et out to discover the North of Thailand, I had an opportunity to fly to Chiang Mai a few weeks ago. Besides receiving a Human Rights award from her Royal Highness Princess Soamsawali also “Mom Luang Soamsawali Kitiyakara”, I discovered the beauty of the North, the mountains, valleys and farm projects. The Lanna tribe spreads across most of the North from Chiang Mai to Chiang Rai. A rich country side, with even richer cultures and the friendly character of the northern Thai. As APPROACH develops, gets better and more interesting, we attract professionals to enhance and improve on special themes such as Health & Wellness, Financial news etc. Larry Edelson, an international authority on financial issues, money & precious metals markets has volunteered to contribute regularly. Tried to get some true political inside information but I might as well print stories of the bothers Grimm. Got some not so nice comments from readers on the road conditions and traffic infra-structure in our town. The municipality, they say, is working on improving the situation, but it requires cash. Government cash is allocated to the provinces and mayor towns and villages once a year and they just have to live with the budgets. Priorities are given to certain project whereas other projects suffer. However one gets the impression that roads are paved without a proper concept. A paved road may end before it is joined with another section leaving gaps of 10 meters with pot holes ( Soi 112), which at night you don’t see if you don’t know it!

The Women´s Club of Hua Hin and Charity organisations such as Jungle Aid are very active these days and Charity Dinners & Galas follow each other up almost on a weekly base. At Multi Culti events such as the one organized by our Lizzy at the Hilton, charity is also a front runner. I am impressed with the dedication of many local residents, both Thai and Foreign. As things get tighter in the US, economically, they boast growth and increased national income whilst experts say it is all but over. Europe seems to have a better grip on the ailing economies but are criticized by the US for their selfish behaviour. Germany who seems to the best of all, is criticised for their non- supportive role in global recovery. Stop those useless money gulping wars. Funny enough they put people in place which tan they remove later through expensive military actions. Moreover, these atrocities in return again create war computer games at which our kids are deliberately taught to shoot, may it be only on an LCD screen, and kill others and facebook refuses to remove paedophilic material from their programme. I closed my facebook, forever. Our dear friend Ritchie”Elvis” Newton´s son was struck unexpectedly by a massive brain stroke and has been in coma for over a week now. We hope and pray that he will recover. We are with you Ritchie ! Yours Truly, GMoss

The entire team of APPROACH wishes our readers a Merry Xmas and a Happy New Year and all the best wishes for 2014!

86th Birthday Anniversary of His Majesty King Bhumipol Adulyadej

H

King Bhumibol Adulyadej has been a successful and increasingly beloved king of Thailand over the many decades of his reign. His life seems similar to other monarchs, such as Japan’s Emperor Akihito; both are semi-divine, have a life-long interest in science, enjoy art and music, etc. However, unlike the current Emperor of Japan, King Bhumibol plays a significant role in the politics of his Kingdom. The ninth Chakri king of Thailand has guided his country through turbulent waters and herewith, he has already earned the title “The Great King.”

is Majesty, King Bhumipol Adulyadej has reigned Thailand for 67 years. He was crowned Monarch in 1946. His Charismatic, Kind and Righteous

character in combination with a resourceful sharp mind has served Thailand in innumerable ways. His innovative agricultural and water resources programmes earned him a Human Development Lifetime Achievement Award from the United Nations. King Bhumibol Adulyadej, is the longest-reigning monarch in the world today, as well as Thailand’s longest-reigning monarch ever. The beloved king common name is pronounced : “POO-mee-pohn uh-DOON-ja-deht”; His throne name is king Rama IX.

The entire APPROACH Team wishes His Majesty, our King Bhumipol Adulyadej a very happy birthday with many more to come in good health and wonderful stay at his Hua Hin Palace.

Frank Zappa Memorial MUSIC IS THE BEST - ZAPPA

F

rank Vincent Zappa, born in Baltimore, Maryland, on December 21, 1940, the first of four children to Rose Marie (Colimore) and Francis Vincent Zappa, a Sicilian immigrant. The family moved frequently due to Francis Vincent Zappa’s expertise as a chemist and mathematician, contracted with various aspects of the defence industry.

But the band was starving, until impresario Herb Cohen (whose career credits include Pete Seeger, Alice Cooper, Lenny Bruce and Linda Ronstadt) took them on and began booking them at hotspots such as Whiskey A-Go-Go. Leonard Bernstein once remarked that he considered Frank Zappa as one of the main composers of the 20th century and said that only Duke Ellington surpassed him. It was not possible to classify Frank Zappa´s compositions as the variations were multiple. With unforgettable compositions such as The Grand Wazoo, Hot Rats, King Kong, Zappa would qualify in Rhythm & Blues , Jazz, Pop, Soul, Rock and Country. Zappa was engaged politically which did not add to his popularity with the US government. US authorities were criticised for their censoring of the Prince song Darling Nikki. His speech in the US Congress against the Parents Music Resource Center will go down in history. Zappa said: “I am a composer, not a Rock musician, but I had no choice. I had to play rock music to finance my Classical music work. Classic Music has always been my priority”. With

Young Zappa’s exposure to chemicals, such as mustard gas, may have had a profound effect on his health, which was always challenging. He showed early interest in innovation via gadgets but this soon turned to music. Avant-guard composers such as Igor Stravinsky and Edgard Varèse attracted him alongside interest in doo-wop/R&B and modern jazz. The family eventually settled outside of Los Angeles in Zappa’s late teens, and he soon took up drum and guitar. His proficiency grew so quickly that by his last year in high school, he was writing, composing and conducting avant-garde arrangements for the school orchestra Frank Zappa launched his career as professional musician shortly after high school but income was sporadic; recordings brought in more money than local gigs— Going back to the band route, Zappa joined The Soul Giants, soon converting them from a bar cover band to performing his original material—they morphed into The Mothers on Mother’s Day, 1965.

famous performers such as John Lennon, Paul McCarthy, Sting , Johnny Cash, Led Zeppelin sharing his work, Eric Clapton mentioned that it was not possible to play some of the passages Zappa played. “His accords were so fast changing that I became cramps in my fingers”. Frank Zappa is recognized by the music world as one of the best and virtuoso guitar players ever. Vaclav Havel, president of Czechoslovakia in 1990 and personal friend of Frank, selected him as official cultural representative of culture exchange between Czechoslovakia and the US. James Baker , the US secretary of state during that period wanted Zappa to back off when in addition to all, he presented himself as US presidential candidate. Zappa pulled out as he became mortally ill. He was able to present his classical composition, The Yellow Shark at the Frankfurt Opera. Frank Zappa passed away on the 4th of December 1993. He is registered at the Rock & Roll Hall of Fame and received a life time Grammy Achievement award in 1997.

W

e set off to discover a different world with a 750 HP – 30 Passenger high-speed cruiser. Hua Hin Sea Discovery offers you luxury trips from Hua Hin

starting at the beach front of Anantasila Hotel along the gulf islands, up the Pranburi River and Sam Roi Yod National Park to a lovely beach where lunch is taken and guests can climb up to the caves or go for a cooling-off swim in the clear waters. The boat is well-equipped with drinks and snacks on-board and crewed by a very professional team accompanied by the Belgian owner, Commodore Harry. As a matter of fact , the captain is an experienced, senior owner of fisher boats, familiar with the entire coast and Gulf of Siam. We departed from the beach front at the Anantasila Hotel/Khao Takiab, visited local islands, snorkeled, relaxed on the beach, enjoyed delicious food and fresh fruit and the compulsory glass of wine. After taking a trip up the Pranburi river looking for small crocodiles , we continued down the coast , anchored and some of us went into the Sam Roi Yod park to climb up to the caves. Later that afternoon we glid back to Hua Hin arriving late afternoon, relaxed and cruise happy. Exclusive tours are organized upon request and the boat can be rented for a private party the whole day as well. For more excact info, contact : Lek 084-677-5208 Thai Mai 092-629-2528 Thai / Engl . HERITAGE

New City

Chiang Mai Capital of The Lanna Kingdom

Est. 1296

C

hiang Mai is the largest and most culturally significant city in northern Thailand.

It is the capital of Chiang Mai Province, a former capital of the Kingdom of Lanna (1296–1768) and was the tributary Kingdom of Chiang Mai from 1774 until 1939. It is located 700 km (435 mi) north of Bangkok, among the highest mountains in the country. The city is along the Ping River, a major tributary of the Chao Phraya River.

Doi Inthanon National Park, which includes Doi Inthanon, the highest mountain in Thailand - Doi Pui Suthep and Obkhan. Doi Pui Suthep National Park is just outside town. From all over Chiang Mai you can see the Wat Doi Suthep Buddhist temple looking down on the town from Doi Suthep mountain Elephant Nature Park: Approximately 60 km (37 mi) north of the city or about one hour drive, the Elephant Nature Park is home to approximately 30 rescued elephants.

Chiang Mai means “New City” and was so-named because it was the new capital, founded in 1296, succeeding Chiang Rai (founded 1262) in the capital of the Lanna kingdom.

Hill-tribe tourism and trekking: A large number of tour companies offer organized treks among the local hills and forests on foot and on elephant back. Most also involve visits to the various local hill tribes. These include representatives from the Akha, Hmong, Karen, and Lisu tribes.

In recent years, Chiang Mai has become an increasingly modern city and has been attracting over 5 million visitors each year, of which between 1.4 million and 2 million are foreign tourists.

There is a lot to see in Chiang Mai with over 300 temples almost in walking distance from each other. History is everywhere in Chiang Mai. Although the city counts over a million inhabitants, there are no “sky scrapers “. I believe the tallest building, being one of the hotels, count 15 floors. I stayed at the Emperial Mae Ping , close to the Ping river where you can take a boat tour along the Chiang Mai “Coast”.

The old city is surrounded by a moat (canal) and a defensive wall, since nearby Burma was a constant threat as well as the armies of the Mongol Empire which only decades earlier had conquered most of Yunnan, China, and in 1292 overran the bordering Thai Lü kingdom of Chiang Hung. With the decline of the Lanna Kingdom, the city lost importance and was occupied by the Burmese in 1556. Chiang Mai formally became part of Siam in 1775 by an agreement with Chao Kavila, after the Thai King Taksin helped drive out the Burmese.

Royal Poinciana [Delonix regia]

by Dr. George Grossniklaus

Common names: Flamboyant tree, Flame tree, Peacock flower Family: Fabaceae/Leguminosae (bean Family) Description Royal poinciana (so named because it used to be in the genus, Poinciana) is a flamboyant tree in flower - some say the world’s most colorful tree. For several weeks in spring and summer it is covered with exuberant clusters of flame-red flowers, 4-5 in (1.2-12.7 cm) across. Even up close the individual flowers are striking: they have four spoon shaped spreading scarlet or orange-red petals about 3 in (7.6 cm) long, and one upright slightly larger petal (the standard) which is marked with yellow and white. Delonix regia gets 30-40 ft (9.1-12.2 m) tall, but its elegant wide-spreading umbrella-like canopy can be wider than its height. Flamboyant tree is deciduous in climates that have a marked dry season, but in areas where the winter is not that much dryer than the summer, it is a semi-evergreen tree. Even the leaves are elegant: they are lacy and fernlike, twice-pinnate, and 12-20 in (30.5-50.8 cm) long with 20-40 pairs of primary leaflets (pinnae), each divided into 10-20 pairs of secondary leaflets (pinules). The dark brown pods are flat and woody, up to 24 in (61 cm) long and 2 in (5.1 cm) wide. A naturally occurring variety (var. flavida) has golden-yellow flowers. Location Royal poinciana is native to Madagascar. It is widely cultivated and may be seen adorning avenues, parks and estates in tropical cities throughout the world. A casual visitor might think the Caribbean Islanders invented this tree they call simply “flamboyant.” Poinciana frequently escapes cultivation and establishes in frost-free climates. Culture Royal poinciana is very fast growing, about 5 ft (1.5 m) per year until maturity, and tolerant of a wide range of well drained soils from acidic to alkaline and from loamy to gravelly. It’s best to provide protection from strong winds. Light: Full sun

APPR OACH M AGAZINE

Moisture Royal poinciana is drought tolerant, but does best with regular water in the growing season and very little water in its dormant season. Propagation Propagate Delonix regia from semi-ripe tip cuttings taken in summer. Best results come with bottom heat. Seedlings vary in flower characteristics and may take 10 or more years to flower. Usage Royal poinciana is a spectacular shade tree in tropical climates. As a free standing specimen tree, it has no peers. The tree tolerates salty conditions and can be grown near the coast, but not in openly exposed beach conditions. Royal poinciana tolerates hard pruning and can be kept at a small size, and even grown in the greenhouse. The flamboyant tree has shallow, wide-spreading roots that will not allow underplanting and the roots can be a threat to building foundations and sidewalks. The tree sheds large woody pods and brittle branches that get broken off in the wind. Seedlings will come up all around the tree. Features Royal poinciana puts on its riotous show over a long season in spring and summer. Even if it never bloomed, it would still be one of the most beautiful trees in the world with its graceful live oak-like form, sculptured Ficus-like surface roots, and lacy fernlike foliage. Virtually everyone falls in love with this tree at first sight. In the Caribbean Islands the pods are used for fuel and called “woman’s tongue” because of the rattling noise they make when the wind blows them (a couple other species share this nickname for the same reason). The tree was named for an 18th century governor of the French West Indies, M. de Poinci.

ENVIRONMENT

Leaders of Fashion all over the world are working towards toxin free production of their fashion wear. The Detox campaign is powered by more than half a million people, demanding toxic-free fashion and clean water in close cooperation with fashion giants.

Behind the scenes, major international brands are conducting business with suppliers, helping to sponsor toxic water pollution and murky business practices.

Together they challenging some of the world’s most popular clothing brands to work with their suppliers and eliminate all releases of hazardous chemicals into our water

One of these brands is Gap - which has been linked to toxic water scandals before, and whose clothing items tested positive for hazardous chemicals in a previous investigation.

Eighteen global fashion leaders have committed to Detox in response to the growing international campaign (Nike, Adidas, Puma, H&M, M&S, C&A, Li-Ning, Zara, Mango, Esprit, Levi’s, Uniqlo, Benetton,Victoria’s Secret, G-Star Raw,Valentino, Coop, Canepa). However, other clothing companies, like GAP, Calvin Klein and Abercrombie & Fitch still need to respond to the urgency of the situation:

Detox their Brands and help Detox our Future. Water has a special place in Thailand’s culture. Sadly, industrial facilities are treating public waterways like private sewers in many areas of Thailand, pumping out a cocktail of hazardous substances into the local waterways. One of the major sources of pollution is the fashion industry – with 68% of industrial facilities on the water ways, producing textiles. The printing and dyeing processes are particularly chemical intensive, and have contributed to our waterways developing a reputation as one of the dirtiest rivers on earth. Poisoning Paradise - Greenpeace collected samples of wastewater discharged from one of the many facilities located on the waterways and found the presence of a number of hazardous chemicals, including nonylphenol, antimony and tributylphosphate. Worse still, wastewater discharged from one of the two smaller outfalls was highly alkaline (pH 14), which is highly caustic, will burn human skin coming into direct contact with the stream, and will have a severe impact (most likely fatal) on aquatic life in the immediate vicinity of the discharge area. The results suggests that this wastewater had not received even the most basic of treatment prior to discharge. APPR OACH M AGAZINE

How many more scandals need to break before Gap work with their suppliers around the world to Detox their production processes and products, and help Detox our water?

Take Action - Share this story with the world Every time you like, share, and promote this story it increases the pressure on Gap to change its ways: to stop polluting rivers in the countries where their products are made, and to stop shipping hazardous chemicals all over the world in their clothes. Major competitors including H&M, Zara, Levi’s and UNIQLO have all committed to Detox. What is Gap waiting for? Join a global movement - Around the world, over half a million fashionistas, activists, designers and bloggers have joined together, united by a belief that beautiful fashion needn›t cost the earth. Join the movement and send a clear message to major brands and suppliers linked to this environmental destruction that we want clothes with a story we can be proud of. Help us continue this important work - Your support has already resulted in 17 major fashion brands committing to remove all hazardous chemicals from their supply chains and products. You can also help protect our precious water supplies by making a contribution today so that we can continue this important work in those areas where it is needed most. Next Time You Check The Tags On A New Shirt, You May Also Want To Check if your favourite fashion designer has joined The Detox manifestation.

FINANCIAL NEWS

GLOBAL REVIEW 2013 HEADING UP OR JUST HOVERING?

T

he current financial crisis is the worst the world has seen since the Great Depression of the 1930s. For younger generations, accustomed to mild recessions of the new phase of recessions of the new phase of globalization, the misery of the Great Depression is hitherto nothing more than a distant legend. However, the collapse of two Bear Stearns Hedge funds in summer of 2007 exposed what came to be known as the subprime mortgage crisis, reintroducing the world to an era of bank failures, a credit crunch, private defaults and massive layoffs. In the new, globalized world of closely interdependent economies, the crisis affected almost every part of the world, receiving extensive coverage in the international media. “In an Interconnected World, American Homeowner Woes Can Be Felt from Beijing to Rio de Janeiro,” observed the International Herald Tribune at the onset of the crisis. “Chinese Steelmakers Shiver, Indian Miners Catch Flu,” noted the Hindustan Times. “US and China Must Tame Imbalances Together,” suggested Yale-Global, as the frenzied search for a solution continues around the globe. In this special report, Yale-Global offers essential information on why the crisis started, how it affected the industries and consumers around the world, and what solutions have been proposed by experts and regulators across countries. Causes While few predicted the financial catastrophe, almost everyone has an explanation as to why it happened. To economists, it all seems painfully simple. Too much foreign money was flowing into the US from the Asian countries especially China. The availability of easy credit meant that too many people borrowed to buy properties that they could not afford. The bankers bundled up these loans and sold them to investors

APPR OACH M AGAZINE

that could not understand the complexity of these bundles and the risks inherent in them. Once US borrowers started defaulting on their mortgages, they lost their houses and investors all around the world, including banks and hedge funds, lost their investments. For the critics of Bush administration, the government failed to regulate the activities of the banking behemoths. For the Fed critics, the crisis resulted from Alan Greenspan’s policy of keeping the interest rates low for an extended period of time. Given the ongoing nature of the crisis, many complicated explanations will surface in the years to come. Yet the root of the economic depression might very well lie in one fundamental human instinct: greed. Effects Since the summer of 2008 the world has experienced the greatest destruction of wealth – paper losses measured in the trillions of dollars – in its history. No industry in the world has been left untouched. The financial powerhouses of Bear Stearns and Lehman Brothers have gone bankrupt and mortgage giants Fannie Mae and Freddie Mac had to be bailed out. Attempts by the US government to save industries led to an increased budget deficit, making some experts predict that the global power epicenter might shift away from the US before the crisis ends. On the other hand, it has become clear that Asian countries need to restructure their domestic economies to encourage consumption. They cannot continue to rely on credit-fueled American consumption to promote growth. Consumer confidence remains low with fears of a double-dip or an anemic recovery being voiced daily. Some poor countries, insulated from foreign finance, suffered from reductions in tourism, remittances and foreign aid. What began as a local problem of excess credit in the United States is likely has affected every member of the global community. All crises in the twentieth century have had world-wide consequences but the crisis of 2008 will go down in history as the first full-blown global crisis. 30

NOVEMB ER 2013

FINANCIAL NEWS

Solutions Over the past decade, Chinese trade revenues, savings and purchases of US debt increased. Low interest rates encouraged US consumers to spend and housing prices soared. But such imbalances could not be sustained and financial instruments containing mortgages for homes that have lost their value, have proven toxic for the world. Economists and central bankers are still struggling to find a way out of the subprime mortgage crisis. If Japan’s lost decade offers lessons, then deflation must be averted at all costs if there is to be hope for a recovery.. But for the long-run, one magical phrase emerges from experts and that›s “stricter regulations for the banking industry.” Once governments succeed in restoring consumer and investor confidence, they should focus on designing regulations that encourage responsibility and a long-term outlook. Furthermore, policymakers have to recognize the need for global oversight of the banking industry, either by strengthening existing institutions or by creating new international authorities. The timing of the rescue is uncertain, and the certainty of its efficacy remains in question. To put the matter in historical perspective, there is still no consensus on whether government spending policies of Franklin D. Roosevelt or increased demand for goods created by Second World War pulled the United States out of the Great Depression. One certainty for this crisis: there are no localized solutions for a problem that extends throughout the world.

COOL STUFF

Great Christmas Gifts Singing Machine Home You’ve always wanted to buy a karaoke machine, but everything you’ve seen just looks so tacky. The Singing Machine Home consists of an orb-shaped Bluetooth speaker and a hybrid microphoneremote shaped like a computer mouse. The speaker, which features 2.1 omnidirectional sound, two tweeters and a subwoofer, can be used as a regular wireless speaker, playing back tunes streamed from your phone, tablet or PC. Plug it to your TV’s HDMI, though, and it turns into a full-featured karaoke machine, giving you instant access to over 8,000 karaoke music videos. Use the mic-remote hybrid to choose songs (you can line up as many tracks as you want, as with regular karaoke machines), then sing right into the same handheld contraption as soon as the video loads.

Eco-Ed LED Christmas Lights

iKettle

This holiday season is the perfect time to experiment with LED lights, if you haven’t already. One of the many great things about LED lights is they don’t get hot – so no more worrying about your tree bursting into flames. Eco-Ed also gave us the scoop on exterior lights that are solar powered LED lights. This means that they won’t add anything to your electric bill and they will help you keep your carbon foot print down while still being festive for the holiday. The lights will run you between THB 500 to THB 1000 per string and you can pick them up at any hardware store. If you don’t know what to do with your old lights try to recycle them with your other electronics before throwing them out.

More than acting as a remote control, though, the iKettle adds some really useful intelligent features that should make being lazy just a little easier. For instance, there’s a Wake Up mode that automatically starts a prompt whether you want to start water boiling the first time you turn on your phone in the morning; there’s also a Welcome Home mode which asks the same thing as soon as your phone joins the home’s Wi-Fi network. Once water boils, it will send another prompt to inform you, as well as give you an option to keep the water warm for a while. It comes with four tailored temperature settings (65°C, 80°, 95° and 100°), allowing you to get the exact level of heat you like.

Dip Clips These are, basically, mini-bowls with a clip on the side that lets you attach them to the edges of your plate. You can attach one, two or as many as will fit, allowing you to arm your plate with half a dozen sauces, dips and condiments within easy reach, while remaining manageable to carry around. No more balancing acts with three extra saucers on top of your plate and no more vomit-inducing mess of a dinner plate with three sauces all mixed in together -- it’s a veritable life saver.

Beer Nerd Board Game The Beer Nerd consists of a 10.5 x 10.5 inch playing board, with game pieces for up to four players and a thick pile of trivia cards for putting your ever-growing treasure trove of beer knowledge to the test. Basically, the Beer Nerd is a board game you can use with the rest of your beer-swilling friends, so you can get drunk on bottle after bottle of suds opened with a Cap Zappa, all while learning more about the history of the same wonderful beverage that you’ve each always felt has truly made your lives complete. For the wine aficionados there is also a Winerd board game available.

THAI LEGAL TIPS

Thai Inheritance Laws – Part II APPLYING FOREIGN WILLS & ASSETS INHERITANCE.

By GMoss

Inheritance for foreigners with assets in Thailand:

Inheritance of leasehold properties:

Foreign wills or the execution of a foreign will or division of the foreigner’s assets in Thailand according to the laws of the foreigner’s home-country is possible. In this case there are 2 options;

Succession of lease rights in Thailand is a tricky subject as lease (hire of property) under Thai law is a personal right and the general principle of Thai law is that the lease is terminated upon death of the lessee. According to Supreme Court the lessee is the essence of the lease agreement, therefore, should the lessee die, the lease contract will be terminated and the lease rights will not transfer to the heirs of the lessee. In a correctly drafted and structured lease or hire of property contract this can be prevented and remaining term can be inherited by the heirs of the lessee. Succession of the lessee’s rights must be agreed upon and anticipated in the lease structure. The lease structure needs to include the necessary clauses and protection. The remaining term and lease term will in principle not automatically transfer to the heirs and the heirs must be registered as the new lessee.

1.

2.

The death certificate and official foreign legal document or court order by which an executor (administrator) is appointed is certified and translated and used to wind up the Thai part of the foreigner’s estate. the foreigner’s will is submitted to a Thai Court and an executor or administrator is appointed. This is generally a more costly and time consuming legal procedure.

Also the execution of a Thai will made by a foreigner in Thailand is subject to a legal procedure and appointment of a executor, however, a Thai last will may be easier to enforce in Thailand and will save on lawyer fees. A Thai will can have a limited jurisdiction clause (i.e. can apply only on assets located in the Kingdom of Thailand).

It is possible to including co-lessees in the lease agreement, who can each independently act as the lessee or hirer in the event of death of one of the lessees. Ownership over a house, separate from the land, could be transferred to the heirs separately at the local land office. In case of separate ownership over the house and a land lease a Thailand right of superficies offers additional protection. A house in Thailand separate from the land can be inherited by foreigners can be inherited without restrictions.

Inheritance of a Condominium in Thailand: Any foreigner who inherits a condominium in Thailand either as statutory heir or inheritor under will shall automatically have ownership over such unit. However, it is required by law (section 19 of the Condominium Act) that the unit shall be disposed of within 1 year of possession if the foreigner does not qualify for ownership under section 19 of the Condominium Act. The fact that the foreigner inherited the condominium does not qualify him for registration of ownership. If the foreigner unqualified for ownership fails to dispose of the unit within one year, the Director-General of Land Department shall have power to sell it on the foreigner’s behalf. We can help if you have inherited a condominium in Thailand or if a will (foreign or Thai) has to be executed in Thailand.

Inheritance in case of controlling shares in a company: More complicated is the situation if the foreigner is a shareholder and managing director in a company that owns a property or runs a business. Controlling shares and voting rights do not automatically pass on to the heirs of the managing director. Section 1132 CCC says; ‹In the event of death or bankruptcy of any shareholder another person becomes entitled to a share, the company shall, on surrender of the share certificate when possible, and on proper evidence produced, register such other person as a shareholder›. Who is allowed to sign on behalf of the company in this case? The foreigner’s controlling shares in the company must transferred at the Ministry of Commerce and at that stage the foreigner’s heirs have lost any control in the company and it’s assets. It is possible to anticipate on this situation.

Inheritance of land: A foreigner cannot acquire land in Thailand as an inheritor under will. Under the Land Code Act land cannot be willed to a foreigner (such clause in a will would be void). A foreigner may inherit land as a statutory heir under the section 93 of the Land Code Act (e.g. a foreigner may inherit land from his or her Thai spouse). In this case the land may be acquired upon permission of the Minister of Interior. There are currently no laws, rules or regulations for the Minister to allow ownership and in practice the foreigner who inherits land as a statutory heir must dispose of the land within a period of not less than 6 months and up to 1 year. If the foreigner fails to dispose of the land the Director-General of the Land Department is authorized to dispose of the land and retain a fee of 5% of the sale price before any deductions or taxes.

Bangkok EVENTS

Christmas & New Year Countdown in Bangkok Christmas Dinners

M

ost of the 5 Star Hotels will have Gala Christmas Dinners ranging from THB 2500 up. It is recommendable to book well in advance.

Hotels with river venues are popular.

New Year Countdown The biggest of countdown event in Bangkok happens in front of CentralWorld Square. With several hundred thousand revellers expected to attend, this is where it’ll be happening! Leave the old year behind and welcome the new one with friends and family, spectacular light and sound shows and live on-stage performances by popular local artists. Enjoy the beer garden, lucky draws and countdown with other countries around the world on large-screen projections. Do plan to arrive at the scene at least two hours before midnight, as traffic could be disastrous around the Ratchaprasong intersection, which will be closed to all car traffic after 18:00.

Other Countdown Venues If you fancy something more private and intimate, it’s a good idea to splurge on a New Year’s Eve set dinner at one of the riverside hotel restaurants or classy rooftop venues. You are not just paying for the gourmet dining experience but the atmosphere that is unrivalled anywhere else in Bangkok. And when the fireworks go off at midnight, you’ll also get the best view. Not in for the splurge? Then, head over to one of the happening clubs and bars at RCA, Silom or Khao San Road. These venues cater to the younger and more dynamic crowd, so expect some wild partying and drinking well into the night. For a classier way to ring in the New Year, go straight to Thonglor, where a lineup of outdoor hip and chic bars await you. Call well ahead to make your reservation, or you might not be able to secure a table.

Forest Born

F

Forest Born, by SHANNON HALE, Bloomsbury Publishing PLC., 2010, paperback, ISBN 978159990692 :13, RRP: 390 ,9.09$ pages. orest Born is the fourth novel in the fantasy series, The Books of Bayern. Forest Born connects to the previous novels but is also a stand-alone book.

Deep in the forest Rin is shadowed amidst her large bustling family. Rin has always found an escape and solace with the trees until one day it seems they no longer offer a place for her. Scared and uncertain, Rin travels to the city and joins the ‘fire sisters’ as they uncovering an unsettling threat. Forest Born is gripping from the very first page. Shannon Hale begins the story in her lyrical, easy pace and winds up the tension carefully, drawing in the reader. This story is magical, adventurous and mysterious as it follows Rin’s path in meeting herself. Hale covers self-esteem, friendships, jealousy, deceit, awareness and connection to nature, magic, thought, knowledge, and the place we call home. Mostly, she writes about all of these in relation to ‘Self ’ and how they can help or hinder one from understanding oneself better. Rin is a unique, sometimes awkward character so the way Hale brings the reader close to her reflects Hale’s great writing skills. Every sentence of Forest Born is rich and pleasurable to devour. This book will delight boys and girls from 12 and up as well as adults. Forest Born is a precious tale that won’t be forgotten and will stick with adolescents long after the final words.

The Adjustment Bureau (2011)

T

he Adjustment Bureau is based on a short story by Philip K. Dick. In the film, David (Matt Damon) is a young politician running for senate of New York. When David knows he is going to lose the election he unintentionally meets Elise (Emily Blunt) who makes him smile with her unique and striking character. By chance they meet again and a bond grows between them, but standing in their way is a team of men in hats, dedicated to keeping all on their designated paths. These men insist that David and Elise cannot and are not meant to be together and use their supernatural gifts to keep the determined David away from her. Through science fiction, the film explores freedom and illusions of it, as well as morality, decision making, true love, and all we consider valuable. It is very enjoyable, funny and romantic with a serious edge. This is a story that will have you thinking about far more than a happy ending. Directed and written by George Nolfi. Also stars Michael Kelly and Anthony Mackie. Reviews by Zara Adcock Copyright © 2013 Zara Adcock

GoodFood Foodover overChristmas Christmas Good HOW TO STAY HEALTHY OVER CHRISTMAS By Kerry Torrens

W

ondering how you›re going to survive the holiday party season?

Good Food nutritionist, Kerry Torrens shares her secrets for staying healthy over Christmas, avoiding overindulgence and beating the morning-after blues. ‫ދދ‬My diet is pretty good most of the time, as you‫ތ‬d expect‫ ތތ‬says Kerry, ‫ދދ‬but the party season is tricky. Here are my strategies for coping with the overindulgence and late nights that are an inevitable but enjoyable part of the festive season.‫ތތ‬

Buffets can be a disaster zone So I make sure I fill half my plate with salad and vegetables, and the rest with protein-based canapés like salmon and chicken. I take my time selecting and eating my food and I move away from the table as soon as my plate is full so I avoid non-stop grazing. Canapés / buffet food: t Smoky chicken skewers t Sesame beef wraps t Thai chicken bites

Everything starts with breakfast If I‫ތ‬m going out in the evening, I‫ތ‬ll start the day with a generous bowl of porridge, topped with a handful of cranberries and a sprinkle of cinnamon. Porridge stabilises blood sugar levels, which helps control appetite later in the day. I also add a good dollop of probiotic yogurt, which helps boost immunity as well as combat some of the less beneficial effects of the party season, like too much alcohol and not enough sleep.

Breakfast ideas: t Cinnamon porridge with banana & berries t Porridge plus t Perfect porridge

No more hangovers !

Don‫ތ‬t be tempted to skip meals so you can stockpile calories for drinking. Alcohol only supplies empty calories, so avoiding proper meals to compensate for a booze splurge means you‫ތ‬re losing out on valuable nutrients, just when your body needs them to help it detoxify. I stick to one type of drink and I make it a lighter-coloured one because they tend to be lower in the chemical by-products that can worsen a hangover. I aim to have no more than one alcoholic drink an hour, alternated with juice, water or soft drinks - perfect if you don‫ތ‬t like holding an empty glass.

What to eat the next morning

Stay hydrated – drink enough water On the day of a big night out, and the day after, I make a conscious effort to drink 6-8 glasses of water, or plenty of herbal teas or diluted juice. Even mild dehydration can lead to a headache and combined with the diuretic effects of alcohol makes maintaining your fluid intake so important. Regular teas and coffee count towards your fluid intake, but caffeinated versions shouldn‫ތ‬t make up your full quota. I sometimes struggle to drink enough when it‫ތ‬s cold, so I‫ތ‬ll take a full glass of water to bed with me at night and start the day with a second. I make sure I‫ތ‬ve drunk both before I have my breakfast.

Sensible snacking If I‫ތ‬m hungry when I arrive at a party, I struggle to resist the canapés, so I always have a pre-party snack. One of my favourites is a small pot of plain yogurt with a sliced banana. The yogurt‫ތ‬s protein slows stomach emptying, which helps delay the effects of that first glass of wine while the potassium-rich banana helps balance any increase in my salt intake - especially helpful if I‫ތ‬m going to be nibbling on olives, crisps or salted nuts. I know I‫ތ‬m better off eating before I go to a party because I‫ތ‬m more likely to stick to my resolve when the canapés come round a second or third time. Other snacks which do the trick include granary toast with nut butter, a bowl of muesli with milk, or a mug of chunky vegetable soup. APPR OACH M AGAZINE

My best ‫ދދ‬morning after‫ ތތ‬breakfast is a frittata or omelette packed with veg. I love mushrooms for their energising B vitamins, tomatoes for vitamin C and onions for their liver-friendly sulphur compounds. If I have spinach to hand I‫ތ‬ll add a generous handful because it›s a great source of folate which helps my body repair DNA. Eggs are an excellent choice for the morning after because they provide choline, a nutrient that supports the liver. Add a sprinkle of cayenne pepper or a chopped chilli to boost circulation and rev up your recovery. If you can‫ތ‬t face a cooked breakfast then have a smoothie made with fruits like bananas, oranges or kiwi - these are rich in potassium which helps replenish the electrolytes lost due to the diuretic effects of alcohol.

Morning-after breakfast: t Spanish spinach omelette t Artichoke & roasted red pepper soufflé omelette t One-pan English breakfast t Forest fruit & banana smoothie

Get back on track After a big night out I don‫ތ‬t skip meals, even if I have over-indulged. After all, it‫ތ‬s the balance of your diet that‫ތ‬s important. I apply the 80:20 principle - eating healthily 80% of the time, which allows me the space for delicious treats at weekends and on special occasions. Rice Pudding Rocky Road Challenge Rate: 3/5 Rocky Road is a delectable treat and quite simple to make.

Tip: Use organic ingredients, free-range eggs and sea salt where possible as it is tastier, better for our health and the earth. Each ingredient that I have labelled organic has previously been found in Hua Hin as organic. Biodynamic, unsprayed, chemical-free and wild-crafted, are also good choices. Ingredients: • 300g quality dark and/or milk chocolate • 50g marshmallows • 100g macadamia nuts (or nuts of your choice) • 50g Turkish delight* * Turkish delight is best if you can get your hands on it, but if not, select 50g of a red jelly lolly.

Method: Melt the chocolate with a double boiler on a gentle heat. Add chopped marshmallows, nuts and Turkish delight to the chocolate. Pour mixture into a mould. Place in refrigerator to set. Once set, cut into pieces to serve.

A Note on Moulds:

Challenge Rate: 3/5 Serves 8-10 Rice Pudding can take just over an hour as the rice needs to be cooked in milk and to absorb the creamy flavour. Rice Pudding can be eaten warm but is even more irresistible once refrigerated.

Ingredients: • 500ml coconut milk • 500ml organic milk • 200ml drinking water • 1 ½ tsp. vanilla essence • 2 tsp. ground cinnamon • 2 pinches of sea salt • 1 cup organic uncooked brown rice

Method: Rinse and drain the rice. In a medium-sized pot bring the full litre of milk, 200ml water, the sea salt, and rice to a boil over high heat. Reduce heat to medium-low to simmer until the rice is edible. When the rice is almost ready, in a small mixing bowl, whisk together the eggs and sugar. Add 2/3 of a cup of the warm rice mixture to the bowl and mix in to blend the eggs and sugar. Empty the contents of the bowl back into the pot and stir on low heat until combined and thickened. Be careful not to allow the mixture to boil or it will curdle. Stir in the vanilla essence. Remove from heat and stir in cinnamon. Serve warm or cold by itself or with a scoop of quality vanilla ice cream. Copyright © 2013 Zara Adcock

The mixture can be poured into any mould lined with baking paper that you like. Instead of a gingerbread house, another special idea for Christmas is to make a mould for Rocky Road in the form of a Christmas tree. For this mould, use a piece of card paper lined with baking paper to twist into a 3D cone and tape into place. Then pour most of the mixture into the lined cone and refrigerate to set. You will need to sit the cone in a jug to balance it. With the remaining mixture pour into a lined square or rectangular dish to set then, cut out ‘present’ shaped pieces in squares, rectangles or both and place around the ‘tree’ on a plate to display.

GOLF & SPORT

APPROACH watches closely as the Golf stars move around the globe. Taking a look at the developments around Tiger & co. is highly interesting. For a tennis player to have a bad day, he may lose from nr. 876. For a golf player to have a bad day, he will still move among the top 10. Tiger Woods not only has friends. Let´s take a look at the foe. While Tiger Woods has spent a career lacking a true rival, he›s used an assortment of adversaries to his advantage. Golf Digest Contributing Editor Tom Callahan touched on this in his book, In Search of Tiger: A Journey Through Golf with Tiger Woods, in a passage about Woods and his mother, Kultida: “If you cross them, you are dead. They are like Joe DiMaggio that way...Tida never forgives, Tiger seldom does; neither of them ever forgets. They revel in paybacks for the rest of their enemies› lives.” Any slight -- even those imagined or innocuous -- does not go unnoticed. Hence the Nixon-like enemies list Woods has developed through the years. Here is a partial list: Brandel Chamblee former tour player and Tiger analyst. Hank Haney former coach. Sergio Garcia launched a racially insensitive joke about Woods. Steve Williams former caddy. Bill Clinton was denied a game together by Woods. Stephen Ames critical co-player on the tour. Nick Faldo TV commentator and Critic. Greg Norman not a Woods fan.Last but not least Jamiee Grubs for revealing personal conversations to a US Magazine of her relationship with Woods.

Further News:

USGA expected to announce changes to rules violations reported on TV. The USGA and the R&A are expected to announce Tuesday new stipulations on how video is used in the reporting of potential rules violations. This announcement is part of their biennial review of the Decisions on the Rules of Golf and will take effect Jan. 1, 2014. Other changes to the decisions book are expected, but addressing how video evidence is used seems timely considering that Tiger Woods was embroiled in several rules controversies this past year that were caught on video and reported. The most famous came with his improper ball drop during the second round of the Masters in April (above) while his most recent was in September when he was given a twostroke penalty at the BMW Championship for accidentally moving his ball while trying to remove loose impediments.

Rafael Nadal maintains top spot on ATP men’s tennis rankings

F1 Rankings – Sebastian Vettel Is All That

Men Rankings

He’s the best, number one, pure genius at work. I know it’s boring to watch perfection at work but when it is made to look that easy, you know you’re watching genius. If it was down to the Red Bull car alone then technically you and I should be able to go race Formula 1 for Red Bull, and that is the point here, you still have to go qualify near the front, drive 300km and win Grand Prix.

Spanish tennis ace Rafael Nadal has maintained his position on top of the newest men›s tennis rankings issued by the ATP. The Spaniard ensured he would end the year as world number one with victory over Stanislas Wawrinka at the ATP World Tour Finals in London on November 6.

According to Sport24, Nadal went on to lose the final to Djokovic, but on 13,030 points could be overtaken by the Serb, who is on 1, 260 at the second. Spain´s David Ferrer third on 5,800 points. GB´s Andy Murray is fourth on 5,790 points Argentine Juan Martin del Potro fifth on 5,255 - Swiss Roger Federer sixth on 4, 205 Czech Tomas Berdych seventh on 4,180 points - Swiss Stanislas Wawrinka eighth on 3,730 points and French Richard Gasquet ninth on 3,300 points. The tenth position is occupied by Gasquet›s compatriot JoWilfried Tsonga with 3,065 points.

Four World Tiles by the age of 26 is special folks, and that is exactly what the little genius called Sebastian Vettel is doing, beating very special drivers like Alonso, Raikkonen and Hamilton who are all proven champions in their own right. Not to mention a hard Aussie called Mark Webber who wants to beat his team-mate, make no mistake about it. Even though fate puts all these hurdles in the way Vettel just keeps on clearing them one after the other.

In the evening the winding roads with a great variety of shops make a great stroll. The restaurants built on stilts into the sea offer superb seafood in the legendary and unsurpassed preparation of the Thai cuisine. Hua Hin, in 2013, once again, was chosen as one of the world’s best places to retire. Strong points for both Hua Hin and Cha Am equally were the low cost of living in general and the affordability of beach-front living in particular, as well as its overall expat-friendliness. RE/MAX was founded in Denver in 1973 by Dave and Gail Liniger. Already a successful real estate agent at that time, the 27 year old Dave was determined to make the US real estate market more professional and efficient. His “Real-Estate-Maximums” concept - short RE/MAX - is based on the assumptions that agents are not only in the business for themselves, but well trained, open to work with other agents whenever possible and most importantly one hundred percent client oriented.

Colossal Expansion of Real Estate in Hua Hin

T

A HOME AWAY FROM HOME IN PARADISE CITY he real estate and property markets in Hua Hin have undergone a colossal expansion over the past couple of years. You cannot fail to notice the rows of billboards on Petchkasem Road as you drive into Hua Hin advertising

Once you are ready and you have a sale price in mind you can begin the process. Renting Property in Hua Hin - Finding a house to rent in Hua Hin can be a long and arduous task, there are a number of pitfalls to be wary of and a few things that can make the process easier. As more and more properties are constructed the market floods with empty places available for rent, unfortunately though the prices in Hua Hin are still climbing. Following the guidelines below should make the process of finding a house to rent in Hua Hin a little easier. Please be aware though that many of theses considerations are general and your situation will probably differ slightly.

luxury condominiums and housing developments. Local magazines and other forms of media are simply flooded by real estate commercials and the number of new housing developments has quite literally increased tenfold per year over the past 2-3 years in and around Hua Hin. It would be fair to say that buying property can be a minefield for the inexperienced or new visitor to Hua Hin. With the government changing and enforcing legislation regarding foreign ownership rights frequently it has become an uphill struggle keeping up with it all. This section aims to clear up some of the discrepancies and provide a clear cut buying, selling and renting guide. We are not a real estate agent so all advice given here is fair and balanced. The first and foremost piece of advice would be to make sure Buying Property in Hua Hin - First and foremost it is not possible for foreigners to own land in Thailand, be very wary of anyone that tells you otherwise. Legislation regarding foreign ownership of property in Thailand is prone to frequent change, only recently a loophole in the law allowing shell companies to purchase land was closed, these companies are now under investigation along with their shareholders.

Caring for your property - A number of local and foreign managed companies have recently started up in Hua Hin offering property care services. As many people are here on a part time basis it is essential to have someone take care of your property in your absence. Services offered can include the following: Security service: routine security checks on doors, windows, locks and perimeter. Cleaning services: House and Yard cleaning. Gardening services: full landscaping or just trimming the hedge. Maid services: daily or weekly maids for errands, shopping, cooking, cleaning and maintenance. Pool services: swimming pool maintenance and chemical treatments. Construction services: overseeing property construction with photographic evidence. Prices range from 500 baht up to thousands depending on your level of service and frequency of visits.

Today buyers are being advised to opt for a 30 year lease by real estate agents in Hua Hin, this option has its own drawbacks as you still don’t technically own the land. Selling Property in Hua Hin - There are a number of considerations you will need to make if you wish to sell property in Hua Hin. The options are available to appoint a real estate agent or try and advertise and sell the property yourself, both have pros and cons and these will be discussed below. Firstly you need to ensure all of the paperwork for the property is in order and that you have the legal right to sell it. Make sure you have the title deeds and all relevant documents at hand (chanote and tabien bahn), also ensure that there are no outstanding debts on the property. APPR OACH M AGAZINE

FICTION

THE ROOFTOP ELEPHANT By Zara Adcock

“T

he Rooftop Elephant was slightly smaller than an average sized adult elephant. His skin was grey and he wore a wide red cloth over his back. He had strong and smooth ivory tusks, and striking midnight-blue eyes. The Rooftop Elephant was putting these eyes to good use on the night before Christmas Eve while standing on top of a skyscraper. He was not worried about the people on the street seeing him for most of the time they watched the footpath as they walked. But if they were to look up, then The Rooftop Elephant would simply leap onto the next building and vanish from their sight in the space of one and a half blinks. Nobody did look up that night and after watching the city for two hours he went for a good night’s sleep on the roof of an elephant enclosure. On Christmas Eve Day, The Rooftop Elephant ate very well, stayed hidden, and went over his master-plans. In the afternoon he had a long nap and awoke promptly at dusk ready for work.

FICTION Santa Claus, in all his cheerful enthusiasm, could not always reach everywhere across the globe in one magical night. Over the years, he had met a number of unusually gifted creatures and persons who were willing to share his task. As an elephant with uncanny balance and an odd liking for heights, The Rooftop Elephant was one of these special creatures. The Rooftop Elephant began his legendary journey, leaping from rooftop to rooftop with gentle thumps and thuds here and there. At each home he would choose a gap that led into the building. Sometimes it was a window and sometimes it was a pipe or a vent. Into these gaps he would point his trunk inside and then with a soft blow, The Rooftop Elephant would send beads of yellow light into the homes. These were the beads of kindness and luck that would swirl and drift and form into presents. The Rooftop Elephant was noble, majestic and only in the deepest, darkest corner of his mind, did just one task ahead of him make his knees knock together. He feared only one thing – he feared the circus. The Rooftop Elephant had to visit a circus to deliver some presents and he dreaded what would happen if he were caught.

The Rooftop Elephant saw the girl – And the girl saw him. Well, she saw the flash of grey and red as The Rooftop Elephant boarded the roof of the train. She also saw the large round column that she knew was an elephant’s leg. The girl got out of bed and rushed through the carriages of the train to check that her elephant friends (who were also in the circus) were safe and sound. Above her, she heard faint thuds and thumps. What was that? In the train, the girl found all three circus elephants, fast asleep. She listened to hear if the roof was still creaking but all was quiet now except for her breathing. With gentle tapping on the cabin’s floor, the girl went over to the nearest window. There was no doubt then that she saw an elephant of grey, red, ivory, and blue!? passing very close to the window. Then the train whipped around a bend as swiftly as a shooting star and the girl saw no more of the mysterious visitor. The girl rubbed her eyes and wandered back to bed, pondering over what she saw…or thought she saw…or dreamt she saw… The Rooftop Elephant watched the train go with triumph.

He truly could not and really would not join a circus. * Aboard the train of the travelling circus, a girl of 9 years was unable to sleep. She was an acrobat. Her father was the ringmaster and her mother the animal tamer. Together they lived on the rail-road with the other performers’ and animals’ carriage’s following behind them. The girl was used to being lulled to sleep by the wheels turning and the lions purring. But on Christmas Eve night, she did not dream about riding big cats. That night, she did not sleep because she was impatient for dawn to come. Towards midnight, the girl decided to herself that it could not hurt to pull back the curtains above her bed, and look out the window for the twenty-second time that night since she was still awake anyway.

He had been so scared of boarding that train that one of his legs had nearly slipped off the rooftop when he had boarded. And yet, he had survived. It wasn’t all so bad. The Rooftop Elephant was glad that he had seen the circus elephants were happy and well cared for. Though, he was sure delivering presents suited him better than performing. There was no reason to be fearful, and with that he leapt onwards to finish the job he started. * Aboard the train of the travelling circus the girl of 9 years was with her family on Christmas morning. Under their tree, she found a small square package with her name written in blue, swirly script. Inside the wrapping was a small green box. And inside the box she saw a brooch that made her gasp. The brooch was of a silver elephant with a little red cloth and striking sapphire jewels for its eyes. THE END Copyright © 2013 Zara Adcock
