Or is it merely a subsidiary of the parent with no independent means of sustainability. There are many options to offer that would allow the tenant to satisfy his ‘tax reason’ while still protecting the

Lessor’s interests. You may allow the replacement tenant, but require the parent company to guaranty the lease. The Guaranty can range from an unconditional full term guaranty to a limited guaranty based either on a certain period of time, or a certain maximum exposure. An increased security deposit adds protection as well. Options such as an irrevocable declining letter of credit issued by a reputable financial institution allow parties to salvage deals that might otherwise fail. Use provisions are important for a number of reasons. It is important that the tenant’s use does not overburden the facility, or interfere with the neighbors. Certain unacceptable tenant uses may involve high levels of noise, or the use of corrosive or carcinogenic materials, or other toxic byproducts. As your facility is an industrial complex, parking is no doubt limited. It is important that the approved uses do not overburden the limited available parking. Rather than approving a very broad undefined

use, it is better to identify the allowed use, but allow the tenant to request approval for a change of use in the event its operations change in the future. I sold one of my apartment buildings and did a 1031 exchange into a single tenant commercial building. The tenant has been there several years and has a pretty sweetheart lease. The base rent is way under market, and he has a couple of options to renew that pretty much keeps him under market for the next ten years. Even though the lease requires the tenant to maintain the property, it looks like hell, not painted, not maintained, kind of a dump. By the way, he also seems to like paying his rent late, just got last month’s rent yesterday, three weeks late! What can I do?

The two options to renew at less than market rents would have negatively impacted the price you were willing to pay as well. By allowing the building to fall into disrepair, and by paying the rent three weeks late, your tenant has provided you with an opportunity to substantially increase the value of your investment. Certain defaults, if uncured, will allow you to take legal steps to terminate the existing lease, and along with terminating the current lease, all options to renew would become ineffective. Go through the lease terms carefully, identify which terms are being violated by the tenant. Review the requirements for exercising the tenant’s right to extend. Most options require that the tenant not be in default when exercising an option. Further, most leases will cancel a tenant’s right to

extend if the tenant has been served with three separate notices of default during the preceding term, even if the defaults were actually cured. Additionally, if a notice to cure a breach is served upon the tenant, and the tenant fails to cure during the relevant cure period, then the landlord will then have the right to file an unlawful detainer action against the tenant and remove the tenant from possession. Quite often, after the filing of suit, the parties may wish to negotiate a settlement and allow the tenant to remain in possession. As part of the negotiated agreement, the landlord will want to redraft the lease agreement in a more favorable light, and either eliminate the options to renew, or change them in such a way that would be acceptable to the landlord. A tenant, failing to cure a notice of breach, has very little negotiating power when faced with the likelihood of being evicted from the premises. I have the misfortune of a classic problem tenant. The noise, the parties, the trash… I don’t even know where to begin. Also, she’s paid her rent late for the past three months. The lease has a late fee provision that charges $50.00 if rent is not received by the 5th of the month. Because of this, she’s been paying both the rent and the late fee well into the second week of the month. Last month, the first of the month fell on a holiday. So I served her a 3-Day Notice to Pay Rent or Quit on the 2nd or should I have waited until after the 5th to serve the Notice?

If rent is due on the first of the month, and the first of the month falls on a weekend or a holiday, the tenant has until the first business day of the month. The rent is considered late the following day. If the first is a Saturday, the rent will actually be due on Monday the third, and will be late Tuesday the fourth. In most instances, the specific language of your lease will govern the issue of when late fees accrue. On one hand, some leases have clauses that define when rent is late. If your lease states that “rent is due on the 1st of the month, but will be considered late if not paid by the 5th,” then your lease defines when rent is late, and you may properly serve a 3-Day Notice to Pay Rent or Quit on the 6th day of the month. Conversely, other leases establish time periods before late fees kick in, but do not define when rent is late. For example, if your lease states “rent is due on the 1st of the month, and if not paid by the 5th will result in the imposition of a late fee of 6%,” then the clause is merely establishing the time period for the imposition of a late fee. In this second scenario, you may serve a 3-Day Notice to Pay Rent or Quit on the 2nd of the month (provided the 1st falls on a business day).

serve my first 3-Day Notice to Pay Rent or Quit. The December rent is $1600.00, and the tenant only came up with $400.00. So, I served him a 3-Day Notice for $1200.00, for rent due from December 8 to December 31. I figured the place is worth $53.33 a day and he had paid for 7 days’ worth of rent. I asked the manager of the building next door, and he said that should be fine. But when I showed it to my dad, he freaked out. Does it really make any difference?
Yes. As a general rule, monthly rent is a sum due for a whole month of tenancy. The remaining balance of $1200.00 is due for the entire month, not a prorated portion. Any payment received should not be accounted or prorated to specific days, but should be applied toward the total monthly installment due. Thus, the remaining balance of $1200.00 is for the period of December 1 through December 31. Although your notice is not technically defective, it infers that the rent is not due until December 8. In addition, errors are commonplace when you try to prorate the rent on a Notice. For these reasons, you’re much better off to serve a Notice for the $1,200.00 due for the entire month of December. I have a tenant who has been consistently making partial and late payments from the day she moved in. The problem has gotten so bad, that it’s now difficult for me to find out how behind she really is. For example, the past three months of payments have been as follows: in October, she paid $500.00; in November, she paid $600.00, and in December, she paid $300.00. The rent is $700.00 per month. As you can see, she hasn’t made a full rent payment for a while. Unfortunately, my records are so bad that I don’t know when the late and partial payments started. If I want to evict her, how do I prepare a 3-Day Notice to Pay Rent or Quit?

appy New Year! I hope this missive finds you safe and healthy so far in 2015. The new Congress has been sworn in, freshmen are figuring out where the cafeteria, the WC and Committee chambers are located (not necessarily in that order) and the party caucuses are organizing for many battles to take place over the next two years. For the GOP, the hope was to start fresh with no extraneous baggage from the last Congress getting in the way of their goals as they take control of both chambers. Alas, it was not to be. Congress left the reauthorization of the Terrorism Risk Insurance Act (TRIA) undone before the end of the 113th Congress so now they must dispense with that before they can dig into other priorities.

As you know by now, former Sen. Tom Coburn (R-Okla.), in his final act of contrarianism, refused to allow the TRIA reauthorization go forward in an expedited manor. Senate Democratic leadership would not take the additional week it would require to run out the clock on Senator Coburn (which would have kept the Senate in almost to Christmas) and therefore TRIA expired on Dec. 31, 2014. The reaction from a broad coalition of industries, trade associations and private companies was shock, disappointment and anger and it was not long before House Republicans issued not one but two statements committing them to the immediate reauthorization of TRIA when the 114th Congress opened for business in January.

It is up for debate as to whether Congress can move as quickly as it would have us believe to reauthorize TRIA. Moreover, there are elements in both the House and the Senate who did not like the reauthorization proposal that was on the table last year and would love to start over and get the product they much prefer. Undoubtedly, that product would significantly reduce the federal government’s role in insuring the availability of terrorism insurance coverage placing in question the ability of members of the apartment industry (and other industries) to get coverage at all, let alone at affordable rates. Regardless, NAA and our coalition partners are working hard to impress Federal Focus — continued on page 22

Federal Focus — continued from page 20 upon Congress the critical need for them to move fast on a reauthorization of TRIA. Signals have been mixed from insurers to this point as to how they will deal with the expiration of TRIA. Some are taking the hard line and notifying policyholders that without TRIA they (a) cannot continue to provide coverage at all or (b) cannot continue to provide it at present rates. Other providers are taking a “wait-and-see” approach and extending their current coverage for some limited period in anticipation that Congress will act quickly to reauthorize the program. What is your provider telling you? I’m interested in your experience so please drop me a line (my email address is at the end of this column) and give me your story. Setting aside the TRIA debacle for the moment, Congress will spend the next 30 days or so getting organized both within the respective political parties
and within individual committees, setting their agendas for the year. Soon after that, Committee Chairmen will release their draft schedules for hearings and perhaps even markup of relevant legislation. At the same time, individual Congressmen will be moving bills of their own through the process. Some will reintroduce bills from the 113th Congress that did not pass the finish line (most of the bills introduced) and others will craft new pieces of legislation reflecting their particular policy priorities. We will be sifting through all of these for the good, the bad and the…well you get the point. The apartment industry will have issues of its own to bring before Congress in March during the 2015 NAA Capitol Conference. Those issues are being determined now and will be announced right around the beginning of February. I hope everyone reading this plans to attend the conference and make their voice heard. We need your support! I encourage you to register
now — hotel rooms are subject to availability after Feb. 20. There are more than 70 new members of Congress, many of whom likely do not know much about the apartment industry. Whether it’s at the Capitol Conference or at home, we need you to meet these leaders and make them smart on our business. ear Maintenance Men: I have a 100 gallon 79,000 BTU Water heater which is about 5 years old. The heater has trouble maintaining a normal operating temperatures and the flame is yellow. I would hate to buy another heater, what do you think is wrong? Greg
Dear Greg:
I think you have a couple of things at work here. First let’s address the yellow flame as that might solve the entire issue. A yellow flame indicates that the burner is not getting enough air. That means there might be an obstruction from dust or cobwebs in the burner assemble. Follow the gas line into the burner assembly and note where the air comes into the burner. If there is no obstruction at the air duct, remove
the gas line from the burner and inspect the gas orifice. It is not unusual to find lint or cobwebs clogging the orifice or the gas line. (Gas line between the thermostat and the burner.) With a brush clean the burner ring. The cleaning should solve the yellow flame issue and greatly improve the efficiency of the burner. A second item to address while maintenance is being done to the water heater is to clean out the

water tank. Most 100 gallon water heaters come with a clean out port on the side of the tank. This port is for cleaning out accumulated calcium and debris from inside the tank. Depending on the hardness of the water being fed to the heater, it is not unusual to remove one or more buckets of debris. The thick deposits on the bottom of the tank greatly impact the ability of the burner to heat the water. Dear Maintenance Men: I am updating my resident move-in letter about the proper usage of the appliances in the unit and I have a question about coffee grounds. I have always heard it is bad to put coffee grounds down the garbage disposal unit, but don’t know why? The grounds are finely ground and should pass through the disposal just with no problem. Can you enlighten me? Lenny
Dear Dan: The metal casement window repair issues are not as difficult as it may appear and the good news is; all the repairs can be done from the inside of the unit. Most casement windows open and close by pivoting on hinges, controlled by a crank mechanism and locked closed by a hinged hook with a handle. Many casement window issues in old buildings have a number of solutions. Over time, the window tracks
Dear Lenny: The problem with coffee grounds is most people just dump the contents of the coffee machine into the drain and don’t use enough water to wash it away. What happens with the coffee grounds, especially with back-to-back drains, is that the coffee grounds tend to pile up in the pipe as it goes through the wall. Over time it will pack the pipe completely. The garbage disposal does not have trouble with the grounds themselves; it’s what happens after they leave the disposal. Again, if the coffee grounds are fed slowly into the disposal with plenty of water running, the grounds will disperse and not compact in the drain line. Unfortunately, we find most residents are not really patient enough and just dump the grounds and go. Dear Maintenance Men: I have an old building with metal casement windows that crank in and out. The windows don’t open or close properly, nor do they lock properly. I don’t want to replace the windows. How do I repair them? Dan

will be covered with too many coats of paint; grime, dirt and rust which will greatly impede the smooth operation of the window. The crank handle may strip out or the gears in the crank body may strip. The cost of replacing the window is much higher than repair. Property Management Reference Checks…Are They Really Necessary?© BY ERNEST F. ORIENTE, THE COACH
A
ccording to the Society of Human Resource Management (SHRM) over 50 percent of the information presented on a resume by a job candidate may be false or misleading. These are alarming statistics, and as the executive of your property management company, it continues to be increasingly important to understand the mindset of the job candidates that are applying for positions within your company. This article will help you and
your company strengthen your reference checking process and eliminate those who will not be a perfect fit, long before a position is ever offered. Some reference checking statistics: A recent SHRM survey at www.shrm. org was sent to 2,640 human resource members regarding reference checking. The survey concluded that job candidates frequently present misleading information about their length of stay with former organizations, their past/
current salary levels and their college credentials. More specifically, 53 percent of companies involved in this survey discovered falsified information about length of employment from job candidates and 51 percent discovered falsified information about past salaries. TIP FROM THE COACH: Based on the above survey information, conducting thorough reference checks must continue to be an important step in the selection and interview process of hiring SuperStars for your property management company. Developing a reference checking process: The first step is to determine how reference checks are going to be done in your property management company and to establish or strengthen your written policy for how reference checks fit into your interview process. With some of our property management clients, their human resource department handles this important step before a formal job offer is made. With other property management clients, all hiring executives handle their own reference checks, based on the specific level of position being offered or the compen-
sation range being presented. As for references, three or more business references should be supplied by a job candidate as early in the interview process as possible. We highly recommend asking for references early in the interview process because this will give your hiring executives additional time to contact each organization submitted by a job candidate. This also means that your hiring executives will not be rushed to do reference checks in the final hours before making a job offer. This makes for a more thorough and complete reference checking process. TIP FROM THE COACH: In addition to reference checks, many property management companies are now asking permission to do background checks, credit checks and criminal checks as part of their hiring process. Based on the SHRM survey statistics above and your own professional experience, have you recently reviewed your reference checking
process? This process will help to link talented SuperStars to compatible positions within your property management company and will reduce the chances of hiring low performers. Questions to ask when calling a reference: It has been our experience that all of our property management clients want to create their own custom reference checking form. Here are some sample questions to get you started with yours: How would you characterize his/her success with your company? How would you characterize his/her energy level? How was this person viewed by his/her peers? Describe the types of decisions this person made on a daily basis? How did this person manage their time? Tell me about a disagreement or a challenging situation and how this person handled it? Specifically, how was this person paid? Why did this person leave your company? Based on what you shared today, would you hire this person back?

Know your product and services… inside and out. Not being knowledgeable frustrates customers. An
uneducated employee is semi-useless to a customer. Job knowledge is key in any position. If for any reason your company doesn’t offer job knowledge training, make it your own priority to find out as much as you can. Job knowledge is a key ingredient to serving customers. 2. Believe in your product and services 150%. We know of a salesperson who has never had any formal sales training. However, based on the belief in the product, services and contagious enthusiasm, this person is a top seller. People love to buy
from people who get excited about their product. Customer service reps are salespeople!!! 3. Walk the walk, talk the talk. Practice what you preach. A Ford dealer would not drive a GM car. Employees need to support their company’s product or services before they can expect their customers to have confidence in them. 4. Keep your word. 7. Make no ulterior motive calls or notes. Every once in a while, drop a note or make a phone call to customers (and prospective customers) without trying to ‘sell’ them something. Telephone Doctor labels those “no ulterior motive” calls. They’re “just because” calls… and very welcomed. When was the last time you heard from a salesperson or a company just to say Hi? (See what I mean?)

he Apartment Association of Orange County held a holiday reception Tuesday, December 16th to honor a few individuals who have made and continue to make an impact on the rental-housing industry. The first award of the night, our Legislator of the Year award, was given to Janet Nguyen, who has and continues to assist in the advancement of our association’s legislative priorities. She works closely with county officials and the association staff to introduce or

support legislation or amendments that benefit the rental housing industry. She has been endorsed by the Orange County Register, Orange County Business Council, and the California Republican Party and has been awarded several local awards recognizing this person’s exceptional services to the community and ability to embrace diversity throughout Orange County. She previously served on the Garden Grove City Council as the first woman councilmember elected in

nearly 35 years. She was also the first woman Supervisor to represent the First District the first Asian-American and the first Vietnamese-American to serve on the Board of Supervisors, as well as the youngest Supervisor elected in Orange County history. In addition, she is the highest-ranking VietnameseAmerican elected official in California and the highest-ranking VietnameseAmerican woman elected official in the United States. She was also recently elected to State Senate.

Free Tax Prep Campaign As the year ends, tax season is just around the corner. Often, filing for taxes stirs up a lot of emotion for individuals and families who may feel overwhelmed by the process and how to prepare their returns accurately and on time. At Orange County United Way, we are proud to help lead the way for hard working families by connecting people to our Free Tax Prep program. Each year thousands of filers discover this great service and many more come back year after year. During the process, many discover that they may also be eligible for the Earned Income Tax Credit (EITC), an anti-poverty tax credit designed to bridge the wage gap for our community’s low-income workers. Each year, in conjunction with the IRS and nonprofit organizations across Orange County, United Way educates residents about this valuable credit. You may be surprised to learn that one in four Orange County residents live in poverty. While that number is alarming, the more surprising and little known fact is that the majority of these households have at least one member working full-time.* The EITC is designed specifically for the working poor and provides up to a $6,143 credit for eligible families. Best of all, these dollars go right back into the local economy, as families use the funds to pay for critical expenses including food, shelter, health care and clothing. Surprisingly, one in five eligible families do not claim this tax credit, leaving millions of unclaimed dollars in Orange County alone. A major barrier keeping families from accessing this credit is that either they do not file their taxes or private tax preparers miss the credit or charge extra for the family to claim it. Do you know a family that is struggling to make ends meet? Perhaps they are often short on rent or cannot pay at all. The EITC could go a long way in helping ease this financial burden and by helping your tenants access this credit, everyone can benefit from this tax season. Please share with your residents about how the Orange County United Way, the IRS and community based organizations all over the county are teaming up to provide FREE tax assistance to ensure residents are taking advantage of the EITC. Even if your tenants do not qualify for the EITC, they can still have their taxes prepared for free at one of the community sites if they make under $60,000. Tenants can call 1.888.434.8248 to find a site nearest to them, or go online and file for free at MyFreeTaxes.com.
