US Government lambasts India on Freedom of Religion

-*Fr Cedric Prakash SJ Releasing the Report, Secretary Blinken said, “religious freedom, like every human right, is universal. All people everywhere are entitled to it, no matter where they live, what they believe or what they don’t believe. Religious freedom is co-equal with other human rights because human rights are indivisible. Religious freedom is not more or less important than the freedom to speak and assemble, to participate in the political life of one’s country, to live free from torture or slavery

or any other human rights. Indeed, they’re all interdependent.

Religious freedom can’t be fully realized unless other human rights are respected.

And when governments violate their people’s right to believe and worship freely, it jeopardizes all the others. And religious freedom is a key element of an open and stable society.

Without it, people aren’t able to make their fullest contribution to their country’s success. And whenever human rights are denied, it ignites tension, it breeds division.

As this year’s International Religious Freedom Report indicates, for many people around the world, this right is still out of reach. In fact, according to the Pew Research Center, 56 countries encompassing a significant majority of the world’s people have high or severe restrictions on religious freedom.

India figured high up in the group of ‘56 countries’ which were referred to. On all counts, India is one of the very few democracies in the world today which pays scant attention to the religious freedom of her people – almost on par with dictatorial regimes. A real disgrace on the international forum! The particularly long section on India is a scathing attack of how the Indian Government has been denying religious freedom to its minorities.

In the Press Briefing during the release of the Report, Dan Nadel, Senior Official from the Office of Religious Freedom responding to a question on India said, “with respect to India first, we do regularly engage with Indian government officials at all levels, encouraging them to uphold human rights, obligations and commitments, including the protection of minorities in keeping with India’s long tradition of democratic values and its history of tolerance. And the best way to address that is to engage in that direct dialogue between government and civil society, including religious communities.

So, with respect to India, I think there’s genuine opportunities there

for the government to address some of the concerns they hear from Indian civil society, through a greater dialogue and engagement”.

The ‘Executive Summary’ on India provides a detailed and in-depth coverage of the systematic, consistent attacks and human rights violations on the religious minorities (particularly the Muslims and Christians) and also on the Dalits. The report includes the actual happenings together with the date and other relevant information.

A significant highlight is the communal violence which took in New Delhi in February 2020 in which fifty-three people were killed and several hundreds were injured – and most of them were Muslims. This violence was definitely Statesponsored. The Report noted quoting Human Rights Watch, “Witnesses accounts and video evidence showed police complicity in the violence, Muslim academics, human rights activists, former police officers, and journalists alleged anti-Muslim bias in the investigation of riots by New Delhi Police.”

The Report also highlighted the way Muslims were targeted when the pandemic COVID-19 broke out in India; hateful rhetoric during pandemic focussed on the Islamic Tablighi Jamaat organization which had organised an international meeting in Delhi. The Tablighi was held responsible for spreading the coronavirus and there was constant use of the words “terrorism” and “Corona Jihad” by the members of the ruling Bharatiya Janata Party (BJP) and some of the mainstream media outlets. The Report minces no words when it notes, “There were reports of religiously motivated killings, assaults, riots, discrimination, vandalism, and actions restricting the right of individuals to practice and speak about their religious beliefs” The anti-CAA protests which rocked the country from the time the Government passed the Citizenship Amendment Act in mid-December 2019, also found prominent space in the Report. It stated that, “Parliament passed the CAA in December 2019 to provide an expedited path to citizenship for Hindu, Sikh, Buddhist, Jain, Parsi,

and Christian migrants from Pakistan, Afghanistan, and Bangladesh who had entered the country on or before December 31, 2014. Similarly situated Muslims, Jews, atheists, and members of other faiths from these three countries were excluded from the CAA. As of late 2020, the government had not yet enacted rules to implement the CAA. Domestic and international media, NGOs, religious groups, intellectuals, and some political parties criticized the exclusion of Muslims from the legislation, sparking widespread protests.

Activists, NGOs, and political parties filed petitions against the CAA on the grounds that it added a religious qualification to the country’s historically secular citizenship laws. None of the more than 100 legal challenges had been heard by the Supreme Court as of the year’s end. Commentators, members of some political parties, and activists said the CAA was part of an effort to marginalize Muslim communities throughout the country. They also questioned delays in hearing legal challenges to the legislation. The government stated the legislation facilitated

naturalization for refugees from religious minorities who had fled neighboring countries due to religious persecution and that Muslims could also apply for citizenship through other mechanisms”.

India has also gained notoriety with its anti-conversion laws which are clearly violative of Article 25 of the Constitution which guarantees every citizen the freedom to preach, practise and propagate the religion of one’s choice. Perhaps the only democracy in the world which violates not only the rights of her people but also Article 18 of the Universal Declaration of Human Rights. On the anti-conversion laws which exist in some States the Report states, “Ten of the 28 states in the country have laws restricting religious conversion: Arunachal Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Odisha, Rajasthan, Uttar Pradesh and Uttarakhand.

Chhattisgarh, Madhya Pradesh, Uttarakhand, and Uttar Pradesh prohibit religious conversion by “force,” “allurement,” or “fraudulent means” and require district

authorities to be informed of any intended conversions one month in advance. Himachal Pradesh and Odisha maintain similar prohibitions against conversion through “force,” “inducement,” or “fraud,” and bar individuals from abetting such conversions. Odisha requires individuals wishing to convert to another religion and clergy intending to officiate at a conversion ceremony to submit formal notification to the government”. In 2021, some States including Uttar Pradesh, Madhya Pradesh and Gujarat have introduced anti-conversion laws which are several times more draconian than the existing ones. It would be interesting to see what the US Report 2021 on India’s freedom of religion would contain.

The Report also details other areas where minorities are selectively targeted solely because of their religious beliefs; these include the Prevention of Cow Slaughter Act and the amendments to the Foreign Contributions Regulation Act (FCRA. In October, the Allahabad High Court in Uttar Pradesh ruled that the state Prevention of Cow Slaughter Act “was being misused

against innocent persons” and granted bail to a Muslim individual arrested under the act. One key point in the Report was its reference to Fr. Stan Swamy when it states, “On November 5, a National Investigative Agency (NIA) court in Mumbai extended the detention of Stan Swamy, a Jesuit priest and 84year-old social activist, on sedition charges in connection with a violent demonstration that resulted in several deaths. NIA officers arrested him on October 8 at his residence on the outskirts of Ranchi, Jharkhand, and his communication with others during detention was strictly regulated. Swamy remained in jail at year’s end.” After languishing in the Taloja jail for almost eight months, on 28 May, Fr Stan was finally allowed by the Bombay High Court the possibility to be admitted to the private Holy Family Hospital in Bandra for fifteen days for urgent medical treatment to address his deteriorating health, Interestingly, more than a fortnight after the US State Department released this Report, the Government of India has not bothered to comment on it, leave

alone issue a rebuttal; besides none of the mainstream media (most of it is still highly ‘godified’ – mouthpiece of the Government) have thought it necessary to make it part of the news. The ‘bhakts’ in the US – who enjoy freedom there and send money ‘home’ to help the fascist agenda of Hindutva to thrive in India – have not shown a whimper of protest. Truth is certainly hard to hide!

A few weeks earlier on 22 April, the US Commission for International Religious Freedom (USCIRF) released its Annual Report 202. The Report said that, “religious freedom conditions in India continued their negative trajectory. The government, led by the Bhartiya Janata Party (BJP), promoted Hindu nationalist policies resulting in systematic, ongoing, and egregious violations of religious freedom.”

It particularly noted the passage of the “religiously discriminatory” Citizenship Amendment Act. The report indicated that there was seeming police complicity in the Delhi riots; adding, “At the beginning of the COVID-19 pandemic, disinformation and

hateful rhetoric—including from government officials—often targeted religious minorities, continuing familiar patterns.”

Further, the report alleged that “government action including the acquittal of all individuals accused of demolishing the Babri Masjid Mosque—as well as government inaction to address religious violence contributed to a culture of impunity for those promulgating hate and violence toward religious minorities”.

The recommendations on India by the USCIRF to the US Government were scathing, which included: i. That India be designated India as a Country of Particular Concern (CPC) for engaging in and tolerating systematic ongoing, and egregious religious freedom violations. ii. Those targeted sanctions be imposed on individuals and entities responsible for severe violations of religious freedom by freezing those individuals’ or entities’ assets and/or barring their entry into the United States. iii. That the administration advances the human rights of all religious communities in

India and promote religious freedom, dignity and interfaith dialogue through bilateral and multilateral forums and agreements. iv. That ongoing religious freedom violations be condemned and support religious organizations and human rights groups being targeted for their advocacy of religious freedom. v. That the US Congress should continue to raise religious freedom concerns in the U.S.India bilateral relationship by hosting hearings, writing letters and constituting Congressional delegations.

Short of declaring India as a CPC, the US State Department Report seems to have integrated several of the recommendations of the USCIRF. On expected lines. the Indian Government rejected the USCIRF Report. A spokesperson from the Ministry of External Affairs went on the offensive saying, "Our principled position remains that we see no locus standi for a foreign entity to pronounce on the state of our citizens' constitutionally protected rights"

So why has the Government of India has not responded to the State Department report is a big question! India cannot be selective in its foreign policy: buying rafale jets from France or arms and ammunition from the United Sates is also an ‘interference’ in the internal affairs of our country; the Prime Minister going to Texas to canvas for Trump for another term of Presidency is also ‘interference’; hypocrisy, one-sidedness and double talk only lays bare the insidious agenda of a fascist regime.

India’s foreign minister is currently in the United States and was absolutely pathetic when he stated, that India is being maligned on the international stage A sad joke indeed! Yes, India is being maligned by those who rule the country today: who are unable to meet the basic health needs of the people, who waste tax-payers money constructing a grandiose Central Vista, who destroy the environment, like the pristine Lakshadweep to help crony capitalists to profit, who use religion to keep people divided,

who spew venom and hate on the minorities… and much more! In a systematic and pernicious way, the regime and their henchmen have attacked and destroyed all that is precious in India: Constitutional Rights, democratic values and the pluralistic fabric.

The US State Department’s ‘2020 International Religious Freedom Report’ – should be an important reminder to the ruling regime that in a democracy, the freedom of religion is not only a right but also sacred. In the words of Mahatma Gandhi, “I do not expect India to develop one religion, i.e., to be wholly Hindu, or wholly Christian, or wholly Muslim, but I want it to be wholly tolerant, with its religions working side by side with one another.”

Whether those in power have the ability to listen and the courage to change – is another question!

DECALOGUE SIX & BOOK SIX before that? Thankfully we live in an era where there is some semblance of church law, largely inspired by the teachings of Vatican II.

# chhotebhai Lest one go into sixes and sevens over this title; it was occasioned by a recent headline in the Times of India that read “New Vatican Law criminalizes sexual abuse by priests, laity”. It was referring to Decalogue Six, the sixth commandment, “You shall not commit adultery” (Ex 20:14, Deut 5:18). It was also referring to Book Six of Canon Law promulgated by Pope John Paul II on 25/1/1983, titled “Sanctions in the Church”. By the Apostolic Constitution “Pascite gregem Dei” (it means – shepherd the flock of God), Pope Francis, on 1/6/2021, revised this book that is now titled “Penal Sanctions in the Church”.

Lay readers in particular would be interested to know that a plethora of church laws were first codified as late as 1917! Was it a free for all

While promulgating the New Code of Canon Law in 1983 Pope John Paul II had this to say: “The Code therefore demonstrates the spirit of this Council ... This new Code can be viewed as a great effort to translate the conciliar ecclesiological teaching into canonical terms ... The Code is regarded as a complement to the authentic teaching proposed by the Second Vatican Council and particularly to its Dogmatic and Pastoral Constitutions (LG & GS)”.

If the Code of Canon Law, old, new or revised, is not seen in the light of Vatican II ecclesiology then it could be misinterpreted or distorted. With this caveat I dare to study the revised Book Six in comparison to the New Code of 1983. For clarity I shall suffix the numbers of the Revised Code with R and the “new” one of 1983 with N. My second caveat is that I am a layman with no theological training, so I may please be pardoned if I arrive at some wrong conclusions.

Let us first quote some of the revised texts and then try and draw

some lessons from them. The first line to strike me was “Any person is considered innocent until the contrary is proven” (1321). This is natural jurisprudence, but it could be used by powerful persons to not relinquish office or accept punishment.

However, the provisions of 1321R, though largely the same as 1326N, add a new clause for graver punishment in the case of “a person who committed an offence in a state of drunkenness or other mental disturbance, if these were deliberately sought so as to commit the offence or to excuse it, or through passion which was deliberately stimulated or nourished” (1326:4R). This is a positive development that would prevent criminals from claiming temporary insanity. Nevertheless, it would have been better if it had specifically mentioned drugs and other psycho tropic substances along with “drunkenness”.

Another positive addition is in 1335:1R that provides for the competent authority to “impose penalties it considers necessary to restore justice or repair scandal”.

So other than punishment there is now also a provision for restitution.

Accordingly a thief, rapist or paedophile, in addition to facing punishment, would also have to

make restitution or compensation.

This is again expressed in 1361:4R. As a student I have a problem with Canons 1365R-1398R where the serial numbers have been changed.

This could lead to much confusion later. There does not seem to be much merit in changing these numbers.

A new provision is found in 1371:3R that provides for punishment for perjury (false statement under oath). This is a deep rooted malaise in the Indian judicial system, as the laws of perjury are not enforced, and filing false affidavits is common.

In contrast, in England, Jeffery Archer, famous novelist and Member of Parliament, was jailed for several years for making a perjurous statement.

Corruption and financial misappropriation are addressed in 1376 & 1377R. Punishment is to be meted out to persons who “steal ecclesiastical goods” (1376:1R).

Alienation of such goods was already covered under 1377N. Abuse of ecclesiastical power, office or function, even by acts of omission, are covered by 1378:1R. Culpable negligence is addressed in 1378:2R. So bishops are also brought to account.

Canon 1393:2R has a similar provision.

A new provision that sets the cat among the pigeons is this; “Both a person who attempts to confer a sacred order on a woman, and the woman who attempts to receive the sacred order, incur latae sententiae ex-communication (automatic, without an opportunity to be heard) reserved to the Holy See (1379:3).This is an insult to half the members of the church. It is an uncalled for retrograde provision.

We have heard umpteen arguments (based on ecclesiastical discipline, not on faith) against women’s ordination. I will here point out one of the most absurd ones, based on the teachings of St Thomas Aquinas, considered the father of systemic theology. I quote from the “Declaration on the question of the Admission of Women to the Ministerial Priesthood” by the Sacred Congregation for the Doctrine of the Faith on 3.2.1977.

“The Christian priesthood is of a sacramental nature ... The whole sacramental economy is in fact based upon natural signs, on symbols imprinted upon the human psychology.

Sacramental signs, says St Thomas, represent what they signify by natural resemblance.

The same natural resemblance is required for persons as for things ... there would not be this natural resemblance which must exist

between Christ and his minister if the role of Christ were not taken by a man; in such a case it would be difficult to see in the minister the image of Christ. For Christ himself was and remains a man” (No 5).

This “natural resemblance” argument raises more questions that in answers. By this token priests should have long hair and beards, do rigorous manual work (like carpenters) begin and end their ministry riding on a donkey, not having a residence of their own (cf Mat 8:20) and not even a place to be buried in. How many popes, cardinals, bishops or priests bear a natural resemblance to Jesus, a circumcised Jew? As for symbols imprinted on the human psyche, were there symbols of women frontline warriors, fighter pilots or CEOs of MNCs earlier? Times change, circumstances change, the Church too must change with time, to stay relevant. I therefore find the insertion of Canon 1379:3R an insult to womanhood, an insult to Eve, an insult to Mother Mary and an unwarranted retrograde step by a male dominated church.

Disappointing.

Canon 1380R condemns the practice of Simony; that of trading spiritual favours for money. This is named after Simon the magician who attracted followers with his

wizardry in Samaria. “When Simon saw that the Spirit was given through the laying on of the apostles’ hands, he offered them money” (Acts 8:18). Peter, the other Simon’s rebuke is classic.

“May your silver be lost forever, and you with it, for thinking that money could buy what God has given for nothing” (Acts 8:20). This begs the question. What about those popes who sold indulgences in the middle ages, something that was a bone of contention with Martin Luther, resulting in the Reformation and the establishment of Protestant churches? If we don’t learn the lessons of history we are doomed to repeat the same mistakes.

Canon 1392R provides for penal provisions for those who “unlawfully abandon the sacred ministry for six months continuously” This is in consonance with the act of a malingerer in civil/ secular service, and to be welcomed.

A contentious issue that has been retained is, “A Person who actually procures an abortion, incurs a latae sententiae excommunication” (1397:2R, 1398N). This provision certainty required revision. The penal provision is disproportionate to the offence; that could have several mitigating circumstances like rape, or the danger to the life of the mother. There was the case of

the 9 year old girl who had been impregnated by her step father in Brazil, and had an abortion. The local archbishop excommunicated her. When then Pope Benedict XVI was asked about the rapist he replied that the sin of the rapist was not as grave so as to invite excommunication! In the case of Savita the Indian dentist in Ireland in 2012, she had septicaemia, but was denied an abortion in “Catholic Ireland.” Both she and the foetus died, inviting much negative publicity for the “holier than though” Catholic Church.

I cannot digest the church’s double standards when it comes to the taking of human life. On the one hand it condemns abortion outright for that very reason. However, when it comes to taking lives in war (men are the prime movers), then there is another set of rules.

When the “Pastoral Constitution of the Church in the Modern World” talks of war it, inter alia, has this to say: “Governments cannot be denied the right to legitimate defence once every means of peaceful settlement have been exhausted... Armed forces should regard themselves as agents of security and freedom.... as long as they fulfil this role properly, they are making a genuine contribution to

the establishment of peace” (GS 79).

The Catechism of the Catholic Church goes a step further, again based on the logic of St Thomas Aquinas. “The act of self-defense can have a double effect, the preservation of one’s own life; and the killing of the aggressor. The one is intended, the other is not” (CCC 2263). “Those who legitimately hold authority also have the right to use arms to repel aggressors against the civil community entrusted to their responsibility” (CCC 2265).

Earlier even the death penalty was considered ok in some circumstances (CCC 2267) until Pope Francis declared it inadvisable on 2/8/18.

Writing in La Croix International on 4/6/21 Loup Besmond de Senneville says that when Abp Fillipo Iannone, President of the Pontifical Council for Legislative Texts since 2018 was questioned about some of these anomalies, specifically pertaining to dismissal of priests for sexual abuse he said: “An automatic sentence would not make sense. It is a principle of justice”! Obviously then, the Catholic Church has one set of principles for women procuring an abortion, and another for the violent or heinous acts of men. I don’t buy this duality.

The next Canon, 1398, redeems the church’s image to some extent.

This is what drew maximum media attention. Unfortunately it retains the archaic term, the sixth commandment of the Decalogue. It could have more specifically referred to sexual acts or relationships.

It calls for punishment and deprivation from office for such acts against a minor or one who “habitually has an imperfect use of reason” (1398:1R).

It also penalizes those who induce or stimulate such persons to expose themselves pornographically (1398:2R). Retention or use of such pornographic context is also punishable (1398:3R) Senneville states that the revision of Canon Law began in 2007 under Pope Benedict XVI. For a 14 year effort, the minor changes that this revision has affected are indeed pathetic.

Had the Vatican functioned a little more efficiently, like a corporate, these changes could have been affected in a month. While the norms regarding paedophilia and accountability are to be welcomed, the one on women’s ordination was totally uncalled for, and the retention of the law on abortion definitely needed to be revisited.

Unfortunately, the revision of Book Six of Canon Law, and the ambiguous references to the Sixth commandment of the Decalogue cannot be called a Sixer in cricketing parlance. It seems more a case of hit cricket. It remains to be seen what impact this will have in cleaning up the many acts of

corruption, scandal and licentiousness in the church, particularly in India that is reeling with multiple cases against bishops. *The writer has further developed some of these thoughts in his latest book THE JERUSALEM CODE .

WANTED: Immediate Justice in the Bhima-Koregaon Conspiracy

-*Fr. Cedric Prakash SJ It was the virtual ‘midnight knock’!

The irony was that the knock took place in broad daylight, and expectedly in a blatantly unjust, uncivilised and unconstitutional manner. On 6 June 2018, Sudhir Dhawale, Surendra Gadling, Mahesh Raut, Shoma Sen and Rona Wilson were arrested from their residences in various parts of

the country. The arrests of others then continued in a phased manner: on 28 August 2018, Arun Ferreira, Sudha Bharadwaj, Varavara Rao and Vernon Gonsalves; on 14 April 2020, Anand Teltumbde and Gautam Navlakha; on 28 July 2020, Hanybabu Tarayil; on 10 September 2020, Sagar Gorkhe, Ramesh Gaichor and (the next day) Jyoti Jagtap – all three from the Kabir Kala Manch were arrested from Pune; finally on 8 October 2020, Fr Stan Swamy was arrested from Ranchi.

It is three years now since the first arrests in the Bhima-Koregaon conspiracy case were made. Today, sixteen (referred to as the BK-16)

of the country's committed citizens continue to languish in jail, with bail being denied to them and with absolutely no signs of any trial beginning. They are no ordinary men and women; they are trade unionists, human rights activists, academics, lawyers, intellectuals and artists. Their crime? To take sides with the poor and the marginalised, to be a voice for the voiceless, to fight for the rights of the Adivasis and Dalits, the women and children, the workers and farmers. They have fought battles in courts; helped organise people to fight for their legitimate rights; consistently exposed the nexus between the politicians and their powerfully rich friends and above all been working for a society which is more just, equitable, free, fraternal and humane. In doing so they have also raised the hackles of the BJP, RSS and their ilk, who obviously have not taken things lightly.

The arrests were preceded by interrogations and investigations; then came the raids! During the raids, the police seized their laptops, mobile phones, pen drives, CDs, documents and apparently

whatever they could lay their hands upon (the tragedy was when they seized Fr Stan’s personal belongings – which consisted of practically nothing! With media posting those photos – the joke actually was on the fascist clowns!). All sixteen of them have been charged under provisions of anti-terror law Unlawful Activities Prevention Act (UAPA) and IPC sections 153 A (promoting enmity between groups), 505 (1)(b) (with intent to cause, or which is likely to cause, fear or alarm to the public).

117 (abetting commission of offence by the public or by more than 10 persons). They have also been charged under Sections 13 (unlawful activities), 16 (terrorist act), 18 (conspiracy), 18B (recruiting of any person or persons for terrorist act) 20 (being a member of a terrorist gang or organization) and 39 (offence relating to support given to terrorist organisation) of the UAPA. All fabricated charges – without the slightest shred of evidence!

Besides, fairly recently the USbased digital forensic analyst in a report has provided significant information of how so-called ‘electronic evidence’ was planted

in the computer of Rona Wilson one of the sixteen!

All these arrests apparently have their ‘roots’ in a mass rally of Dalits, who assemble every year on 1 January in Bhima Koregaon, a small village about 30 km northeast of Pune; the massive rally, which brings together lakhs of Dalits from all over the country, commemorates the historic victory of lower-caste Mahar soldiers in the British army over the Brahmin Peshwa-led Maratha Empire in 1818; and 2018 marked the 200th anniversary of the Bhima Koregaon battle.

In the run-up to the rally, a coalition of 260 non-profit organisations held on 31 December 2017, an event called ‘Elgar Parishad’ at Pune’s Shaniwar Wada. This was the seat of the Peshwai, the Brahmin rulers of the Maratha Empire who rigidly enforced caste discrimination. The Elgar Parishad featured several well-known personalities like politicians Prakash Ambedkar and Jignesh Mewani and Dalit rights activist Radhika Vemula.

The Marathas and some of the

upper castes resented the Dalit gathering and apparently Hindutva leaders like Milind Ekbote, head of the Hindu Ekta Manch, and Sambhaji Bhide, chief of the Shiv Pratishthan Hindustan made provocative, anti-Dalit speeches a few days before the event. Largescale violence broke out in some parts of Maharashtra on 1 and 2 January 2018. On 3 January, police filed cases against Ekbote and Bhide, for allegedly instigating the violence on Dalits. However, while Ekbote was released on bail soon after being arrested in March, Bhide has not yet been arrested, despite a Supreme Court order demanding his arrest. Bhide is close to several of the RSS leaders including PM Modi.

Strangely the tables soon turnedvery obviously with pressure from the ‘higher-ups’: the victims became the perpetrators. In June 2018, five activists (as we mentioned earlier), mainly organisers of the Elgar Parishad were arrested for apparently ‘inciting the violence’ and this was followed by the arrest of eleven others till Fr Stan’s arrest on 8 October 2020 (most of these latter

are not connected with the Elgar Parishad or for that matter with Bhima-Koregaon). These past three years, there is national and even international outrage at this unconstitutional and repressive act by the Government and their henchmen from the National Intelligence Agency (NIA) Civil society from across the board, including intellectuals, academics have these past three years written statements, signed petitions, held press conferences and protest rallies in different parts of the country and the world. On 11 June 2021, hundreds of concerned citizens from all walks of life joined family and friends of the BK-16 in a pathbreaking webinar ‘Campaign Against State Repression”, demanding the immediate release of those incarcerated and the repeal of the UAPA. Writing a powerful op-ed in the Indian Express (10 June 2021) under the title ‘When justice is incarcerated’, wellknown human rights worker and author Harsh Mander says, “three years later, the trial against them has still not commenced. The state

has succeeded in misusing the law — with the complicity of all institutions of criminal justice — to confine behind bars the BK-16 accused, without any opportunity for either bail or to prove their innocence. The flimsy evidence marshalled against the accused rests on some alleged emails, but independent agencies contest that these are malign insertions though malware.

The experience of the BK-16 accused reveals the ease with which it is possible for the executive to smear reputations, and imprison indefinitely without bail or trial, people who dissent and organise struggles against state policies. During the pandemic, when governments globally have decongested prisons, the state has been steadfast in its opposition to bail for these pre-trial political prisoners, even after they displayed worrying signs of life-threatening illness.”

In his article Mander not only voices the plain truth but also the concerns of millions of Indians and others; he also exposes the brutality and the lack of humanity that is

clearly the DNA of a fascist regime that brooks no dissent! Already in 2018, noted historian Ramachandra Guha lashed out at the government over the arrests of activists, calling it a "brutal, authoritarian, oppressive, arbitrary. Illegal act by the Maharashtra police”. Mr. Guha categorically stated, "corporate cronies of the ruling government were bent on grabbing tribal land, forest and mineral resources. This is absolutely chilling. This is being done to not only intimidate and silence those detained but also those who could potentially come to their legal rescue. The courts must intervene to stop this persecution and harassment of independent voices.

Sudha Bharadwaj is as far from violence and illegality as Amit Shah is close to those things. As a biographer of Gandhi, I have no doubt that if the Mahatma was alive today, he would don his lawyer’s robes and defend Bharadwaj in court; that is assuming the Modi Sarkar hadn’t yet detained and arrested him too.”

Going further he said, (those arrested) “are people who represent the country's disenfranchised and the

dispossessed. What is happening in the Adivasi heartland of India... it is murder, rape, physical, natural, social... and these were the lawyers representing the tribals... and their arrest leaves those dispossessed unrepresented in court.”.

In a letter dated 10 June 2021 and addressed to the Prime Minister, the Chief Justice of India and others, as many as fifty-seven top international personalities, including Nobel laureates, academics, human rights defenders, lawyers, cultural personalities, and members of Parliament of European countries, have urged them to ensure immediate release of human rights defenders in India “into safe conditions”. Signatories to the letter include Polish writer Olga Tokarczuk (Nobel Prize for Literature 2018) and Nigerian writer Wole Soyinka (Nobel Prize for Literature 1986), former president of the United Nations Working Group on Arbitrary Detention José Antonio GuevaraBermúdez, and former Archbishop of Canterbury Rowan Williams.

These eminent international personalities have clearly stated in their letter that the Indian government and authorities should show compassion and responsibility in the current COVID- 19 emergency and release them given the spread of the pandemic in Indian prisons. Their constitutional right to live and die in dignity needs to be guaranteed under the present circumstances, given that legal recourse takes a long time and all the arrested are under pre-trial detention, they add.

This appeal follows an initiative of International Solidarity for Academic Freedom in India (Insaf India), a collective of diasporic Indian academics and professionals from around the world, the as well as numerous prominent lawyers and members of parliament from Germany, UK, Spain, Ireland and other countries.

The open letter said, “among the thousands in India arrested for “political offences” is a group known as the Bhima-Koregaon (BK)-16: four academics, three lawyers, two independent journalists, a union organizer and social activist, a poet, three

performing artists, and a Jesuit priest. A majority of them are senior citizens, some of whom have comorbidities that render them particularly vulnerable. All are human rights defenders with a record of writing, speaking, and organizing for the rights of workers, minorities, Dalits, and Adivasis through peaceful and constitutional means”. Their letter ends unequivocally, “with this letter, we call on the Indian authorities to take urgent and prompt action: • Release the BK-16 from overcrowded and unsafe prisons immediately.

• Allow them to be cared for by their kin.

• Show compassion and responsibility in order to avoid catastrophic consequences.

• Ensure them their constitutional right to live and die in dignity”.

The country is going through dark times: every single democratic institution is being systematically dismantled and even destroyed.

Constitutional and other independent authorities, which

were well known for their objectivity and impartiality in the past, have now become caged parrots; this is so obvious be it the case of the Central Bureau of Investigation (CBI), the NIA and for that matter, even the Election Commission. Some of those in the judiciary – have brought a pillar of democracy down to the ground with their totally obnoxious, prejudiced and one-sided judgements. The less said about mainstream media the better: they have lost their morality and become a wholly lapdog one. The ruling regime has thrown all propriety to the wind with their brazen corrupt, communal, insensitive anti-national and unconstitutional ways.

But thank God for the BK-16: Sudhir Dhawale, Surendra Gadling, Mahesh Raut, Shoma Sen Rona Wilson Arun Ferreira, Sudha Bharadwaj, Varavara Rao and Vernon Gonsalves, Anand Teltumbde, Gautam Navlakha, Hanybabu Tarayil, Sagar Gorkhe, Ramesh Gaichor, Jyoti Jagtap and Fr Stan Swamy. The system that has incarcerated them is brutal, rotten and unjust. They suffer

today in jail because they believed in the idea of India, in the Constitution, in the ‘we the people’, in the rights of the excluded and the exploited. They were voices of democracy and of dissent – and because of that, they are paying the price today.

We all need to be eternally grateful for these heroes, these real freedom fighters of today’s India! We who are not yet in prison – are called to be more visible and vocal: to keep the torch which they have given us, burning! The struggle for their immediate freedom, for justice for all and for the complete repeal of the UAPA must continue relentlessly. We cannot be complacent or think that what has happened to the BK-16 does not concern us! Our engagement today may guarantee a more liveable India for future generations. Deep down we know that we will overcome: because JUSTICE and TRUTH always triumph – till then the struggle will continue!

C: 1/2 tsp mustard seeds Few curry leaves 1 tbsp ghee METHOD:

Clean, cut crabs into 2 pieces or as required. Marinate with salt & pinch of turmeric. Keep aside.

Adding amchur powder or raw mango pieces to curry gives awesome taste.

Roast all dry ingredients from A in 1tsp oil. Take it off. Add another tsp oil roast all wet ingredients until soft & golden brown. Keep aside.

Grind all roasted ingredients, including B items into very fine & smooth paste.

Take marinated crabs in big kadai, add very little water & salt to taste.

Cook until done.

Add ground masala to boiled crabs.

Adjust consistency to medium thick.

Simmer well and take it off.

Take small pan, add ghee, once hot add mustard seeds & curry leaves fry until crispy. Pour this top of the prepared crab curry. . Enjoy this curry with hot boiled rice or everyones favourite Mangalore Panpole, Sanna or Appa TIPS: Adjust all ingredients as per your taste & spice control.

Mutton chops with

chickpeas soup

Ingredients : 1) 6 pcs mutton chops 2) 1 cup chana (chickpeas) washed and soaked for minimum 8 hours 3) 1 dry lemon (make few holes with

fork) 4) 1 tomato, finely chopped 5) 1 medium onion, thinly sliced 6) 2-3 cloves garlic, crushed 7) 1 inch cinnamon stick 4-5 cloves 9) 1 tsp pepper corns 10) 1 tsp coarsely ground pepper powder 11) small bunch of spring onions 12) coriander leaves for garnishing 13) 1 tbsp pure ghee 14) salt as per taste Recipe - In a pressure cooker, heat ghee - Add onions and fry till golden brown - Add mutton chops stir well and fry for 2 mins on high flame - Add remaining ingredients (except

Mix well - Add water above the level ( approximately 6 cups) - Cover the lid and cook for 5-6 whistles on medium flame and then switch off flame - Once pressure is released, open the lid and add spring onions. Mix well and cook for 5 mins on medium flame or until full boil

- Switch off flame and transfer soup into soup bowls and garnish with coriander leaves.
