Appointment of Justice Arun Mishra as Chairperson, NHRC: Another Move to Subvert & Destroy Democratic Institutions 2nd June 2021 JOINT PRESS STATEMENT We, the members of various Human Rights Organisations and Concerned individuals, condemn the appointment of former SC Judge, Shri Arun Kumar Mishra, as the next Chairperson of the National Human Rights Commission (NHRC) of India by the selection Committee headed by the Prime Minister. What is troubling is that the decision to appoint Justice Arun Kumar Mishra as NHRC Head was despite the objection raised by the Leader of the Opposition in the Lok Sabha, Shri Mallikarjun Kharge, who suggested that a person representing Dalits, Adivasis, Minorities or other marginalised sections instead be appointed
as Chairperson, considering that the bulk of victims of state abuse comes from these communities. The suggestion was ignored and no reasons for discarding the same have been placed on record by the government. Very clearly, the decision shows open contempt for the mandate of the NHRC which places emphasis on independent functioning and autonomy. This was an opportunity to nominate a retired CJI or retied justice, with a proven track record of a concern for human rights thereby augmenting the reputation of the NHRC as an institution serious about redressing human rights violations. The public have a right to know the basis for the decision of the Selection Committee.

This decision made by the Modi-led Government smacks of brazen arrogance and indifference to public opinion and once again highlights the cynical disdain of the government for democratic norms and constitutional proprieties. By appointing Justice Arun Mishra, whose tenure as a former Supreme Court judge was very controversial, the Modi government has demonstrated once again, that the basis for their selection is not guided by the requirements of a Head of the NHRC or even the track record of defending human rights by the person so selected. Instead, what matters is whether the person selected was close to the ruling dispensation. We would like to point out that in matters involving critical right to life and livelihood issues of people from the margins of society, Justice Mishra as SC judge had scant respect for their plight. He was much criticised for ordering the eviction of millions of poor forest dwellers
in a PIL challenging the Forest Rights Act and the order was kept in abeyance only after numerous nation-wide agitations launched by affected tribal communities. In personal liberty matters, he tended to prefer a hard line, favouring state action over charges of violation of individual liberties. In land acquisition matters, a study of the dominant pattern in his orders indicated a tendency to favour the state as against individual landowners who challenged the land acquisition. In short, in all politically sensitive cases he always sided with the Central Government or acted in a manner to help some of the top leaders of the Central Government. These include Loya Case, Sahara Birla Corruption Case, Sanjiv Bhat Case, Haren Pandya Case, the tussle within CBI case, bail for Anand Teltumbde and Gautam Navlakha. We highlight only cases relating to human rights. His record in deciding land acquisition cases involving compensation claims indicated a clear bias to dismiss

the appeals filed by private individuals in favour of the respondent-state. In contrast, in matters where the appeals were field by the state (Governments) and its instrumentalities, invariably he either allowed the appeals or partly decided them in their favour. He infamously presided over a 5-judge Bench on land acquisition, set up to reconcile a conflict in opinion between an earlier 3-judge Bench and a Bench presided by him. Requests that he should recuse himself as there was conflict of interest with him heading the 5judge Bench which was examining his previous judgment, not only fell on deaf ears, but brushed aside. It is very clear that Justice Arun Mishra seems to have been rewarded for having declared his fealty to Prime Minister Modi in a Judicial Conference involving judges from 24 countries on 20th January 2020. Notwithstanding that he was still a sitting SC judge, Justice Mishra unabashedly described PM Modi, in glowing
terms, in his presence, as “an internationally acclaimed visionary … (a) versatile genius who thinks globally and acts locally …”. The supreme irony of a sitting Supreme Court Judge openly describing the PM, as the Head of the Executive, in such flowery terms indicating his closeness to the ruling regime was not lost on discerning jurists, lawyers and concerned citizens. How can a person who made an improper and unwarranted statement praising the PM in his very presence, be trusted by people to act without fear or favour to protect their human rights violated by the government? Few have forgotten the unprecedented action of 4 of the seniors most SC judges consisting of Justice Gogoi, Chelameswar, Madan Lokur and Joseph, conducting a press conference in January, 2019. The immediate trigger for the press conference was the assignment of the Judge Loya case to a Bench headed by Justice Arun Kumar Mishra. The

4 judges also pointed to how cases were being fixed and sent to particular Benches - and people inside the judicial system knew that the court was of Justice Arun Mishra – for favourable orders. It is therefore not strange that throwing democratic proprieties to the wind, the Government has appointed Justice Arun Mishra as the Chairperson of NHRC. Equally troubling is the appointment of former Director of Intelligence Bureau, Rajiv Jain as a member of the NHRC, when he has no human rights qualifications to speak of. Through such arbitrary and partial action, the government has demonstrated their scant respect for the foundational principles of good governance and constitutional rule – which requires independent institutions which remain autonomous from the control of the executive; impartial institutional leaders who exhibit allegiance not to a leader but to the Constitution of India; and in whose working ethos embody the principles of transparency,
accountability, responsibility.

The appointment is one more brazen and deliberate blow by the Central Government to the Constitution, rule of law and human rights. It is important to point out that the NHRC was created as an independent body which would enquire into complaints of abuse and violations of human rights by the State and its agencies. The NHRC, created by the PHR Act, is guided by the Paris Principles. What stands out is that the appointment of Justice Arun Mishra is a flagrant violation of the `Paris Principles’ which govern the recognition of the NHRC in international law. The Paris Principles mandate the international minimum standards that all National Human Rights Institutions (NHRI) have to meet – irrespective of the size of the NHRIs – if they are to be `legitimate, credible and effective in promoting and

protecting human rights’. Of the 6 foundational principles, the appointment of Justice Mishra directly violates 3: (1) Independence: International law recognises that even though NHRI’s are State institutions, set up and funded by the State, NHRI’s must be independent from government and from NGOs. As one international document points out, NHRI’s must have legal independence, operational independence, policy independence and financial independence. (2) Pluralism: ensuring that the composition of the NHRI’s reflects the social forces (from civilian society) who are the targets of social discrimination, inequality and rights violations. (3) Accountability. The NHRC’s are morally accountable to the larger citizenry who is at the receiving end of the brazen rights violations committed with impunity by state forces confident that they are always immune from being held accountable for their actions.
While the NHRCs may comply with the legal accountability of placing reports before Parliament, the issue of owning up to their moral and ethical accountability is of utmost importance. The NHRC itself has acknowledged their responsibility to comply with the Paris Principles and accreditation by GANHRI (Global Alliance of National Human Rights Institutions set up by the UN Human Rights Council). They have declared in their website that they have complied with the above principles sufficient to be reaccredited as an “A” Level NHRI by GANHRI in 2019. The appointment of Justice Mishra seriously repudiates the Paris Principles and must be questioned. There can be no iota of doubt that effective NHRI’s should have “independent members who exercise independent thinking and leadership”. As the judiciary never tires of saying, justice should not only be done,

but seen to be done. A big casualty of the appointment of a person like Justice Mishra will be the trust and confidence of people, especially victims of rights violations in the independence of the NHRC. This apart, the other request of Mr. Kharge who suggested that there be greater diversity in selection of NHRC members by appointing Dalit, Adivasi or Minority communities, was also summarily rejected by PM – headed Selection Committee who reportedly finalised the appointments of the former Director of Intelligence Bureau, Mr. Rajiv Jain, and former J&K HC Judge, MK Mittal as members. Once again, the Selection Committee has shown the scant respect it has for Dalit, Adivasi, minority and marginalised communities by appointing former police/ security officials who were seen to be close to the ruling dispensation thereby ignoring the demand for ensuring diversity in appointment of NHRC
members. It is a moot question as to whether in a nation of 1.38 billion people, there are no independent thinking, credible, constitutionally sensitive members from Dalit, Adivasi and minority communities. When repeatedly, only government officers, especially police officers are appointed as NHRC members, it confirms the suspicion that the Government is rewarding such officials for their loyalty to the ruling regimes. Similarly, it is a valid question raised by members of the Dalit, Adivasi, Minority, and other marginalised communities as to why members of their communities, who have been former judges of High Courts and Supreme Courts, leading academics and professionals amongst them are seldom appointed as members of the NHRC. This too highlights the claim of the government of respecting diversity as bare tokenism, and that too in bad faith.

It is time the voices of the silent majority are heeded and nonofficials from these communities are recognised and appointed to the NHRC. ICYM Initiates -Mission Share and Care
ICYM Mangalore diocesan youth have taken up the initiative to distribute food to eliminate hunger
and assist families during the pandemic lockdown. The title of the mission is "Mission Share and Care 2021", a campaign aimed at eradicating hunger in Mangalore.

volunteer amid this challenging time. The youth volunteers start packing food at 10.30 every morning and then set to distribute food by 11.30,

in the streets of Mangalore. The mission is to reach out to the people who are not easily located. ICYM Youth therefore go in search of people who are in the interior streets and share with them food and water. Very often this is the only meal that they get during these difficult times. The youth spend 2 to 3 hours each day on streets searching for such people. An average of 200 packets are distributed daily. The ICYM Youth have already distributed 5750- meals, 4500- 1ltr water bottles, 2500 - masks in the past 32 days of the mission. On an average the food packets costs ₹60/- per meal, not including the water and masks that they also distribute.

Pandemic Beckons us to be Good Samaritans dioceses, religious congregations, social work societies, caritas etc. even during normal times but especially during natural and manmade calamities.
Church is not only Mater et Magistra but also Samaritanus Bonus. Following the footsteps of the Master, Church has been called always to be a good Samaritan. The Church is carrying out this mandate through numerous works of mercy, both corporal and spiritual, by individuals and through its institutions such as parishes,
The unprecedented crisis created by the exponential spread of corona virus all over the world, and its disastrous impact on human lives, economy, business, jobs, travel, tourism, worship etc. beckons the Church to respond actively, creatively, and urgently, not as the Priest and Levite did but as the Good Samaritan in the parable of the same name. In fact, Christ is the Good Samaritan who reaches out to the needy in all circumstances. Church as the Mystical Body of Christ must do the same. What the head is, so must the members of his body be. The crisis is huge, global as well as local and the Church at universal and local levels must respond to the need of the time and

place. “The joys and hopes, the grief and anguish of the people of our time, especially of those who are poor or afflicted are the joys and hopes, the grief and anguish of the followers of Christ as well.” (G.S.1) The Golden Rule “do to others as you would have them do to you” (cf. Mt. 7:12; Tob.4:15) becomes imperative in these trying circumstances. While the Church is called to be the Good Samaritan, the Church is often herself wounded and lies on the road seeking help as many of its members are sick infected with the virus or afflicted with other causes, many are dying or already dead. Thus, it must reach out to its own members and to wounded humanity at large. Pope Francis in his latest Encyclical, Fratelli Tutti, on Fraternity and Social Friendship, has devoted an entire chapter (ch.2) to the parable of the Good Samaritan. The Holy Father tells us that “We
need to acknowledge that we are constantly tempted to ignore others, especially the weak…… We have become accustomed to looking the other way, passing by, ignoring situations until it affects us directly” (F.T.64). We are like the Priest or Levite in the parable who passed by. Only the Samaritan stopped, and cared for the wounded man spending his time and money. “In the face of so much pain and suffering (at present due to pandemic), our only concern is to imitate the Good Samaritan. Any other decision would make us either one of the robbers or one of those who walked by without showing compassion for the sufferings of the man on the roadside” (F.T.67). Fortunately, it is heartening to see many priests, religious and lay faithful, apart from the medical personnel, reaching out to those who are suffering due to covid-19 and because of the impact of lockdown, even risking their own lives. Not only Christians, but people of all faiths are coming forward to help the suffering and needy. There is so many beautiful heart-

touching testimonies. Pope Francis reminds us that “Each day we have to decide whether to be Good Samaritans or indifferent bystanders…… All of us have in ourselves something of the wounded man, something of the robber, something of the passersby and something of Good Samaritan” (F.T.69) Pope Francis tells us not to overlook a particular detail. The passers-by were religious, devoted to the worship of God, namely a Priest and a Levite. That is a clear indictment on Church Leaders, Clergy and Religious. It is not sufficient to perform our duties towards God, at the same time we must carry out our duties towards our neighbours, those in need. “All of us have a responsibility for the wounded, those of our own people and all the people of the earth. Let us care for the needs of every man and woman, young and old, with the same fraternal spirit of care and closeness that marked the Good Samaritan” (F.T.79)
Jesus gives us a new understanding of neighbour, not just those who are next or nearest to us, but all in need. We ourselves should become neighbours to all. “Jesus asks us to be present to those in need of help, regardless of whether or not they belong to our social group. In this case, the Samaritan becomes a neighbour to the wounded Judean,” (F.T.81) Jesus concluded the parable by saying “Go and do likewise” (Lk.10:37). This is a mandate for the Church as a whole and for everyone. The parable “gives a universal dimension to our call to love, one that transcends all prejudices, all historical and cultural barriers, all petty interests.” (F.T.83) The global pandemic is a great opportunity for the Church to be the Good Samaritan. The whole world is wounded and is lying on the roadside. We cannot pass by. We cannot be indifferent. We cannot look the other way. We must get involved at the local level, parish, diocese, congregation, the church to provide medical, material, emotional and spiritual assistance

▪︎Take big vessel, add water, salt cook okra.
For Masala Grinding:
▪︎Add ground masala to cooked okra, adjust consistency & simmer well. Now add prawns and boil for 2 - 5 mins. Take it off.

The Origin and Solution to Covid-19 These days the entire world is under the grip of pandemic Covid-19. There are any number of videos, articles, comments from persons of various fields on Covid-19. Various hypotheses are presented regarding its origin, spreading, treatment, how to remain safe, what to do and what not to do. At times, these hypotheses are contradicting and confusing. Which are true and which are false, who will tell us the truth? At present governments blame people, people hold governments responsible. The game of blaming others is going on. Some are sending prayer requests for their relatives and friends who are affected by Covid-19. Some recommend prayers and fasting so that God may stop this pandemic. Simple folk believe that this pandemic is a punishment or curse sent by God and therefore only he can deliver us from it. Some ask, “If there is a God why is he silent? Why
can’t he see the pain and agony of helpless people?” Thousands of questions are raised and will continue to be raised. No solutions or satisfactory answers. We are all lost in this tsunami of Covid-19. I am not a biomedical scientist, or Doctor of Medicine or from the field of medicine and health care. I am a linguist. Hence, I cannot talk about the cause and cure of Covid-19. In linguistics we use terms, surface structure and deep structure. Rules of transformation change deep structure into surface structure. From the surface structure, we discover the deep structure. Using this principle of linguistics, as a Catholic and Jesuit priest, I tried to discover the deep structure of covid-19 in the Book of Genesis, chapters 1 and 2 of the Bible. These two chapters narrate how God created everything including humans using stories. The authors are not making historical or

scientific facts. They are presenting faith statements based on their reflections, experience, and knowledge. There are two accounts of creation. The Priestly account of creation is in Genesis 1:1-2:4a and the Yahwist account of creation is in 2.4b-25. According to the priestly account, after creating everything, on the sixth day God created man and woman in his own image and likeness. God saw everything that he had made, and behold, it was particularly good. God blessed man and woman and said to them, “Be fruitful and multiply and fill the earth and subdue it and have dominion over the fish of the sea and over the birds of the sky, and over every living creature that moves on the earth.” God gave plants, birds, fishes, and animals as food for them. Man was appointed as God’s administrator. This subduing does not mean exploitation of the environment by industry, technology, etc. Rather, it means that man has to overcome every sign of the chaotic forces in various spheres of life and lead this world towards its God appointed destiny.
According to the Yahwist account God created earth and heavens, there was no one to work on the ground. Hence God created man. Later he created plants and animals. He placed man in the garden of Eden to till it and take care of it. God commanded the man saying, “You may surely eat of every tree of the garden, but the tree of knowledge of good and evil you shall not eat, for the day that you eat of it you shall surely die.” Since man was alone, God then created woman from his rib. The expression “to till the earth and take care of it (2:15)” need not be restricted only to farming. It includes every human endeavour to harness the world’s latent energies, be they material, cultural or spiritual. Man must help and guide the world to evolve towards its God appointed perfection. As the story of man’s life on earth unfolds in the following chapters of Genesis, sin makes its appearance and seriously impairs the relationship of love and trust between Adam (man) and Adamah (earth). Every creature, except we humans, lives by God given instinct to it.

Therefore, no creature really destroys the earth. They live as per God’s plan and in harmony with nature. God gave human persons the power of knowledge and free will to choose. Therefore, they filled themselves with arrogance, pride and all forms of vices and negativity. They exploited the earth and other creatures for their greed and pleasure. Ten thousand years ago or even prior to that human person lived in harmony with nature. There were no skyscrapers, multistory buildings, aeroplanes, railways, steamers, vehicles, large bridges, electricity, nuclear energy, industry, factories, modern gadgets, large cities, smart cities, mining, bombs, rockets, and modern war equipment, pesticide, plastic, production of chemicals, garbage, etc. Life was simple. Mostly people lived in villages and forest areas. They breathed fresh air, worked in fields. Agriculture was the dominant occupation. Hunting was done exclusively for food. They ate fresh food, drank water from the streams or well and used herbal medicines. They lived in harmony with their tribe and the earth. Since they worked hard, their life span was
short. In Konknni there is a saying, “Satt søt’tør, fondda bhitør” (sixty or seventy years, time to go to the grave). Such people do exist even now in the Amazon Rainforest of Brazil, the Rainforest of Congo in Central Africa, in certain islands of Andaman and Nicobar Islands. We label them as “savage, barbarians, uncivilized, uncultured” people. In India those who live in the forest and hilly areas are labelled as Adivasis or tribals. They used the forest products for their survival only and not for the accumulation of wealth by destroying forests, hills, and rivers. We who call ourselves as “civilized and modern” instead of creating smart villages, created congested overpopulated cities. Our “civilized and modern” life has inflicted unbearable wounds on the earth which sustains us. We forgot the master plan of our creator for us. We disobeyed him. We thought that we could be smarter than him and live ignoring his commandments. After exploiting the earth, now we want to explore and exploit the moon and other planets. We want to control the

universe and planning to become immortal. God must be repenting now for creating humans and moreover giving humans the free will and intelligence to discover new things. And now we must pay the heavy price for our own sins of exploitation ignoring God’s divine master plan for us and the universe. We have not learned lessons from history. Wherever there was congestion of people, there were epidemics. The entire humankind is responsible for the past, present and future viruses, and pandemics. Covid-19 is the byproduct of our misused intelligence. It is a manmade disaster and not a divine punishment. Covid-19 might come under control in near future, but it has come here to remain like Malaria, Dengue, and several other fevers, Tuberculosis, Cancer, Pneumonia, Polio, HIV virus, and other diseases. Many more new viruses will emerge and cause new diseases soon. Jesus had warned his disciples saying, “Nations will fight one another, and kingdom oppose kingdom. There will be great earthquakes and, in many places, famines and plagues.” (Gospel of Luke 21:10-11). What happens if the
humans disappear from the earth? Will there be any loss? Surely not, on the contrary the earth will bloom and flourish. There are no instant and short-term solutions for all our problems including Covid-19. What I suggest might seem like a madman’s madness. But I am convinced based on my life experience in my own village till I joined the Jesuits to become a priest. I joined in 1971 after completing my B.Sc. At home we had no electricity, phone, gas, or any modern gadgets, except a small transistor and alarm clock. We cooked and ate fresh vegetables, fish and meat at home. In our nourishing diet there was no processed food, or artificial drinks. We ate fresh fruits and drank fresh fruit juice. Milk, curd, buttermilk, ghee was prepared at home. We used earthen vessels for cooking, using exclusively firewood. We cultivated vegetables and fruit bearing trees. We drank water from our own well. Besides studies, I must do manual work in our property including plucking coconuts and other fruits. Life was simple, tough but enjoyable and healthy. We lived

by our basic needs and not by greed. There was no pollution, no industry, no multistory buildings in my village. We had not even one MBBS doctor in our village. For common ailments home remedies and herbal medicines were used. In our village there was Dr. S.V. Pai an Ayurvedic doctor but was prescribing allopathic medicines. There were two medical compounders. They fulfilled the role of doctors. My mother gave birth to her seven children at home with the help of local women. We lived in harmony with nature. Our movements outside the village were restricted. Because our basic needs were met in the village and at the taluka town. After joining the Jesuits in 1973 for the first time I went to our district headquarter Mangaluru and stayed with the Jesuits of St. Aloysius College!!! To save the earth and ourselves we must abandon the cities and create new villages and go back to agriculture, horticulture, and animal rearing occupation. Let us fill this earth with native trees and plants, instead of erecting concrete structures. In short let us go back to
ten thousand years in history and live like our ancestors. Sounds crazy and stupid. Yes, I am convinced of this. Thank God there are a few people who live this way. In North America and Canada Orthodox Mennonites advocate high moral standards and have many restrictions on technology. They live with no electricity, telephones, gas, automobiles, or computerized technologies. They use horses instead of tractors. They live as a community. Last week Mr Amit Wagle, a member of my WhatsApp group sent me a video of a lady living in a forest area. I was overwhelmed by seeing it. I am sharing it with you on WhatsApp. I am also sharing with you another video " What happens if all humans die" by Jaggi Vasudev, popularly known as Sadhuguru. If God gives me another life, I will live in a forest among the animals without confining them to cages. I will live to fulfill God’s masterplan, “to till the earth and take care of it”. Sounds utterly crazy. It is better to live a “crazy” life than to destroy the earth and ourselves with endless viruses.
