On the care of persons in the critical and terminal phases of life Introduction The Vatican Congregation for the Doctrine of the Faith (CDF) issued a Letter Samaritanus Bonus (The Good Samaritan) on 14th July 2020, though it was made public on 22 nd September 2020. Following the example of the Good Samaritan, who is Jesus Christ himself, the CDF addresses the very sensitive issue of care of persons in the critical and terminal phases of life, with special reference to the moral issues involved in Euthanasia and assisted suicide. Basically, the present letter “seeks to enlighten pastors and the faithful regarding their questions and uncertainties about medical
care, and their spiritual and pastoral obligations to the sick in the critical and terminal stages of life.” The Letter intends to “reaffirm the message of the Gospel and its expression in the basic doctrinal statements of the Magisterium” and “provide precise and concrete pastoral guidelines to deal with these complex situations at the local level and to handle them in a way that fosters the patient’s personal encounter with the merciful love of God”. However, we must accept death as part of human condition. “One cannot think of physical life as something to preserve at all costs. The Letter states with absolute clarity: “The judgement that an illness is incurable cannot mean that care has come to an end”.
The Letter of CDF goes on to enumerate few cultural obstacles that obscure the sacred value of every human life in the modern society. The first obstacle lies in the notion of “dignified death” as measured by the standard of the ‘quality of life’ which a utilitarian perspective sees in terms of economic means, well-being, beauty and enjoyment of physical life etc. forgetting the other, more profound, interpersonal, spiritual and religious dimensions of existence.

The third factor is a growing individualism, where the other is viewed as a limitation or a threat to one’s freedom. “Individualism, in particular, is at the root of what is regarded as the most hidden malody of our time: solitude or privacy.” Pope Francis has often spoken of a ‘throw-away culture’ and Pope John Paul II spoke of a “culture of death”, where abortion and euthanasia are justified and legalized. “In this culture of waste and death, euthanasia and assisted suicide emerge as erroneous solutions to the challenge of the care of terminal patients”, says the present CDF Letter. The Teaching of the Magisterium
Samaritanus Bonus then goes on to reaffirm the Teaching of the Magisterium. “The Church is convinced of the necessity to reaffirm as definitive teaching that euthanasia is a crime against human
life because, in this act, one chooses directly to cause the death of another innocent human being (for it is) an action or an omission which of itself or by intention causes death, in order that all pain may in this way be eliminated.” Euthanasia is therefore, an intrinsically evil act in every situation or circumstance. Any formal or immediate material cooperation in such an act is also a grave sin against human life. When a request for euthanasia rises from anguish and despair, “although in these cases the guilt of the individual may be reduced, or completely absent, nevertheless the error of judgement into which the conscience falls, perhaps in good faith, does not change the nature of this act of killing, which will always be in itself something to be rejected.” Enactment of any laws which legalize euthanasia and assisted suicide is gravely unjust, and is a degradation of legal systems, affirms the CDF Letter.

While human life is to be respected and protected, we must accept death as part of the human condition. One cannot think of physical life as something to preserve at all costs, but do one’s best to safeguard and promote it until natural death. Hence, to precipitate death or delay it through “aggressive medical treatment” deprives death of its due dignity. With medical and technological advance today, death can be artificially delayed, often without real benefit to the patient. “When death is imminent, and without interruption of the normal care the patient requires in such cases, it is lawful according to science and conscience to renounce treatments that provide only a precarious or painful extension of life.” While it is morally permissible to renounce extraordinary or disproportionate means, it is not lawful to suspend ordinary treatments that are required to maintain essential physiological functions, as long as the body can benefit from them such as
hydration, nutrition, thermoregu lation, proportionate respiratory support etc. “Obligatory nutrition and hydration can at times be administered artificially, provided that it does not cause harm or intolerable suffering to the patient.” CDF underscores the need of palliative care for terminally ill patients. Palliative care is an authentic expression of the human and Christian activity of providing care, the tangible symbol of the compassionate “remaining” at the side of the suffering person. Experience also teaches us that the employment of palliative care reduces considerably the number of persons who request euthanasia. The Letter also underscores the role of the family as central to the care of the terminally ill patient. It is essential that the sick under care do not feel themselves to be a burden, but can sense the intimacy and support of their loved ones. Next to the family, hospice centers which welcome the terminally sick and ensure their care until the last moment of life provide an important and valuable service.

Children need care just like adults, perhaps even more. “Beginning at conception, children suffering from malformation or other pathologies are little patients whom medicine today can always assist and accompany in a manner respectful of life. Their life is sacred, unique, unrepeatable, and inviolable, exactly like that of every adult person”. “The empathetic accompaniment of a child, who is among the most frail, in the terminal stages of life, aims to give life to the years of a child and not years to the child’s life”. Today’s dominant culture, unfriendly to disability, often prompts the choice of abortion portraying it as a kind of “prevention.” Abortion consists in the deliberate killing of an innocent human life, and as such it is never lawful. To mitigate a patient’s pain, analgesic therapy employs drugs that can induce loss of consciousness (sedation). The Church “affirms the moral liceity of sedation as part of patient care in order to ensure that the end of life arrives with the greatest possible
peace and the best internal conditions.” However, the use of analgesics that “directly and intentionally causes death is a euthanistic practice and is unacceptable. Many terminally ill patients lie for long, sometimes even years, in a persistent vegetative state (PVS) or state of minimal consciousness. CDF Letter warns: “It is always completely false to assume that the vegetative state, and the state of minimal consciousness, in subjects who can breathe autonomously, are signs that the patient has ceased to be a human person with all of the dignity belonging to persons as such… One must never forget in such painful situations that the patient in these states has the right to nutrition and hydration, even administered by artificial methods… In some cases, such measures can become disproportionate, because their administration is ineffective, or involves procedures that create an excessive burden with negative results that exceed any benefits to the patient.” Only then they may be withdrawn.

Healthcare workers must exclude any formal or immediate material cooperation in euthanasia or assisted suicide or any immoral practice. “It is never morally lawful to collaborate with such immoral actions or to imply collusion in word, action or omission.” In such situations “we must obey God rather than men” (Acts 5:29). Death is a decisive moment in the human person’s encounter with God the Saviour. The Church is called to accompany spiritually the faithful in this situation. No believer should die in loneliness and neglect. The last Sacraments provide great comfort, consolation and spiritual strength to the patient. Pastoral accompaniment of those who expressly ask for euthanasia or assisted suicide today presents a singular moment for the pastor to reaffirm the teaching of the Church. For valid and worthy reception of Sacraments of Penance, Anointing and Viaticum the confessor must discern the penitent’s readiness to take concrete steps that indicate he
or she has modified the decision in this regard. Those who assist these persons spiritually must avoid any gesture, such as remaining until the euthanasia is performed, that could be interpreted as approval of this action, and so avoid scandal. Education has a critical role to play in rightly forming the healthcare workers. Families, schools, other educational institutions and parochial communities must reawaken and refine the sensitivity of people towards the sick and suffering neighbours. More importance is to be given to palliative care. Conclusion: Given the dominant ‘throw-away culture’ and ‘culture of death’ in the world, where abortions, euthanasia and assisted suicide are legalized and are responsible for the deaths of millions of unborn babies by abortion and thousands of terminally ill patients by euthanasia or assisted suicide, a presentation of the clear teachings of the Church was timely and necessary. This social encyclical is addressed to all people, not just Catholics because the theme is universal and is to be heeded by all people of good will so that a new world order of universal love, brotherhood and solidarity can be created. The Encyclical has 8 chapters with 287 Numbers or paragraphs and 288 footnotes. It ends with two prayers one to God the Creator and another Ecumenical Christian Prayer. The Pope begins by analyzing the current situation of the world describing it as “Dark clouds over a closed world”, wherein he speaks of shattered dreams, a throw-away culture, globalization and progress without a shared roadmap, reminds us that there have been pandemics
and calamities in human history but despite all evils there is still hope. He goes on to beautifully explain the parable of the Good Samaritan (ch.2) and presents a model for discerning the attitudes and habits which we must develop if we are to truly grow in human solidarity. We all need to be brothers and sisters, neighbors without borders to one and all, the rich reaching out to the poor and marginalized. Pope Francis argues for a world more open, a love ever more open. He advocates “universal love that promotes persons and promotes the moral good”. Hence solidarity is a value that must be upheld in such a world. Property has a social role. It is meant for the benefit of all, not only for a few. World’s resources are for all. Hence no one should go hungry to bed. He condemns xenophobia and appeals for welcoming refugees and migrants with open arms. Pope Francis is obviously not happy with the current state of world politics and makes an appeal for better kind of politics where there is political love, sacrifice born of love

and emphasizes fruitfulness over results in governance. There is need for dialogue and social friendship in society. We need to embrace a new culture of dialogue. Quoting the statement of Indian Bishops, Pope Francis says “the goal of dialogue is to establish friendship, peace and harmony, and to share spiritual and moral values and experiences in a spirit of truth and love” (No.271; footnote 259). In establishing peace in the world, there is need for forgiveness. War and death penalty are both unjust. They are “false answers that do not resolve the problems they are meant to solve and ultimately do no more than introduce new elements of destruction in the fabric of national and global society”. (No.255) The Pontiff proposes a global fund “with the money spent on weapons and other military expenditures, which can finally put an end to hunger and favour development in the most impoverished countries” (No. 262). Pope Francis also clearly states that “the death penalty is inadmissible” (No.263).
In the final chapter Pope appeals to the Religions and Religious leaders to be at the service of fraternity in the world. Religions should create peace and harmony and brotherhood. There is no place for violence in religion and in the society. Holy Father quotes the joint Declaration on Fraternity he signed in Abu Dhabi along with the Grand Imam Ahmad Al-Tayyeb to reiterate his appeal for fraternity among all. Towards the end of the Encyclical Pope Francis acknowledges that he was highly inspired by St. Francis of Assisi to write this document on Fraternity and Solidarity. He also mentions Martin Luther King, Desmond Tutu, Mahatma Gandhi and Blessed Charles de Foucauld as persons who have inspired him a lot in writing this Encyclical. In my humble opinion, the message of Fratelli Tutti is timely, relevant and urgently necessary for the entire world today. The world cannot survive with war and violence, selfishness and corruption, injustice and oppression. We need to live with one another as brothers and sisters and reach out to others

He was also the vice-Rector of St Charles Seminary from 1988 to 1994 and the parish priest of St Joseph's Cathedral, Lucknow, from June 1995 to March 2000. He was the vice-president of the Association of Moral Theologians of India from 1994 to 2000 and was a consultor to the Doctrinal Commission of the CBCI from 1990 to 1996. Bishop Mathias was appointed Bishop of Simla-Chandigarh on December 22, 1999 and was consecrated Bishop on April 9, 2000. He is at present the vice-chairman of the CBCI Commission for Youth and a member of the Advisory Council of Administration of the Union Territory of Chandigarh. webinar on the topic “Investing in mental health: Role of educators” on 14-10-2020. This webinar was envisioned keeping in mind the role of educators as benefactors of a healthy work environment and also their involvement in contributing towards mental health of those who are stake holders of an education system. The webinar began by our host, Ms Jeanne Cotta, student of Clinical Psychology, extending a welcome to the participants and guests and leading us in prayer. The topic “Investing in mental health: Role of educators” was then introduced by highlighting the theme- Increased investment in mental health and the objectivesfocusing on contemporary mental health and destigmatising mental health in the education sector. Sr Dr Vinora AC, Coordinator, St Agnes Centre for Post Graduate Studies and Research, officially welcomed the participants and introduced the speakers- Dr Santosh Prabhu, Assistant Professor, K S Hegde Medical Academy, Locum Consultant Psychiatrist,
Queensland Health Australia and Dr Shailaja Shastri, Consultant Psychologist & Director of Training and Research Initiatives, Bengaluru. Sr Dr Venissa AC, The Principal, St Agnes College, delivered her message on the occasion and applauded the initiative. The principal’s address was followed by educative and enriching sessions by the guest speakers. Dr Santosh Prabhu spoke on the theme – ‘Mental Health Now- A wide perspective’. Dr. Prabhu initiated the session by laying before us statistics pertaining to the incidence of mental illness and 20% of which is seen among youth between the ages of 18 to 25 years and reported death by suicide to be the common cause of death among 15 to 30 year olds, next to deaths caused by accidents. He stated that vulnerability among youth arises from the biological, social behaviour and relationships, financial pressure, increased responsibility, changing expectations and environment, which is seen through emotional, social and psychological arrest, loss

of potential and/or increased use of substance. He further enlightened the participants on how educational institutes can help by assisting them deal with issues related to cultural diversity, time constrains, heavy consequences, increasing competiveness and their expectations of self and others, while also supporting them in the transition from college to career. And then stated that “In the end we need to go about assisting them”. Dr Shailaja Shastri spoke on the theme – ‘Destigmatising Mental Health in Education Sector: The way forward’ she began by sharing a letter on what a child expected of its teachers – ‘A happy Face’ and then went on to encourage us about bridging the gap between mental illness and wellness through psychological aid, that can be executed at 3 levels- the Curative, Preventive and Promotive level, highlighting the importance of the latter two. She urged teachers and institutes to promote and bring the language of emotions to the forefront.
The forum was then open to questions from the participants which was moderated by Assistant Professor Deepa Kothari, followed by Mr Rajath Nayak, student of M.Sc. Psychology announcing the prize winners of each category. ‘Self-care’ was the theme for the poetry writing contest and the winners are as follows: First place – Judith Pereira, Second place – Brunda Nandakumar and Third place – Vaishnavi Shetty. ‘Depression, Family, suicide’ were the themes for film analysis and the winners are as follows: First place – Jeanne Marie Cotta, Second place – Shravya M H and Third place – Saurav Das. The webinar began with a soulful prayer by the Jesuit Brothers followed by a warm welcome to the speaker and the participants by Rev. Fr. Alphonse Fernandes SJ, Superior, Ashakiran. The opening remarks of the webinar was made by Rev. Fr. Dr Praveen Martis SJ, Principal, St Aloysius College (Autonomous), Mangalore. A very thought provoking message was made by the Principal where he spoke about
the woes of the migrants which has been there always and was heightened during the Lockdown during COVID 19 and how St Aloysius College has come forward in performing their social responsibility in these trying times. The speaker, Rev. Fr. Martin opened his talk stating “Migrant woes ‘greatest manmade tragedy’ in India since Partition” which is one of the most highlighted quotes in recent times by the famous historian Ramachandra Guha. He presented a completely new perspective to the migrant situation by comparing their plight with two historical events: firstly with the disturbing images of mass migration during

the partition of India in 1947 and secondly, the exodus experiences of the people of Israel from the slavery in Egypt (Biblical reference). He went on to stress that in contemporary India decades of rural distress has led to forced migration among landless agricultural labourers and marginal farmers. However, he pointed towards the fact that urban India did not really care for these migrant labourers till the COVID 19 lockdown was announced and the services of these migrants were not available. And to add to it there was complete failure and lack of preparedness by the government during that time. However, despite the struggle and hardships, these migrant labourers preferred taking all kinds of risk and trouble to get back to their villages and hometowns. This was basically their means of survival in their workplace was no longer available and the only way they could survive was getting back to their homes where somehow they could manage to live. Amidst all of this there was a ray of hope because when the
government failed these poor and helpless migrant labourers the common man played a major role. Various NGOs, Civil Society, Educational Institutions, Students etc. came forward to help. Rev Fr Martin had four suggestions to give in order to improve the erstwhile troubled situation of these migrant workers: accepting them as fellow citizens; protection of their rights; including them in unorganised workers’ social security boards; and providing them with basic services and entitlements. The talk concluded with the reference to the Constitution of India [Art.19] (1) (d) and (e) which states, “all citizens shall have the right ... to move freely throughout the territory of India; to reside and settle in any part of the territory of India”. However, this is possible only when everyone ensures that migrants get justice and only then will they be ever able to lead a dignified human life throughout the country.
